<section id="H7ADB9EA44F234E8D8B00468532E672EE"><enum>2.</enum><header>Definitions</header> 
<subsection id="HA49A3852FD5F4CB0AC67409C75B4D49E" commented="no"><enum>(a)</enum><header>Application of terms</header><text>Unless otherwise specified, the terms in section 44801 of title 49, United States Code, shall apply to this Act.</text></subsection> <subsection id="HC0DCDA5B625A45F4BCACAF3D54CE5832"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="HBA40AAB0E77E4BD4899449F56591BA70"><enum>(1)</enum><header>Appropriate committees of Congress</header><text>The term <quote>appropriate committees of Congress</quote> means—</text> <subparagraph id="H295EAF4AD73E49179EC2AF280C79841C"><enum>(A)</enum><text>the Committee on Homeland Security, the Committee on the Judiciary, and the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H9312F6F14A1D46C1A252ADB683BCB7F9"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on the Judiciary, the Committee on Homeland Security and Governmental Affairs, and the Committee on Commerce, Science, and Transportation of the Senate.</text></subparagraph></paragraph> <paragraph id="H806FE46931F5475EA175A95ECF1B5ED8"><enum>(2)</enum><header>Covered airport</header><text>The term <quote>covered airport</quote> means—</text> 
<subparagraph id="H6D4DE1B8A1B34D9580AC2047E502102B"><enum>(A)</enum><text>a large hub airport (as defined in section 47102 of title 49, United States Code);</text></subparagraph> <subparagraph id="H3948E8233FD94F6CA4427C2C8298A88E"><enum>(B)</enum><text>a medium hub airport (as defined in section 47102 of title 49, United States Code); or</text></subparagraph> 
<subparagraph id="H246AC481B7044F1F89D5797E67B5F182"><enum>(C)</enum><text>an airport with a total annual landed weight of all-cargo of more than 7,500,000,000 pounds in 2021 or any year thereafter.</text></subparagraph></paragraph> <paragraph id="H7C13BD77D2E34981A821EB0A813B3D54"><enum>(3)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means—</text> 
<subparagraph id="H45E09E2E14B34383A7F90A8B98F23272"><enum>(A)</enum><text>the owner or proprietor of a covered site; and</text></subparagraph> <subparagraph id="HF1DFDCAB886D460EAA71BCC8FDA7F4D4"><enum>(B)</enum><text>with respect to a public gathering, the organizing entity of such gathering.</text></subparagraph></paragraph> 
<paragraph id="H980276FBF0C64523BE3EAD8BB22A6AFD"><enum>(4)</enum><header>Covered site</header><text>The term <quote>covered site</quote> means—</text> <subparagraph id="H95751DA15FB7486086E3E85D9FF7A843"><enum>(A)</enum><text display-inline="yes-display-inline">a fixed site facility related to—</text> 
<clause id="H3E400DB2E68640F4B47B1AFC6FF8CB90"><enum>(i)</enum><text display-inline="yes-display-inline">critical infrastructure, such as energy production, transmission, distribution facilities and equipment, and railroad facilities;</text></clause> <clause id="HA7A01587D20E42AFABD13A9F401C6549"><enum>(ii)</enum><text>oil refineries and chemical facilities;</text></clause> 
<clause id="H7CD467A7D9BB4BC1999F3EBE4F1A7979"><enum>(iii)</enum><text>amusement parks; or </text></clause> <clause id="HE74AB1DA25824920BB0BB7747EF2D660"><enum>(iv)</enum><text>State prisons;</text></clause></subparagraph> 
<subparagraph id="H68A7678B24E6473F8B685BB3FDCA2838"><enum>(B)</enum><text display-inline="yes-display-inline">the location of a large public gathering described in section 44812(c) of title 49, United States Code; or</text></subparagraph> <subparagraph id="H846111BF28CF42218D2E2784019B6E8F"><enum>(C)</enum><text>the site with respect to which a flight restriction is maintained pursuant to section 521 of division F of the Consolidated Appropriations Act, 2004 (<external-xref legal-doc="usc" parsable-cite="usc/49/40103">49 U.S.C. 40103</external-xref> note).</text></subparagraph></paragraph></subsection></section> 
<section id="H70394FF4DA1C4C0F92B1AE360B079F40"><enum>3.</enum><header>Protection of certain facilities and assets from unmanned aircraft systems</header><text display-inline="no-display-inline">Section 210G of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n</external-xref>) is amended—</text> <paragraph id="H24DBEA1EDF96460FBD9ECA810235DBB3"><enum>(1)</enum><text>in subsection (a) by striking <quote>(as defined by the Secretary or the Attorney General, in consultation with the Secretary of Transportation)</quote> and inserting <quote>(as defined by the Secretary and the Attorney General, in coordination with the Secretary of Transportation)</quote>;</text></paragraph> 
<paragraph id="HFF7282EC95954192B53DDCEEDFD82F83"><enum>(2)</enum><text>in subsection (b)—</text> <subparagraph id="H9257F01E790940718FB084026403CA1E"><enum>(A)</enum><text>in paragraph (1)—</text> 
<clause id="H72A11D7832FE4F739917625D9EC68F70"><enum>(i)</enum><text>in subparagraph (A) by inserting <quote>or unmanned aircraft</quote> after <quote>During the operation of the unmanned aircraft system</quote>;</text></clause> <clause id="H7380C62B94954F04A532817E2806D58E"><enum>(ii)</enum><text>in subparagraph (D) by striking <quote>Seize or exercise control of</quote> and inserting <quote>Seize, exercise control of, or otherwise confiscate</quote>;</text></clause> 
<clause id="HA6EF7859ED984555860A2CF4DBE7FE6F"><enum>(iii)</enum><text>by striking subparagraph (E); and</text></clause> <clause id="H77A2A5C163704A9C82E681FBE00C4221"><enum>(iv)</enum><text>by redesignating subparagraph (F) as subparagraph (E); and</text></clause></subparagraph> 
<subparagraph id="HC568727FD3F74BE79DB32611B6461553"><enum>(B)</enum><text>by striking paragraphs (2) through (4) and inserting the following:</text> <quoted-block id="HE1A70CB6BD7A44E29EC966B2239DDF13" style="OLC"> <paragraph id="HC85F908B8AB246118321186E4BD69581"><enum>(2)</enum><header>Coordination</header> <subparagraph id="H106F16BB1A784879B22A9568EBC84E46"><enum>(A)</enum><header>In general</header><text>The Secretary and the Attorney General shall coordinate with the Secretary of Transportation in carrying out the actions described in paragraph (1).</text></subparagraph> 
<subparagraph id="HB688DAB460B347BEB544264BEB73DE06"><enum>(B)</enum><header>Determination by Administrator of Federal Aviation Administration</header><text>Before the Secretary and the Attorney General may take or authorize the taking of an action under this section, the Administrator of the Federal Aviation Administration shall determine if such action would result in an adverse impact on aviation safety, civil aviation and aerospace operations, aircraft airworthiness, or the use of the national airspace system. If the Administration determines such action would not result in such an adverse impact, the Secretary and the Attorney General may take or authorize the taking of such action. If the Administrator determines such action would result in such an adverse impact, the Secretary and the Attorney General shall coordinate with the Administrator to take any necessary action to ensure that such an adverse impact can be sufficiently mitigated.</text></subparagraph></paragraph> <paragraph id="H0B0339B05E694D4EA94292D3D8E7BE37"><enum>(3)</enum><header>Research, testing, training, and evaluation</header> <subparagraph id="HF64ECEFB3A26479E83B3766B1BB822E1"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, the Attorney General, and the Secretary of Transportation may conduct research on, testing on, training on, and evaluation of equipment, including electronic equipment, and technology to determine the capability and utility of such equipment or technology for any action described in paragraph (1), including prior to the initial use of such equipment or technology.</text></subparagraph> 
<subparagraph id="HA71BC5658FFF4F5B9D9A324B87CF224B"><enum>(B)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary, the Attorney General, and the Secretary of Transportation shall coordinate activities under this paragraph and mutually share data and results from such activities.</text></subparagraph></paragraph> <paragraph id="H43DAB26F0D32485992476DC3C55CBD6D"><enum>(4)</enum><header>List of authorized equipment and technologies</header> <subparagraph id="H9755604A62D441F4997B978C598A5F6A"><enum>(A)</enum><header>List</header><text>Not later than 1 year after the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>, the Secretary, in coordination with the Attorney General and the Administrator of the Federal Aviation Administration, shall maintain a list of approved makes and models of counter-UAS detection and mitigation systems, equipment, and technology. Such list shall include the following: </text> 
<clause id="H0A0528CDC3EB428AAC34EE73E4629296"><enum>(i)</enum><text>A description of the specific detection or mitigation functions of each such system, equipment, or technology that enable each such system, equipment, or technology to carry out an action described in paragraph (1).</text></clause> <clause id="H7F647A1B8C2742BF939CB179AD9E1FFF"><enum>(ii)</enum><text>Whether each such system, equipment, or technology is authorized for an action described in subparagraph (A), (B), (C), or (D) of paragraph (1).</text></clause> 
<clause id="H3359EA2D736C45EF892302ABF4A2FB69"><enum>(iii)</enum><text display-inline="yes-display-inline">Any conditions or restrictions generally applicable to the use, location, or positioning of each such system, equipment, or technology, including whether and how each such system, equipment, or technology may be suitable for use in terminal airspace.</text></clause></subparagraph> <subparagraph id="H05AA0E775F5B4B9DB42B8FAFE167D2E1"><enum>(B)</enum><header>Impact determination by Administrator</header><text display-inline="yes-display-inline">A counter-UAS detection or mitigation system, equipment, or technology may not be included on the list maintained under subparagraph (A) unless the Administrator of the Federal Aviation Administration makes a written determination that—</text> 
<clause id="HEB1A9A4F91BA4D8A8D425E5ADADCEE33"><enum>(i)</enum> 
<subclause id="HBE47C5078E8442FFBEBF8D38CBBEE590" display-inline="yes-display-inline"><enum>(I)</enum><text>the system, equipment, or technology meets any applicable minimum performance requirements as described in section 44810(e) of title 49, United States Code; and</text></subclause> <subclause id="HA65A461405AA4367B9CEA48C163481AB" indent="up1"><enum>(II)</enum><text>the use of such system, equipment, or technology does not present an adverse impact on aviation safety, civil aviation and aerospace operations, aircraft airworthiness, or the use of the national airspace system; or</text></subclause></clause> 
<clause id="HCF81E835D7ED4103A00918F26F66261E"><enum>(ii)</enum><text>in the event the Administrator identifies such an adverse impact from such system, equipment, or technology, such an adverse impact can be sufficiently mitigated and the mitigation activities are described in the list maintained under subparagraph (A) or in a manner determined by the Administrator.</text></clause></subparagraph> <subparagraph id="HC8F8A37C32924337A498E49EB5247D21"><enum>(C)</enum><header>Spectrum impact consultation</header><text>The Secretary, the Attorney General, and the Administrator of the Federal Aviation Administration shall consult with the Federal Communications Commission or the Administrator of the National Telecommunications and Information Administration, as appropriate, to determine whether the use of a counter-UAS detection or mitigation system, equipment, or technology on the list maintained under subparagraph (A)—</text> 
<clause id="H5297F8A83C9242EE895027CA389E8317"><enum>(i)</enum><text>does not present an adverse impact on civilian telecommunications, communications spectrum, internet technology, or radio communications networks or systems; or</text></clause> <clause id="HB64CEB644E584AB896AAF911A23971CA"><enum>(ii)</enum><text display-inline="yes-display-inline">in the event that such an adverse impact is identified, such impact can be sufficiently mitigated, or the system, equipment, or technology is excluded from the list maintained under subparagraph (A) until such an adverse impact is sufficiently mitigated.</text></clause></subparagraph> 
<subparagraph id="H6DA5970EE17544EC9BD45DA0E412AE3E"><enum>(D)</enum><header>Limitation on inclusion of counter-UAS systems manufactured by certain foreign enterprises</header> 
<clause id="H94716B2656214035BC1C88BEFD5F81E6"><enum>(i)</enum><header>Limitation</header><text>The Secretary may not include on the list maintained under subparagraph (A) a counter-UAS detection and mitigation systems, equipment, and technology, manufactured or developed by a covered manufacturer.</text></clause> <clause id="H0AEAE5069C6840918A53ABDC6321B295"><enum>(ii)</enum><header>International agreements</header><text>This subsection shall be applied in a manner consistent with the obligations of the United States under international agreements in effect as of the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>.</text></clause> 
<clause id="H729C5B96E5A24D068FAD489D715830AB"><enum>(iii)</enum><header>Authorized utilization</header><text>Upon the inclusion of a counter-UAS detection or mitigation system, equipment, or technology on the list maintained under subparagraph (A), the Secretary and the Attorney General may utilize such system, equipment, or technology for any action described in paragraph (1).</text></clause> <clause id="H95B126F2E8A44408820F35D360733F90" commented="no"><enum>(iv)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary of Homeland Security is exempt from the limitation under this subsection if the Secretary determines that the operation or procurement of such system is for the sole purpose of research, evaluation, training, testing, or analysis.</text></clause> 
<clause id="H9833E7BB8D1649A9B8478AFDA41F74C7" commented="no"><enum>(v)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subparagraph:</text> <subclause id="HBA1FD4E762E74BBA8EA9FF6F58244512" commented="no"><enum>(I)</enum><header>Covered manufacturer</header><text display-inline="yes-display-inline">The term <quote>covered manufacturer</quote> means an entity that is owned by, controlled by, is a subsidiary of, or is otherwise related legally or financially to, a person based in a country that—</text> 
<item id="HD9DF6A0C323A4AE6B9EA831D10C3248E" commented="no"><enum>(aa)</enum><text>is identified as a nonmarket economy country (as defined in section 771 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677</external-xref>)) as of the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>;</text></item> <item id="HFA000E318A424863A29B17988102ADFC" commented="no"><enum>(bb)</enum><text>was identified by the United States Trade Representative in the most recent report required under section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a priority foreign country under subsection (a)(2) of such section; and</text></item> 
<item id="HCAC5C2B20BF4443CBEDA7A8FCA707707" commented="no"><enum>(cc)</enum><text>is subject to monitoring by the United States Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></item></subclause> <subclause id="H24499ED34F804AC282A60DCCC2BE5A0E" commented="no"><enum>(II)</enum><header>Otherwise related legally or financially</header><text display-inline="yes-display-inline">The term <quote>otherwise related legally or financially</quote> does not include a minority stake relationship or investment.</text></subclause></clause></subparagraph> 
<subparagraph id="HBB625E6581F64E9F993672BD0184F187"><enum>(E)</enum><header>Rule of construction</header><text>Nothing in this paragraph may be construed to prevent the Secretary, the Attorney General, or the Administrator of the Federal Aviation Administration from exercising any authority to counter unmanned aircraft systems in effect prior to the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H2227069C10DE49F3901AD4C999FBC664"><enum>(3)</enum><text>in subsection (d) by striking paragraph (2) and inserting the following:</text> 
<quoted-block id="HA13DF1014D72402DB76F1EAADEDBE0E8" style="OLC"> 
<paragraph id="H7C8633D3D8474C28A545E028795CC33C"><enum>(2)</enum><header>Coordination</header><text display-inline="yes-display-inline">The Secretary, the Secretary of Transportation, and the Attorney General shall coordinate to develop their respective regulations and guidance under paragraph (1) before issuing any such regulation or guidance.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="HCADF3082F59B4FF09118139C671D8D94"><enum>(4)</enum><text>in subsection (e)—</text> 
<subparagraph id="H3ADDC849F45D4CAA94D70FF8C3589E63"><enum>(A)</enum><text>by striking paragraph (3) and inserting the following:</text> <quoted-block id="HD66F441DBC9C4B0F97B0282A98B0DB9E" style="OLC"> <paragraph id="H5B7C72187910459881E1FAA7A9C828BA"><enum>(3)</enum><text>records of such communications are disposed of immediately following an action described in subsection (b)(1) to mitigate a credible threat referred to in subsection (a), except that if the Secretary or the Attorney General determines that maintenance of such records is necessary to investigate or prosecute a violation of law is required by Federal law or for the purpose of litigation, such records may be maintained for not more than 90 days; </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HAD986DE0B4E3425D8DB1938D0D8E3E92"><enum>(B)</enum><text>in paragraph (4)—</text> <clause id="H6C56F25CB7384F849B546B811CA12027"><enum>(i)</enum><text>in the matter preceding subparagraph (A) by striking <quote>are not disclosed outside the Department of Homeland Security or the Department of Justice unless</quote> and inserting <quote>are not shared outside of personnel of the department in possession of such communications, except if</quote>; and</text></clause> 
<clause id="HB913A8ADC3584CCEBD12F30319C0BEB6"><enum>(ii)</enum><text>in subparagraph (B) by striking <quote>, or any regulatory, statutory, or other enforcement action relating to</quote>;</text></clause></subparagraph></paragraph> <paragraph id="HDA4B30D9497E4B149D52B3DBA0C95B26"><enum>(5)</enum><text>in subsection (f) by striking <quote>within the Department of Homeland Security or the Department of Justice</quote>;</text></paragraph> 
<paragraph id="HE4E0B8A146B54F33B10375B16C516154"><enum>(6)</enum><text>in subsection (g)—</text> <subparagraph id="HEA1667A1635A42809B312004C98067A7"><enum>(A)</enum><text>in paragraph (1) by striking <quote>the Secretary and the Attorney General shall, respectively,</quote> and inserting <quote>the Secretary, the Attorney General, and the Secretary of Transportation shall jointly</quote>;</text></subparagraph> 
<subparagraph id="HE3EBC66ABC9B4F06B3C8487AB5292399"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraphs (2) and (3) and inserting the following:</text> <quoted-block id="H149D50DCAC6A4E5CBF6B36C19FDA8C60" style="OLC"> <paragraph id="HAF769D7D0E9B4A949F2A143B2C0C5EA6"><enum>(2)</enum><header>Content</header><text>Each briefing required under paragraph (1) shall include the following:</text> 
<subparagraph id="H4675DB7EAE274A24A21643C2FD0CD123"><enum>(A)</enum><text>The number of instances and a description of each instance in which actions described in subsection (b)(1) have been taken, including all such instances that—</text> <clause id="H1130A47F786F42199EFDD55212B45FAF"><enum>(i)</enum><text>equipment, system, or technology disrupted the transmission of radio or electronic signals, including and disaggregated by whether any such disruption was minimized;</text></clause> 
<clause id="H52D8F2A29AA54C6D96CD902249D6C514"><enum>(ii)</enum><text>may have resulted in harm, damage, or loss to a person or to private property, including and disaggregated by whether any such harm, damage, or loss was minimized;</text></clause> <clause id="H383F3480099340C198DC9E1CBDBA1AD5"><enum>(iii)</enum><text>resulted in successful seizure, exercise of control, or confiscation under subsection (b)(1)(D); or</text></clause> 
<clause id="H6192DE6AB7674F0CA2157F8C4C846D9D"><enum>(iv)</enum><text>required the use of reasonable force under subsection (b)(1)(E).</text></clause></subparagraph> <subparagraph id="H1557F01987D14676BED05AB6AB88BA7B"><enum>(B)</enum><text>The frequency and nature of instances in which communications were intercepted or acquired during the course of actions described in subsection (b)(1), including the following:</text> 
<clause id="H55AD73E227674787B0371F5C9A1D6D92"><enum>(i)</enum><text>The approximate number and nature of incriminating communications intercepted.</text></clause> <clause id="H2B69F9B417FE4C6D967B69122DBBF62F"><enum>(ii)</enum><text>The approximate number and nature of other communications intercepted.</text></clause></subparagraph> 
<subparagraph id="H1CD5D120DB0946059EA8065ECE603E65"><enum>(C)</enum><text>The total number of instances in which records of communications intercepted or acquired during the course of actions described in subsection (b)(1) were—</text> <clause id="H6AA3AC655A2D427AA47BFCEF6D3646E7"><enum>(i)</enum><text>shared with the Department of Justice or another Federal law enforcement agency, including a list of receiving Federal law enforcement agencies; or</text></clause> 
<clause id="H425822B5205E4349A2F8DAB919945200"><enum>(ii)</enum><text>maintained for more than 90 days.</text></clause></subparagraph> <subparagraph id="HF23AADB5DEA84CA683E5054E1742CB4D"><enum>(D)</enum><text>The number of instances and a description of each instance in which the Secretary, Secretary of Transportation, or the Attorney General have engaged with Federal, State, or local law enforcement agencies to implement the authority under this section, including the number of instances that resulted in a criminal investigation or litigation.</text></subparagraph> 
<subparagraph id="H9851724D8D5240789BD81875B4879B2C"><enum>(E)</enum><text display-inline="yes-display-inline">Information on the on the implementation of paragraphs (3) and (4)(A) of subsection (b), including regarding equipment or technology, including electronic equipment to address emerging trends and changes in unmanned aircraft system or unmanned aircraft system-related security threats.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> <subparagraph id="HDB6FDE105D8345F4A5A7D9743801CD73"><enum>(C)</enum><text>in paragraph (5)—</text> 
<clause id="HFC6DC46E03BC45F6A877BF7585609760"><enum>(i)</enum><text>in the first sentence—</text> <subclause id="H50FC487D7ED54B7582692C2939757FC4" commented="no"><enum>(I)</enum><text>by striking <quote>new technology</quote> and inserting <quote>counter-UAS detection and mitigation system, equipment, or technology approved under subsection (b)(4)</quote>; and</text></subclause>

<paragraph id="HCB19783085F4400883A091ABAD995638"><enum>(1)</enum><text>The information required under subsection (g)(2).</text></paragraph> <paragraph id="H167A6AB15BC44D9CB732761F9482E474"><enum>(2)</enum><text>A description of any guidance, policies, programs, and procedures to mitigate or eliminate any adverse impact of the activities carried out pursuant to this section, or the use of any counter-UAS detection or mitigation system, equipment, or technology, on aviation safety, civil aviation and aerospace operations, aircraft airworthiness, or the use of the national airspace system.</text></paragraph> 
<paragraph id="H8D8BA2203FD54C42A23526CBECCDA3A2"><enum>(3)</enum><text>A description of the guidance, policies, programs, and procedures established to address privacy, civil rights, and civil liberties issues implicated by the activities carried out pursuant to this section.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="HB0811720893D4849ABD66229E8056B3E"><enum>(10)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H27E6835B29A0442993FF93D3E527D664" style="OLC"> 
<subsection id="H499E7434FA704CFA92DDCD9BA9B37BC0"><enum>(m)</enum><header>Counter-UAS system training</header><text display-inline="yes-display-inline">The Attorney General, in coordination with the Secretary of Homeland Security (acting through the Director of the Federal Law Enforcement Training Centers) may—</text> <paragraph id="H50F3EE17351249C9B3EAF6AD8BD8C9E5"><enum>(1)</enum><text>provide training relating to measures to take the actions described in subsection (b)(1); and</text></paragraph> 
<paragraph id="H06B411EFA9FA4A72BBBE204287B4B5AB"><enum>(2)</enum><text>establish or designate 1 or more facilities or training centers for the purpose described in paragraph (1).</text></paragraph></subsection> <subsection id="H690A6A4A6F5442FD9DF2A83EC90AAE7D" commented="no"><enum>(n)</enum><header>Counter-UAS detection and mitigation system operator qualification and training criteria</header> <paragraph id="H89897E89B71445DF81B0F510D4866592" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary and Attorney General, in coordination with the Administrator of the Federal Aviation Administration, shall establish standards for initial and recurring training programs or certifications for individuals seeking to operate counter-UAS detection and mitigation systems, equipment, or technology.</text></paragraph> 
<paragraph id="H9DFA945728A743F5816C33447CEDA1A6" commented="no"><enum>(2)</enum><header>Training criteria</header><text>In carrying out paragraph (1), the Secretary and the Attorney General shall, at a minimum—</text> <subparagraph id="H43C36D9C2DCB41B685E93A9B06B80B28" commented="no"><enum>(A)</enum><text>consider the potential impacts of such systems, equipment, or technology to aviation safety, civil aviation and aerospace operations, aircraft airworthiness, or the civilian use of airspace, and appropriate actions to maintain aviation safety, as determined by the Administrator;</text></subparagraph> 
<subparagraph id="HBEFDCE4EB67D4D00B048C7B5F2401F73" commented="no"><enum>(B)</enum><text>establish interagency coordination requirements prior to deployment of such systems, equipment, or technology; and</text></subparagraph> <subparagraph id="H70C261B7A228451E96AD88A132823897" commented="no"><enum>(C)</enum><text>establish the frequency at which an individual authorized to operate counter-UAS detection and mitigation systems, equipment, or technology shall complete and renew such training or certification.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H4B413BBCA5AB4158831D9FCDC6B32B18"><enum>4.</enum><header>FAA counter-UAS activities</header> 
<subsection id="H3408A3E517BC4309936452673883D8CC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 44810 of title 49, United States Code, is amended to read as follows:</text> <quoted-block id="H589DEA7BBE9F4FC9887C75B7F06EBB92" style="USC"> <section id="HC948F84E0C774E8DB37499D597DC08C8"><enum>44810.</enum><header>Counter-UAS activities</header> <subsection id="HE1346B1F1C384AEB83FCC1920BFB8521"><enum>(a)</enum><header>Authority</header> <paragraph id="H3A669EC766A2429496D9757213ED2470"><enum>(1)</enum><header>In general</header><text>The Administrator of the Federal Aviation Administration may take such actions as described in paragraph (2) that are necessary to—</text> 
<subparagraph id="H2997975305424BEAA1C6B2EF13718B27"><enum>(A)</enum><text>detect or mitigate a credible threat (as defined by the Secretary of Homeland Security and Attorney General, in consultation with the Administrator) that an operation of an unmanned aircraft or an unmanned aircraft system poses to the safe and efficient operation of the national airspace system; or</text></subparagraph> <subparagraph id="H38B5DA1197C942D1911B586AE14406E1"><enum>(B)</enum><text>test or evaluate the potential adverse impacts or interference of a counter-UAS detection or mitigation system, equipment, or technology on or with safe airport operations, aircraft navigation, air traffic services, or the safe and efficient operation of the national airspace system.</text></subparagraph></paragraph> 
<paragraph id="H67C72E52490F46179EA7B4AFEA34B39F"><enum>(2)</enum><header>Authorized actions</header><text>In carrying out paragraph (1), the Administrator may take the following actions:</text> <subparagraph id="HA83E4F3E20EC4E31839BB00490079A41"><enum>(A)</enum><text>Detect, identify, monitor, and track an unmanned aircraft system or unmanned aircraft, without prior consent from the operator of such system or aircraft, including by means of intercept or other access of a wire, oral, or electronic communication used to control the unmanned aircraft system or unmanned aircraft.</text></subparagraph> 
<subparagraph id="H0D106F129005426AB591785F9D5FEDCC"><enum>(B)</enum><text>Contact or warn the operator of an unmanned aircraft system of a potential counter-UAS action authorized under this subsection.</text></subparagraph> <subparagraph id="H4088215E00BD45C5A961F30EF1DB5033"><enum>(C)</enum><text>Seize, exercise control of, or otherwise confiscate an unmanned aircraft system or unmanned aircraft.</text></subparagraph> 
<subparagraph id="H12F5C8A1C65641A3BCF07C5A347A710A"><enum>(D)</enum><text>Disrupt control of, disable, damage, or destroy an unmanned aircraft or unmanned aircraft system, including by means of intercept or other access of a wire, oral, or electronic communication used to control the unmanned aircraft or unmanned aircraft system.</text></subparagraph></paragraph></subsection> <subsection id="HB9461350FFA94456A725D6ACA3206EF9" commented="no"><enum>(b)</enum><header>Applicability of other laws</header> <paragraph id="H8B26BEC4D87A4DE6B09A9DA5126DDE8F" commented="no"><enum>(1)</enum><header>In general</header><text>Section 46502 of this title or sections 32, 1030, and 1367 and chapters 119 and 206 of title 18 shall not apply to activities authorized by the Administrator pursuant to this section.</text></paragraph> 
<paragraph id="HADD30252D91140BCBD1B84FD603CE168" commented="no"><enum>(2)</enum><header>Privacy protection</header><text>In implementing the requirements of this section, the Administrator, in coordination with the Attorney General and Secretary of Homeland Security, shall ensure that—</text> <subparagraph id="H2724F182DF394D0589B9E7124A108678" commented="no"><enum>(A)</enum><text>the interception or acquisition of, or access to, or maintenance or use of, communications to or from an unmanned aircraft system under this section is conducted in a manner consistent with the First and Fourth Amendments to the Constitution of the United States and applicable provisions of Federal law; </text></subparagraph> 
<subparagraph id="HECBBEF8DD105412E94B34D7D81BCC779" commented="no"><enum>(B)</enum><text>communications to or from an unmanned aircraft system are intercepted or acquired only to the extent necessary to support an action as described under subsection (a)(2); </text></subparagraph> <subparagraph id="HBD03FB7E11A6461486C9CB7A2B66735E" commented="no"><enum>(C)</enum><text>records of such communications are disposed of immediately following herein authorized activity to mitigate a credible threat, unless the Administrator, the Secretary of Homeland Security, or the Attorney General determine that maintenance of such records—</text> 
<clause id="HC5790E71F12843E89FA8660B30CD0738"><enum>(i)</enum><text>is necessary to investigate or prosecute a violation of law;</text></clause> <clause id="H213AD77646554343A5095B7AB9B0E623" commented="no"><enum>(ii)</enum><text>would directly support the Department of Defense, a Federal law enforcement agency, or the enforcement activities of a regulatory agency of the Federal Government in connection with a criminal or civil investigation of, or any regulatory, statutory, or other enforcement action relating to an action described in subsection (a)(2);</text></clause> 
<clause id="HEB39B5D10D7F4293ADD55A1479D7AEC0" commented="no"><enum>(iii)</enum><text>is between the Secretary of Homeland Security and the Attorney General in the course of a security or protection operation of either agency or a joint operation of such agencies; or</text></clause> <clause id="HA317F13A1EBE484FB6785A8B95D5BC9A" commented="no"><enum>(iv)</enum><text>is otherwise required by law; and</text></clause></subparagraph> 
<subparagraph id="HC965E117A1284C26AA423FC171B8548F" commented="no"><enum>(D)</enum><text>to the extent necessary, the Secretary of Homeland Security and the Attorney General are authorized to share threat information, which shall not include communications described in this subsection, with State, local, territorial, or tribal law enforcement agencies in the course of a security or protection operation.</text></subparagraph></paragraph></subsection> <subsection id="HC685B7B1C26D49EE9F0943C9D81AB93C"><enum>(c)</enum><header>Office of Counter-UAS Activities</header> <paragraph id="HDD13276205DF46DB91486A416F78EC3C"><enum>(1)</enum><header>In general</header><text>There is established within the Federal Aviation Administration an Office of Counter-UAS Activities for purposes of managing and directing the counter-UAS activities of the Administration.</text></paragraph> 
<paragraph id="HAFF3429CAB694010AEDEF0FD737459BB"><enum>(2)</enum><header>Director</header><text>The Administrator shall designate a Director of Counter-UAS Activities, who shall be the head of the Office.</text></paragraph> <paragraph id="HA9EDFFF862C1408AB622FD5982319BFA"><enum>(3)</enum><header>Duties</header><text>In carrying out the activities described in paragraph (1), the Director shall—</text> 
<subparagraph id="HF79AD34F45F648769BE6B86A946DDFEC"><enum>(A)</enum><text>coordinate with other offices of the Administration to ensure that such activities do not adversely impact aviation safety or the efficiency of the national airspace system;</text></subparagraph> <subparagraph id="HE3A3A6F013E44912B7FE46BD46F367BF"><enum>(B)</enum><text>lead the development and implementation of counter-UAS activity strategic planning within the Federal Aviation Administration; and</text></subparagraph> 
<subparagraph id="HD5DA80F4E3A146BA9B9F1EE710013893"><enum>(C)</enum><text>serve as the Administration’s primary point of contact for coordinating counter-UAS activities, including such activities of—</text> <clause id="H3D170091A70246329A58D3F45A79B2DD"><enum>(i)</enum><text>Federal and State agencies;</text></clause> 
<clause id="H3D376C4AB1C94F8E8AC9C2763CDFD146"><enum>(ii)</enum><text>covered airports; and</text></clause> <clause id="H1EBCDFC7198C45AFA73608593089985D"><enum>(iii)</enum><text>other relevant stakeholders; and</text></clause></subparagraph> 
<subparagraph id="H8802708744AA416E83F37684CD1D35A4"><enum>(D)</enum><text>carry out other such counter-UAS activities as the Administrator may prescribe.</text></subparagraph></paragraph></subsection> <subsection id="HD6736F65C6A24FA3A07EC541FE86EBD1"><enum>(d)</enum><header>Interagency coordination</header> <paragraph id="HEDA42ACA64C4420B8E45165CE5A4381C"><enum>(1)</enum><header>In general</header><text>The Administrator shall coordinate with the Secretary of Homeland Security and the Attorney General to carry out this section, subject to any restrictions of the Secretary or Attorney General’s authority to acquire, deploy, and operate counter-UAS systems, equipment, or technology.</text></paragraph> 
<paragraph id="H8809F1950320483F9666507B60B074BA"><enum>(2)</enum><header>Non-delegation</header><text>Nothing under this section shall permit the Administrator to delegate any authority granted to the Administrator to any other Federal agency. </text></paragraph></subsection> <subsection id="H49D842BDD14A4030B736692480901134" commented="no"><enum>(e)</enum><header>Counter-UAS detection and mitigation system performance requirements</header> <paragraph id="HC9DF71A24A9C44E79A25365084849734" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 270 days after the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>, the Administrator, in coordination with the Secretary and the Attorney General, shall establish minimum performance requirements for the safe and reliable deployment or use of counter-UAS detection and mitigation systems, equipment, and technology within the national airspace system.</text></paragraph> 
<paragraph id="HD2584589904841F48C83697C4EA1836B" commented="no"><enum>(2)</enum><header>Considerations</header> 
<subparagraph id="H6FB46F8189BB4CC08228431B0BA139A5" commented="no"><enum>(A)</enum><header>Aviation safety</header><text>In establishing minimum performance requirements under paragraph (1), the Administrator shall—</text> <clause id="HC603D1F8D00349768AF6CF51C43BCCC7" commented="no"><enum>(i)</enum><text>leverage data collected in testing and evaluation activities conducted under this section and any other relevant testing and evaluation data determined appropriate by the Administrator; </text></clause> 
<clause id="H271618C58B83464F9AB81F770C1A38D7" commented="no"><enum>(ii)</enum><text>determine the extent to which a counter-UAS detection or mitigation system, equipment, or technology can safely operate without disrupting or interfering with the operation of aircraft or other national airspace system users; and</text></clause> <clause id="H35E90FCC0C5444E48073A84599A4D007"><enum>(iii)</enum><text display-inline="yes-display-inline">establish specific requirements for the deployment and use of such systems, equipment, or technology in terminal airspace.</text></clause></subparagraph> 
<subparagraph id="H50C216C0841D424DAD008BB682AC1A8F" commented="no"><enum>(B)</enum><header>Efficacy</header><text>In establishing minimum performance requirements under subsection (a), the Administrator shall consider criteria, as determined by the Secretary of Homeland Security, to determine the degree to which counter-UAS detection and mitigation systems, equipment, or technology reliable and effective in detecting or mitigating unauthorized unmanned aircraft system operations independent of data or information provided by the system manufacturer of such unmanned aircraft system.</text></subparagraph> <subparagraph id="H2D48AABB98F64E5391E96EBAF6A4D008" commented="no"><enum>(C)</enum><header>Other interference</header><text>In establishing minimum performance requirements under subsection (a), the Administrator shall consider criteria, as determined by the Federal Communications Commission, to determine the extent to which counter-UAS detection and mitigation systems, equipment, or technology can be safely operated without disrupting or interfering with the operation of civilian communications and information technology networks and systems, including such networks and systems that rely on radio frequency or cellular network communications links.</text></subparagraph></paragraph> 
<paragraph id="H2351282A3FB14AE788628E4E48BAD1F4" commented="no"><enum>(3)</enum><header>Demonstration</header><text>The Administrator shall develop a standardized process by which a manufacturer or end-user of a counter-UAS detection or mitigation system, equipment, or technology may demonstrate that such system, equipment, or technology meets the requirements established pursuant to paragraph (1), which may include validation by an independent third party.</text></paragraph> <paragraph id="H0EB1A970EC7B47E2A62775ACA8321D57"><enum>(4)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in paragraph (1) shall require the Administrator to conduct a rulemaking in publishing minimum performance requirements under such paragraph.</text></paragraph></subsection> 
<subsection id="H11F63F4B871E4AD4B9267513E0032C69" commented="no"><enum>(f)</enum><header>Counter-UAS system testing, evaluation, and validation</header> 
<paragraph id="H772E714A034D44A8818BE307CE27546C" commented="no"><enum>(1)</enum><header>Evaluation and validation</header><text>The Administrator may conduct such testing, evaluation, and validation of counter-UAS detection and mitigation systems, equipment, and technology as necessary to ensure—</text> <subparagraph id="H2441D5340E2C41A6B342D0C3DE6829D8" commented="no"><enum>(A)</enum><text>such systems, equipment, and technology will not have an adverse impact on the safe and efficient operation of the national airspace system or transportation safety; and</text></subparagraph> 
<subparagraph id="H60C5FFBAA93C4DF69EF64B3B13708662" commented="no"><enum>(B)</enum><text>such systems, equipment, and technology meet minimum performance requirements under subsection (e).</text></subparagraph></paragraph> <paragraph id="H172294652A8E4E82BFA38B78354C183E" commented="no"><enum>(2)</enum><header>Testing and training</header><text>Prior to the commencement of any training or testing of counter-UAS systems, equipment, and technology used for detection or mitigation purposes, an agreement shall be established between the testing or training entity and the Administrator to ensure aviation safety.</text></paragraph> 
<paragraph id="HDD29803792C14830808B40CBD6E0B1B3" commented="no"><enum>(3)</enum><header>Airspace hazard mitigation program</header> 
<subparagraph id="H2492F808A2EC40B9B6341C86CF18F62E" commented="no"><enum>(A)</enum><header>Testing program</header><text>In order to test and evaluate counter-UAS systems, equipment, or technology that detect or mitigate potential aviation safety risks posed by unmanned aircraft, the Administrator shall deploy such systems or technology at 5 airports, as appropriate, and any other location the Administrator determines appropriate.</text></subparagraph> <subparagraph id="HF352A976E6B947DE8377121D67EE41FF" commented="no"><enum>(B)</enum><header>Testing and evaluation</header><text>Notwithstanding section 46502 or sections 32, 1030, 1367 and chapters 119 and 206 of title 18, the Administrator of the Federal Aviation Administration may conduct testing and evaluation of any counter-UAS detection or mitigation system, equipment, or technology to assess potential impacts on, or interference with, safe airport operations, aircraft and air traffic navigation, air traffic services, or the safe and efficient operation of the national airspace system.</text></subparagraph> 
<subparagraph id="H0572318637A04ABA99401DE53189995E"><enum>(C)</enum><header>Coordination</header><text>In carrying out this paragraph, the Administrator shall coordinate with the Secretary of Homeland Security and the head of any other Federal agency that the Administrator considers appropriate.</text></subparagraph></paragraph></subsection> <subsection id="HA9E771FA59004FCAB8A1ECAEA63B3941" commented="no"><enum>(g)</enum><header>Limitations on operation of counter-UAS systems manufactured by certain foreign enterprises</header> <paragraph id="HC9F947CD2A504D4488732270E1ECE2CE" commented="no"><enum>(1)</enum><header>Limitation</header><text>Notwithstanding any other provision of this section, the Administrator may not acquire, deploy, or operate, or authorize the acquisition, deployment, or operation of, a counter-UAS system or any associated elements, including software, manufactured or developed by a covered manufacturer.</text></paragraph> 
<paragraph id="HED0A21C527E64C32B9852D083E2A29B4" commented="no"><enum>(2)</enum><header>International agreements</header><text>This subsection shall be applied in a manner consistent with the obligations of the United States under international agreements in place on the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>.</text></paragraph> <paragraph id="HEACB73AB8234469CA755339CA7065336" commented="no"><enum>(3)</enum><header>Exception</header><text>The Secretary of Transportation is exempt from the limitation under this subsection if the Secretary determines that the operation or procurement of such system supports the safe, secure, or efficient operation of the national airspace system or maintenance of public safety, including activities carried out under the Federal Aviation Administration’s Alliance for System Safety of UAS through Research Excellence Center of Excellence, FAA-authorized unmanned aircraft systems test ranges, and any other testing and evaluation activity deemed to support the safe, secure, or efficient operation of the national airspace system or maintenance of public safety, as determined by the Secretary. </text></paragraph> 
<paragraph id="H7EE4F98EB8944EEFB6C076F054074F29" commented="no"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text> <subparagraph id="H7C75F3842A6C4B72A272C5AA28D868A3" commented="no"><enum>(A)</enum><header>Covered manufacturer</header><text>The term <quote>covered manufacturer</quote> means an entity that is owned by, controlled by, is a subsidiary of, or is otherwise related legally or financially to, a person based in a country that—</text> 
<clause id="H1B941DCC3F3947A68551972F85553114" commented="no"><enum>(i)</enum><text>is identified as a nonmarket economy country (as defined in section 771 of the Tariff Act of 1930 (<external-xref legal-doc="usc" parsable-cite="usc/19/1677">19 U.S.C. 1677</external-xref>)) as of the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>;</text></clause> <clause id="H5DD4C43D96F4420B902E8E7ADD191DBD" commented="no"><enum>(ii)</enum><text>was identified by the United States Trade Representative in the most recent report required by section 182 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2242">19 U.S.C. 2242</external-xref>) as a priority foreign country under subsection (a)(2) of that section; and</text></clause> 
<clause id="H88C44F227E5F419A9E7521AF4FEC9855" commented="no"><enum>(iii)</enum><text>is subject to monitoring by the Trade Representative under section 306 of the Trade Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/19/2416">19 U.S.C. 2416</external-xref>).</text></clause></subparagraph> <subparagraph id="H6F5C215D77744033B695A131C72B8ABD" commented="no"><enum>(B)</enum><header>Otherwise related legally or financially</header><text>The term <quote>otherwise related legally or financially</quote> does not include a minority stake relationship or investment.</text></subparagraph></paragraph></subsection> 
<subsection id="H89D08E8D24DC4723B81F58743F2A1EC8" commented="no"><enum>(h)</enum><header>Briefings</header> 
<paragraph id="HF02177DDB922475187F9ACCF71244ED5" commented="no"><enum>(1)</enum><header>Semiannual briefings and notifications</header> 
<subparagraph id="HB0A9CF6FE70C4B7D82BED384924EFCD3" commented="no"><enum>(A)</enum><header>In general</header><text>The Administrator shall provide the specified committees of Congress a briefing not less than once every 6 months on the activities carried out pursuant to this section.</text></subparagraph> <subparagraph id="H6CC7F10F1A394E36B2307D6056277545" commented="no"><enum>(B)</enum><header>Content</header><text>Each briefing required under this paragraph shall include—</text> 
<clause id="H292D7E00FCE049C29F744DDB44F92FAE" commented="no"><enum>(i)</enum><text>the number of instances and a description of each instance in which actions described in subsection (a)(2) have been taken, including all such instances that—</text> <subclause id="HEE8092DAEBDE464C96233368BE8D0317" commented="no"><enum>(I)</enum><text>equipment, systems, or technology disrupted the transmission of radio or electronic signals, including and disaggregated by whether any such disruption was minimized;</text></subclause> 
<subclause id="H379A6F5AF0EB4008BBF91EDAB91047C3" commented="no"><enum>(II)</enum><text>may have resulted in harm, damage, or loss to a person or to private property, including and disaggregated by whether any such harm, damage, or loss was minimized;</text></subclause> <subclause id="HBCC837351B0C4C2B869FD68B3C0501DC" commented="no"><enum>(III)</enum><text>resulted in the successful seizure, exercise of control, or confiscation under subsection (a)(2); or</text></subclause> 
<subclause id="H2BD63300F409434199B3B82CE6DD4C23" commented="no"><enum>(IV)</enum><text>required the use of reasonable force under subsection (a)(2);</text></subclause></clause> <clause id="HB367388EA811456F87916588805DC945" commented="no"><enum>(ii)</enum><text>the frequency and nature of instances in which communications were intercepted or acquired during the course of actions described in subsection (a)(2), including—</text> 
<subclause id="H70E714BA78C84B469B6F6F5822FA3C76" commented="no"><enum>(I)</enum><text>the approximate number and nature of incriminating communications intercepted;</text></subclause> <subclause id="HA712C7AAEE5749C2B9AE0B13F311BFFF" commented="no"><enum>(II)</enum><text>the approximate number and nature of other communications intercepted; and</text></subclause> 
<subclause id="HBCA3123B44194804BAE4A6805C04E0C1" commented="no"><enum>(III)</enum><text>the total number of instances in which records of communications intercepted or acquired during the course of actions described in subsection (a)(2) were—</text> <item id="H9673002EBAE941F4B1DA44FF14D9D41D" commented="no"><enum>(aa)</enum><text>shared with the Department of Justice or another Federal law enforcement agency, including a list of receiving Federal law enforcement agencies; or</text></item> 
<item id="H92FF8B349653485F90D8DCFFD7D83C04" commented="no"><enum>(bb)</enum><text>maintained for more than 90 days;</text></item></subclause></clause> <clause id="HC1911F1E524245699F5833945BA44287" commented="no"><enum>(iii)</enum><text>the number of instances and a description of each instance in which Administrator of the Federal Aviation Administration has engaged with Federal, State, or local law enforcement agencies to implement the authority under this section, including the number of instances that resulted in a criminal investigation or litigation; and</text></clause> 
<clause id="H487C5CE7D50941F488FACF642C56EC08" commented="no"><enum>(iv)</enum><text>information on the actions carried out under subparagraphs (C) and (D) of subsection (a)(2), including equipment or technology to address emerging trends and changes in unmanned aircraft system or unmanned aircraft system-related security threats.</text></clause></subparagraph> <subparagraph id="H670FE4AD586C4F19AD6AEE2A5CD0F9F9" commented="no"><enum>(C)</enum><header>Classification</header> <clause id="H60F9AE6741C144BA9B3648249C13E8BF" commented="no"><enum>(i)</enum><header>In general</header><text>Each briefing required under this subsection shall be in an unclassified form, but shall be accompanied by an additional classified briefing at the request of the Chair or Ranking Member of any specified committee of Congress.</text></clause> 
<clause id="HE21038AD81244F29950A80EF7B911A3E" commented="no"><enum>(ii)</enum><header>Content of briefings</header><text>Such briefings shall include, at a minimum—</text> <subclause id="HF74D4161FFAB4FBD902EA64B8A8642FE" commented="no"><enum>(I)</enum><text>a description of instances in which an active mitigation action under this section has been taken, including all such instances that may have resulted in harm, damage, or loss to an individual or to private property; and</text></subclause> 
<subclause id="HCB73F50C946741E5BB7FE6CE50D6B9EB" commented="no"><enum>(II)</enum><text>a description of each covered site, including the capabilities of counter-UAS systems used at such sites.</text></subclause></clause></subparagraph></paragraph> <paragraph id="HAC4ABA54644343519DC394DC5A01A500" commented="no"><enum>(2)</enum><header>Notification</header><text>Beginning 180 days after the date of enactment of the <short-title>Counter-UAS Authority Security, Safety, and Reauthorization Act</short-title>, the Administrator shall—</text> 
<subparagraph id="H03818CCD30F54B4A893F0F78AF11B3F5" commented="no"><enum>(A)</enum><text>notify the specified committees of Congress of any newly authorized acquisition, deployment, or operation of a counter-UAS system, equipment or technology under this section not later than 90 days after such newly authorized acquisition, deployment, or operation; and</text></subparagraph> <subparagraph id="H3272A3CB227C41C6B9B08AE053692080" commented="no"><enum>(B)</enum><text>in providing a notification under subparagraph (A), include a description of options considered to mitigate any identified impacts to the national airspace system related to the use of any counter-UAS system, technology, or equipment operated at a covered site, including the minimization of the use of any technology, equipment or system that disrupts the transmission of radio or electronic signals.</text></subparagraph></paragraph></subsection> 
<subsection id="HCFAD0BEBF3BB4606BE20D3A98F729E78" commented="no"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H49C21AA1CFC24F71807A44416606231A" commented="no"><enum>(1)</enum><header>Specified committees of Congress</header><text>The term <quote>specified committees of Congress</quote> means—</text> 
<subparagraph id="HD877E4191CF04E39B84A685AE6C2F9A7"><enum>(A)</enum><text>the Committee on Transportation and Infrastructure, the Committee on Homeland Security, and the Committee on the Judiciary of the House of Representatives; and</text></subparagraph> <subparagraph id="H7E0DD18FCB69444ABF839B7AF40C5ECD"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation, the Committee on Homeland Security and Governmental Affairs, and the Committee on the Judiciary of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H9806813DDC00494090ACA0841B26C008" commented="no"><enum>(2)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means a State, the District of Columbia, and a territory or possession of the United States.</text></paragraph></subsection> <subsection id="H0F5D077DE4AC486E8F89A1FCAF39CE8B"><enum>(j)</enum><header>Sunset</header><text>This section ceases to be effective on October 1, 2029.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1B0BFDC1A3B74D86A2159442B12503E4"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/448">chapter 448</external-xref> of title 49, United States Code, is amended by striking the item relating to section 44810 and inserting the following:</text> <quoted-block id="HB72B9379EC9F45FE91A22E4F310326FE" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">44810. Counter-UAS activities.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H8FE300580F47400BAC3E0C4C6CC9E4F2"><enum>5.</enum><header>Additional limited authority for detection, identification, monitoring, and tracking</header> <subsection id="H460A2C90225D422D9BCC449A6FF20AD2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in coordination with the Administrator of the Federal Aviation Administration and the Attorney General, may authorize the acquisition, deployment, and operation of approved counter-UAS detection systems, equipment or technology intended to be used for the detection of unmanned aircraft systems by a covered entity. </text></subsection> 
<subsection id="H859D3433AD1741C4B9CCBEDB4C3B8BAF"><enum>(b)</enum><header>Required application</header><text display-inline="yes-display-inline"></text> <paragraph id="HAC33683BFA4B46EB80832E0F6DBE8001"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary of Homeland Security, in coordination with the Administrator and the Attorney General, not later than 180 days after the establishment of the list of approved makes and models of counter-UAS detection systems, equipment, and technology, shall establish an application process to authorize the acquisition, deployment, and operation of an approved counter-UAS detection system, equipment, or technology by a Federal, State, local, territorial, or Tribal law enforcement agency, in partnership with a covered entity, at a covered site.</text></paragraph> 
<paragraph id="HA3FB112EA2CB4D87B5A0CC895EBF6C78"><enum>(2)</enum><header>Application requirements</header><text>The application described in paragraph (1) shall contain—</text> <subparagraph id="HC453DFA112634BF983F7A48E54629A85"><enum>(A)</enum><text>a justifiable need (based on a threat posed by an unmanned aircraft or unmanned aircraft system to a covered site) to detect an unmanned aircraft system with an approved counter-UAS detection system, equipment, or technology;</text></subparagraph> 
<subparagraph id="H0E139CAEB0324116BCDF61BC08E88982"><enum>(B)</enum><text>a plan for the acquisition, deployment, and operation of such counter-UAS detection system, equipment, or technology, that shall—</text> <clause id="H6B459917682A43E8B8A0DD3C7CA9CF0E"><enum>(i)</enum><text>be subject to the approval of the Secretary of Homeland Security, the Administrator of the Federal Aviation Administration, and the Attorney General; and</text></clause> 
<clause id="HEA76E9FE81574495AA3440EF11659336"><enum>(ii)</enum><text>include—</text> <subclause id="H9545BE3BC1864B199566D23C399DE40E"><enum>(I)</enum><text>a description of the covered site or sites at which the counter-UAS detection system, equipment, or technology will be deployed and operated;</text></subclause> 
<subclause id="H017027CF0EC24392B87DDE125F7B9845"><enum>(II)</enum><text>a description of the time periods and dates during which the counter-UAS detection system, equipment, or technology will be operated;</text></subclause></clause></subparagraph> <subparagraph id="H52531EE75C904D4F9DFAEBD4E6C7EBFF"><enum>(C)</enum><text>a written agreement between the covered entity and a Federal, State, local, or Tribal law enforcement agency to operate such approved counter-UAS detection system, equipment, or technology at a covered site on behalf of such covered entity;</text></subparagraph> 
<subparagraph id="H1B10740782D742F09D5F2E360A8FEB1C"><enum>(D)</enum><text>proof of completion of initial and recurrent training or certification requirements under section 210G(n) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(n)</external-xref>); and</text></subparagraph> <subparagraph id="H50124294DAFA42AB80E254AB4B6A8B45"><enum>(E)</enum><text>any other requirements the Secretary determines appropriate.</text></subparagraph></paragraph></subsection> 
<subsection id="H43317D1E181247CCA8A3C02A4283388B"><enum>(c)</enum><header>Agreements</header><text>Upon approval of an application required under subsection (b) by the Secretary of Homeland Security, the Secretary shall enter into an agreement with the applicable covered entity to authorize the acquisition, deployment, and operation of an approved counter-UAS detection system, equipment, or technology, that shall specify, at a minimum—</text> <paragraph id="H8337400C577A440EBBDD552D01EA8FAE"><enum>(1)</enum><text>the approved counter-UAS detection system, equipment, or technology to be operated;</text></paragraph> 
<paragraph id="H20BA40DBAFA94E8F82B48AA00376A66A"><enum>(2)</enum><text>the covered site or sites at which the system, equipment, or technology may be operated;</text></paragraph> <paragraph id="H2125A79C23154AB2AC69A5783BA25849"><enum>(3)</enum><text>the time periods, dates, and circumstances during which the counter-UAS detection system, equipment, or technology may be operated; and</text></paragraph> 
<paragraph id="HC9A162A2F605466193E4FDF71DC9EA1A"><enum>(4)</enum><text>any terms and conditions on the deployment and operation of an approved counter-UAS detection system, equipment, or technology the Secretary determines necessary to ensure public safety.</text></paragraph></subsection> <subsection id="H25C52BF0A0AA4F80939B90EF0E95218E"><enum>(d)</enum><header>Revocation</header><text>The Secretary shall revoke the authorization or approval for the deployment and operation of an approved counter-UAS detection system, equipment, or technology pursuant to this section if the Secretary determines that the covered entity has not—</text> 
<paragraph id="HC45C5B0E95D046C4BF61C961EB81D5C0"><enum>(1)</enum><text>maintained an agreement that is acceptable to the Secretary with a Federal, State, local, or Tribal law enforcement agency to operate such approved counter-UAS detection system, equipment, or technology on behalf of the covered entity;</text></paragraph> <paragraph id="HCCF8F34ACFB94DC897FD4F10BAA9ECE6"><enum>(2)</enum><text display-inline="yes-display-inline">complied with the initial and recurrent training or certification requirements under section 210G(n) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(n)</external-xref>); and</text></paragraph> 
<paragraph id="HECEF144C1EB04CA48ABB8B0E7B5DFCB4"><enum>(3)</enum><text>complied with the privacy protections under section 210G(e) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(e)</external-xref>).</text></paragraph></subsection> <subsection id="H64CA171DDE944CE98BE9BC080C2D04E1"><enum>(e)</enum><header>Coordination</header><text>The Secretary shall coordinate with the Administrator of the Federal Aviation Administration and the Attorney General in carrying out the application and agreement processes under this section.</text></subsection> 
<subsection id="H34E0EF51078745D48E663236CEA1E15A"><enum>(f)</enum><header>Applicability of other laws</header><text display-inline="yes-display-inline">Section 46502 of title 49, United States Code, or sections 32, 1030, and 1367 and chapters 119 and 206 of title 18, United States Code, shall not apply to activities authorized by the Secretary under this section or section 6.</text></subsection> <subsection id="H757168F832904D7BA85F0670F68DB581"><enum>(g)</enum><header>Previously acquired counter-UAS systems</header><text>If the Administrator finds that a covered entity acquired and operated a counter-UAS detection system, equipment, or technology prior to the date of enactment of this Act, the Secretary may authorize the use of such system, equipment, or technology if—</text> 
<paragraph id="HE48D3AF9A0CD470BA1D9E10B423E311E"><enum>(1)</enum><text>such system, equipment, or technology meets the minimum performance requirements issued pursuant to section 44810(e) of title 49, United States Code; and</text></paragraph> <paragraph id="HDE32005C7D9847558BAC41FB7AB4E98A"><enum>(2)</enum><text>such covered entity submits an application under subsection (b) and enters into required agreements under subsection (c).</text></paragraph></subsection> 
<subsection id="H0037EB315DAB4DF4B406C1F8B2490D1A"><enum>(h)</enum><header>Audits</header><text>Not later than 18 months after the date of enactment of this Act, and every 18 months thereafter, the inspectors general of the Department of Transportation, the Department of Homeland Security, and the Department of Justice shall conduct a joint audit of the implementation of the requirements of this section, section 6, or section 7.</text></subsection> <subsection id="H89AF129E2D3D4CF5A9F94E9E01E87E62"><enum>(i)</enum><header>Report to Congress</header><text>Not later than 90 days after the date on which the inspectors general complete each audit required under subsection (h), the inspector generals shall submit to the appropriate committees of Congress a report on the findings of such audit and any recommendations related to the administration of this section.</text></subsection> 
<subsection id="H03AB00CE87B84B5EB5ECB37EA5843BEF"><enum>(j)</enum><header>Termination of authority</header><text>The authorities under this section shall terminate on October 1, 2029.</text></subsection> <subsection id="HA226CDE92A7D4F87801619EE8E1F8943"><enum>(k)</enum><header>Savings clause</header> <paragraph id="HEF71E500E98B4069A292A2C12C88A0C3"><enum>(1)</enum><header>Rules of construction</header> <subparagraph id="HDFA9F99244AF44A7BF423D1E957FF8FF" display-inline="no-display-inline"><enum>(A)</enum><header>Safety and efficiency</header><text>Nothing in this section or section 6 shall be construed to limit or restrict the Administrator of the Federal Aviation Administration from ensuring the safety and efficiency of the national airspace system.</text></subparagraph> 
<subparagraph id="H6C6750A0E399484D833D2E40E0508C15"><enum>(B)</enum><header>Preclusion</header><text>Nothing in this section or section 7 shall be construed to preclude a covered entity from acquiring and operating an approved counter-UAS detection system, equipment, or technology without an authorization if the lawful operation of such system, equipment, or technology does not—</text> <clause id="H5439F709ED0F49E4932016F20F20930D"><enum>(i)</enum><text>require the relief provided under subsection (f); and</text></clause> 
<clause id="HB538965CB61D4F77B5FE6FC7C944F9D9"><enum>(ii)</enum><text>adversely impact the safe operation of the national airspace system.</text></clause></subparagraph></paragraph> <paragraph id="H53BBBD1B9E574ED3B458078BE6BD5B03"><enum>(2)</enum><header>Suspension of authority</header> <subparagraph id="H563E98F061D04E0590CA8E14A48A1468"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration, in consultation with the Attorney General, may suspend the authority provided under this section or section 6 if the Administrator—</text> 
<clause id="H5ABE1ECD87B9429887BD7F6D80952F16"><enum>(i)</enum><text>determines that the exercise of such authority threatens the safety or efficiency of the national airspace system; and</text></clause> <clause id="H4A8E35B1B83C456F8D4A9473FB2071A6"><enum>(ii)</enum><text>conveys in writing the determination to the Secretary of Homeland Security.</text></clause></subparagraph> 
<subparagraph id="HDE30682BD92C4B908C07BDD6A56308FA"><enum>(B)</enum><header>Reporting</header><text>The Administrator shall notify the appropriate committees of Congress within 48 hours of suspending the authority provided under this section under subparagraph (A).</text></subparagraph></paragraph></subsection> <subsection id="HD84E573000AC467FA096409239631281"><enum>(l)</enum><header>Approved counter-UAS detection system defined</header><text display-inline="yes-display-inline">In this section, the term <quote>approved counter-UAS detection system</quote> means a counter-UAS detection system approved under section 210G(b)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(b)(4)</external-xref>) and that meets the minimum performance requirements established pursuant to section 44810(e) of title 49, United States Code.</text></subsection></section> 
<section id="H90AE156415314C7BB8991292CFF523A6" display-inline="no-display-inline" section-type="subsequent-section" commented="no"><enum>6.</enum><header>Counter-UAS mitigation law enforcement pilot program</header> 
<subsection id="HF969E872E5334D74AA30D6F705AD25B1" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the availability of appropriations for such purpose, not later than 180 days after the first determination that a counter-UAS system with mitigation capabilities meets the requirements of section 44810(e) of title 49, United States Code, the Secretary of Homeland Security, in coordination with the Attorney General and the Administrator of the Federal Aviation Administration, shall establish a pilot program to assess the efficacy of approved counter-UAS mitigation systems at covered sites and determine the appropriate policies, procedures, and protocols necessary to allow State and covered local law enforcement agencies (in coordination with the Secretary, Attorney General, and Administrator) to acquire, deploy, and operate approved counter-UAS mitigation systems and mitigate unauthorized UAS operations on behalf of covered entities.</text></subsection> <subsection id="H947F9A6815FA41278E2DDCCD2A19D66C" commented="no"><enum>(b)</enum><header>Required application</header> <paragraph id="HF53BF7C87A1F48749C802C3ACD3A9E84" commented="no"><enum>(1)</enum><header>In general</header><text>In carrying out this section, the Secretary of Homeland Security, in coordination with the Attorney General and the Administrator, shall establish an application process to authorize the acquisition, deployment, and operation of an approved counter-UAS mitigation system, equipment, or technology by a State or covered local law enforcement agency, in partnership with a covered entity, at a covered site.</text></paragraph> 
<paragraph id="H3ECAEBA76ED6452F9F45F1EF310EC0D6" commented="no"><enum>(2)</enum><header>Application requirements</header><text>The application described in paragraph (1) shall contain—</text> <subparagraph id="HBEA158AEFA7F4A2FBFFFE92FC6506DA1" commented="no"><enum>(A)</enum><text>a justifiable need (based on a threat posed by an unmanned aircraft or unmanned aircraft system to a covered site) to mitigate an unmanned aircraft system with an approved counter-UAS mitigation system, equipment, or technology;</text></subparagraph> 
<subparagraph id="H310BA76892324B028CF676C2EF0A7549" commented="no"><enum>(B)</enum><text>a plan for the acquisition, deployment, and operation of such counter-UAS mitigation system, equipment, or technology, that shall—</text> <clause id="HBEAFF05EB2B342C789152E308F61D426" commented="no"><enum>(i)</enum><text>be subject to the approval of the Secretary of Homeland Security, the Attorney General, and the Administrator of the Federal Aviation Administration; and</text></clause> 
<clause id="H841B181B35674B14B8B3DC7CF4B0529E" commented="no"><enum>(ii)</enum><text>include—</text> <subclause id="HE4CAF52CBF64477F9FE703870B46A5BE" commented="no"><enum>(I)</enum><text>a description of the covered site or sites at which the counter-UAS mitigation system, equipment, or technology will be deployed and operated; and</text></subclause> 
<subclause id="H872180060F0F495BB254B733F8E8B700" commented="no"><enum>(II)</enum><text>a description of the time periods and dates during which the counter-UAS mitigation system, equipment, or technology will be operated;</text></subclause></clause></subparagraph> <subparagraph id="H5538045AC6E845B3AB92D9E0551D61E3" commented="no"><enum>(C)</enum><text>a written agreement between the covered entity and a State or covered local law enforcement agency to operate such approved counter-UAS mitigation system, equipment, or technology at a covered site on behalf of such covered entity;</text></subparagraph> 
<subparagraph id="HAE33869967F046B29BD98D2A2D115907" commented="no"><enum>(D)</enum><text>proof of completion of initial and recurrent training or certification requirements under section 210G(n) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(n)</external-xref>);</text></subparagraph> <subparagraph id="H01A86A4130234789AF5D4E2D2726DB13"><enum>(E)</enum><text display-inline="yes-display-inline">proof that the airspace above such covered site is restricted by a temporary flight restriction, a determination under section 2209 of the FAA Extension, Safety, and Security Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/49/44802">49 U.S.C. 44802</external-xref> note), or any other similar restriction determined appropriate by the Secretary; and </text></subparagraph> 
<subparagraph id="H890DE4AD85684B1CA66A05D27795F20B" commented="no"><enum>(F)</enum><text>any other requirements the Secretary determines appropriate.</text></subparagraph></paragraph></subsection> <subsection id="H722B032F304C49D8861A0473EEC42AC8" commented="no"><enum>(c)</enum><header>Agreements</header><text>Upon approval of an application required under subsection (b) by the Secretary of Homeland Security, the Secretary shall enter into an agreement with the applicable covered entity and State or covered local law enforcement agency to authorize the acquisition, deployment, operation of an approved counter-UAS mitigation system, equipment, or technology, that shall specify, at a minimum—</text> 
<paragraph id="H75D6B60E90D84BE79329C7A6D8234FA3" commented="no"><enum>(1)</enum><text>the approved counter-UAS mitigation system, equipment, or technology to be operated;</text></paragraph> <paragraph id="H86BD7CC89E234CB1A8E700B8045870F6" commented="no"><enum>(2)</enum><text>the covered site or sites at which the system, equipment, or technology may be operated;</text></paragraph> 
<paragraph id="H158FF597837F47CCBA4ED1490FA6FB94" commented="no"><enum>(3)</enum><text>the time periods, dates, and circumstances during which the counter-UAS mitigation system, equipment, or technology may be operated; </text></paragraph> <paragraph id="H335D9C3A13824A0F9844FBA672CE17C0" commented="no"><enum>(4)</enum><text>any terms and conditions on the deployment and operation of an approved counter-UAS mitigation system, equipment, or technology the Secretary determines necessary to ensure public safety;</text></paragraph> 
<paragraph id="H8EA51385E2EA430693B488DC36BE1DAB"><enum>(5)</enum><text display-inline="yes-display-inline">the frequency with which the appropriate Federal agency representatives shall conduct periodic site visits to ensure compliance with the approved terms and conditions of deployment and operations of the approved counter-UAS mitigation system, equipment, or technology;</text></paragraph> <paragraph id="HBC49595CA3DC4CEA8C3E0C1C229A140D"><enum>(6)</enum><text display-inline="yes-display-inline">the required Federal coordination prior to the mitigation of an unmanned aircraft system by a State or covered local law enforcement agency described in subsection (d)(1); and</text></paragraph> 
<paragraph id="HC7BC09B9AC7842B8B269BAE84004A316"><enum>(7)</enum><text display-inline="yes-display-inline">the post-event reporting requirements specified in subsection (d)(3).</text></paragraph></subsection> <subsection id="H514BB41CB86547C8A19BBE5D023B70B5"><enum>(d)</enum><header>Required coordination and notification</header> <paragraph id="H60F984B4533848C6B3E71F2CB3EDE926"><enum>(1)</enum><header>In general</header><text>Until the date that is 270 days after the initial deployment of an authorized counter-UAS system, equipment, or technology, the Secretary of Homeland Security shall expressly approve, on a case-by-case basis, the mitigation of unmanned aircraft system by a State or covered local law enforcement agency under this section.</text></paragraph> 
<paragraph id="HA5008010C1724FA0BEA52F376941E331"><enum>(2)</enum><header>Verification and notification</header><text>In carrying out paragraph (1), the Secretary of Homeland Security shall—</text> <subparagraph id="H1BE74E9B16464E0D878CBF6A4616791D"><enum>(A)</enum><text>verify that there is a justifiable threat that warrants the use of such counter-UAS system, equipment, or technology; </text></subparagraph> 
<subparagraph id="H394B7DEDC00E4A0A92F8DAF8A22678EE"><enum>(B)</enum><text>verify that the use of such counter-UAS system, equipment, or technology will—</text> <clause id="H452EDBBF73AC453B9E22B8FB7E1CDE77"><enum>(i)</enum><text>be conducted in a manner consistent with the agreement between the Secretary and the State or covered local law enforcement agency; and</text></clause> 
<clause id="H8221C867C16F418FA2F2425AC3879596"><enum>(ii)</enum><text>abide by all safety protocols, terms, and conditions established for the use of such system, equipment, or technology at the covered site; and</text></clause></subparagraph> <subparagraph id="H7323E1BAEFB144F287A4F7BEF6210929"><enum>(C)</enum><text>immediately notify the Administrator of the Federal Aviation Administration of the approval provided under this paragraph.</text></subparagraph></paragraph> 
<paragraph id="HC52344AF4E9A40B19F1C0B7127938DB0"><enum>(3)</enum><header>Report</header> 
<subparagraph id="H13441B5A2DD54C89B8888EBCDDC9B9CC"><enum>(A)</enum><header>In general</header><text>Not later than 24 hours after each mitigation of a UAS conducted under the authorities in this section, the relevant State or covered local law enforcement agency shall submit to the Secretary of Homeland Security, the Administrator of the Federal Aviation Administration, and the Attorney General a post-event report.</text></subparagraph> <subparagraph id="HCA10336DF7934D3CADE0483A8505889F"><enum>(B)</enum><header>Contents</header><text>The report under subparagraph (A) shall include all relevant information pertaining to the event, including the drone operation, and subsequent mitigation and enforcement actions, and subsequent enforcement actions, as specified by the Secretary.</text></subparagraph></paragraph></subsection> 
<subsection id="H0C959DD5DE874576A38F80462F87F55E" commented="no"><enum>(e)</enum><header>Revocation</header><text>The Secretary shall revoke the authorization or approval for the deployment and operation of an approved counter-UAS mitigation system, equipment, or technology pursuant to this section if the Secretary determines that the covered entity has not—</text> <paragraph id="HFCB977185B7F4D0FA1B78114959C2346" commented="no"><enum>(1)</enum><text>maintained an agreement that is acceptable to the Secretary with a State or covered local law enforcement agency to operate such approved counter-UAS mitigation system, equipment, or technology on behalf of the covered entity;</text></paragraph> 
<paragraph id="H263379C5B1F447C8BD4E3C2E7952CED8" commented="no"><enum>(2)</enum><text>complied with the initial and recurrent training or certification requirements under section 210G(n) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(n)</external-xref>); and</text></paragraph> <paragraph id="HFD75EC30DB524866BB7F78684A59F27E" commented="no"><enum>(3)</enum><text>complied with the privacy protections under section 210G(e) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(e)</external-xref>).</text></paragraph></subsection> 
<subsection id="HAE387A3CDB5F4EE4B6281143EFEA5DAA" commented="no"><enum>(f)</enum><header>Coordination</header><text>The Secretary shall coordinate with the Administrator of the Federal Aviation Administration and the Attorney General in carrying out the application, agreement, and revocation processes under this section.</text></subsection> <subsection id="HF31A1E3C41FF4797A9CA76191BC322C7" commented="no"><enum>(g)</enum><header>Selection criteria</header> <paragraph id="H90968DDCB2B5411C9BD0739F785CAA25" commented="no"><enum>(1)</enum><header>Airspace considerations</header><text display-inline="yes-display-inline"></text> 
<subparagraph id="H665D5933F93E44EEAC5AFD6985669C6F" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Federal Aviation Administration, in coordination with the Secretary of Homeland Security and the Attorney General, shall make a site-specific determination for each covered site selected under the pilot program established under this section to ensure that any potential use of counter-UAS mitigation systems, equipment, or technology at the covered site will not adversely impact the safe operation of the national airspace system, including any airport that is located near the covered site.</text></subparagraph> <subparagraph id="H3EF3EA6FD6AC4C21985359BD53F9E77A" commented="no"><enum>(B)</enum><header>Ineligibility for participation</header><text>If an adverse impact is identified under subparagraph (A) and cannot be safely mitigated to the satisfaction of the Administrator, the covered site is not eligible for participation in the pilot program established under this section.</text></subparagraph></paragraph> 
<paragraph id="HCFE3AB1F842040B89B7F21869837C127"><enum>(2)</enum><header>Program size, review, and expansion</header> 
<subparagraph id="HD8BEE14F11344B3C88B89F7EE2F83179" display-inline="no-display-inline"><enum>(A)</enum><header>Initial size</header><text>The program established under subsection (a) may include not more than 5 State or covered local law enforcement agencies.</text></subparagraph> <subparagraph id="HCF5493136CA7449CABD23592FE71FB44"><enum>(B)</enum><header>Restriction</header><text>No State or covered local law enforcement agency participating in the pilot program established under subsection (a) may operate approved counter-UAS mitigation systems, equipment, or technology at more than 4 covered sites.</text></subparagraph> 
<subparagraph id="HDBFFCB03FA3A44EABFD437235FD34EA3"><enum>(C)</enum><header>Review and expansion</header><text display-inline="yes-display-inline">Not later than 18 months after approved counter-UAS mitigation systems, equipment, or technology are deployed for use by State or covered local law enforcement agencies participating in the pilot program established under subsection (a), the Secretary, in coordination with the Administrator and the Attorney General, shall review the preliminary results of such pilot program and, if appropriate, take such actions as may be necessary to revise or expand, subject to the availability of trained personnel, the number of law enforcement agencies permitted to participate in the program by 10. </text></subparagraph></paragraph> <paragraph id="H7F5524377DD142598DFF154D7456346B" commented="no"><enum>(3)</enum><header>Review and expansion</header><text>Not later than 3 years after approved counter-UAS mitigation systems, equipment, or technology are deployed at the 5 covered sites selected under subsection (a), the Secretary, in coordination with the Administrator and the Attorney General, shall review the preliminary results of such pilot program and, if appropriate, take such actions as may be necessary to revise or expand counter-UAS system mitigation authorities, subject to the availability of trained personnel, to not more than 20 covered sites under the pilot program. </text></paragraph></subsection> 
<subsection id="H16314DC754994FB3A4401802F122AF64" commented="no"><enum>(h)</enum><header>Required briefing</header><text display-inline="yes-display-inline">Not later than 6 months after the establishment of the pilot program under this section, and every 6 months thereafter, the Secretary shall brief the appropriate committees of Congress on the progress and findings of the pilot program established under this section, including a description of all mitigation events reported under subsection (d).</text></subsection> <subsection id="H7816B5F542374285B1ADE4600389EAEB" commented="no"><enum>(i)</enum><header>Sunset</header><text>The authority under this section shall terminate on October 1, 2029.</text></subsection> 
<subsection id="HE28D45668A324BD0A43F50A135924EEC" commented="no"><enum>(j)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H2DF758CABFEA4A25BBEFA82A7B73AF2C"><enum>(1)</enum><header>Approved counter-UAS detection system</header><text>The term <quote>approved counter-UAS detection system</quote> means a counter-UAS detection system approved under section 210G(b)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(b)(4)</external-xref>) and that meets the minimum performance requirements established pursuant to section 44810(e) of title 49, United States Code.</text></paragraph> 
<paragraph id="H49A072EB77E94049B070F2F3A5561E67"><enum>(2)</enum><header>Covered local law enforcement agency</header><text display-inline="yes-display-inline">The term <quote>covered local law enforcement agency</quote> means a local law enforcement agency that has jurisdiction over an area containing a population of at least 650,000 people.</text></paragraph></subsection></section> <section id="HD1FDABBC437D42C893A7358E2FD2F190"><enum>7.</enum><header>Counter-UAS system planning and deployment at airports</header> <subsection id="HAFD89FC207D4440B82C4D332F5978C69"><enum>(a)</enum><header>Strategic airport planning</header> <paragraph id="H5C542263744F48F2B38384BE5E8B02E0"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the Federal Aviation Administration, in coordination with the Secretary of Homeland Security and the Attorney General, shall develop a plan for operations at covered airports of counter-UAS detection and mitigation systems, equipment, or technology that meet the performance requirements described in section 44810(e) of title 49, United States Code, for purposes of—</text> 
<subparagraph id="HAD3C6CADA47F4398A2C25A834429D9B8"><enum>(A)</enum><text>ensuring the safety and security of aircraft; and</text></subparagraph> <subparagraph id="H2420299F80CD4CF18DD1E2D046C38C4D"><enum>(B)</enum><text>responding to a persistent disruption of air traffic operations caused by unmanned aircraft system activity.</text></subparagraph></paragraph> 
<paragraph id="H9994B449B8B6406B87CC4ABBF48B4165"><enum>(2)</enum><header>Contents</header><text>The plan required under paragraph (1) shall consider, at a minimum—</text> <subparagraph id="H5AC446759E444176A7754729676DEC66"><enum>(A)</enum><text>the roles and responsibilities of—</text> 
<clause id="H9391A3F1F0A34FB083ADD30971961AC8"><enum>(i)</enum><text>Federal agency personnel, including air traffic control personnel and Federal Air Marshal resources;</text></clause> <clause id="H370C275918FD4273A562A31825885D53"><enum>(ii)</enum><text>relevant airport personnel; and</text></clause> 
<clause id="H9225F95D5C124027A08BDD87E42FF04A"><enum>(iii)</enum><text>any other stakeholder the Administrator determines appropriate in the terminal airspace;</text></clause></subparagraph> <subparagraph id="H841989C665774D3684066869D6BA8213"><enum>(B)</enum><text>operational procedures, protocols, policies, and guidelines pertaining to the deployment of such systems, equipment, or technology;</text></subparagraph> 
<subparagraph id="HE1276612EAAF48849A38EAC21E69E8BD"><enum>(C)</enum><text>minimum performance requirements for such systems, equipment, or technology;</text></subparagraph> <subparagraph id="H3A318E394B5F4D6C8DDBDCB1F0BDA3D9"><enum>(D)</enum><text>funding responsibilities and mechanisms for the acquisition, deployment, and operation of such systems, equipment or technology;</text></subparagraph> 
<subparagraph id="H564FB6F5868346D6801B8C0C4BA086D3"><enum>(E)</enum><text>the operational approval process by which such systems, equipment or technology may be deployed;</text></subparagraph> <subparagraph id="H55FD83126C5D495F8E626ACE3E3EC863"><enum>(F)</enum><text>reporting requirements associated with the use of such systems, equipment, or technology;</text></subparagraph> 
<subparagraph id="HC3A65B4194CF45909063DC45F42F4094"><enum>(G)</enum><text>initial operator training and recurrent training requirements;</text></subparagraph> <subparagraph id="H4714CBC20D2E4047AF020A1EBA1A3662"><enum>(H)</enum><text>how the remote identification of unmanned aircraft systems can be leveraged for the operation of counter-UAS systems, equipment or technology; and</text></subparagraph> 
<subparagraph id="HAE53A84F4B3140BCB495958B3FD90695"><enum>(I)</enum><text>any other content as determined necessary by the Administrator, the Secretary, and the Attorney General.</text></subparagraph></paragraph> <paragraph id="H73683FC357AC446EAB5D1864B17BB331"><enum>(3)</enum><header>Coordination</header><text>In developing the plan described in paragraph (1), the Administrator—</text> 
<subparagraph id="H860C138017824BC4B6164D766703C075"><enum>(A)</enum><text>shall coordinate with the Secretary of Homeland Security and the Attorney General to consider, and if determined appropriate by the Administrator, include requirements and procedures for—</text> <clause id="H74953AE7E8FA4C8AA7A8A2ABCADDF41D"><enum>(i)</enum><text>conducting and updating airport-specific vulnerability assessments;</text></clause> 
<clause id="HDDE1E6A5DA574069B6228D9BEE0F50C6"><enum>(ii)</enum><text>developing airport-specific coordination and communication requirements with Federal agencies, local law enforcement, and airport personnel appropriate for the scope of such plan;</text></clause> <clause id="H89D4B5F48DF745399F545D80F04F8980"><enum>(iii)</enum><text>tactical response and status reporting during events within the scope of such plan; and</text></clause> 
<clause id="H1F13296EEF394CA9A8527FEE05356BDE"><enum>(iv)</enum><text>acquisition and deployment of counter-UAS systems, equipment, or technology within the scope of such plan; and</text></clause></subparagraph> <subparagraph id="HB734EE0FEB53410780E319119ABC94F6"><enum>(B)</enum><text display-inline="yes-display-inline">shall consult with airport and law enforcement stakeholders, including the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, as appropriate.</text></subparagraph></paragraph> 
<paragraph id="HC0FB8D228DF34195843DADE5B7E1FEBE"><enum>(4)</enum><header>Periodic update</header><text>In carrying out this subsection, the Administrator shall review and update such plan not less than annually.</text></paragraph></subsection> <subsection id="H6CEE126A6D574BF8B93686F85D8B3D78"><enum>(b)</enum><header>Counter-UAS detection systems at airports</header> <paragraph id="H9C71E7C69B2F40C28131DFC922037994"><enum>(1)</enum><header>In general</header><text>Pursuant to the plan required in subsection (a) and subject to available appropriations, the Administrator, in coordination with the Secretary of Homeland Security, the Attorney General, and other relevant Federal agencies, shall provide for the deployment of approved counter-UAS detection systems, equipment, or technology within the terminal airspace of—</text> 
<subparagraph id="HA96695F2FEC1415A9861994A138DC2CF"><enum>(A)</enum><text display-inline="yes-display-inline">each large hub airport (as defined in section 47102 of title 49, United States Code), not later than 30 months after the publication of the performance requirements described in section 44810(e) of title 49, United States Code;</text></subparagraph> <subparagraph id="H6FC36000DD78467E9649263A5B28C13F"><enum>(B)</enum><text>a minimum of 3 airports that each have a total annual landed weight of all-cargo of more than 7,500,000,000 pounds in 2021 or any year thereafter, not later than 12 months after the publication of the guidance described in subsection (a); and</text></subparagraph> 
<subparagraph id="H4A9FA4802DCC4996B9A8841AA3A028D6"><enum>(C)</enum><text display-inline="yes-display-inline">each medium hub airport (as defined in section 47102 of title 49, United States Code), not later than 4 years after the publication of the performance requirements described in section 44810(e) of title 49, United States Code.</text></subparagraph></paragraph> <paragraph id="HBC028D999AA74AC2BE8A8123B4F5E312"><enum>(2)</enum><header>Pre-deployment activities</header><text>The Administrator of the Federal Aviation Administration, in consultation with the Federal Communications Commission, the National Telecommunications and Information Administration, and other Federal agencies as appropriate, shall conduct site-specific spectrum and suitability assessments for each selected airport under the program, based on the specific counter-UAS detection systems, equipment, or technology intended to be deployed.</text></paragraph></subsection> 
<subsection id="HC53AE33BC99D4D9F87265489DBFE758D"><enum>(c)</enum><header>Counter-UAS mitigation at airports</header> 
<paragraph id="HE33D0980B9E146998048DCC976D57DB2"><enum>(1)</enum><header>Establishment</header><text>Pursuant to the plan required in subsection (a), the Secretary of Homeland Security, jointly with the Administrator of the Federal Aviation Administration and in coordination with the Attorney General, shall, subject to the availability of appropriations, establish a pilot program to assess the feasibility of deploying approved counter-UAS mitigation systems, equipment, and technology capable of mitigating unmanned aircraft and unmanned aircraft systems for purposes of responding to a persistent disruption of air traffic operations caused by unauthorized unmanned aircraft system activity.</text></paragraph> <paragraph id="HF465D69EAF54424383E6C24DAB2B724F"><enum>(2)</enum><header>Deployment of counter-UAS mitigation systems</header><text>The pilot program shall include deployment of approved counter-UAS mitigation systems, equipment, or technology at up to 5 covered airports not later than 2 years after the publication of the performance requirements described in section 44810(e) of title 49, United States Code.</text></paragraph> 
<paragraph id="HAC812D5F6CFB49DEBFE6175512ED150F"><enum>(3)</enum><header>Selection</header><text>The Administrator shall provide the Secretary of Homeland Security a list of covered airports eligible for inclusion in the pilot program, based on the suitability of each such airport for counter-UAS system, equipment, or technology deployment.</text></paragraph> <paragraph id="H8579005D7D654A7DB0D2FC8CE57142C6"><enum>(4)</enum><header>Pre-deployment activities</header><text>The Administrator shall, in consultation with the Federal Communications Commission, the National Telecommunications and Information Administration, and other Federal agencies as appropriate, conduct site-specific spectrum and suitability assessments for each selected airport under the program, based on the specific counter-UAS mitigation systems, equipment, or technology to be deployed, prior to the operation of such systems at each selected airport.</text></paragraph> 
<paragraph id="HECDEC3840FCE43FC9BD202D9D4FD7593"><enum>(5)</enum><header>Limitations on mitigation activities</header> 
<subparagraph id="H8ECB4E03B17845CD8AD24F81B19C4BD9"><enum>(A)</enum><header>Authorization of mitigation</header><text>No activity to mitigate the operation of an unmanned aircraft or unmanned aircraft system under the pilot program may be carried out without authorization from both the Secretary of Homeland Security and the Administrator.</text></subparagraph> <subparagraph id="HBF95241C9E574349891B0D9301FC435E"><enum>(B)</enum><header>Emergency, temporary deployment</header><text>The Secretary of Homeland Security or the Administrator, may, on a case-by-case basis, authorize an emergency, temporary deployment and operation of systems, equipment, or technology capable of mitigating unmanned aircraft and unmanned aircraft systems to a public airport (as defined under section 47102 of title 49, United States Code) not participating in the pilot program for purposes of responding to a persistent disruption of air traffic operations caused by unauthorized unmanned aircraft system activity.</text></subparagraph></paragraph></subsection> 
<subsection id="H70422454D1464C90A10FAA3952F1577E"><enum>(d)</enum><header>Site specific planning</header> 
<paragraph id="H4C09B38C433B4032975994A48C464B56"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Prior to the deployment and operation of a counter-UAS detection or mitigation system, equipment, or technology at an airport as described in subsection (b) and paragraph (1) of subsection (c), the Secretary and the Administrator shall coordinate with airport personnel, including the exclusive bargaining representative of air traffic controllers certified under section 7111 of title 5, United States Code, State law enforcement, and other relevant stakeholders to develop a site-specific plan for the use of counter-UAS detection and mitigation systems, equipment, or technology at such airport.</text></paragraph> <paragraph id="HADEC50DA5C134002BBFE26B8E6DD2A41"><enum>(2)</enum><header>Responsibilities</header><text>A plan required under paragraph (1) shall include—</text> 
<subparagraph id="HD114D256F6794830BEC0C628708247CE"><enum>(A)</enum><text>roles and responsibilities of—</text> <clause id="HEE0FBD154BBA49B4B581F15BEF4571ED"><enum>(i)</enum><text>Federal agency personnel, including air traffic control personnel;</text></clause> 
<clause id="H14D6D66CE3E24C2E8EF22DADA7B39A51"><enum>(ii)</enum><text>airport law enforcement and security personnel;</text></clause> <clause id="H0421FBE08EBD416F91ABC2F82DF4A78D"><enum>(iii)</enum><text>State law enforcement personnel;</text></clause> 
<clause id="H8163F0ED5495414FBBD9AE8391920A3C"><enum>(iv)</enum><text>other relevant airport personnel, as determined by the Secretary and the Administrator; and</text></clause> <clause id="HC50B12DAD20F403481C4D81FCD4CE1E8"><enum>(v)</enum><text>any other stakeholder in a terminal airspace the Secretary and Administrator determine appropriate;</text></clause></subparagraph> 
<subparagraph id="HAE35E9B7BAE4435EB7AC21A89D3D06AA"><enum>(B)</enum><text>operational procedures, protocols, policies, and guidelines pertaining to the deployment, use, and maintenance of such systems, equipment, or technology;</text></subparagraph> <subparagraph id="H83B2F217B3AC471D85FE4F8690B0207B"><enum>(C)</enum><text>the operational approval process by which such systems, equipment, or technology may be actively deployed and operated;</text></subparagraph> 
<subparagraph id="H3E95324547E84BA99ADBAD7EBDF52D1C"><enum>(D)</enum><text>reporting requirements associated with the use of such systems, equipment, or technology;</text></subparagraph> <subparagraph id="H09AD50DC45CA4CC98F738FE622AC6C55"><enum>(E)</enum><text>initial and recurring counter-UAS operator training requirements;</text></subparagraph> 
<subparagraph id="HEB25EAB0C86D4100A3E0869E24656E66"><enum>(F)</enum><text>appropriate consideration of, and updates to, counter-UAS emergency response plans for an airport; and</text></subparagraph> <subparagraph id="H657DA4FBFAD54C1EB2B524DD0DFA4786"><enum>(G)</enum><text>any other content as determined necessary by the Secretary and the Administrator.</text></subparagraph></paragraph></subsection> 
<subsection id="H0E35ED76449D456CBEDEB5B3E0FA333F"><enum>(e)</enum><header>Restriction</header><text display-inline="yes-display-inline">No Federal agency may require an airport operator to procure, acquire, deploy, or operate an approved counter-UAS detection system, equipment, or technology, or approved counter-UAS mitigation system, equipment, or technology for or on behalf of the Federal agency.</text></subsection> <subsection id="HDBC8EA0EDFA9444A81352A914D13AD26"><enum>(f)</enum><header>Previously acquired counter-UAS systems</header><text display-inline="yes-display-inline">If the Administrator finds that an airport acquired and operated a counter-UAS detection system, equipment, or technology prior to the date of enactment of this Act, the Administrator may authorize the use of such system, equipment, or technology under this subsection if—</text> 
<paragraph id="H7B1060CAF7964165B228273D6347F2A5"><enum>(1)</enum><text display-inline="yes-display-inline">such system, equipment, or technology meets the minimum performance requirements issued pursuant to section 44810(e) of title 49, United States Code; and</text></paragraph> <paragraph id="H25F699EBAFD745B2820E7BDE486A2B01"><enum>(2)</enum><text display-inline="yes-display-inline">such airport agrees to such terms and conditions as the Administrator may prescribe under this subsection.</text></paragraph></subsection> 
<subsection id="HA2B7E1E7DFC34BE784C8AA7F2421B692"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H0C38794480A9437F949F712200F4C65F"><enum>(1)</enum><header>Approved counter-UAS detection system defined</header><text>The term <quote>approved counter-UAS detection system</quote> means a system approved under section 210G(b)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(b)(4)</external-xref>) and that meets the minimum performance requirements established pursuant to section 44810(e) of title 49, United States Code.</text></paragraph> 
<paragraph id="HFE6AE3F5A15149C995720ECE09B9CBDD"><enum>(2)</enum><header>Approved counter-UAS mitigation system defined</header><text>The term <quote>approved counter-UAS mitigation system</quote> means a system approved under section 210G(b)(4) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/124n">6 U.S.C. 124n(b)(4)</external-xref>) and that meets the minimum performance requirements established pursuant to section 44810(e) of title 49, United States Code.</text></paragraph></subsection></section> <section id="H1D72381021F0437483CCE0D4B027737D" commented="no"><enum>8.</enum><header>UAS detection and mitigation enforcement authority</header> <subsection id="H12E283C5112A40EDBEA4E70D31695FCD" commented="no"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/448">Chapter 448</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<subsection id="H1F941B682DD54358ABFFDFCDFEA2E91D" commented="no"><enum>(a)</enum><header>Prohibition</header> 
<paragraph id="HA2ECE1E1A9B341E6B987DC5650CFB5AE"><enum>(1)</enum><header>In general</header><text>No person may carelessly or recklessly operate a system, equipment, or technology to detect, identify, monitor, track, or mitigate an unmanned aircraft system or unmanned aircraft in a manner that adversely impacts or interferes with safe airport operations, navigation, or air traffic services, or the safe and efficient operation of the national airspace system.</text></paragraph> <paragraph id="H32611A20FA0547DD89CD296D4E78A936" commented="no"><enum>(2)</enum><header>Actions by the Administrator</header><text>The Administrator of the Federal Aviation Administration may take such action as may be necessary to address the adverse impacts or interference of operations that violate paragraph (1).</text></paragraph></subsection> 
<subsection id="HE263AAE380404576BA84F81C543306F8"><enum>(b)</enum><header>Rule of construction</header><text>The term <quote>person</quote> as used in this section does not include—</text> <paragraph id="HD66ACA13ECF64728B929A8470582951B"><enum>(1)</enum><text>the Federal Government or any bureau, department, instrumentality, or other agency of the Federal Government; or</text></paragraph> 
<paragraph id="H665C49B68BB142349A1532B2DAFDD7AF"><enum>(2)</enum><text>an officer, employee, or contractor of the Federal Government or any bureau, department, instrumentality, or other agency of the Federal Government if the officer, employee, or contractor is authorized by the Federal Government or any bureau, department, instrumentality, or other agency of the Federal Government to operate a system or technology referred to in subsection (a)(1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H03F5CDCBAB4B43F798F48CBD2E6C3ABF"><enum>(b)</enum><header>Penalties relating to the operation of unmanned aircraft system detection and mitigation technologies</header><text>Section 46301(a) of title 49, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H41F660A4DC9448E6B64C037EB6D1E113" indent="up1"><enum>(9)</enum><header>Penalties relating to the operation of unmanned aircraft system detection and mitigation technologies</header><text>Notwithstanding paragraphs (1) and (5) of subsection (a), the maximum civil penalty for a violation of section 44815 committed by a person described in such section, including an individual or small business concern, shall be the maximum civil penalty authorized under subsection (a)(1) of this section for persons other than an individual or small business concern.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA1ED6E379C3C4DF087ED3F60DF9D2BED" commented="no"><enum>(c)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/448">chapter 448</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text>

<section id="H40D1FDBC4F4649BCA1BA163A17D21BF6" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Reporting on counter-UAS activities</header> 
<subsection id="H817F78BA636E4BDA8C3BDDF8924B5572"><enum>(a)</enum><header>Requirement</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter, the Secretary of Homeland Security shall issue, in coordination with the Administrator of the Federal Aviation Administration and the Attorney General, a public report summarizing the results of all counter-UAS detection and mitigation activities conducted pursuant to this Act during the previous year.</text></subsection> <subsection id="H780AEA777D0445219252D6F7F9B56BD6"><enum>(b)</enum><header>Contents</header><text>The report under subsection (a) shall include—</text> 
<paragraph id="H2467ABF903A040B09A8663FE90C6E0B7"><enum>(1)</enum><text>information on any violation of, or failure to comply with, this Act or the amendments made by this Act by personnel authorized to conduct detection and mitigation activities, including a description of any such violation or failure;</text></paragraph> <paragraph id="HA36A80427B8E4311953E124D93E78C71"><enum>(2)</enum><text>data on the number of detection activities conducted, the number of mitigation activities conducted, and the number of instances of communications interception from an unmanned aircraft system;</text></paragraph> 
<paragraph id="H531902FEC0B24D3AA2E462319433762C"><enum>(3)</enum><text>whether any unmanned aircraft that experienced mitigation was engaged in First Amendment-protected activities, and whether any unmanned aircraft or unmanned aircraft systems were properly or improperly seized, disabled, damaged, or destroyed as well as methods used to seize, disable, damage, or destroy such aircraft or systems; and</text></paragraph> <paragraph id="H50FC15C9B08D41C8947A7F31A8B8EB69"><enum>(4)</enum><text>a description of the efforts of the Federal Government to protect privacy and civil liberties when carrying out counter-UAS detection and mitigation activities.</text></paragraph></subsection>
