<section id="H5988C7A7AF4B4209A1B30600C997DB82" commented="no" section-type="section-one"><enum>1.</enum><header>Removing the in-person requirements under medicare for mental health services furnished through telehealth and telecommunications technology</header> 
<subsection id="H33843E412DCB4BAA9BCC83EC84CA36EB"><enum>(a)</enum><header>Removing in-Person requirements for mental health services furnished through telehealth</header><text display-inline="yes-display-inline">Section 1834(m)(7) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(m)(7)</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" id="H6E4962BF36E24ED1817773CD292DF81A" display-inline="no-display-inline"> <paragraph id="HD416D64443A8455A8E3635862B32D2E0"><enum>(7)</enum><header>Treatment of substance use disorder services and mental health services furnished through telehealth</header><text display-inline="yes-display-inline">The geographic requirements described in paragraph (4)(C)(i) shall not apply with respect to telehealth services furnished on or after July 1, 2019, to an eligible telehealth individual with a substance use disorder diagnosis for purposes of treatment of such disorder or co-occurring mental health disorder, as determined by the Secretary, or, on or after the first day after the end of the emergency period described in section 1135(g)(1)(B), to an eligible telehealth individual for purposes of diagnosis, evaluation, or treatment of a mental health disorder, as determined by the Secretary, at an originating site described in paragraph (4)(C)(ii) (other than an originating site described in subclause (IX) of such paragraph) or, for the period for which clause (iii) of paragraph (4)(C) applies, at any site described in such clause.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4893C358FE7B4D7DB349F85D83E19559"><enum>(b)</enum><header>Mental health visits furnished by rural health clinics</header><text>Section 1834(y) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(y)</external-xref>) is amended—</text> <paragraph id="H209124ABA6254161BA586E843BB9CA65"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">to hospice patients</header-in-text></quote>; and</text></paragraph> 
<paragraph id="H3C39B1B2AD69442089D491E8FC7BA769"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>prior to the day that is the 152nd day after the end of the emergency period described in section 1135(g)(1)(B))</quote>.</text></paragraph></subsection> <subsection id="H4102FF405FC244988C714FAB11B89FF4"><enum>(c)</enum><header>Mental health visits furnished by federally qualified health centers</header><text>Section 1834(o)(4) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395m">42 U.S.C. 1395m(o)(4)</external-xref> is amended—</text> 
<paragraph id="H016ACEF1D5AD4A2680B8117B34A0E62B"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">to hospice patients</header-in-text></quote>; and</text></paragraph> <paragraph id="H39F1EFDF2C754EFF816D9039D9E8169B"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking <quote>prior to the day that is the 152nd day after the end of the emergency period described in section 1135(g)(1)(B))</quote>.</text></paragraph></subsection></section>
