which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name></action-desc></action><action display="yes"><action-date date="20241205">December 5, 2024</action-date><action-desc>Additional sponsor: <cosponsor name-id="C001125">Mr. Carter of Louisiana</cosponsor></action-desc></action><action display="yes"><action-date date="20241205">December 5, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require Facility Security Committees to respond to security recommendations issued by the Federal Protective Service relating to facility security, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="HCBDE387AF6094A58B411AEBF729E0CAB" style="OLC"><section section-type="section-one" id="H0B35648E9FE6410EA269A815C6A1B6CF" changed="not-changed"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Federal Building Security Act of 2024</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H9131B26A8FCC45BFA406A0F75F3ACE06" changed="not-changed"><enum>2.</enum><header>Responding to security recommendations</header><subsection commented="no" display-inline="no-display-inline" id="H07F453D242E0497EA10AF5E82EA0879A" changed="not-changed"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H123171F031464280B2AED80429C1DF84" changed="not-changed"><enum>(1)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code.</text></paragraph><paragraph id="H37727359C660477B8EAE07BF9A5376BD" changed="not-changed"><enum>(2)</enum><header>Facility Security Committee</header><text>The term <term>Facility Security Committee</term> means a committee that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H1F44BCF1F75F407BB39E64398B9E16C2" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">consists of representatives of—</text><clause commented="no" display-inline="no-display-inline" id="H406C6F0F6BD0486698391B16259513EC" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">all Federal tenants in a specific non-military facility;</text></clause><clause commented="no" display-inline="no-display-inline" id="HDCD1A9AE557C44459746DADFCDD8F6F3" changed="not-changed"><enum>(ii)</enum><text display-inline="yes-display-inline">the security organization for the facility; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H2B725F2BED094485A91AE87DD4C26799" changed="not-changed"><enum>(iii)</enum><text display-inline="yes-display-inline">the owning or leasing Federal tenant; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7E251E9A5D84E5D8B1382E7CE9F93B3" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">is responsible for addressing facility-specific security issues and approving the implementation of security measures and practices in the facility. </text></subparagraph></paragraph><paragraph id="HC99AE3C7B5664177999671C84BB03508" changed="not-changed"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security. </text></paragraph></subsection><subsection id="H9BDF590BF0EA46D89D36BD152129F22B" changed="not-changed"><enum>(b)</enum><header>Response</header><paragraph commented="no" display-inline="no-display-inline" id="H43E4E14CA3D84F59BA7F3323A738AD5E" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date on which the Federal Protective Service issues a security recommendation to a Facility Security Committee to improve facility security, the head of the Facility Security Committee, or a designee thereof, shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB94C6CACA8D344D4BA1E4B23817BCAB0" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">respond to the Secretary—</text><clause commented="no" display-inline="no-display-inline" id="HFBE51243D37C4AB3BC99F46048F9E4C0" changed="not-changed"><enum>(i)</enum><text display-inline="yes-display-inline">indicating if the Facility Security Committee intends to adopt or reject the recommendation; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H30F4B3AEB8C6408591B74F3AEB2B176F" changed="not-changed"><enum>(ii)</enum><text>describing the financial implications of adopting or rejecting the recommendation, including if the benefits outweigh the costs; and </text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5E9D6F5C65B24784A2042FD646FA6947" changed="not-changed"><enum>(B)</enum><text>if the Facility Security Committee intends to reject the recommendation, provide the Secretary a justification for accepting the risk posed by rejecting the recommendation.</text></subparagraph></paragraph><paragraph id="H5ED6FB3BD6804CD187B880987EA0B6D6" changed="not-changed"><enum>(2)</enum><header>Method</header><text>The Secretary shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HACEE1B710D9C497AB894996F5922A192" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">develop a method to monitor the recommendations and responses described in paragraph (1); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5EB89A62924D4C258F24D3047D7E7ED2" changed="not-changed"><enum>(B)</enum><text>take reasonable action to ensure Facility Security Committee responsiveness under paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="H77889CDD62374F0EADA43915D3926E1F" changed="not-changed"><enum>(c)</enum><header>Annual report</header><paragraph commented="no" display-inline="no-display-inline" id="HAA9598AB71224BF3B4400B0BC046F8B6" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Not later than 270 days after the date of enactment of this Act, and annually thereafter, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives a report that, for the fiscal year preceding the report, includes—</text><subparagraph id="H1F8CB68DA9DB4DD98E6DA66AB3542A52" changed="not-changed"><enum>(A)</enum><text>a summary of the security recommendations issued by the Federal Protective Service to Facility Security Committees to improve facility security;</text></subparagraph><subparagraph id="H639054CE7726431EBEFC8CC040091D63" changed="not-changed"><enum>(B)</enum><text>the percentage of recommendations described in subparagraph (A) that were accepted and the percentage of such recommendations that were rejected;</text></subparagraph><subparagraph id="H20C9CD427BEB4C89BF206B8059379512" changed="not-changed"><enum>(C)</enum><text>the percentage of Facility Security Committees that failed to respond to a recommendation described in subparagraph (A) in a timely manner;</text></subparagraph><subparagraph id="HE28A10C1DEEE44288DA5308AE866C52C" changed="not-changed"><enum>(D)</enum><text>a summary of justifications provided by Facility Security Committees if a Facility Security Committee rejected a recommendation described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11E2752D88D64B40A4326D513EAB16B0" changed="not-changed"><enum>(E)</enum><text>a summary of the financial implications of Facility Security Committee responses to recommendations described in subparagraph (A), including if the benefits outweigh the costs;</text></subparagraph><subparagraph id="H4A4EA60D9B9C4B33A7117C9D36DBE24D" changed="not-changed"><enum>(F)</enum><text>an analysis of steps taken by Facility Security Committees to mitigate the risk posed by rejecting a recommendation described in subparagraph (A); and</text></subparagraph><subparagraph id="HB5074F60FCBB4706A0FDFEE08AA0C7CC" changed="not-changed"><enum>(G)</enum><text>an analysis of any trends found among the findings in the report.</text></subparagraph></paragraph><paragraph id="HC6FD593E10AB472080149F52E29717C1" changed="not-changed"><enum>(2)</enum><header>Form</header><text>Each report required under paragraph (1) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE5A8797067094BF0B83D03561B225599" changed="not-changed"><enum>(3)</enum><header>Briefing</header><text>The Secretary shall brief the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives on an annual basis on the findings of the most recently submitted report under paragraph (1).</text></paragraph></subsection><subsection id="HCFB031E35D5A49B98382EBB3429DD64B" changed="not-changed"><enum>(d)</enum><header>Report on surveillance technology</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security and the Committee on Transportation and Infrastructure of the House of Representatives an unredacted report on—</text><paragraph id="H63589EB6FDD7438AA23DEC84F9BFCCEE" changed="not-changed"><enum>(1)</enum><text>all surveillance technology recommended by the Federal Protective Service; and</text></paragraph><paragraph id="H02F9DEA15ABF4A6AA6F65F14026659D1" changed="not-changed"><enum>(2)</enum><text>any intended use of the technology described in paragraph (1). </text></paragraph></subsection><subsection id="HB32A8A4319DB468186E30EF9511B1DAD" changed="not-changed"><enum>(e)</enum><header>No additional funds</header><text>No additional funds are authorized to be appropriated for the purpose of carrying out this Act.</text></subsection><subsection id="HADE2DBCB888743548F4314962DF514CC" changed="not-changed"><enum>(f)</enum><header>Sunset and report</header><paragraph id="H3C8A0557E6EC4D1491F62D825DA82EFA" changed="not-changed"><enum>(1)</enum><header>Sunset</header><text>This Act shall cease to be effective on the date that is 5 years after the date of enactment of this Act.</text></paragraph><paragraph id="H1DF01A6AAFC5407F8FA9C7F5B1ECC129" changed="not-changed"><enum>(2)</enum><header>GAO report</header><text>Not later than 5 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the effectiveness of this Act. </text></paragraph></subsection><subsection id="H7CA3A9FBE2794090964514B4BEC2A62A"><enum>(g)</enum><header>Application</header><text>This Act shall only apply to—</text><paragraph commented="no" display-inline="no-display-inline" id="H940C9A4C66F344598ECC853A02AFB323"><enum>(1)</enum><text display-inline="yes-display-inline">General Services Administration facilities under protection of the Federal Protective Service; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82B9BD5B56B54836B22A315E9C7194C7"><enum>(2)</enum><text display-inline="yes-display-inline">non-General Services Administration facilities that pay fees to the Federal Protective Service for protection.</text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20241205">December 5, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
