Short title

This Act may be cited as the Clean Air in the Cloud Act.

2.

Factors, operational analysis, and business case

(a)

In general

Not later than 90 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall, as described in the GAO report— (1)identify factors for evaluating whether the information technology systems of the Environmental Protection Agency may be ready for replacement or retirement; (2)document an operational analysis for the AQS and AirNow; and (3)develop and document a business case, in accordance with the System Life Cycle Management process of the Agency— (A)for a new information technology system that manages and reports air quality data collected through the national ambient air quality monitoring system to replace the AQS and AirNow; (B)that addresses issues with the AQS and AirNow; and (C)that details considerations of alternatives, if appropriate. (b)

Report

Not later than 120 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a report describing the factors identified, the operational analysis documented, and the business case developed and documented, under subsection (a). (c)

Definitions

In this Act: (1)

AirNow

The term AirNow means the information technology system of the Environmental Protection Agency that receives near real-time air quality data, primarily on ozone and particulate matter, that the Environmental Protection Agency reports to the public through a website and the AirNow app. (2)

Air Quality System

The term Air Quality System means the repository of the Environmental Protection Agency for ambient air quality data that the Environmental Protection Agency uses for regulatory purposes. (3)

AQS

The term AQS means the Air Quality System. (4)

GAO report

The term GAO report means the report of the Government Accountability Office to the Ranking Member, Subcommittee on Cybersecurity, Information Technology, and Government Innovation, Committee on Oversight and Accountability, House of Representatives, titled AIR POLLUTION: EPA Needs to Develop a Business Case for Replacing Legacy Air Quality Data Systems and dated September 2023 (GAO–23–105618).
