<section id="HC6715F6C8ED84022B6CA17D8FA7555A3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Aaron Salter, Jr., Responsible Body Armor Possession Act</short-title></quote>.</text></section> <section id="H960156C8BC7E4D7FBE04EDAF03E4AE7B"><enum>2.</enum><header>Ban on purchase, ownership, or possession of enhanced body armor by civilians; exceptions</header> <subsection id="H83DF4BAA1E424A2F875D88A503FDA16A"><enum>(a)</enum><header>Ban</header> <paragraph id="H0DA083B37C2B49E2B9BAB2D8D319788C"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block id="H4E3EAAE47E5140B995976B87CB12C7E8" style="USC"> 
<section id="H51A1B01454A0481D9709ABA7D97CDEDD"><enum>935.</enum><header>Ban on purchase, ownership, or possession of enhanced body armor by civilians</header> 
<subsection id="HBE6072B1690644829E474241F1DF47AB"><enum>(a)</enum><text>Except as provided in subsection (b), it shall be unlawful for a person to purchase, own, or possess enhanced body armor.</text></subsection> <subsection id="HE4E76096E1884AF98B48CA486ECBD018"><enum>(b)</enum><text>Subsection (a) shall not apply to—</text> 
<paragraph id="H50F0C8EEE7F247519E27729ED564B3BB"><enum>(1)</enum><text>a purchase, ownership, or possession by or under the authority of—</text> <subparagraph id="HCC040DB1119D413F9BA493E92AB70E06"><enum>(A)</enum><text>the United States or any department or agency of the United States; or</text></subparagraph> 
<subparagraph id="H948DF3D27C5542C18B9CD9F32239C652"><enum>(B)</enum><text>a State, or a department, agency, or political subdivision of a State;</text></subparagraph></paragraph> <paragraph id="HB196D2875060412F8E14B4D18531910D"><enum>(2)</enum><text>a covered law enforcement officer; or</text></paragraph> 
<paragraph id="H8D32BCAF286A4C45B88B0FFCDE91C480"><enum>(3)</enum><text display-inline="yes-display-inline">enhanced body armor that was lawfully possessed by any person at any time before the date this section takes effect.</text></paragraph></subsection> <subsection id="HC5C24161322F43A1865545873EFD3E58"><enum>(c)</enum><text>In this section, the term <quote>covered law enforcement officer</quote>—</text> 
<paragraph id="H14463891DFD64C57B2C60381CC1FCD18"><enum>(1)</enum><text>has the meaning given the term <quote>qualified law enforcement officer</quote> in section 926B and the term <quote>qualified retired law enforcement officer</quote> in section 926C; and</text></paragraph> <paragraph id="H5131A0269AFF4C4B904B0726E6C73E7F"><enum>(2)</enum><text>includes corrections officers.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAFE545F0A9954EB2A74353D045C3219D"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> <quoted-block id="H751F8C0F78E94BD7BCAE41CC6360EE91" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">935. Ban on purchase, ownership, or possession of enhanced body armor by civilians.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H79A4046AA2C64E5091349A7FD903478A"><enum>(b)</enum><header>Enhanced body armor defined</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended by adding at the end the following:</text>

<paragraph id="HE6174ED1E7B344A5A4FA33697DC38447"><enum>(38)</enum><text>The term <quote>enhanced body armor</quote> means body armor, including a helmet or shield, the ballistic resistance of which meets or exceeds the ballistic performance of Type III armor, determined using such standard as the National Institute of Justice has in effect at the time at which a person purchases, owns, or possesses such armor.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HA8D70A4D4822405B88487A1074A0756F"><enum>(c)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 924(a) of title 18, United States Code, is amended by adding at the end the following:</text>

<paragraph id="H4A3271C1E383448F852FDD991C3B74BD"><enum>(9)</enum><text>Whoever knowingly violates section 935 shall be fined under this title, imprisoned not more than 10 years, or both.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body></bill>
