which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the designation of areas within which fishing activities carried out using bottom trawls may be carried out.</official-title></form><legis-body id="HC865718B08034627906D3CF0446D9581" style="OLC"><section id="HA6C9772E954442BBBE68BAAF596C2224" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bottom Trawl Clarity Act of 2024</short-title></quote>.</text></section><section id="H703C6E796A2C4E56BEE97F1AE6CCACD8" section-type="subsequent-section"><enum>2.</enum><header>Defining substantial bottom contact</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this Act, each Council that manages a fishery that allows the use of any bottom trawl gear shall, after providing notice and an opportunity for public comment, submit to the Secretary—</text><paragraph id="H884DF7A1541C4AE2998CA312932773B1"><enum>(1)</enum><text>a definition of the term <term>substantial bottom contact</term> as compared to the term <term>limited bottom contact</term> when used to describe how often fishing gear interacts with the seafloor;</text></paragraph><paragraph id="HB96BC6BBF9674771950F62C8F805ED94"><enum>(2)</enum><text>a monitoring and enforcement plan to ensure that any pelagic trawl fishing activity carried out within a fishery managed by such Council has limited bottom contact; and</text></paragraph><paragraph id="HE08C95485AA348F1B2B15CED5972594F"><enum>(3)</enum><text>a list of each gear type that has substantial bottom contact based on the definition submitted under paragraph (1).</text></paragraph></section><section id="HC64A204DA4A44719995B15E7B4E2D1B2"><enum>3.</enum><header>Designation of Bottom Trawl Zones</header><subsection id="H9C95081A0B444DB08B6CC29136678AAB"><enum>(a)</enum><header>Initial designations</header><paragraph id="HD4BEAC110E934CBABAF4AA85D6AF48F2"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which a Council completes the requirements of section 2, such Council shall, after providing notice and an opportunity for public comment, submit to the Secretary, and the Secretary shall publish in the Federal Register—</text><subparagraph id="H846A7EF41A2B447D960B8DE76152BEAD"><enum>(A)</enum><text>a list of each area within the jurisdiction of such Council within which fishing activities using bottom trawls were carried out during the 7-year period ending on December 31, 2024; and</text></subparagraph><subparagraph id="HBA6CFF7CBB264D1EA7050FF68714DE07" commented="no"><enum>(B)</enum><text>a recommendation regarding each area identified under subparagraph (A), or portion thereof, that is not ineligible for designation under subsection (c) and should be designated as a Bottom Trawl Zone under paragraph (2).</text></subparagraph></paragraph><paragraph id="H30D70AD5180249DBB751F6B2C36E2C21"><enum>(2)</enum><header>Designation process</header><subparagraph id="H6FDC0E5005D148D4820BF98AC8E6058E"><enum>(A)</enum><header>Proposed designation</header><text>Not later than 9 months after the date on which the recommendations of a Council are published in the Federal Register pursuant to subsection (a)(1)(B), the Secretary shall publish in the Federal Register a proposed rule to designate as a Bottom Trawl Zone each area, or portion thereof, recommended for such designation by such Council as the Secretary determines appropriate.</text></subparagraph><subparagraph id="HC84ED5407610475483FF2896A3AEFB1E"><enum>(B)</enum><header>Failure to recommend</header><text display-inline="yes-display-inline">If a Council fails to submit recommendations to the Secretary under paragraph (1) by the deadline described in that paragraph, not later than 1 year after such deadline, the Secretary, after providing notice and an opportunity for public comment, shall publish in the Federal Register a proposed rule that—</text><clause id="H8C8DF41E25AA43A5BE19DE5B84C24714"><enum>(i)</enum><text display-inline="yes-display-inline">lists each area within the jurisdiction of such Council within which fishing activities using bottom trawls were carried out during the 7-year period ending on December 31, 2024; and</text></clause><clause id="H078FCC3DB29647DCA6A27F018765875F"><enum>(ii)</enum><text>indicates each area identified under clause (i), or portion thereof, that is not ineligible for designation under subsection (c) that the Secretary proposes to designate as a Bottom Trawl Zone.</text></clause></subparagraph><subparagraph id="H00E58EFF70A048F3A6C8FFD7C4F55F55"><enum>(C)</enum><header>Comment period</header><text>The Secretary shall accept comments on a proposed rule published under subparagraph (A) or (B) for 60 days after the date of such publication.</text></subparagraph><subparagraph id="H714599DCF659461E9847631578832B5B"><enum>(D)</enum><header>Final designation</header><clause id="HBC505EA9CB8F4118B08101A226B41D13"><enum>(i)</enum><header>In general</header><text>Not later than 30 days after the date on which a comment period described in subparagraph (C) for a proposed rule published under subparagraph (A) or (B) ends, the Secretary shall designate as a Bottom Trawl Zone each area, or portion thereof, included in such proposed rule.</text></clause><clause id="H7F7092F4C4BC45BAA738FD0F67F1A004"><enum>(ii)</enum><header>Publication</header><text>The Secretary shall publish in the Federal Register each designation made under clause (i).</text></clause></subparagraph></paragraph></subsection><subsection id="HD727B2303B5A46D4B35426CBDA08207A"><enum>(b)</enum><header>Subsequent designations</header><paragraph id="HFEEF6E7844DD4D47890D128C2F1F6D0F" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">After the initial designations of Bottom Trawl Zones under subsection (a)(2), the Secretary, in consultation with the relevant Council or upon the recommendation of a Council, may designate as a Bottom Trawl Zone an area, or portion thereof, within the jurisdiction of such Council if—</text><subparagraph id="H2EB5F69AA95D402B98271498A1FA9A7F" commented="no"><enum>(A)</enum><text>the area was not designated as a Bottom Trawl Zone under subsection (a)(2);</text></subparagraph><subparagraph id="HF49688549AB849699275C7428FCE27C0"><enum>(B)</enum><text display-inline="yes-display-inline">fishing activities using bottom trawls were carried out within the area during the preceding 7-year period; and</text></subparagraph><subparagraph id="H38B6B77066F34EE69135D27FEF4697FD"><enum>(C)</enum><text display-inline="yes-display-inline">the area is not ineligible for designation under subsection (c).</text></subparagraph></paragraph><paragraph id="H8BB4E47FDA6541AEB145C7AC251E398A"><enum>(2)</enum><header>Designation process</header><subparagraph id="H0AF2CBC08B1749A4A10132CCFB83636A"><enum>(A)</enum><header>Proposed designation</header><text>The Secretary shall publish in the Federal Register a proposed rule to designate as a Bottom Trawl Zone an area described in paragraph (1).</text></subparagraph><subparagraph id="H37CE0530E0E043E486853BB876F3348C"><enum>(B)</enum><header>Comment period</header><text display-inline="yes-display-inline">The Secretary shall accept comments on a proposed rule published under subparagraph (A) for 60 days after the date of such publication.</text></subparagraph><subparagraph id="H2A1E8927995449D6BEF4C7F277281C94"><enum>(C)</enum><header>Final designation</header><clause id="H1B0D014510FF4D05A0D653D92A8E2F19"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which a comment period described in subparagraph (B) for a proposed rule published under subparagraph (A) ends, the Secretary shall designate as a Bottom Trawl Area each area, or portion thereof, included in such proposed rule.</text></clause><clause id="HAFB9893E6FD84B169C9CFE73863745A7"><enum>(ii)</enum><header>Publication</header><text>The Secretary shall publish in the Federal Register each designation made under clause (i).</text></clause></subparagraph></paragraph></subsection><subsection id="H384540AFA20C414192F18E724C6D4CF5"><enum>(c)</enum><header>Areas ineligible for designation</header><text>An area may not be designated as a Bottom Trawl Zone if—</text><paragraph id="H9D85CAA35F024DEAB4737BE9D7242790"><enum>(1)</enum><text>the Secretary determines there is evidence of the presence of a deep sea coral and sponge ecosystem within the area; or</text></paragraph><paragraph id="HD409C7C3DDEC4A1AA0DAE4CD1CAF84C3"><enum>(2)</enum><text>the area is designated pursuant to the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1801">16 U.S.C. 1801 et seq.</external-xref>) as—</text><subparagraph id="H375A3AAC141C43EA869B207EF9A25E45"><enum>(A)</enum><text>a Savings Area; or</text></subparagraph><subparagraph id="HBB021420F04544228A39B3353413AAEF"><enum>(B)</enum><text>an otherwise protected area for a stock of fish.</text></subparagraph></paragraph></subsection><subsection id="HD55128971886492486951814B43328B6"><enum>(d)</enum><header>Activities within Bottom Trawl Zones</header><text>As of the date on which the Secretary designates an area as a Bottom Trawl Zone under subsection (a)(2)(D), bottom trawls may only be used in an area that is designated as a Bottom Trawl Zone.</text></subsection></section><section id="HBF91455BA8604D2981753DFC9AEA6C0B"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H9251965AD8464D499BBA6E851B64A08D"><enum>(1)</enum><header>Bottom trawl</header><text display-inline="yes-display-inline">The term <term>bottom trawl</term> means, when used within the jurisdiction of a Council, any trawl or dredge fishing gear that makes substantial bottom contact with the seafloor while in use, as defined by the Council or as determined by the Secretary, as applicable.</text></paragraph><paragraph id="H2D751471D779483D8B51B6DFC3FFB034"><enum>(2)</enum><header>Bottom Trawl Zone</header><text>The term <term>Bottom Trawl Zone</term> means an area within which bottom trawls may be used.</text></paragraph><paragraph id="H3D9999A68B994575B0807E9E296CCC47"><enum>(3)</enum><header>Council</header><text>The term <term>Council</term> means a Regional Fishery Management Council established by section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1852">16 U.S.C. 1852</external-xref>).</text></paragraph><paragraph id="H52B04EA97A4A44649D5452672D75DDE4"><enum>(4)</enum><header>Deep sea corals</header><text>The term <term>deep sea corals</term> means species that—</text><subparagraph id="H144461E767DA497CA2B71869F0E90F41"><enum>(A)</enum><text>occur at a depth of greater than 50 meters;</text></subparagraph><subparagraph id="HF6ED3698D69B4A158FFF5AE6D838DF26"><enum>(B)</enum><text>do not contain symbiotic algae; and</text></subparagraph><subparagraph id="HD044B021B7A54331BEC34CE7D79E2E71"><enum>(C)</enum><text>are in the phylum Cnidaria, in the order—</text><clause id="H96CBAB362EB44ACF8DD1698AB88EF5BB"><enum>(i)</enum><text display-inline="yes-display-inline">Alcyonacea (soft corals);</text></clause><clause id="H21BDF2A3C1E64C308C59CE82A1EFF9EB"><enum>(ii)</enum><text display-inline="yes-display-inline">Antipatharia (black corals);</text></clause><clause id="HE867A752B5F64A8FB4FF355A928FF14F"><enum>(iii)</enum><text display-inline="yes-display-inline">Gorgonacea (horny corals);</text></clause><clause id="H6B9335ED93F247F694AEE2F9ADFD8C32"><enum>(iv)</enum><text display-inline="yes-display-inline">Hydrocorallina (hydrocorals), in the class Hydrozoa;</text></clause><clause id="H197A3FEC19454C84812AE74ADC2F805B"><enum>(v)</enum><text display-inline="yes-display-inline">Pennatulacea (sea pens), in the class Anthozoa; or</text></clause><clause id="H707D572C0E62462C855713FD42EC36F3"><enum>(vi)</enum><text display-inline="yes-display-inline">Scleractinia (stony corals).</text></clause></subparagraph></paragraph><paragraph id="HAA93D62505A84D9883167CB263F8E2DF" commented="no"><enum>(5)</enum><header>Deep sea coral and sponge ecosystem</header><text display-inline="yes-display-inline">The term <term>deep sea coral and sponge ecosystem</term> means an ecosystem composed of living deep sea corals or deep sea sponges, the benthic and demersal species associated with such living deep sea corals or deep sea sponges, and the biological, physical, chemical, and geologic components that constitute habitat for living deep sea corals or deep sea sponges.</text></paragraph><paragraph id="H002805A6CC764EBD8AD8BB1DBD74DE1B"><enum>(6)</enum><header>Deep sea sponges</header><text>The term <term>deep sea sponges</term> means species that—</text><subparagraph id="H897953333EFB491082727D5A7D979086"><enum>(A)</enum><text>occur at a depth of greater than 50 meters; and</text></subparagraph><subparagraph id="HC27EB5AB747E471480CAEB46C742A796"><enum>(B)</enum><text>are in the phylum Porifera.</text></subparagraph></paragraph><paragraph id="HB61637E78D4749A5B509940B1F9CE565"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Commerce.</text></paragraph></section></legis-body></bill>
