which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committees on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, <committee-name committee-id="HIG00">Intelligence (Permanent Select)</committee-name>, and <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish prohibitions with respect to vessels loaded or previously held at ports, harbors, or marine terminals in certain Western Hemisphere countries and with respect to which land owned, held, or controlled directly or indirectly by United States persons that is necessary to access the ports, harbors, marine terminals, or relevant port infrastructure has been nationalized, forcibly limited, or expropriated by the governments of such countries, and for other purposes.</official-title></form><legis-body id="HEEFD03646E41468BB5AC3D148F008284" style="OLC"><section id="H7F96209454BF46FB91AD9A5132D8D63F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Defending American Property Abroad Act</short-title></quote>.</text></section><section id="HFCCDBB1E43724EA895C1A42D69EC750C"><enum>2.</enum><header>Designation of prohibited property</header><text display-inline="no-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Homeland Security shall—</text><paragraph id="HB828D5E2DF254E67B5601EB2C2395075"><enum>(1)</enum><text>designate all prohibited property, as defined in section 5 of this Act; and</text></paragraph><paragraph id="HC919031E61D74846814F7F6EFFE9D2A0"><enum>(2)</enum><text>provide a list of all prohibited property designated pursuant to paragraph (1) to—</text><subparagraph id="H7860C984E31F4AAD846CF61883EB9EAF"><enum>(A)</enum><text>the necessary agencies and officials within the Department of Homeland Security and the Department of State for the implementation of section 3 of this Act; and</text></subparagraph><subparagraph id="H1518F8DFCB0A4CF189E42DA8AF6862C6"><enum>(B)</enum><text>the appropriate congressional committees.</text></subparagraph></paragraph></section><section id="H4929A717520E425BBCB54AE9379EE741"><enum>3.</enum><header>Prohibitions on the use of designated property</header><subsection id="H4180FB327FF443ABA236574A74E80CC5"><enum>(a)</enum><header>In general</header><text>For fiscal year 2024 and each fiscal year thereafter, none of the funds appropriated or otherwise made available to the Department of Homeland Security or the Department of State may be used to allow a vessel loaded or previously held at a port, harbor, or marine terminal that is designated by the Secretary of Homeland Security as a prohibited property under section 2(1) of this Act to—</text><paragraph id="H1498E55B3F8D453CB00C4A22C2523DB6"><enum>(1)</enum><text>import into the United States any good, ware, article, merchandise, or other freight;</text></paragraph><paragraph id="H98D4D08F3DE74A22BBD89412F2C4A59B"><enum>(2)</enum><text>release into the United States any good, ware, article, merchandise, or other freight;</text></paragraph><paragraph id="H24813E5B80CC46A19D29C35FCCA9CD65"><enum>(3)</enum><text>dock any passenger vessel in the United States;</text></paragraph><paragraph id="HF6F58E95BAD3485BB54872C1566A36AA"><enum>(4)</enum><text>release into the United States any passengers from a passenger vessel; or</text></paragraph><paragraph id="HEB394F67BE7C4990A973102A9CB53E1C"><enum>(5)</enum><text>dry dock, complete repair work, refurbish, victual, refuel, or conduct any other servicing or maintenance-related activities.</text></paragraph></subsection><subsection id="H2DDEF85116E745ADA7AA06B4DBAC3C88"><enum>(b)</enum><header>Prohibition on government activities or salaries</header><text>For fiscal year 2024 and each fiscal year thereafter, none of the funds appropriated or otherwise made available to the Department of Homeland Security or the Department of State shall be available for any activity or for paying the salary of any Government employee in the case in which funding the activity or paying the salary to a Government employee would result in a determination, regulation, or policy that would limit or impede the enforcement of subsection (a) of this section.</text></subsection></section><section id="H7E063C5668304830A2FA1F8534F4D16B"><enum>4.</enum><header>Reports to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, and each year thereafter—</text><paragraph id="HC179DA39ABF04C2BA5A0F1B3D02975EB"><enum>(1)</enum><text>the Secretary of Homeland Security shall submit to the appropriate congressional committees a report on—</text><subparagraph id="H85777B89E42B440EBE5868CBEC6D88FE"><enum>(A)</enum><text>the number of prohibited property designations made by the Secretary under section 2(1) of this Act;</text></subparagraph><subparagraph id="H979CA62DC3DC40FDBC32E8EAA657DFFA"><enum>(B)</enum><text>the number of freight vessels that were prevented from importing or releasing any goods, wares, articles, merchandise, or other freight into the United States under the prohibition in section 3 of this Act;</text></subparagraph><subparagraph id="H6D54F650574B4C80B101FEB20E32961E"><enum>(C)</enum><text>the number of passenger vessels that were prevented from docking or releasing passengers into the United States under the prohibition in section 3 of this Act; and</text></subparagraph><subparagraph id="H2E3F192D943748EEA98A60B891CE7A85"><enum>(D)</enum><text>the number of vessels that were prevented from dry docking, completing repair work, refurbishing, victualling, refueling, or conducting any other servicing or maintenance-related activities;</text></subparagraph></paragraph><paragraph id="H846CF38771ED4A54B9417E2544ACF1CA"><enum>(2)</enum><text>the United States Trade Representative shall submit to the appropriate congressional committees a report on—</text><subparagraph id="HFFB86D5D07074526BCF0313848D18BE8"><enum>(A)</enum><text>the number of foreign trade partner governments that have—</text><clause id="H69CC6FA85C1B40A699248DC7D4AD9E24"><enum>(i)</enum><text>nationalized, forcibly limited, or expropriated land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure;</text></clause><clause id="HC12EBE60824441B8BD27CB4F7C569A95"><enum>(ii)</enum><text>repudiated or nullified any contract, permit, concession, easement, or similar authorization with a United States person related to land necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause><clause id="HAEDB910C7A0F4E29AE58010706D33663"><enum>(iii)</enum><text>taken any other action which has the effect of seizing ownership or control of the land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause></subparagraph><subparagraph id="H6381D5D281634AFC9AFBE3A0D709E12B"><enum>(B)</enum><text>the impact of the actions described in subparagraph (A) on the existing trade relationship between the United States and any such foreign trade partner;</text></subparagraph></paragraph><paragraph id="H9ED8F77968B9410581C8CE4591D14A78"><enum>(3)</enum><text>the Director of National Intelligence shall submit to the appropriate congressional committees a report on—</text><subparagraph id="H1A19C9F3417343C88F22C5E7432AD04E"><enum>(A)</enum><text>the national security implications of actions by foreign trade partners to—</text><clause id="HF7B6BB2035D5434C84DBF2DECA185478"><enum>(i)</enum><text>nationalize, forcibly limit, or expropriate land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure;</text></clause><clause id="H31FDC57B25DE455F81F980542344A36B"><enum>(ii)</enum><text>repudiate or nullify any contract, permit, concession, easement, or similar authorization with a United States person related to land necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause><clause id="H5CD61250691D4A2AAC0EDABF31D09CD6"><enum>(iii)</enum><text>seize ownership or control of land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause></subparagraph><subparagraph id="H3B3C674BE6C345AF9E78BEEB5A9762F5"><enum>(B)</enum><text>the impact of the actions described in subparagraph (A) on the national security assessment of any such foreign trade partner; and</text></subparagraph></paragraph><paragraph id="H1A93B4A8481441F0AF35E767A1E7964A"><enum>(4)</enum><text>the Secretary of State shall submit to the appropriate congressional committees a report on—</text><subparagraph id="H215A2E991DA240F3B0113966B2320F91"><enum>(A)</enum><text>the economic implications of actions by foreign trade partners to—</text><clause id="HD6CE4D0E74C74449ACFBC74F97C6855A"><enum>(i)</enum><text>nationalize, forcibly limit, or expropriate land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure;</text></clause><clause id="HD743E327E8DA4BB8848882C877740575"><enum>(ii)</enum><text>repudiate or nullify any contract, permit, concession, easement, or similar authorization with a United States person related to land necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause><clause id="H96EE514C1E994F078F6866CF1F3843FF"><enum>(iii)</enum><text>seize ownership or control of land owned, held, or controlled directly or indirectly by a United States person that is necessary to access a port, harbor, marine terminal, or relevant port infrastructure; and</text></clause></subparagraph><subparagraph id="H81C7D884EE2C4A1CA7A8A70F7BA9B4F8"><enum>(B)</enum><text>the impact of the actions described in subparagraph (A) on the economic assessment of the investment climate of any such foreign trade partner.</text></subparagraph></paragraph></section><section id="H0E6B3377CF67477AAEB4880488A308C5"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this Act:</text><paragraph id="HDB8F7B79DB9A4D4C9970C820C1BDDEE0"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <quote>appropriate congressional committees</quote> means—</text><subparagraph id="H0AE0F076DA974BD8A8B3D7C7EEC23CEC"><enum>(A)</enum><text>in the House of Representatives—</text><clause id="H2CA869DB789641E69684AEB83D4BCC3B"><enum>(i)</enum><text>the Committee on Homeland Security;</text></clause><clause id="H1DFD33716F8A4E5C81B25CE325ED07C2"><enum>(ii)</enum><text>the Committee on Foreign Affairs;</text></clause><clause id="H9BD03CA2F300480EB640D615900A25DB"><enum>(iii)</enum><text>the Committee on Ways and Means; and</text></clause><clause id="H3706E6585C2F421883452D33C8CC6A50"><enum>(iv)</enum><text>the Permanent Select Committee on Intelligence; and</text></clause></subparagraph><subparagraph id="H563A05BAE68649809D0DE9096A826FFB"><enum>(B)</enum><text>in the Senate—</text><clause id="H1A68E0CDA84A49049034238135185736"><enum>(i)</enum><text>the Committee on Homeland Security and Governmental Affairs;</text></clause><clause id="H83A8CF3F89814BA5AE0B44FCF2CDB9F1"><enum>(ii)</enum><text>the Committee on Foreign Relations;</text></clause><clause id="HE6EA35521DA54ED6A504F5177324B403"><enum>(iii)</enum><text>the Committee on Finance; and</text></clause><clause id="HECC0FF28B2C14050BB5600E2DDA38F60"><enum>(iv)</enum><text>the Committee on Intelligence.</text></clause></subparagraph></paragraph><paragraph id="H2299290A58CE4BA8A783C83EF9B65F9A"><enum>(2)</enum><header>Foreign trade partner</header><text>The term <quote>foreign trade partner</quote> means a Western Hemisphere country that is party to an active free trade agreement with the United States;</text></paragraph><paragraph id="H223978240392490FA0D3B4D9556CF7C2"><enum>(3)</enum><header>Passenger vessel</header><text>The term <quote>passenger vessel</quote> means a vessel that—</text><subparagraph id="H1389DE52CDA14A4588962E22407615B2"><enum>(A)</enum><text>is authorized to carry at least 250 passengers;</text></subparagraph><subparagraph id="H0D45F1FEAFB14966B2F803EBF32C83EF"><enum>(B)</enum><text>has onboard sleeping facilities for each passenger;</text></subparagraph><subparagraph id="HAF89C125402C45608B041CDE8D08F0B9"><enum>(C)</enum><text>is on a voyage that embarks or disembarks passengers; and</text></subparagraph><subparagraph id="HAED1B84879AD498E8D01EB90B0239350"><enum>(D)</enum><text>is not engaged in a coastwise voyage;</text></subparagraph></paragraph><paragraph id="HE1367815AD3A47E3B37D71E7C46FD317"><enum>(4)</enum><header>Prohibited property</header><text>The term <quote>prohibited property</quote> means any ports, marine terminals, or harbors that—</text><subparagraph id="H22DBE4FD50CC4C4994E814AEB5E5BF4A"><enum>(A)</enum><text>are located within the territory of a foreign trade partner;</text></subparagraph><subparagraph id="H61676552A7CF43B0877318E1B248934A"><enum>(B)</enum><text>are only accessible by land that is owned, held, or controlled directly or indirectly by a United States person; and</text></subparagraph><subparagraph id="HF8F75BEFB01F4610B9678FF023B6D017"><enum>(C)</enum><text>the departments, agencies, or officials of such trade partner have on or after January 1, 2024—</text><clause id="H13146F10BD1E424C9F56FEE8D21205F4"><enum>(i)</enum><text>nationalized, forcibly limited, or expropriated the land owned, held, or controlled directly or indirectly by a United States person that is necessary to access the port, harbor, marine terminal, or relevant port infrastructure;</text></clause><clause id="H8694F4A4F4824C64B008E8F08F4C977A"><enum>(ii)</enum><text>repudiated or nullified any contract, permit, concession, easement, or similar authorization with a United States person related to the land necessary to access the port, harbor, marine terminal, or relevant port infrastructure; or</text></clause><clause id="HBD467A7E4E7548B9958FBD37CC837A1B"><enum>(iii)</enum><text>taken any other action which has the effect of seizing ownership or control of the land owned, held, or controlled directly or indirectly by a United States person that is necessary to access the port, harbor, marine terminal, or relevant port infrastructure;</text></clause></subparagraph></paragraph><paragraph id="H731E7D21BF38415190B4C014873FC10C"><enum>(5)</enum><header>Relevant port infrastructure</header><text>The term <quote>relevant port infrastructure</quote> means—</text><subparagraph id="HB0DAC1E8955D48E68D575C419B3522FB"><enum>(A)</enum><text>conveyors and other equipment used to load or unload freight or passenger vessels;</text></subparagraph><subparagraph id="H1D6F77B53F254D4B8126E92193CCDBF1"><enum>(B)</enum><text>roads and pathways used to load or unload freight or passenger vessels;</text></subparagraph><subparagraph id="HC7F2DB0FC78647BABD6A33FD6D490E39"><enum>(C)</enum><text>docks and piers used to load or unload freight or passenger vessels;</text></subparagraph><subparagraph id="HFF999A2913CA40008B79D6441BF3D1C9"><enum>(D)</enum><text>moorings, dolphins, or other structures used for anchoring freight or passenger vessels;</text></subparagraph><subparagraph id="HFDB15081A8D647FDB6730AEE7EA00819"><enum>(E)</enum><text>silos, domes, or other structures used for the storage of any good, ware, article, merchandise, or other freight; and</text></subparagraph><subparagraph id="H267DAF0D74524C3FA86C4AF4206BBF57"><enum>(F)</enum><text>offices, facilities, and other buildings used for the administration and security of the port or harbor; and</text></subparagraph></paragraph><paragraph id="H18D33AC9470547E4B57F676A47F47FE2"><enum>(6)</enum><header>United states person</header><text>The term <quote>United States person</quote> means a United States citizen or corporation, partnership, or association at least 50 percent beneficially owned by United States citizens.</text></paragraph></section></legis-body></bill>
