<official-title display="yes">To impose sanctions with respect to economic or industrial espionage by foreign adversarial companies, and for other purposes.</official-title>

<section id="HA784D64C99364055998DE7DFCBB4C43A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Economic Espionage Prevention Act</short-title></quote>.</text></section> <section id="HEF60AF09D40F4E8A83E6B3B4A44E14EE" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HC5606237134D484E801AE0D072265D50"><enum>(1)</enum><text>On March 14, 2024, the Department of State notified Congress of the following:</text> <subparagraph id="HA338BB28E8A0429D8105450D22A16047"><enum>(A)</enum><text>People’s Republic of China exports of semiconductors to Russia have increased substantially since Russia’s full-scale invasion of Ukraine.</text></subparagraph> 
<subparagraph id="HBECFD3104DC84A6FADBCD26BD7448060"><enum>(B)</enum><text>In the second half of 2023, China exported between $25,000,000 and $50,000,000 in additional semiconductors to Russia every month relative to pre-invasion levels.</text></subparagraph> <subparagraph id="H49A28FA7EA7A4F62AF727A2281F5F7E4"><enum>(C)</enum><text>During the same period, China also exported between $50,000,000 and $100,000,000 in additional exports to Russia every month to known transshipment hubs.</text></subparagraph> 
<subparagraph id="H825984C7BE2B4336868D4B7A948CCB8C"><enum>(D)</enum><text>These exports include both Chinese and United States-branded semiconductors (integrated circuits), according to analysis of commercially available trade data by the Bureau of Industry and Security of the Department of Commerce, and are almost certainly supporting Russia’s military capabilities based on Ukrainian analysis of recovered Russian weapons.</text></subparagraph> <subparagraph id="H81ACBC81C9B141E7B773A07C3D3920EA"><enum>(E)</enum><text>Because of the prevalence of United States manufacturing equipment in global semiconductor supply chains, nearly all chips produced worldwide, including in the People’s Republic of China, are subject to United States export controls if destined for Russia or Belarus.</text></subparagraph> 
<subparagraph id="HC024A3B6489847319945F681F4406C4A"><enum>(F)</enum><text>All advanced semiconductors described on the Commerce Control List have been subject to a license requirement if destined to an entity in Russia since its further invasion of Ukraine.</text></subparagraph></paragraph> <paragraph id="H59B4330C29DA40028A2B052F0791B7AD"><enum>(2)</enum><text>On April 3, 2024, Deputy Secretary of State, Kurt Campbell, said <quote>I think we have assessed, over the course of the last couple of months that Russia has almost completely reconstituted militarily. And after the initial setbacks on the battlefield delivered to them by a brave and hearty group in Ukraine, with the support of China in particular, dual use capabilities and a variety of other efforts, industrial and commercial, Russia has retooled and now poses a threat to Ukraine. . .But not just to Ukraine, its new found capabilities pose a longer term challenge to stability in Europe and threatens NATO allies.</quote>.</text></paragraph></section> 
<section id="H1866597EEFDC41BC9373A96B174E515F"><enum>3.</enum><header>Report</header> 
<subsection id="H83EE344BCD4244A2A564DB57DB0E7C53"><enum>(a)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of State, in coordination with the heads of relevant Federal departments and agencies, as appropriate, shall submit to the appropriate congressional committees, a written report that contains the following:</text> <paragraph id="H56026C31CCC14615AC4875192EEA25A1"><enum>(1)</enum><text>An analysis and description of the extent to which any foreign person who is a citizen of the People’s Republic of China or an entity organized under the laws of the People’s Republic of China, or any foreign person or entity controlled by or operating at the direction of the Government of the People’s Republic of China—</text> 
<subparagraph id="H25428EBF65E247D6A2DC4C73330A2166"><enum>(A)</enum><text>is knowingly a material source of critical components necessary for the manufacture of weapons, vehicles, and other military equipment by the defense industrial base of the Russian Federation;</text></subparagraph> <subparagraph id="H61C105D73A5B4DC28CA63B98453B64AA"><enum>(B)</enum><text>has knowingly delivered critical components to or entered into any agreement relating to the sale or delivery of critical components with any entity operating in the defense or intelligence sectors of the Government of the Russian Federation;</text></subparagraph> 
<subparagraph id="H9868120081754F3786E04F0E60459AAC"><enum>(C)</enum><text>has knowingly delivered critical components to or entered into any agreement relating to the sale or delivery of critical components with any country or entity with which the defense or intelligence sectors of the Government of Russian Federation are cooperating in support of Russia’s war against Ukraine; or</text></subparagraph> <subparagraph id="H9F1EDAF99F5B43C7956B83EFADA2C14C"><enum>(D)</enum><text>has knowingly delivered critical components to or entered into any agreement relating to the sale or delivery of critical components with a foreign person that knowingly and directly provides these components to the defense or intelligence sectors of the Government of the Russian Federation.</text></subparagraph></paragraph> 
<paragraph id="HCEC2C994BEB64515A39A0E0E8E81BD69"><enum>(2)</enum><text>The extent to which—</text> <subparagraph id="HE96A862933F246B9BF4E539034414909"><enum>(A)</enum><text>any foreign person that is a citizen of the People’s Republic of China or an entity organized under the laws of the People’s Republic of China has knowingly engaged, on or after the date of the enactment of this Act, in transactions with a person that is part of, or operates on behalf of, the defense or intelligence sectors of the Government of the Russian Federation;</text></subparagraph> 
<subparagraph id="H589F32ECFF444BE99D0CBA2F2B13DFD4"><enum>(B)</enum><text>any foreign person identified pursuant to subparagraph (A) has engaged in transactions which would constitute a significant transaction with persons that have been sanctioned for being part of, or operating on behalf of, the defense or intelligence sectors of the Government of the Russian Federation; or</text></subparagraph> <subparagraph id="H0FEECA12A2DE4E209521BFF77EDD7FC9"><enum>(C)</enum><text>any foreign person identified pursuant to subparagraph (A) has been subjected to sanctions imposed pursuant to sections 231 and 235 of the Countering America’s Adversaries Through Sanctions Act (22 U.S.C. 9525 and 9529).</text></subparagraph></paragraph></subsection> 
<subsection id="HEA3D93884AA64152AC2954E4F5D5B642"><enum>(b)</enum><header>Form and availability</header> 
<paragraph id="HA69BA2921F3A4A2F9D0A1BE3A3C1B790"><enum>(1)</enum><header>Form</header><text>The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex.</text></paragraph> <paragraph id="H8DDD2260F6634CBC83A96383D561F469"><enum>(2)</enum><header>Availability</header><text>The unclassified portion of the report required by subsection (a) may also be made available to the public.</text></paragraph></subsection></section> 
<section id="H5257D8010FD5482CA0D9EAC814E901E8"><enum>4.</enum><header>Imposition of sanctions with respect to economic or industrial espionage by foreign adversary entities</header> 
<subsection id="H9B8999C52A7F40B98235AC6927CE580A"><enum>(a)</enum><header>In general</header><text>On and after the date that is 30 days after the date of the enactment of this Act, the President (a) may impose the sanctions described in subsection (c) against any of the foreign persons described in subsection (b).</text></subsection> <subsection id="HD567A9FF7EA44468A19BD294E189ED35"><enum>(b)</enum><header>Foreign persons described</header><text>A foreign person is described in this subsection if the President determines on or after the date of the enactment of this Act that the person is a foreign adversary entity that knowingly engages in—</text> 
<paragraph id="H7C9EF8B02C164E4081947E38CA07EA28"><enum>(1)</enum><text>economic or industrial espionage with respect to trade secrets or proprietary information owned by United States persons;</text></paragraph> <paragraph id="H9900116D7D394ADB9BD167F0AD17DA21"><enum>(2)</enum><text>the provision of material support or services to a foreign adversaries’ military, intelligence, or other national security entities; or</text></paragraph> 
<paragraph id="H8712949A16504E64B6180EB2D52607B8"><enum>(3)</enum><text>the violation of United States export control laws.</text></paragraph></subsection> <subsection id="HBC473A7DAA3247B5AA62D479743B04D5"><enum>(c)</enum><header>Sanctions described</header><text>The sanctions that may be imposed with respect to a foreign person under subsection (b) are the following:</text> 
<paragraph id="H9F612733BDA44B31B4C404771A2D8B69"><enum>(1)</enum><header>Property blocking</header><text>The exercise of all powers granted to the President by the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>) to the extent necessary to block and prohibit all transactions in property and interests in property of the foreign person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text></paragraph> <paragraph id="H61590DC22BA641318A47BF804088690E"><enum>(2)</enum><header>Ineligibility for visas, admission, or parole</header> <subparagraph id="H029A6570127D457DAE7150654CFF68A8"><enum>(A)</enum><header>Visas, admission, or parole</header><text>An alien described in subsection (b) is—</text> 
<clause id="H2A5239CAEEC2451FB97E0AFA247228AD"><enum>(i)</enum><text>inadmissible to the United States;</text></clause> <clause id="HAC95DDDA7014477A85E0B4A4969678E8"><enum>(ii)</enum><text>ineligible to receive a visa or other documentation to enter the United States; and</text></clause> 
<clause id="H185723A3E1DA44A9B28D3620847A424C"><enum>(iii)</enum><text>otherwise ineligible to be admitted or paroled into the United States or to receive any other benefit under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></clause></subparagraph> <subparagraph id="H45DEC2E037A94A2EAA47F6663729080C"><enum>(B)</enum><header>Current visas revoked</header> <clause id="H6F10E8C9B5F5427BB6EFD3E08CE6B216"><enum>(i)</enum><header>In general</header><text>An alien described in subsection (b) is subject to revocation of any visa or other entry documentation regardless of when the visa or other entry documentation is or was issued.</text></clause> 
<clause id="H6977D68267734CCD9705C2FC34D32A76"><enum>(ii)</enum><header>Immediate effect</header><text>A revocation under clause (i) shall take effect immediately and automatically cancel any other valid visa or entry documentation that is in the alien’s possession.</text></clause></subparagraph></paragraph></subsection> <subsection id="H2EA3E9172B7E4BEE9A09FD61DD032426"><enum>(d)</enum><header>Exceptions</header> <paragraph id="HB2D79D4C3C94438287FCD53F5BBA8904"><enum>(1)</enum><header>Exception for intelligence activities</header><text>Sanctions under this section shall not apply to any activity subject to the reporting requirements under title V of the National Security Act of 1947 (<external-xref legal-doc="usc" parsable-cite="usc/50/3091">50 U.S.C. 3091 et seq.</external-xref>) or any authorized intelligence activities of the United States.</text></paragraph> 
<paragraph id="H14164044664D4A36AA925E31F9309D27"><enum>(2)</enum><header>Exception to comply with international obligations</header><text>Sanctions under subsection (c)(2) shall not apply with respect to the admission of an alien if admitting or paroling the alien into the United States is necessary to permit the United States to comply with—</text> <subparagraph id="H7C7A28F27E234855A091401B46EE64DD"><enum>(A)</enum><text>the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States; or</text></subparagraph> 
<subparagraph id="HFE906D25D02E4629A69B5DAFD1DF8700"><enum>(B)</enum><text>other applicable international obligations.</text></subparagraph></paragraph> <paragraph id="HB43B1BE35BDF44AE95E4090DFD9DB750"><enum>(3)</enum><header>Exception to carry out or assist law enforcement activities</header><text>Sanctions under subsection (c)(2) shall not apply with respect to an alien if admitting or paroling the alien into the United States is necessary to carry out or assist law enforcement activity in the United States.</text></paragraph></subsection> 
<subsection id="H8007D3B54AB74DC3B85A72C150743007"><enum>(e)</enum><header>Waiver</header><text>The President may waive the application of sanctions under this section with respect to a foreign person for renewable periods of not more than 180 days each if the President determines and submits to the appropriate congressional committees a report that contains a determination of the President that such a waiver is in the national security interests of the United States.</text></subsection> <subsection id="H6B804F9E2409485D958370C12089D0F4"><enum>(f)</enum><header>Implementation; penalties</header> <paragraph id="HBBA045870682476E9AC3D5B89F5E422D"><enum>(1)</enum><header>Implementation</header><text>The President may exercise the authorities provided to the President under sections 203 and 205 of the International Emergency Economic Powers Act (50 U.S.C. 1702 and 1704) to the extent necessary to carry out this section.</text></paragraph> 
<paragraph id="HC33560819C5B48CA943FC8391CF25D15"><enum>(2)</enum><header>Penalties</header><text>A person that violates, attempts to violate, conspires to violate, or causes a violation of subsection (a) or any regulation, license, or order issued to carry out that subsection shall be subject to the penalties set forth in subsections (b) and (c) of section 206 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1705">50 U.S.C. 1705</external-xref>) to the same extent as a person that commits an unlawful act described in subsection (a) of that section.</text></paragraph> <paragraph id="HEC63BB5D38744CDA8A84873C87B42978"><enum>(3)</enum><header>Procedures and guidelines for sanctions</header><text>The President shall establish procedures and guidelines for the implementation and enforcement of sanctions imposed under this section.</text></paragraph> 
<paragraph id="H063B74497FB24A49BDD602CDBFFD14F5"><enum>(4)</enum><header>Annual report</header> 
<subparagraph id="H2A9527BB130A4B98B173352E477509BD"><enum>(A)</enum><text>Unless the exception in subparagraph (B) applies, not later than one year after the date of the enactment of this Act, and for each of the 5 years thereafter, the President shall submit to the appropriate congressional committees a report on any notable developments regarding economic or industrial espionage activities by foreign persons.</text></subparagraph> <subparagraph id="H015A0A6E1FE6432393DA7FD7B317F8FA"><enum>(B)</enum><text>The President shall not be required to submit the annual report described by subparagraph (A) if the President has imposed sanctions as authorized under this section within the previous calendar year.</text></subparagraph></paragraph></subsection> 
<subsection id="H295A7367054F443AA5DA1F0DD6A9B7A8"><enum>(g)</enum><header>Rule of construction</header><text>For purposes of this section, a transaction shall not be construed to include participation in an international standards-setting body or the activities of such a body.</text></subsection></section> <section id="H23079AC304BF43EFB640A48F9D348987"><enum>5.</enum><header>Clarifying amendments</header><text display-inline="no-display-inline">Section 203 of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702</external-xref>) is amended—</text> 
<paragraph id="HDD85375EC24840448F88160C72C5D755"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="H58D051481DA141C2B24B8DFFBFAE1335"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>, directly or indirectly</quote>; </text></subparagraph> 
<subparagraph id="HC23E59BF7B9E40E3A52B694F65EC0AE6"><enum>(B)</enum><text>in paragraph (3)—</text> <clause id="H1BE45B8658DA4A5B97ACDF50357F6239"><enum>(i)</enum><text>by striking <quote>including but not limited to</quote> and all that follows through <quote>news wire feeds.</quote> and inserting <quote>except to the extent that the President determines that such imports and exports would seriously impair his ability to deal with any national emergency declared under section 202.</quote>; and</text></clause> 
<clause id="HA13EF9A28E6D45EEAFC6C030ACD463A7"><enum>(ii)</enum><text>by striking <quote>under section 5 of the Export Administration Act of 1979, or under section 6 of such Act</quote> and inserting <quote>under other statutory or regulatory export control authorities</quote>; and</text></clause></subparagraph> <subparagraph id="HDECD1CBB2B38463696A6B5B5BB0B8F85"><enum>(C)</enum><text>in paragraph (4), by inserting <quote>, except to the extent that the President determines that such imports and exports would seriously impair the ability to deal with any national emergency declared under section 202</quote> before the period at the end; and</text></subparagraph></paragraph> 
<paragraph id="H482A4C5089CE4FA0A806B7B4B5F694E7"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block id="H1BE78D7D5CA2438588EE55A124DE0BFE" style="OLC"> <subsection id="HD2A625E71D0A45DFA7F8A443B7224A1A"><enum>(d)</enum><header>Rules of construction relating to sensitive and personal data</header><text>The communication, the importation to a country, or the exportation from a country, directly or indirectly, whether commercial or otherwise, of bulk sensitive personal data or of source code used in a connected software application may not be construed to constitute—</text> 
<paragraph id="H7B3C657AC8C54C1CA4A0149DBB3657DA"><enum>(1)</enum><text>a <quote>postal, telegraphic, telephonic, or other personal communication</quote>, for purposes of subsection (b)(1); or</text></paragraph> <paragraph id="H6AD37E050FF146F08FD5736038B12FEA"><enum>(2)</enum><text>an importation from a country, or an exportation to a country, of <quote>information or informational materials</quote>, for purposes of subsection (b)(3).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3F6E4F6A06DF45579F8FCBD894C02AB3"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> <paragraph id="HA6DE8148897742C090CAD4E94BA60796"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text> 
<subparagraph id="H90C762F64F0F4FB5AE2C9175A89F9B94"><enum>(A)</enum><text>the Committee on Foreign Affairs of the House of Representatives; and</text></subparagraph> <subparagraph id="HD9863424262442F88A6457CBB4244A65"><enum>(B)</enum><text>the Committee on Foreign Relations of the Senate.</text></subparagraph></paragraph> 
<paragraph id="H8397621562774A4BB480FFE3B5935A95"><enum>(2)</enum><header>Economic or industrial espionage</header><text>The term <term>economic or industrial espionage</term> has the meaning given that term in section 1637(d) of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015.</text></paragraph> <paragraph id="H73C39523A5F5479A87737AE19258EFFA"><enum>(3)</enum><header>Foreign person</header><text>The term <term>foreign person</term> means any person that is not a United States person.</text></paragraph> 
<paragraph id="HE23F9F7F297B444C814E86ACA61B2CB3"><enum>(4)</enum><header>Knowingly</header><text>The term <term>knowingly</term>, with respect to conduct, a circumstance, or a result, means that a person has actual knowledge, or should have known, of the conduct, the circumstance, or the result.</text></paragraph> <paragraph id="H1B481643BD6B42489142DAC6D6D7912E"><enum>(5)</enum><header>Own, proprietary information, and trade secret</header><text>The terms <term>own</term>, <term>proprietary information</term>, and <term>trade secret</term> have the meanings given those terms in section 1637(d) of the Carl Levin and Howard P. <quote>Buck</quote> McKeon National Defense Authorization Act for Fiscal Year 2015 (<external-xref legal-doc="usc" parsable-cite="usc/50/1708">50 U.S.C. 1708(d)</external-xref>).</text></paragraph> 
<paragraph id="H8097CC839AF646CB9E442AF65695E661"><enum>(6)</enum><header>Person</header><text>The term <term>person</term> means an individual or entity.</text></paragraph> <paragraph id="H625B16215C794929A8B77853272811F0"><enum>(7)</enum><header>United states person</header><text>The term <term>United States person</term> means—</text> 
<subparagraph id="H016F93B4BB984327B53022010F88E571"><enum>(A)</enum><text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text></subparagraph> <subparagraph id="HE46D34248EC0470F850A8753917133F1"><enum>(B)</enum><text>an entity organized under the laws of the United States or any jurisdiction within the United States, including a foreign branch of such an entity.</text></subparagraph></paragraph> 
<paragraph id="H886B33FDBC1747BFB36B379CF88212AC"><enum>(8)</enum><header>Foreign adversary</header><text>The term <term>foreign adversary</term> means the countries listed in section 7.4 of title 15, Code of Federal Regulations.</text></paragraph></section> </legis-body> <attestation><attestation-group><attestation-date date="20240909" chamber="House">Passed the House of Representatives September 9, 2024.</attestation-date><attestor display="no">Kevin F.
