which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to require additional ethics disclosures for the President, Vice President, and their family members, and for other purposes.</official-title></form><legis-body id="HF9FFA57A3A5B4E738F847A1EE23FB693" style="OLC"><section id="HC155579A700242C3A9730F94B06E1E1A" section-type="section-one" commented="no"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Presidential Ethics Reform Act</short-title></quote>.</text></section><section id="H66C3CC18CE674619A29DC371EDD7F21D"><enum>2.</enum><header>Additional reporting requirements for Presidents and Vice Presidents</header><subsection id="H5B3082CA22464AD6849D1D7798245D10"><enum>(a)</enum><header>Additional ethics reporting requirements for Presidents and Vice Presidents</header><text display-inline="yes-display-inline">Section 13103 of title 5, United States Code, is amended—</text><paragraph id="H9E2AA64B30D34B69B8FA03A1CBEDFF95"><enum>(1)</enum><text>by redesignating subsection (i) as subsection (j);</text></paragraph><paragraph id="H07F6FC1FC1DA4DEF92A468174EDCE691"><enum>(2)</enum><text>by inserting after subsection (h) the following new subsection:</text><quoted-block style="USC" id="HB7F88AC24B64408DB51906AC3D61FFEA" display-inline="no-display-inline"><subsection id="HEA668D6842B24519BDF3D745C8B439B5"><enum>(i)</enum><header>Additional ethics reports for Presidents and Vice Presidents</header><paragraph id="H0D6238D882394AB6A4B084827C022883"><enum>(1)</enum><header>Upon entering</header><text display-inline="yes-display-inline">Within 30 days of assuming the office of President or Vice President, an individual shall file a report containing the information described in each of subsections (j) through (m) of section 13104 with respect to the 2 years preceding the assumption of such office.</text></paragraph><paragraph id="HA0EDE8BD03C24BE9BCC6DF922955596A"><enum>(2)</enum><header>Additional annual reports</header><text display-inline="yes-display-inline">Any individual who occupies the office of President or Vice President shall file on or before May 15 a report containing, with respect to the prior calendar year for which such individual occupies the office, the information described in each of subsections (j) through (o) of section 13104.</text></paragraph><paragraph id="H924A763F0EEA4885933E32ADE161CABA"><enum>(3)</enum><header>Post-Departure Reports</header><subparagraph id="H6BE7516A14114FB3B5320509B14B9ED8"><enum>(A)</enum><header>Initial post-departure report</header><text>Following the date on which an individual ceases to occupy the office of President or Vice President, such individual shall file a report containing, with respect to the final calendar year during which such individual occupied the office and any applicable partial calendar year immediately preceding such date, the information described in each of subsections (j) through (o) of section 13104—</text><clause id="H9B82487414F84BD5ACFB49C82F28803B"><enum>(i)</enum><text display-inline="yes-display-inline">on or before the first-occurring May 15 after the full regular term in office of the individual has ended; or</text></clause><clause id="H64AD911797C4446ABD2FF29F65B4BB75"><enum>(ii)</enum><text display-inline="yes-display-inline">within 30 calendar days of the date that such individual ceases to occupy office if such date is prior to the end of their full regular term in office.</text></clause></subparagraph><subparagraph id="HFC6C080F6F6A4D72873AE7DDB6822432" commented="no"><enum>(B)</enum><header>Subsequent post-departure reports</header><text display-inline="yes-display-inline">Beginning on the date that is one year after the date on which an individual ceased to occupy the office of President or Vice President and annually thereafter, such individual shall file on or before May 15 a report containing, with respect to the prior year, the information described in each of subsections (j) through (m) of section 13104.</text></subparagraph><subparagraph id="HF818697552844AA38EF3C4212A85F7A3" commented="no"><enum>(C)</enum><header>Duration</header><text>The requirement under subparagraph (B) ends on the first-occurring May 15 following the date that is 2 years after the date on which such individual ceased to occupy such office.</text></subparagraph></paragraph><paragraph id="HB61197147CA0455883DFDE83CC277070"><enum>(4)</enum><header>Reports requiring periodic updates</header><text>With respect to an individual required to submit a report under paragraphs (1) through (3), such individual shall—</text><subparagraph id="H1051E0E21E254A7483D67BBCC5AA0AFF" commented="no"><enum>(A)</enum><text>with respect to subsection (n), submit an addendum to the report required under paragraphs (2) and (3)(A) to the entities under paragraph (5)(A) within 30 days of a new conflict of interest becoming known; and</text></subparagraph><subparagraph id="H93961011C3D54A14B54BC48060A410C8" commented="no"><enum>(B)</enum><text>with respect to subsection (o), submit an addendum to the report required under paragraphs (2) and (3)(A) to the entities designated under paragraph (5) within 30 days of a relative accompanying such individual on official travel.</text></subparagraph></paragraph><paragraph id="HCC2B01D096A54C53BDB2A4B1F7698DC7" commented="no"><enum>(5)</enum><header>Submission of reports</header><subparagraph id="HB41EA3EAE03C4BE2B0390B5608DE95B9"><enum>(A)</enum><header>In general</header><text>Each report or addendum required to be submitted under this subsection shall be submitted to the following entities:</text><clause id="H3506D966B8714612B1B62BE5E3346E0D" commented="no"><enum>(i)</enum><text>The Committee on Oversight and Accountability of the House of Representatives.</text></clause><clause id="H3BA332A4547448DC9F56945825B5332A" commented="no"><enum>(ii)</enum><text>The Judiciary Committee of the Senate.</text></clause><clause id="H9717087C7B514F9D842E6EF168D8F850" commented="no"><enum>(iii)</enum><text display-inline="yes-display-inline">The Director of the Office of Government Ethics to be made publicly available by the Director within 30 days of receipt, in conformity with the requirements under paragraph (6).</text></clause></subparagraph><subparagraph id="HA66CF48091BE4AD0869308B3F3F790D4" commented="no"><enum>(B)</enum><header>Additional entities</header><text>In the case of subsection (o), the report or addendum shall also be submitted to the following:</text><clause id="H18F543D0B23F4D508D1F68F7FC7B04C1" commented="no"><enum>(i)</enum><text>The Committee on Armed Services of the House of Representatives.</text></clause><clause id="HA90F5C6B0EB74DACB16BBFF2EAB19588" commented="no"><enum>(ii)</enum><text>The Permanent Select Committee on Intelligence of the House of Representatives.</text></clause><clause id="HC866FF8EDAC843909D0C754020B31C55" commented="no"><enum>(iii)</enum><text>The Committee on Armed Services of the Senate.</text></clause><clause id="H32FEBF5C3EA74CE590D0A5134AFEB255" commented="no"><enum>(iv)</enum><text>The Select Committee on Intelligence of the Senate.</text></clause><clause id="H64BC56E26C83413A92FD88B60C30D3B9" commented="no"><enum>(v)</enum><text display-inline="yes-display-inline">The Director of the White House Military Office to be made publicly available by the Director within 30 days of receipt, in conformity with the requirements under paragraph (6).</text></clause></subparagraph></paragraph><paragraph id="H07DA7B8C7B064F10866B109E663DA279"><enum>(6)</enum><header>Availability of reports</header><text>The applicable reports under paragraph (5) shall be made publicly available on a website, which may utilize an existing government website, in a manner that—</text><subparagraph id="HEA49F9B00B7540908AFC53BDC40905A3"><enum>(A)</enum><text display-inline="yes-display-inline">allows the public to search, sort, filter, and download reports by the category of additional reports required under this subsection, the filer name or name of the filer’s relative, or a date or the date range of the period covered by the report; and</text></subparagraph><subparagraph id="H3358105609DC46D38B3247B15E5C5AFF"><enum>(B)</enum><text display-inline="yes-display-inline">is fully compliant with the web design requirements under subsection (a) of section 3 of the 21st Century Integrated Digital Experience Act (<external-xref legal-doc="usc" parsable-cite="usc/44/3501">44 U.S.C. 3501</external-xref> note).</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HD74D1C723FE547B4B37CEC32A1FCC543"><enum>(3)</enum><text>in subsection (j) as redesignated by paragraph (1), by inserting <quote>, except subsection (i),</quote> after <quote>under this section</quote>.</text></paragraph></subsection><subsection id="HD87FE7C02F7A4D429C4B01AD55094033"><enum>(b)</enum><header>Contents of additional ethics reports</header><text>Section 13104 of title 5, United States Code, is amended by adding at the end the following new subsections:</text><quoted-block style="USC" id="HC484560FC5EB4E3C973CFB28F095F1F0" display-inline="no-display-inline"><subsection id="H23F836AA922D4F0C90DBCE6618DEEA47"><enum>(j)</enum><header>Gifts</header><text display-inline="yes-display-inline">Each report filed pursuant to section 13103(i) shall include a full and complete statement with respect to each gift valued at more than $10,000—</text><paragraph id="HF411D259AD8F4E529A53FD845E32F815"><enum>(1)</enum><text display-inline="yes-display-inline">received by such individual during the applicable time period from a relative; and</text></paragraph><paragraph id="H853B081BB5BC4F16934A4AD8987550B5"><enum>(2)</enum><text display-inline="yes-display-inline">received by a relative during the applicable time period.</text></paragraph></subsection><subsection id="H680337252AE74277917CEFB64A550702" commented="no"><enum>(k)</enum><header>Loans</header><text display-inline="yes-display-inline">Each report filed pursuant to section 13103(i) shall include a full and complete statement with respect to all loans or loan repayments, including the terms and repayment schedules of each such loan or loan repayment, made during the applicable time period—</text><paragraph id="HD82B4E5FCD844003B5719B196CE9E2B7"><enum>(1)</enum><text>to such individual by a relative; or</text></paragraph><paragraph id="H8F8FDC55F57F4C058B80C8D0765312B6"><enum>(2)</enum><text display-inline="yes-display-inline">to a relative of such an individual in an amount greater than $10,000, other than commercial loans or repayments thereof, which may include loans that have customary interest rates based on commonly accepted categories of loans and that are evidenced by a written instrument between parties that defines the terms of repayment.</text></paragraph></subsection><subsection id="H596E6768BD7B49509B18551476DCDE8A"><enum>(l)</enum><header>Foreign payments</header><paragraph id="H8F26D7B41C14455A9ECACC0AB1772AFA"><enum>(1)</enum><text display-inline="yes-display-inline">Each report filed pursuant to section 13103(i) shall include a full and complete statement with respect to any payment, transfer, or other item of value received during the applicable time period by such individual or a relative of such individual from a foreign principal or a foreign principal’s agent, representative, employee, or servant.</text></paragraph><paragraph id="H50073C8707754DAAB7C72776566D00DD"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>foreign principal</term> includes—</text><subparagraph id="H3B838FC270DE46D6A9888B0941D0A525"><enum>(A)</enum><text>a government of a foreign country and a foreign political party;</text></subparagraph><subparagraph id="H3A5D89DBBAB246F1ABF3B22C709B0AEB"><enum>(B)</enum><text>a person outside of the United States, unless it is established that such person is an individual and a citizen of and domiciled within the United States, or that such person is not an individual and is organized under or created by the laws of the United States or of any State or other place subject to the jurisdiction of the United States and has its principal place of business within the United States; and</text></subparagraph><subparagraph id="H6E70D52A16304830B46A281BCDF69FF1"><enum>(C)</enum><text>a partnership, association, corporation, organization or other combination of persons organized under the laws of or having its principal place of business in a foreign country.</text></subparagraph></paragraph></subsection><subsection id="H15B140B243A645C99764BF4F9D7ED3E5" display-inline="no-display-inline"><enum>(m)</enum><header>Federal income tax returns</header><paragraph id="H9A34A3203DC24CB095040F3273955568" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each report filed pursuant to section 13103(i) shall include a copy of each applicable Federal income tax return with respect to the reporting individual for any taxable year which ends in or with the time period covered by such report. In the case of any such income tax return which is not filed with the Internal Revenue Service before the date on which such report is filed, such return shall be submitted under section 13103(i) not later than 30 days after the date that such income tax return is filed with the Internal Revenue Service.</text></paragraph><paragraph id="H9BAD992BE61947C8A430B6161049D4B0"><enum>(2)</enum><header>Confidentiality</header><text display-inline="yes-display-inline">Before making publicly available any income tax return under this subchapter, the Director of the Office of Government Ethics shall redact such information as the Director determines is necessary for protecting against identity theft, such as social security numbers.</text></paragraph><paragraph id="H7A66EAEB7C3B4A288882E093B92E5B17" display-inline="no-display-inline"><enum>(3)</enum><header>Applicable Federal income tax return</header><text>For purposes of this subsection, the term <term>applicable Federal income tax return</term> means any Federal income tax return of—</text><subparagraph id="HFC130CBC882D4134A22D7ECCA7F67B06"><enum>(A)</enum><text>a reporting individual;</text></subparagraph><subparagraph id="H3052EEE956674572896346EB91F908B7"><enum>(B)</enum><text>an individual who is married (within the meaning of <external-xref legal-doc="usc" parsable-cite="usc/26/7703">section 7703(a)</external-xref> of the Internal Revenue Code of 1986) to a reporting individual for the taxable year to which such return relates;</text></subparagraph><subparagraph id="H33B237E427814F6CAA10A43A4C2D4E54"><enum>(C)</enum><text display-inline="yes-display-inline">any corporation or partnership which is controlled by any individual described in subparagraph (A) or (B) at any time during the taxable year to which such return relates;</text></subparagraph><subparagraph id="H5190A35A886B4E6DB29476F4AA1CED13"><enum>(D)</enum><text display-inline="yes-display-inline">the estate of any person described in (A) or (B) or any estate with respect to which any person described in subparagraph (A), (B), or (C) is an executor, or beneficiary at any time during the taxable year to which such return relates; and</text></subparagraph><subparagraph id="HA7736856D03B4827BBBBECA6269D36E1"><enum>(E)</enum><text>any trust with respect to which any person described in subparagraph (A), (B), (C), or (D) is a grantor, fiduciary or beneficiary, or for which another trust described in this subparagraph is a grantor or beneficiary, at any time during the taxable year to which such return relates.</text></subparagraph><continuation-text continuation-text-level="paragraph">Such term shall include any schedule, attachment, or other document filed with such return.</continuation-text></paragraph><paragraph id="H61082EE9B014437CB029FD46CFD9CB2A"><enum>(4)</enum><header>Control</header><text display-inline="yes-display-inline">For purposes of paragraph (3)(C)—</text><subparagraph id="H1C6C927436AB41C0A907B6C4AC53B8A7"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this paragraph, control shall be determined under the rules of paragraphs (2) and (3) of <external-xref legal-doc="usc" parsable-cite="usc/26/6038">section 6038(e)</external-xref> of the Internal Revenue Code of 1986 (determined without regard to subparagraphs (A) and (B) of such paragraph (2) and without regard to subparagraph (C) of paragraph (3) thereof).</text></subparagraph><subparagraph id="H5BD03541E6F644ADB844A207F92309B8"><enum>(B)</enum><header>Restriction on family attribution</header><clause id="H287DA5711E434C9B9EB9A43283124370"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), for purposes of applying subparagraph (A)—</text><subclause id="H6B592D619BDB4D3DA19474793B4A7245"><enum>(I)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/318">section 318</external-xref> of the Internal Revenue Code of 1986 shall be applied without regard to subsection (a)(1)(A)(ii) thereof; and</text></subclause><subclause id="H2B71B2B9E69646C7A854C62706DE1F9E"><enum>(II)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/267">section 267(c)</external-xref> of the Internal Revenue Code of 1986 shall be applied by treating the family of an individual as including only such individual’s spouse (in lieu of the application of paragraph (4) thereof).</text></subclause></clause><clause id="HA473E223A3EF4F939E054016E13EF82F"><enum>(ii)</enum><header>Exception for recent transfer to family members</header><text display-inline="yes-display-inline">For purposes of determining whether any corporation or partnership is controlled by a reporting individual under paragraph (3)(C) for any taxable year, clause (i) shall not apply if such corporation or partnership was controlled by such reporting individual (after application of clause (i)) at any time during the 4 immediately preceding taxable years.</text></clause></subparagraph></paragraph><paragraph id="H92B7458CFE744F67B018BD9A3A52F830"><enum>(5)</enum><header>Application to amended returns</header><text>For purposes of this paragraph (1), any amendment or supplement to a return of tax shall be treated as for the taxable year to which the underlying return relates.</text></paragraph></subsection><subsection id="H3D892F15919B461BA3934377789DE6C0"><enum>(n)</enum><header>Conflicts of interest</header><paragraph id="H769E71B00CF34A70A57D8C603029A1D8" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each report filed pursuant to section 13103(i) shall include a full and complete statement with respect to each instance during the applicable time period in which the reporting individual or a relative of such individual—</text><subparagraph id="HCEA57EE8ABB34D39A8C126E7CB6D5B32"><enum>(A)</enum><text display-inline="yes-display-inline">knows that a particular matter involving specific parties had a direct effect or is likely to have both a direct and predictable effect on the financial interest of such individual or such relative; or</text></subparagraph><subparagraph id="HE519465F8B134632BB515D7B084E99BE"><enum>(B)</enum><text>knows that a person with whom the individual or such relative has a covered relationship, as described in paragraph (2), is or represents a party to such matter.</text></subparagraph></paragraph><paragraph id="HDFC0ECC75C924413BD282A73074BBA25"><enum>(2)</enum><header>Covered relationship</header><text display-inline="yes-display-inline">With respect to a particular matter involving specific parties, an individual or relative has a covered relationship with such a party or a representative of such a party if the individual or relative—</text><subparagraph id="H9451FC3799FB460FB26CA9FCE066C716"><enum>(A)</enum><text display-inline="yes-display-inline">has served, is serving, or is seeking to serve as an officer, director, trustee, general partner, agent, attorney, consultant, contractor or employee of the party or a representative;</text></subparagraph><subparagraph id="H2CF5C186EA23446DAFD0DB3FF6176F33"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise has or seeks a business, contractual, or other financial relationship with the party or a representative that involves other than a routine consumer transaction;</text></subparagraph><subparagraph id="HDCC8931878B44BCF84A9F89F52C75D4F"><enum>(C)</enum><text display-inline="yes-display-inline">is a member of the household of the party or is otherwise a family member of the party or a representative with a close personal relationship; or</text></subparagraph><subparagraph id="H1A23A1953F4947918D6DD444B5BDA881"><enum>(D)</enum><text display-inline="yes-display-inline">is otherwise an active participant in an organization in which the party or a representative is also an active participant.</text></subparagraph></paragraph><paragraph id="HDA810C7B5C694318B08FD08F11B8D46C"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph id="H86EB196E69B24933BDE85331D9667C2A" commented="no"><enum>(A)</enum><header>Direct and predictable effect</header><text display-inline="yes-display-inline">For the purposes of the term <term>direct and predictable effect</term>—</text><clause id="HD14A1D8E27194895A33E164FA89C7398" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">a <quote>direct effect</quote> (of a particular matter on a financial interest)—</text><subclause id="HECD98DBA2CD042C2B8D6AAF2AD5B0953" commented="no"><enum>(I)</enum><text>is characterized by a close causal link between any decision or action to be taken in the matter and any effect or expected effect of the matter on the financial interest, even if the effect does not occur immediately;</text></subclause><subclause id="H122C086AF46A4DD888B31FDAAC870084" commented="no"><enum>(II)</enum><text>is not characterized by—</text><item id="HEC3213A6341440EBBF7D9AC3FA99984C" commented="no"><enum>(aa)</enum><text>an attenuated chain of causation or a chain of causation contingent upon the occurrence of events that are speculative or that are independent of, and unrelated to, the matter; or</text></item><item id="H6663528BFC7D4C3CAE7631C62F2BD51E" commented="no"><enum>(bb)</enum><text>an effect on a financial interest only as a consequence of effects on the general economy; and</text></item></subclause></clause><clause id="HFDFDA7E8BFAC462EA0D98C5FF51545F9" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">a <quote>predictable effect</quote> (of a particular matter on a financial interest) is characterized by a reasonable expectation of a real, as opposed to a speculative possibility, that the matter will affect the financial interest regardless of whether the magnitude of the gain or loss be known, or the dollar amount of the gain or loss is immaterial.</text></clause></subparagraph><subparagraph id="H2ADB838D4FBA4993A8BF2C733C8E1488"><enum>(B)</enum><header>Particular matter involving specific parties</header><text display-inline="yes-display-inline">The term <term>particular matter involving specific parties</term> means any judicial or other proceeding, application, request for a ruling or other determination, contract, claim, controversy, investigation, charge, accusation, arrest or other particular matter involving a specific party or parties in which the United States is a party or has a direct and substantial interest.</text></subparagraph></paragraph></subsection><subsection id="H28B06098E5B44B4EB5287F4884B4A4C6" commented="no"><enum>(o)</enum><header>Accompaniment on official travel</header><paragraph id="H44C10DF38BFB404F8B0CF9D5E4007880" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Each report or addendum filed pursuant to section 13103(i) shall, with respect to the applicable time period, include a full and complete statement with respect to the following:</text><subparagraph id="HD8F564AF433C4DE398C99B10705544C3" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">Each instance on which a relative (other than a minor child) accompanied the reporting individual on official travel and a description of the official purpose for the relative to accompany the reporting individual, including a listing of related events and meetings on the trip which the relative attended.</text></subparagraph><subparagraph id="H11C5B39268664B36916B014959048ADF" commented="no"><enum>(B)</enum><text>Each instance on which the accompaniment of the relative under subparagraph (A) also related to a commercial purpose.</text></subparagraph><subparagraph id="HCF0875CF93174FC18981584F59E097D9" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">A description of each commercial purpose under subparagraph (B) to which the accompaniment under subparagraph (A) is related.</text></subparagraph><subparagraph id="H752E6E41701E40008E8DA01893A2A3F6" commented="no"><enum>(D)</enum><text>The name, professional title or role, and associated entity of each person involved in any meeting or other engagement or activity with the relative relating to each commercial purpose described in subparagraph (C).</text></subparagraph><subparagraph id="HFC6FE1F7B4C1495E99FADFD2413453AE" commented="no"><enum>(E)</enum><text>Each instance on which the accompaniment of the relative under subparagraph (A) included a meeting with a foreign principal that otherwise exceeded the scope of the official purpose of the travel described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H78E90A8871B3416B916E1BDD2B078ABE" commented="no"><enum>(2)</enum><header>Classified Annex</header><text>The reporting individual may submit a classified annex to the report or addendum required under this subsection to protect properly classified national security information.</text></paragraph></subsection><subsection id="H21752C625B3745D1B908C71D986F5C49"><enum>(p)</enum><header>Information relating to relatives</header><paragraph id="HDC670F70F0AD4898B63BD88D8199DD48" commented="no"><enum>(1)</enum><header>In case of estrangement</header><text display-inline="yes-display-inline">With respect to each report or addendum required by section 13103(i) containing the information required in each of subsections (j) through (o), the reporting individual may exclude the information of any relative if the reporting individual—</text><subparagraph id="H968BA4C2948E46FDAA292DC7BF7879BA"><enum>(A)</enum><text>certifies to the Director of the Office of Government Ethics that the reporting individual—</text><clause id="H522B24B2A5E34CE7AC835BC48B69BFF1"><enum>(i)</enum><text>engaged in a sustained and diligent effort to contact or connect with any such relative in order to acquire the relevant information from any such relative; and</text></clause><clause id="H02C1039149E94F7EBD498CC14840EE83"><enum>(ii)</enum><text>is unable to acquire relevant information from any such relative to comply with the reporting requirements under subsections (j) through (o) despite the effort engaged in under clause (i);
