which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><action display="yes"><action-date date="20241114">November 14, 2024</action-date><action-desc>Additional sponsors: <cosponsor name-id="D000629">Ms. Davids of Kansas</cosponsor> and <cosponsor name-id="B000825">Ms. Boebert</cosponsor></action-desc></action><action display="yes"><action-date date="20241114">November 14, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></action><action><action-desc><pagebreak></pagebreak></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the conveyance of certain Federal land at Swanson Reservoir and Hugh Butler Reservoir in the State of Nebraska, and for other purposes.<pagebreak></pagebreak></official-title></form><legis-body id="H8E902D96A9E747B4BDD7B45BB171692D" style="OLC"><section section-type="section-one" id="H26D2772BF8C7409BBA4B38EA13A9FE5B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Swanson and Hugh Butler Reservoirs Land Conveyances Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HED2E4BE61C3E4EF980F629C03FB7110B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC7458D038E6347EC9371AAA03C3D0530"><enum>(1)</enum><header>Fair market value</header><text>The term <term>fair market value</term>, with respect to a specified property right, means the most probable price, as of a specified date, in cash, terms equivalent to cash, or other precisely revealed terms, for which the specified property right should sell after reasonable exposure in a competitive market under all conditions requisite for a fair sale, with the buyer and seller each acting prudently, knowledgeably, and in the self-interest of the buyer or seller, as applicable, and assuming that the buyer and seller are not under undue duress. </text></paragraph><paragraph id="H5D4E51337AF7474391208A13FC9C1C35"><enum>(2)</enum><header>Frontier County</header><text>The term <term>Frontier County</term> means Frontier County, Nebraska, acting through the Board of Commissioners of Frontier County.</text></paragraph><paragraph id="H70077A4B071240AD8B9260C13B717A3E"><enum>(3)</enum><header>Hitchcock County</header><text>The term <term>Hitchcock County</term> means Hitchcock County, Nebraska, acting through the Board of Commissioners of Hitchcock County.</text></paragraph><paragraph id="H53B7699549A9494CB315064FE8FAB5C3"><enum>(4)</enum><header>Hugh Butler Reservoir</header><text>The term <term>Hugh Butler Reservoir</term> means the Hugh Butler Lake and Red Willow Dam constructed as part of the Pick-Sloan Missouri Basin Program, Frenchman-Cambridge Division, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665).</text></paragraph><paragraph id="H7319794713124B4F949FE5E31EC1F1FF"><enum>(5)</enum><header>Lakeview Lodge Management Agreement</header><text>The term <term>Lakeview Lodge Management Agreement</term> means the management agreement entitled <quote>Management Agreement between the Bureau of Reclamation, et al., for the Development, Operation, and Maintenance of a Concession Operation at Swanson Reservoir</quote>, numbered 23–LM–60–4160, and dated March 1, 2022.</text></paragraph><paragraph id="HAC38BA1191AC4F21AA2E9C26FBB12453"><enum>(6)</enum><header>Lakeview Lodge Permitted Concession Land</header><text>The term <term>Lakeview Lodge Permitted Concession Land</term> means the approximately 21.5 acres of land and water for the operation of a public concession at Swanson Reservoir—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7966C780932F4F82B27D7662BE415B4B"><enum>(A)</enum><text display-inline="yes-display-inline">located in the NE<fraction>¼</fraction>NE<fraction>¼</fraction> sec. 9, T. 2 N., R. 34 W., sixth principal meridian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFEC880DAC2504299820DBF60F2C883FF"><enum>(B)</enum><text display-inline="yes-display-inline">as generally depicted on the map prepared by the Bureau of Reclamation entitled <quote>Lakeview Lodge Concession Boundary</quote> and dated August 2023; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H69A0FEB35758497FBC42D4AF27AA17C9"><enum>(C)</enum><text display-inline="yes-display-inline">as further defined by a land survey, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H26DD22E4EA124903B99A8730EEA25B1E"><enum>(7)</enum><header>Property</header><text>The term <term>property</term> means any cabin or trailer site—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC462D8AAE07742E693BD765CA3FE734D"><enum>(A)</enum><text display-inline="yes-display-inline">with respect to which a permit is in effect on the date of enactment of this Act; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H601EBF740D714E8AA8035B2AD59633F9"><enum>(B)</enum><text display-inline="yes-display-inline">that is located on—</text><clause commented="no" display-inline="no-display-inline" id="H3B7EC8EE3AAA4F9E8483240F7067CBCA"><enum>(i)</enum><text display-inline="yes-display-inline">the Lakeview Lodge Permitted Concession Land;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD3A56E10967A48648E929D63550B7DF6"><enum>(ii)</enum><text display-inline="yes-display-inline">the Red Willow Permitted Cabin Land;</text></clause><clause commented="no" display-inline="no-display-inline" id="H2E29F1210D274EA991FE0CBF84D08A46"><enum>(iii)</enum><text display-inline="yes-display-inline">the Red Willow Permitted Concession Land;</text></clause><clause commented="no" display-inline="no-display-inline" id="HA2671A3ED37B4DF784AE7640ED4551A5"><enum>(iv)</enum><text display-inline="yes-display-inline">the Swanson Permitted Cabin Land; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HCAE7B334746C47C6917C1730528ADA8C"><enum>(v)</enum><text>the Swanson Permitted Concession Land.</text></clause></subparagraph></paragraph><paragraph id="H188DD0150E104D578A2D7C7CDFD63AC0"><enum>(8)</enum><header>Red Willow Management Agreement</header><text>The term <term>Red Willow Management Agreement</term> means the management agreement entitled <quote>Management Agreement between the Bureau of Reclamation, et al., for the Development, Management, Operation, and Maintenance of a Concession Operation at Hugh Butler Reservoir</quote>, numbered 24–LM–60–5155, and dated May 1, 2024.</text></paragraph><paragraph id="HBF4FC1AC7D2444BA94DA5536AA71F25C"><enum>(9)</enum><header>Red Willow Permitted Cabin Land</header><text>The term <term>Red Willow Permitted Cabin Land</term> means the approximately 6.5 acres of land encompassing the 8 permitted cabin lots at the Hugh Butler Reservoir—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC03ADA0817D64E11B8495DB0CB42C23E"><enum>(A)</enum><text display-inline="yes-display-inline">located in the S<fraction>½</fraction> sec. 35, T. 5 N., R. 30 W., sixth principal meridian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEDCC31D22804DFA8387D6145425805A"><enum>(B)</enum><text display-inline="yes-display-inline">as generally depicted on the map prepared by the Bureau of Reclamation entitled <quote>Red Willow Cabin Map</quote> and dated March 2024; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFD6BCC00D72648209CFE441EDFEC8C2B"><enum>(C)</enum><text display-inline="yes-display-inline">as further defined by a land survey, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H601044A26FD64BFDA0C46791AA7566EE"><enum>(10)</enum><header>Red Willow Permitted Concession Land</header><text>The term <term>Red Willow Permitted Concession Land</term> means the approximately 23 acres of land and water for the operation of a public service concession at the Hugh Butler Reservoir—</text><subparagraph commented="no" display-inline="no-display-inline" id="H563D958867414C06B240D77F5520FECC"><enum>(A)</enum><text display-inline="yes-display-inline">located in the E<fraction>½</fraction> sec. 25, T. 5 N., R. 30 W., sixth principal meridian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F312A72347C406886587D1E76F514FB"><enum>(B)</enum><text display-inline="yes-display-inline">as generally depicted on the map prepared by the Bureau of Reclamation entitled <quote>Red Willow Concession Boundary</quote> and dated August 2023; and</text></subparagraph><subparagraph id="H6C946659A59E4D05A7141DA4A883E8A3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">as further defined by a land survey, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H10281503FEBC42E9A26DD40C60F13902"><enum>(11)</enum><header>Requested Federal land</header><text>The term <term>requested Federal land</term> means each of the following parcels of land, or any subset of those parcels, with respect to which a title transfer agreement is executed:</text><subparagraph commented="no" display-inline="no-display-inline" id="H3E467BC70BB94803A422FE8E0F8AE87E"><enum>(A)</enum><text display-inline="yes-display-inline">The Lakeview Lodge Permitted Concession Land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84A34964495D4429975FF080537A3592"><enum>(B)</enum><text display-inline="yes-display-inline">The Red Willow Permitted Cabin Land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H45FA62DDF9B64C0E9B5298407AE2CEE7"><enum>(C)</enum><text display-inline="yes-display-inline">The Red Willow Permitted Concession Land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7BAAFF493FAC46AC9CD7D579190AF09A"><enum>(D)</enum><text display-inline="yes-display-inline">The Swanson Permitted Cabin Land.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE4ED255751C443BE9021F8D42261FA81"><enum>(E)</enum><text display-inline="yes-display-inline">The Swanson Permitted Concession Land.</text></subparagraph></paragraph><paragraph id="HAEDED31F83D84D65B4350B54B61B3B7E"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11CE3D1B6F1E4A90BA80BAC5B492D7DC"><enum>(13)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means the State of Nebraska.</text></paragraph><paragraph id="H2ECC0FBDFEAC4FDA82A40328909FFB67"><enum>(14)</enum><header>Swanson Management Agreement</header><text>The term <term>Swanson Management Agreement</term> means the management agreement entitled <quote>Management Agreement between the Bureau of Reclamation, et al., for the Development, Management, Operation, and Maintenance of Concession Operation at Swanson Reservoir</quote>, numbered 23–LM–60–4170, and dated May 1, 2023.</text></paragraph><paragraph id="HC731435F687D4A709700CDEBF3DEA27C"><enum>(15)</enum><header>Swanson Permitted Cabin Land</header><text>The term <term>Swanson Permitted Cabin Land</term> means the approximately 6.2 acres of land encompassing the 11 permitted cabin lots at the Swanson Reservoir—</text><subparagraph commented="no" display-inline="no-display-inline" id="H735B90BBEF054A57844313CF2D8664CB"><enum>(A)</enum><text display-inline="yes-display-inline">located in the N<fraction>1/2</fraction> sec. 18, S<fraction>½</fraction> sec. 7, T. 2 N., R. 33 W., sixth principal meridian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC957DC19F0184176888FD8E6E5F85D2D"><enum>(B)</enum><text display-inline="yes-display-inline">as generally depicted on the map prepared by the Bureau of Reclamation entitled <quote>Swanson Cabin Map</quote> and dated March 2024; and</text></subparagraph><subparagraph id="HB84B77C8E04A4935987D5C3FF0DCC3C6" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">as further defined by a land survey, as the Secretary determines to be appropriate. </text></subparagraph></paragraph><paragraph id="HF5CCEC01436B40CDB0F929E4832E872B"><enum>(16)</enum><header>Swanson Permitted Concession Land</header><text>The term <term>Swanson Permitted Concession Land</term> means the approximately 20 acres of land and water for the operation of a public service concession at the Swanson Reservoir—</text><subparagraph commented="no" display-inline="no-display-inline" id="H37181236F9384453B978134FF49FA751"><enum>(A)</enum><text display-inline="yes-display-inline">located in the N<fraction>½</fraction> sec. 17, T. 2 N., R. 33 W., sixth principal meridian;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H264D8508342A4217AB2C61276A12E0D0"><enum>(B)</enum><text display-inline="yes-display-inline">as generally depicted on the map prepared by the Bureau of Reclamation entitled <quote>Swanson Concession Boundary</quote> and dated August 2023; and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB9FE5B2B9F374FE3BB24C2D26824E2FF"><enum>(C)</enum><text display-inline="yes-display-inline">as further defined by a land survey, as the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="HF9C3091423FB4929A303D9821F13D20F"><enum>(17)</enum><header>Swanson Reservoir</header><text>The term <term>Swanson Reservoir</term> means the Swanson Reservoir and Trenton Dam constructed as part of the Pick-Sloan Missouri Basin Program, Frenchman-Cambridge Division, as authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665). </text></paragraph><paragraph id="H0CCB93891BC74E99B9E93F9700CB3311"><enum>(18)</enum><header>Title transfer agreement</header><text>The term <term>title transfer agreement</term> means a title transfer agreement between the Secretary and Frontier County or Hitchcock County, as applicable, entered into pursuant to a memorandum of agreement to determine the legal, institutional, and financial terms for the conveyance of the Lakeview Lodge Permitted Concession Land, Red Willow Permitted Cabin Land, Red Willow Permitted Concession Land, Swanson Permitted Cabin Land, or Swanson Permitted Concession Land, as applicable.</text></paragraph></section><section id="HD99E9D9219334555A8FACAD4B82C06CE"><enum>3.</enum><header>Conveyances of Federal land to Hitchcock County and Frontier County, Nebraska</header><subsection id="HF0785564724540EF97019D1386102A7F"><enum>(a)</enum><header>Conveyance to Hitchcock County</header><paragraph id="H951D96EB70F643C099DE0B1072F1073D"><enum>(1)</enum><header>Title transfer agreement</header><text>Subject to paragraphs (2) and (6) and sections 4 and 5, not later than 3 years after the date of enactment of this Act, the Secretary shall enter into good faith negotiations to enter into a title transfer agreement with Hitchcock County under which the Secretary shall convey to Hitchcock County all requested right, title, and interest of the United States in and to the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable.</text></paragraph><paragraph id="H0EB974D92F974A8FBB48178C990B14ED"><enum>(2)</enum><header>Prohibition on subdivision</header><text>A title transfer agreement entered into pursuant to paragraph (1) shall be subject to the condition that the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB24BC04C6221460CADFACC6A1D3DCB0D"><enum>(A)</enum><text display-inline="yes-display-inline">shall be conveyed in whole; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE0281A7C0D1845B5921D93F4836ACC57"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be subdivided.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF9B08F15C80C40C7AD872D3AEF47AAE9"><enum>(3)</enum><header>Offer to convey</header><text display-inline="yes-display-inline">As soon as practicable after the date on which a title transfer agreement is entered into pursuant to paragraph (1), the Secretary shall offer to convey to Hitchcock County all right, title, and interest of the United States in and to the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable, in accordance with paragraph (2) and the terms and conditions described in the title transfer agreement.</text></paragraph><paragraph id="H0877EC5F50244DABB26FB8D4BC1EF5A4"><enum>(4)</enum><header>Memorandum of agreement</header><subparagraph commented="no" display-inline="no-display-inline" id="H22EF7265963646669A57B5F606A63A20"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall enter into a memorandum of agreement with Hitchcock County to establish and define the roles and responsibilities for actions required to convey to Hitchcock County the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable, in accordance with the title transfer agreement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H31C4C90CBFA14573A7442AD36C218120"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">The memorandum of agreement entered into under subparagraph (A) shall include the establishment of a plan for— </text><clause id="H9802511D851847A8A96F2A9CA45C8739"><enum>(i)</enum><text>the demonstration by Hitchcock County of—</text><subclause commented="no" display-inline="no-display-inline" id="H79AA2BA1CDA1473086D17DD53ED7AF2A"><enum>(I)</enum><text display-inline="yes-display-inline">the technical capability of Hitchcock County to operate and maintain the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable, permanently; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="HA755B72DC0D2465E84FB54D2C460D552"><enum>(II)</enum><text display-inline="yes-display-inline">the ability of Hitchcock County to satisfy financial obligations relating to the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HE3A2EAC81F7B408B8FD93A3CBF168F10"><enum>(ii)</enum><text>the management by Hitchcock County of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable, to be conveyed in accordance with the memorandum of agreement, including addressing any issues to ensure compliance with applicable State fire, safety, and health codes and standards not later than 2 years after the date of the applicable conveyance.</text></clause></subparagraph></paragraph><paragraph id="H0C970F70590249C890AF30FB6D2F7564"><enum>(5)</enum><header>Costs</header><subparagraph id="HA09BE7CF464E4BC980369EA5C895F10E"><enum>(A)</enum><header>Consideration</header><clause commented="no" display-inline="no-display-inline" id="H9578E3885D95409992393267BE8E4545"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>As consideration for the conveyance of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable, under paragraph (1), Hitchcock County shall provide compensation to the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093), in an amount equal to the fair market value of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, respectively, as determined by an appraisal conducted—</text><subclause commented="no" display-inline="no-display-inline" id="H21B4796A51674DC7807E30EEABFF5176"><enum>(I)</enum><text display-inline="yes-display-inline">in accordance with clause (ii);</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H48310F9E56A0426D90618E7E791C20AA"><enum>(II)</enum><text display-inline="yes-display-inline">by a third-party appraiser approved by the Secretary; and</text></subclause><subclause id="H6C8B777C7EC1438291936A3B4A58B4AD"><enum>(III)</enum><text>subject to the management requirements under paragraph (6) and section 4. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H45DB695EA5154AA2A8932C210B0471B5"><enum>(ii)</enum><header>Appraisal requirements</header><subclause commented="no" display-inline="no-display-inline" id="HE86C17EA2DEC4F7D9738160FF2293AE6"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An appraisal under clause (i) shall be conducted in accordance with the Uniform Standards of Professional Appraisal Practice.</text></subclause><subclause commented="no" id="HCB38F2B639F54921A8BBE5D2E96F1D64"><enum>(II)</enum><header>Exclusion</header><text>For purposes of clause (i), any improvements to the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable, made by a permit holder shall not be included in the appraised value of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, respectively.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H73E5D4852DE34E779D51126142C31C34"><enum>(III)</enum><header>Resolution of dispute</header><text>Any dispute over the fair market value of the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land under an appraisal conducted under clause (i) shall be resolved in accordance with section 2201.4 of title 43, Code of Federal Regulations (or a successor regulation).</text></subclause><subclause id="H6A09DEAABAE840F88EAB1D7D7B1B2AC3"><enum>(IV)</enum><header>Consideration of revenues</header><text>An appraisal under clause (i) shall take into consideration any future income stream that the United States would have derived from the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable, at the time of the conveyance, including revenues to the United States—</text><item id="H9A93403510334AEC82B1E97F2970CCCA"><enum>(aa)</enum><text>from existing water service and repayment contracts;</text></item><item id="HA9C9674F1A7241B3BCFFE3CA8963AFE1"><enum>(bb)</enum><text>from known or reasonably foreseeable new contracts or renewals;</text></item><item id="H59C0401A3B084627BE619DE1C1AAF628"><enum>(cc)</enum><text>as aid to irrigation; and</text></item><item id="H8E00A3966A3448E394441A281EC62E02"><enum>(dd)</enum><text>from any other authorized source.</text></item></subclause></clause></subparagraph><subparagraph id="H6C3781B4ED5E4B9B98A2CA08896088C0"><enum>(B)</enum><header>Conveyance costs</header><clause commented="no" display-inline="no-display-inline" id="HDA062498551F423B920E3DB7C7A19CA8"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Hitchcock County shall be responsible for paying, in advance of the conveyance of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, as applicable, under paragraph (1), the estimated costs associated with the conveyance, as determined by the Secretary. </text></clause><clause commented="no" display-inline="no-display-inline" id="H113D7264A8F34B2892A6E2DEC196DBF2"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Conveyance costs under clause (i) may include—</text><subclause commented="no" display-inline="no-display-inline" id="H05A8D2DD16014773A0B9CCEDD7446B77"><enum>(I)</enum><text display-inline="yes-display-inline">any transaction, survey, and administrative costs necessary for the preparation and completion of transfer of title;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF2ADA8D15AF948CD9AC250D0EAC45724"><enum>(II)</enum><text display-inline="yes-display-inline">the costs of legal instruments and deeds;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H660ED06765144FB098D98F956BF3D166"><enum>(III)</enum><text display-inline="yes-display-inline">the costs of compliance with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and other applicable Federal laws; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H5AB1F1BD21084F26AF5E0E8EF046BA3A"><enum>(IV)</enum><text display-inline="yes-display-inline">the costs of any other conveyance procedures determined to be necessary by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="H687B03CACE6644A682359E6880844DBE"><enum>(6)</enum><header>Management</header><text>Hitchcock County shall manage the Swanson Permitted Cabin Land, the Swanson Permitted Concession Land, or the Lakeview Lodge Permitted Concession Land, as applicable, conveyed under paragraph (1)—</text><subparagraph id="H5A6689D2C8BE444C973F4E85EAEFFE49"><enum>(A)</enum><text>for substantially the same purposes for which the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, respectively, is being used as of the date of enactment of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF57833DB2E464955A77F4AF5036454B6"><enum>(B)</enum><text>for—</text><clause id="H525945A6B27A4F7183661FF8FC161B67"><enum>(i)</enum><text>recreation and public purposes consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>);</text></clause><clause id="H7C2DC973F85E48C591DA6C7083B7CC25"><enum>(ii)</enum><text>public access;</text></clause><clause id="H1974A407A20546CFA4D1493E89CC9892"><enum>(iii)</enum><text>fish and wildlife habitat; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H0ED3A5DD7E0C47B580705EF9F67AC8BA"><enum>(iv)</enum><text>the preservation of the natural character of the Swanson Permitted Cabin Land, Swanson Permitted Concession Land, or Lakeview Lodge Permitted Concession Land, respectively. </text></clause></subparagraph></paragraph></subsection><subsection id="HC3D5726BEE394BEB8DA7FA66527A34B1"><enum>(b)</enum><header>Conveyance to Frontier County</header><paragraph id="H759EED59D6CB4F638FEA4C4107A48C01"><enum>(1)</enum><header>Title transfer agreement</header><text>Subject to paragraphs (2) and (6) and sections 4 and 5, not later than 3 years after the date of enactment of this Act, the Secretary shall enter into good faith negotiations to enter into a title transfer agreement with Frontier County under which the Secretary shall convey to Frontier County all requested right, title, and interest of the United States in and to the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable.</text></paragraph><paragraph id="HC0B516917A8047EA8A889FCDD6C21F9D"><enum>(2)</enum><header>Prohibition on subdivision</header><text>A title transfer agreement entered into pursuant to paragraph (1) shall be subject to the condition that the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7ECDBE29F0AA43F1BBF5C5635CDD26D7"><enum>(A)</enum><text display-inline="yes-display-inline">shall be conveyed in whole; and</text></subparagraph><subparagraph id="H9CEF1B1A604E47D4960F9676D6096804" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">shall not be subdivided.</text></subparagraph></paragraph><paragraph id="HB8ACED2DE4434BBCB7B944BEBF2AFB17"><enum>(3)</enum><header>Offer to convey</header><text>As soon as practicable after the date on which a title transfer agreement is entered into pursuant to paragraph (1), the Secretary shall offer to convey to Frontier County all right, title, and interest of the United States in and to the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable, in accordance with paragraph (2) and the terms and conditions described in the title transfer agreement.</text></paragraph><paragraph id="H851D6EBE6C5E4AB6A6D07633EBB3E334"><enum>(4)</enum><header>Memorandum of agreement</header><subparagraph commented="no" display-inline="no-display-inline" id="HC83F9829D7934C7F9E1D096FDE0A4AC5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">As soon as practicable after the date of enactment of this Act, the Secretary shall enter into a memorandum of agreement with Frontier County to establish and define the roles and responsibilities for actions required to convey to Frontier County the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable, in accordance with the title transfer agreement.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H495DD2FEC5DD4F5AA4CBE995DCDEA514"><enum>(B)</enum><header>Requirement</header><text display-inline="yes-display-inline">The memorandum of agreement entered into under subparagraph (A) shall include the establishment of a plan for—</text><clause id="H0448AF2764674272A80516210D33C064"><enum>(i)</enum><text>the demonstration by Frontier County of—</text><subclause commented="no" display-inline="no-display-inline" id="H53A9092BEDD3496D99AFA3107C2D278F"><enum>(I)</enum><text display-inline="yes-display-inline">the technical capability of Frontier County to operate and maintain the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable, permanently; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6E1D5858F70D49C38DA4897F768E506B"><enum>(II)</enum><text display-inline="yes-display-inline">the ability of Frontier County to satisfy financial obligations relating to the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable; and</text></subclause></clause><clause id="H451E621477204FA6A1FF0D7FEF120D7B"><enum>(ii)</enum><text>the management by Frontier County of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable, to be conveyed in accordance with the memorandum of agreement, including addressing any issues to ensure compliance with applicable State fire, safety, and health codes and standards not later than 2 years after the date of the conveyance.</text></clause></subparagraph></paragraph><paragraph id="H7DE5D251FEA748BDA5B7FA9E7F90487B"><enum>(5)</enum><header>Costs</header><subparagraph id="HFDCF6718EDCC4FAB9317518CAAB0671D"><enum>(A)</enum><header>Consideration</header><clause commented="no" display-inline="no-display-inline" id="HCC957721E61F4D108A901A16C7B4E3A2"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>As consideration for the conveyance of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable, under paragraph (1), Frontier County shall provide compensation to the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093), in an amount equal to the fair market value of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, respectively, as determined by an appraisal conducted—</text><subclause commented="no" display-inline="no-display-inline" id="HD5B8FDDD375A45BCBBA84D1ED591510B"><enum>(I)</enum><text display-inline="yes-display-inline">in accordance with clause (ii);</text></subclause><subclause id="H8EE67CDFB92B470895A6D081AB6EE905" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">by a third-party appraiser approved by the Secretary; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HCE3CDF700FC642B1B74F20F00B5A611D"><enum>(III)</enum><text>subject to the management requirements under paragraph (6) and section 4.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HD8CC07E3E3F54E108838C995041782BA"><enum>(ii)</enum><header>Appraisal requirements</header><subclause commented="no" display-inline="no-display-inline" id="H222E2703F5AB42528C397D2CC1D3986F"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An appraisal under clause (i) shall be conducted in accordance with the Uniform Standards of Professional Appraisal Practice.</text></subclause><subclause commented="no" id="HBC5FA8299F6C42B69118362ABC9A0218"><enum>(II)</enum><header>Exclusion</header><text>For purposes of clause (i), any improvements to the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable, made by a permit holder shall not be included in the appraised value of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, respectively.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HB3FCE3054AA64CD7B53BE600D795ABD7"><enum>(III)</enum><header>Resolution of dispute</header><text>Any dispute over the fair market value of the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable, under an appraisal conducted under clause (i) shall be resolved in accordance with section 2201.4 of title 43, Code of Federal Regulations (or a successor regulation).</text></subclause><subclause id="HEB37F045B4D9457998B2C5AC8F035C58"><enum>(IV)</enum><header>Consideration of revenues</header><text>An appraisal under clause (i) shall take into consideration any future income stream that the United States would have derived from the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable, at the time of the conveyance, including revenues to the United States—</text><item id="H211D90303E7A4F32B609AE04FDF50141"><enum>(aa)</enum><text>from existing water service and repayment contracts;</text></item><item id="HBF6C93956F6749CE82F51FCBA44DCBC7"><enum>(bb)</enum><text>from known or reasonably foreseeable new contracts or renewals;</text></item><item id="HFC36CECB1DD64098A63EBB2FD01AF6CF"><enum>(cc)</enum><text>as aid to irrigation; and</text></item><item id="H856881FA9DB04DDBAF160025859128D0" commented="no" display-inline="no-display-inline"><enum>(dd)</enum><text>from any other authorized source.</text></item></subclause></clause></subparagraph><subparagraph id="HE52F1748200843AC8EB4AFC3B6086EF5"><enum>(B)</enum><header>Conveyance costs</header><clause commented="no" display-inline="no-display-inline" id="HB47911719E454C8996127F627E688404"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Frontier County shall be responsible for paying, in advance of the conveyance of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, as applicable, under paragraph (1), the estimated costs associated with the conveyance, as determined by the Secretary. </text></clause><clause commented="no" display-inline="no-display-inline" id="H5C88C47EDC414E0C993FDD4C55AD84D9"><enum>(ii)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Conveyance costs under clause (i) may include—</text><subclause commented="no" display-inline="no-display-inline" id="HD40A0E1238104C69B51A4DB9D72EB1B2"><enum>(I)</enum><text display-inline="yes-display-inline">any transaction, survey, and administrative costs necessary for the preparation and completion of transfer of title;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H49C38FC496A8458886CB21466E53F4F8"><enum>(II)</enum><text display-inline="yes-display-inline">the costs of legal instruments and deeds;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H72A0F62DA27341CAAD3308546D891D72"><enum>(III)</enum><text display-inline="yes-display-inline">the costs of compliance with the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>) and other applicable Federal laws; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H55C1200B196041809969F1E0337159A1"><enum>(IV)</enum><text display-inline="yes-display-inline">the costs of any other conveyance procedures determined to be necessary by the Secretary.</text></subclause></clause></subparagraph></paragraph><paragraph id="HB1423BD5BA934A47A73D3975E3889F67"><enum>(6)</enum><header>Management</header><text>Frontier County shall manage the Red Willow Permitted Cabin Land or the Red Willow Permitted Concession Land, as applicable, conveyed under paragraph (1)—</text><subparagraph id="H5502571D25F84161A84D2B40A36398A5"><enum>(A)</enum><text>for substantially the same purposes for which the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, respectively, is being used as of the date of enactment of this Act; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB1D4202693CA4444AF520BDA14549FD6"><enum>(B)</enum><text>for—</text><clause id="HCAF849256352401DAAEA2DF87344C7D7"><enum>(i)</enum><text>recreation and public purposes consistent with the Act of June 14, 1926 (commonly known as the <quote>Recreation and Public Purposes Act</quote>) (44 Stat. 741, chapter 578; <external-xref legal-doc="usc" parsable-cite="usc/43/869">43 U.S.C. 869 et seq.</external-xref>);</text></clause><clause id="HEEFAC2C464474D03A123ED8C35C18E5E"><enum>(ii)</enum><text>public access;</text></clause><clause id="H74A5C1D3A68B4E0AABAD1E3E7FDAF25A"><enum>(iii)</enum><text>fish and wildlife habitat; or</text></clause><clause id="H8D25EEAD635F4575A969E05FB4C6C459"><enum>(iv)</enum><text>the preservation of the natural character of the Red Willow Permitted Cabin Land or Red Willow Permitted Concession Land, respectively.</text></clause></subparagraph></paragraph></subsection><subsection id="HB570B7552B084A3E87E5C9B632A46830"><enum>(c)</enum><header>Reclamation title transfer procedures</header><text>Any procedures for the conveyance of requested Federal land under subsection (a) or (b) shall comply with the requirements contained in the Reclamation Manual Directives and Standards numbered CMP 11–01 (as in effect on the date of enactment of this Act), as determined to be applicable by the Secretary.</text></subsection><subsection id="H85FA81D2CD5246968DAA360A7566B2BD"><enum>(d)</enum><header>Subsequent conveyance of requested Federal land</header><paragraph id="HFE6A6230A7294080A3C0114710351F8D"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), on completion of a conveyance to Hitchcock County or Frontier County, as applicable, of requested Federal land under subsection (a) or (b), Hitchcock County or Frontier County may not subsequently reconvey the applicable requested Federal land.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H14E416461DDE4C2AA7328A85D6F295FB"><enum>(2)</enum><header>Exceptions</header><text>Notwithstanding paragraph (1), Hitchcock County or Frontier County may subsequently convey requested Federal land if—</text><subparagraph id="H591BDA1D0E344F0FA6BC3CD6B3B306A0"><enum>(A)</enum><text>the requested Federal land is reconveyed, at no cost, to an entity located in the State that is recognized by the State as a publicly owned or governmental organization, including—</text><clause commented="no" display-inline="no-display-inline" id="H8C9E97B30EFF451D91D8BEF90EDCF292"><enum>(i)</enum><text display-inline="yes-display-inline">a State agency;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC0DF2164D09E4AAE8AFAFB3E24BA6F40"><enum>(ii)</enum><text display-inline="yes-display-inline">a county, city, village, or township in, or political subdivision of, the State;</text></clause><clause commented="no" display-inline="no-display-inline" id="H37F261676E6E4CAF9836A8C2E230C304"><enum>(iii)</enum><text display-inline="yes-display-inline">a natural resource district; and</text></clause><clause id="H10B1EA17433F49F5A5F8AD3752DA2B60" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">an irrigation or reclamation district;</text></clause></subparagraph><subparagraph id="H74F7CB0CFBC4412980BE4523D4EC85B2"><enum>(B)</enum><text>Hitchcock County or Frontier County, respectively, has demonstrated an impending adverse impact if the requested Federal land is not reconveyed; </text></subparagraph><subparagraph id="HF6D559EDA2AA492CBB97E14815A1A970"><enum>(C)</enum><text>the entity to which the requested Federal land would be reconveyed has the capacity to continue to manage the requested Federal land for the same purposes for which the requested Federal land has been managed as of the date of enactment of this Act; and</text></subparagraph><subparagraph id="H660EE9A24083450BB72B9493CC8AFBF7"><enum>(D)</enum><text>the requested Federal land to be reconveyed would continue to be available for public access.</text></subparagraph></paragraph><paragraph id="HA16C353FC3544E8ABA4D3BE3A2804310"><enum>(3)</enum><header>Future conveyances</header><text>A subsequent conveyance of requested Federal land shall be subject to the requirements of this subsection and subsections (a)(6) and (b)(6), as applicable.</text></paragraph></subsection></section><section id="HC0C78B63CE824475BBC27787EC4F98E6"><enum>4.</enum><header>Effect on reservations, easements, and other rights</header><subsection id="HB12AEA242D3645DB8B8750DA17278243"><enum>(a)</enum><header>In general</header><text>A conveyance under subsection (a) or (b) of section 3 shall be subject to—</text><paragraph id="H8142B4985F754F6488E168D3C3173849"><enum>(1)</enum><text>valid existing rights;</text></paragraph><paragraph id="HA912965762B4433FA761A3D109912EF1"><enum>(2)</enum><text>operational requirements of the Pick-Sloan Missouri River Basin Program authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891, chapter 665), including Swanson Reservoir and Hugh Butler Reservoir; </text></paragraph><paragraph id="H9F4718B3CC67470AA7CF829F41BAF867"><enum>(3)</enum><text>any flowage easement reserved by the United States to allow full operation of the Swanson Reservoir and Hugh Butler Reservoir for authorized purposes, as applicable;</text></paragraph><paragraph id="HE3B2943524E84FE8BDE55795F15F2EC1"><enum>(4)</enum><text>any applicable reservations described in—</text><subparagraph commented="no" display-inline="no-display-inline" id="H54AAE2D21A2E44BB8FE3096EC98D7AF6"><enum>(A)</enum><text display-inline="yes-display-inline">the Lakeview Lodge Management Agreement, Red Willow Management Agreement, or Swanson Management Agreement, as applicable; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H85F048D7E67342C89EAACA162E2C4AE1"><enum>(B)</enum><text>an applicable cabin permit;</text></subparagraph></paragraph><paragraph id="H0C1CD89A385B4654B999A4F9953228B6"><enum>(5)</enum><text>oil, gas, and other mineral rights reserved of record, as of the date of enactment of this Act, by, or in favor of, the United States or a third party, with respect to the applicable requested Federal land;</text></paragraph><paragraph id="HB8FEFDD7983A4888800198794B870C78"><enum>(6)</enum><text>any permit, license, lease, right-of-use, flowage easement, or right-of-way of record in, on, over, or across the applicable requested Federal land, whether owned by the United States or a third party, as of the date of enactment of this Act;</text></paragraph><paragraph id="H221FACCB923749ED859600809EDB2170"><enum>(7)</enum><text>a deed restriction that prohibits building any new permanent structure on the applicable requested Federal land below an elevation of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HBB12FB9E7B544317ADAB7C63BB61AE0B"><enum>(A)</enum><text display-inline="yes-display-inline">2,785 feet at Swanson Reservoir; or</text></subparagraph><subparagraph id="H31D04BD8E84643609F0CD214EAEC2D03"><enum>(B)</enum><text>2,628 feet at Hugh Butler Reservoir; and</text></subparagraph></paragraph><paragraph id="HDD9CAD38FEA14E31818C9ACE14514298"><enum>(8)</enum><text>the granting of applicable easements for—</text><subparagraph id="H42F0ABDF41F6404FB27F7131A1748086"><enum>(A)</enum><text>vehicular access to the applicable requested Federal land; and</text></subparagraph><subparagraph id="H94319A01C8BB470383FD0ED861CEF12F"><enum>(B)</enum><text>access to, and use of, all docks, boathouses, ramps, retaining walls, and other improvements for which access is provided in a permit for the use of the applicable requested Federal land as of the date of enactment of this Act.</text></subparagraph></paragraph></subsection><subsection id="HD991CEA768BF432080DBB82A66FECB1E"><enum>(b)</enum><header>Liability; taking</header><paragraph id="H8DD842DD044940439EDED018BAF0BCB0"><enum>(1)</enum><header>Liability</header><text>The United States shall not be liable for flood damage to a property, Hitchcock County, or Frontier County, or for damages arising out of any act, omission, or occurrence relating to a permit holder, Hitchcock County, or Frontier County, other than for damages caused by an act or omission of the United States or an employee, agent, or contractor of the United States before the date of enactment of this Act. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3CCD2DC02C3A48C5A4A0EFE15DDD9D97"><enum>(2)</enum><header>Hold harmless</header><text display-inline="yes-display-inline">Hitchcock County, Frontier County, and any entity to which requested Federal land is subsequently conveyed pursuant to section 3(d)(2) shall agree to indemnify and hold harmless the Unites States for all claims by Hitchcock County, Frontier County, or others arising from—</text><subparagraph id="HA493A8B440364E7198659E569D38C38C"><enum>(A)</enum><text>the design, construction, operation, maintenance, or replacement of Red Willow Dam, Hugh Butler Reservoir, Trenton Dam, or Swanson Reservoir;</text></subparagraph><subparagraph id="H99F8A1E35ADB43148D7795C3821BAABE"><enum>(B)</enum><text>the survey of claims, description of claims, delineation of boundaries, conveyance documents, conveyance process, and recording of deeds associated with a conveyance under this Act; or</text></subparagraph><subparagraph id="H84A350BAECBD431AAC5A926C95AEE7FE"><enum>(C)</enum><text>any damages associated with a structure or land that may be displaced in a flood event.</text></subparagraph></paragraph><paragraph id="HA468036B09B1435C96111A9FFEDF94F2"><enum>(3)</enum><header>No additional liability</header><text>Nothing in this Act increases the liability of the United States beyond the liability provided under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/171">chapter 171</external-xref> of title 28, United States Code (commonly known as the <quote>Federal Tort Claims Act</quote>).</text></paragraph><paragraph id="H86C024F5197642F7B9868D0A65917770"><enum>(4)</enum><header>Taking</header><text>Any temporary flooding or flood damage to a property, Hitchcock County, or Frontier County, shall not be considered to be a taking by the United States.</text></paragraph></subsection></section><section id="H30DCB1BBB01849328DC8C1744B8B9521"><enum>5.</enum><header>Interim requirements</header><text display-inline="no-display-inline">During the period beginning on the date of enactment of this Act and ending on the date of conveyance of requested Federal land under subsection (a) or (b) of section 3, the provisions of the Lakeview Lodge Management Agreement, Red Willow Management Agreement, and Swanson Management Agreement, as applicable, and any applicable permits, shall remain in force and effect.</text></section><section id="HAB417D717E014F67AF8EF2057CA2DE3A"><enum>6.</enum><header>Compliance with other laws</header><subsection id="H5A9206FF95C946C6B23BB654760C64B4"><enum>(a)</enum><header>Environmental and historic preservation laws</header><text>Before conveying requested Federal land pursuant to subsection (a) or (b) of section 3, the Secretary shall carry out all activities with respect to the conveyance required under—</text><paragraph id="HC81D6A6FDB1A4D63B804E449EF5D7E51"><enum>(1)</enum><text>the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></paragraph><paragraph id="H45B6E37421764462AD90BAC2583A88D5"><enum>(2)</enum><text>the <act-name parsable-cite="ESA">Endangered Species Act of 1973</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>);</text></paragraph><paragraph id="H80A1C39123034E54A027EF771E507887"><enum>(3)</enum><text>division A of subtitle III of title 54, United States Code; and</text></paragraph><paragraph id="HF1E5BDC5660449D482F23641A0541256"><enum>(4)</enum><text>any other applicable laws.</text></paragraph></subsection><subsection id="H004B0ADC6768446C82B28B806F14847A"><enum>(b)</enum><header>Compliance by Counties</header><text>Effective on the date of conveyance of requested Federal land pursuant to subsection (a) or (b) of section 3, Hitchcock County and Frontier County shall comply with all applicable Federal, State, and local laws (including regulations) with respect to management of the conveyed requested Federal land, as applicable.</text></subsection></section></legis-body><endorsement display="yes"><action-date date="20241114">November 14, 2024</action-date><action-desc>Committed to the Committee of the Whole House on the State of the Union and ordered to be printed</action-desc></endorsement></bill>
