<section id="HD07C838A04F44B3CA043361A5A533E4D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Air in the Cloud Act</short-title></quote>. </text></section> <section id="HB135D8C37DCB4EC2964F7F2FC4246102"><enum>2.</enum><header>Factors, operational analysis, and business case</header> <subsection id="H0419D7E650CA496D8EC64EC39EB723F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall, as described in the GAO report—</text> 
<paragraph id="HF148FB0127F54CBA9B74804FA7E48510"><enum>(1)</enum><text>identify factors for evaluating whether the information technology systems of the Environmental Protection Agency may be ready for replacement or retirement;</text></paragraph> <paragraph id="H34F46B12F1F44799AF562E4A8E5CA174" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">document an operational analysis for the AQS and AirNow; and</text> </paragraph> 
<paragraph id="H6E72E65469384DEE9A72D3EDA977CE56" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">develop and document a business case, in accordance with the System Life Cycle Management process of the Agency—</text> <subparagraph id="H5B87931EFF2643B8AD6B01F6A31BB4A5" commented="no"><enum>(A)</enum><text>for a new information technology system that manages and reports air quality data collected through the national ambient air quality monitoring system to replace the AQS and AirNow;</text> </subparagraph> 
<subparagraph id="H233CA9251A634964AB33D2814202F34E" commented="no"><enum>(B)</enum><text>that addresses issues with the AQS and AirNow; and</text></subparagraph> <subparagraph id="HF5A615397CAA49E88992E36FA9FBC00A" commented="no"><enum>(C)</enum><text>that details considerations of alternatives, if appropriate. </text> </subparagraph></paragraph></subsection> 
<subsection id="HA8FB71B11A3E45F2B4CA39FFF8CF16C8"><enum>(b)</enum><header>Report</header><text>Not later than 120 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a report describing the factors identified, the operational analysis documented, and the business case developed and documented, under subsection (a).</text> </subsection> <subsection id="HB77D76E41C2D498580AA7A42032668A9"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text> 
<paragraph id="HB384858277AD49D7AFF42E493469A937"><enum>(1)</enum><header>AirNow</header><text>The term <term>AirNow</term> means the information technology system of the Environmental Protection Agency that receives near real-time air quality data, primarily on ozone and particulate matter, that the Environmental Protection Agency reports to the public through a website and the AirNow app.</text></paragraph> <paragraph id="H110AD1CC8315493F981D197726CDA74C"><enum>(2)</enum><header>Air Quality System</header><text display-inline="yes-display-inline">The term <term>Air Quality System</term> means the repository of the Environmental Protection Agency for ambient air quality data that the Environmental Protection Agency uses for regulatory purposes.</text></paragraph> 
<paragraph id="H24D96DCC85FD45098771C6401AAABA9A"><enum>(3)</enum><header>AQS</header><text>The term <term>AQS</term> means the Air Quality System.</text></paragraph> <paragraph id="HC0DBB242370141B68BA706A1D1C34D70" commented="no"><enum>(4)</enum><header>GAO report</header><text display-inline="yes-display-inline">The term <term>GAO report</term> means the report of the Government Accountability Office to the Ranking Member, Subcommittee on Cybersecurity, Information Technology, and Government Innovation, Committee on Oversight and Accountability, House of Representatives, titled <quote>AIR POLLUTION: EPA Needs to Develop a Business Case for Replacing Legacy Air Quality Data Systems</quote> and dated September 2023 (GAO–23–105618).</text></paragraph></subsection></section>
