Amendment to International Emergency Economic Powers Act.</toc-entry></toc></subsection></section><section id="H62BAB380EE28467D93968E9FA3BC5FCD"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1742 of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HFC3534CAED50424FB7088E832BC0D130" display-inline="no-display-inline"><paragraph id="HAA5F81CBEBE44C8781700B0357C00A94"><enum>(15)</enum><header>Additional definitions</header><subparagraph id="H5C42E0358D6747AAA25B188691B00B3A" commented="no"><enum>(A)</enum><header>Artificial intelligence</header><text display-inline="yes-display-inline">The term <quote>artificial intelligence</quote> has the meaning given that term in section 5002(3) of the National Artificial Intelligence Initiative Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/15/9401">15 U.S.C. 9401(3)</external-xref>).</text></subparagraph><subparagraph id="HFB5304E2415D49B3B2213E891BEE3A8B"><enum>(B)</enum><header>Artificial intelligence system</header><text display-inline="yes-display-inline">The term ‘artificial intelligence system’ means any software or hardware implementation of artificial intelligence, including artificial intelligence model weights and any numerical parameters associated with the artificial intelligence implementation.</text></subparagraph><subparagraph id="H83750F7C1B8545F5A1728884C5963934"><enum>(C)</enum><header>Covered artificial intelligence system</header><clause id="HE20B182DCAAC40699353661096595047"><enum>(i)</enum><header>Interim definition</header><text display-inline="yes-display-inline">For the period beginning on the date of the enactment of this paragraph and ending on the date on which the Secretary issues the regulations required by clause (ii), the term <quote>covered artificial intelligence system</quote> means an artificial intelligence system that—</text><subclause id="H35BAE6063923472EBF23A5DE951A29EE"><enum>(I)</enum><text display-inline="yes-display-inline">exhibits, or could foreseeably be modified to exhibit, capabilities in the form of high levels of performance at tasks that pose a serious risk to the national security and foreign policy of the United States or any combination of those matters, even if it is provided to end users with technical safeguards that attempt to prevent users from taking advantage of the relevant capabilities, such as by—</text><item id="H0C68D19D1AFB494F8D44181755496D87"><enum>(aa)</enum><text>substantially lowering the barrier of entry for experts or non-experts to design, synthesize, acquire, or use chemical, biological, radiological, or nuclear (CBRN) weapons or weapons of mass destruction;</text></item><item id="H5E704D703D924A81945BC7CA32906912"><enum>(bb)</enum><text>enabling offensive cyber operations through automated vulnerability discovery and exploitation against a wide range of potential targets of cyber attacks; or</text></item><item id="H4FE92601288343EA873AF51FC2D423F3"><enum>(cc)</enum><text>permitting the evasion of human control or oversight through means of deception or obfuscation; or</text></item></subclause><subclause id="H1FF189D9017A4CC29AC8A7F75817521E"><enum>(II)</enum><text display-inline="yes-display-inline">can reasonably be expected to exhibit the capabilities described in subclause (I), such as by demonstrating technical similarity or equivalent performance to models in which relevant capabilities have emerged unexpectedly.</text></subclause></clause><clause id="H3649FF8457354426B1315A9FEFE14CE1"><enum>(ii)</enum><header>Final definition</header><subclause id="H8AEF56E8EDAD4A0791AD32BA67B946D8"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 365 days after the date of the enactment of this paragraph, the Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the Secretary of Energy, shall issue regulations defining the term <quote>covered artificial intelligence system</quote> for purposes of this subtitle. Thereafter, the Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the Secretary of Energy, shall update the definition of such term as necessary. </text></subclause><subclause id="HCE9A1E047494445DAFA2BAA046982487"><enum>(II)</enum><header>Factors</header><text display-inline="yes-display-inline">In developing the definition of the term <quote>covered artificial intelligence system</quote> under this clause, the Secretary, in consultation with the Secretary of State, the Secretary of Defense, and the Secretary of Energy, shall consider technical and non-technical factors, including those factors that will most effectively promote the national security of the United States.</text></subclause></clause></subparagraph><subparagraph id="HAD364B0D19094A68B9EED4F347B8A3C0"><enum>(D)</enum><header>Model weight</header><text display-inline="yes-display-inline">The term <quote>model weight</quote> means a numerical parameter within an artificial intelligence model that helps determine the model’s outputs in response to inputs.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HF9B6C427DFCB451BA9EC722800912E88"><enum>3.</enum><header>Authority of the President</header><text display-inline="no-display-inline">Section 1753(a) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4812">50 U.S.C. 4812(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H6658CCA0432841E29BB327C9F397D80C" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">In addition, in order to carry out the policy set forth in paragraphs (1) through (10) of section 1752, the President may control the activities of United States persons, wherever located, relating to specific covered artificial intelligence systems and emerging and foundational technologies that are identified as essential to the national security of the United States pursuant to section 1758(a). </quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H864CDC63B6D740A8BCA73E19D63353F2"><enum>4.</enum><header>Additional authorities</header><text display-inline="no-display-inline">Section 1754(d) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H279FAF292D2A4CF9A1C28B8CDD043511" display-inline="no-display-inline"><paragraph id="H6ED94F640C624679BF421FD9CF52D2EF"><enum>(3)</enum><header>Additional authorities</header><text display-inline="yes-display-inline">In furtherance of section 1753(a), the President may require a United States person, wherever located, to apply for and receive a license from the Department of Commerce for—</text><subparagraph id="H8BAC9E53DD8F48D59E75310E589735F0" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the export, reexport, or in-country transfer of items described in paragraph (4), including items that are not subject to control under this subchapter; and</text></subparagraph><subparagraph id="HE9DE1349A65A4D36B11F963471CCAF57"><enum>(B)</enum><text display-inline="yes-display-inline">other activities that may support the design, development, production, use, operation, installation, maintenance, repair, overhaul, or refurbishing of, or for the performance of services relating to, any items described in paragraph (4).</text></subparagraph></paragraph><paragraph id="H42936B3564024B9E82B2903AF3CBD826"><enum>(4)</enum><header>Items described</header><text display-inline="yes-display-inline">The items described in this paragraph include—</text><subparagraph id="H30BD2097D3C74D648F59DF1A42DBC05A"><enum>(A)</enum><text display-inline="yes-display-inline">covered artificial intelligence systems; and</text></subparagraph><subparagraph id="HB411E78B768E43F4B0D091E6F303C2FF"><enum>(B)</enum><text display-inline="yes-display-inline">specific emerging and foundational technologies that are identified as essential to the national security of the United States pursuant to section 1758(a).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H14E691B3B83B46818717F744FDFC01B4"><enum>5.</enum><header>Amendment to International Emergency Economic Powers Act</header><text display-inline="no-display-inline"> Section 203(b)(3) of the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1702">50 U.S.C. 1702(b)(3)</external-xref>) is amended by striking <quote>section 5 of the Export Administration Act of 1979, or under section 6 of such Act to the extent that such controls promote the nonproliferation or antiterrorism policies of the United States</quote> and inserting <quote>section 1754 of the Export Control Reform Act of 2018</quote>. </text></section></legis-body></bill>
