which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Director of the Federal Housing Finance Agency to assess the costs and benefits of requiring the enterprises obtain 2 rather than 3 credit reports and credit scores, and for other purposes.</official-title></form><legis-body id="HAF521010788F48C3934BD0AF2A64B7BF" style="OLC"><section id="HFE25E36C5418413E9BAD7B19E0D6406A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Credit Report Enhancement Directive Act</short-title></quote> or the <quote><short-title>CRED Act</short-title></quote>.</text></section><section id="HFD71F62BC6074BEC9C8D6E13E51B9BDB"><enum>2.</enum><header>Analysis of costs and benefits required</header><subsection id="H654C7EFD807145BEBA3CF6EBAE83393D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Federal Housing Finance Agency shall conduct an analysis of the costs and benefits of a requirement that the enterprises obtain 2 rather than 3 credit reports and credit scores from the national consumer reporting agencies if the enterprise conditions the purchase of a residential mortgage loan on the delivery of a borrower’s credit score.</text></subsection><subsection id="HED95DAE481A8433EAB6CBD2A17BB3CF2"><enum>(b)</enum><header>Requirements</header><text>In conducting the analysis required under subsection (a), the Director should consider potential—</text><paragraph id="H54AC209A02EE46F788F63249E58F5269"><enum>(1)</enum><text>cost savings for mortgage borrowers;</text></paragraph><paragraph id="H9F46FB295BA9436597AB0E3A59DE2B9A"><enum>(2)</enum><text>changes in access to mortgage credit for consumers that may result from reviewing two, rather than three, credit reports and credit scores;</text></paragraph><paragraph id="H5572B677479746288BCA1292245E7346"><enum>(3)</enum><text>compliance and operating costs for mortgage lenders and servicers, the three national credit reporting agencies, and the enterprises; and</text></paragraph><paragraph id="H98FC2FDA28014F808A266932CB1D3435"><enum>(4)</enum><text>legal exposures for mortgage lenders and servicers that result from selecting two, rather than three, credit reports and credit scores.</text></paragraph></subsection><subsection id="HCAC2C25F307F44A2853A35588B584002"><enum>(c)</enum><header>Public comment</header><paragraph id="H1CDEA42A71D54762AC31E3060049AF97"><enum>(1)</enum><header>In general</header><text>The Director shall publish the analysis required under this section in the Federal Register and invite public comment on the analysis for 90 days. </text></paragraph><paragraph id="H29962A8ECB9C490A8AF7F61B791AFBA3"><enum>(2)</enum><header>Restriction</header><text display-inline="yes-display-inline">The Director may not establish a requirement that the enterprises obtain 2 rather than 3 credit reports and credit scores from the national consumer reporting agencies if the enterprise conditions the purchase of a residential mortgage loan on the delivery of a borrower’s credit score until the public comment period is closed.</text></paragraph></subsection><subsection id="H49771DF44B1248DBA0A4AA374ACEABDC"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD6A13E2287BB453B8B107223EBAF24AF"><enum>(1)</enum><header>Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Federal Housing Finance Agency.</text></paragraph><paragraph id="H48B506F412EB44A593260D3D2606ED68" display-inline="no-display-inline"><enum>(2)</enum><header>Consumer report</header><text>The term <term>consumer report</term> has the meaning given that term in section 603(d) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(d)</external-xref>.</text></paragraph><paragraph id="H1833B209E94D40629AA0A3F75A0EBB21"><enum>(3)</enum><header>Credit score</header><text>The term <term>credit score</term> has the meaning given that term in section 302(b)(7)(A)(i) of the Federal National Mortgage Association Charter Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1717">12 U.S.C. 1717(b)(7)(A)(i)</external-xref>).</text></paragraph><paragraph id="H85C110030B63410DBF3123D08CA03668"><enum>(4)</enum><header>National consumer reporting agency</header><text>The term <term>national consumer reporting agency</term> means a <quote>consumer reporting agency that compiles and maintains files on consumers on a nationwide basis</quote> as defined in section 603(p) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(p)</external-xref>.</text></paragraph><paragraph id="HAAF8EE98D4F44106BFADBA050EE6177D"><enum>(5)</enum><header>Residential mortgage</header><text>The term <term>residential mortgage</term> has the meaning given that term in section 302(h) of the Federal Home Loan Mortgage Corporation Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1451">12 U.S.C. 1451(h)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
