<official-title display="yes">To require the Secretary of Homeland Security to establish a public blockchain-based system to securely store and share data related to border security, and for other purposes.</official-title>

<section id="HB2C3C658279E4AFC89EE44AA7FFA6968" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Border Security and Blockchain Technology Act</short-title></quote>.</text></section> <section id="HBAC99A77B4D14ECEAB7009535949391F"><enum>2.</enum><header>Blockchain technology for border apprehensions</header> <subsection id="H3BFED9ABC45B4B9E96C88AF46AD2112C"><enum>(a)</enum><header>Implementation</header> <paragraph id="H618D2F053D03459DB15B44A7C1D9845D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of the enactment of this Act, the Commissioner of U.S. Customs and Border Protection shall select a public blockchain platform that meets the agency’s needs and requirements, as set forth in the agency’s budgets for fiscal year 2017–2021.</text></paragraph> 
<paragraph id="HBEC9511DA8524A819B0562E60C798469"><enum>(2)</enum><header>Smart contracts</header><text>The Commissioner of U.S. Customs and Border Protection may develop smart contracts that may be used to securely store and share data related to border security.</text></paragraph> <paragraph id="H330D8CD1F9FC4076B5021E509078F885"><enum>(3)</enum><header>Integration</header><text>The Commissioner of U.S. Customs and Border Protection shall integrate existing systems, such as biometric data and travel documents, with the public blockchain platform selected under paragraph (1).</text></paragraph> 
<paragraph id="H1779F705103F4EC6BFB804098BBE1E9C" commented="no"><enum>(4)</enum><header>Data verification and integrity</header><text display-inline="yes-display-inline">The Commissioner of U.S. Customs and Border Protection shall utilize blockchain technology to ensure the integrity and immutability of data related to border security operations, including biometric data, visa information, and customs documentation.</text></paragraph> <paragraph id="H8114066D506E476F90630FBAFFD4B3AE" commented="no"><enum>(5)</enum><header>Enhanced interoperability</header><text display-inline="yes-display-inline">The Commissioner of U.S. Customs and Border Protection shall facilitate secure and efficient data exchange and interoperability between various Federal and international border control and immigration agencies, leveraging blockchain’s decentralized nature to enhance collaboration without compromising data security.</text></paragraph> 
<paragraph id="HA3462BF861E34C94B435463AC44C7406"><enum>(6)</enum><header>Data input</header><text>The platform shall be designed to input data in real-time from all relevant Federal Government agencies, including U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.</text></paragraph> <paragraph id="H2694F214D92448A8B49B57540BB2BE54" commented="no"><enum>(7)</enum><header>Applications</header><text>The public blockchain platform shall be utilized for the following applications to enhance border security operations:</text> 
<subparagraph id="H65B9166BB8A64F43980FB0CFF44A1EC2" commented="no"><enum>(A)</enum><header>Documentation Verification</header><text>The platform shall be utilized to securely verify the authenticity of travel and identity documents in real time, reducing fraud and streamlining the entry process.</text></subparagraph> <subparagraph id="H452E088314224C3B849FA499C1974634" commented="no"><enum>(B)</enum><header>Supply Chain Security</header><text display-inline="yes-display-inline">The platform shall be utilized to improve the tracking and management of goods through customs, enhancing transparency and efficiency in trade and commerce.</text></subparagraph> 
<subparagraph id="HF2C587A66D104449AF519B4481C09D19" commented="no"><enum>(C)</enum><header>Personnel Management</header><text display-inline="yes-display-inline">The platform shall be utilized to manage border control personnel deployment and operations securely and efficiently.</text></subparagraph> <subparagraph id="H5E28BD481681422B9922634533F8EC39" commented="no"><enum>(D)</enum><header>Real-Time Data Sharing</header><text display-inline="yes-display-inline">The platform shall be utilized to enable secure and instant data sharing among border control agencies, law enforcement, and other relevant government entities to enhance situational awareness and response times.</text></subparagraph></paragraph> 
<paragraph id="H4DA39A1DFAC24D7992A7E2B02A377891" commented="no"><enum>(8)</enum><header>Objectives</header><text>The implementation of the public blockchain platform aims to achieve the following objectives:</text> <subparagraph id="H71E27F6285AE454089C8BF54E9F12E06" commented="no"><enum>(A)</enum><header>Enhanced Security</header><text>The platform shall trengthen the security of border operations by leveraging blockchain’s immutable and encrypted record-keeping capabilities.</text></subparagraph> 
<subparagraph id="HF24D2FD53932422FBFC0A4BA841010BC" commented="no"><enum>(B)</enum><header>Improved Efficiency</header><text>The platform shall streamline border control processes through faster verification procedures and reduced manual data entry.</text></subparagraph> <subparagraph id="HA1866D091A8C425CB1701EEA9006600A" commented="no"><enum>(C)</enum><header>Increased Transparency</header><text>The platform shall provide a transparent and tamper-proof system for the management and oversight of border security operations.</text></subparagraph> 
<subparagraph id="HC85AFA196D854DCC8E7CED215B4F062B" commented="no"><enum>(D)</enum><header>Interagency Collaboration</header><text>The platform shall facilitate a higher degree of collaboration and data sharing among Federal agencies involved in border security.</text></subparagraph></paragraph></subsection> <subsection id="H85AB13995683442B9162923CD2EE52CD"><enum>(b)</enum><header>Oversight and evaluation</header><text>The Commissioner of U.S. Customs and Border Protection shall establish a system for oversight and evaluation of the implementation of public blockchain technology in border security, including the appointment of a project manager, regular reports to the relevant authorities and an independent evaluation of the project.</text></subsection> 
<subsection id="H4F69C4D9A18A47AB9610A083927603B7" commented="no"><enum>(c)</enum><header>Security</header><text>The platform shall be designed to ensure the security and confidentiality of sensitive information.</text></subsection> <subsection id="HB5FB0E35C3B54C0F957C7DC219D3CFA6"><enum>(d)</enum><header>Report to Congress</header> <paragraph id="H850656C93FBC4FB9B54730839D94188A"><enum>(1)</enum><header>In general</header><text>Not later than six months after the selection of a public blockchain platform under subsection (a)(1), the Secretary of Homeland Security shall submit to Congress a report on the implementation of the platform, including a description of the platform’s capabilities and any challenges encountered during implementation.</text></paragraph> 
<paragraph id="HB52EBE1221CE4094BF7CD9BB013300FF"><enum>(2)</enum><header>Annual report</header><text>Not later than one year after the submission of the report required under paragraph (1) and annually thereafter, the Secretary of Homeland Security shall submit to Congress a report on the ongoing operation and maintenance of the platform.</text></paragraph></subsection> <subsection id="H3C8657CF721E4691B0AB3F343474970B"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HFB5BD1044F77404182573DDEA25C4CF8"><enum>(1)</enum><header>Blockchain</header><text display-inline="yes-display-inline">The term <quote>blockchain</quote> means a distributed ledger technology that uses cryptography to secure and validate transactions and data.</text></paragraph> <paragraph id="HEAEABED1143C4FB6A26717FC8C364EB0"><enum>(2)</enum><header>Border apprehensions</header><text>The term <quote>border apprehensions</quote> means the arrest and detainment of individuals by Federal law enforcement officials for immigration violations at or near the United States border.</text></paragraph> 
<paragraph id="HB5F39F23E2F2429EB0090D42A7214450"><enum>(3)</enum><header>Border control agencies</header><text display-inline="yes-display-inline">The term <quote>border control agencies</quote> means U.S. Customs and Border Protection and any other Government agencies the Secretary of Homeland Security determines is involved in border security.</text></paragraph> <paragraph id="H37CD596556EA44BB8BF47AA504C42F1C"><enum>(4)</enum><header>Smart contract</header><text display-inline="yes-display-inline">The term <quote>smart contract</quote> means a self-executing contract with the terms of the agreement written into lines of code.</text></paragraph></subsection></section>
