R. 8466</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240517">May 17, 2024</action-date><action-desc><sponsor name-id="W000828">Mr. Williams of New York</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HBA00">Financial Services</committee-name>, <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, <committee-name committee-id="HII00">Natural Resources</committee-name>, <committee-name committee-id="HGO00">Oversight and Accountability</committee-name>, <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, and <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend division N of the Consolidated Appropriations Act, 2021 to improve the Affordable Connectivity Program, and for other purposes.</official-title></form><legis-body id="HD3F1471911814F27A08D5A66D7D6264C" style="OLC"><section id="HCF8C328349E3478F98FD186A64DC0945" display-inline="no-display-inline" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Affordable Connectivity Program Improvement and Extension Act of 2024</short-title></quote>.</text></section><section id="HF07A25B9B16E496FB65815952F56093E"><enum>2.</enum><header>Improving the Affordable Connectivity Program</header><subsection id="H880DE03E97DA4011B7592B11E5C554FC"><enum>(a)</enum><header>Improving verification of eligibility</header><paragraph id="H7E2CC16834714CF69AA1D81ABFD513EC"><enum>(1)</enum><header>Required use of National Verifier to determine eligibility</header><text>Section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>) is amended—</text><subparagraph id="H89F477173F0445BB89877378992085A0"><enum>(A)</enum><text>in subsection (a)(6)(C), by striking <quote>or the participating provider verifies eligibility under subsection (a)(2)(B)</quote>; and</text></subparagraph><subparagraph id="HB595E69DD61F456F8BC2C4B472DCC1A6"><enum>(B)</enum><text>in subsection (b)(2), by striking <quote>shall</quote> and all that follows and inserting the following: <quote>shall use the National Verifier or National Lifeline Accountability Database.</quote>.</text></subparagraph></paragraph><paragraph id="H032FE687E7134A338DA8D10DB5EAB1F9"><enum>(2)</enum><header>Repeal of eligibility through a provider’s existing low-income program</header><text>Section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)</external-xref>) is amended—</text><subparagraph id="HC1DFBE120F544325A8416C0791434A3E"><enum>(A)</enum><text>in subparagraph (C), by adding <quote>or</quote> at the end;</text></subparagraph><subparagraph id="HC74DEFE6132E4C4D97E7000B79DA54C2"><enum>(B)</enum><text>by striking subparagraph (D); and</text></subparagraph><subparagraph id="HCDD94D1C5D4048ADB03CE06A592FD106"><enum>(C)</enum><text>by redesignating subparagraph (E) as subparagraph (D).</text></subparagraph></paragraph><paragraph id="HCA2CE3D46F9040DFB2FD8ED2E9114E25"><enum>(3)</enum><header>Limitation on eligibility through the community eligibility provision of the free lunch program and the free school breakfast program</header><text>Section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)</external-xref>) is amended by striking subparagraph (B) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HC6091EEF13D54F9BBFFCA270B5853592"><subparagraph id="H9FBC80C80FB8422AA4B40C33BAB32B04"><enum>(B)</enum><text>at least 1 member of the household—</text><clause id="H01E602E152DB461D86171AF1F2570632"><enum>(i)</enum><text>is eligible for and receives—</text><subclause id="H74DE9B571C414F01BF83A2A7E9401D32"><enum>(I)</enum><text>free or reduced price lunch under the school lunch program established under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>); or</text></subclause><subclause id="H912CC8B4F6F24ECD909A2C355078D82F"><enum>(II)</enum><text>free or reduced price breakfast under the school breakfast program established under section 4 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1773">42 U.S.C. 1773</external-xref>); and</text></subclause></clause><clause id="HF4F414CF4A674FB2BA4443A287323F37"><enum>(ii)</enum><text>attends a school the local educational agency of which does not elect to receive special assistance payments under section 11(a)(1)(F) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1759a">42 U.S.C. 1759a(a)(1)(F)</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H3B67C3675CF34C11B8318D2172FE0DA8" commented="no"><enum>(4)</enum><header>Reduction of eligible households</header><text>Section 904(a)(6)(A) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)(A)</external-xref>) is amended by striking <quote>except that</quote> and all that follows and inserting a semicolon.</text></paragraph><paragraph id="H5AA8438F21D144D3923EEA7367E6B298"><enum>(5)</enum><header>Informational requirement</header><text display-inline="yes-display-inline">Section 904(b)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(b)(6)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HB137EBC9E2DE49EBA8BA4BAB57D238CD" display-inline="no-display-inline"><subparagraph id="HCAEC8CC6C7AD45D08ED306627FFA3309"><enum>(D)</enum><text display-inline="yes-display-inline">That the participating provider has obtained the last 4 digits of the social security number of at least 1 member from each eligible household for which the participating provider is seeking reimbursement.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4A85EF9624E6402BAE1CCF417FAD9149"><enum>(6)</enum><header>Effective date; rules</header><subparagraph commented="no" display-inline="no-display-inline" id="HD29FEE639C4340BBBDB5C29FADDBAE44"><enum>(A)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this paragraph—</text><clause commented="no" display-inline="no-display-inline" id="H368F543218204A82986AF4C30DEE07EB"><enum>(i)</enum><text display-inline="yes-display-inline">the terms <term>affordable connectivity benefit</term>, <term>Commission</term>, <term>eligible household</term>, and <term>participating provider</term> have the meanings given those terms in section 904(a) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)</external-xref>), as amended by this subsection; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H550A083BCF61476AA3E0563AD4F5566D"><enum>(ii)</enum><text>the term <term>Affordable Connectivity Program</term> means the program established under section 904(b)(1) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(b)(1)</external-xref>).</text></clause></subparagraph><subparagraph id="H1666213A08C14DB182047F929AAF8429"><enum>(B)</enum><header>Effective date</header><text>Except as provided in subparagraph (C), the amendments made by this subsection shall take effect on the date of enactment of this Act.</text></subparagraph><subparagraph id="H9F8E5AF77D874D0AA142ED99BEBEF6E6"><enum>(C)</enum><header>Enrolled households</header><text>A household that received the affordable connectivity benefit as of April 30, 2024, but is no longer an eligible household by reason of the amendments made by this subsection shall nonetheless be treated as an eligible household until the date that is 180 days after the date of enactment of this Act.</text></subparagraph><subparagraph id="H04CA1F3A616A41888AA145A4D5E70F27"><enum>(D)</enum><header>Updating rules</header><text>Not later than 180 days after the date of enactment of this Act, the Commission shall update the rules of the Commission relating to the Affordable Connectivity Program to implement the amendments made by this subsection.</text></subparagraph><subparagraph id="HDD3DED3C356F46799561E289BEB482EF"><enum>(E)</enum><header>Re-certification</header><text display-inline="yes-display-inline">During the period beginning on the date on which the Commission updates the rules under subparagraph (D) and ending on the date that is 240 days after the date of enactment of this Act, a participating provider or the Administrator of the Universal Service Administrative Company, as applicable, shall re-certify the eligibility of a household for the Affordable Connectivity Program in accordance with section 54.1806(f) of title 47, Code of Federal Regulations, or any successor regulation, based on the amendments made by this subsection.</text></subparagraph></paragraph></subsection><subsection id="HEFF5BF9BDC824FC98B1C6E6363C37673"><enum>(b)</enum><header>Limitation with respect to changing providers</header><text display-inline="yes-display-inline">Section 904(a)(6) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(a)(6)</external-xref>), as amended by subsection (a), is further amended—</text><paragraph id="H43EA8DF4E12F46238E499DEF2EED8E5E"><enum>(1)</enum><text>by redesignating subparagraphs (A), (B), (C), and (D) as clauses (i), (ii), (iii), and (iv), respectively, and conforming the margins accordingly;</text></paragraph><paragraph id="H0859ABA5D9BE40FEB3F90C8340A8E765"><enum>(2)</enum><text>by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" id="H7E52FD47EA8F47718C42E7A76596EDB1" display-inline="no-display-inline"><subparagraph id="H8D6FFFF544214647BC7D682A7136789F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H45844CACE7E54564A141627BBC728BE0"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HC3D9DA557EC342639C819B76A034C980" display-inline="no-display-inline"><subparagraph id="H78FE03299CF545CFBDFC4EB809FFE4E4"><enum>(B)</enum><header>Limitation with respect to changing providers</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), in the case of a household that receives an affordable connectivity benefit pursuant to the Affordable Connectivity Program and is seeking to change broadband providers, the term ‘eligible household’ does not apply to such household for purposes of a new broadband provider unless such household has been receiving broadband internet access service from the current broadband provider of such household for at least 180 days.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE155CE42F9AA499F91E60A874BED9468"><enum>(c)</enum><header>Antifraud controls, performance goals, and measures</header><text>Section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H748109D1DB6948AC9761A9B45F2B3DF7"><subsection id="H198E6EA4B5EC43D89307AEEFF5DC524A"><enum>(k)</enum><header>Antifraud controls, performance goals, and measures</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this subsection, the Commission shall develop and implement antifraud controls, performance goals, and performance measures for the Affordable Connectivity Program, and in doing so, shall consider the recommendations submitted by the Comptroller General of the United States to the Commission in the report entitled <quote>Affordable Broadband: FCC Could Improve Performance Goals and Measures, Consumer Outreach, and Fraud Risk Management</quote>, publicly released January 25, 2023 (GAO–23–105399).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3D71723C1DF74170AE07639F585A9A2B"><enum>(d)</enum><header>Report on effectiveness</header><text>Not later than 1 year after the date of enactment of this Act, the Inspector General of the Federal Communications Commission shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report analyzing the effects of this section, including the amendments made by this section, with respect to improving the efficiency and quality of the Affordable Connectivity Program established under section 904 of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752</external-xref>).</text></subsection><subsection id="HED159B1C9CFD470D80626634FC23E62A"><enum>(e)</enum><header>Appropriation of funds</header><text display-inline="yes-display-inline">Section 904(i)(2) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/47/1752">47 U.S.C. 1752(i)(2)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="H34E981B1111D44E6A710291F94A24427"><enum>(1)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">Appropriation</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Appropriations</header-in-text></quote>;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HADF4B4DC2BCB424FBD99388E55F24C62"><enum>(2)</enum><text>by striking <quote>There is</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C59A946040048E3A805B8CFB832E9FC"><subparagraph id="H0A53A5604CAB460D8A9A4473ECD8BF22"><enum>(A)</enum><header>Fiscal year 2021</header><text>There is</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB5B93FAD72A4DB68B53A0209A0E6349"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H4428D56F4FE54766848842F1B4D1BEBB"><subparagraph id="HB5876BE6507D4053B76D6A003C200AB6"><enum>(B)</enum><header>Fiscal year 2024</header><text>There is appropriated to the Affordable Connectivity Fund, out of any money in the Treasury not otherwise appropriated, $6,000,000,000 for fiscal year 2024, to remain available until expended.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9B93553B57C94DF394A071008E0C30A4"><enum>(f)</enum><header>Rescission</header><text display-inline="yes-display-inline">Section 521(a)(4) of the Consolidated Appropriations Act, 2024 is amended by striking <quote>$12,440,000,000,</quote> and inserting <quote>$18,440,000,000,</quote>.</text></subsection></section></legis-body></bill>
