which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food Security Act of 1985 to improve wildlife habitat connectivity and wildlife migration corridors, and for other purposes.</official-title></form><legis-body id="H5273310E9FA14531816A5FF80BE6915D" style="OLC"><section id="HBA3B930A9A7D4F8D8B4804C4CF45DE5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Habitat Connectivity on Working Lands Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H7282A198AE724C26ABBD832B406F2DBD"><enum>2.</enum><header>Conservation programs</header><subsection id="H51E11AEA049745FF89A21B1F53090D77"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1240A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-1">16 U.S.C. 3839aa–1</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H46337506D96F42A882E8CBAFE75C525F" display-inline="no-display-inline"><paragraph id="HECAEDC6CCBBB431CB8B81CDFD6D2CF96"><enum>(11)</enum><header>Habitat connectivity</header><text display-inline="yes-display-inline">The term <term>habitat connectivity</term> means the degree to which landscape or habitat elements facilitate native species movement among seasonal habitats.</text></paragraph><paragraph id="HACF3CBA327F340769FE3A81635E02DA0"><enum>(12)</enum><header>Big game species</header><text>The term <term>big game species</term> means native species of large mammals including, wild deer, elk, pronghorn, wild sheep, and moose.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="HB294366C60DC4C33AD142760DDDDD083"><enum>(b)</enum><header display-inline="yes-display-inline">Regional Conservation Partnership Program critical conservation areas</header><text>Section 1271F(a)(2)(C) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3871f">16 U.S.C. 3871f(a)(2)(C)</external-xref>) is amended by inserting <quote>, including restoration and enhancement of wildlife habitat connectivity and wildlife migration corridors, with a focus on big game species</quote> before <quote>; and</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4589801B4AFC49B19A64B8A29B97EA4C"><enum>(c)</enum><header>Enrollment in the environmental quality incentives program and the conservation stewardship program of grassland enrolled in the conservation reserve program</header><paragraph commented="no" display-inline="no-display-inline" id="H01AC98F2EA8C4039BB75117F51E57F7D"><enum>(1)</enum><header display-inline="yes-display-inline">Environmental quality incentives program</header><text>Section 1240B(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2(d)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7A4C52DAEC194DCEA7EFB1C3A9AA45CD"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>A producer</quote> and inserting <quote>Except as provided in paragraph (8), a producer</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE8BECDA88AE3482188D5219C68FA4886"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEEA589C0BD614609BCA366FDE1CAFB9A"><paragraph commented="no" display-inline="no-display-inline" id="HD1C01FF2D1B0429E8B076302B0291A96"><enum>(8)</enum><header>Cost-share payments for grassland enrolled in the conservation reserve program</header><subparagraph commented="no" display-inline="no-display-inline" id="HB25A3F1227214579B073A8D03ADACD6F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide payments under the program for costs associated with planning, design, materials, equipment, installation, labor, management, maintenance, or training with respect to eligible land that is—</text><clause commented="no" display-inline="no-display-inline" id="HD2932231FF7C40B5AC81E37D09426761"><enum>(i)</enum><text display-inline="yes-display-inline">enrolled in the conservation reserve program under section 1231(d)(2)(A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H51F92AC4381C46C29C9B553CC3275BAE"><enum>(ii)</enum><text display-inline="yes-display-inline">of ecological significance, as described in section 1231(d)(2)(B)(iii).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCE6730991F014F7EB0AE9981490FBD6B"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">A producer shall not be eligible for payments under subparagraph (A) for practices if the producer receives payments or other benefits for the same practice on the same land under another Federal program (other than the conservation reserve program under subchapter B of chapter 1).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8101E90B2A1640C5A1FBC170DB8BDA79"><enum>(2)</enum><header>Conservation stewardship program</header><text>Section 1240J(b) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-22">16 U.S.C. 3839aa–22(b)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4EEE982E532044438595AF6CCBCAF735"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>and except as provided in paragraph (3),</quote> after <quote>paragraph (2),</quote>; and</text></subparagraph><subparagraph id="H9F97CDC51539468AA6099A3736D9FD44"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H26FC4EED3B484A36B929E25ACB96C082"><paragraph commented="no" display-inline="no-display-inline" id="H7DC32BA3EF374D04B1D0B415DF74F4D7"><enum>(3)</enum><header>Cost-share payments for grassland enrolled in the conservation reserve program</header><subparagraph commented="no" display-inline="no-display-inline" id="HE02212A347134843BC26F51D5C1B8E07"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may provide payments under the program for costs associated with planning, design, materials, equipment, installation, labor, management, maintenance, or training with respect to eligible land that is—</text><clause commented="no" display-inline="no-display-inline" id="HF8B849B3BAF540D08F221218D37ED601"><enum>(i)</enum><text display-inline="yes-display-inline">enrolled in the conservation reserve program under section 1231(d)(2)(A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8C0A13E7AAE44FE3B29F76CEC5DA532D"><enum>(ii)</enum><text display-inline="yes-display-inline">of ecological significance, as described in section 1231(d)(2)(B)(iii).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H80D29A33996A4B068C67C98BBCAD818E"><enum>(B)</enum><header>Limitation</header><text display-inline="yes-display-inline">A producer shall not be eligible for payments under subparagraph (A) for conservation activities if the producer receives payments or other benefits for the same conservation activities on the same land under another Federal program (other than the conservation reserve program under subchapter B of chapter 1).</text></subparagraph><subparagraph id="HD650464F9E924DA2BC053986309079B2"><enum>(C)</enum><header>Emergency grazing and haying access preserved</header><text display-inline="yes-display-inline">No priority resource concern, practice, or incentive pertaining to restoration and enhancement of wildlife habitat connectivity and wildlife migration corridors on the acres described above will prevent or alter emergency grazing and haying access for grassland acres enrolled in the conservation research program.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1ADF74880D8B44028B158708307EFA26"><enum>(3)</enum><header>Payment limitation for rental payments under the conservation reserve program</header><text>Section 1234(g)(1) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3834">16 U.S.C. 3834(g)(1)</external-xref>) is amended by striking <quote>$50,000</quote> and inserting <quote>$125,000</quote>.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H098770D8C5094D6E9334F5BA2DB4BC16"><enum>(d)</enum><header>Increased payments under the environmental quality incentives program</header><text>Section 1240B(d) of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-2">16 U.S.C. 3839aa–2(d)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="HD5C70BEB79BF4A099199CB229916A9CC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3)(F), by inserting <quote>and wildlife habitat connectivity</quote> before <quote>; or</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8EB2AB7B65504F578E0C6A74E63DB899"><enum>(2)</enum><text>in paragraph (7)(A)—</text><subparagraph commented="no" display-inline="no-display-inline" id="HFFE5B875A0754072A6D8623CDFF1CF22"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (iii), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B8E9C784C1142F99410A52A82586E6B"><enum>(B)</enum><text>in clause (iv), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H44B47B85D2864600BBD7FA267547C69F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBFBB484532F7419BBF7BBA35947A424F"><clause id="H5EEEA360E0E74EE4A4DA3AAD3BE92C08"><enum>(v)</enum><text>addresses the conservation and restoration of wildlife habitat, including wildlife habitat connectivity and wildlife migration corridors.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H2F118DA78ED947689E5DD4962CC42A52"><enum>(e)</enum><header>Conservation practice standards</header><text>Section 1242 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3842">16 U.S.C. 3842</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7A92E7338165497CB52A3EB47C128418"><subsection id="HA50A8666717C4082A5FA7AC14A32C5E7"><enum>(j)</enum><header>Addressing barriers to habitat connectivity</header><paragraph id="HC1C5D04F3DE34DCBB403B49DA87EB177"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="HEF2893DDC0634E2E8F88878C2545AB45"><enum>(A)</enum><text>to the maximum extent practicable, fully incorporate nonstructural methods to control livestock distribution, such as virtual fencing, into the conservation practice standards; and</text></subparagraph><subparagraph id="HAFE9BDA92EFE456F9A6EAEE4A8FF4A70"><enum>(B)</enum><text>provide for the appropriate range of conservation practices and resource mitigation measures available to landowners using nonstructural methods described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H3CC07837C51A4A3FA0A6B7E26B9B6396"><enum>(2)</enum><header>Availability of adequate technical assistance</header><text>The Secretary shall ensure that adequate technical assistance is available for the implementation of—</text><subparagraph commented="no" display-inline="no-display-inline" id="HC846C56C2D304E70BE8D1E37FDE64AD1"><enum>(A)</enum><text display-inline="yes-display-inline">nonstructural methods described in paragraph (1)(A); and </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H17EC9B9827C14AE292DD8DA2AEA0FD59"><enum>(B)</enum><text display-inline="yes-display-inline">other practices that support habitat connectivity (as that term is defined in section 1240A) through Federal conservation programs.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9FC7976FC4814727A863258B559A2D7E"><enum>(f)</enum><header>Administrative requirements for conservation programs</header><text>Section 1244 of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3844">16 U.S.C. 3844</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H224E7F69AA2C4DB2AEAC46CF62DFB42F"><subsection id="HA54B5C4B89054B308C9A11379A2CFFE9"><enum>(q)</enum><header>Encouragement of habitat connectivity and big game corridors</header><text>In carrying out any conservation program administered by the Secretary, the Secretary may, as appropriate, encourage—</text><paragraph id="H46F3CF2EE38E444DB4736EEE546A9444"><enum>(1)</enum><text>the conservation of landscape corridors and hydrologic connectivity, where native big game species (as that term is defined in section 1240A) and ecological processes can transition from one habitat to another, in order to conserve native biodiversity and ensure resiliency against impacts from a range of stressors; and</text></paragraph><paragraph id="H7C0337EF5EEF4E088A21FAE930152B69"><enum>(2)</enum><text>the use of conservation practices that support the development, restoration, and maintenance of landscape corridors and hydrologic connectivity.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HF30190FD26B84EF489622689E55A99BA"><enum>3.</enum><header>High-priority research and extension areas</header><text display-inline="no-display-inline">Section 1672(d) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/5925">7 U.S.C. 5925(d)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7B0987F263DD4DF49E216FAFC65B5DC7"><paragraph id="HBE081F0F8D2B4BA2801BFE5E19346B7D"><enum>(21)</enum><header>Virtual fencing</header><text>Research and extension grants may be made under this section for the purposes of—</text><subparagraph id="H7F4E5983B13F4A4EB851A8FB9690B8D5"><enum>(A)</enum><text>understanding and addressing the barriers to the adoption of virtual fencing technology; and</text></subparagraph><subparagraph id="H76C11869A4F64A078426DD2540BCEFB3"><enum>(B)</enum><text>studying the effects of virtual fencing technology on natural and cultural resources, such as—</text><clause id="HBBDF1652532A466F9FDC6D3CE4476E8D"><enum>(i)</enum><text>sensitive riparian areas; and</text></clause><clause id="H15D1BEDEF8F74B49835714ECDB9BA46A"><enum>(ii)</enum><text display-inline="yes-display-inline">crucial winter range and stopover habitats for native big game species (as that term is defined in section 1240A of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839aa-1">16 U.S.C. 3839aa–1</external-xref>)).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
