<section id="H0C92ECB0C79D4B83878318176A15EEE1" section-type="section-one"><enum>1.</enum><header>E–3 visas for Irish nationals</header>
<subsection id="HFC3A5D2E3ED64C7D897EAA1931D39DAF"><enum>(a)</enum><header>In general</header><text>Section 101(a)(15)(E)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(E)(iii)</external-xref>) is amended by inserting <quote>or, on a basis of reciprocity as determined by the Secretary of State, a national of Ireland,</quote> after <quote>Australia</quote>.</text></subsection> <subsection id="HF3AC518EC8384D1B8C4413AAD1D26BBA"><enum>(b)</enum><header>Employer requirements</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text>
<paragraph id="HCEA2031268254339B57E03EB3C8DD09C"><enum>(1)</enum><text>by redesignating the second subsection (t) (as added by section 1(b)(2)(B) of <external-xref legal-doc="public-law" parsable-cite="pl/108/449">Public Law 108–449</external-xref> (118 Stat. 3470)) as subsection (u); and</text></paragraph> <paragraph id="H50F8F476C3984375B840BAEA4F061EBF"><enum>(2)</enum><text>by adding at the end of subsection (t)(1) (as added by section 402(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/77">Public Law 108–77</external-xref> (117 Stat. 941)) the following:</text>

<subparagraph id="H2A7C1F768A5146C7A8CDA946EB142A48"><enum>(E)</enum><text>In the case of an attestation filed with respect to a national of Ireland described in section 101(a)(15)(E)(iii), the employer is, and will remain during the period of authorized employment of such Irish national, a participant in good standing in the E-Verify program described in section 403(a) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HD3AE5E5DFC3F4CCF82E36778EC9F5B6C"><enum>(c)</enum><header>Application allocation</header><text>Paragraph (11) of section 214(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(11)</external-xref>) is amended to read as follows:</text>

<paragraph id="H51B2AE3FFE5147DF98657E65CDB15B1D"><enum>(11)</enum>
<subparagraph id="H3361264A13674167B0DB1D1C27808BF8" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary of State may approve initial applications submitted for aliens described in section 101(a)(15)(E)(iii) only as follows:</text> <clause id="H91152BA44AF9409BBA5DBC8841A8D419"><enum>(i)</enum><text>For applicants who are nationals of the Commonwealth of Australia, not more than 10,500 for a fiscal year.</text></clause>
<clause id="H11502386688943BF8CD71737DB6375EC"><enum>(ii)</enum><text>For applicants who are nationals of Ireland, not more than a number equal to the difference between 10,500 and the number of applications approved in the prior fiscal year for aliens who are nationals of the Commonwealth of Australia.</text></clause></subparagraph> <subparagraph id="HC14847C0936B49C5986438E01F5A1BCD"><enum>(B)</enum><text>The approval of an application described under subparagraph (A)(ii) shall be deemed for numerical control purposes to have occurred on September 30 of the prior fiscal year.</text></subparagraph>
<subparagraph id="H584A131FA7A4473B942BD062E53A0B00"><enum>(C)</enum><text>The numerical limitation under subparagraph (A) shall only apply to principal aliens and not to the spouses or children of such aliens.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
