<official-title display="yes">To amend the HOME Investment Partnerships Act to establish a Project Turnkey Program to leverage vacant hotels and motels for housing and enhance shelter capacity nationally, and for other purposes.</official-title>

<section id="H447174CD9816406EB712938EF7E9624C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Project Turnkey Act</short-title></quote>. </text></section> <section id="H5ED6444E946B473E87DC8AD868B30F2A"><enum>2.</enum><header>Project Turnkey Program</header><text display-inline="no-display-inline">Subtitle E of the HOME Investment Partnerships Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12821">42 U.S.C. 12821</external-xref>) is amended by adding at the end the following:</text>

<section id="HE038276565A5403BB8443F653C7918E2"><enum>272.</enum><header>Project Turnkey Program</header>
<subsection id="HB237631768E344ABB1EF769C58923A49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established a Project Turnkey Program through which the Secretary shall award amounts to eligible entities to use for eligible activities.</text></subsection> <subsection id="H46E1A6F2CA0542DEA97599036B16FA60"><enum>(b)</enum><header>Use of amounts by eligible entities</header> <paragraph id="H54C3DD4C1D174C6584765628800DF87E"><enum>(1)</enum><header>Administrative and planning costs</header><text display-inline="yes-display-inline">An eligible entity that receives amounts under this section may use not more than 15 percent of such amounts for administrative and planning costs.</text></paragraph>
<paragraph id="HF972F9C7542847278558F371778CAB62"><enum>(2)</enum><header>Operating expenses of other organizations</header>
<subparagraph id="HA9FEBE3A996D4796BAED73E1A57F88B7"><enum>(A)</enum><header>In general</header><text>An eligible entity that receives amounts under this section may use not more than 5 percent of such amounts to cover the operating expenses of community housing development organizations and nonprofit organizations carrying out activities authorized under this section.</text></subparagraph> <subparagraph id="H781DB594F0404D5FA6EB249EA20FD30E"><enum>(B)</enum><text>An eligible entity may only use amounts in the manner described in subparagraph (A) if—</text>
<clause id="H22DD067F8030406C9F686E667D707CE5"><enum>(i)</enum><text>such funds are used to develop the capacity of the community housing development organization or nonprofit organization in the jurisdiction or insular area to carry out activities authorized under this section; and </text></clause> <clause id="H1C6811B2927342C18E4F67183E476A2F"><enum>(ii)</enum><text>the community housing development organization or nonprofit organization complies with the limitation on assistance in section 234(b).</text></clause></subparagraph></paragraph>
<paragraph id="HD398880F25A34D0FBDAFA6BAF8DDA1A2" commented="no"><enum>(3)</enum><header>Contracting</header><text display-inline="yes-display-inline">A grantee, when contracting with service providers engaged directly in the provision of supportive services as defined by section 578.53 of title 24, Code of Federal Regulations shall, to the extent practicable, enter into contracts in amounts that cover the actual total program costs and administrative overhead to provide the services contracted.</text></paragraph></subsection> <subsection id="H3F34B620DAD44456B4BBB44D7B025CB6"><enum>(c)</enum><header>Subgrants</header><text>Any eligible entity that is a public entity may subgrant any amounts received under this section. </text></subsection>
<subsection id="HF8B64CE9BB79485FA1DF292EF21384E0"><enum>(d)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">As a condition of receiving amounts under this section, an eligible entity shall use such funds received under this section only to supplement the level of State or local funds that would, in the absence of the receipt of funds under this section, be made available for activities described in this section.</text></subsection> <subsection id="H1738AA5CF8874595BE0EACAF673D0C1C"><enum>(e)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts otherwise available under this Act, there is authorized to be appropriated to carry out this section $1,000,000,000 annually.</text></subsection>
<subsection id="HFBCDD1E6D5564579A38C6C1FA7CB4DA8"><enum>(f)</enum><header>Availability of amounts</header><text>Amounts appropriated pursuant to this section shall remain available until 2034.</text></subsection> <subsection id="HDBD5ABD535AB4142AFC5AB813CFD7239"><enum>(g)</enum><header>Allocation of amounts</header> <paragraph id="HB5EF05DD1E274206BFE9900A8E2C1B45"><enum>(1)</enum><header>Formula assistance</header><text display-inline="yes-display-inline">Except as provided in paragraphs (2) and (3), the Secretary shall allocate amounts appropriated under this section to grantees that received allocations under section 217 in fiscal year 2024.</text></paragraph>
<paragraph id="H05F6E19DC07046EC9DE0558883F4076B"><enum>(2)</enum><header>Technical assistance</header><text>$25,000,000 of any amounts appropriated under this section may be provided by the Secretary to be used to increase capacity building and technical assistance available to grantees receiving amounts under this section.</text></paragraph> <paragraph id="H5825E9EDD73A4D1091E93A622E96AFBA"><enum>(3)</enum><header>Administration</header><text>Not more than $50,000,000 of any amounts appropriated under this section may be used by the Secretary to cover costs related to the administration and implementation of this section.</text></paragraph>
<paragraph id="HB369F17F1B824C6888CA2F114392B731"><enum>(4)</enum><header>Waivers and alternative requirements</header><text>The Secretary may waive or specify alternative requirements for any provision of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12701">42 U.S.C. 12701 et seq.</external-xref>) and titles I and IV of the McKinney-Vento Homelessness Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11301">42 U.S.C. 11301 et seq.</external-xref>, 11360 et seq.) or regulation for the administration of the amounts made available under this section other than requirements related to fair housing, nondiscrimination, labor standards, and the environment, upon a finding that the waiver or alternative requirement is necessary to expedite or facilitate the use of amounts made available under this section. </text></paragraph></subsection> <subsection id="HDB7C1689F042490B8481DD6638D88032"><enum>(h)</enum><header>Special rules</header><text display-inline="yes-display-inline">The cost limits described in section 212(e), the commitment requirements described in section 218(g), the matching requirements described in section 220, and the set-aside for housing developed, sponsored, or owned by community housing development organizations required in section 231 shall not apply for any amounts appropriated under this section. </text></subsection>
<subsection id="H133EB72969D44BF0BDBB5AF48D7785E2" display-inline="no-display-inline"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H1B041EF3FE9047908DEF2FED0883F3A3"><enum>(1)</enum><header>Qualifying individual or family defined</header><text display-inline="yes-display-inline">The term <quote>qualifying individual or family</quote> means an individual or family that is—</text>
<subparagraph id="H6073E58EB4A34CA08D05FB00646650A1"><enum>(A)</enum><text>homeless, as such term defined in section 103(a) of the McKinney- Vento Homeless Assistance Act;</text></subparagraph> <subparagraph id="HB3018BE37DFB4609BA63673F7786C312"><enum>(B)</enum><text display-inline="yes-display-inline">at-risk of homelessness, as defined in section 401(1) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360(1)</external-xref>;</text></subparagraph>
<subparagraph id="HCD10425D0928420CA2281C95755F5557"><enum>(C)</enum><text display-inline="yes-display-inline">fleeing, or attempting to flee, domestic violence, dating violence, sexual assault, stalking, or human trafficking, as such terms are defined by the Secretary;</text></subparagraph> <subparagraph id="HA40441736542452495D38F69D0FEE7F6"><enum>(D)</enum><text display-inline="yes-display-inline">a homeless children or youth, as that term is defined in section 725 of McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>); or</text></subparagraph>
<subparagraph id="H432BFE368412464C8E670B317A6690B3"><enum>(E)</enum><text>a youth experiencing homelessness as that term is defined in section 38723 of the Runaway and Homeless Youth Act (<external-xref legal-doc="usc" parsable-cite="usc/34/11279">34 U.S.C. 11279</external-xref>).</text></subparagraph></paragraph> <paragraph id="H1ABF1545E50F4F5292FE29F563F07B7B"><enum>(2)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <quote>eligible entity</quote> means—</text>
<subparagraph id="H71AE30206BEE451CA029A4FE37924E9E"><enum>(A)</enum><text>a State, city, county, regional government, or territory government;</text></subparagraph> <subparagraph id="HC584DAD92E1A4803A48D5031CF19CF4F"><enum>(B)</enum><text>a public housing agency;</text></subparagraph>
<subparagraph id="H4EDBECD2DCDD4081BED7CA1D83044FA0"><enum>(C)</enum><text>a project sponsor receiving amounts under the Continuum of Care program under title IV of this Act, or any combination of such entities;</text></subparagraph> <subparagraph id="HE1A807D18E81441AA24AEB443F64D421"><enum>(D)</enum><text display-inline="yes-display-inline">a nonprofit that provides housing;</text></subparagraph>
<subparagraph id="H6B2F0823699044ACB7C09A2E2B499B06"><enum>(E)</enum><text>a Community Development Corporation; or </text></subparagraph> <subparagraph id="HFD49CB7FF8EC41DB9773559C02549976"><enum>(F)</enum><text>a Community Development Financial Institution.</text></subparagraph></paragraph>
<paragraph id="H0CF13007312F47C2AA19DA7E58FE6D18"><enum>(3)</enum><header>Eligible activity</header><text display-inline="yes-display-inline">The term <quote>eligible activity</quote> means—</text> <subparagraph id="HBDCF2880827547A1890F7F2C1E8E226B"><enum>(A)</enum><text display-inline="yes-display-inline">rental assistance, including—</text>
<clause id="H712E31737FE3451F9AC44EDD13FAD7F7"><enum>(i)</enum><text>providing rent payment assistance;</text></clause> <clause id="H2474ED2DEA1848449A9CDBA231EC0850"><enum>(ii)</enum><text>providing security deposit assistance;</text></clause>
<clause id="HF2655F3691AB4B9B8E24B70A470CF168"><enum>(iii)</enum><text>providing utility deposits and utility payments; and </text></clause></subparagraph> <subparagraph id="H8975FF6DBB884790A7C4C76CFFC96B0A"><enum>(B)</enum><text>any eligible use of investments described under section 212(a);</text></subparagraph>
<subparagraph id="HB36C83B2455A44FFBD482397E521A39E"><enum>(C)</enum><text>supportive services as defined in section 578.53 of title 24, Code of Federal Regulations including—</text> <clause id="H376600011E624579A285F573ACD894CD"><enum>(i)</enum><text>activities listed in section 401(29) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360(29)</external-xref>);</text></clause>
<clause id="HD9DA1A531FE745FEA7B805641B7A86C0"><enum>(ii)</enum><text>housing counseling; and</text></clause> <clause id="H9DC5218E8E9F492693ACEED9AEEAD3B6"><enum>(iii)</enum><text>homeless prevention services; </text></clause></subparagraph>
<subparagraph id="H070A779AF4624BABA8661CB1CFB1745C"><enum>(D)</enum><text>the acquisition, development, and operation of non-congregate shelter units or affordable rental housing;</text></subparagraph> <subparagraph id="H6DA809CBCC444F35AC561E26ECA1028E"><enum>(E)</enum><text display-inline="yes-display-inline">the rehabilitation, retrofitting, and conversion of newly acquired or vacant properties, including motels, hotels, schools, hospitals, and office buildings, for the purposes of providing affordable housing or shelter; </text></subparagraph>
<subparagraph id="H95948933A7954B2EACE269D1238214C4"><enum>(F)</enum><text display-inline="yes-display-inline">the repair and expansion of shelters and preservation of bed capacity; and</text></subparagraph> <subparagraph id="HD981CC4E2D634CCA9D2DE63F316D7BC7"><enum>(G)</enum><text>any other purpose as determined appropriate by the Secretary.</text></subparagraph></paragraph>
<paragraph id="H7F6B0B1BD006467C9032BBF73CBEE65F"><enum>(4)</enum><header>Hotel</header><text>The term <quote>hotel</quote> has the meaning given the term in section 301(7)(A) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181(7)(A)</external-xref>), that are no longer affecting commerce (as such term is defined in such section 301).</text></paragraph> <paragraph id="HA1BC4E13257047FB96DF109F813C7DFF"><enum>(5)</enum><header>Motel</header><text>The term <quote>motel</quote> has the meaning given the term in section 301(7)(A) of the Americans with Disabilities Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12181">42 U.S.C. 12181(7)(A)</external-xref>), that are no longer affecting commerce (as such term is defined in such section 301).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
