R. 8123</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240423">April 23, 2024</action-date><action-desc><sponsor name-id="P000034">Mr. Pallone</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Food, Drug, and Cosmetic Act to establish new prohibited acts relating to dietary supplements.</official-title></form><legis-body id="HD581DA4CCA9A4D0BBEED3EED01C16C93" style="OLC"><section id="H458D52CCA6024B9E96895652BB0C9D1F" section-type="section-one"><enum>1.</enum><header>New prohibited acts relating to dietary supplements</header><subsection id="HC9B15B6BB889410EADE7E6DCEC7EBC6B"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 301 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/331">21 U.S.C. 331</external-xref>) is amended by adding at the end the following: </text><quoted-block style="traditional" id="H6F4214276EF946A48793B0502E8D536E" display-inline="no-display-inline"><subsection id="H147421A163594DEE96422E2B62C744A3"><enum>(jjj)</enum><text display-inline="yes-display-inline">The introduction or delivery for introduction into interstate commerce of any product marketed as a dietary supplement that does not meet the definition of a dietary supplement under section 201(ff).</text></subsection><subsection id="H0D3D7A72099C4EBC967AA01B2D7664C1"><enum>(kkk)</enum><text display-inline="yes-display-inline">The introduction or delivery for introduction into interstate commerce of a dietary supplement that has been prepared, packed, or held using the assistance of, or at the direction of, a person debarred under section 306.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7569584576C146CD811D056B9849AA30"><enum>(b)</enum><header>New import exclusion</header><text>Section 801(a) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/381">21 U.S.C. 381(a)</external-xref>) is amended in paragraph (3) of the third sentence, by striking <quote>section 301(ll)</quote> and inserting <quote>paragraph (ll), (jjj), or (kkk) of section 301</quote>.</text></subsection><subsection id="HAC558CD621574814A7ADF2CE43CEAE39"><enum>(c)</enum><header>New seizure authorities</header><text>Section 304 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/334">21 U.S.C. 334</external-xref>) is amended—</text><paragraph id="H5DA6DA4A0F1D4B0B813F25D8A09843D1"><enum>(1)</enum><text>in subsection (a)(1), in the first sentence, by striking <quote>section 301(ll)</quote> and inserting <quote>paragraph (ll), (jjj), or (kkk) of section 301</quote>; and</text></paragraph><paragraph id="H800DE6EEBE3A47BE828F6BA9F725E7CD"><enum>(2)</enum><text>in subsection (d)(1), in the first sentence, by striking <quote>or cosmetic</quote> and inserting <quote>cosmetic, or product in violation of paragraph (jjj) or (kkk) of section 301</quote>.</text></paragraph></subsection></section></legis-body></bill>
