as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Housing and Urban Development to establish a universal design standards certification system and to establish a refundable tax credit for individuals and groups that construct or renovate buildings and residences, and for other purposes.</official-title></form><legis-body id="HD885989480544723B57369DE6B1C43FC" style="OLC"><section id="H4331EBDEC0FC455698FE173A04CD671A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Universal Design Standard Tax Incentive Act</short-title></quote>.</text></section><section id="H7BE8815A75FB4144A71D1E01D5C39D09"><enum>2.</enum><header>Certification</header><subsection id="H5523FB57D0834465AE3DF363BAAE5DE1" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the Secretary of Housing and Urban Development, in coordination with the head of each covered agency, shall establish a certification system through which an owner of a dwelling unit or a commercial unit may have such unit certified by the Secretary as meeting the universal design standards. </text></subsection><subsection id="H66AEFEC465104A60B2F5BC00A078FF87"><enum>(b)</enum><header>Working group</header><paragraph id="HD6AF0892CC60484AB9DD419B7C67C7D2" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall, not later than 1 year after the date of the enactment of this section establish a universal design working group.</text></paragraph><paragraph id="H5F5AD8E1E5954F3E971114800AA58F09"><enum>(2)</enum><header>Membership</header><text>The working group established under paragraph (1) shall be made up of—</text><subparagraph id="H9AE5D0FB2D194523B9F0FEB3DB580AD8" commented="no"><enum>(A)</enum><text>staff from Federal agencies, including from—</text><clause id="HEFB4EFA5CD00408A85623F411632685A" commented="no"><enum>(i)</enum><text>the Department of Agriculture;</text></clause><clause id="H6ED61C12ECED435C90A0964B65D4FAF6" commented="no"><enum>(ii)</enum><text>the Department of Veterans Affairs;</text></clause><clause id="H8478649C8AE24651AEA76DD2E9E3608A" commented="no"><enum>(iii)</enum><text>the Federal Housing Finance Agency; and</text></clause><clause id="HE74144FEFAF2407CBC4C2C1C6418C68C" commented="no"><enum>(iv)</enum><text>the Department of Health and Human Services;</text></clause></subparagraph><subparagraph id="HC848214446CD46428C9FCC83D4CAAE35" commented="no"><enum>(B)</enum><text>community partners, including—</text><clause id="HC2288E3B2ADA4CA3A73DE3B5054B5D11" commented="no"><enum>(i)</enum><text>the AARP;</text></clause><clause id="HE6FE15AAA77F42DEA0126279205671CA" commented="no"><enum>(ii)</enum><text>the National Council on Aging;</text></clause><clause id="HF04918B375AB428FBC3042721F63A085" commented="no"><enum>(iii)</enum><text>the Universal Design Project;</text></clause><clause id="H50F6CDE7A4454C31A5C8EADA24052F57" commented="no"><enum>(iv)</enum><text>the Centers for Independent Living;</text></clause><clause id="HBD148299A0384BACB66375A4257DA45C"><enum>(v)</enum><text>Certified Aging-in-Place Specialists; and</text></clause><clause id="HA008F295421E4D3C9CF44F95BE99C61E"><enum>(vi)</enum><text display-inline="yes-display-inline">the National Disability Rights Network.</text></clause></subparagraph><subparagraph id="HF3862F4209AD44C9A36715AD0D0C73D9"><enum>(C)</enum><text>academic partners;</text></subparagraph><subparagraph id="H680E2D21E07A4E58BDAC047D4432F922"><enum>(D)</enum><text>industry partners;</text></subparagraph><subparagraph id="H02FC686B0C9D4D8A8C3DAD27DBAFCDB2" commented="no"><enum>(E)</enum><text>health professionals, including occupational therapists; and</text></subparagraph><subparagraph id="H625E2EB824D54D92805A5F56C9681553"><enum>(F)</enum><text>individuals with lived experience of disability.</text></subparagraph></paragraph><paragraph id="H9E446F4F11604FBC91CD201109C6B935"><enum>(3)</enum><header>Duties</header><text>The working group established by the Secretary pursuant to paragraph (1) shall—</text><subparagraph id="HA9E67D5994C447C4A5F2159CC0AC9667" commented="no"><enum>(A)</enum><text>establish universal design standards that comply with the requirements described in subsection (c) and issue such updates of such standards as the working group determines appropriate;</text></subparagraph><subparagraph id="HC8D36AD8EB2B40479AF5DABA4E94F1AB" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">establish a timeline for the certification process described in subsection (d); </text></subparagraph><subparagraph id="H36F7F91B61CE4670A8E062B35A2A70C7" commented="no"><enum>(C)</enum><text>provide recommendations to the Secretary on the licensing process described in subsection (f); and</text></subparagraph><subparagraph id="HB09146FF890840E895E5A15D3C697916" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">make a recommendation to the Secretary of the Treasury for regulations to determine which buildings renovations are sufficient to qualify for the tax credit established under section 3.</text></subparagraph></paragraph></subsection><subsection id="HC05B9DF45F264B9C88F00FF0EE2B51E6" commented="no"><enum>(c)</enum><header>Standards</header><text display-inline="yes-display-inline">The universal design standards established by the working group described in subsection (b) shall—</text><paragraph id="HF99BE6C1B99E42C7A07F0D5D644F626B" commented="no"><enum> (1)</enum><text>ensure that each certified dwelling unit or commercial unit—</text><subparagraph id="H550CFAC30B7F40B994B020CF4C1856F6" commented="no"><enum>(A)</enum><text>is useful and marketable to people with diverse abilities;</text></subparagraph><subparagraph id="H2F08A51163354E6399F7B2F4E55CCCBD" commented="no"><enum>(B)</enum><text>accommodates a range of individual preferences and abilities;</text></subparagraph><subparagraph id="H4527D7F8EB2C4DD2823A619F25DB8943" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">is designed to provide information to residents and visitors with varying sensory abilities;</text></subparagraph><subparagraph id="H7D96184FAF91444A82833F0B41015B6E" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">is designed in a manner that minimizes hazards and the adverse consequences of accidental or unintended actions;</text></subparagraph><subparagraph id="HE2E6DD87F4D540DD8BDF6A1450A47701"><enum>(E)</enum><text>is designed in a manner that is simple and intuitive to use, regardless of the experience, knowledge, language skills, and concentration level of the user;</text></subparagraph><subparagraph id="H6BA65CD845C6484CAF45876DA22BC082" commented="no"><enum>(F)</enum><text>is designed in a manner to allow for efficient and comfortable use with minimum fatigue; and</text></subparagraph><subparagraph id="HFBC45F2125044B92B378CB46F26891A0" commented="no"><enum>(G)</enum><text>provides appropriate space for approach, reach, manipulation, and use of all aspects of the unit regardless of the body size, posture, or mobility of the resident or visitor to the dwelling unit; </text></subparagraph></paragraph><paragraph id="HFD1ADECC50EF4905AFC8E41076E9B5D8" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">require, at a minimum, that certified dwelling units and commercial units comply with the <quote>ADA Standards for Accessible Design</quote>; and</text></paragraph><paragraph id="H368FC8AD1C8745B7AC1E106667F98545" commented="no"><enum>(3)</enum><text>be updated not later than 5 years from the date of establishment of such standards, and every 5 years thereafter, to reflect any changes in needs of residents or visitors and any changes in technology. </text></paragraph></subsection><subsection id="H9A4E98DC7C5843BEA5A3B755E468ADE6"><enum>(d)</enum><header>Certification</header><paragraph id="H729D602EB33A43B1B25C3EE4D5BB7B3B" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">If an owner of a dwelling unit or commercial unit wants such unit to be certified by the Secretary as complying the universal design standards, such owner shall submit an application for certification to the Secretary at such time and in such manner as the Secretary may reasonably require and such application shall include such information as is necessary for the Secretary to confirm such unit is compliant with the universal design standards.</text></paragraph><paragraph id="HC89B37D814034492B8883D52BD1691D1"><enum>(2)</enum><header>Verification</header><text>All information in any application submitted to the Secretary pursuant to paragraph (1) shall be verified by a licensed inspector, at the cost of the owner of the dwelling unit or commercial unit unless such licensed inspector agrees to provide such inspection on a cost-free basis. </text></paragraph><paragraph id="HC95DDB92DFAE4FC4A8099812ADCE9E28" commented="no"><enum>(3)</enum><header>Certification of multi-unit buildings</header><subparagraph id="H01673D3717AF44718427924407B2F672" commented="no"><enum>(A)</enum><header>Buildings with 1 to 4 units</header><text display-inline="yes-display-inline">With respect to a building containing 1 to 4 dwelling units or commercial units, the property may be certified as accessible if all common areas and all units in the building comply with the universal design standards.</text></subparagraph><subparagraph id="H7605FD76CCFC46D3884D5B34D0F0C825" commented="no"><enum>(B)</enum><header>Buildings with 5 or more units</header><text>With respect to a building containing 5 or more dwelling units or commercial units, the property may be certified as accessible if all common areas in the building comply with the universal design standards and not less than 50 percent of all the units in the building comply with the universal design standards.</text></subparagraph></paragraph><paragraph id="H306E78CB5AD5478A8D776F81D52BF336"><enum>(4)</enum><header>Label</header><text>If the licensed inspector determines that the dwelling unit meets the universal design standards, the owner of the dwelling unit or commercial unit may use the universal design label established by the Secretary pursuant to subsection (e) when marketing such dwelling unit or commercial unit to potential tenants and buyers.</text></paragraph><paragraph id="H25AF410C99054EDD8C03C0BBD1D7460E"><enum>(5)</enum><header>Re-certification</header><subparagraph id="HEFCCA5E074A04F099A73FBCB860AC17A"><enum>(A)</enum><header>In general</header><text>An owner of a dwelling unit or commercial unit certified under this section shall have such unit re-certified before the date that is 10 years after the date of the most recent certification to continue using the label established pursuant to subsection (e) when marketing such unit.</text></subparagraph><subparagraph id="H4543FFF52722418FB6C5843422F8649C"><enum>(B)</enum><header>Renovation</header><text>If a unit certified under this section is renovated, the owner of such unit shall reapply for certification under this section before using the label established pursuant to subsection (e) when marketing such unit.</text></subparagraph><subparagraph id="H7C06CCA4D5564315A806BF9BA9109206" commented="no"><enum>(C)</enum><header>Ownership change</header><text display-inline="yes-display-inline">If ownership of a dwelling unit or commercial unit certified under this section changes, the new owner of such unit may not use the label established pursuant to subsection (e) when marketing such unit until such new owner has such unit re-certified. </text></subparagraph></paragraph></subsection><subsection id="H8E6A6A3741774C09ADC945ED82F092D4"><enum>(e)</enum><header>Universal design label</header><text>—</text><paragraph id="H1F52A3BD99AC4944BBFC64AD54A41A29"><enum>(1)</enum><header>In general</header><text>The Secretary shall establish a label that is designed to identify a dwelling unit or commercial unit as having been certified by the Secretary as complying with the universal design standards.</text></paragraph><paragraph id="HA7B77EB2EA6F4196972B104A67972B35"><enum>(2)</enum><header>Public awareness</header><text display-inline="yes-display-inline">The Secretary, in coordination with the head of each covered agency, shall work to increase public awareness of the label established pursuant to paragraph (1), including by providing special outreach to small business owners who are licensed as a professional engineer or registered architect in any State.</text></paragraph></subsection><subsection id="HD4043B067AFD40DAB34EC8882840B47E" commented="no"><enum>(f)</enum><header>Licensing of inspectors</header><paragraph id="H8D1E7C28E4224817A5CCB4F14FD96A36" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall issue licenses to inspectors to verify the information in any application submitted to the Secretary pursuant to subsection (d).</text></paragraph><paragraph id="HEA90B565045C4DACB89822C490875FE3"><enum>(2)</enum><header>Termination of license</header><text>The Secretary shall terminate the license of an inspector if such inspector is found to have incorrectly certified 2 or more dwelling units or commercial units during any 2-year period.</text></paragraph><paragraph id="H67D49D86472E4FB18D0AE5EB8D961E67"><enum>(3)</enum><header>Falsification</header><text display-inline="yes-display-inline">If an inspector licensed by the Secretary pursuant to paragraph (1) is found by the Secretary to have falsified information with respect to any application submitted under this section, the Secretary may pursue recourse under Federal law and any applicable State or Territorial licensing laws. </text></paragraph></subsection></section><section id="H863B86ED3C254FD3821B8D269C353885"><enum>3.</enum><header>Universal Design Standard Tax Credit</header><subsection id="H95F6EEFEDCB4469186578C4D0BBCD026"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart B of part IV of subchapter A of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H220A6191EDFA442C95A19BCFD49E04A3" display-inline="no-display-inline"><section id="H43A14209C30D4312B8D33F058999232F"><enum>30E.</enum><header>Universal design standard credit</header><subsection id="HCE2E3C14F90546899D772BF10254BB38"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There shall be allowed as a credit against the tax imposed by this chapter a credit in an amount equal to the sum of—</text><paragraph id="HEBF646C237C74E99ADAB85CAEAD0A9EB"><enum>(1)</enum><text>20 percent of the qualified universal design expenses of the taxpayer for the taxable year that are attributable to design or construction of a new building, plus</text></paragraph><paragraph id="HE54A2D69ADE640BCB94DDF48B88E0445"><enum>(2)</enum><text>50 percent of the qualified universal design expenses of the taxpayer for the taxable year that are attributable to renovation of an existing building.</text></paragraph></subsection><subsection id="H997A04646586421797850E37BD4FC255"><enum>(b)</enum><header>Qualified universal design expenses</header><text>For purposes of this section, the term <quote>qualified universal design expenses</quote> means amounts paid or incurred with respect to a building certified under section 2(d) of the <short-title>Universal Design Standard Tax Incentive Act</short-title> during the taxable year for design, construction, or renovations of such building performed in order to receive such certification.</text></subsection><subsection id="HAD4FE983C56E404EA32EB8517BB4A08D"><enum>(c)</enum><header>Special rules</header><paragraph id="H67F08D1726AC4686BF82D20E2E602D8E"><enum>(1)</enum><header>Basis reduction</header><text display-inline="yes-display-inline">For purposes of this subtitle, the basis of any property for which a credit is allowable under this section shall be reduced by the amount of such credit so allowed.</text></paragraph><paragraph id="H7969F5A4D4C241F79167A2A8117C3244"><enum>(2)</enum><header>No double benefit</header><text>No other credit or deduction shall be allowed under this chapter for amounts with respect to which a credit is allowed under this section.</text></paragraph><paragraph id="HB420E59969FD49A89CB8EDF1E06CA60D"><enum>(3)</enum><header>Application with other credits</header><subparagraph id="HE3F25DB94CC94B10AC29DC57FE233577"><enum>(A)</enum><header>Business credit treated as part of general business credit</header><text display-inline="yes-display-inline">So much of the credit which would be allowed under subsection (a) for any taxable year (determined without regard to this subsection) that is attributable to property of a character subject to an allowance for depreciation shall be treated as a credit listed in section 38(b) for such taxable year (and not allowed under subsection (a)). </text></subparagraph><subparagraph id="HAEAA3271FA7145359D92358A18390871"><enum>(B)</enum><header>Credit made refundable for individuals</header><text display-inline="yes-display-inline">In the case of an individual, the credit allowed under subsection (a) shall be treated as a credit allowed under subpart C and not as a credit allowed under this subpart.</text></subparagraph></paragraph><paragraph id="HEA0E5F4EBE73425F9ECA0917CE977667"><enum>(4)</enum><header>No medical documentation required</header><text>The Secretary may not require any person to submit any medical documentation in order to be allowed a credit under subsection (a).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD5C60E687008471AA28F3DFA84DF7A68"><enum>(b)</enum><header>Credit included in general business credit</header><text>Section 38(b) is amended by striking <quote>plus</quote> at the end of paragraph (40), by striking the period at the end of paragraph (41) and inserting a comma, and by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H465033A7D577417B8E0AC23C91DFEC9C" display-inline="no-display-inline"><paragraph id="HC2A68E7E9B734A069586DF4328D2E44B"><enum>(42)</enum><text display-inline="yes-display-inline">the portion of the universal design standard credit to which section 30E(c)(3)(A) applies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2D53CD2BAB4F412DB1CDD2FEFA68AFC3"><enum>(c)</enum><header>Basis adjustment</header><text>Section 1016(a) of such Code is amended by striking <quote>and</quote> at the end of paragraph (37), by striking the period at the end of paragraph (38) and inserting <quote>, and</quote>, and by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="H47BA2101FA914A069119D7DA7C2B19E0" display-inline="no-display-inline"><paragraph id="H058ECA53AA5E42C491C7F146530BB9CC"><enum>(39)</enum><text display-inline="yes-display-inline">to the extent provided in section 30E(C)(1).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HB099E51819224187B2322EF7E776B78E"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart B of part IV of subchapter A of such Code is amended by adding at the end the following new item:</text><quoted-block style="OLC" id="H22A4B89435674790BB691B9285D160EB" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry idref="H43A14209C30D4312B8D33F058999232F" level="section">Sec. 30E. Universal design standard credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE6EA8E2A38194601B05A041996EC95FC"><enum>(e)</enum><header>Outreach</header><text>The Secretary of the Treasury and the Secretary of Housing and Urban Development shall carry out an outreach campaign to make the public aware of the credit established by the amendments made by this section.</text></subsection><subsection id="HDC314C7D93644722B711E8F2E06A5335"><enum>(f)</enum><header>Report</header><text>The Secretary of the Treasury shall annually publish on the website of the Department of the Treasury an analysis of the total number of taxpayers claiming the credit established by section 30E of such Code and the aggregate value of credits allowed under such section for the most recent calendar year.</text></subsection><subsection id="HB4B959FE8E254559A3C972E652BBE390"><enum>(g)</enum><header>Effective date</header><text>The amendments made by this section shall apply to buildings constructed or renovated after the date of the enactment of this Act.</text></subsection></section><section id="HC9FF49F1500B40E4A7340618655C6720"><enum>4.</enum><header>Reports to Congress</header><subsection id="H4D159BC4B2624EAEB371168165C5B64F"><enum>(a)</enum><header>Briefing</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary, in conjunction with the Commissioner, shall brief the appropriate congressional committees on the progress of the bill as measured by the increase of the Nation’s accessible housing stock and number of individuals that applied for the credit.</text></subsection><subsection id="H560C5EDBBA2B4150807D8A0F196AE3E1"><enum>(b)</enum><header>First report on accessible housing</header><text>Not later than 5 years after the date of enactment of this Act, the Secretary, in conjunction with the Commissioner, shall submit to the appropriate congressional committees a report that—</text><paragraph id="H2EC0435F3D0B434DB3A08C7425C8CE38"><enum>(1)</enum><text>summarizes and evaluates the implementation of such tax credit and the impact of the United States increasing it’s accessible housing supply for people with disabilities and senior citizens;</text></paragraph><paragraph id="HF0E4FA98E1974A2EBFB1477A08BEB471"><enum>(2)</enum><text>describes the nature and extent of the coordination among the relevant Federal departments and agencies on the implementation of such strategy;</text></paragraph><paragraph id="HC79F8204DD184599A4015D4B929C2A5F"><enum>(3)</enum><text>outlines the monitoring and evaluation tools, mechanisms, and common indicators to assess progress made on increase of the Nation’s accessible housing stock; and</text></paragraph><paragraph id="H56D7A5ECDF0C4BF6BC7C3733B02F3BA1"><enum>(4)</enum><text>provides recommendations for improving the program and credit.</text></paragraph></subsection><subsection id="HABA3AA6CB2FA45C99A87ABDB13517358"><enum>(c)</enum><header>Second report on accessible housing</header><text>Not later than 10 years after the date of enactment of this Act, the Secretary, in conjunction with the Commissioner, shall submit to the appropriate congressional committees a report that—</text><paragraph id="H8BD2AEA43D0D4837B7B2B3C1ED6EE961"><enum>(1)</enum><text>summarizes and evaluates the implementation of such tax credit and the impact of United States’ increasing it’s accessible housing supply for people with disabilities and senior citizens;</text></paragraph><paragraph id="H713F0E45F4824517A876C513A34EB76A"><enum>(2)</enum><text>describes the nature and extent of the coordination among the relevant Federal departments and agencies on the implementation of such strategy;</text></paragraph><paragraph id="H3C46B823C97F49CAB014002228386557"><enum>(3)</enum><text>outlines the monitoring and evaluation tools, mechanisms, and common indicators to assess progress made on increase of the Nation’s accessible housing stock;
