which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and the Workforce</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish grants to provide education on guardianship alternatives for older adults and people with disabilities to health care workers, educators, family members, and court workers and court-related personnel.</official-title></form><legis-body id="H3F3785CD153A4D00A3C57278A739EF4E" style="OLC"><section id="H00E7A35DAAF64186824CCD5632613B2B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alternatives to Guardianship Education Act</short-title></quote>.</text></section><section id="HC6175F8F530844E0AFB7C9288B708EA9"><enum>2.</enum><header>Findings and purpose</header><subsection id="H34EF328C516A414DA6A50F67173794E7"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H39A9D1B2DE444447AF4C5A2945F9D845"><enum>(1)</enum><text>Guardianship, although at times necessary, can negatively affect the person under guardianship by reducing or eliminating their self-determination and autonomy.</text></paragraph><paragraph id="HB0350F3A27164AB5A239240CDD06AD8F"><enum>(2)</enum><text>Although State courts and State laws attempt to provide some procedures to appoint trustworthy guardians, incidents of physical, financial, emotional, psychological, and other types of abuse have occurred to people under guardianship arrangements.</text></paragraph><paragraph id="H72DDE55BE0C84B0A84F020762B2D9908"><enum>(3)</enum><text>Once guardianship arrangements are in place, restoration of rights rarely occurs.</text></paragraph><paragraph id="HE289C225A9CC4CFD91114D2F96AC71ED"><enum>(4)</enum><text>Less restrictive options to guardianship, such as supported decisionmaking and advance directives, offer ways to help people make decisions without losing their independence. </text></paragraph><paragraph id="H9E47CF047FD24FA7BBABA30CEF8768E0"><enum>(5)</enum><text>Awareness of guardianship alternatives by personnel that interact with individuals facing guardianship determinations, including health care workers, educators, family members, and court workers and court-related personnel, may help reduce unnecessary guardianship arrangements and preserve decisionmaking rights.</text></paragraph><paragraph id="H2C194CF095084EB1B452F6442F276799"><enum>(6)</enum><text>Families and disability support personnel have reported that they have limited awareness of guardianship alternatives.</text></paragraph></subsection><subsection id="HF2C7C86C10964324BDD458921DC9B6B0"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to improve the awareness of guardianship alternatives, for health care workers, educators, family members, and court workers and court-related personnel, through education programs. </text></subsection></section><section id="H2A2CFB860190489FADAE852D1BFC23D9"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H3591834172D04C54980F6FCFE8CBE36C"><enum>(1)</enum><header>Aging agency</header><text>The term <term>aging agency</term> means an organization that represents older adults, and that may have experience in serving family members of such adults. </text></paragraph><paragraph id="H576792E002754DCEADE22DC1780BCD00"><enum>(2)</enum><header>Disability</header><text>The term <term>disability</term> has the meaning given that term in section 3 of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12102">42 U.S.C. 12102</external-xref>).</text></paragraph><paragraph id="H02B5ED62D17948F3997B8B9F7BFBBC31"><enum>(3)</enum><header>Disability agency</header><text>The term <term>disability agency</term> means an organization serving people with disabilities that—</text><subparagraph id="H997ACD525CC54803B71551DE8D95ADB9"><enum>(A)</enum><text>is operated by a board, on which—</text><clause id="HA414BB0A12854BFC978C1E2C4C77B2B4"><enum>(i)</enum><text>a majority of the members are people with disabilities or their family members; and</text></clause><clause id="HD7FB9910819140608E9B87496F9B5B63"><enum>(ii)</enum><text>the number of members on the board who are people with disabilities is greater than the number of members on the board who are family members;</text></clause></subparagraph><subparagraph id="H9710972012B34DA7A940F4DE5DF02D57"><enum>(B)</enum><text>has an advisory panel or council, on which—</text><clause id="H6518840AA57A4642863B5B5BBFFFCB9C"><enum>(i)</enum><text>a majority of the members are people with disabilities or their family members; and</text></clause><clause id="HEB535B35BDA44EB3B5606E2C97E58F4A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>the number of members on the board who are people with disabilities is greater than the number of members on the board who are family members; or </text></clause></subparagraph><subparagraph id="H18B050D113754E8FAF8B561E53516116"><enum>(C)</enum><text>has employees, a majority of whom are people with disabilities.</text></subparagraph></paragraph><paragraph id="H089530CF724142A4A96F4F1B232DDE8F" commented="no"><enum>(4)</enum><header>Guardianship</header><text>The term <term>guardianship</term> means—</text><subparagraph id="HC319BF0BB47A45CAA6C16B7C82090E87" commented="no"><enum>(A)</enum><text>a protective arrangement resulting from the process by which a State court determines that an adult individual lacks capacity to make decisions about self-care, finances, property, or personal affairs, and appoints another individual or entity known as a guardian, as a conservator, or by a similar term, as a surrogate decisionmaker;</text></subparagraph><subparagraph id="HCC0657F26D324639B259852D47BF5884" commented="no"><enum>(B)</enum><text>a protective arrangement in which the court-appointed surrogate decisionmaker carries out duties to the individual and the court; or</text></subparagraph><subparagraph id="H61705F75AEFE47AE9BAB4FF4D09CFA1A" commented="no"><enum>(C)</enum><text>a protective arrangement in which the court exercises oversight of the surrogate decisionmaker. </text></subparagraph></paragraph><paragraph id="H97CAC9B7B71642E0884A4DDF274A0E0D"><enum>(5)</enum><header>Indian tribe</header><text>The term <term>Indian Tribe</term> has the meaning given that term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><paragraph id="H84F4E782950F40A48ED66975D14D87E1"><enum>(6)</enum><header>Legal services agency</header><text>The term <term>legal services agency</term> means a public or nonprofit organization that has experience providing legal services to low-income older adults or adults with disabilities. </text></paragraph><paragraph id="HF3059F67DB204102ABF8A8D6FDC93225"><enum>(7)</enum><header>Older adult</header><text>The term <term>older adult</term> has the meaning given the term <term>older individual</term> as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>). </text></paragraph><paragraph id="H4C205E1932CD4AFA955F21B47EC8A431"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services, acting through the Administrator of the Administration for Community Living.</text></paragraph><paragraph id="HB4A0F9A8C74D46FE89A10DF08646B206"><enum>(9)</enum><header>State</header><text>The term <term>State</term> means any of the 50 States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, and the Commonwealth of the Northern Marianas. </text></paragraph></section><title id="H3643602DA40641D6A0369ED7D9689678" style="OLC"><enum>I</enum><header>Guardianship alternatives education for health care workers</header><section id="H6E62B5DF9E8B4AFABC53ADA9E35D9587"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H5FF113AEA59D44A28028B5F542F572BA" commented="no"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a partnership (established by a disability agency, legal services agency, or aging agency)—</text><subparagraph id="HE147B63F86C8466888835D3AD1881030" commented="no"><enum>(A)</enum><text>that includes—</text><clause id="H31829E8613B24A43991E89B8B6DEF314" commented="no"><enum>(i)</enum><text>that disability agency, legal services agency, or aging agency; and</text></clause><clause id="HF27BD0F5E43346ABB89A47E795559640" commented="no"><enum>(ii)</enum><text>at least one health care entity, department of such an entity, or specialty office of such an entity, that has frequent contact with people with disabilities or older adults, including—</text><subclause id="H8EEF42D1A85648069C3C78A4913059AE" commented="no"><enum>(I)</enum><text>a primary care clinic, including a Federally qualified health center or rural health clinic (as such terms are defined in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>)); </text></subclause><subclause id="H9AD7797FF83843C9AEF27ADA1F14C78F" commented="no"><enum>(II)</enum><text>an emergency department;</text></subclause><subclause id="H332ED1089635477BA756BA87A2D215B4" commented="no"><enum>(III)</enum><text>a long-term care provider;</text></subclause><subclause id="HC2876C8EFCC94EDD8BDF0F69793024E1" commented="no"><enum>(IV)</enum><text>a pediatric office;</text></subclause><subclause id="H0203D08318EF4B81B32D7DF5327191DE" commented="no"><enum>(V)</enum><text>a rehabilitation center;</text></subclause><subclause id="H040D0511EC3D4AD2999F8B42C291B490" commented="no"><enum>(VI)</enum><text>a geriatrician office;</text></subclause><subclause id="HE688682A14ED4629A83C2DB34D4FDC3F" commented="no"><enum>(VII)</enum><text>a neurology office; or</text></subclause><subclause id="H5C7E754DD66A470FBAF1A6A2B00F828C" commented="no"><enum>(VIII)</enum><text>an entity providing a training program for health care workers in any specialty listed in this subparagraph; and</text></subclause></clause></subparagraph><subparagraph id="H057B53D1A8514D5FB4E560298B831389" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for which the establishing agency has memorialized the establishment, membership, and functions of the partnership in the form of a letter of support, memorandum of understanding, or similar document. </text></subparagraph></paragraph><paragraph id="HA9B87EFEF42741C394CECD0FADF3CDC6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Health care workers</header><text>The term <term>health care workers</term> means staff with direct contact with patients in health care settings, including physicians, advanced practice providers, nurses, medical assistants, social workers, health care administrators, dentists, dental hygiene professionals, receptionists, and mental health professionals. </text></paragraph></section><section id="HA64A87F75C064101B6DC8FD0B2F062D6"><enum>102.</enum><header>Grant program</header><subsection id="HD50A5A20702F47FE86379FB68CC1A926"><enum>(a)</enum><header>In general</header><text>The Secretary shall make grants, on a competitive basis, to eligible entities in States, and to eligible entities that serve Indian Tribes, to enable the recipients to carry out guardianship alternatives education programs for health care workers.</text></subsection><subsection id="HB8D4CEC9A72D4742B44CFC6145532A28"><enum>(b)</enum><header>Term</header><text>The Secretary may make such a grant for a first term of 3 years. An eligible entity may seek renewal of, and the Secretary may make, such a grant for a second term of 3 years, in order to expand service delivery of the education program to health care workers.</text></subsection></section><section id="HED39E6E4D24B4A52A0CCA42BFE97226E"><enum>103.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible to receive a grant under this title, an entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="H6166D5A3E0914683BFCA00E7E3B54526"><enum>(1)</enum><text>information identifying the target population to receive instruction, and a projected number of participants in and graduates of the education program to be carried out under the grant; </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H49F19F6CAAF6464EA612C62249C0EE90"><enum>(2)</enum><text>a needs assessment, identifying the need for guardianship alternatives education for the target population proposed;</text></paragraph><paragraph id="HE2D52FC7499F45AD97808B2129F76C3D"><enum>(3)</enum><text>information identifying who will facilitate the related instruction;</text></paragraph><paragraph id="H94B175FD63C14A43B3ED8E2C986576C0"><enum>(4)</enum><text>a description of how the entity will conduct outreach to health care workers for the education program;</text></paragraph><paragraph id="H0715D342ADC2490EAB86D004349F3128"><enum>(5)</enum><text>a description of learning objectives for the education program;</text></paragraph><paragraph id="HF37BE9522D354034B4469669A733E008"><enum>(6)</enum><text>a description of activities to be carried out under the grant;</text></paragraph><paragraph id="HA5BCECA295644919BF11294CB1DE74D1"><enum>(7)</enum><text>an evaluation plan for the education program;</text></paragraph><paragraph id="HD1EF457C6A654502BDDC17BA1920E867"><enum>(8)</enum><text>a timeline for establishing and carrying out the education program;</text></paragraph><paragraph id="H7E4F70F415BD4962B161BE3F983E9167"><enum>(9)</enum><text>information that demonstrates the instructors’ knowledge of guardianship alternatives and experience in conducting education and training programs for the public; </text></paragraph><paragraph id="HB906BDF9F6F1408E84D3BBBC2F12E3EC"><enum>(10)</enum><text>information describing the format for the instruction, which may be in-person, online, or hybrid, and how the instruction and related materials will be accessible by all participants; and</text></paragraph><paragraph id="H217359910923474A9D15733EA1927ADB"><enum>(11)</enum><text>a description of how the entity will, to the best of its ability, ensure the education program reaches populations from diverse backgrounds and communities and underserved demographic populations (such as an underserved race, ethnicity, gender, gender identity, sexual orientation, age, or type of disability). </text></paragraph></section><section id="H70A6EAC781514ACE83E1E7C288B6A647"><enum>104.</enum><header>Use of funds</header><subsection id="H61F9949AD6094D179DA3AEE90B1A46F0"><enum>(a)</enum><header>Required uses</header><text>An eligible entity that receives a grant under this title shall use the grant funds for—</text><paragraph id="H212E8B28F6A5431686A4FA630ADDD3BC"><enum>(1)</enum><text>implementing an education program to enhance the awareness of alternatives to guardianship for health care workers; and</text></paragraph><paragraph id="HCC6E79B20D974C888D3E57B30D6C5DB0" commented="no"><enum>(2)</enum><text>ensuring that the guardianship alternatives education program—</text><subparagraph id="H2EF214FE810D41FDA5301E659835D52E" commented="no"><enum>(A)</enum><text>discusses the background of guardianship, the possible consequences of unnecessary guardianship, and the need for guardianship alternatives;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F939A57D9264BD3AF9962646E9C5BEF"><enum>(B)</enum><text>covers the various guardianship alternatives available in the State or States involved;</text></subparagraph><subparagraph id="HD7BE95D89793482CAC4A10E55EDA2F56" commented="no"><enum>(C)</enum><text>includes a curriculum tailored to the needs of the target population;</text></subparagraph><subparagraph id="H2310161BEAA647F58B7A8CD811B4C99A" commented="no"><enum>(D)</enum><text>includes, to the best of its ability, instructors with a diverse range of disabilities as instructors or speakers; </text></subparagraph><subparagraph id="H224328BA672443199D0743617AE48C8A" commented="no"><enum>(E)</enum><text>provides the instruction and related materials for the education program in accessible formats; and</text></subparagraph><subparagraph id="HFC1B2598E2E045FB8002D4E916A511F2"><enum>(F)</enum><text>includes, to the best of its ability, methods to reach populations from diverse backgrounds and communities and underserved demographic populations (such as an underserved race, ethnicity, gender, gender identity, sexual orientation, age, or type of disability). </text></subparagraph></paragraph></subsection><subsection id="HC120846B67EF4D5B8C0F4A14D5235629"><enum>(b)</enum><header>Allowable uses</header><text>The eligible entity may use the grant funds for—</text><paragraph id="H4B6F332EC97444A0ACE47E0CFB28491F"><enum>(1)</enum><text>recruiting individuals to receive guardianship alternatives education;</text></paragraph><paragraph id="H274BCAF7DD8A482DA2E0A5E71D2482C4"><enum>(2)</enum><text>modifying a curriculum for the education program;</text></paragraph><paragraph id="HC95028F9E375422596814454B6FA6E65"><enum>(3)</enum><text>creating accessible materials for the education program, such as materials with Communication Access Realtime Translation, with American Sign Language, in Braille, in plain language, and in other appropriate formats;</text></paragraph><paragraph id="H4C31FD5439284D34AE0F49383F30B356"><enum>(4)</enum><text>transporting individuals enrolled in the education program to and from the instructional sessions;</text></paragraph><paragraph id="HECD9302ABC784579ADF065543874BB5A"><enum>(5)</enum><text>providing child care during the instructional sessions for people in attendance;</text></paragraph><paragraph id="H4FC42C5C0A4C4F388D7708661DFF821D"><enum>(6)</enum><text>conducting website management for the education program;</text></paragraph><paragraph id="H8E4DCC56BFF6400C950140585787D362"><enum>(7)</enum><text>translating recruitment and instructional materials for the education program;</text></paragraph><paragraph id="HD971AD0C245641618F32B448CCC5702D"><enum>(8)</enum><text>providing payment for venue for in-person instruction;</text></paragraph><paragraph id="H858C87E4DFAD48A081343A86C6CB4253"><enum>(9)</enum><text>providing payment for costs of arranging for professional continuing education credits;</text></paragraph><paragraph id="H332E886B136242889D85C98096F465BB"><enum>(10)</enum><text>providing reasonable food and beverages for in-person instruction;</text></paragraph><paragraph id="H0D3B8F053D7B40D4B858FA5DE0453D02"><enum>(11)</enum><text>expanding or adapting an existing (as of the date of submission of the application for the grant) guardianship alternatives education program; or</text></paragraph><paragraph id="HD69D6F2A4FD8473BB5A95C99E166572C" commented="no" display-inline="no-display-inline"><enum>(12)</enum><text>providing payment for instructors (including guest instructors) and speakers. </text></paragraph></subsection></section></title><title id="HC65936CB86734C39B55B246B34E02CA0" style="OLC"><enum>II</enum><header>Guardianship alternatives education for educators</header><section id="H69ABF41DF651404BB3422FA6590CDD6B"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H6EF47BF2F1264BD19E86F20AF2C513F9"><enum>(1)</enum><header>Educators</header><text>The term <term>educators</term> means teachers and other staff (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), in a public or private elementary school or secondary school, that have contact with students with disabilities and their caregivers, including—</text><subparagraph id="H732BA1BD55584D63BD7529B02340E5B1"><enum>(A)</enum><text>teachers;</text></subparagraph><subparagraph id="H443ACF576E0448E1827AAB5928BC1A94"><enum>(B)</enum><text>special education teachers;</text></subparagraph><subparagraph id="H3AE588CCCBE44F85B3BF7329F53A5F45"><enum>(C)</enum><text>special education directors;</text></subparagraph><subparagraph id="HBE1B1276E4D14B81AC342721F9D4E8E1"><enum>(D)</enum><text>transition coordinators;</text></subparagraph><subparagraph id="HBDBD1889ACBC4C419940A22478296408"><enum>(E)</enum><text>State qualified vocational rehabilitation counselors, as defined in section 100(a)(3)(E) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720(a)(3)(E)</external-xref>);</text></subparagraph><subparagraph id="HDA94241BAB8C45A8890804C5740753CB"><enum>(F)</enum><text>any person providing pre-employment transition services, as defined in section 7 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705</external-xref>);</text></subparagraph><subparagraph id="H4FFD2E62B22E45AE9616AC05F12526BA"><enum>(G)</enum><text>paraprofessionals;</text></subparagraph><subparagraph id="HB05055D91C4B420DABB512D3DD81BBEC"><enum>(H)</enum><text>school social workers;</text></subparagraph><subparagraph id="H944ACA258E25480682AAD1DD108BBF4C"><enum>(I)</enum><text>school psychologists;</text></subparagraph><subparagraph id="H6228A320BD6A41939EFF0405D77EA07C"><enum>(J)</enum><text>school counselors; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H532160BA4D7040D1B58AFE34C80C28DE"><enum>(K)</enum><text>educational diagnosticians;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7531F20DFD974506A026D279A1842652"><enum>(L)</enum><text display-inline="yes-display-inline">specialized instructional support personnel, as defined in that section 8101; and</text></subparagraph><subparagraph id="H86A0CDB81C784353AFBDA9C87D2322C8"><enum>(M)</enum><text>staff of a training program for an occupation described in any of subparagraphs (A) through (L).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC056A90B74814BC2A5671725E4FB14B8"><enum>(2)</enum><header>Elementary school; secondary school</header><text>The terms <term>elementary school</term> and <term>secondary school</term> have the meanings given the terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="H404915A01A0F4E01A840BBFE30A5B7AF"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a partnership (established by a disability agency or legal services agency)—</text><subparagraph id="HF2B0F4BEEEE243FC83D1182FA37950B5"><enum>(A)</enum><text>that includes—</text><clause id="HC53AD9D840C645848A214A3E761206FD"><enum>(i)</enum><text>that disability agency or legal services agency; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE75487F0713D4A59A27A848BD09A1045"><enum>(ii)</enum><text>a local educational agency, or a public or private elementary school or secondary school, that employs educators; and </text></clause></subparagraph><subparagraph id="H94C91E548D014A0091DDCE8E75700A0F" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for which the establishing agency has memorialized the establishment, membership, and functions of the partnership in the form of a letter of support, memorandum of understanding, or similar document.</text></subparagraph></paragraph></section><section id="H12D37AAAA5AF47CDAA81426BC6F86293"><enum>202.</enum><header>Grant program</header><subsection id="H5147E79A8FD34E63A613DF53D553AD72"><enum>(a)</enum><header>In general</header><text>The Secretary shall make grants, on a competitive basis, to eligible entities in States, and to eligible entities that serve Indian Tribes, to enable the recipients to carry out guardianship alternatives education programs for educators.</text></subsection><subsection id="H3A30664F900F4C298CD36178062627D9"><enum>(b)</enum><header>Term</header><text>The Secretary may make such a grant for a first term of 3 years. An eligible entity may seek renewal of, and the Secretary may make, such a grant for a second term of 3 years, in order to expand service delivery of the education program to educators.</text></subsection></section><section id="HAE4E512EE44E4AF2B2D8F4454BAB5793"><enum>203.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible to receive a grant under this title, an entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="H00C76863DCDD424092FCE63D58B51A6D"><enum>(1)</enum><text>information identifying the target population to receive instruction, and a projected number of participants in and graduates of the education program to be carried out under the grant;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD4E38EDEB4944CCC924F9C537592C11C"><enum>(2)</enum><text>a needs assessment, identifying the need for guardianship alternatives education for the target population;</text></paragraph><paragraph id="H558D4E6141D54EF6B5DEF89A78042545"><enum>(3)</enum><text>information identifying who will facilitate the related instruction;</text></paragraph><paragraph id="HEC4A10BA88454F8A933C3D1B4927599C"><enum>(4)</enum><text>a description of how the entity will conduct outreach to educators for the education program;</text></paragraph><paragraph id="HD94EABD9080B4C3CBBC179C504C7C289"><enum>(5)</enum><text>a description of learning objectives for the education program;</text></paragraph><paragraph id="H4E242EDD40934142BB9884D3282C41EA"><enum>(6)</enum><text>a description of activities to be carried out under the grant;</text></paragraph><paragraph id="H5DB5E976E1814326B54E826806D49EE7"><enum>(7)</enum><text>an evaluation plan for the education program;</text></paragraph><paragraph id="H2032A504B42E434AA52252ADC9294A33"><enum>(8)</enum><text>a timeline for establishing and carrying out the education program;</text></paragraph><paragraph id="HECC3E6CDCB6648BB98F58DFBE90AFA41"><enum>(9)</enum><text>information that demonstrates the instructors’ knowledge of guardianship alternatives and experience in conducting education and training programs for the public; and</text></paragraph><paragraph id="HE51F9FFF73D34977A7FDA4019B0AB113"><enum>(10)</enum><text>information describing the format for the instruction, which may be in-person, online, or hybrid, and how the instruction and related materials will be accessible by all participants.</text></paragraph></section><section id="HB5866AE191A5440B9812CFA6AB8A70E0" commented="no"><enum>204.</enum><header>Use of funds</header><subsection commented="no" display-inline="no-display-inline" id="H3BA0AF81418F4FB1A199BDC45D23CDC0"><enum>(a)</enum><header display-inline="yes-display-inline">Required uses</header><text>An eligible entity that receives a grant under this title shall use the grant funds for implementing an education program to enhance the awareness of alternatives to guardianship for educators and ensuring that the education program meets the requirements of section 104(a)(2).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H0C19C80FFDE4464A8F76F698612C4DDB"><enum>(b)</enum><header>Allowable uses</header><text>The eligible entity may use the grant funds to carry out the activities described in section 104(b), for the education program.</text></subsection></section></title><title id="HFF4E4396714C493194EACF3AE8005A85" style="OLC"><enum>III</enum><header>Guardianship alternatives education for families</header><section id="H3D61C52BFDD6459E8B385FF3CAC397E6" commented="no"><enum>301.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph commented="no" display-inline="no-display-inline" id="HA9D2F90992934BD3B40B233FE2BF01C3"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means a disability agency, legal services agency, or aging agency with a goal to inform and support older adults, or people with disabilities, and their family members.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1D6C2EF63584F7FB81C7654DBF9FFF2"><enum>(2)</enum><header>Family member</header><text>The term <term>family member</term> means a member of the family of—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7ECB6004B95E4449A8DE27DF4D87FB7C"><enum>(A)</enum><text display-inline="yes-display-inline">an older adult; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6E986A4D96314966816E1B56FB51BCEB"><enum>(B)</enum><text>a person with a disability.</text></subparagraph></paragraph></section><section id="H6B49FE7D63FC4A6CAEAF82383B09F4CD"><enum>302.</enum><header>Grant program</header><subsection id="H7A98D94178304389AC47E5D2B83E35FC"><enum>(a)</enum><header>In general</header><text>The Secretary shall make grants, on a competitive basis, to eligible entities in States, and to eligible entities that serve Indian Tribes, to enable the recipients to carry out guardianship alternatives education programs for family members of older adults and family members of people with disabilities.</text></subsection><subsection id="H9459F01E4FF24936AF848BD12059E6D2"><enum>(b)</enum><header>Term</header><text>The Secretary may make such a grant for a first term of 3 years. An eligible entity may seek renewal of, and the Secretary may make, such a grant for a second term of 3 years, in order to expand service delivery of the education program to such family members.</text></subsection></section><section id="H814BBD17393048D7B6722AC1343986F8"><enum>303.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible to receive a grant under this title, an entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph id="H23381DDC7D0C4EAD8B19219038A7CFA4"><enum>(1)</enum><text> information identifying the target population to receive instruction, and a projected number of participants in and graduates of the education program to be carried out under the grant;</text></paragraph><paragraph id="H487A014C2D2D4F9CAE7347F69D1A015C"><enum>(2)</enum><text> information identifying who will facilitate the related instruction for the education program;</text></paragraph><paragraph id="H360385BC19AC4B52990326E45877A5DC"><enum>(3)</enum><text>a description of how the entity will conduct outreach to educators for the education program;</text></paragraph><paragraph id="HE66EA99C079A455390018191DB3C8179"><enum>(4)</enum><text>a description of learning objectives for the education program;</text></paragraph><paragraph id="H09914541260D469A9C8BDDFDA6F83288"><enum>(5)</enum><text>a description of activities to be carried out under the grant;</text></paragraph><paragraph id="HF264FBDCB958453FB0484CADA1E536DF"><enum>(6)</enum><text>an evaluation plan for the education program;</text></paragraph><paragraph id="H0A42EE81717F4C41B6785AC674270C72"><enum>(7)</enum><text>a timeline for establishing and carrying out the education program;</text></paragraph><paragraph id="H8367E5544FAF4100B1C70CE10D7C8A31"><enum>(8)</enum><text>information that demonstrates the instructors’ knowledge of guardianship alternatives and experience in conducting education and training programs for the public; and</text></paragraph><paragraph id="HFD26D5C4F4564180B2C85FB84218BA5D"><enum>(9)</enum><text>information describing the format for the instruction, which may be in-person, online, or hybrid, and how the instruction and related materials will be accessible by all participants.</text></paragraph></section><section id="H2C9C4F590C1041B9BA354ED22C4D1DFD" commented="no"><enum>304.</enum><header>Use of funds</header><subsection commented="no" display-inline="no-display-inline" id="H6485090F7A6F499B907434DE57FD28AA"><enum>(a)</enum><header display-inline="yes-display-inline">Required uses</header><text>An eligible entity that receives a grant under this title shall use the grant funds for implementing an education program to enhance the awareness of alternatives to guardianship for family members and ensuring that the education program meets the requirements of section 104(a)(2).</text></subsection><subsection id="H184D07B4C98443798C5B13B50E77FA56" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Allowable uses</header><text>The eligible entity may use the grant funds to carry out the activities described in section 104(b), for the education program. </text></subsection></section></title><title id="HB400233E55014813A13A37D87C8EF531" style="OLC"><enum>IV</enum><header>Guardianship alternatives education for court workers and court-related personnel</header><section id="HBACD1DAA6CCB4CA990B4664253C85B4E"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="H9980530CE0A64B14848AA23556C2F8C0"><enum>(1)</enum><header>Court-related personnel</header><text>The term <term>court-related personnel</term> means persons working in, or members of organizations supporting, court systems or court workers, including—</text><subparagraph id="HC65CF8F0535F46209C2F76A85ACB1D7B"><enum>(A)</enum><text>staff and members of local chapters of the American Bar Association;</text></subparagraph><subparagraph id="HDB8DF1612FE34546A70FD94D8E159668"><enum>(B)</enum><text>staff and members of local chapters of the American Civil Liberties Union;</text></subparagraph><subparagraph id="HBEE68E842F5A4EEAB8AA09203BB390F4"><enum>(C)</enum><text>staff and members of local associations of court workers;</text></subparagraph><subparagraph id="HD59EC409C958491DA5E4595F592CC156"><enum>(D)</enum><text>staff and members of elder rights law organizations;</text></subparagraph><subparagraph id="H919E8C2868404155B089A10922E619FA"><enum>(E)</enum><text>staff and members of disability rights law organizations;</text></subparagraph><subparagraph id="H75DA2312361A4922945BD5B0C28284BC"><enum>(F)</enum><text>staff of an agency implementing a State protection and advocacy system, as defined in section 102 of the Developmental Disabilities Act and Bill of Rights of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/42/15002">42 U.S.C. 15002</external-xref>);</text></subparagraph><subparagraph id="HAD9308262ACA455AAD948DB05D745B03"><enum>(G)</enum><text>district attorneys and their staff; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H27DE119C49264705A825FCB8355531E6"><enum>(H)</enum><text display-inline="yes-display-inline">court clerks and clerk staff not directly employed by the court; or</text></subparagraph><subparagraph id="H50B0CFBEB5BF408BBA97D06E198EE83B" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text>an entity providing a training program for any specialty relevant to an organization or occupation listed in this paragraph. </text></subparagraph></paragraph><paragraph id="HE4ED0C6B64DD4D7D81EFF072307B761D"><enum>(2)</enum><header>Court workers</header><text>The term <term>court workers</term> means persons working in local court systems, including—</text><subparagraph id="HE9A1B7C0E760491DADF51101B621979B"><enum>(A)</enum><text>court staff;</text></subparagraph><subparagraph id="H059C771D70D4406DAE3A20EC3E734837"><enum>(B)</enum><text>law or court clerks and paralegals;</text></subparagraph><subparagraph id="H25F8B7A9DF9748CAB1859F4DA462E3F2"><enum>(C)</enum><text>attorneys; and</text></subparagraph><subparagraph id="H20B2C855AC2043AC863BBA5281A844FD"><enum>(D)</enum><text>judges.</text></subparagraph></paragraph><paragraph id="H8B939E5861074A5ABDDB4D8F2CFE95DC"><enum>(3)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a partnership (established by a disability agency, legal services agency, or aging agency)—</text><subparagraph id="HE8D6F6BD78604DA4A8C7893748F345A0"><enum>(A)</enum><text>that includes—</text><clause id="HF4EC3A16B0974D76AB83988F6789DF58"><enum>(i)</enum><text>that disability agency, legal services agency, or aging agency; and</text></clause><clause id="HA7452391E1784412B6C52589D25A5256"><enum>(ii)</enum><text>a court whose employees, or other court-related organization whose members, have contact with plaintiffs who are under or facing a guardianship or other protective arrangement or address cases related to guardianship and other protective arrangements; and</text></clause></subparagraph><subparagraph id="H11BD96BAE3BD47698A3CE86E32D18DEE" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for which the establishing agency has memorialized the establishment, membership, and functions of the partnership in the form of a letter of support, memorandum of understanding, or similar document.</text></subparagraph></paragraph></section><section id="H0D34F34057274662BB7DA990C8F41EEA"><enum>402.</enum><header>Grant program</header><subsection id="H3E9058DD905840648B9A7EE8B0CD6561"><enum>(a)</enum><header>In general</header><text>The Secretary shall make grants, on a competitive basis, to eligible entities in States, and to eligible entities that serve Indian Tribes, to enable the recipients to carry out guardianship alternatives education programs for court workers and other court-related personnel.</text></subsection><subsection id="H1172608BDA8E40D7B3868D5B3BB3C37F"><enum>(b)</enum><header>Term</header><text>The Secretary may make such a grant for a first term of 3 years. An eligible entity may seek renewal of, and the Secretary may make, such a grant for a second term of 3 years, in order to expand service delivery of the education program to court workers and other court-related personnel.</text></subsection></section><section id="H62445361E1DE4AB89C66324B654786F7"><enum>403.</enum><header>Applications</header><text display-inline="no-display-inline">To be eligible to receive a grant under this title, an entity shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including—</text><paragraph commented="no" display-inline="no-display-inline" id="HAFB5BBD382E8485585CDEEDEF08C187A"><enum>(1)</enum><text display-inline="yes-display-inline">information identifying the target population to receive instruction, including a projected number of participants in and graduates of the education program to be carried out under the grant;</text></paragraph><paragraph id="H067FD4F419114C18AEA3939916EBA166"><enum>(2)</enum><text>a needs assessment, identifying the need for guardianship alternatives education for the target population proposed; </text></paragraph><paragraph id="H2889745150D948E4A7116A29B79BCDA9"><enum>(3)</enum><text>information identifying who will facilitate the related instruction;</text></paragraph><paragraph id="H6FD2C27F1B6F4F14A35703C33F15928A"><enum>(4)</enum><text>a description of how the entity will conduct outreach to the court workers or other court-related personnel proposed for the education program;</text></paragraph><paragraph id="H74AA3EDB65714979B1529025EDCA7F62"><enum>(5)</enum><text>a description of learning objectives for the education program;</text></paragraph><paragraph id="H260C99C5783B4953A90346F7F1B6F7F1"><enum>(6)</enum><text>a description of activities to be carried out under the grant;</text></paragraph><paragraph id="H2CA0FCB7A72B40ECB66FF18925177E75"><enum>(7)</enum><text>an evaluation plan for the education program;</text></paragraph><paragraph id="H20AC4CEB2DE641959CD835D9DA0CE772"><enum>(8)</enum><text>a timeline for establishing and carrying out the education program;</text></paragraph><paragraph id="HD107C2255F8F42758B4F31FC005EA53B"><enum>(9)</enum><text>information that demonstrates the instructors’ knowledge of guardianship alternatives and experience in conducting education and training programs for the public; and</text></paragraph><paragraph id="H3E2E001022964CB7A15713AB03ACA12E"><enum>(10)</enum><text>information describing the format for the instruction, which may be in-person, online, or hybrid, and how the instruction and related materials will be accessible by all participants.</text></paragraph></section><section id="H9990475F90BF4D688E8F1DC7C62C04D7" commented="no"><enum>404.</enum><header>Use of funds</header><subsection commented="no" display-inline="no-display-inline" id="H6208A281216B4B9EB5FCBD219D1B6CDA"><enum>(a)</enum><header display-inline="yes-display-inline">Required uses</header><text>An eligible entity that receives a grant under this title shall use the grant funds for implementing an education program to enhance the awareness of alternatives to guardianship for court workers or other court-related personnel and ensuring that the education program meets the requirements of section 104(a)(2).</text></subsection><subsection id="H13F28AE5A83B4E5FA0AF3C8CCCFD26A5" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Allowable uses</header><text>The eligible entity may use the grant funds to carry out the activities described in section 104(b), for the education program. </text></subsection></section></title><title id="H323A4BE6C08C4C39AC1E6967DEAD897F" style="OLC"><enum>V</enum><header>Administration</header><section id="HAC22472AA8754ED18F7AEBAC041259E2"><enum>501.</enum><header>Grant Advisory Council</header><subsection id="H855421917960454B8132A9CF422D19AA"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish an advisory council, to be known as the <quote>Grant Advisory Council</quote>, to advise eligible entities that receive grants under this Act on activities carried out under the grants.</text></subsection><subsection id="HD04D5CAF7C534064B4351648E0C9D9F0"><enum>(b)</enum><header>Composition</header><text>The advisory council shall be composed of 13 members, consisting of—</text><paragraph id="H1159CA87427242A7B4CD1CBC3BCEBE3F"><enum>(1)</enum><text>3 experts who have experience in counseling individuals and guiding individuals to guardianship alternatives, or who have data-driven expertise in ways to guide individuals to guardianship alternatives, which may include—</text><subparagraph id="H876E813A4B5D4947BECC71630D9CD348" commented="no"><enum>(A)</enum><text>a social services program administrator;</text></subparagraph><subparagraph id="H1E6A66E4DC4440CF98E244295ACC83B4" commented="no"><enum>(B)</enum><text>a guardianship researcher; or</text></subparagraph><subparagraph id="HB174CDD3A7AB4302AB69DFC5B3684F16" commented="no"><enum>(C)</enum><text>an advocate for people with disabilities; and</text></subparagraph></paragraph><paragraph id="H27690528D5244E7B87A716E6DFCA5AC0" commented="no"><enum>(2)</enum><text>1 health care administrator or manager with experience with guardianship alternatives;</text></paragraph><paragraph id="H09F756643C4E493695B7EF14AB441C9E" commented="no"><enum>(3)</enum><text>1 administrator from a school served by a local educational agency, and 1 administrator from an institution of higher education, with experience with guardianship alternatives;</text></paragraph><paragraph id="H03340BB69A4E4FDDA957A52E811CA98A" commented="no"><enum>(4)</enum><text>1 family member, as defined in section 301, with experience with guardianship alternatives;</text></paragraph><paragraph id="H3109506057FB4A7492220C5F72B61892" commented="no"><enum>(5)</enum><text>1 court worker, as defined in section 401, with experience with guardianship alternatives;</text></paragraph><paragraph id="HF1AA8A7DE0A545B4A994D1E83F5310D1"><enum>(6)</enum><text>3 people with disabilities, or older adults, who have successfully transitioned to a guardianship alternative, of which at least 1 shall be a person with a disability and at least 1 shall be an older adult; and </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2A4F9ACD12324E1485CBEC026AEAE6C9"><enum>(7)</enum><text display-inline="yes-display-inline">3 people with disabilities, or older adults, who are in a guardianship alternative, of which at least 1 shall be a person with a disability and at least 1 shall be an older adult. </text></paragraph></subsection><subsection id="H3AF5DB3075934AE7BA00795B0BAF31FD"><enum>(c)</enum><header>Period of appointment; vacancies</header><text>Members shall be appointed for the life of the advisory council. Any vacancy in the council shall not affect the powers of the advisory council, but shall be filled in the same manner as the original appointment was made. </text></subsection><subsection id="H0FB7BD8F31384CFC8C766588453EAB91"><enum>(d)</enum><header>Chairman and vice chairman</header><text>The advisory council shall select a Chairperson and Vice Chairperson from among its members. </text></subsection><subsection id="HF5C587D17F004A578103E92770AB71E8"><enum>(e)</enum><header>Duties</header><text>The advisory council shall—</text><paragraph id="H37A6BD37FD7C439BBEB5A52E77DF64BB"><enum>(1)</enum><text>advise the Secretary on, and provide general oversight for, the grant programs carried out under titles I through IV concerning the activities carried out under the grants, including development of the curricula for guardianship alternatives education;</text></paragraph><paragraph id="H30992D5188724F54A935083A7284E04C"><enum>(2)</enum><text>consult with the Secretary on the awarding of the grants;</text></paragraph><paragraph id="H628193D7B47C4B8D845941D4226FC334"><enum>(3)</enum><text>provide recommendations for sustainability and expansion of the guardianship alternatives education programs carried out under the grants, such as development of a train-the-trainer model for such an education program; and</text></paragraph><paragraph id="HF8165BA37DCC42B2B8BE73CF7E84C535"><enum>(4)</enum><text>provide input for the evaluation methods and implementation of the evaluation described in section 502, including advising the Secretary on additional criteria for the evaluator to evaluate under section 502, to measure effectiveness of guardianship alternatives education programs described in section 502. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3D9D56A63D6F4E8682270613071B520E"><enum>(f)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than September 30, 2027, and not later than September 30, 2030, the advisory council shall prepare a report containing recommendations on the programs, activities, and curricula described in subsection (e)(1) and the sustainability and expansion described in subsection (e)(3). The advisory council shall submit the report to the covered committees defined in section 504(f).</text></subsection><subsection id="H880893A7E0C2493CA2FA80EA33AFE3AC"><enum>(g)</enum><header>Travel expenses</header><text>Subject to the limit described in section 505(b), the members of the advisory council shall be allowed travel expenses, including per diem in lieu of subsistence, at rates authorized for employees of agencies under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code, while away from their homes or regular places of business in the performance of services for the advisory council.</text></subsection><subsection id="H30114E9D1A6F4D00B43AABAE8CAA01A5"><enum>(h)</enum><header>Detail of government employees</header><text>Any Federal Government employee may be detailed to the advisory council without reimbursement to serve as a staff member for the advisory council, and such detail shall be without interruption or loss of civil service status or privilege. </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H51ECEB2ECB7747628DAE897A2C309A8C"><enum>(i)</enum><header>Termination</header><text>The advisory council shall terminate on October 1, 2030.</text></subsection></section><section id="H5A65113FFDDC4405B2F505BDBF03652C"><enum>502.</enum><header>Evaluation of education programs</header><subsection id="H3DEB3BF9E6444EC69A104E1FC5AB003F"><enum>(a)</enum><header>Independent evaluator</header><text>The Secretary shall enter into a contract with an independent entity, who is not a grant recipient under this Act and who has expertise in evaluating programs for people with disabilities or programs for older adults, to carry out an evaluation of the education programs carried out under this Act.</text></subsection><subsection id="H7D9C8D71CDEA4C8E97DFAF0D18BC96CF"><enum>(b)</enum><header>Population covered by evaluation</header><text>In conducting the evaluation, the evaluator shall consider the impact of the education programs carried out under this Act on all participants served by the education programs and on each underserved demographic population (such as an underserved race, ethnicity, gender, gender identity, sexual orientation, age, or type of disability) served by the education programs.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H87D48F814F5C453D9AB6036BC9C6D3C3"><enum>(c)</enum><header>Performance</header><paragraph id="HCD2E71BE53F84D89932C9677925FE931"><enum>(1)</enum><header>Performance in changing awareness of guardianship alternatives</header><subparagraph commented="no" display-inline="no-display-inline" id="H306D0FF14DCF4870BA8AB95C4C995AD7"><enum>(A)</enum><header>Awareness of by program participants</header><text>The evaluator shall measure program participants’ awareness of guardianship alternatives as a result of the education programs.</text></subparagraph><subparagraph id="H2B2EC6C29F4741A58785D4ED5687AB4E" commented="no"><enum>(B)</enum><header>Awareness due to dissemination</header><text>The evaluator shall measure the dissemination of information on guardianship alternatives in the workplaces and communities of participants in the education programs, as a result of the education programs, to evaluate how far awareness of guardianship alternatives has expanded beyond the participants. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFEE03571935E42F69BB42537E9E0C4A6"><enum>(2)</enum><header>Effectiveness of education programs</header><text display-inline="yes-display-inline">The evaluator shall measure the effectiveness of the education programs on any additional criterion that the advisory committee advised the Secretary to adopt, and the Secretary adopted, in accordance with section 501(e)(4).</text></paragraph></subsection><subsection id="HE478EE1615474452A495B016D54D489B"><enum>(d)</enum><header>Policy changes at the State level</header><text>In conducting the evaluation, the evaluator shall identify any guardianship policy changes at the State level, including the creation of, removal of, or changes to guardianship policies.</text></subsection></section><section id="H470496ED5019450EBF4980A4714FA4CC"><enum>503.</enum><header>State data collection on protective arrangements</header><subsection id="H5390B9BA65744FEF80A6FE2D590C5FCA"><enum>(a)</enum><header>Rehabilitation Act of 1973</header><text>The Rehabilitation Act of 1973 is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HAF4BEA08AB084B16AE3735E9DE9DE3CE"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101(a)(10) (<external-xref legal-doc="usc" parsable-cite="usc/29/721">29 U.S.C. 721(a)(10)</external-xref>)—</text><subparagraph id="H8C29AE0B49A04022A449D1067C10A731"><enum>(A)</enum><text>by redesignating subparagraphs (F) through (H) as subparagraphs (G) through (I), respectively; and</text></subparagraph><subparagraph id="H11A5002695C24C92B5A8555D856D4145"><enum>(B)</enum><text>by inserting after subparagraph (E) the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H739182290A3047F19F1E7EC3F46D6FC2"><subparagraph id="H18EB1DB04AF149D29F9714516C69B35A"><enum>(F)</enum><text>The Commissioner shall require that each designated State unit include in the reports additional information described in section 503(b) of the <short-title>Alternatives to Guardianship Education Act</short-title>.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2663F10ECF6C49C69208914D126F1018"><enum>(2)</enum><text>in section 607 (<external-xref legal-doc="usc" parsable-cite="usc/29/795l">29 U.S.C. 795l</external-xref>), by inserting <quote>(except with respect to information under subparagraph (F) of section 101(a)(10))</quote> after <quote>section 101(a)(10)</quote>.</text></paragraph></subsection><subsection id="HC71DE0487F8244709A221E8BF6B8A010"><enum>(b)</enum><header>Data To be collected and submitted by States</header><text>In order to provide objective, measurable data on guardianships and guardianship alternatives in the States, States receiving funds under title I of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720 et seq.</external-xref>) shall collect and report to the Secretary, in accordance with subsection (a), information about each of the following: </text><paragraph commented="no" display-inline="no-display-inline" id="HB453785D332142BC9129B7DF2330558C"><enum>(1)</enum><text display-inline="yes-display-inline">The number and type of guardianships and protective arrangements established and dissolved each calendar year in the State.</text></paragraph><paragraph id="H043343559D5B4DECB669B4787FBAFBBB"><enum>(2)</enum><text>Demographic information of guardians and people under guardianship arrangements, including type of guardian (such as family member, friend, professional private guardian, or public agency).</text></paragraph><paragraph id="H88BF293844C14262BE96E224BB39F95E"><enum>(3)</enum><text>The average length of a guardianship arrangement in the State, as of the time such data is reported.</text></paragraph><paragraph id="H4D61627F8E2644F3B06EAF22312411D7"><enum>(4)</enum><text>Information about the reasons for guardianship arrangements in the State.</text></paragraph><paragraph id="H934F520878B4476E9C39815605D7EFB8"><enum>(5)</enum><text>Information about the reasons that guardianship arrangements were terminated in the State since the last report, including receipt of guardianship alternatives education.</text></paragraph></subsection></section><section id="H6F948C88759E4071B559930F21778C48"><enum>504.</enum><header>Reporting</header><subsection id="HF2B01D1ED28A49408A96D096E95447DC"><enum>(a)</enum><header>Eligible entity reports</header><text>Each eligible entity that receives a grant under this Act for an education program shall annually prepare and submit to the Secretary a progress report, that measures the change in indicators described in paragraphs (1) and (2) of section 502(c), as a result of the education program, and the change in policies described in section 502(d).</text></subsection><subsection id="HB57BB1947AFD4FE1AFC4BA7947979E86"><enum>(b)</enum><header>Summary effectiveness report</header><text>The Secretary shall annually—</text><paragraph id="H8138596C00A64639A88C799DD403FDB8"><enum>(1)</enum><text>prepare a summary report on the change, in the aggregate, in indicators described in paragraphs (1) and (2) of section 502(c), as a result of the education programs carried out under this Act, and the change in policies described in section 502(d), which report shall include—</text><subparagraph id="H29283AE45F854B5C873FB001DD9A6198"><enum>(A)</enum><text>information on methods of outreach to recruit participants for the education programs from diverse backgrounds and communities, including the number of the participants recruited through each method;</text></subparagraph><subparagraph id="H4A570CC6DE67434488BE980CAFBD4470"><enum>(B)</enum><text>the total number of participants in the education programs, and the percentage of such participants who completed the education programs; and</text></subparagraph><subparagraph id="H3B56F40FE744425BB7AB2C94270D1507"><enum>(C)</enum><text>data on demographic characteristics, including the race, ethnicity, gender, gender identity, age, and type of disability, of the participants, and data on the geographic location of the participants, in the education programs; and</text></subparagraph></paragraph><paragraph id="H78CEE724B896458F90FA5DAAED22BD5D"><enum>(2)</enum><text>submit the report to the Committee on Health, Education, Labor, and Pensions and the Special Committee on Aging of the Senate, and the Committee on Education and the Workforce of the House of Representatives.</text></paragraph></subsection><subsection id="HD419F7C4AF4A43AA8CA8F1A77EDB4AD0"><enum>(c)</enum><header>Renewal report</header><text>Not later than 3 years after the date of enactment of this Act, the Secretary shall prepare and submit to the covered committees a formative report on the instruction provided through the guardianship alternatives education program during the 2-year period after eligible entities first receive grants under this Act. The Secretary shall use the information in the report in determining whether to renew grants for eligible entities for a second grant term. The Secretary shall submit the report to the grant recipients whose grants are renewed, to inform the work of the recipients during the second grant term.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H3C04DEABA4F248728ADACFCDFCA1D202"><enum>(d)</enum><header>State data report</header><text>The Secretary shall prepare a report containing the data collected under section 503, and make the report publicly available. </text></subsection><subsection id="HBAD9245BD74A43D08B0AB1A7BE26F2D1"><enum>(e)</enum><header>Final report</header><text>Not later than 1 year after the end of the last second grant term to be completed under this Act, the Secretary shall prepare and submit to the covered committees a final report summarizing all actions taken under grants made available under this Act.</text></subsection><subsection id="HC3084C3AAE284752832C504224044F20"><enum>(f)</enum><header>Covered committees</header><text>In this section, the term <term>covered committees</term> means the Committee on Health, Education, Labor, and Pensions, the Committee on Finance, and the Special Committee on Aging of the Senate, and the Committee on Education and the Workforce and the Committee on Energy and Commerce of the House of Representatives.</text></subsection></section><section id="HBF95887E144F44E09424B8790B818B00"><enum>505.</enum><header>Authorization of appropriations</header><subsection id="HFB265EF41A2040969C9E98D635F0659E"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to carry out this Act, $10,000,000 for each of fiscal years 2025 through 2030.</text></subsection><subsection id="HE6E3698793C94B3DB2D41CF34DF636A8"><enum>(b)</enum><header>Administration and evaluation</header><text>From the amount made available under subsection (a) for each fiscal year, the Secretary shall reserve not more than 5 percent for administration of this Act, including carrying out the activities required in sections 501 through 504. </text></subsection></section></title></legis-body></bill>
