BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to further restrict contributions of foreign nationals, and for other purposes.</official-title></form><legis-body id="H516CBFED4FEB4B21B55D510B523A6E95" style="OLC"><section section-type="section-one" id="HD35CEF2179A044D691B66D8ECF98BC86"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preventing Foreign Interference in American Elections Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="HD0AF34D1B1524863815A6876E01C9C89"><enum>2.</enum><header>Modifications to foreign money ban</header><subsection commented="no" display-inline="no-display-inline" id="H9A1EC30A456D40A99BE6E8BA4AA7751B"><enum>(a)</enum><header>Additional restrictions</header><paragraph commented="no" display-inline="no-display-inline" id="HF22862B550A7413B85D80DA43A220FDA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 319(a)(1) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)(1)</external-xref>) is amended—</text><subparagraph id="H8250E9FF84364F85A4B8CA52CD7BFCB6"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subparagraph (B); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE662B43EB2CC41BFB7CBB9887936BE42"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H9AFDD16200384728930801920068CF4D"><subparagraph commented="no" display-inline="no-display-inline" id="H52C9E9844D7D419D965A687A5F821ABC"><enum>(D)</enum><text>a donation for the purpose of—</text><clause commented="no" display-inline="no-display-inline" id="HE6490B8890344DE48673BD6E495BB502"><enum>(i)</enum><text display-inline="yes-display-inline">voter registration activity;</text></clause><clause commented="no" display-inline="no-display-inline" id="HB30DD76D0AC44FC797FAF719C3E463A9"><enum>(ii)</enum><text>ballot collection;</text></clause><clause commented="no" display-inline="no-display-inline" id="HD69EEB9DA8D44BBBBEAAC1A7F4C763FA"><enum>(iii)</enum><text display-inline="yes-display-inline">voter identification;</text></clause><clause commented="no" display-inline="no-display-inline" id="HAFC73FE415E54E0E9DA3814056286919"><enum>(iv)</enum><text display-inline="yes-display-inline">get-out-the-vote activity; </text></clause><clause commented="no" display-inline="no-display-inline" id="H255F9CD54DA247BBB7BB854DCBF51D00"><enum>(v)</enum><text display-inline="yes-display-inline">any public communication that refers to a clearly identified Federal, State, or local political party; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H46F40EB89DC9466EB83DEA4142F0C1A3"><enum>(vi)</enum><text>the administration of a Federal, State, or local election; or</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF2B23CD99CB045C1A0508966E9864182"><enum>(2)</enum><header>Conforming amendment</header><text>Section 319(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)(2)</external-xref>) is amended by striking <quote>subparagraph (A) or (B) of paragraph (1)</quote> and inserting <quote>subparagraph (A), (B), or (D) of paragraph (1)</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HED7F15EC00244B4A9C7D3A934E740684"><enum>(b)</enum><header>Prohibition on aiding or facilitating violations</header><text>Section 319(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121(a)</external-xref>), as amended by subsection (a), is amended—</text><paragraph id="H7FA28961858848E2AB0B1499281127A1"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of paragraph (1)(D);</text></paragraph><paragraph id="H3B5FB5FF42B4435A97F9C97FEDB81083"><enum>(2)</enum><text>by striking the period at the end of paragraph (2) and inserting <quote>; or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1AF25E96D9A14BDE867E45461B7FBCD9"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H88FC0121A0B64B1CBFCFE518E2414CDA"><paragraph commented="no" display-inline="no-display-inline" id="H44B620A183814DB4B1F785F9C17586BB"><enum>(3)</enum><text>a person to knowingly aid or facilitate a violation of paragraph (1) or (2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6CF9EF1384B445F49811A6D460FA7A82"><enum>(c)</enum><header>Indirect contributions</header><text>Section 319 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H508CB581A5074AAB92D1C0F2E7A9B64A"><subsection id="H05D91A931F134CD280A823030A11725F"><enum>(c)</enum><header>Indirect contributions</header><text>For purposes of this section, a person shall be treated as having indirectly made a contribution, donation, expenditure, or disbursement described in subparagraph (A), (B), (C), or (D) of subsection (a)(1) if such person has made a contribution or donation to a person with a designation, instruction, or encumbrance (whether direct or indirect, express or implied, oral or written, or involving intermediaries or conduits) which results in any part of such contribution, donation, expenditure, or disbursement being used for an activity described in subparagraph (A), (B), (C), or (D) of subsection (a)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H352B21E75E6F45C49400B59206075AE1"><enum>(d)</enum><header>Enforcement provisions</header><text>Section 319 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30121">52 U.S.C. 30121</external-xref>), as amended by subsection (c), is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAEF8CB28E8D14756907A06D7F078A684"><subsection commented="no" display-inline="no-display-inline" id="HBFEBF7735282467EA9ED90F999E3EA75"><enum>(d)</enum><header>Enforcement</header><paragraph commented="no" display-inline="no-display-inline" id="HC135377F33AA409D975B5160EC3751BD"><enum>(1)</enum><header display-inline="yes-display-inline">Use of certification as a defense</header><subparagraph commented="no" display-inline="no-display-inline" id="H6E7D73FB37374C6AA7B1C2840AE33BA3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any allegation that a person has violated subsection (a), any person alleged in the complaint may, in connection with a response to such allegation under section 309(a)(1), submit, under penalty of perjury, a certification that no such violation has occurred.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFAA9ADE3654E4A969DDAA324D8538368"><enum>(B)</enum><header>Effect of submission</header><text>The Commission shall take into consideration any certification submitted under subparagraph (A) in making a determination under section 309(a)(2) whether there is reason to believe such violation has occurred.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9B4CD1F41D86400896F5A60973EC77B4"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation on investigations</header><subparagraph commented="no" display-inline="no-display-inline" id="HCEB8EE0473464EB9BF24597A66EA93B8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>If the Commission makes a determination under section 309(a)(2) that there is reason to believe a violation of subsection (a) has occurred or is about to occur, any investigation of such alleged violation shall be limited in scope to the factual matter necessary to determine whether such alleged violation occurred.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCFDE15BF38FE4EBEB99ED66F1B824EC9"><enum>(B)</enum><header>Petition to quash subpoena or order on basis not limited in scope to necessary factual matter</header><clause commented="no" display-inline="no-display-inline" id="H06D75871070F4641BDFB1EA7EE22F9AA"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A person subject to an investigation by the Commission following a determination of the Commission that there is reason to believe a violation of subsection (a) has occurred or is about to occur may file a petition in any United States district court with jurisdiction to quash any subpoena or order of the Commission issued under paragraph (3) or (4), respectively, of section 307(a) on the basis that the subpoena or order is not limited in scope to the factual matter necessary to determine whether such alleged violation occurred as required under subparagraph (A).</text></clause><clause commented="no" display-inline="no-display-inline" id="HB88DAC347E6F48A9A5A2C0A0DA165069"><enum>(ii)</enum><header>Clarification</header><text display-inline="yes-display-inline">Nothing in clause (i) shall be construed to alter the right of any person to otherwise challenge the power of the Commission to issue a subpoena under section 307(a)(3) or an order under section 307(a)(4).</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HF806B6FAAD92417D940B099DDCA6E955"><enum>(e)</enum><header>Reporting</header><paragraph commented="no" display-inline="no-display-inline" id="H0631B4C37C5D4E378C7D396D57EF3626"><enum>(1)</enum><header display-inline="yes-display-inline">Contributions and expenditures of political committees and political parties</header><text>Section 304(b) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(b)</external-xref>) is amended—</text><subparagraph id="H4D63CD650FCB4656B020A6E35CE09A87"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (7);</text></subparagraph><subparagraph id="H7DA7A48ADA584558815FB5363E53F37A"><enum>(B)</enum><text>by striking the period at the end of paragraph (8) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HAC967AEAA32542BC8FEFB8D5EEDEDE22"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A0C2F66A89A4CB39800121774B753B5"><paragraph commented="no" display-inline="no-display-inline" id="H00605ADEE42540E18FF406482195368D"><enum>(9)</enum><text>under penalty of perjury, a certification that the committee has complied with the requirements of section 319(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD82EBD639B8A4AAB9364766BB976E2B6"><enum>(2)</enum><header display-inline="yes-display-inline">Independent expenditures</header><subparagraph commented="no" display-inline="no-display-inline" id="H1CD0A0DA14754AF4A63D15019302C559"><enum>(A)</enum><header display-inline="yes-display-inline">Committee reports</header><text>Section 304(b)(6)(B)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(b)(6)(B)(iii)</external-xref>) is amended—</text><clause commented="no" display-inline="no-display-inline" id="H2CCAA558E8164EDCA2B6FD70F78EA78E"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>and a certification</quote> and inserting <quote>a certification</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H1B625E9C5E5B493AB92F0A1FFA3DC0FF"><enum>(ii)</enum><text>by inserting <quote>, and a certification, under penalty of perjury that the independent expenditure does not violate section 319(a)</quote> before the semicolon at the end.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD9F123FB7974367BBB4FD693D2F5BBE"><enum>(B)</enum><header display-inline="yes-display-inline">Other persons</header><text>Section 304(c)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(c)(2)</external-xref>) is amended—</text><clause id="H90F7F908B1054DC788BF3B17971AFB76"><enum>(i)</enum><text>by striking <quote>and</quote> at the end of subparagraph (B);</text></clause><clause id="HB732107FDF9E496BA6AB4F9116731E49"><enum>(ii)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></clause><clause id="H72CBA847A9994B82B77E992F39456814"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB06EB574F24A4DB4B193C1372382E960"><subparagraph commented="no" display-inline="no-display-inline" id="H867D3E32150B40619834B6A06D2B2978"><enum>(C)</enum><text>under penalty of perjury, a certification that the independent expenditure does not violate section 319(a); and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8DF12ACC8B843EC9051A5CEFE71BA5C"><enum>(3)</enum><header>Electioneering communications</header><text>Section 304(f)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/52/30104">52 U.S.C. 30104(f)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C777830A91545F5B9F0E2706B7AF5B6"><subparagraph commented="no" display-inline="no-display-inline" id="HF4FA54D229DF4CD9A2EDADAE309069AD"><enum>(G)</enum><text>A certification, under penalty of perjury, that the disbursement does not violate section 319(a).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H2D52173B11DD4EE79A00B1D3162A7E4A"><enum>3.</enum><header>Protecting privacy of donors to tax-exempt organizations</header><subsection id="HB2A8A8BAF7A94188B8377BF5B23719C7"><enum>(a)</enum><header>Restrictions on collection of donor information</header><paragraph id="H0E6DD7FC2FAA4378A11B36998893E932"><enum>(1)</enum><header>Restrictions</header><text display-inline="yes-display-inline">An entity of the Federal Government may not collect or require the submission of information on the identification of any donor to a tax-exempt organization.</text></paragraph><paragraph id="H7EFA8787DA1B4FAD9577B194EE3F235B"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply to the following:</text><subparagraph id="HE93E22E7FA8D49EB941131E718A490C5"><enum>(A)</enum><text>The Internal Revenue Service, acting lawfully pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/6033">section 6033</external-xref> of the Internal Revenue Code of 1986 or any successor provision.</text></subparagraph><subparagraph id="H52E05CF691824A5D99B8EF025AE2E171"><enum>(B)</enum><text>The Secretary of the Senate and the Clerk of the House of Representatives, acting lawfully pursuant to section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>).</text></subparagraph><subparagraph id="HE8CC8F2ED7744D998294C89244402607"><enum>(C)</enum><text>The Federal Election Commission, acting lawfully pursuant to—</text><clause commented="no" display-inline="no-display-inline" id="HC2AE96C2E4214FC59C3B062322EFAAE6"><enum>(i)</enum><text display-inline="yes-display-inline">section 510 of title 36, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HF70E5143B9554350926232AD630BE69B"><enum>(ii)</enum><text>any provision of title III of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101 et seq.</external-xref>).</text></clause></subparagraph><subparagraph id="HE0DCD7C7849942EB99F7AE5300A9B122"><enum>(D)</enum><text display-inline="yes-display-inline">An entity acting pursuant to a lawful order of a court or administrative body which has the authority under law to direct the entity to collect or require the submission of the information, but only to the extent permitted by the lawful order of such court or administrative body.</text></subparagraph></paragraph></subsection><subsection id="H26EF7C83AA334CAE97E6A39A60CF1E0B"><enum>(b)</enum><header>Restrictions on release of donor information</header><paragraph id="H88EA5FDA75224578946067AECF41547F"><enum>(1)</enum><header>Restrictions</header><text>An entity of the Federal Government may not disclose to the public information revealing the identification of any donor to a tax-exempt organization.</text></paragraph><paragraph id="HA72475C58566438DBC0D927EF85B5138"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply to the following:</text><subparagraph id="H501ECBD0279D4717869CEA6746842DD3"><enum>(A)</enum><text>The Internal Revenue Service, acting lawfully pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/6104">section 6104</external-xref> of the Internal Revenue Code of 1986 or any successor provision.</text></subparagraph><subparagraph id="HE4F2111FBE2740939CBC9E5C91B62CB6"><enum>(B)</enum><text>The Secretary of the Senate and the Clerk of the House of Representatives, acting lawfully pursuant to section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>).</text></subparagraph><subparagraph id="H14ABD01594F0419E8E02A6ABEF7161A4"><enum>(C)</enum><text>The Federal Election Commission, acting lawfully pursuant to—</text><clause commented="no" display-inline="no-display-inline" id="H34AE0EF78E0D4A899FDDB91AA3E0A7E2"><enum>(i)</enum><text display-inline="yes-display-inline">section 510 of title 36, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H80D817C54D404A7283EAF6ADFC9C5DE6"><enum>(ii)</enum><text>any provision of title III of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30101">52 U.S.C. 30101 et seq.</external-xref>). </text></clause></subparagraph><subparagraph id="H48369C78F7BB42D5B596D7C61699A5DA"><enum>(D)</enum><text display-inline="yes-display-inline">An entity acting pursuant to a lawful order of a court or administrative body which has the authority under law to direct the entity to disclose the information, but only to the extent permitted by the lawful order of such court or administrative body.</text></subparagraph><subparagraph id="H2D9720508F644E3AAC072A6840477F44"><enum>(E)</enum><text>An entity which discloses the information as authorized by the organization.</text></subparagraph></paragraph></subsection><subsection id="H53C3E555EED244DC9F300304898275EC"><enum>(c)</enum><header>Tax-Exempt organization defined</header><text display-inline="yes-display-inline">In this section, a <term>tax-exempt organization</term> means an organization which is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and is exempt from taxation under section 501(a) of such Code. Nothing in this subsection may be construed to treat a political organization under section 527 of such Code as a tax-exempt organization for purposes of this section.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H7F49B422BDE846D3B99BF5C973694C4D"><enum>(d)</enum><header>Penalties</header><text display-inline="yes-display-inline">It shall be unlawful for any officer or employee of the United States, or any former officer or employee, willfully to disclose to any person, except as authorized in this section, any information revealing the identification of any donor to a tax-exempt organization. Any violation of this section shall be a felony punishable upon conviction by a fine in any amount not exceeding $250,000, or imprisonment of not more than 5 years, or both, together with the costs of prosecution, and if such offense is committed by any officer or employee of the United States, he shall, in addition to any other punishment, be dismissed from office or discharged from employment upon conviction for such offense.</text></subsection></section></legis-body></bill>
