which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 49, United States Code, to prohibit access by certain individuals to certain areas of airports, and for other purposes.</official-title></form><legis-body id="HB1EEC7D4CD6643939098F195180EFD21" style="OLC"><section id="H8374776AF874402B9C7B69F1E70CC99A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Secure Airports From Enemies Act</short-title></quote> or the <quote><short-title>SAFE Act</short-title></quote>.</text></section><section id="H64A4708C0C634BB19AB087AF6EC3ED33"><enum>2.</enum><header>Prohibition on access by certain individuals to certain areas of airports</header><subsection id="HE6F738EB32DA4A73BFF0E4EDAC907D3F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HABCA48073C854EDEB1E920A5DB108C54" display-inline="no-display-inline"><section id="H5CDA07888C7A465797496B499DFC5213"><enum>44930.</enum><header>Prohibition on certain access by certain individuals</header><subsection id="H45417CDF60614C9C9C52D287B284890D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Administrator of the Transportation Security Administration may not permit any access to the locations specified in subsection (b) to any individual who is a representative of or acting on behalf of a country specified in subsection (c).</text></subsection><subsection id="H67C6999A84AF4615BD06C01365EA027B"><enum>(b)</enum><header>Locations specified</header><text>The locations specified in this subsection are the following:</text><paragraph id="HF4BACF3C0AE44751B507E6C4791936C2"><enum>(1)</enum><text>The secured area of an airport.</text></paragraph><paragraph id="H57DED5230B584E808AE70B3455A45847"><enum>(2)</enum><text display-inline="yes-display-inline">The Security Identification Display Area (SIDA) of an airport.</text></paragraph><paragraph id="H9345C5D92DE24B0B8C806EA2C356E935"><enum>(3)</enum><text display-inline="yes-display-inline">The sterile area of an airport.</text></paragraph><paragraph id="H63700E8E31014D1094C5A8A7562F4222"><enum>(4)</enum><text>The air cargo area of an airport.</text></paragraph></subsection><subsection id="HF0B8767F512B4046917A627CA86B9BA0"><enum>(c)</enum><header>Countries specified</header><text display-inline="yes-display-inline">A country specified in this subsection is a country the government of which the Secretary of State determines, or has determined at any time in the immediately preceding three years, has repeatedly provided support for international terrorism pursuant to—</text><paragraph id="HD1714932089345C997F143630980BA63"><enum>(1)</enum><text>section 1754(c)(1)(A) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)</external-xref>);</text></paragraph><paragraph id="HC0F537E88EA345DD8B8AB826901C2B53"><enum>(2)</enum><text>section 620A of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371</external-xref>);</text></paragraph><paragraph id="HD2A192F980074E2DA9DA6A9F836B5B31"><enum>(3)</enum><text>section 40 of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780</external-xref>); or</text></paragraph><paragraph id="HCD7949DC6978495DA16F2AB7F7283063"><enum>(4)</enum><text>any other provision of law.</text></paragraph></subsection><subsection id="H50032FC9D9204DB6B0D61D9DD4E56A06"><enum>(d)</enum><header>Definitions</header><text>In this section, the terms <quote>secured area</quote>, <quote>Security Identification Display Area (SIDA)</quote>, and <quote>sterile area</quote> have the meanings given such terms in section 1540.5 of title 49, Code of Federal Regulations.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF493B3A87E714F10927C616C9F7CF14B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/449">chapter 449</external-xref> of title 49, United States Code, is amended by adding at the following new item:</text><quoted-block style="USC" id="HF07C5E4DC48642BBA80EA4EFD245864B" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">44930.
