Effective date.</toc-entry></toc></subsection></section><title id="H186ECEEB7A8245B9BBFD3BD351083525"><enum>I</enum><header>My Voice Voucher Pilot Program</header><section id="HE8A51953FB6B468CB68A481361B4C721"><enum>101.</enum><header>Establishment of pilot program</header><subsection id="HA947D02FCDD148E1AF9908869B9C69A6"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Federal Election Commission (hereafter in this part referred to as the <quote>Commission</quote>) shall establish a pilot program under which the Commission shall select 3 eligible States to operate a voucher pilot program which is described in section 102 during the program operation period.</text></subsection><subsection id="HD3656BAE72B449FE927F8F3C51CA9075"><enum>(b)</enum><header>Eligibility of States</header><text display-inline="yes-display-inline">A State is eligible to be selected to operate a voucher pilot program under this part if, not later than 180 days after the beginning of the program application period, the State submits to the Commission an application containing—</text><paragraph id="H0C13B1790B9B411B8E8DFEEA10CFA9C1"><enum>(1)</enum><text>information and assurances that the State will operate a voucher program which contains the elements described in section 102(a);</text></paragraph><paragraph id="HA5DDB74083A0409084C2C21DDCFC6F78"><enum>(2)</enum><text>information and assurances that the State will establish fraud prevention mechanisms described in section 102(b);</text></paragraph><paragraph id="HE0C6F7EC827C4394872AACAD4C980CEE"><enum>(3)</enum><text>information and assurances that the State will establish a commission to oversee and implement the program as described in section 102(c);</text></paragraph><paragraph id="H26567626F0BF402DB0936D2A5D8DE48B"><enum>(4)</enum><text display-inline="yes-display-inline">information and assurances that the State will carry out a public information campaign as described in section 102(d);</text></paragraph><paragraph id="H17CE90B9AA814BDC92F1081C5DCE6683"><enum>(5)</enum><text>information and assurances that the State will submit reports as required under section 103; and</text></paragraph><paragraph id="H2A08091C2C91482EB2C23DF2679BFC58"><enum>(6)</enum><text>such other information and assurances as the Commission may require.</text></paragraph></subsection><subsection id="H4EFF0AD0029644AE9CEFBAD51E8B0C7D"><enum>(c)</enum><header>Selection of participating States</header><paragraph id="HC8DB01F9BDA849F0AE69BDB24195A456"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the beginning of the program application period, the Commission shall select the 3 States which will operate voucher pilot programs under this part.</text></paragraph><paragraph id="H432C1B5549A141B3B17B6DE086978FA5"><enum>(2)</enum><header>Criteria</header><text>In selecting States for the operation of the voucher pilot programs under this part, the Commission shall apply such criteria and metrics as the Commission considers appropriate to determine the ability of a State to operate the program successfully, and shall attempt to select States in a variety of geographic regions and with a variety of political party preferences.</text></paragraph><paragraph id="H55F2AB9CB15E4AC8AC035ADFAD1309AB"><enum>(3)</enum><header>No supermajority required for selection</header><text>The selection of States by the Commission under this subsection shall require the approval of only half of the Members of the Commission.</text></paragraph></subsection><subsection id="H2E8E0518F5F64BCB972B490E1B9302D4"><enum>(d)</enum><header>Duties of States during program preparation period</header><text>During the program preparation period, each State selected to operate a voucher pilot program under this part shall take such actions as may be necessary to ensure that the State will be ready to operate the program during the program operation period, and shall complete such actions not later than 90 days before the beginning of the program operation period.</text></subsection><subsection id="H434B28CC4F704071AFD64A20C12C1236"><enum>(e)</enum><header>Termination</header><text>Each voucher pilot program under this part shall terminate as of the first day after the program operation period.</text></subsection><subsection id="HD3562F6A737C4062ABF744A83D27F339"><enum>(f)</enum><header>Reimbursement of Costs</header><paragraph id="HDEC18F10429B45CF93FA5CF2F0599B4B"><enum>(1)</enum><header>Reimbursement</header><text>Upon receiving the report submitted by a State under section 103(a) with respect to an election cycle, the Commission shall transmit a payment to the State in an amount equal to the reasonable costs incurred by the State in operating the voucher pilot program under this part during the cycle.</text></paragraph><paragraph id="H9EB28703E6B946CCBC62C9B0FDB86149"><enum>(2)</enum><header>Source of funds</header><text>Payments to States under the program shall be made using amounts in the Freedom From Influence Fund under section 541 of the Federal Election Campaign Act of 1971 (as added by section 201), hereafter referred to as the <quote>Fund</quote>.</text></paragraph><paragraph id="H481023E71DCE487A9642F2620D112FEB"><enum>(3)</enum><header>Mandatory reduction of payments in case of insufficient amounts in Freedom From Influence Fund</header><subparagraph id="H01C3A191483A447AB63CFF296BF08B24"><enum>(A)</enum><header>Advance audits by Commission</header><text display-inline="yes-display-inline">Not later than 90 days before the first day of each program operation period, the Commission shall—</text><clause id="HEABF48CA06014ED8829AA0F6A1C0DB95"><enum>(i)</enum><text>audit the Fund to determine whether, after first making payments to participating candidates under title V of the Federal Election Campaign Act of 1971 (as added by section 201), the amounts remaining in the Fund will be sufficient to make payments to States under this part in the amounts provided under this subsection; and</text></clause><clause id="HFB1D491AED2242CBB0F64A088A3CFC74"><enum>(ii)</enum><text>submit a report to Congress describing the results of the audit.</text></clause></subparagraph><subparagraph id="H9195D1567FD74A6FBCF3440804DFD178"><enum>(B)</enum><header>Reductions in amount of payments</header><clause id="H6C465DF1024C426EB711E0E4022344C3"><enum>(i)</enum><header>Automatic reduction on pro rata basis</header><text>If, on the basis of the audit described in subparagraph (A), the Commission determines that the amount anticipated to be available in the Fund with respect to an election cycle involved is not, or may not be, sufficient to make payments to States under this part in the full amount provided under this subsection, the Commission shall reduce each amount which would otherwise be paid to a State under this subsection by such pro rata amount as may be necessary to ensure that the aggregate amount of payments anticipated to be made with respect to the cycle will not exceed the amount anticipated to be available for such payments in the Fund with respect to such cycle.</text></clause><clause id="HAF2BF94216CC4C23A524FC4CB0F83F86"><enum>(ii)</enum><header>Restoration of reductions in case of availability of sufficient funds during election cycle</header><text>If, after reducing the amounts paid to States with respect to an election cycle under clause (i), the Commission determines that there are sufficient amounts in the Fund to restore the amount by which such payments were reduced (or any portion thereof), to the extent that such amounts are available, the Commission may make a payment on a pro rata basis to each such State with respect to the cycle in the amount by which such State’s payments were reduced under clause (i) (or any portion thereof, as the case may be).</text></clause><clause id="H761DECE9F4224C239D25A0A26A54CAE6"><enum>(iii)</enum><header>No use of amounts from other sources</header><text>In any case in which the Commission determines that there are insufficient moneys in the Fund to make payments to States under this part, moneys shall not be made available from any other source for the purpose of making such payments.</text></clause></subparagraph></paragraph><paragraph id="H2543E8BE99954C02A1C37A7C547CCADD"><enum>(4)</enum><header>Cap on amount of payment</header><text>The aggregate amount of payments made to any State with respect to any program operation period may not exceed $10,000,000. If the State determines that the maximum payment amount under this paragraph with respect to the program operation period involved is not, or may not be, sufficient to cover the reasonable costs incurred by the State in operating the program under this part for such period, the State shall reduce the amount of the voucher provided to each qualified individual by such pro rata amount as may be necessary to ensure that the reasonable costs incurred by the State in operating the program will not exceed the amount paid to the State with respect to such period.</text></paragraph></subsection></section><section id="HDD712BA2B06647C990A82F01941B1134"><enum>102.</enum><header>Voucher program described</header><subsection id="H4F3747DF794441699BFF2E2AD6CDE9D4"><enum>(a)</enum><header>General elements of program</header><paragraph id="H4D47278F41A34931B0862E0233A96B04"><enum>(1)</enum><header>Elements described</header><text>The elements of a voucher pilot program operated by a State under this part are as follows:</text><subparagraph id="H6F19FD461A9144D0A57BDB4081421325"><enum>(A)</enum><text display-inline="yes-display-inline">The State shall provide each qualified individual upon the individual’s request with a voucher worth $25 to be known as a <quote>My Voice Voucher</quote> during the election cycle which will be assigned a routing number and which at the option of the individual will be provided in either paper or electronic form.</text></subparagraph><subparagraph id="H80B7F4EFC8B2459F9F4461EC109173E6"><enum>(B)</enum><text display-inline="yes-display-inline">Using the routing number assigned to the My Voice Voucher, the individual may submit the My Voice Voucher in either electronic or paper form to qualified candidates for election for the office of Representative in, or Delegate or Resident Commissioner to, the Congress and allocate such portion of the value of the My Voice Voucher in increments of $5 as the individual may select to any such candidate.</text></subparagraph><subparagraph id="H1F303D69748F42C9904C5B49E3B18157"><enum>(C)</enum><text display-inline="yes-display-inline">If the candidate transmits the My Voice Voucher to the Commission, the Commission shall pay the candidate the portion of the value of the My Voice Voucher that the individual allocated to the candidate, which shall be considered a contribution by the individual to the candidate for purposes of the Federal Election Campaign Act of 1971.</text></subparagraph></paragraph><paragraph id="H9EC606AE21F74269A19FF4EFF2BD0AAC"><enum>(2)</enum><header>Designation of qualified individuals</header><text>For purposes of paragraph (1)(A), a <quote>qualified individual</quote> with respect to a State means an individual—</text><subparagraph id="HA009FB6594B040EC9B081FF46331B5E3"><enum>(A)</enum><text>who is a resident of the State;</text></subparagraph><subparagraph id="H04F6A552C825411CAA9DD955F8E3C6FB"><enum>(B)</enum><text>who will be of voting age as of the date of the election for the candidate to whom the individual submits a My Voice Voucher; and</text></subparagraph><subparagraph id="H21BD612609634D7495BCE7F16C4E4C58"><enum>(C)</enum><text>who is not prohibited under Federal law from making contributions to candidates for election for Federal office.</text></subparagraph></paragraph><paragraph id="H93476683359443E9B18D2E03186E0A17"><enum>(3)</enum><header>Treatment as contribution to candidate</header><text>For purposes of the Federal Election Campaign Act of 1971, the submission of a My Voice Voucher to a candidate by an individual shall be treated as a contribution to the candidate by the individual in the amount of the portion of the value of the Voucher that the individual allocated to the candidate.</text></paragraph></subsection><subsection id="H2FB83D7E66624D1493326D00B68BF272"><enum>(b)</enum><header>Fraud prevention mechanism</header><text display-inline="yes-display-inline">In addition to the elements described in subsection (a), a State operating a voucher pilot program under this part shall permit an individual to revoke a My Voice Voucher not later than 2 days after submitting the My Voice Voucher to a candidate.</text></subsection><subsection id="HEB7A5340C33D44CEB7F95AD9C277DC07"><enum>(c)</enum><header>Oversight commission</header><text>In addition to the elements described in subsection (a), a State operating a voucher pilot program under this part shall establish a commission or designate an existing entity to oversee and implement the program in the State, except that no such commission or entity may be comprised of elected officials.</text></subsection><subsection id="HF43A303F870E4643BD3CF172D433E5D1"><enum>(d)</enum><header>Public information campaign</header><text>In addition to the elements described in subsection (a), a State operating a voucher pilot program under this part shall carry out a public information campaign to disseminate awareness of the program among qualified individuals.</text></subsection></section><section id="HA6CC77FD072142918E486CB4010038C8"><enum>103.</enum><header>Reports</header><subsection id="H28307625F0514233AC276F961BF2F0BA"><enum>(a)</enum><header>Preliminary report</header><text display-inline="yes-display-inline">Not later than 6 months after the first election cycle of the program operation period, a State which operates a voucher pilot program under this part shall submit a report to the Commission analyzing the operation and effectiveness of the program during the cycle and including such other information as the Commission may require.</text></subsection><subsection id="HA782348A6437454F935989655CF7427A"><enum>(b)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than 6 months after the end of the program operation period, the State shall submit a final report to the Commission analyzing the operation and effectiveness of the program and including such other information as the Commission may require.</text></subsection><subsection id="H2BB62A6268C34ADF97F17B581EF7B7A2"><enum>(c)</enum><header>Study and report on impact and effectiveness of voucher programs</header><paragraph id="H498FAF0E8F0246E89086407DCF45F6A2"><enum>(1)</enum><header>Study</header><text display-inline="yes-display-inline">The Federal Election Commission shall conduct a study on the efficacy of political voucher programs, including the program under this part and other similar programs, in expanding and diversifying the pool of individuals who participate in the electoral process, including those who participate as donors and those who participate as candidates.</text></paragraph><paragraph id="H30F47F35EFBD45A595C6E9FA12FD4E4A"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Commission shall publish and submit to Congress a report on the study conducted under subsection (a), and shall include in the report such recommendations as the Commission considers appropriate which would enable political voucher programs to be implemented on a national scale.</text></paragraph></subsection></section><section id="H636A0EDFE3D340748004E3B946FEA23C"><enum>104.</enum><header>Definitions</header><subsection id="H508AE3576BB5432D81C29A04A5A2626D"><enum>(a)</enum><header>Election cycle</header><text display-inline="yes-display-inline">In this part, the term <term>election cycle</term> means the period beginning on the day after the date of the most recent regularly scheduled general election for Federal office and ending on the date of the next regularly scheduled general election for Federal office.</text></subsection><subsection id="H1B230DE909164B2BA11FB6562D4A13B0"><enum>(b)</enum><header>Definitions relating to periods</header><text>In this part, the following definitions apply:</text><paragraph id="H7328291955454E8E892B695D261752E8"><enum>(1)</enum><header>Program application period</header><text>The term <term>program application period</term> means the first election cycle which begins after the date of the enactment of this Act.</text></paragraph><paragraph id="H9D85810CD3CE4C07BF72BF67D72B6103"><enum>(2)</enum><header>Program preparation period</header><text>The term <term>program preparation period</term> means the first election cycle which begins after the program application period.</text></paragraph><paragraph id="HE37CAAE4C5E14B4A9E5BA7ABCBB39F4F"><enum>(3)</enum><header>Program operation period</header><text>The term <term>program operation period</term> means the first 2 election cycles which begin after the program preparation period.</text></paragraph></subsection></section></title><title id="H843C1A27574245138DA8620B15286488"><enum>II</enum><header>Small Dollar Financing of Congressional Election Campaigns</header><section id="HABD0B9DAC7304407A1991135999E7D42"><enum>201.</enum><header>Benefits and eligibility requirements for candidates</header><text display-inline="no-display-inline">The <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block act-name="Federal Election Campaign Act of 1971" id="H5BB9F4A7741E4A39B0054ABC9FDA0B81"><title id="H7B9B70512C28485DBA6560261A10286A"><enum>V</enum><header>Small Dollar Financing of Congressional Election Campaigns</header><subtitle id="HC69FF2039CB44809B0B420F4AF88E7DA"><enum>A</enum><header>Benefits</header><section id="H86AC31022CA34D3685491E8B82478C07"><enum>501.</enum><header>Benefits for participating candidates</header><subsection id="HFD6DE5F03C064EDAB22545C8F8DC1001"><enum>(a)</enum><header>In general</header><text>If a candidate for election to the office of Representative in, or Delegate or Resident Commissioner to, the Congress is certified as a participating candidate under this title with respect to an election for such office, the candidate shall be entitled to payments as provided under this title.</text></subsection><subsection id="H56392E444DE44DBAA568DE9766046AF6"><enum>(b)</enum><header>Amount of payment</header><text display-inline="yes-display-inline">The amount of a payment made under this title shall be equal to 600 percent of the amount of qualified small dollar contributions received by the candidate since the most recent payment made to the candidate under this title during the election cycle, without regard to whether or not the candidate received any of the contributions before, during, or after the Small Dollar Democracy qualifying period applicable to the candidate under section 511(c).</text></subsection><subsection id="H79A66F71251B4DF6923895E070055144"><enum>(c)</enum><header>Limit on aggregate amount of payments</header><text display-inline="yes-display-inline">The aggregate amount of payments made to a participating candidate with respect to an election cycle under this title may not exceed 50 percent of the average of the 20 greatest amounts of disbursements made by the authorized committees of any winning candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress during the most recent election cycle, rounded to the nearest $100,000.</text></subsection></section><section id="HACD645695A394266AE2F1B9E2DB34B5A"><enum>502.</enum><header>Procedures for making payments</header><subsection id="H27E71467AAA1428F8939858B4AAB92DD"><enum>(a)</enum><header>In general</header><text>The Commission shall make a payment under section 501 to a candidate who is certified as a participating candidate upon receipt from the candidate of a request for a payment which includes—</text><paragraph id="HD7D0F0DB478E4AE4B918D6FCB75FDB6D"><enum>(1)</enum><text>a statement of the number and amount of qualified small dollar contributions received by the candidate since the most recent payment made to the candidate under this title during the election cycle;</text></paragraph><paragraph id="HAD3437DE0AE74164A89B05B5740AC432"><enum>(2)</enum><text>a statement of the amount of the payment the candidate anticipates receiving with respect to the request;</text></paragraph><paragraph id="H056A9B3BB5354458BE55C35C1154B512"><enum>(3)</enum><text>a statement of the total amount of payments the candidate has received under this title as of the date of the statement; and</text></paragraph><paragraph id="HBC4C7B20D3CB42C6B2BFCA95475597FD"><enum>(4)</enum><text>such other information and assurances as the Commission may require.</text></paragraph></subsection><subsection id="HCB774FEB0A8742F6AD65382AFE902152"><enum>(b)</enum><header>Restrictions on submission of requests</header><text>A candidate may not submit a request under subsection (a) unless each of the following applies: </text><paragraph id="HD69CFD3872A24E03A16650DB3978547C"><enum>(1)</enum><text>The amount of the qualified small dollar contributions in the statement referred to in subsection (a)(1) is equal to or greater than $5,000, unless the request is submitted during the 30-day period which ends on the date of a general election.</text></paragraph><paragraph id="H314B2616145345A78A714D79E18193E7"><enum>(2)</enum><text>The candidate did not receive a payment under this title during the 7-day period which ends on the date the candidate submits the request.</text></paragraph></subsection><subsection id="HAD91F89EDE794EE889BE6BE7F2448632"><enum>(c)</enum><header>Time of payment</header><text display-inline="yes-display-inline">The Commission shall, in coordination with the Secretary of the Treasury, take such steps as may be necessary to ensure that the Secretary is able to make payments under this section from the Treasury not later than 2 business days after the receipt of a request submitted under subsection (a).</text></subsection></section><section id="H51FCBD072DE24AF08EC3F9E29658836E"><enum>503.</enum><header>Use of funds</header><subsection id="HF16B8E326C6C42BFA47AEFC5073D9201"><enum>(a)</enum><header>Use of funds for authorized campaign expenditures</header><text display-inline="yes-display-inline">A candidate shall use payments made under this title, including payments provided with respect to a previous election cycle which are withheld from remittance to the Commission in accordance with section 524(a)(2), only for making direct payments for the receipt of goods and services which constitute authorized expenditures (as determined in accordance with title III) in connection with the election cycle involved.</text></subsection><subsection id="HBA38F4684F5049A48322C5859887BBD8"><enum>(b)</enum><header>Prohibiting use of funds for legal expenses, fines, or penalties</header><text>Notwithstanding title III, a candidate may not use payments made under this title for the payment of expenses incurred in connection with any action, claim, or other matter before the Commission or before any court, hearing officer, arbitrator, or other dispute resolution entity, or for the payment of any fine or civil monetary penalty.</text></subsection></section><section id="H61F0FE4C628F468886470B0C92FFC138"><enum>504.</enum><header>Qualified small dollar contributions described</header><subsection id="H031B1E016504429D81A55DFC16019FA8"><enum>(a)</enum><header>In general</header><text>In this title, the term <term>qualified small dollar contribution</term> means, with respect to a candidate and the authorized committees of a candidate, a contribution that meets the following requirements:</text><paragraph id="HAA157966DB1B47CABC5DDCE784213ABD"><enum>(1)</enum><text>The contribution is in an amount that is—</text><subparagraph id="H83A625C04A37487E9433BBD71C171618"><enum>(A)</enum><text>not less than $1; and</text></subparagraph><subparagraph id="H071E92CC08E44696A841F6D3A8BE92B8"><enum>(B)</enum><text>not more than $200.</text></subparagraph></paragraph><paragraph id="H45010D368371401A8F2245D66A26DD42"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4BF3C94AFE19442EBB1EF2A3B74C18B3"><enum>(A)</enum><text>The contribution is made directly by an individual to the candidate or an authorized committee of the candidate and is not—</text><clause id="HDBC1D6B03F8742F295E1982B2E882E5E" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">forwarded from the individual making the contribution to the candidate or committee by another person; or</text></clause><clause id="H7398453522CD49F68C341648C8A39800" indent="up1"><enum>(ii)</enum><text>received by the candidate or committee with the knowledge that the contribution was made at the request, suggestion, or recommendation of another person.</text></clause></subparagraph><subparagraph id="H6551D2D3BAEE430B8D24BE636C29E3EB" indent="up1"><enum>(B)</enum><text>In this paragraph—</text><clause id="H6ADAE5FEBD074E63BA3182DE11F60FA4"><enum>(i)</enum><text display-inline="yes-display-inline">the term <term>person</term> does not include an individual (other than an individual described in section 304(i)(7) of the Federal Election Campaign Act of 1971), a political committee of a political party, or any political committee which is not a separate segregated fund described in section 316(b) of the Federal Election Campaign Act of 1971 and which does not make contributions or independent expenditures, does not engage in lobbying activity under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>), and is not established by, controlled by, or affiliated with a registered lobbyist under such Act, an agent of a registered lobbyist under such Act, or an organization which retains or employs a registered lobbyist under such Act; and</text></clause><clause id="H8B1E6E51D22440BEA0691F6005CD89A6"><enum>(ii)</enum><text display-inline="yes-display-inline">a contribution is not <quote>made at the request, suggestion, or recommendation of another person</quote> solely on the grounds that the contribution is made in response to information provided to the individual making the contribution by any person, so long as the candidate or authorized committee does not know the identity of the person who provided the information to such individual.</text></clause></subparagraph></paragraph><paragraph id="H435CC0F35BED4A92A96C57F260F3D400"><enum>(3)</enum><text>The individual who makes the contribution does not make contributions to the candidate or the authorized committees of the candidate with respect to the election involved in an aggregate amount that exceeds the amount described in paragraph (1)(B), or any contribution to the candidate or the authorized committees of the candidate with respect to the election involved that otherwise is not a qualified small dollar contribution.</text></paragraph></subsection><subsection id="HFE14D19F36634FB59E52BC40A1C82325"><enum>(b)</enum><header>Treatment of my voice vouchers</header><text>Any payment received by a candidate and the authorized committees of a candidate which consists of a My Voice Voucher under the Government By the People Act of 2021 shall be considered a qualified small dollar contribution for purposes of this title, so long as the individual making the payment meets the requirements of paragraphs (2) and (3) of subsection (a).</text></subsection><subsection id="H956F74EEBF3D4872849D316BD40184DD"><enum>(c)</enum><header>Restriction on subsequent contributions</header><paragraph id="H035FA78C1621412EA11AB9DDD76ED32B"><enum>(1)</enum><header>Prohibiting donor from making subsequent nonqualified contributions during election cycle</header><subparagraph id="H7615DB2DF2D54067B0C061B88A8F921B"><enum>(A)</enum><header>In general</header><text>An individual who makes a qualified small dollar contribution to a candidate or the authorized committees of a candidate with respect to an election may not make any subsequent contribution to such candidate or the authorized committees of such candidate with respect to the election cycle which is not a qualified small dollar contribution.</text></subparagraph><subparagraph id="HB9133A7ACEE743419B2DC3E157B226FA"><enum>(B)</enum><header>Exception for contributions to candidates who voluntarily withdraw from participation during qualifying period</header><text display-inline="yes-display-inline">Subparagraph (A) does not apply with respect to a contribution made to a candidate who, during the Small Dollar Democracy qualifying period described in section 511(c), submits a statement to the Commission under section 513(c) to voluntarily withdraw from participating in the program under this title.</text></subparagraph></paragraph><paragraph id="H60CBC986CFAE467B9931C49ECF97297B"><enum>(2)</enum><header>Treatment of subsequent nonqualified contributions</header><text display-inline="yes-display-inline">If, notwithstanding the prohibition described in paragraph (1), an individual who makes a qualified small dollar contribution to a candidate or the authorized committees of a candidate with respect to an election makes a subsequent contribution to such candidate or the authorized committees of such candidate with respect to the election which is prohibited under paragraph (1) because it is not a qualified small dollar contribution, the candidate may take one of the following actions:</text><subparagraph id="H6DAFAA1BAFFA4C7F916BBDC0C6A414DC"><enum>(A)</enum><text>Not later than 2 weeks after receiving the contribution, the candidate may return the subsequent contribution to the individual. In the case of a subsequent contribution which is not a qualified small dollar contribution because the contribution fails to meet the requirements of paragraph (3) of subsection (a) (relating to the aggregate amount of contributions made to the candidate or the authorized committees of the candidate by the individual making the contribution), the candidate may return an amount equal to the difference between the amount of the subsequent contribution and the amount described in paragraph (1)(B) of subsection (a).</text></subparagraph><subparagraph id="H2FFF3412E75B4AB2B3C6395FFAA54258"><enum>(B)</enum><text display-inline="yes-display-inline">The candidate may retain the subsequent contribution, so long as not later than 2 weeks after receiving the subsequent contribution, the candidate remits to the Commission for deposit in the Freedom From Influence Fund under section 541 an amount equal to any payments received by the candidate under this title which are attributable to the qualified small dollar contribution made by the individual involved.</text></subparagraph></paragraph><paragraph id="HF6E67997B1C4421CA6ACC4B5DC8E0923"><enum>(3)</enum><header>No effect on ability to make multiple contributions</header><text>Nothing in this section may be construed to prohibit an individual from making multiple qualified small dollar contributions to any candidate or any number of candidates, so long as each contribution meets each of the requirements of paragraphs (1), (2), and (3) of subsection (a).</text></paragraph></subsection><subsection id="H67D999D7870C461ABC3F9CAF2F5A6532"><enum>(d)</enum><header>Notification requirements for candidates</header><paragraph id="H2D3025324F17405CA3B6C279F8AE37E2"><enum>(1)</enum><header>Notification</header><text>Each authorized committee of a candidate who seeks to be a participating candidate under this title shall provide the following information in any materials for the solicitation of contributions, including any internet site through which individuals may make contributions to the committee:</text><subparagraph id="H4A4AD08B2F65432EB54225AFAF62524D"><enum>(A)</enum><text>A statement that if the candidate is certified as a participating candidate under this title, the candidate will receive matching payments in an amount which is based on the total amount of qualified small dollar contributions received.</text></subparagraph><subparagraph id="H1C642BC44BA24CFD90A597D0E07A9BED"><enum>(B)</enum><text>A statement that a contribution which meets the requirements set forth in subsection (a) shall be treated as a qualified small dollar contribution under this title.</text></subparagraph><subparagraph id="H66C776339D9F4621AC22BF2D4BDEB64C"><enum>(C)</enum><text>A statement that if a contribution is treated as qualified small dollar contribution under this title, the individual who makes the contribution may not make any contribution to the candidate or the authorized committees of the candidate during the election cycle which is not a qualified small dollar contribution.</text></subparagraph></paragraph><paragraph id="HEFB3AC412B6D45B5AA78139628823FE2"><enum>(2)</enum><header>Alternative methods of meeting requirements</header><text>An authorized committee may meet the requirements of paragraph (1)—</text><subparagraph id="H7AF1C18E30AB48BAA1F3E3316EAD73BC"><enum>(A)</enum><text>by including the information described in paragraph (1) in the receipt provided under section 512(b)(3) to a person making a qualified small dollar contribution; or</text></subparagraph><subparagraph id="HFD46095143894FCB8F806A87A8208531"><enum>(B)</enum><text>by modifying the information it provides to persons making contributions which is otherwise required under title III (including information it provides through the internet).</text></subparagraph></paragraph></subsection></section></subtitle><subtitle id="H2192763B567548AF826F448B75BE7A29"><enum>B</enum><header>Eligibility and Certification</header><section id="H1F5E310DDEDF4EE291243D4C00A43EE2"><enum>511.</enum><header>Eligibility</header><subsection id="H05B7499C6A0A4E468F85E996DA05D616"><enum>(a)</enum><header>In general</header><text>A candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress is eligible to be certified as a participating candidate under this title with respect to an election if the candidate meets the following requirements:</text><paragraph id="H085782F34A44401E9F9D73DDE58D6C74"><enum>(1)</enum><text>The candidate files with the Commission a statement of intent to seek certification as a participating candidate.</text></paragraph><paragraph id="H28A05B8185C0487B91CB4B2B21C73AEA"><enum>(2)</enum><text>The candidate meets the qualifying requirements of section 512.</text></paragraph><paragraph id="H87CC9856A43B4FE88AE5605858092774"><enum>(3)</enum><text>The candidate files with the Commission a statement certifying that the authorized committees of the candidate meet the requirements of section 504(d).</text></paragraph><paragraph id="H10B06F4E516B45419BBC298A9AE0FA69"><enum>(4)</enum><text>Not later than the last day of the Small Dollar Democracy qualifying period, the candidate files with the Commission an affidavit signed by the candidate and the treasurer of the candidate's principal campaign committee declaring that the candidate—</text><subparagraph id="H7026500962924E3E99BB11876BA0D0FD"><enum>(A)</enum><text>has complied and, if certified, will comply with the contribution and expenditure requirements of section 521;</text></subparagraph><subparagraph id="H4F737D12C1B9410AA8F7285C086BF0EF"><enum>(B)</enum><text>if certified, will run only as a participating candidate for all elections for the office that such candidate is seeking during that election cycle; and</text></subparagraph><subparagraph id="HB4813B97372B4FF6AABC0790F926E74F"><enum>(C)</enum><text>has either qualified or will take steps to qualify under State law to be on the ballot.</text></subparagraph></paragraph></subsection><subsection id="H802BED327F734EEB8DBA4BFD88CB50AF"><enum>(b)</enum><header>General election</header><text>Notwithstanding subsection (a), a candidate shall not be eligible to be certified as a participating candidate under this title for a general election or a general runoff election unless the candidate’s party nominated the candidate to be placed on the ballot for the general election or the candidate is otherwise qualified to be on the ballot under State law.</text></subsection><subsection id="HF8E3C14CC7134238A6F19FE816D49512"><enum>(c)</enum><header>Small Dollar Democracy qualifying period Defined</header><text>The term <term>Small Dollar Democracy qualifying period</term> means, with respect to any candidate for an office, the 180-day period (during the election cycle for such office) which begins on the date on which the candidate files a statement of intent under section 511(a)(1), except that such period may not continue after the date that is 30 days before the date of the general election for the office.</text></subsection></section><section id="H2276300367BF4FF48161BCE403579476"><enum>512.</enum><header>Qualifying requirements</header><subsection id="HCD10CB55D1BB4BC09954D9278D450C7C"><enum>(a)</enum><header>Receipt of qualified small dollar contributions</header><text>A candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress meets the requirement of this section if, during the Small Dollar Democracy qualifying period described in section 511(c), each of the following occurs:</text><paragraph commented="no" id="HBF4CA3D5939F46DD87D8999C9905A3E4"><enum>(1)</enum><text>Not fewer than 1,000 individuals make a qualified small dollar contribution to the candidate.</text></paragraph><paragraph commented="no" id="HF9C05C058ED94E81AEC37B4F44FA7D38"><enum>(2)</enum><text>The candidate obtains a total dollar amount of qualified small dollar contributions which is equal to or greater than $50,000.</text></paragraph></subsection><subsection id="H41E8688490E8447F90E1140827EE478E"><enum>(b)</enum><header>Requirements relating to receipt of qualified small dollar contribution</header><text>Each qualified small dollar contribution—</text><paragraph id="H6ED6FEB680E74E699C6EF3B4E626575C"><enum>(1)</enum><text>may be made by means of a personal check, money order, debit card, credit card, electronic payment account, or any other method deemed appropriate by the Commission;</text></paragraph><paragraph id="H2CFA62F3EFE842CE8E42CB000D672014"><enum>(2)</enum><text display-inline="yes-display-inline">shall be accompanied by a signed statement (or, in the case of a contribution made online or through other electronic means, an electronic equivalent) containing the contributor’s name and address; and</text></paragraph><paragraph id="H9FD7BF43D0D445DA903559DE168C416E"><enum>(3)</enum><text>shall be acknowledged by a receipt that is sent to the contributor with a copy (in paper or electronic form) kept by the candidate for the Commission.</text></paragraph></subsection><subsection commented="no" id="HF4C5EB6EBBEC45A881135DCEA4C263A6"><enum>(c)</enum><header>Verification of contributions</header><text>The Commission shall establish procedures for the auditing and verification of the contributions received and expenditures made by participating candidates under this title, including procedures for random audits, to ensure that such contributions and expenditures meet the requirements of this title.</text></subsection></section><section id="HE8E518B9C494411AA958B0A5AFAC6D8B"><enum>513.</enum><header>Certification</header><subsection id="HB729DA7728E343739EC3FEF3451C5A93"><enum>(a)</enum><header>Deadline and Notification</header><paragraph id="HFE9FB4ABCF1841A3B1F34252DC831C94"><enum>(1)</enum><header>In general</header><text>Not later than 5 business days after a candidate files an affidavit under section 511(a)(4), the Commission shall—</text><subparagraph id="H7A5CB6E696064EC5AAEA7C97B38284F1"><enum>(A)</enum><text>determine whether or not the candidate meets the requirements for certification as a participating candidate;</text></subparagraph><subparagraph id="H6F0B824BE00B4702A35D211F83FC4064"><enum>(B)</enum><text>if the Commission determines that the candidate meets such requirements, certify the candidate as a participating candidate; and</text></subparagraph><subparagraph id="H6A5F724B2F9349029C5BD7E26DC0FFDA"><enum>(C)</enum><text>notify the candidate of the Commission's determination.</text></subparagraph></paragraph><paragraph id="HCA117D595EA14A4C923315FD3936E829"><enum>(2)</enum><header>Deemed certification for all elections in election cycle</header><text>If the Commission certifies a candidate as a participating candidate with respect to the first election of the election cycle involved, the Commission shall be deemed to have certified the candidate as a participating candidate with respect to all subsequent elections of the election cycle.</text></paragraph></subsection><subsection id="H4B4D2B2342624DAE9EC0F15ED7F79A8A"><enum>(b)</enum><header>Revocation of certification</header><paragraph id="HE665E06469E94C5FB8C9D5530869D11D"><enum>(1)</enum><header>In general</header><text>The Commission shall revoke a certification under subsection (a) if—</text><subparagraph id="H5A6377CDB9E442E1AFE0ACBECE251292"><enum>(A)</enum><text display-inline="yes-display-inline">a candidate fails to qualify to appear on the ballot at any time after the date of certification (other than a candidate certified as a participating candidate with respect to a primary election who fails to qualify to appear on the ballot for a subsequent election in that election cycle);</text></subparagraph><subparagraph id="H119FDD870FB34A6A84E18EC8D301FBBB"><enum>(B)</enum><text>a candidate ceases to be a candidate for the office involved, as determined on the basis of an official announcement by an authorized committee of the candidate or on the basis of a reasonable determination by the Commission; or</text></subparagraph><subparagraph id="H8FCD3C7B02954C8DB4406E386C10902E"><enum>(C)</enum><text>a candidate otherwise fails to comply with the requirements of this title, including any regulatory requirements prescribed by the Commission.</text></subparagraph></paragraph><paragraph id="HD03FBAE056E2437889BB9D6C8F645746"><enum>(2)</enum><header>Existence of criminal sanction</header><text>The Commission shall revoke a certification under subsection (a) if a penalty is assessed against the candidate under section 309(d) with respect to the election.</text></paragraph><paragraph commented="no" id="H37BA718BA2194B4C90E1FA89D355C4B5"><enum>(3)</enum><header>Effect of revocation</header><text>If a candidate’s certification is revoked under this subsection—</text><subparagraph id="HA01AE337642342B9832D6E2EA8FA33AB"><enum>(A)</enum><text>the candidate may not receive payments under this title during the remainder of the election cycle involved; and</text></subparagraph><subparagraph id="H8FA9A5B67E0A44C2B936F86633EBA54A"><enum>(B)</enum><text>in the case of a candidate whose certification is revoked pursuant to subparagraph (A) or subparagraph (C) of paragraph (1)—</text><clause id="H1A5CA2CF389A4574B051390227F3BA72"><enum>(i)</enum><text>the candidate shall repay to the Freedom From Influence Fund established under section 541 an amount equal to the payments received under this title with respect to the election cycle involved plus interest (at a rate determined by the Commission on the basis of an appropriate annual percentage rate for the month involved) on any such amount received; and</text></clause><clause id="H9913CB3D97C6424D9D0D78C9705B4A85"><enum>(ii)</enum><text>the candidate may not be certified as a participating candidate under this title with respect to the next election cycle.</text></clause></subparagraph></paragraph><paragraph id="H09338BFB276340EB9D356DD805CA5C74"><enum>(4)</enum><header>Prohibiting participation in future elections for candidates with multiple revocations</header><text>If the Commission revokes the certification of an individual as a participating candidate under this title pursuant to subparagraph (A) or subparagraph (C) of paragraph (1) a total of 3 times, the individual may not be certified as a participating candidate under this title with respect to any subsequent election.</text></paragraph></subsection><subsection id="H349ED036CBDC4C7E93622A26E4175DED"><enum>(c)</enum><header>Voluntary withdrawal from participating during qualifying period</header><text display-inline="yes-display-inline">At any time during the Small Dollar Democracy qualifying period described in section 511(c), a candidate may withdraw from participation in the program under this title by submitting to the Commission a statement of withdrawal (without regard to whether or not the Commission has certified the candidate as a participating candidate under this title as of the time the candidate submits such statement), so long as the candidate has not submitted a request for payment under section 502.</text></subsection><subsection id="H1FB7989E5132422C8876C199BAD063CB"><enum>(d)</enum><header>Participating Candidate defined</header><text>In this title, a <quote>participating candidate</quote> means a candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress who is certified under this section as eligible to receive benefits under this title.</text></subsection></section></subtitle><subtitle id="H47A06F4C6CFD4D0EB84DA2AFAA49CE01"><enum>C</enum><header>Requirements for Candidates Certified as Participating Candidates</header><section id="HA517008A6BD24164A56C2298B77F419C"><enum>521.</enum><header>Contribution and expenditure requirements</header><subsection id="H6BD9BF5880154605A424995D300EBF73"><enum>(a)</enum><header>Permitted sources of contributions and expenditures</header><text>Except as provided in subsection (c), a participating candidate with respect to an election shall, with respect to all elections occurring during the election cycle for the office involved, accept no contributions from any source and make no expenditures from any amounts, other than the following:</text><paragraph id="H2FEE36908C134339BD3EB52E56E603B2"><enum>(1)</enum><text>Qualified small dollar contributions.</text></paragraph><paragraph id="H0C6A8F72069240829A5CA65A85BF32FD"><enum>(2)</enum><text>Payments under this title.</text></paragraph><paragraph id="H0D23D227946B4C1ABE245D611EDE7655"><enum>(3)</enum><text>Contributions from political committees established and maintained by a national or State political party, subject to the applicable limitations of section 315.</text></paragraph><paragraph id="HB671D1892CF548E49061D733212AB29A"><enum>(4)</enum><text display-inline="yes-display-inline">Subject to subsection (b), personal funds of the candidate or of any immediate family member of the candidate (other than funds received through qualified small dollar contributions).</text></paragraph><paragraph id="H31542C898CF04AF0A5161CC2F037F615"><enum>(5)</enum><text>Contributions from individuals who are otherwise permitted to make contributions under this Act, subject to the applicable limitations of section 315, except that the aggregate amount of contributions a participating candidate may accept from any individual with respect to any election during the election cycle may not exceed $1,000.</text></paragraph><paragraph id="H14C8090C5B734324B2D93E68C19D183B"><enum>(6)</enum><text>Contributions from multicandidate political committees, subject to the applicable limitations of section 315.</text></paragraph></subsection><subsection id="H16C633C26C2C49F7BF95B1A6CC9088AE"><enum>(b)</enum><header>Special rules for personal funds</header><paragraph id="H419E749EEC0341819904715C363AEFE9"><enum>(1)</enum><header>Limit on amount</header><text>A candidate who is certified as a participating candidate may use personal funds (including personal funds of any immediate family member of the candidate) so long as—</text><subparagraph id="HF6B65A14C7D949D0931E008AA8AD887A"><enum>(A)</enum><text>the aggregate amount used with respect to the election cycle (including any period of the cycle occurring prior to the candidate’s certification as a participating candidate) does not exceed $50,000; and</text></subparagraph><subparagraph id="HB8D9219752EA45F6B10A250EC05DCE90"><enum>(B)</enum><text display-inline="yes-display-inline">the funds are used only for making direct payments for the receipt of goods and services which constitute authorized expenditures in connection with the election cycle involved.</text></subparagraph></paragraph><paragraph id="HDE73FF215FC44AAAB4607B87A2EBAB98"><enum>(2)</enum><header>Immediate family member defined</header><text>In this subsection, the term <term>immediate family member</term> means, with respect to a candidate—</text><subparagraph id="H6B7A8D8C96AD4DE28A7F88495E7FC5C6"><enum>(A)</enum><text>the candidate’s spouse;</text></subparagraph><subparagraph id="H122A82F5D5BF40A7BBE78EA692613B2A"><enum>(B)</enum><text>a child, stepchild, parent, grandparent, brother, half-brother, sister, or half-sister of the candidate or the candidate’s spouse; and</text></subparagraph><subparagraph id="H0E34F1F369DE42ECB12533C6D76A6E65"><enum>(C)</enum><text>the spouse of any person described in subparagraph (B).</text></subparagraph></paragraph></subsection><subsection id="H745FE64801D04BE29CF044B03C296455"><enum>(c)</enum><header>Exceptions</header><paragraph id="HC2CF7A4843CC4115850C3E8173E24960"><enum>(1)</enum><header>Exception for contributions received prior to filing of statement of intent</header><text display-inline="yes-display-inline">A candidate who has accepted contributions that are not described in subsection (a) is not in violation of subsection (a), but only if all such contributions are—</text><subparagraph id="HB77F77A2F33A47FDBF927C7FFD728AD2"><enum>(A)</enum><text>returned to the contributor;</text></subparagraph><subparagraph id="HE676488E5CCA4B65A74D90C2864A46BF"><enum>(B)</enum><text>submitted to the Commission for deposit in the Freedom From Influence Fund established under section 541; or</text></subparagraph><subparagraph id="H4DF8FC81C8344147A02E3C49E2A96089"><enum>(C)</enum><text>spent in accordance with paragraph (2).</text></subparagraph></paragraph><paragraph id="H5ED76EEC07A54D37A186FE23B4B4EEC1"><enum>(2)</enum><header>Exception for expenditures made prior to filing of statement of intent</header><text>If a candidate has made expenditures prior to the date the candidate files a statement of intent under section 511(a)(1) that the candidate is prohibited from making under subsection (a) or subsection (b), the candidate is not in violation of such subsection if the aggregate amount of the prohibited expenditures is less than the amount referred to in section 512(a)(2) (relating to the total dollar amount of qualified small dollar contributions which the candidate is required to obtain) which is applicable to the candidate.</text></paragraph><paragraph id="H4E1CE4A663204D848F20FBCEDFA55ABF"><enum>(3)</enum><header>Exception for campaign surpluses from a previous election</header><text>Notwithstanding paragraph (1), unexpended contributions received by the candidate or an authorized committee of the candidate with respect to a previous election may be retained, but only if the candidate places the funds in escrow and refrains from raising additional funds for or spending funds from that account during the election cycle in which a candidate is a participating candidate.</text></paragraph><paragraph id="H81C77858190B48F5A6E45E7E5B8779A4"><enum>(4)</enum><header>Exception for contributions received before the effective date of this title</header><text>Contributions received and expenditures made by the candidate or an authorized committee of the candidate prior to the effective date of this title shall not constitute a violation of subsection (a) or (b). Unexpended contributions shall be treated the same as campaign surpluses under paragraph (3), and expenditures made shall count against the limit in paragraph (2).</text></paragraph></subsection><subsection id="HF79AC613F7C6438DBB4ABB5AD43CC4E6"><enum>(d)</enum><header>Special Rule for Coordinated Party Expenditures</header><text>For purposes of this section, a payment made by a political party in coordination with a participating candidate shall not be treated as a contribution to or as an expenditure made by the participating candidate.</text></subsection><subsection id="H13DA1895E2EE4ECAA663F6D2EBA3E004"><enum>(e)</enum><header>Prohibition on joint fundraising committees</header><paragraph id="HEF31FD7239AA45519A577343B3FE34FD"><enum>(1)</enum><header>Prohibition</header><text>An authorized committee of a candidate who is certified as a participating candidate under this title with respect to an election may not establish a joint fundraising committee with a political committee other than another authorized committee of the candidate.</text></paragraph><paragraph id="H599D85C5C2CB430B9C4BFC85DDF808ED"><enum>(2)</enum><header>Status of existing committees for prior elections</header><text>If a candidate established a joint fundraising committee described in paragraph (1) with respect to a prior election for which the candidate was not certified as a participating candidate under this title and the candidate does not terminate the committee, the candidate shall not be considered to be in violation of paragraph (1) so long as that joint fundraising committee does not receive any contributions or make any disbursements during the election cycle for which the candidate is certified as a participating candidate under this title.</text></paragraph></subsection><subsection id="HD1EB961AE2804B16AB7CAD5A82C41794"><enum>(f)</enum><header>Prohibition on Leadership PACs</header><paragraph id="HBB0F2FD6437E4A149E631B25FB99B01C"><enum>(1)</enum><header>Prohibition</header><text>A candidate who is certified as a participating candidate under this title with respect to an election may not associate with, establish, finance, maintain, or control a leadership PAC.</text></paragraph><paragraph id="HCE723C74931B4C2C8F4AAF923976D3D1"><enum>(2)</enum><header>Status of existing leadership PACs</header><text>If a candidate established, financed, maintained, or controlled a leadership PAC prior to being certified as a participating candidate under this title and the candidate does not terminate the leadership PAC, the candidate shall not be considered to be in violation of paragraph (1) so long as the leadership PAC does not receive any contributions or make any disbursements during the election cycle for which the candidate is certified as a participating candidate under this title.</text></paragraph><paragraph id="HAFC34E57C09F43F1884F292C0D7D5E8E"><enum>(3)</enum><header>Leadership PAC defined</header><text>In this subsection, the term <term>leadership PAC</term> has the meaning given such term in section 304(i)(8)(B). </text></paragraph></subsection></section><section id="H735DF8B31F6A4C2D99829A5A5BF8D628"><enum>522.</enum><header>Administration of campaign</header><subsection id="H47ECD141E184442880CD10DEF9E7FD0B"><enum>(a)</enum><header>Separate accounting for various permitted contributions</header><text display-inline="yes-display-inline">Each authorized committee of a candidate certified as a participating candidate under this title—</text><paragraph id="H6E30AD44588E458A95640FC6D04E3A2B"><enum>(1)</enum><text>shall provide for separate accounting of each type of contribution described in section 521(a) which is received by the committee; and</text></paragraph><paragraph id="HDD129969D99C4590AC2237510299ACD9"><enum>(2)</enum><text>shall provide for separate accounting for the payments received under this title.</text></paragraph></subsection><subsection id="HF250B4726FB54B668ACC4C8B2B2663FD"><enum>(b)</enum><header>Enhanced disclosure of information on donors</header><paragraph id="H133C8DD6410E46C2883960CF37254C2C"><enum>(1)</enum><header>Mandatory identification of individuals making qualified small dollar contributions</header><text display-inline="yes-display-inline">Each authorized committee of a participating candidate under this title shall, in accordance with section 304(b)(3)(A), include in the reports the committee submits under section 304 the identification of each person who makes a qualified small dollar contribution to the committee.</text></paragraph><paragraph id="HC87FCAABF4EB44C2AEFD99448525DA90"><enum>(2)</enum><header>Mandatory disclosure through Internet</header><text>Each authorized committee of a participating candidate under this title shall ensure that all information reported to the Commission under this Act with respect to contributions and expenditures of the committee is available to the public on the internet (whether through a site established for purposes of this subsection, a hyperlink on another public site of the committee, or a hyperlink on a report filed electronically with the Commission) in a searchable, sortable, and downloadable manner.</text></paragraph></subsection></section><section id="HCE4C699AE57E4FBDAD1A5A2A594DD770"><enum>523.</enum><header>Preventing unnecessary spending of public funds</header><subsection id="HBAC2795AF7124C64BCC121599624A8C5"><enum>(a)</enum><header>Mandatory spending of available private funds</header><text display-inline="yes-display-inline">An authorized committee of a candidate certified as a participating candidate under this title may not make any expenditure of any payments received under this title in any amount unless the committee has made an expenditure in an equivalent amount of funds received by the committee which are described in paragraphs (1), (3), (4), (5), and (6) of section 521(a).</text></subsection><subsection id="HBD0F0ECBD282404B9FC87D174DAD37B0"><enum>(b)</enum><header>Limitation</header><text>Subsection (a) applies to an authorized committee only to the extent that the funds referred to in such subsection are available to the committee at the time the committee makes an expenditure of a payment received under this title.</text></subsection></section><section display-inline="no-display-inline" id="H654757C974DB43218ACB4148BB0FF944"><enum>524.</enum><header>Remitting unspent funds after election</header><subsection id="H4163E4A0C37D41EA8B1F50D0117B1F1B"><enum>(a)</enum><header>Remittance required</header><text>Not later than the date that is 180 days after the last election for which a candidate certified as a participating candidate qualifies to be on the ballot during the election cycle involved, such participating candidate shall remit to the Commission for deposit in the Freedom From Influence Fund established under section 541 an amount equal to the balance of the payments received under this title by the authorized committees of the candidate which remain unexpended as of such date.</text></subsection><subsection id="H7D4782DF096540E4AF5082A1B63B4C46"><enum>(b)</enum><header>Permitting candidates participating in next election cycle To retain portion of unspent funds</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), a participating candidate may withhold not more than $100,000 from the amount required to be remitted under subsection (a) if the candidate files a signed affidavit with the Commission that the candidate will seek certification as a participating candidate with respect to the next election cycle, except that the candidate may not use any portion of the amount withheld until the candidate is certified as a participating candidate with respect to that next election cycle. If the candidate fails to seek certification as a participating candidate prior to the last day of the Small Dollar Democracy qualifying period for the next election cycle (as described in section 511), or if the Commission notifies the candidate of the Commission’s determination does not meet the requirements for certification as a participating candidate with respect to such cycle, the candidate shall immediately remit to the Commission the amount withheld. </text></subsection></section></subtitle><subtitle id="HE5F228B3128D4F079284BBB17BFF4A63"><enum>D</enum><header>Enhanced Match Support</header><section id="HA6C683992E0D437594206C814A233414"><enum>531.</enum><header>Enhanced support for general election</header><subsection id="H7FA2DFEB831241F99D2CC6892ED904A1"><enum>(a)</enum><header>Availability of Enhanced Support</header><text display-inline="yes-display-inline">In addition to the payments made under subtitle A, the Commission shall make an additional payment to an eligible candidate under this subtitle.</text></subsection><subsection id="H954DEC46D8DE4623AE430CB2AC29A740"><enum>(b)</enum><header>Use of funds</header><text display-inline="yes-display-inline">A candidate shall use the additional payment under this subtitle only for authorized expenditures in connection with the election involved.</text></subsection></section><section id="H211856ABAB76438F982696BEE9E38EAA"><enum>532.</enum><header>Eligibility</header><subsection id="H43F91B687844421E8D9A6BC75CE27CF3"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">A candidate is eligible to receive an additional payment under this subtitle if the candidate meets each of the following requirements:</text><paragraph id="H3724DDE110784282A84168FEB155E60F"><enum>(1)</enum><text>The candidate is on the ballot for the general election for the office the candidate seeks.</text></paragraph><paragraph id="H462E0B9F0F024F5DA7E712AD04DAEA7D"><enum>(2)</enum><text>The candidate is certified as a participating candidate under this title with respect to the election.</text></paragraph><paragraph id="H9CDC42E61F994AB2820A0CFE8FB32515"><enum>(3)</enum><text>During the enhanced support qualifying period, the candidate receives qualified small dollar contributions in a total amount of not less than $50,000.</text></paragraph><paragraph id="H87EBAD3F13C14DF5966D982434A5CDE8"><enum>(4)</enum><text>During the enhanced support qualifying period, the candidate submits to the Commission a request for the payment which includes—</text><subparagraph id="HD67F083400B64978BEC0C4C04894045F"><enum>(A)</enum><text display-inline="yes-display-inline">a statement of the number and amount of qualified small dollar contributions received by the candidate during the enhanced support qualifying period;</text></subparagraph><subparagraph id="H2B24FEF12AAF4FC1B4D9B41DDB2B7C28"><enum>(B)</enum><text>a statement of the amount of the payment the candidate anticipates receiving with respect to the request; and</text></subparagraph><subparagraph id="H3FB7181F5F0A4A28B05C86FE7E70B1B9"><enum>(C)</enum><text>such other information and assurances as the Commission may require.</text></subparagraph></paragraph><paragraph id="H2A5C088FF8A34595924062D2148D87FF"><enum>(5)</enum><text>After submitting a request for the additional payment under paragraph (4), the candidate does not submit any other application for an additional payment under this subtitle.</text></paragraph></subsection><subsection id="HEBBC94F19A8A49ED980281985B8FE1E3"><enum>(b)</enum><header>Enhanced Support Qualifying Period Described</header><text display-inline="yes-display-inline">In this subtitle, the term <term>enhanced support qualifying period</term> means, with respect to a general election, the period which begins 60 days before the date of the election and ends 14 days before the date of the election.</text></subsection></section><section id="H2115A365BBC7416AA04F6DE83F260FAC"><enum>533.</enum><header>Amount</header><subsection id="HBC6696CC27AC44B6AC2774077B62A07A"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subject to subsection (b), the amount of the additional payment made to an eligible candidate under this subtitle shall be an amount equal to 50 percent of—</text><paragraph id="HCBF434036298430E89D028534051BEBD"><enum>(1)</enum><text>the amount of the payment made to the candidate under section 501(b) with respect to the qualified small dollar contributions which are received by the candidate during the enhanced support qualifying period (as included in the request submitted by the candidate under section 532(a)(4)); or</text></paragraph><paragraph id="H2A7200AE35B74748864A91E4FBFB501A"><enum>(2)</enum><text>in the case of a candidate who is not eligible to receive a payment under section 501(b) with respect to such qualified small dollar contributions because the candidate has reached the limit on the aggregate amount of payments under subtitle A for the election cycle under section 501(c), the amount of the payment which would have been made to the candidate under section 501(b) with respect to such qualified small dollar contributions if the candidate had not reached such limit.</text></paragraph></subsection><subsection id="H4C97D41BCFB849AAAAC9F2906CC0B419"><enum>(b)</enum><header>Limit</header><text>The amount of the additional payment determined under subsection (a) with respect to a candidate may not exceed $500,000.</text></subsection><subsection id="H124734892DD043F59A1608F9512EDA24"><enum>(c)</enum><header>No Effect on Aggregate Limit</header><text display-inline="yes-display-inline">The amount of the additional payment made to a candidate under this subtitle shall not be included in determining the aggregate amount of payments made to a participating candidate with respect to an election cycle under section 501(c).</text></subsection></section><section id="H7505C309BA984610B399808C789D4E30"><enum>534.</enum><header>Waiver of authority to retain portion of unspent funds after election</header><text display-inline="no-display-inline">Notwithstanding section 524(a)(2), a candidate who receives an additional payment under this subtitle with respect to an election is not permitted to withhold any portion from the amount of unspent funds the candidate is required to remit to the Commission under section 524(a)(1).</text></section></subtitle><subtitle id="H82D649DCAD3C45CA8F43C622D9D19630"><enum>E</enum><header>Administrative Provisions</header><section id="H49D82B4C7CBF479099187A3C65DB41A7"><enum>541.</enum><header>Freedom From Influence Fund</header><subsection id="HAACD0372C59B44C2B293416095D11214"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury a fund to be known as the <quote>Freedom From Influence Fund</quote>.</text></subsection><subsection id="HF385DB5D90754D1AAE668D6AB9189EBB"><enum>(b)</enum><header>Amounts held by Fund</header><text>The Fund shall consist of the following amounts:</text><paragraph id="HB6F193FAB4994335B285C8C56C35A041"><enum>(1)</enum><header>Assessments against fines, settlements, and penalties</header><text display-inline="yes-display-inline">Amounts transferred under section 3015 of title 18, United States Code, section 9706 of title 31, United States Code, and <external-xref legal-doc="usc" parsable-cite="usc/26/6761">section 6761</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="H030E01442EFE4A99B6CF4F16D04F9332"><enum>(2)</enum><header>Deposits</header><text>Amounts deposited into the Fund under—</text><subparagraph id="HD7D209D9A4824C358B2EBEA8FEE7AB3D"><enum>(A)</enum><text>section 521(c)(1)(B) (relating to exceptions to contribution requirements);</text></subparagraph><subparagraph id="H207790E5C91F4D2AA4C8F2F484F36289"><enum>(B)</enum><text>section 523 (relating to remittance of unused payments from the Fund); and</text></subparagraph><subparagraph id="H040A18FB59E34E479D91D22975E53429"><enum>(C)</enum><text>section 544 (relating to violations).</text></subparagraph></paragraph></subsection><subsection id="HB2B795F12DBB4CA3BF7EEDDD95E5410E"><enum>(c)</enum><header>Use of Fund To make payments to participating candidates</header><paragraph id="HDB34E8483CD04D33B4544B1760E21DCE"><enum>(1)</enum><header>Payments to participating candidates</header><text display-inline="yes-display-inline">Amounts in the Fund shall be available without further appropriation or fiscal year limitation to make payments to participating candidates as provided in this title.</text></paragraph><paragraph id="H5EFEDF7FB3FA4F8B859E3C3F7398A436"><enum>(2)</enum><header>Mandatory reduction of payments in case of insufficient amounts in Fund</header><subparagraph id="HD980D5C9AF984D32B6BAC4A702D25F59"><enum>(A)</enum><header>Advance audits by Commission</header><text display-inline="yes-display-inline">Not later than 90 days before the first day of each election cycle (beginning with the first election cycle that begins after the date of the enactment of this title), the Commission shall—</text><clause id="HF423651CA0364789A3D59E2497E33C1A"><enum>(i)</enum><text>audit the Fund to determine whether the amounts in the Fund will be sufficient to make payments to participating candidates in the amounts provided in this title during such election cycle; and</text></clause><clause id="HA58580EBB5B74E8782877BEFEFFC1D78"><enum>(ii)</enum><text>submit a report to Congress describing the results of the audit.</text></clause></subparagraph><subparagraph id="H4D5A2D51E4CF48ECB0B133732D96CAEB"><enum>(B)</enum><header>Reductions in amount of payments</header><clause id="H059FE202FA714DC88791CD62BF87FE4C"><enum>(i)</enum><header>Automatic reduction on pro rata basis</header><text>If, on the basis of the audit described in subparagraph (A), the Commission determines that the amount anticipated to be available in the Fund with respect to the election cycle involved is not, or may not be, sufficient to satisfy the full entitlements of participating candidates to payments under this title for such election cycle, the Commission shall reduce each amount which would otherwise be paid to a participating candidate under this title by such pro rata amount as may be necessary to ensure that the aggregate amount of payments anticipated to be made with respect to the election cycle will not exceed the amount anticipated to be available for such payments in the Fund with respect to such election cycle.</text></clause><clause id="H249011A3E4BD4E4DB9EF9B2BF4267624"><enum>(ii)</enum><header>Restoration of reductions in case of availability of sufficient funds during election cycle</header><text>If, after reducing the amounts paid to participating candidates with respect to an election cycle under clause (i), the Commission determines that there are sufficient amounts in the Fund to restore the amount by which such payments were reduced (or any portion thereof), to the extent that such amounts are available, the Commission may make a payment on a pro rata basis to each such participating candidate with respect to the election cycle in the amount by which such candidate’s payments were reduced under clause (i) (or any portion thereof, as the case may be).</text></clause><clause id="H9DBEAAAA30114BF1BAE484220165DD61"><enum>(iii)</enum><header>No use of amounts from other sources</header><text>In any case in which the Commission determines that there are insufficient moneys in the Fund to make payments to participating candidates under this title, moneys shall not be made available from any other source for the purpose of making such payments.</text></clause></subparagraph></paragraph></subsection><subsection id="H159116519DD34B6E86A387FA905A2169"><enum>(d)</enum><header>Use of Fund To make other payments</header><text>In addition to the use described in subsection (d), amounts in the Fund shall be available without further appropriation or fiscal year limitation—</text><paragraph id="HDA31477CCDE9454DB24CCB8FBA65D2D9"><enum>(1)</enum><text display-inline="yes-display-inline">to make payments to States under the My Voice Voucher Program under the Government By the People Act of 2021, subject to reductions under section 5101(f)(3) of such Act;</text></paragraph><paragraph id="HFC3DC91771464C6AA13CDD28137A05D3"><enum>(2)</enum><text>to make payments to candidates under chapter 95 of subtitle H of the Internal Revenue Code of 1986, subject to reductions under section 9013(b) of such Code; and</text></paragraph><paragraph id="H082905B4F29D495798D67180652E7140"><enum>(3)</enum><text>to make payments to candidates under chapter 96 of subtitle H of the Internal Revenue Code of 1986, subject to reductions under section 9043(b) of such Code.</text></paragraph></subsection><subsection id="H7717BE90974540DCA4820B069B7B785D" display-inline="no-display-inline"><enum>(e)</enum><header>No taxpayer funds permitted</header><text display-inline="yes-display-inline">No taxpayer funds may be deposited into the Fund.</text></subsection><subsection id="H142D6EA8973F41D3B55DB88193DDC998"><enum>(f)</enum><header>Effective date</header><text>This section shall take effect on the date of the enactment of this title.</text></subsection></section><section id="HC7129989F9C8444BB3F8133ED02366B0"><enum>542.</enum><header>Reviews and reports by Government Accountability Office</header><subsection id="H14E051A6CA53405781EE37B4AE09C39E"><enum>(a)</enum><header>Review of Small Dollar financing</header><paragraph id="H04D066A26AB14D32BD3D31332A80B247"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">After each regularly scheduled general election for Federal office, the Comptroller General of the United States shall conduct a comprehensive review of the Small Dollar financing program under this title, including—</text><subparagraph id="H819FEC99D7FD4EC5819BD57F2F3157D8"><enum>(A)</enum><text>the maximum and minimum dollar amounts of qualified small dollar contributions under section 504;</text></subparagraph><subparagraph id="H3020733822DB440FB6ED8F9A901CE773"><enum>(B)</enum><text>the number and value of qualified small dollar contributions a candidate is required to obtain under section 512(a) to be eligible for certification as a participating candidate;</text></subparagraph><subparagraph id="H71CFB35A6F3A4E0E9E988AD3054DC9E8"><enum>(C)</enum><text>the maximum amount of payments a candidate may receive under this title; </text></subparagraph><subparagraph id="H2F4409625BF940FCAA8FD7B59F0A411E"><enum>(D)</enum><text>the overall satisfaction of participating candidates and the American public with the program; </text></subparagraph><subparagraph id="HC68629C509D54570BED097234224A841" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">the extent to which the program increased opportunities for participation by candidates of diverse racial, gender, and socio-economic backgrounds; and </text></subparagraph><subparagraph id="H61A7B2FF0F1D4176A9544768412EDC0F"><enum>(F)</enum><text display-inline="yes-display-inline">such other matters relating to financing of campaigns as the Comptroller General determines are appropriate.</text></subparagraph></paragraph><paragraph id="HC02CAF7550B647219B726AEB945274B5"><enum>(2)</enum><header>Criteria for review</header><text display-inline="yes-display-inline">In conducting the review under subparagraph (A), the Comptroller General shall consider the following:</text><subparagraph id="H5978CEF5753D463985984961799EFCE5"><enum>(A)</enum><header>Qualified small dollar contributions</header><text display-inline="yes-display-inline">Whether the number and dollar amounts of qualified small dollar contributions required strikes an appropriate balance regarding the importance of voter involvement, the need to assure adequate incentives for participating, and fiscal responsibility, taking into consideration the number of primary and general election participating candidates, the electoral performance of those candidates, program cost, and any other information the Comptroller General determines is appropriate.</text></subparagraph><subparagraph id="HEB179D19C8494A9FA02A1DEA772FB658"><enum>(B)</enum><header>Review of payment levels</header><text display-inline="yes-display-inline">Whether the totality of the amount of funds allowed to be raised by participating candidates (including through qualified small dollar contributions) and payments under this title are sufficient for voters in each State to learn about the candidates to cast an informed vote, taking into account the historic amount of spending by winning candidates, media costs, primary election dates, and any other information the Comptroller General determines is appropriate.</text></subparagraph></paragraph><paragraph id="H42915634F14B444C98FC4136E1C4F787"><enum>(3)</enum><header>Recommendations for adjustment of amounts</header><text display-inline="yes-display-inline">Based on the review conducted under subparagraph (A), the Comptroller General may recommend to Congress adjustments of the following amounts:</text><subparagraph id="HD68492E5A8034302A164E8160F04ECD6"><enum>(A)</enum><text display-inline="yes-display-inline">The number and value of qualified small dollar contributions a candidate is required to obtain under section 512(a) to be eligible for certification as a participating candidate.</text></subparagraph><subparagraph id="H7BFCCB08C66D4776ACE17F679A465DF3"><enum>(B)</enum><text>The maximum amount of payments a candidate may receive under this title.</text></subparagraph></paragraph></subsection><subsection id="H160F6B00989E45AF868C4126FC470CB5"><enum>(b)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than each June 1 which follows a regularly scheduled general election for Federal office for which payments were made under this title, the Comptroller General shall submit to the Committee on House Administration of the House of Representatives a report—</text><paragraph id="H944DA04971824CF79D96C21936583604"><enum>(1)</enum><text>containing an analysis of the review conducted under subsection (a), including a detailed statement of Comptroller General’s findings, conclusions, and recommendations based on such review, including any recommendations for adjustments of amounts described in subsection (a)(3); and</text></paragraph><paragraph id="HE4BD877EBB3144789B02C354B66C20DF"><enum>(2)</enum><text>documenting, evaluating, and making recommendations relating to the administrative implementation and enforcement of the provisions of this title.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE8260257C9B84F2BA7CB15732F09929F"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as are necessary to carry out the purposes of this section.</text></subsection></section><section id="H6B1502D7EC2746A9BD8923CD62D2E5EE"><enum>543.</enum><header>Administration by Commission</header><text display-inline="no-display-inline">The Commission shall prescribe regulations to carry out the purposes of this title, including regulations to establish procedures for—</text><paragraph id="HC9B19FE31B5249FB8639288A95A3A8A6"><enum>(1)</enum><text>verifying the amount of qualified small dollar contributions with respect to a candidate;</text></paragraph><paragraph id="HEE619A294C2B4C9C977221582C49202F" commented="no"><enum>(2)</enum><text>effectively and efficiently monitoring and enforcing the limits on the raising of qualified small dollar contributions;</text></paragraph><paragraph id="H981387F6EF35488B90011001C4A39911"><enum>(3)</enum><text>effectively and efficiently monitoring and enforcing the limits on the use of personal funds by participating candidates; and</text></paragraph><paragraph id="H424264AF591E4E6280D6DCF353F20394"><enum>(4)</enum><text>monitoring the use of allocations from the Freedom From Influence Fund established under section 541 and matching contributions under this title through audits of not fewer than <fraction>1/10</fraction> (or, in the case of the first 3 election cycles during which the program under this title is in effect, not fewer than <fraction>1/3</fraction>) of all participating candidates or other mechanisms.</text></paragraph></section><section id="H8E9F060330884A6BBABBA44BB9F9932C"><enum>544.</enum><header>Violations and penalties</header><subsection id="H631D0D8759624D9D9D071091046570FD"><enum>(a)</enum><header>Civil penalty for violation of contribution and expenditure requirements</header><text display-inline="yes-display-inline">If a candidate who has been certified as a participating candidate accepts a contribution or makes an expenditure that is prohibited under section 521, the Commission may assess a civil penalty against the candidate in an amount that is not more than 3 times the amount of the contribution or expenditure. Any amounts collected under this subsection shall be deposited into the Freedom From Influence Fund established under section 541.</text></subsection><subsection commented="no" id="H0E81F221CD6247E781EE79F2FA710026"><enum>(b)</enum><header>Repayment for improper use of Freedom From Influence Fund</header><paragraph commented="no" id="H9A4417763479497A90647F0D5E0D289E"><enum>(1)</enum><header>In general</header><text>If the Commission determines that any payment made to a participating candidate was not used as provided for in this title or that a participating candidate has violated any of the dates for remission of funds contained in this title, the Commission shall so notify the candidate and the candidate shall pay to the Fund an amount equal to—</text><subparagraph commented="no" id="H95ECDED2BFFF4C73994EBCF6949D006A"><enum>(A)</enum><text>the amount of payments so used or not remitted, as appropriate; and</text></subparagraph><subparagraph commented="no" id="H70DBC19F3BEC4D52911786357ACBEB20"><enum>(B)</enum><text>interest on any such amounts (at a rate determined by the Commission).</text></subparagraph></paragraph><paragraph commented="no" id="H8229B87A472F438AA0AE3E376EF6AC79"><enum>(2)</enum><header>Other action not precluded</header><text>Any action by the Commission in accordance with this subsection shall not preclude enforcement proceedings by the Commission in accordance with section 309(a), including a referral by the Commission to the Attorney General in the case of an apparent knowing and willful violation of this title.</text></paragraph></subsection><subsection id="HA3423C121E914518A71C3B628DFD2953"><enum>(c)</enum><header>Prohibiting certain candidates from qualifying as participating candidates</header><paragraph id="HAC09203DCFC0456DBAC12AF4938BB406"><enum>(1)</enum><header>Candidates with multiple civil penalties</header><text display-inline="yes-display-inline">If the Commission assesses 3 or more civil penalties under subsection (a) against a candidate (with respect to either a single election or multiple elections), the Commission may refuse to certify the candidate as a participating candidate under this title with respect to any subsequent election, except that if each of the penalties were assessed as the result of a knowing and willful violation of any provision of this Act, the candidate is not eligible to be certified as a participating candidate under this title with respect to any subsequent election.</text></paragraph><paragraph id="HCB38E2E863194099A594BD87056CB8EE"><enum>(2)</enum><header>Candidates subject to criminal penalty</header><text>A candidate is not eligible to be certified as a participating candidate under this title with respect to an election if a penalty has been assessed against the candidate under section 309(d) with respect to any previous election.</text></paragraph></subsection><subsection id="H4ACDA129DDB04ECDA459851ED2E6947C"><enum>(d)</enum><header>Imposition of criminal penalties</header><text>For criminal penalties for the failure of a participating candidate to comply with the requirements of this title, see section 309(d).</text></subsection></section><section id="HDE808056F99942B997F317A9CA3FB30F"><enum>545.</enum><header>Appeals process</header><subsection id="HD6647661716247F8BE66B4399D31AC8C"><enum>(a)</enum><header>Review of Actions</header><text display-inline="yes-display-inline">Any action by the Commission in carrying out this title shall be subject to review by the United States Court of Appeals for the District of Columbia upon petition filed in the Court not later than 30 days after the Commission takes the action for which the review is sought.</text></subsection><subsection id="H97C4CFF25F074BA18B1302BD2F720ADF"><enum>(b)</enum><header>Procedures</header><text>The provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code, apply to judicial review under this section.</text></subsection></section><section id="H9084630745C3481B9342EC3B69C3695E"><enum>546.</enum><header>Indexing of amounts</header><subsection id="H5578B5C8BBE34659A715BD1CE4680603"><enum>(a)</enum><header>Indexing</header><text display-inline="yes-display-inline">In any calendar year after 2026, section 315(c)(1)(B) shall apply to each amount described in subsection (b) in the same manner as such section applies to the limitations established under subsections (a)(1)(A), (a)(1)(B), (a)(3), and (h) of such section, except that for purposes of applying such section to the amounts described in subsection (b), the <quote>base period</quote> shall be 2026.</text></subsection><subsection id="HDC09B6527DFD483092134F8EB0557C3A"><enum>(b)</enum><header>Amounts described</header><text>The amounts described in this subsection are as follows:</text><paragraph id="H8AE7FC764C0448B3A6F4FBD1B796AB9C"><enum>(1)</enum><text>The amount referred to in section 502(b)(1) (relating to the minimum amount of qualified small dollar contributions included in a request for payment).</text></paragraph><paragraph id="H31143A5B0D2C4B07AC629AF17FAC6639"><enum>(2)</enum><text>The amounts referred to in section 504(a)(1) (relating to the amount of a qualified small dollar contribution).</text></paragraph><paragraph id="HE4167C17D318475A93D9ABC9A109EA7B"><enum>(3)</enum><text>The amount referred to in section 512(a)(2) (relating to the total dollar amount of qualified small dollar contributions).</text></paragraph><paragraph id="H093CEA7D2DC44D6AAF6873EAEE550F8E"><enum>(4)</enum><text display-inline="yes-display-inline">The amount referred to in section 521(a)(5) (relating to the aggregate amount of contributions a participating candidate may accept from any individual with respect to an election).</text></paragraph><paragraph id="H11D7E4F060D3475B9A6B168EC3534300"><enum>(5)</enum><text>The amount referred to in section 521(b)(1)(A) (relating to the amount of personal funds that may be used by a candidate who is certified as a participating candidate).</text></paragraph><paragraph id="H8B2491A1398042EDA9138E63F25B60A5"><enum>(6)</enum><text>The amounts referred to in section 524(a)(2) (relating to the amount of unspent funds a candidate may retain for use in the next election cycle).</text></paragraph><paragraph id="H7FC6232847ED4CDFA03FFD70630A28DE"><enum>(7)</enum><text>The amount referred to in section 532(a)(3) (relating to the total dollar amount of qualified small dollar contributions for a candidate seeking an additional payment under subtitle D).</text></paragraph><paragraph id="H20A4CCC99E6C4A51921FDF6F7A2E058F"><enum>(8)</enum><text>The amount referred to in section 533(b) (relating to the limit on the amount of an additional payment made to a candidate under subtitle D).</text></paragraph></subsection></section><section id="HA79CCC1C120E4017A375624CD81DFB21"><enum>547.</enum><header>Election cycle defined</header><text display-inline="no-display-inline">In this title, the term <term>election cycle</term> means, with respect to an election for an office, the period beginning on the day after the date of the most recent general election for that office (or, if the general election resulted in a runoff election, the date of the runoff election) and ending on the date of the next general election for that office (or, if the general election resulted in a runoff election, the date of the runoff election).</text></section></subtitle></title><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9A79C15384234A8398105E7AA6D239BE"><enum>202.</enum><header>Contributions and expenditures by multicandidate and political party committees on behalf of participating candidates</header><subsection id="HEED3AEE4D1664DB7A4CD76AB918C346A"><enum>(a)</enum><header>Authorizing Contributions Only From Separate Accounts Consisting of Qualified small dollar contributions</header><text display-inline="yes-display-inline">Section 315(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30116">52 U.S.C. 30116(a)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="traditional" id="H982F0CB3155A4BCFBF1E7483FAC84F2B" display-inline="no-display-inline"><paragraph id="HF18943BC5BEC4E449606EDDEA87DD352" indent="up1"><enum>(10)</enum><text>In the case of a multicandidate political committee or any political committee of a political party, the committee may make a contribution to a candidate who is a participating candidate under title V with respect to an election only if the contribution is paid from a separate, segregated account of the committee which consists solely of contributions which meet the following requirements:</text><subparagraph id="H4C6357AB91F7459F89925CF198BF10F3"><enum>(A)</enum><text>Each such contribution is in an amount which meets the requirements for the amount of a qualified small dollar contribution under section 504(a)(1) with respect to the election involved.</text></subparagraph><subparagraph id="H9A9A4A73EBDD457387299D4BCA7311A8"><enum>(B)</enum><text>Each such contribution is made by an individual who is not otherwise prohibited from making a contribution under this Act.</text></subparagraph><subparagraph id="HF901A55289A64E33AB5F7F27FFC159B0"><enum>(C)</enum><text display-inline="yes-display-inline">The individual who makes the contribution does not make contributions to the committee during the year in an aggregate amount that exceeds the limit described in section 504(a)(1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD0E50785D49B4E5C838A949D448EDBBF"><enum>(b)</enum><header>Permitting Unlimited Coordinated Expenditures From Small Dollar Sources by Political Parties</header><text>Section 315(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30116">52 U.S.C. 30116(d)</external-xref>) is amended—</text><paragraph id="HDB38E25D97A54AC9BB2A61C17572E8DB"><enum>(1)</enum><text>in paragraph (3), by striking <quote>The national committee</quote> and inserting <quote>Except as provided in paragraph (6), the national committee</quote>; and</text></paragraph><paragraph id="H31D938252F97477C84F05BFCBF7A49FA"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="traditional" id="HB7FB9066A6D547A8B579F065D812902B" display-inline="no-display-inline"><paragraph id="H96E8BDDBF45C4DC3A9C7C296C4129B1F" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The limits described in paragraph (3) do not apply in the case of expenditures in connection with the general election campaign of a candidate for the office of Representative in, or Delegate or Resident Commissioner to, the Congress who is a participating candidate under title V with respect to the election, but only if—</text><subparagraph id="HE9B492D41485408CB52B528BC4E7A223"><enum>(A)</enum><text>the expenditures are paid from a separate, segregated account of the committee which is described in subsection (a)(10); and</text></subparagraph><subparagraph id="H94EA0B3310E54B67AE06541B3F948092"><enum>(B)</enum><text>the expenditures are the sole source of funding provided by the committee to the candidate.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HB10B00CB8D0347BAB32EDB2716226087"><enum>203.</enum><header>Prohibiting use of contributions by participating candidates for purposes other than campaign for election</header><text display-inline="no-display-inline">Section 313 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30114">52 U.S.C. 30114</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H441E590C186345828B87CD750B60AAA8" style="OLC"><subsection id="H8E96CD0FF76C4A45AC186A4860AE234D"><enum>(d)</enum><header>Restrictions on Permitted Uses of Funds by Candidates Receiving Small Dollar Financing</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2), (3), or (4) of subsection (a), if a candidate for election for the office of Representative in, or Delegate or Resident Commissioner to, the Congress is certified as a participating candidate under title V with respect to the election, any contribution which the candidate is permitted to accept under such title may be used only for authorized expenditures in connection with the candidate’s campaign for such office, subject to section 503(b).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HED6B7FB3DE9B4B6EB3740D8654520AAC"><enum>204.</enum><header>Assessments against fines and penalties</header><subsection id="H173FF208A70B4192AF01260042D6D012"><enum>(a)</enum><header>Assessments relating to criminal offenses</header><paragraph id="HE9773D2EAC354C268ACB72C851F4EA4D"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">Chapter 201</external-xref> of title 18, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="H1B3188521B394EA38DDDA1AC4A79EE6A" display-inline="no-display-inline"><section id="HDD3A24CB52304D5F83BF360626433FBD"><enum>3015.</enum><header>Special assessments for Freedom From Influence Fund</header><subsection id="H80CE9A242A9E43F58E0567FAE5DAC81A"><enum>(a)</enum><header>Assessments</header><paragraph id="HE066E12DBE0145BA910B4048AC245675"><enum>(1)</enum><header>Convictions of crimes</header><text>In addition to any assessment imposed under this chapter, the court shall assess on any organizational defendant or any defendant who is a corporate officer or person with equivalent authority in any other organization who is convicted of a criminal offense under Federal law an amount equal to 4.75 percent of any fine imposed on that defendant in the sentence imposed for that conviction. </text></paragraph><paragraph id="H9608C08A8E2046238FDBA660BA11E145"><enum>(2)</enum><header>Settlements</header><text display-inline="yes-display-inline">The court shall assess on any organizational defendant or defendant who is a corporate officer or person with equivalent authority in any other organization who has entered into a settlement agreement or consent decree with the United States in satisfaction of any allegation that the defendant committed a criminal offense under Federal law an amount equal to 4.75 percent of the amount of the settlement.</text></paragraph></subsection><subsection id="H3C4C60C3DE4F44EBAEFA8D7E6BE22218"><enum>(b)</enum><header>Manner of collection</header><text display-inline="yes-display-inline">An amount assessed under subsection (a) shall be collected in the manner in which fines are collected in criminal cases.</text></subsection><subsection id="H85FE1F5BD55C40339236D11E02726BA4"><enum>(c)</enum><header>Transfers</header><text display-inline="yes-display-inline">In a manner consistent with section 3302(b) of title 31, there shall be transferred from the General Fund of the Treasury to the Freedom From Influence Fund under section 541 of the Federal Election Campaign Act of 1971 an amount equal to the amount of the assessments collected under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H134A58B1B962477FAFFE57F7C223D75F"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/201">chapter 201</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" Special assessments for Freedom From Influence Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC0131BE14DD345CA87C2FE54E934416F"><enum>(b)</enum><header>Assessments relating to civil penalties</header><paragraph id="HBD15BAE43D0E476C8FC0DBBBB93A5E0F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/97">Chapter 97</external-xref> of title 31, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HC50D3F9D819144FDB5EF6CEBE6250229" display-inline="no-display-inline"><section id="HFC9185A9A5534FDB80F972EF0748B33C"><enum>9706.</enum><header>Special assessments for Freedom From Influence Fund</header><subsection id="HC683727AB2844A518AB61CB0D13860F1"><enum>(a)</enum><header>Assessments</header><paragraph id="H4723A5C4935E409C95BB9788B729AA8B"><enum>(1)</enum><header>Civil penalties</header><text display-inline="yes-display-inline">Any entity of the Federal Government which is authorized under any law, rule, or regulation to impose a civil penalty shall assess on each person, other than a natural person who is not a corporate officer or person with equivalent authority in any other organization, on whom such a penalty is imposed an amount equal to 4.75 percent of the amount of the penalty.</text></paragraph><paragraph id="H3446B59AAB584930B80719FA2DD12D33"><enum>(2)</enum><header>Administrative penalties</header><text display-inline="yes-display-inline">Any entity of the Federal Government which is authorized under any law, rule, or regulation to impose an administrative penalty shall assess on each person, other than a natural person who is not a corporate officer or person with equivalent authority in any other organization, on whom such a penalty is imposed an amount equal to 4.75 percent of the amount of the penalty.</text></paragraph><paragraph id="H45D04C49CEC34713AB76CD076DFC8D4B"><enum>(3)</enum><header>Settlements</header><text display-inline="yes-display-inline">Any entity of the Federal Government which is authorized under any law, rule, or regulation to enter into a settlement agreement or consent decree with any person, other than a natural person who is not a corporate officer or person with equivalent authority in any other organization, in satisfaction of any allegation of an action or omission by the person which would be subject to a civil penalty or administrative penalty shall assess on such person an amount equal to 4.75 percent of the amount of the settlement.</text></paragraph></subsection><subsection id="HB85DB35F36EB4DC7BBC05AB88805C803"><enum>(b)</enum><header>Manner of collection</header><text>An amount assessed under subsection (a) shall be collected—</text><paragraph id="H604F48359F6C4651943CDC302E58E58E"><enum>(1)</enum><text>in the case of an amount assessed under paragraph (1) of such subsection, in the manner in which civil penalties are collected by the entity of the Federal Government involved;</text></paragraph><paragraph id="H4BE2A4929A084BA1802BAA23B2AFAACA"><enum>(2)</enum><text>in the case of an amount assessed under paragraph (2) of such subsection, in the manner in which administrative penalties are collected by the entity of the Federal Government involved; and</text></paragraph><paragraph id="HA3B881217E454C898C1C755E1B4481B6"><enum>(3)</enum><text>in the case of an amount assessed under paragraph (3) of such subsection, in the manner in which amounts are collected pursuant to settlement agreements or consent decrees entered into by the entity of the Federal Government involved.</text></paragraph></subsection><subsection id="H97D733568E444873A5A6F7F5D556FE39"><enum>(c)</enum><header>Transfers</header><text display-inline="yes-display-inline">In a manner consistent with section 3302(b) of this title, there shall be transferred from the General Fund of the Treasury to the Freedom From Influence Fund under section 541 of the Federal Election Campaign Act of 1971 an amount equal to the amount of the assessments collected under this section.</text></subsection><subsection id="HA62741261CE54F3487E826CBA2F15E50"><enum>(d)</enum><header>Exception for penalties and settlements under authority of the Internal Revenue Code of 1986</header><paragraph id="HA8BECDEF92E844D79C73229C4EA3068D"><enum>(1)</enum><header>In general</header><text>No assessment shall be made under subsection (a) with respect to any civil or administrative penalty imposed, or any settlement agreement or consent decree entered into, under the authority of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="HBB0F32A09C704189B31D1055DD61F8B1"><enum>(2)</enum><header>Cross reference</header><text>For application of special assessments for the Freedom From Influence Fund with respect to certain penalties under the Internal Revenue Code of 1986, see <external-xref legal-doc="usc" parsable-cite="usc/26/6761">section 6761</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HC3ACB5C378F3434E93FF845762B52CA0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/97">chapter 97</external-xref> of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="HA58F9D999EBB47B19E8280A7FCB869C7" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">9706. Special assessments for Freedom From Influence Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF11D3FD71BFA4AA9A63AC35FADB130A8"><enum>(c)</enum><header>Assessments relating to certain penalties under the Internal Revenue Code of 1986</header><paragraph id="H96E3868338B443D89923A22E70D3B00B"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/68">Chapter 68</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subchapter:</text><quoted-block style="OLC" id="H5FF7D04DCD3E4A82AA53C2D457CC0964" display-inline="no-display-inline"><subchapter id="H9BDD466FC96744FC910CAE0E1D27C3CD"><enum>D</enum><header>Special assessments for Freedom From Influence Fund</header><section id="H9D6F822E05AF4B2EB57C044CA316C688"><enum>6761.</enum><header>Special assessments for Freedom From Influence Fund</header><subsection id="HC41B85406D7743B280A90965374680A6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each person required to pay a covered penalty shall pay an additional amount equal to 4.75 percent of the amount of such penalty.</text></subsection><subsection id="HEDB68FE7843948A482B12D060DC235FA"><enum>(b)</enum><header>Covered penalty</header><text>For purposes of this section, the term <term>covered penalty</term> means any addition to tax, additional amount, penalty, or other liability provided under subchapter A or B.</text></subsection><subsection id="H2D6C7E4D422641D3B19CE7D427B3C4A0"><enum>(c)</enum><header>Exception for certain individuals</header><paragraph id="H55C74A960958412CA4022985E031A656"><enum>(1)</enum><header>In general</header><text>In the case of a taxpayer who is an individual, subsection (a) shall not apply to any covered penalty if such taxpayer is an exempt taxpayer for the taxable year for which such covered penalty is assessed.</text></paragraph><paragraph id="H1F85E8278EE34F61802803E80B998CF8"><enum>(2)</enum><header>Exempt taxpayer</header><text>For purposes of this subsection, a taxpayer is an exempt taxpayer for any taxable year if the taxable income of such taxpayer for such taxable year does not exceed the dollar amount at which begins the highest rate bracket in effect under section 1 with respect to such taxpayer for such taxable year.</text></paragraph></subsection><subsection id="H0D7312D214A34853A284CF8740C1967E" commented="no"><enum>(d)</enum><header>Application of certain rules</header><text>Except as provided in subsection (e), the additional amount determined under subsection (a) shall be treated for purposes of this title in the same manner as the covered penalty to which such additional amount relates. </text></subsection><subsection id="HB233E0AF7E7A4EFDABB412F760EDEF2B"><enum>(e)</enum><header>Transfer to Freedom From Influence Fund</header><text display-inline="yes-display-inline">The Secretary shall deposit any additional amount under subsection (a) in the General Fund of the Treasury and shall transfer from such General Fund to the Freedom From Influence Fund established under section 541 of the Federal Election Campaign Act of 1971 an amount equal to the amounts so deposited (and, notwithstanding subsection (d), such additional amount shall not be the basis for any deposit, transfer, credit, appropriation, or any other payment, to any other trust fund or account). Rules similar to the rules of section 9601 shall apply for purposes of this subsection.</text></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HB6858D94C77149E4AC791959DC2F6B58"><enum>(2)</enum><header>Clerical amendment</header><text>The table of subchapters for chapter 68 of such Code is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="H71D5BB98FF06424794A5EFA54DA0A311" display-inline="no-display-inline"><toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H5FF7D04DCD3E4A82AA53C2D457CC0964" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry idref="H9BDD466FC96744FC910CAE0E1D27C3CD" level="subchapter">Subchapter D—Special assessments for Freedom From Influence Fund</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC80F5B12271E4E6D9BC5C6A3A54B8523"><enum>(d)</enum><header>Effective dates</header><paragraph id="H4CCB692D856241D7A1F4DFEDA3B9178F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), the amendments made by this section shall apply with respect to convictions, agreements, and penalties which occur on or after the date of the enactment of this Act.</text></paragraph><paragraph id="H48420C67815C4991839859E30D6E15E0" commented="no"><enum>(2)</enum><header>Assessments relating to certain penalties under the Internal Revenue Code of 1986</header><text>The amendments made by subsection (c) shall apply to covered penalties assessed after the date of the enactment of this Act.</text></paragraph></subsection></section><section id="H12A44274AF434CF584C69D3D430B1136"><enum>205.</enum><header>Study and report on small dollar financing program</header><subsection id="H370AE8B077C34009A7E04C42DE6F2980"><enum>(a)</enum><header>Study and report</header><text display-inline="yes-display-inline">Not later than 2 years after the completion of the first election cycle in which the program established under title V of the Federal Election Campaign Act of 1971, as added by section 201, is in effect, the Federal Election Commission shall—</text><paragraph id="HA8169B3F31A44BD3915FDAF91A8A0B16"><enum>(1)</enum><text>assess—</text><subparagraph id="H89F7AFE31FBF4142B10CF05E1D8A76A2"><enum>(A)</enum><text>the amount of payment referred to in section 501 of such Act; and</text></subparagraph><subparagraph id="H1F1B8008934C41FD8A1B101E6AE7DF9A"><enum>(B)</enum><text>the amount of a qualified small dollar contribution referred to in section 504(a)(1) of such Act; and</text></subparagraph></paragraph><paragraph id="HB778BB69906C45A39703176EC437C679"><enum>(2)</enum><text>submit to Congress a report that discusses whether such amounts are sufficient to meet the goals of the program.</text></paragraph></subsection><subsection id="HD7B631CBC1074D76AD88F091EE3B23AE"><enum>(b)</enum><header>Update</header><text>The Commission shall update and revise the study and report required by subsection (a) on a biennial basis.</text></subsection><subsection id="H74DFF3F3F4454CDBA0DF2B26277C11B6"><enum>(c)</enum><header>Termination</header><text>The requirements of this section shall terminate 10 years after the date on which the first study and report required by subsection (a) is submitted to Congress.</text></subsection></section><section id="H773BEA3D819143B5BCBA319320279BF7"><enum>206.</enum><header>Effective date</header><subsection id="H214660C35EEB46B1B5C7F1FF891FD0FC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as may otherwise be provided in this title and in the amendments made by this title, this title and the amendments made by this title shall apply with respect to elections occurring during 2030 or any succeeding year, without regard to whether or not the Federal Election Commission has promulgated the final regulations necessary to carry out this title and the amendments made by this title by the deadline set forth in subsection (b).</text></subsection><subsection id="H92E38755F34649679F32D16FA2143590"><enum>(b)</enum><header>Deadline for regulations</header><text>Not later than June 30, 2028, the Federal Election Commission shall promulgate such regulations as may be necessary to carry out this title and the amendments made by this title.</text></subsection></section></title></legis-body></bill>
