such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to provide for the public reporting of data on certain contributions received by tax-exempt organizations from foreign sources, and for other purposes.</official-title></form><legis-body id="H2EEEBD6610034F5E8C420772428B144E" style="OLC"><section id="HFBA018221BF0447D83155DC9EA0031AE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Donor Privacy and Foreign Funding Transparency Act</short-title></quote>.</text></section><section id="H90D26976F8F647EAB1510AF02FE22D4E"><enum>2.</enum><header>Annual disclosure of data on contributions received by tax-exempt organizations from foreign sources</header><subsection id="H9A7386D8124F4CE0BA073F328DFF368C"><enum>(a)</enum><header>Reporting requirement</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/6033">Section 6033</external-xref> of the Internal Revenue Code of 1986 is amended by redesignating subsection (o) as subsection (p) and by inserting after subsection (n) the following new subsection:</text><quoted-block style="OLC" id="H57C61A4165FF44A5A1B4F5773A41686F" display-inline="no-display-inline"><subsection id="H1D0F7DD535E1488F9B53C6B15421709A"><enum>(o)</enum><header>Contributions received from foreign sources</header><paragraph id="H05A9BE6386E84897B76483FF8690FD3E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Every organization described in section 501(c) which is required to file an annual return under subsection (a)(1) for any taxable year shall include in such return the following information with respect to contributions from a foreign source during such taxable year:</text><subparagraph id="HA5F6F2A9F22A4EC392C305E0720D4DCC"><enum>(A)</enum><text>Whether the organization accepted any such contributions.</text></subparagraph><subparagraph id="H025E53995CA7462AB67A55E9613A646D"><enum>(B)</enum><text>The aggregate amount of all such contributions received (if any).</text></subparagraph><subparagraph id="HB18BCF0A423A444A87C79AEA64B67304"><enum>(C)</enum><text>The country of citizenship or principal place of business (as the case may be) of any foreign source making such a contribution to the organization.</text></subparagraph><subparagraph id="H9C246472EA8148EEBE10CA267FBCFE24"><enum>(D)</enum><text>The aggregate amount of contributions received, grouped by source country.</text></subparagraph></paragraph><paragraph id="H7202F2F2074F4015B47BB011CA4354F6"><enum>(2)</enum><header>Definitions</header><text>For purposes of this subsection—</text><subparagraph id="H750254F4BF354DA3B6B03CBB8F50E95E"><enum>(A)</enum><header>Foreign source</header><text display-inline="yes-display-inline">The term <quote>foreign source</quote> means—</text><clause id="H60500A70BDCB4B07BDBB0F98A073E3D9"><enum>(i)</enum><text display-inline="yes-display-inline">any foreign principal (as defined in section 1 of the Foreign Agents Registration Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/22/611">22 U.S.C. 611</external-xref>), except that such term shall not include any individual if it is established that such individual is a citizen of the United States), and</text></clause><clause id="HBE45DC83F78A4ED8AE8D101AFCBCA5CA"><enum>(ii)</enum><text>any agent of a foreign principal (as defined in such section 1, determined by only treating foreign principals (within the meaning of clause (i) of this subparagraph) as foreign principals).</text></clause></subparagraph><subparagraph id="H15C1995A17ED4418805EACCB40E47467"><enum>(B)</enum><header>Source country</header><text>The term <quote>source country</quote> means the country of citizenship or principal place of business (as the case may be) of a foreign source.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3F594E22704A4ADEA85DD61AFB586C16"><enum>(b)</enum><header>Public disclosure</header><text>Section 6104 of such Code is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H516A3ADD209140049B75040187186209"><subsection id="H780926672B1D4B9A90940190FCEA1D52"><enum>(e)</enum><header>Public disclosure of certain information</header><text>The Secretary shall make publicly available in a searchable database the following information:</text><paragraph id="H797E72F178C247D092A2AD09D71299F0"><enum>(1)</enum><text>The information furnished under <external-xref legal-doc="usc" parsable-cite="usc/26/6033">section 6033(o)</external-xref> of the Internal Revenue Code of 1986. </text></paragraph><paragraph id="HC5599387114A4660A7BF9795F61ECA6E"><enum>(2)</enum><text>The name of the organization furnishing the information described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5A675B5E800349E78E1F26EA70F3ACCA"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to returns filed for taxable years beginning after the date of the enactment of this Act.</text></subsection></section><section id="H1A67CFBCCBAE493287020D1785D3BD37"><enum>3.</enum><header>Protecting privacy of donors to tax-exempt organizations</header><subsection id="H843AE67431384CBB96EEBF49C4872C08"><enum>(a)</enum><header>Restrictions on collection of donor information</header><paragraph id="HD703107583324EC096B7204A39E1F8BD"><enum>(1)</enum><header>Restrictions</header><text display-inline="yes-display-inline">An entity of the Federal Government may not collect or require the submission of information on the identification of any donor to a tax-exempt organization.</text></paragraph><paragraph id="HF5A3210B8FA6418EAC0CF5C3C64C20F7"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply to the following:</text><subparagraph id="H936C775A600648A3A93C570002F8065F"><enum>(A)</enum><text>The Internal Revenue Service, acting lawfully pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/6033">section 6033</external-xref> of the Internal Revenue Code of 1986 or any successor provision.</text></subparagraph><subparagraph id="H06DF82DC400946B5A1A60055AD94E08D"><enum>(B)</enum><text>The Secretary of the Senate and the Clerk of the House of Representatives, acting lawfully pursuant to section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>).</text></subparagraph><subparagraph id="H4183B9EA3EE04522A022392D866B6992"><enum>(C)</enum><text>The Federal Election Commission, acting lawfully pursuant to section 510 of title 36, United States Code.</text></subparagraph><subparagraph id="HE37BE178F6CA493D91AC6AC2D59BCDE9"><enum>(D)</enum><text display-inline="yes-display-inline">An entity acting pursuant to a lawful order of a court or administrative body which has the authority under law to direct the entity to collect or require the submission of the information, but only to the extent permitted by the lawful order of such court or administrative body.</text></subparagraph></paragraph></subsection><subsection id="H2A689C4773874D839555B444E98B4336"><enum>(b)</enum><header>Restrictions on release of donor information</header><paragraph id="HA2F95B1C5DDB4C63B15F6038E0E96981"><enum>(1)</enum><header>Restrictions</header><text>An entity of the Federal government may not disclose to the public information revealing the identification of any donor to a tax-exempt organization.</text></paragraph><paragraph id="HCC8D7E5E3B4E4AA38070FAA3397EDB61"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) does not apply to the following:</text><subparagraph id="H0AD0A962E9F74EC18B5D0A46A1022F17"><enum>(A)</enum><text>The Internal Revenue Service, acting lawfully pursuant to <external-xref legal-doc="usc" parsable-cite="usc/26/6104">section 6104</external-xref> of the Internal Revenue Code of 1986 or any successor provision.</text></subparagraph><subparagraph id="HFF831CF414AF4249A96E2677878F01A5"><enum>(B)</enum><text>The Secretary of the Senate and the Clerk of the House of Representatives, acting lawfully pursuant to section 3 of the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1604">2 U.S.C. 1604</external-xref>).</text></subparagraph><subparagraph id="H464A5433472C4EDAB97DF004D601D552"><enum>(C)</enum><text>The Federal Election Commission, acting lawfully pursuant to section 510 of title 36, United States Code.</text></subparagraph><subparagraph id="H3B49CA787C5F4F4485EECFB3D8AB52FD"><enum>(D)</enum><text display-inline="yes-display-inline">An entity acting pursuant to a lawful order of a court or administrative body which has the authority under law to direct the entity to disclose the information, but only to the extent permitted by the lawful order of such court or administrative body.</text></subparagraph><subparagraph id="H54559CEF42E147C7A0EAF74FE9FB28EF"><enum>(E)</enum><text>An entity which discloses the information as authorized by the organization.</text></subparagraph></paragraph></subsection><subsection id="H1F445B85C9E847F59976D6FAD5F40AA8"><enum>(c)</enum><header>Tax-Exempt organization defined</header><text display-inline="yes-display-inline">In this section, a <quote>tax-exempt organization</quote> means an organization which is described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)</external-xref> of the Internal Revenue Code of 1986 and exempt from taxation under section 501(a) of such Code. Nothing in this subsection may be construed to treat a political organization under section 527 of such Code as a tax-exempt organization for purposes of this section.</text></subsection><subsection id="H5F0704553055476B87C74B73007C9ADB"><enum>(d)</enum><header>Penalties</header><text display-inline="yes-display-inline">It shall be unlawful for any officer or employee of the United States, or any former officer or employee, willfully to disclose to any person, except as authorized in this section, any information revealing the identification of any donor to a tax-exempt organization. Any violation of this section shall be a felony punishable upon conviction by a fine in any amount not exceeding $250,000, or imprisonment of not more than 5 years, or both, together with the costs of prosecution, and if such offense is committed by any officer or employee of the United States, he shall, in addition to any other punishment, be dismissed from office or discharged from employment upon conviction for such offense.</text></subsection></section></legis-body></bill>
