which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to require the National Institutes of Health to select awardees based on merit, and for other purposes.</official-title></form><legis-body id="HFC477571B24245DCAC70A800085A20A1" style="OLC"><section id="HA160421FB4D04997853D33167C0B27CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abolishing Woke Awards for Research and Development Act of 2024</short-title></quote>. </text></section><section id="H8CA139AC09864576965693E9AAF04193"><enum>2.</enum><header>Requiring NIH To select awardees based on merit</header><text display-inline="no-display-inline">Part A of title IV of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/281">42 U.S.C. 281 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF59D944EF0C7458881A3D0BEF8ACE68C" display-inline="no-display-inline"><section id="H8D190894BFB84F988A1C0A7D1CF722AA"><enum>404P.</enum><header>Requiring NIH To select awardees based on merit</header><subsection id="H3B02A75C06924F659C997FFD28CBFE6F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The National Institutes of Health (including any officer thereof)—</text><paragraph id="H364F8B364EDA4C148B20860709DE9A1F"><enum>(1)</enum><text>shall select the recipients of grants, contracts, cooperative agreements, or other awards based only on—</text><subparagraph id="HE4247C5B7C4244C8B0AD4D35300CB2D9"><enum>(A)</enum><text>the merits of the proposals; and</text></subparagraph><subparagraph id="H9CDA25FFA0F441AFA692852C240F7841"><enum>(B)</enum><text display-inline="yes-display-inline">the intrinsic research, development, and scientific benefits of the proposals; and</text></subparagraph></paragraph><paragraph id="H7B76C263ADF04A6C81A770AF43985ED2"><enum>(2)</enum><text display-inline="yes-display-inline">shall not mandate the use of diversity statements or any other diversity, equity, and inclusion material or documentation as a qualification for, or condition of receipt of, an award.</text></paragraph></subsection><subsection id="HAA07A9D825D04F2194ED7CA19E0D3E00"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section may be construed to prevent the National Institutes of Health from conducting or supporting the disaggregation of data by population for purposes of conducting research or developing products.</text></subsection><subsection id="H3623C982B9344C38B0A71A488F13EC09"><enum>(c)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>diversity statement</term> means any written or oral statement discussing—</text><paragraph id="H4551612FF5A845BDB033E978D29FCF16"><enum>(1)</enum><text>the race, sex, color, ethnicity, gender identity, or sexual orientation of the person making the statement;</text></paragraph><paragraph id="H456685A0C57345C7B4EBF3BB0958C92D"><enum>(2)</enum><text>the views of the person making the statement on, experience with, or contributions to—</text><subparagraph id="H15D5F3C2E91D4308BE3F701E1F39F76A"><enum>(A)</enum><text>diversity, equity, and inclusion;</text></subparagraph><subparagraph id="H1ABD380D262649F0B5C3EABDC0884839"><enum>(B)</enum><text>marginalized groups;</text></subparagraph><subparagraph id="H3FFCF7F0A58444988866C6E3E614BBD6"><enum>(C)</enum><text>anti-racism;</text></subparagraph><subparagraph id="H4F3C756CB7E24525AF04384C4AD35929"><enum>(D)</enum><text>social justice;</text></subparagraph><subparagraph id="H1286AC37A69444B29C4D551AB3F13696"><enum>(E)</enum><text>intersectionality;</text></subparagraph><subparagraph id="H4C080644B9674D40A9DDC7C98D42F440"><enum>(F)</enum><text>confessing one's race-based privilege; or</text></subparagraph><subparagraph id="H5A941B0604344E2C95506035EC1A9C0E"><enum>(G)</enum><text>related concepts;</text></subparagraph></paragraph><paragraph id="H65E272A584C24054A336B65CB373F742"><enum>(3)</enum><text>the views of the person making the statement on, experience with the race, sex, color, ethnicity, gender identity, or sexual orientation of students and co-workers; or</text></paragraph><paragraph id="H4C029AF8D00B4EF493B1839D0DE28150"><enum>(4)</enum><text>the views of the person making the statement regarding any theory or practice that advocates for the differential treatment of any individual or groups of individuals based on race, sex, color, gender, ethnicity, gender identity, or sexual orientation.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
