which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide that silencers be treated the same as firearms accessories.</official-title></form><legis-body id="H7D945A18DACD47F6BC841CEC8C23DA48" style="OLC"><section id="H3387C92227FE446290E98A97436FE546" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Silencers Help Us Save Hearing Act</short-title></quote> or the <quote><short-title>SHUSH Act</short-title></quote>.</text></section><section id="HDC32B003483348409C67B417624AFC8A"><enum>2.</enum><header>Equal treatment of silencers and firearms</header><subsection id="H3F3020AF0067427E815B83738A72CCBD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5845">Section 5845(a)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(7) any silencer</quote> and all that follows through <quote>; and (8)</quote> and inserting <quote>; and (7)</quote>.</text></subsection><subsection id="HAA49156E2DD04943BE43EBD2FB256E4C"><enum>(b)</enum><header>Effective date</header><paragraph id="H55ECF4E800424B8E9B729179C1AA14D0"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the amendment made by this section shall take effect on the date of the enactment of this Act.</text></paragraph><paragraph id="HB2C1D6A64A3E4F7DAFEA43BAAE2B9901"><enum>(2)</enum><header>Transfers</header><text>In the case of the tax imposed by section 5811 of such Code, the amendment made by this section shall apply with respect to transfers after October 22, 2015.</text></paragraph></subsection></section><section id="HC0F06A7AE0B9487EBD460181599489F5"><enum>3.</enum><header>Treatment of certain silencers</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/5841">Section 5841</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H1803A01C2FDF41548A5AA98131CA6790" style="OLC"><subsection id="HA0D1539A6D354AA98DE36ABC0748491F"><enum>(f)</enum><header>Firearm silencers</header><text display-inline="yes-display-inline">A person acquiring or possessing a firearm silencer in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, shall be treated as meeting any registration and licensing requirements of the National Firearms Act (as in effect on the day before the date of the enactment of this subsection) with respect to such silencer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H1496D5DB13EE47A2819B2C2F7B838EA8" section-type="subsequent-section"><enum>4.</enum><header>Preemption of certain State laws in relation to firearm silencers</header><text display-inline="no-display-inline">Section 927 of title 18, United States Code, is amended by adding at the end the following: <quote>Notwithstanding the preceding sentence, a law of a State or a political subdivision of a State that, as a condition of lawfully making, transferring, using, possessing, or transporting a firearm silencer in or affecting interstate or foreign commerce, imposes a tax on any such conduct, or a marking, recordkeeping or registration requirement with respect to the firearm silencer, shall have no force or effect.</quote>.</text></section><section id="H60E2C06C025541BCB11EDAA2C2D5C96E"><enum>5.</enum><header>Silencers and mufflers not to be Federally regulated</header><subsection id="H0ECB7D0A5EDF43D6A15ACFA66BB1EF73"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921(a) of title 18, United States Code, is amended—</text><paragraph id="H4157D34742E048B7926528C887DC8A2B"><enum>(1)</enum><text>in paragraph (3), by striking <quote>(C) any firearm muffler or firearm silencer; or (D)</quote> and inserting <quote>or (C)</quote>; and</text></paragraph><paragraph id="H0A86C3BC512445F9AC84973BADED48A2"><enum>(2)</enum><text>by striking paragraph (24).</text></paragraph></subsection><subsection id="H66CCA8FF250E4E3D858455B3FDEFF4CF"><enum>(b)</enum><header>Penalties</header><text display-inline="yes-display-inline">Section 924 of such title is amended—</text><paragraph id="HE78D54E74D534CEEBC9640CE430B4DD5"><enum>(1)</enum><text>in subsection (c)—</text><subparagraph id="HA3872B7F4213450C99BA8162E7A86260"><enum>(A)</enum><text>in paragraph (1)(B)(ii) by striking <quote>, or is equipped with a firearm silencer or firearm muffler</quote>; and</text></subparagraph><subparagraph id="H6D394341224F417DA59DC6E303D508B4"><enum>(B)</enum><text>in paragraph (1)(C)(ii), by striking <quote>or is equipped with a firearm silencer or firearm muffler,</quote>; and</text></subparagraph></paragraph><paragraph id="H52A929AF44B64D7FB41A3324CB867359"><enum>(2)</enum><text>in subsection (o), by striking <quote>or is equipped with a firearm silencer or muffler,</quote>.</text></paragraph></subsection><subsection id="H5603FCBDB62B4A4C9027AD34960F9D22"><enum>(c)</enum><header>Carrying of concealed firearms by qualified law enforcement officers</header><text>Section 926B(e)(3) of such title is amended—</text><paragraph id="H6FEF9708C49849A5A45C89FF846A1CD1"><enum>(1)</enum><text>in subparagraph (A), by adding <quote>and</quote> at the end;</text></paragraph><paragraph id="H04F1B162497B449283D20C826D80E1D4"><enum>(2)</enum><text>by striking subparagraph (B); and</text></paragraph><paragraph id="H3DF473DE487640D69149E2F0E0E73D61"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection><subsection id="H9615256163FF45E0B6CCA3637B99EB70"><enum>(d)</enum><header>Carrying of concealed firearms by qualified retired law enforcement officers</header><text>Section 926C(e)(1)(C) of such title is amended—</text><paragraph id="HFB8CC3C5E5C345899619D500C0F91C17"><enum>(1)</enum><text>in clause (i), by adding <quote>and</quote> at the end; and</text></paragraph><paragraph id="H9E60CFF70C714DCEB2A51397E045D6F8"><enum>(2)</enum><text>by striking clause (ii).</text></paragraph></subsection></section></legis-body></bill>
