R. 8161</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240429">April 29, 2024</action-date><action-desc><sponsor name-id="N000189">Mr. Newhouse</sponsor> (for himself, <cosponsor name-id="F000469">Mr. Fulcher</cosponsor>, <cosponsor name-id="B000668">Mr. Bentz</cosponsor>, and <cosponsor name-id="R000103">Mr. Rosendale</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of the Interior and the Secretary of the Army from retiring an energy generation source if that retirement would raise customer electricity rates and decrease regional energy reliability by more than 10 percent, and for other purposes.</official-title></form><legis-body id="H77B825855F854DE2B341FD6D8B42DC91" style="OLC"><section id="HF5473670228B40D79E0BCA7AD8D9430F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electric Act</short-title></quote>.</text></section><section id="H23A4D1E7E70E4DD9B4553F12A29832F0"><enum>2.</enum><header>Prohibition on retirement of energy generation sources</header><subsection id="HAC4F57038E9A46BCBA1974B638D3BC06"><enum>(a)</enum><header>Prohibition</header><paragraph id="H25CE9E281D344D9EA3A7C3D200E1CAC5"><enum>(1)</enum><header>In general</header><text>The Secretary shall not retire an energy generation source if the retirement of that energy generation source would—</text><subparagraph id="HAFB9039DD38142DAA099AD96058DF041"><enum>(A)</enum><text>raise customer electricity rates by more than 10 percent; or</text></subparagraph><subparagraph id="HDCA84238F7DE41A486AB1B6E99032073"><enum>(B)</enum><text display-inline="yes-display-inline">decrease energy reliability, as determined by the Administrator of the Bonneville Power Administration, in any portion of Washington, Oregon, Idaho, Montana, Wyoming, and California by more than 10 percent of the energy reliability as compared to the 12-month period before the retirement.</text></subparagraph></paragraph><paragraph id="H2ED7DFBA22404BD294880A536B53190C"><enum>(2)</enum><header>Safety exception</header></paragraph></subsection><subsection id="H1012A91C803B44199E55333A9B3F0D9D"><enum>(b)</enum><header>Replacement of Baseload Generation</header><text display-inline="yes-display-inline">Not later than 30 days after retiring an energy generation source, the Secretary shall ensure that not less than 100 percent of the baseload generation of the retired energy generation source has been replaced. </text></subsection><subsection id="H58562D7114EE4A1C8F4132CE22FADB35"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H2A79045311794006B0F559C566AC00D6" commented="no"><enum>(1)</enum><header>Baseload generation</header><text display-inline="yes-display-inline">The term <term>baseload generation</term> means the the minimum amount of electric power supplied to an electrical grid.</text></paragraph><paragraph id="H018C90ADA0FE4089B7C32A9A331A17C7"><enum>(2)</enum><header>Energy generation source</header><text display-inline="yes-display-inline">The term <term>energy generation source</term> means a federally operated dam that generates hydropower.</text></paragraph><paragraph id="H8B9DC65902634EF6A1A4CEBF7E22AE6C"><enum>(3)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means—</text><subparagraph id="H6FE4FDA186534C2DA62E7795EE9D5CFE"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary of the Interior, in reference to an energy generation source operated by the Bureau of Reclamation; and</text></subparagraph><subparagraph id="H53B60A68409F477F94F676AD1812F705"><enum>(B)</enum><text display-inline="yes-display-inline">the Secretary of the Army, in reference to an energy generation source operated by the Army Corps of Engineers.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
