<section id="H6551E35A46F741EAB459A8CD4A62211B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AM Radio for Every Vehicle Act of 2024</short-title></quote>.</text></section> <section id="H85EFCCA7216A453AAF37D6748AB3041B"><enum>2.</enum><header>Definitions</header> <subsection commented="no" display-inline="no-display-inline" id="H6D62284550854BA2968CADF7547B2636"><enum/><text>In this Act:</text>
<paragraph id="HFDD32ADA134C4CEAB6ABCAA6D86A16C2"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H97A299CB172D477EA012FB110CF54FBC"><enum>(2)</enum><header>AM broadcast band</header><text>The term <term>AM broadcast band</term> means the band of frequencies between 535 kilohertz and 1705 kilohertz, inclusive.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB1F6AD56ADD34A6890DB3ABAC7688A97"><enum>(3)</enum><header>AM broadcast station</header><text>The term <term>AM broadcast station</term> means a radio broadcast station—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HEE7EDB5A189F439DA6EBA8B04A1927E2"><enum>(A)</enum><text display-inline="yes-display-inline">licensed by the Federal Communications Commission for the dissemination of radio communications intended to be received by the public; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H0455A46ABE414445884FB1F04366D9F4"><enum>(B)</enum><text>operated on a channel in the AM broadcast band.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H20C58BBCAA934247AFC5DE437F9EB0F8"><enum>(4)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HC3FD071681604F4E8BF10F3B026FD1AA"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HB0A2B2FA694145049745240A94C6575C"><enum>(B)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HC3E41F4D53AD4C2781DC3FDBEAD730AA"><enum>(C)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H5D13FED919F947719F2EDDC6CB019648"><enum>(D)</enum><text>the Committee on Homeland Security of the House of Representatives; and</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H87DFF1B450C34C5EBB1E466DAE853231"><enum>(E)</enum><text>the Committee on Energy and Commerce of the House of Representatives.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H46FD45EE0B124C8F8C2B543AB20A697F"><enum>(5)</enum><header>Comptroller General</header><text>The term <term>Comptroller General</term> means the Comptroller General of the United States.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H6CB5B1C491D849BDB98D5624EC20E55B"><enum>(6)</enum><header>Device</header><text>The term <term>device</term> means a piece of equipment or an apparatus that is designed—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H5092562BB09243BCB6105C64D82C1B88"><enum>(A)</enum><text display-inline="yes-display-inline">to receive signals transmitted by a radio broadcast station; and </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H9855D5F11C6D47EC94A183BCF3DD3F8B"><enum>(B)</enum><text display-inline="yes-display-inline">to play back content or programming derived from those signals. </text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H303970D18D9F42A2B9051EAEEFCD274F"><enum>(7)</enum><header>Digital audio AM broadcast station</header> <subparagraph commented="no" display-inline="no-display-inline" id="H9D3987CF19E845F2B0813A1C4872FF35"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>digital audio AM broadcast station</term> means an AM broadcast station that uses an In Band On Channel DAB System (as defined in section 73.402 of title 47, Code of Federal Regulations (or a successor regulation)) for broadcasting purposes.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H142523500BA84046B219569B86EB7E1B"><enum>(B)</enum><header>Exclusion</header><text>The term <term>digital audio AM broadcast station</term> does not include an All-digital AM station (as defined in section 73.402 of title 47, Code of Federal Regulations (or a successor regulation)).</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HADE190550AE44A209593F9B5440FFE2D"><enum>(8)</enum><header>IPAWS</header><text>The term <quote>IPAWS</quote> means the public alert and warning system of the United States described in section 526 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/321o">6 U.S.C. 321o</external-xref>).</text></paragraph>
<paragraph id="H830C7744621C4931B23F7E2F699A1E28" commented="no"><enum>(9)</enum><header>Manufacturer</header><text>The term <term>manufacturer</term> has the meaning given the term in section 30102(a) of title 49, United States Code.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HBD6A8A77BDCC4B25A8F0CEA8E2D3866D"><enum>(10)</enum><header>Passenger motor vehicle</header><text>The term <term>passenger motor vehicle</term> has the meaning given the term in section 32101 of title 49, United States Code.</text></paragraph>
<paragraph id="HAD078595E5974753A7CDF0117A097F44" commented="no"><enum>(11)</enum><header>Radio broadcast station</header><text>The term <quote>radio broadcast station</quote> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph> <paragraph id="H5D80AB01BF3B4373A440C52C66DE1918" commented="no"><enum>(12)</enum><header>Radio station license</header><text display-inline="yes-display-inline">The term <quote>radio station license</quote> has the meaning given the term in section 3 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/153">47 U.S.C. 153</external-xref>).</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HBFA246B4F59F4BBCA50CB90111075163"><enum>(13)</enum><header>Receive</header><text>The term <term>receive</term> means to receive a broadcast signal via over-the-air transmission.</text></paragraph> <paragraph id="H289E122B787F458B8A720D168E343D2B" commented="no" display-inline="no-display-inline"><enum>(14)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph>
<paragraph id="HD75A7927754D44ED8654196F16E75841"><enum>(15)</enum><header>Signal</header><text>The term <term>signal</term> means radio frequency energy that a holder of a radio station license intentionally emits or causes to be emitted at a specified frequency for the purpose of transmitting content or programming to the public.</text></paragraph> <paragraph id="HD978703B299B429FBA49D607DC65319B" commented="no"><enum>(16)</enum><header>Standard equipment</header><text>The term <term>standard equipment</term> means motor vehicle equipment (as defined in section 30102(a) of title 49, United States Code) that—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="H00E77CA7CD874267875AFE2EDFFEFC63"><enum>(A)</enum><text display-inline="yes-display-inline">is installed as a system, part, or component of a passenger motor vehicle as originally manufactured; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H929FDAAFC86D4E06BA1E238CC6A62818"><enum>(B)</enum><text display-inline="yes-display-inline">the manufacturer of the passenger motor vehicle recommends or authorizes to be included in the passenger motor vehicle for no additional or separate monetary fee, payment, or surcharge, beyond the base price of the passenger motor vehicle.</text></subparagraph></paragraph>
<paragraph id="H6B0A89EB27484FB18E53A69EDFF0DCC9" commented="no"><enum>(17)</enum><header>State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means each State of the United States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph></subsection></section> <section commented="no" display-inline="no-display-inline" id="HA5ECE164FAB4496F900A44B1047AE531"><enum>3.</enum><header>AM broadcast stations rule</header> <subsection id="H9140F88207AB476D93B9E087DFA1172B"><enum>(a)</enum><header>Rule required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Administrator and the Federal Communications Commission, shall issue a rule—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H8B74A3FF9873489F8D82138B8907AB4B"><enum>(1)</enum><text display-inline="yes-display-inline">requiring devices that can receive signals and play content transmitted by AM broadcast stations be installed as standard equipment in passenger motor vehicles—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H89EE6EC39B684374B7ACFC692B3175F4"><enum>(A)</enum><text display-inline="yes-display-inline">manufactured in the United States for sale in the United States, imported into the United States, or shipped in interstate commerce; and </text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H7927C9F0CE94437282790C6E32323432"><enum>(B)</enum><text display-inline="yes-display-inline">manufactured after the effective date of the rule;</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HDF42D379FDAE491D9490DF464633813C"><enum>(2)</enum><text>requiring access to AM broadcast stations through the devices required under paragraph (1) in a manner that is easily accessible to drivers; and</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="HB8633D738B934C4BA6F4244A1B547BDF"><enum>(3)</enum><text>allowing a manufacturer to comply with that rule by installing devices as described in paragraph (1) that can receive signals and play content transmitted by digital audio AM broadcast stations.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H3E33A4041FCA490DB99ACD45FD09AA68"><enum>(b)</enum><header>Compliance</header> <paragraph commented="no" display-inline="no-display-inline" id="H0C9E2BD0856C4053BE2566EBFFBB64A6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), in issuing the rule required under subsection (a), the Secretary shall establish an effective date for the rule that is not less than 2 years, but not more than 3 years, after the date on which the rule is issued.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H03A100F15DBB4E989C2AAD944D11CE0B"><enum>(2)</enum><header>Certain manufacturers</header><text display-inline="yes-display-inline">In issuing the rule required under subsection (a), the Secretary shall establish an effective date for the rule that is at least 4 years after the date on which the rule is issued with respect to manufacturers that manufactured not more than 40,000 passenger motor vehicles for sale in the United States in 2022.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="H0272A305222143DAA994640FA027AFAD"><enum>(c)</enum><header>Interim requirement</header><text>For passenger motor vehicles manufactured after the date of enactment of this Act and manufactured in the United States for sale in the United States, imported into the United States, or shipped in interstate commerce during the period beginning on the day after the date of enactment of this Act and ending on the day before the effective date of the rule issued under subsection (a) that do not include devices that can receive signals and play content transmitted by AM broadcast stations, the manufacturer of the passenger motor vehicles—</text>
<paragraph commented="no" display-inline="no-display-inline" id="H134FAB14DDCD4468AA3BD0C1402A62E8"><enum>(1)</enum><text display-inline="yes-display-inline">shall provide clear and conspicuous labeling to inform purchasers of those passenger motor vehicles that the passenger motor vehicles do not include devices that can receive signals and play content transmitted by AM broadcast stations; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H332AEF3768304B77BC67C21DC74D589A"><enum>(2)</enum><text>may not charge an additional or separate monetary fee, payment, or surcharge, beyond the base price of the passenger motor vehicles, for access to AM broadcast stations for the period described in this subsection.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="HCF4AFC37FCE14F2FB5681D498548DE28"><enum>(d)</enum><header>Relationship to other laws</header><text>After the date of enactment of this Act, a State or a political subdivision of a State may not prescribe or continue in effect a law, regulation, or other requirement applicable to access to AM broadcast stations in passenger motor vehicles.</text></subsection> <subsection commented="no" display-inline="no-display-inline" id="H317F1CD724F04A14B13FE0ACB1441592"><enum>(e)</enum><header>Enforcement</header> <paragraph commented="no" display-inline="no-display-inline" id="H82016D6917F44C97AD300BBA6639CEA8"><enum>(1)</enum><header display-inline="yes-display-inline">Civil penalty</header><text>Any person who violates the rule issued under subsection (a) shall be liable to the United States Government for a civil penalty under section 30165(a)(1) of title 49, United States Code, as if that rule were a regulation described in that section.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H966AEE36A3C34D75A0E35C5C12E4030B"><enum>(2)</enum><header>Civil action</header><text>The Attorney General may bring a civil action under section 30163 of title 49, United States Code, in an appropriate district court of the United States to enjoin a violation of the rule issued under subsection (a) of this section, as if that rule were a regulation described in subsection (a)(1) of that section 30163.</text></paragraph></subsection> <subsection id="H81B0313333204CBC91AC01BCA261DDC7"><enum>(f)</enum><header>GAO study</header> <paragraph commented="no" display-inline="no-display-inline" id="H753F6C4D43EE401AB1ABD0FFF62E90B0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Comptroller General shall conduct a comprehensive study on disseminating emergency alerts and warnings to the public.</text></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="H215C7AC7F61C4D0A88C03D10F2117989"><enum>(2)</enum><header>Requirements</header><text>The study required under paragraph (1) shall include—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H8855A524524C450785DDB7301EB32B4A"><enum>(A)</enum><text display-inline="yes-display-inline">an assessment of—</text>
<clause commented="no" display-inline="no-display-inline" id="H2BF3AFF339B64EE7AD4B86C36738B640"><enum>(i)</enum><text display-inline="yes-display-inline">the role of passenger motor vehicles in IPAWS communications, including by providing access to AM broadcast stations;</text></clause> <clause commented="no" display-inline="no-display-inline" id="HD5BBDBFF97FB40D6A7F47B390DAB15D5"><enum>(ii)</enum><text>the advantages, effectiveness, limitations, resilience, and accessibility of existing IPAWS communication technologies, including AM broadcast stations in passenger motor vehicles;</text></clause>
<clause commented="no" display-inline="no-display-inline" id="H23C3A8420BE247739347B5A149789296"><enum>(iii)</enum><text>the advantages, effectiveness, limitations, resilience, and accessibility of AM broadcast stations relative to other IPAWS communication technologies in passenger motor vehicles; and</text></clause> <clause commented="no" display-inline="no-display-inline" id="H1538EB8E97114AF09574030C88B125C4"><enum>(iv)</enum><text>whether other IPAWS communication technologies are capable of ensuring the President (or a designee) can reach at least 90 percent of the population of the United States at a time of crisis, including at night; and</text></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H6FF4EDB5A7AD4EF5814209DA490E0B3B"><enum>(B)</enum><text>a description of any ongoing efforts to integrate new and emerging technologies and communication platforms into the IPAWS framework.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HC8FF24924A7B40B383F1529CA347722E"><enum>(3)</enum><header>Consultation required</header><text>In conducting the study required under paragraph (1), the Comptroller General shall consult with—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="HD6DB12860C544C9D89B903BAA84AF51F"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0C352F50A0BE40488AD68D8B5309F006"><enum>(B)</enum><text>the Federal Communications Commission;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H214E1354BAA7407A9FF6DE4F55A98424"><enum>(C)</enum><text>the National Telecommunications and Information Administration;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H48609B0DF17149A298ED356AC3033FA3"><enum>(D)</enum><text display-inline="yes-display-inline">the Secretary;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H1534D6AFB49D40789020F7391EC85000"><enum>(E)</enum><text>Federal, State, Tribal, territorial, and local emergency management officials;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H13075153A3024D818AFB272F61768ECD"><enum>(F)</enum><text>first responders;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H5BA386D360344E4CB21698FA5B6E483B"><enum>(G)</enum><text>technology experts in resilience and accessibility;</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H103CDAE68AE34E8A9477CE3E86BBD8C4"><enum>(H)</enum><text>radio broadcasters;</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="HEB1B730B172F4ED6AF7A46D99BCE1A3F"><enum>(I)</enum><text>manufacturers of passenger motor vehicles; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="HC31F1560FA2749C1955746B1E46923F0"><enum>(J)</enum><text>other relevant stakeholders, as determined by the Comptroller General.</text></subparagraph></paragraph>
<paragraph id="H5B61CAD09F574721B6D3CC7B83C8CB57"><enum>(4)</enum><header>Briefing and report</header>
<subparagraph id="HD9D2E1956D264DDEBE322712939EBF6D"><enum>(A)</enum><header>Briefing</header><text>Not later than 1 year after the date of enactment of this Act, the Comptroller General shall brief the appropriate committees of Congress on the results of the study required by paragraph (1), including recommendations for legislation and administrative action as the Comptroller General determines appropriate.</text></subparagraph> <subparagraph id="HE16BE782E6DA4570A6C3654F93D1D732" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Report</header><text>Not later than 180 days after the date on which the Comptroller General provides the briefing required under subparagraph (A), the Comptroller General shall submit to the appropriate committees of Congress a report describing the results of the study required under paragraph (1), including recommendations for legislation and administrative action as the Comptroller General determines appropriate.</text></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="H41D4871D46B841B09BAE25B7CF46EB42"><enum>(g)</enum><header>Review</header><text>Not less frequently than once every 5 years after the date on which the Secretary issues the rule required by subsection (a), the Secretary, in coordination with the Administrator and the Federal Communications Commission, shall submit to the appropriate committees of Congress a report that shall include an assessment of—</text> <paragraph commented="no" display-inline="no-display-inline" id="HB0F316629BCA4461AFEF3FEF9D1928B0"><enum>(1)</enum><text display-inline="yes-display-inline">the impacts of the rule issued under that subsection, including the impacts on public safety; and</text></paragraph>
