which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program for States that adopt the Uniform Partition of Heirs Property Act, and for other purposes.</official-title></form><legis-body id="HA6A9AE8E1B70403D94CB296C7C5F704A" style="OLC"><section id="H2957F2EA9A844E7BBBDFB28B7A23E60E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Heirs Estate Inheritance Resolution and Succession Act of 2024</short-title></quote> or the <quote><short-title>HEIRS Act of 2024</short-title></quote>. </text></section><section id="HC5C44309DA9D43C3AF604B552E65BDF9"><enum>2.</enum><header>Grants for eligible entities that adopt the Uniform Partition of Heirs Property Act</header><subsection id="H3E4B141A5EC840F19C9740648FFA5A68"><enum>(a)</enum><header>In general</header><text>The Secretary of Housing and Urban Development shall, not later than 1 year after the date of the enactment of this section, establish a grant program that provides amounts to eligible entities that—</text><paragraph id="H05D2DC9D8DD044EBBCF70748D1B28F5E"><enum>(1)</enum><text display-inline="yes-display-inline">before the date of the enactment of this section, had enacted or adopted the Uniform Partition of Heirs Property Act as approved and recommended for enactment in all the States by the National Conference of Commissioners on Uniform State Laws in 2010 or a similar law that the Secretary determines is a substantial equivalent; and</text></paragraph><paragraph id="H6C8F5B541D304FD49A4F0B1AE273EB72"><enum>(2)</enum><text>on or after the date of the enactment of this section, enact or adopt the Uniform Partition of Heirs Property Act as approved and recommended for enactment in all the States by the National Conference of Commissioners on Uniform State Laws in 2010 or a similar law that the Secretary determines is a substantial equivalent.</text></paragraph></subsection><subsection id="H99296C8FAF2B42508EDBDA63601EAFF3"><enum>(b)</enum><header>Use of amounts</header><paragraph id="H099DD586B03F42A6B9329F1A4AF4B070"><enum>(1)</enum><header>In general</header><text>Each eligible entity that receives amounts under this section shall use such amounts to assist residents of such eligible entity with bona fide expenses relating to establishing and documenting property ownership rights or settling a decedent’s estate, including fees and costs related to obtaining title reports and title abstracts, copies of public records, land surveys, estate planning, heirs search or tracing services, recording and filing fees, notary fees, and legal fees and expenses.</text></paragraph><paragraph id="H8461EEBB70D843EE8B2811D0E2509EB9"><enum>(2)</enum><header>Layering of assistance</header><text display-inline="yes-display-inline">An eligible entity that receives amounts under this section may use such amounts to assist residents of such State who are receiving assistance from other sources, including Federal, State, local, private, public, and nonprofit sources. </text></paragraph></subsection><subsection id="H1A6CB987EC734B6FAFD979B4084BF774"><enum>(c)</enum><header>Regulations and criteria for selection</header><text>The Secretary shall, not later than 1 year after the date of the enactment of this section, issue a rule to carry out this section, that includes criteria for the selection of recipients.</text></subsection><subsection id="H5139A3EB714345ADA2CB9B14CBA81194"><enum>(d)</enum><header>Authorization of appropriations</header><paragraph id="H2AFEACE6C1544C0896C4092BA867661C"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary of Housing and Urban Development $30,000,000 each of year fiscal years 2025 through 2035 to carry out this section.</text></paragraph><paragraph id="HE40A3562EFF0426DBD0CB89966CA3B80"><enum>(2)</enum><header>Availability</header><text>Any amounts appropriated under this subsection shall remain available until expended.</text></paragraph></subsection><subsection id="H9E0294F00BB84A059FAAD8F0D7208AA6"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HE39B01D1F18E4DF0BFCD0D0DB528734B"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Housing and Urban Development. </text></paragraph><paragraph id="H8DD15625A1AC49CC86D3F8FF466C2ACA"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a <quote>State</quote> and a <quote>unit of general local government</quote> as such terms are defined in section 102 of title 1 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302</external-xref>) a territory, or a Tribal government.</text></paragraph></subsection></section><section id="H4A30AC279CD74498B68F20F1F093B373" commented="no"><enum>3.</enum><header>Grants to provide assistance relating to heirs’ property resolution</header><subsection id="HD2BB55D7EE794ED09D484D8DEC805312" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Housing and Urban Development shall carry out a program under this section to provide grants each year to eligible entities to use to provide housing counseling, legal assistance, and financial assistance related to title clearing and home retention efforts for owners of heirs’ property.</text></subsection><subsection id="H33533DAE02714D5EA860BB130AC8F3C0" commented="no"><enum>(b)</enum><header>Awards</header><text display-inline="yes-display-inline">The Secretary shall consider the following when awarding grants under this section:</text><paragraph id="H7B696F2FF5364298AF36778544A971E4" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Whether the eligible entity has a proven track record of—</text><subparagraph id="HFDD31DC40A4F4C3C85073ABDEAE6C320"><enum>(A)</enum><text>providing assistance to homeowners;</text></subparagraph><subparagraph id="HF333557FCC97444FB681731D2AECB9D4"><enum>(B)</enum><text>targeting services to minority and low- and moderate-income persons; and</text></subparagraph><subparagraph id="H1BDAFB02C7E046A9B04BE4FFD221A421"><enum>(C)</enum><text>providing services in neighborhoods that have a high concentrations of minority persons or low- and moderate-income persons.</text></subparagraph></paragraph><paragraph id="HF132735CB20B4F7CBCB4B854B0AB63E5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Whether the eligible entity has planned or existing partnerships with other eligible entities.</text></paragraph><paragraph id="H3F7BEF856E3C480BA7AD47CC74A06F52" commented="no"><enum>(3)</enum><text>Whether the eligible entity is located in an area with a high number of owners of heirs’ property, as determined by the Secretary.</text></paragraph></subsection><subsection id="H1BC21F7454A146A3B11263A64BF99825"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary, for grants under this section, $10,000,000 in each of fiscal years 2025 through 2029.</text></subsection><subsection id="HF79ED9A68F334FA79623E7842A126E9F" commented="no"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text><paragraph id="HDC718CE865F34F5A9F20F903464B8F07"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means—</text><subparagraph id="H5DFCD70C81344A3AA651D2D9D68DF5B6"><enum>(A)</enum><text display-inline="yes-display-inline">a HUD approved housing counseling agency;</text></subparagraph><subparagraph id="HE8AD0CDFEC4949A0ADEF6482E7AE49B0"><enum>(B)</enum><text>a legal services clinics operated by an institute of higher education; or </text></subparagraph><subparagraph id="H1DD97F28ABAC41009D1376C3644F6AB0"><enum>(C)</enum><text>a qualifiying nonprofit.</text></subparagraph></paragraph><paragraph id="HC9CEE4217BF64F7C91BD5CA5B81D13C6" commented="no"><enum>(2)</enum><header>Heirs’ property</header><text display-inline="yes-display-inline">The term <term>heirs’ property</term> means residential property for which title passed by operation of law through intestacy and is held by two or more heirs as tenants in common.</text></paragraph><paragraph id="H1D73D555762E41A9AB5E5CE74C998AD5"><enum>(3)</enum><header>Hud approved housing counseling agency</header><text display-inline="yes-display-inline">The term <term>HUD approved housing counseling agency</term> means a housing counseling agency found eligible to receive assistance by the Department of Housing and Urban Development under section 106(a)(2) of the Housing and Urban Development Act of 1968.</text></paragraph><paragraph id="H2D58FDB1F68840EFA5C91BE8707006F0" commented="no"><enum>(4)</enum><header>Low- and moderate-income persons</header><subparagraph id="H83A8ABCD225A4640AE13A8540076FF1A"><enum>(A)</enum><header>In general</header><text>The term <term>low- and moderate-income persons</term> means a person whose household income does not exceed 120 percent of the median income for the area, as determined by the Secretary, within which—</text><clause id="H1B8C5E3CE99F4545805A297DA47188E4" commented="no"><enum>(i)</enum><text>the heirs’ property which respect to which the homeowner is seeking assistance is located; or</text></clause><clause id="HBDB884CFC03A43BF8CE8B97B44DC2F0E"><enum>(ii)</enum><text>the place of residence of the homeowner is located. </text></clause></subparagraph><subparagraph id="HFF6340DF2B5B4B72B367744AB670F77A"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">If the area described in subparagraph (A) is a high-cost area, as determined by the Secretary, the term <term>low- and moderate-income persons</term> means a homeowner whose household income does not exceed 140 percent of the median income for the area. </text></subparagraph></paragraph><paragraph id="H6A0EFC27A3D74E03B39E81DB303A397B"><enum>(5)</enum><header>Qualifying nonprofit</header><text display-inline="yes-display-inline">The term <term>qualifying nonprofit</term> means a nonprofit, mission-driven entity that, as determined by the Secretary—</text><subparagraph id="H3691A522AA7544ACB88A2104C22C3896"><enum>(A)</enum><text>has a track record of providing assistance to homeowners;</text></subparagraph><subparagraph id="H5B375CA5DBA2410BBDA09CDC9AB2285D"><enum>(B)</enum><text>targets services to minority and low- and moderate-income persons; or</text></subparagraph><subparagraph id="HC447DF08183246EA84806F7D7CA80FAE"><enum>(C)</enum><text>provides services in neighborhoods that have high concentrations of minority persons and low- and moderate-income persons.</text></subparagraph></paragraph><paragraph id="HEC3A7673EBC44F5D8547F2552770C33C"><enum>(6)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection></section><section id="H820715D3B6484A35AE77E2EA248AC289" commented="no"><enum>4.</enum><header>Heirs’ property housing counseling</header><text display-inline="no-display-inline">Section 106(g) of the Housing and Urban Development Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/12/1701x">12 U.S.C. 1701x(g)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HF631E02536E446419A69640CAC5230AB"><paragraph id="H8B5EBB61B190473C996C17B214777F75" commented="no"><enum>(6)</enum><header>Counseling with respect to heirs’ property</header><subparagraph id="HE8A42D73D3C84E38872570833DDB0C28" commented="no"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any nonprofit organization that receives amounts under this section shall, when providing homeownership counseling services to consumers—</text><clause id="H2C431AD66449429AB86DFABF49006984"><enum>(i)</enum><text display-inline="yes-display-inline">explain to such consumer what heirs’ property is, the risks associated with heirs’ property, and how to avoid heirs’ property issues; and</text></clause><clause id="H7BB754EDF9F24CECB1A28E47797F0C14"><enum>(ii)</enum><text display-inline="yes-display-inline">inform consumers of all available estate planning and title clearing options, assistance, and services, including those offered under sections 2 and 3 of the Heirs Estate Inheritance Resolution and Succession Act of 2024.</text></clause></subparagraph><subparagraph id="HE7C6FF4119974730B9F367FBF7EB5B88" commented="no"><enum>(B)</enum><header>Referral</header><text display-inline="yes-display-inline">The Secretary shall ensure that each nonprofit organization that receives amounts under this section knows how to refer consumers, where appropriate, to mission-driven nonprofit organizations and legal services clinics operated by institutes of higher education that are capable of assisting a consumer to clear title and with general estate planning. </text></subparagraph><subparagraph id="HCA198DA1F9DB47C8B3250ECDF7166C47" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Heirs’ property</header><text display-inline="yes-display-inline">The term <term>heirs’ property</term> means residential property for which title passed by operation of law through intestacy and is held by two or more heirs as tenants in common.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
