id="H72C6FBAB13D54D1580190797167DF14A"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC7A78516F2C748BEBFBFE254EEC77E95"><enum>(2)</enum><header>Centers of Excellence</header><text>The term <term>Centers of Excellence</term> means—</text><subparagraph commented="no" display-inline="no-display-inline" id="H68DC173512034B77B1CB1E6191A0A788"><enum>(A)</enum><text display-inline="yes-display-inline">the Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions established under section 201(c)(1)(A); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA8BA48C0D9B4475B928DD8B1A0ED2EF3"><enum>(B)</enum><text>the Rural Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions established under section 201(c)(1)(B).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53CDE7722D444F758D4702905E656452"><enum>(3)</enum><header>Essential use</header><text>The term <term>essential use</term>, with respect to a perfluoroalkyl or polyfluoroalkyl substance, means a use of the perfluoroalkyl or polyfluoroalkyl substance that is designated under section 102(c), as reflected under a review or recommendation under any applicable report under section 101(h) (including a subsequent report), as being an essential use because the use of the perfluoroalkyl or polyfluoroalkyl substance in an item or process is—</text><subparagraph commented="no" display-inline="no-display-inline" id="H205173994CF14801BB8C679D5F27F5A3"><enum>(A)</enum><text display-inline="yes-display-inline">critical for the health, safety, or functioning of society;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5303E2CF761345CBBF1B2DD12C78BCA5"><enum>(B)</enum><text>necessary for the item or process to function; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H108133BAD2A547E18B6CE54C7859EBF4"><enum>(C)</enum><text>a use for which a safer alternative is not available.</text></subparagraph></paragraph><paragraph id="H2A302D23A05C4D2F9CF2CB28DD389611"><enum>(4)</enum><header>Manufacturer</header><subparagraph id="H7A9F07D7A9764B7AA51F51829284D0D4"><enum>(A)</enum><header>In general</header><text>The term <term>manufacturer</term> means any person who—</text><clause commented="no" display-inline="no-display-inline" id="H9A53624420924FE2ABE6D346453386A9"><enum>(i)</enum><text display-inline="yes-display-inline">imports into the United States, a territory of the United States, or a Freely Associated State a perfluoroalkyl or polyfluoroalkyl substance;</text></clause><clause commented="no" display-inline="no-display-inline" id="H1F31B7FC13C94B5FAF287F16715097F2"><enum>(ii)</enum><text display-inline="yes-display-inline">exports from the United States, a territory of the United States, or a Freely Associated State a perfluoroalkyl or polyfluoroalkyl substance;</text></clause><clause commented="no" display-inline="no-display-inline" id="HFD7CFADC67BB4E0B8F2A0C136C17C00E"><enum>(iii)</enum><text display-inline="yes-display-inline">produces a perfluoroalkyl or polyfluoroalkyl substance;</text></clause><clause commented="no" display-inline="no-display-inline" id="H2B1221DCC57C4D0693C2990BA48FF989"><enum>(iv)</enum><text display-inline="yes-display-inline">manufactures a perfluoroalkyl or polyfluoroalkyl substance; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H98C9F82E58C44682A2A29E3C1E8C73DC"><enum>(v)</enum><text display-inline="yes-display-inline">processes a perfluoroalkyl or polyfluoroalkyl substance.</text></clause></subparagraph><subparagraph commented="no" id="H7062D720C9A048B8B7F06525379046B2"><enum>(B)</enum><header>Inclusions</header><text>The term <term>manufacturer</term> includes importers and exporters of products that are known to contain perfluoroalkyl or polyfluoroalkyl substances.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5C2AAEA62A054F4EA32F94C7F473C394"><enum>(C)</enum><header>Exclusion</header><text>The term <term>manufacturer</term> does not include an entity that neither manufactures nor uses perfluoroalkyl or polyfluoroalkyl substances, but receives perfluoroalkyl or polyfluoroalkyl substances in the normal course of operations of the entity, including a solid waste management facility, a composting facility, a public water system (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)), and a publicly or privately owned or operated treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF6B176E7912C4AFFB6DC78FD61715E35"><enum>(5)</enum><header>National Academies</header><text>The term <term>National Academies</term> means the National Academies of Sciences, Engineering, and Medicine.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB8B7F41F992148B080B845641064CE13"><enum>(6)</enum><header>Nonessential use</header><text>The term <term>nonessential use</term> means a use of a perfluoroalkyl or polyfluoroalkyl substance that is not an essential use.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C719C9DB0BE4026B5A4E7A8146989D2"><enum>(7)</enum><header>Perfluoroalkyl or polyfluoroalkyl substance</header><text>The term <term>perfluoroalkyl or polyfluoroalkyl substance</term> means a substance that is a perfluoroalkyl substance or a polyfluoroalkyl substance (as those terms are defined in section 7331(2)(B) of the PFAS Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/15/8931">15 U.S.C. 8931(2)(B)</external-xref>)), including a mixture of those substances.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H977137AC5DD543B2B90326B5D0EBC377"><enum>(8)</enum><header>Process</header><text>The term <term>process</term>, with respect to a perfluoroalkyl or polyfluoroalkyl substance, means the preparation of the perfluoroalkyl or polyfluoroalkyl substance, including preparation that includes the mixture of multiple perfluoroalkyl or polyfluoroalkyl substances, after the manufacture of that perfluoroalkyl or polyfluoroalkyl substance for distribution in commerce—</text><subparagraph commented="no" display-inline="no-display-inline" id="H6746AAF44A244320A696F90EA02BEBF5"><enum>(A)</enum><text display-inline="yes-display-inline">in the same form or physical state as, or in a different form or physical state from, that in which the perfluoroalkyl or polyfluoroalkyl substance was received by the person so preparing the perfluoroalkyl or polyfluoroalkyl substance; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H383C2E9AAC794E618292EC6ABAF58C43"><enum>(B)</enum><text>as part of an article containing the perfluoroalkyl or polyfluoroalkyl substance.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5D1049C1EE4E4A79BC6EFC7A0747FA51"><enum>(9)</enum><header>Safer alternative</header><text>The term <term>safer alternative</term>, with respect to the use of a perfluoroalkyl or polyfluoroalkyl substance, means a use that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H382D1D69B651439285B4C2E9B97155E8"><enum>(A)</enum><text display-inline="yes-display-inline">does not require the use of a perfluoroalkyl or polyfluoroalkyl substance to achieve the intended function;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEB84D49A49E34F9B976885A5B0DCC9D7"><enum>(B)</enum><text>demonstrates adequate performance for the intended use;</text></subparagraph><subparagraph id="HF43B18E3741745648E2A89CFBC3E237D"><enum>(C)</enum><text>does not pose an unreasonable chronic or acute risk to the environment or public health as compared to the substance being replaced, including any harm that may result from persistence, bioaccumulation, and toxicity in any environment or human system, either by itself or cumulatively with other substances that cause similar harms; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H003A8533F87044C99B6E400E3B4F434A"><enum>(D)</enum><text>has other risk characteristics that the Administrator determines appropriate, in consultation with the heads of relevant Federal agencies and stakeholders as the Administrator determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H838DDA79FCE74B34B815824C9CE4EEFE"><enum>(10)</enum><header>State</header><text>The term <term>State</term> means—</text><subparagraph id="HEA7C0A5A028446968131175DFF80CFA0"><enum>(A)</enum><text>each State;</text></subparagraph><subparagraph id="HC7140B19F5A54838B28F3A321E95EA22"><enum>(B)</enum><text>a territory of the United States;</text></subparagraph><subparagraph id="H814D7C30F9AC4EAF8D3B7114412A6141"><enum>(C)</enum><text>a Freely Associated State;</text></subparagraph><subparagraph id="HD86DC0EC124F43BBA0A71024C32F5692"><enum>(D)</enum><text>an Indian Tribe included on the list most recently published by the Secretary of the Interior under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7CF48B684875493799E7A9E464F0926A"><enum>(E)</enum><text>the District of Columbia. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H483A06DFADE143118C104DCAD0491EE6"><enum>(11)</enum><header>User</header><subparagraph commented="no" display-inline="no-display-inline" id="HC87A7A88A30343C88DBCFAF4D96B5FFD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraphs (B) and (C), the term <term>user</term>, with respect to a perfluoroalkyl or polyfluoroalkyl substance, has the meaning given the term by the Administrator.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4206E1E1C0A6442D823E5DB1DC3E869C"><enum>(B)</enum><header>Considerations</header><text>In determining the definition of the term <term>user</term> under subparagraph (A), the Administrator shall consider—</text><clause commented="no" display-inline="no-display-inline" id="H5D08E9C54DA5459A8BCB010012357593"><enum>(i)</enum><text>the volume of a perfluoroalkyl or polyfluoroalkyl substance used by an entity;</text></clause><clause commented="no" display-inline="no-display-inline" id="H0A8BF0DBC2B648AFAE41F0CCC0F069D3"><enum>(ii)</enum><text>risks associated with releases of or exposure to a perfluoroalkyl or polyfluoroalkyl substance as a result of actions of an entity, including—</text><subclause commented="no" display-inline="no-display-inline" id="HA561BE6B348841969CAB882171A6FE3A"><enum>(I)</enum><text display-inline="yes-display-inline">toxicity;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD7A6802A5E254B5882C893A1954FAE37"><enum>(II)</enum><text>bioaccumulative properties;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H64F87C2DE99741648D2BF15E041E6C80"><enum>(III)</enum><text>persistence in the environment;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H8A1E27FE7CB742C7AE723D16FF748044"><enum>(IV)</enum><text>interactions with other perfluoroalkyl or polyfluoroalkyl substances and other toxic chemicals;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE415A046CE354641A931326889008AF2"><enum>(V)</enum><text>contamination and pollution burden of impacted communities; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF875FFDBD598429F812498D26357715B"><enum>(VI)</enum><text>associated human health effects;</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H706F3D3F59B2409EB7BDC820331591B4"><enum>(iii)</enum><text>past or possible future releases of a perfluoroalkyl or polyfluoroalkyl substance into the environment by an entity; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8C460ED6E8044256BAB5887186605940"><enum>(iv)</enum><text display-inline="yes-display-inline">the use and fate of a perfluoroalkyl or polyfluoroalkyl substance used by an entity.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4CE48E3D236E4315B9771197466D1FCB"><enum>(C)</enum><header>Exclusion</header><text>The term <term>user</term> does not include an entity that neither manufactures nor uses perfluoroalkyl or polyfluoroalkyl substances, but receives perfluoroalkyl or polyfluoroalkyl substances in the normal course of operations of the entity, including a solid waste management facility, a composting facility, a public water system (as defined in section 1401 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f</external-xref>)), and a publicly or privately owned or operated treatment works (as defined in section 212 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1292">33 U.S.C. 1292</external-xref>)). </text></subparagraph></paragraph></section><title id="HD4CCDD072440417D84D2A25387763C12" style="OLC"><enum>I</enum><header>Phaseout of nonessential perfluoroalkyl and polyfluoroalkyl substances and all releases</header><section id="HF602CC4FB555442BBE0F081204F6A50F"><enum>101.</enum><header>Agreement with the National Academies concerning the essential uses of perfluoroalkyl or polyfluoroalkyl substances</header><subsection commented="no" display-inline="no-display-inline" id="H3ACF6BAC2F8B42FC98F7467815903FD1"><enum>(a)</enum><header display-inline="yes-display-inline">Purposes</header><text>The purposes of this section are to provide for the National Academies, an independent nonprofit scientific organization with appropriate expertise that is not part of the Federal Government—</text><paragraph commented="no" display-inline="no-display-inline" id="H47C5DEC160C94BB089F760E980E7392E"><enum>(1)</enum><text display-inline="yes-display-inline">to review and evaluate the available scientific evidence regarding categories of essential uses of perfluoroalkyl or polyfluoroalkyl substances; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7DA06091CD05438FB7E622DB8B5C1DCB"><enum>(2)</enum><text>to provide guidance on designating perfluoroalkyl or polyfluoroalkyl substances as essential or nonessential.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE4125B6407EC417AA7B610B1E48FE51B"><enum>(b)</enum><header>Agreement</header><paragraph commented="no" display-inline="no-display-inline" id="H5D659A043204460CA4F553CEA1C9BCD3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator (in consultation, as the Administrator determines appropriate, with the heads of other Federal departments and agencies with relevant expertise regarding the essential uses of perfluoroalkyl or polyfluoroalkyl substances) shall seek to enter into a 10-year agreement to carry out the duties described in this section.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6D805BA18D974D7FA53C4BCC3E535938"><enum>(2)</enum><header>Extension</header><text>The Administrator and the National Academies may extend the agreement described in paragraph (1) in 5-year increments.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H21A16A093A3646FAA67030FEDC93485D"><enum>(c)</enum><header>Review of scientific evidence</header><paragraph commented="no" display-inline="no-display-inline" id="HA1A1295BF822475F88737F424797EDB6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Under an agreement under subsection (b), the National Academies shall, in accordance with the policy described in section 103(a), review and summarize the scientific evidence, and assess the strength of that scientific evidence, with respect to— </text><subparagraph commented="no" display-inline="no-display-inline" id="HDD938A23551E4B95A450E7A21C8174CE"><enum>(A)</enum><text display-inline="yes-display-inline">uses of perfluoroalkyl or polyfluoroalkyl substances that should be designated as essential uses; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H852E7A8250A34672AA5AE3E88ACD4366"><enum>(B)</enum><text>the criteria for designating essential uses.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC63F651636974866A77AB5458ED74CC4"><enum>(2)</enum><header>Inclusions</header><text>In carrying out the review described in paragraph (1), the National Academies shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE688FC20ACD54D91B93A8BF67E3B914B"><enum>(A)</enum><text>analyze the definition of the term <term>essential use</term> under section 2(3) as it relates to perfluoroalkyl or polyfluoroalkyl substances;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA8A7AD49B0264E3A857E8DF797BC8474"><enum>(B)</enum><text>conduct an assessment of how perfluoroalkyl or polyfluoroalkyl substances are integrated into the society of the United States, in which sectors of the economy of the United States perfluoroalkyl or polyfluoroalkyl substances are used, and in which sectors those uses are essential uses;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0DF7C1B998304A68A248C14AE4AD98A7"><enum>(C)</enum><text>describe any research gaps with respect to the uses of perfluoroalkyl or polyfluoroalkyl substances, including consideration of mitigation strategies and safer alternatives; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H58EAD44BE466490687E0BA0EC262E8AD"><enum>(D)</enum><text>develop recommendations with respect to—</text><clause commented="no" display-inline="no-display-inline" id="HAE90BD3CAA964BB3A557728943CECF17"><enum>(i)</enum><text display-inline="yes-display-inline">the research and development activities necessary to transition the United States from the use of perfluoroalkyl or polyfluoroalkyl substances; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H40EA0F7F032A40B7A9E14C2ABAC64E2A"><enum>(ii)</enum><text>how the Federal Government may—</text><subclause commented="no" display-inline="no-display-inline" id="H27D36124DAAB4D868C4C924C66E49EEF"><enum>(I)</enum><text display-inline="yes-display-inline">best ensure the conduct of the research and development activities described in clause (i) to ensure that safer alternatives minimize health, safety, and environmental risks; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEBE615E252064EF5BF9A70F51F48607E"><enum>(II)</enum><text>best address the research gaps identified under subparagraph (C) and the research and development needs identified under clause (i) through collaboration or coordination of programs and other efforts with State, local, and Tribal governments and nongovernmental organizations, including private sector organizations.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB85761B983F640278A98F0FFD187F47D"><enum>(3)</enum><header>Timing</header><text>The initial review carried out under paragraph (1) pursuant to an agreement under subsection (b) shall conclude not later than 3 years after the date on which the review begins.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D74E3EA37B3422C8D4566A096A16DE3"><enum>(d)</enum><header>Scientific determinations of essential uses</header><text>For each essential use, the National Academies shall, to the extent that available scientific data permit meaningful determinations, determine—</text><paragraph commented="no" display-inline="no-display-inline" id="HF7CFA479BBD84464AF3C06E1B941BFA7"><enum>(1)</enum><text display-inline="yes-display-inline">categories of uses of perfluoroalkyl or polyfluoroalkyl substances that can inform regulatory requirements under this title and amendments made by this title;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCCC37E352C9247EE8201D703F156591B"><enum>(2)</enum><text>a framework to guide decisionmakers in making designations of essential uses under section 102(c), which shall include—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2ECA1B2CD7B745A99F6E5D189800750E"><enum>(A)</enum><text display-inline="yes-display-inline">the integration of findings with respect to perfluoroalkyl or polyfluoroalkyl substances, including findings on human health effects that have sufficient or limited evidence of an association, from authoritative reviews (such as reviews by national or international bodies) and high-quality systematic reviews; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H50F56BA36E65412CA406AA24A62DBEE9"><enum>(B)</enum><text>a review of emerging evidence with respect to perfluoroalkyl or polyfluoroalkyl substances that is impactful in decisionmaking; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H791948AF18AC4F3DACD934DB22F926CD"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H59F97FD83A234F50A88DDC958C67EED1"><enum>(A)</enum><text>whether certain perfluoroalkyl or polyfluoroalkyl substances in certain consumer products pose an unreasonable risk to consumers, such as risks due to perfluoroalkyl or polyfluoroalkyl substance toxicity, persistence, or bioaccumulation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="HEF6C605F08534D90842D692184A5D59A"><enum>(B)</enum><text>the contribution of the uses identified under subparagraph (A) to the cumulative impact of perfluoroalkyl or polyfluoroalkyl substances on the environment and public health; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" indent="up1" id="H73C941D2AB7D45DABC0DC499751912B9"><enum>(C)</enum><text>recommendations for possible methods to eliminate perfluoroalkyl or polyfluoroalkyl substances from consumer products described in subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="H9D0D7DDAC0EC42EB8A0BB51DD0287B7E"><enum>(e)</enum><header>Community engagement</header><text>In carrying out reviews and studies under this section, the National Academies shall integrate robust, transparent, meaningful, and public community outreach.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H3097BFD26F084A0484B55553C6A629DB"><enum>(f)</enum><header display-inline="yes-display-inline">Cooperation of Federal agencies</header><text>The head of each relevant Federal agency, including the Administrator, shall cooperate fully with the National Academies in carrying out the agreement under subsection (b).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H276599C41FC2468B8EA7188100CD74BC"><enum>(g)</enum><header>Recommendations for additional studies</header><paragraph commented="no" display-inline="no-display-inline" id="HFFC92954A75746B4A9F34565546AFD24"><enum>(1)</enum><header>In general</header><text>The National Academies shall make any recommendations for additional scientific studies determined appropriate by the National Academies to resolve areas of continuing scientific uncertainty relating to essential uses of perfluoroalkyl or polyfluoroalkyl substances.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H57C3DD2DCF914F299788484121329729"><enum>(2)</enum><header>Requirements</header><text>In making recommendations under paragraph (1), the National Academies shall consider—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA80B601FA5F94CC28C767B464AB0EF99"><enum>(A)</enum><text display-inline="yes-display-inline">the scientific information that is available at the time of the recommendation;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7FEDBFACB8984E28B3A439975DD882E1"><enum>(B)</enum><text>the value and relevance of the information that could result from additional studies; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H03998819D3C8466B9B05445783C8A4B4"><enum>(C)</enum><text>the cost and feasibility of carrying out those additional studies.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF6B8CA53A9D34058973729024410AF6F"><enum>(h)</enum><header>Reports</header><paragraph commented="no" display-inline="no-display-inline" id="H26B379FA00B640A5BCB7ACE3F18CB37D"><enum>(1)</enum><header display-inline="yes-display-inline">Initial report</header><subparagraph commented="no" display-inline="no-display-inline" id="H12C53EEAAF8D4755A83D43395F15AF03"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the National Academies shall submit to the Administrator, the Committee on Environment and Public Works of the Senate, and the Committee on Energy and Commerce of the House of Representatives an initial report on the activities of the National Academies under the agreement under subsection (b).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD538908F034B4C5282C956623111F05C"><enum>(B)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The report required under subparagraph (A) shall include—</text><clause commented="no" display-inline="no-display-inline" id="HC34296ABC0584857ADAEC5276973A27B"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="H976EEAD8372149EF88B92B4EDC69ED32"><enum>(I)</enum><text display-inline="yes-display-inline">a description of the determinations, if any, made under subsection (d); and</text></subclause><subclause commented="no" display-inline="no-display-inline" indent="up1" id="H36FFEA3AA7A74F74A0A69D2ECF59AC57"><enum>(II)</enum><text>a full explanation of the scientific evidence and reasoning that led to those determinations; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1CBC4280634640C4BE648923EF4E6743"><enum>(ii)</enum><text>any recommendations made under subsection (g).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8DA237899BCA4967B42E9EE293503B18"><enum>(2)</enum><header>Subsequent reports</header><text>Not less frequently than once every 2 years after the date on which the initial report under paragraph (1) is submitted, the National Academies shall submit to the Administrator, the Committee on Environment and Public Works of the Senate, and the Committee on Energy and Commerce of the House of Representatives an update of that report.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HFD31140840DA4B52815855B855FE4773"><enum>(i)</enum><header>Additional studies</header><paragraph commented="no" display-inline="no-display-inline" id="H50B3FAF41E0042B6858684B80BC2DABC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date that is 2 years after the date that the National Academies completes the review under subsection (c), the Administrator may initiate not more than 5 additional studies with the National Academies—</text><subparagraph commented="no" display-inline="no-display-inline" id="H64CBA6A1D5CF467DA67C1C7FAD47D73F"><enum>(A)</enum><text display-inline="yes-display-inline">to update the review carried out under subsection (c) based on new evidence; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA047D506A21F4DBFB9C64B6F2DF48215"><enum>(B)</enum><text>to address the recommendations made under subsection (g).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9C1F4CF18F9B463BBD7E413F61FD8B37"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator such sums as are necessary to carry out this subsection.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0475284498AF4BA0A2670851584AEE3B"><enum>(j)</enum><header>Alternative contracting scientific organization</header><paragraph commented="no" display-inline="no-display-inline" id="H6BE5115369374637945DD3BD1A40CF7A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>If the Administrator is unable to enter into an agreement under subsection (b) with the National Academies within the 60-day period described in that subsection on terms acceptable to the Administrator, the Administrator shall seek to enter into an agreement for purposes of carrying out this section with another appropriate scientific organization that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H0EB032C70A854EBE85691505AB9EA3DA"><enum>(A)</enum><text display-inline="yes-display-inline">is not part of the Federal Government;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2A7C0DDB8EE249E68FB28A4C7963060A"><enum>(B)</enum><text>operates as a not-for-profit entity; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H398D4B0E302442959028949411AEE2F8"><enum>(C)</enum><text>has expertise and objectivity comparable to that of the National Academies.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H401293CE09C04D6992EFEE34D3BB6EC5"><enum>(2)</enum><header>Effect of alternative organization</header><text>If the Administrator enters into an agreement with an alternative scientific organization under paragraph (1), any reference in this title to <quote>the National Academies</quote> shall be deemed to be a reference to that alternative scientific organization.</text></paragraph></subsection></section><section id="H0E1560FED1EE4546BECF1958D59C3A27"><enum>102.</enum><header>Manufacturing and use phaseout program</header><subsection commented="no" display-inline="no-display-inline" id="HFE0071B9DC00446F80141E6D998B3437"><enum>(a)</enum><header display-inline="yes-display-inline">Annual perfluoroalkyl or polyfluoroalkyl substance manufacturer and user monitoring and reporting requirements</header><paragraph commented="no" display-inline="no-display-inline" id="H86430236168741CD8566B91C30C41F95"><enum>(1)</enum><header display-inline="yes-display-inline">Purpose</header><text>The purposes of the amendments made by this subsection are—</text><subparagraph commented="no" display-inline="no-display-inline" id="H95E63868EE4C4156B0C97C1BA5429B00"><enum>(A)</enum><text display-inline="yes-display-inline">to make available and accessible data to inform a nationwide phaseout of the use and environmental release of perfluoroalkyl or polyfluoroalkyl substances;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7C349604F1854206814A5551DD966B2F"><enum>(B)</enum><text>to put in place a process for that phaseout; and</text></subparagraph><subparagraph id="H9CE39A8D506F4ECDA60A8765773D484B"><enum>(C)</enum><text>to increase transparency for the public and interested stakeholders with respect to the use, release, and prevalence of perfluoroalkyl or polyfluoroalkyl substances.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF393F78A3B2243E8B8858AE80391003A"><enum>(2)</enum><header>Amendments</header><text>Section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB5E974EFA3064A16A230486C4DD2D829"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Not later</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HF5AF6D688A894C709AC162DA429A59CE"><subparagraph commented="no" display-inline="no-display-inline" id="H3C53EDC77544412995A7315525B97672"><enum>(A)</enum><header>In general</header><text>Not later</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H17986181B9D04CCFB43F55BD9833DCA8"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D39CF643ED74B17AC9608B3B8E7F46B"><subparagraph commented="no" display-inline="no-display-inline" id="H5769D43D1C444DDAA92CFA71B3D754D9"><enum>(B)</enum><header display-inline="yes-display-inline">Annual supplements</header><clause commented="no" display-inline="no-display-inline" id="HF139B23476DA465AB3D139FDF901759B"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions of essential use; manufacturer; perfluoroalkyl or polyfluoroalkyl substance; safer alternative; user</header><text>In this subparagraph, the terms <term>essential use</term>, <term>manufacturer</term>, <term>perfluoroalkyl or polyfluoroalkyl substance</term>, <term>safer alternative</term>, and <term>user</term> have the meanings given those terms in section 2 of the <short-title>Forever Chemical Regulation and Accountability Act of 2024</short-title>.</text></clause><clause id="H57D2563ABC4C402385B14670F6CFABDE"><enum>(ii)</enum><header>Manufacturer and user report required</header><text>Not later than 3 years after the date of enactment of this subparagraph but in a manner that does not otherwise delay the implementation of this paragraph (as in effect on the day before the date of enactment of this subparagraph), the Administrator shall require each manufacturer and user of perfluoroalkyl or polyfluoroalkyl substance to submit a report described in subparagraph (A) if that manufacturer or user was not required to do so on the day before the date of enactment of this subparagraph.</text></clause><clause commented="no" display-inline="no-display-inline" id="H77A7433BD3174321982950A71979DFA3"><enum>(iii)</enum><header display-inline="yes-display-inline">Supplemental reports required</header><text>Not later than 18 months after the date on which the Administrator publishes the final rule carrying out this subparagraph and not less frequently than annually thereafter, subject to clause (v), each manufacturer or user of a perfluoroalkyl or polyfluoroalkyl substance shall—</text><subclause commented="no" display-inline="no-display-inline" id="H8157311A21124A1C9104E329C7F15A82"><enum>(I)</enum><text display-inline="yes-display-inline">supplement the report required described in subparagraph (A) (including a report submitted pursuant to clause (ii)) by—</text><item commented="no" display-inline="no-display-inline" id="H2069B68755974DDE84657D8291F6F05E"><enum>(aa)</enum><text display-inline="yes-display-inline">including, as applicable, any updates to the information included in the report under that subparagraph; and</text></item><item commented="no" display-inline="no-display-inline" id="H8354205478164D67A612E73541658D82"><enum>(bb)</enum><text>including in the report—</text><subitem commented="no" display-inline="no-display-inline" id="HEFE5FF1FA5784C428426946A4D684DE4"><enum>(AA)</enum><text display-inline="yes-display-inline">a description of any essential uses of perfluoroalkyl or polyfluoroalkyl substances carried out by the manufacturer or user;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H93CD8D3EC98647EA8EE3CAC49EC71090"><enum>(BB)</enum><text display-inline="yes-display-inline">any safer alternatives for uses of perfluoroalkyl or polyfluoroalkyl substances used by the manufacturer or user; </text></subitem><subitem commented="no" display-inline="no-display-inline" id="H974DC9EE694A4E2CB2F68EB71A236B77"><enum>(CC)</enum><text display-inline="yes-display-inline">any environmental releases of a perfluoroalkyl or polyfluoroalkyl substance, at any detectable level;</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H130924D234C8480FA865CDBC92BB7E01"><enum>(DD)</enum><text>any use of a perfluoroalkyl or polyfluoroalkyl substance that is required pursuant to Federal law (including regulations), Federal standards, or Federal Government specifications; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H3F3CFF176B5244018376909F2195C262"><enum>(EE)</enum><text>any additional information that the Administrator may require; and</text></subitem></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H633A0D30BBAF487DB47F206E55C23F73"><enum>(II)</enum><text display-inline="yes-display-inline">submit the supplemental report to the Administrator in such a manner and at such time as the Administrator requires.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HC64DCCBBD6B0475D90E313BC37A97B91"><enum>(iv)</enum><header>Use of reports</header><subclause commented="no" display-inline="no-display-inline" id="H97D79C1D55794F27B43900FC7D0BE99D"><enum>(I)</enum><header display-inline="yes-display-inline">Publication</header><text>Not later than 180 days after the date on which the Administrator receives a supplemental report from a manufacturer or user under clause (iii), the Administrator shall publish the supplemental report for a period of public comment and review of not less than 90 days.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HDAB5861642284518804E35BD66490236"><enum>(II)</enum><header>Data quality</header><text display-inline="yes-display-inline">The Administrator shall conduct data quality assurance and scientific integrity reviews of supplemental reports received under clause (iii)—</text><item commented="no" display-inline="no-display-inline" id="HF7B131445E4B4F32936718EA4B9132AD"><enum>(aa)</enum><text display-inline="yes-display-inline">to ensure the quality of reported data; and</text></item><item commented="no" display-inline="no-display-inline" id="HC2D5DCC67FB74A20869D10BA2E5ABFD1"><enum>(bb)</enum><text>to provide comment on the validity of the supplemental reports of the manufacturer.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HDA7CF97A308745328F385AD5F52ADB4D"><enum>(III)</enum><header>Confidential business information</header><text display-inline="yes-display-inline">The Administrator shall carry out this clause in accordance with section 14. </text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HF755F064E0DC4A0CBB3CA8F77031FCA2"><enum>(v)</enum><header>No further reports required</header><subclause commented="no" display-inline="no-display-inline" id="H73BBE98341F045528AACA8281F7F1AB1"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">No further supplemental reports under clause (iii) shall be required from a manufacturer or user if the manufacturer or user—</text><item id="H8496F98F4F7B473EB160FDF4D8E10375"><enum>(aa)</enum><text>permanently ceases use of all perfluoroalkyl or polyfluoroalkyl substances; and</text></item><item id="HDB6D52E1AC7F4D659AC9D51B591DB385"><enum>(bb)</enum><text>notifies the Administrator in writing that the requirement under item (aa) has been met.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H308E91E2E74C473D84B9E968616A04F5"><enum>(II)</enum><header>Final report</header><text display-inline="yes-display-inline">Notwithstanding the submission of a notice under subclause (I)(bb), a manufacturer or user shall submit to the Administrator a final supplemental report under clause (iii) if, at any time during the 1-year period beginning on the date on which the manufacturer or user submitted the previous supplemental report under that clause, the manufacturer or user used a perfluoroalkyl or polyfluoroalkyl substance.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H7417AFDDC5654EDC97C300B354AAA95A"><enum>(III)</enum><header>Public notice of cessation</header><text display-inline="yes-display-inline">The Administrator shall issue a public notice describing each notification received under subclause (I)(bb).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H70E5FB4AA08C4A4493242333DD2AEAAA"><enum>(3)</enum><header>Savings provision</header><text>Nothing in paragraph (2) or the amendments made by paragraph (2) affects the requirements under subparagraph (A) of section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>) or any timeline established for the implementation of that section (as in effect on the day before the date of enactment of this Act).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H8B22013650E147B2A29AA2A8825A5CC6"><enum>(b)</enum><header>Production and consumption phaseouts required</header><paragraph commented="no" display-inline="no-display-inline" id="HC0EFA48E42064974A052919E8912868A"><enum>(1)</enum><header display-inline="yes-display-inline">General rule</header><text>Not later than 10 years after the date of enactment of this Act, manufacturers and users shall complete the full phaseout of nonessential uses of perfluoroalkyl or polyfluoroalkyl substances.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE27C87B2274B49DBA1EBEBF7C32D0D79"><enum>(2)</enum><header>Plans required</header><subparagraph commented="no" display-inline="no-display-inline" id="H34049712669141C18026189EEA5B7F84"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this Act, each manufacturer and user shall submit to the Administrator, in such a manner as the Administrator may require, a plan and schedule for the full phaseout of nonessential uses of perfluoroalkyl and polyfluoroalkyl substances within the 10-year period described in paragraph (1).</text></subparagraph><subparagraph commented="no" id="H08115B204FD14866B0D54431C9B0FBE2"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">A plan submitted by a manufacturer or user under subparagraph (A) may include verifiable transfer of perfluoroalkyl or polyfluoroalkyl substance stocks in the possession of the manufacturer or user to an accredited research consortium, including Centers of Excellence, National Laboratories of the Department of Energy, institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), and other relevant entities, as determined by the Administrator, for the purposes of—</text><subclause commented="no" display-inline="no-display-inline" id="H72020CC0DDEE405B8DA3AF168BCDBD04"><enum>(I)</enum><text display-inline="yes-display-inline">research into the destruction, detection, and remediation of perfluoroalkyl or polyfluoroalkyl substances; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD058F6D77985443AB2B858E43B22852E"><enum>(II)</enum><text>other related research.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H8A85033155894D0E9523DC658DA841C8"><enum>(ii)</enum><header>Savings provision</header><text>Nothing in this subparagraph—</text><subclause commented="no" display-inline="no-display-inline" id="H4C4CC22544B84C1BA7C4D20EA97467A9"><enum>(I)</enum><text display-inline="yes-display-inline">affects an obligation of a manufacturer or user to comply with a regulation or requirement associated with the removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HEB226414407B49D88D7FA4A8E0F0F8EE"><enum>(II)</enum><text>prohibits a manufacturer or user from using a method of removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance in accordance with applicable law. </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5B1E2838E39A477AAAF7E6DFB2B7F44D"><enum>(C)</enum><header>Public availability</header><text>The Administrator shall make the plans submitted by manufacturers and users under subparagraph (A) publicly available in accordance with section 14 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2614">15 U.S.C. 2614</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H525897F0EC9B4987AA02836564C9152A"><enum>(3)</enum><header>Accelerated schedule</header><subparagraph commented="no" display-inline="no-display-inline" id="H3D84BBB4735B456484471BAA366564ED"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator may, after a period of notice and opportunity for public comment of not less than 180 days, require that the full phaseout of nonessential uses of perfluoroalkyl or polyfluoroalkyl substances required under paragraph (1) occur on a schedule that is more stringent than the schedule required under that paragraph.</text></subparagraph><subparagraph id="H52BE96B3A9704BFA872B459BD75BA888"><enum>(B)</enum><header>Petition</header><clause commented="no" display-inline="no-display-inline" id="H24A9818FEC9549E9B67EFA183713A104"><enum>(i)</enum><header>In general</header><text>Any person may petition the Administrator to establish a more stringent schedule under subparagraph (A).</text></clause><clause commented="no" display-inline="no-display-inline" id="H8CE1089444CB4B4787EBD41F6292B6C2"><enum>(ii)</enum><header>Requirements</header><text>A petition submitted under clause (i) shall—</text><subclause commented="no" display-inline="no-display-inline" id="H3D766E6734FE4BA6A4CBC3FA054EFD61"><enum>(I)</enum><text display-inline="yes-display-inline">be made at such time, in such manner, and containing such information as the Administrator shall require; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H07548C73AD3F4E15B95442454309CB93"><enum>(II)</enum><text>include a showing by the petitioner that there are scientific data with respect to nonessential uses of perfluoroalkyl or polyfluoroalkyl substances to support the petition.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H07E865228D8F44888CB64998EF0077DA"><enum>(iii)</enum><header>Response timeline</header><subclause commented="no" display-inline="no-display-inline" id="H1AB8216F8ED0457AB08A7967D9A4DB3B"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text>If the Administrator receives a petition under clause (i), the Administrator shall—</text><item commented="no" display-inline="no-display-inline" id="HB8D5C3C1AC6849D8BB0969A7DF9D0BC1"><enum>(aa)</enum><text display-inline="yes-display-inline">not later than 180 days after the date on which the Administrator receives the petition—</text><subitem commented="no" display-inline="no-display-inline" id="H850F3DE1B0384090B05DCCE75133A256"><enum>(AA)</enum><text display-inline="yes-display-inline">make the complete petition available to the public; and</text></subitem><subitem commented="no" display-inline="no-display-inline" id="H3D7B1F4CA12B4AF582314C74B6763EEF"><enum>(BB)</enum><text>when making the petition available pursuant to subitem (AA), propose and seek public comment, for a period of not less than 90 days, on the proposal of the Administrator to grant or deny the petition; and</text></subitem></item><item commented="no" display-inline="no-display-inline" id="HC55D0FE7C5B544F789A7E9F5142626B8"><enum>(bb)</enum><text>not later than 1 year after the date on which the Administrator receives the petition, take final action on the petition.</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H462501EDCDFB4B5CB44D3E9CD3B05B1C"><enum>(II)</enum><header>Revised plans and schedules</header><item commented="no" display-inline="no-display-inline" id="H7F30C12F6484497E996629D97FA0D65D"><enum>(aa)</enum><header>In general</header><text display-inline="yes-display-inline">If, after receiving public comment with respect to a petition received under clause (i), the Administrator grants the petition, each manufacturer and user shall revise and submit to the Administrator an update to the plan and schedule required under paragraph (2)(A) to reflect the more stringent schedule described in the petition.</text></item><item commented="no" display-inline="no-display-inline" id="H6FDD656653D5436494300D2838F08CFA"><enum>(bb)</enum><header>Requirement</header><text>A revised plan and schedule under item (aa) shall be submitted in accordance with paragraph (2).</text></item></subclause></clause></subparagraph></paragraph><paragraph id="HC6940A9FB8644B83B7FC3E36ADCFFC7F"><enum>(4)</enum><header>Accelerated phase-out in certain products</header><subparagraph commented="no" display-inline="no-display-inline" id="H5CA91E8E20E94A69B97F915F42CD1180"><enum>(A)</enum><header display-inline="yes-display-inline">Phase-out within 1 year</header><clause commented="no" display-inline="no-display-inline" id="H484FAC79A9CE4D59B869C6D5FD11B443"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this Act but subject to clause (ii), beginning on the date that is 1 year after the date of enactment of this Act, no person may sell, offer for sale, or distribute for sale in interstate commerce—</text><subclause commented="no" display-inline="no-display-inline" id="H2048D2D143564A6CBBEF2E4608C6498A"><enum>(I)</enum><text display-inline="yes-display-inline">a carpet or rug that contains perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2CFB529E254F463AB0F8364A0A3A6EAC"><enum>(II)</enum><text>a fabric treatment that contains perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE3A0D5701141423CA42266941E9ACCA1"><enum>(III)</enum><text>food packaging and containers that contains perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H78CD8E5FFEBA4993984D0247C7FF0874"><enum>(IV)</enum><text>a juvenile product that contains perfluoroalkyl or polyfluoroalkyl substances; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H732DCBA343CC414A86BED7BC6048715E"><enum>(V)</enum><text>an oil or gas product that contains perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H90BBA30152C940CD934BF1B215BA35A8"><enum>(ii)</enum><header>Exception for resale</header><text>The prohibition under clause (i) does not apply to the sale or resale of used products described in subclauses (I), (II), and (IV) of that clause.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8E366DDD07DF48858F84D5B477E36160"><enum>(B)</enum><header>Phase-out within 2 years</header><clause commented="no" display-inline="no-display-inline" id="HB3BA44E1DCBA4EEA801D4DD69D99678D"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of this Act but subject to clause (ii), beginning on the date that is 2 years after the date of enactment of this Act, no person may sell, offer for sale, or distribute for sale in interstate commerce—</text><subclause commented="no" display-inline="no-display-inline" id="HB499E837E7BE449589A58962622A6A4F"><enum>(I)</enum><text display-inline="yes-display-inline">a cosmetic that contains perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H91D8986B4D39475BAFFBAFD7A655AFD3"><enum>(II)</enum><text>an indoor textile furnishing that contains perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H1B2D9261053D4D63A1C3B835E785EF61"><enum>(III)</enum><text>indoor upholstered furniture that contains perfluoroalkyl or polyfluoroalkyl substances; </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H2EA6466967B04BE986B8C01FB1676126"><enum>(IV)</enum><text>an accessory or handbag that contains perfluoroalkyl or polyfluoroalkyl substances; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H08FF1DAC474D4515AF1CDDC2E7D95503"><enum>(V)</enum><text>except for a product described in subparagraph (D), indoor and outdoor apparel that contains perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H111DB5CD4CC348FB999306DCA0069480"><enum>(ii)</enum><header>Exception for resale</header><text>The prohibition under clause (i) does not apply to the sale or resale of used products described in each of subclauses (II) through (V) of that clause.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3539BBBE8FDB4E4EAA43F6150FAB67E6"><enum>(C)</enum><header>Phase-out within 4 years</header><clause commented="no" display-inline="no-display-inline" id="H1FF1DC07154C4FF78456EDCD048A080E"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of this Act but subject to clause (ii), beginning on the date that is 4 years after the date of enactment of this Act, no person may sell, offer for sale, or distribute for sale in interstate commerce—</text><subclause commented="no" display-inline="no-display-inline" id="H377F5536032A411986A330182993B5F2"><enum>(I)</enum><text>an outdoor textile furnishing that contains perfluoroalkyl or polyfluoroalkyl substances; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6F593F54DBC64C6A845BA830E4BB25BD"><enum>(II)</enum><text>outdoor upholstered furniture that contains perfluoroalkyl or polyfluoroalkyl substances.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H4A1A08B392E8491E8ED8CDF6F99713D0"><enum>(ii)</enum><header>Exception for resale</header><text>The prohibition under clause (i) does not apply to the sale or resale of used products described in that clause.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H74EE688D0A8B4BD6BB32F2465DA01A71"><enum>(D)</enum><header>Phaseout within 5 years</header><clause commented="no" display-inline="no-display-inline" id="H075B02280BE845109EB9EB545A989A55"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of this Act but subject to clause (ii), beginning on the date that is 5 years after the date of enactment of this Act, no person may sell, offer for sale, or distribute for sale in interstate commerce outdoor apparel for severe wet conditions that contain intentionally used perfluoroalkyl or polyfluoroalkyl substances.</text></clause><clause commented="no" display-inline="no-display-inline" id="H1907F404288E4A179FC3974D64CA60DC"><enum>(ii)</enum><header>Exception for resale</header><text>The prohibition under clause (i) does not apply to the sale or resale of used products described in that clause.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H37849DFB4E7D4F449654A61DA6838367"><enum>(c)</enum><header>Designations of nonessential and essential uses</header><paragraph commented="no" display-inline="no-display-inline" id="H556B7C0E7E8F4B4A93E4E79B4495618E"><enum>(1)</enum><header>10-year requirement</header><text>Beginning on the date that is 10 years after the date of enactment of this Act—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7D517F1CBE9F4B8FA8F727D0E1B8EF3B"><enum>(A)</enum><text>all nonessential uses of a perfluoroalkyl or polyfluoroalkyl substance shall be prohibited; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDA1FBD3F8B9A4F289BCB03B783A4D321"><enum>(B)</enum><text display-inline="yes-display-inline">any use of a perfluoroalkyl or polyfluoroalkyl substance shall be considered a nonessential use unless the Administrator, consistent with applicable recommendations or other analysis, if any, under a report under section 101(h) (including a subsequent report), has designated the use as an essential use under paragraph (2) or (3).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAC3966FD534645D5B79194DFDA3D2BC4"><enum>(2)</enum><header>Petition</header><subparagraph commented="no" display-inline="no-display-inline" id="H2A8C827FDA0A4287BEE0C46C47AB777F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>A person may submit to the Administrator a petition to designate a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use at such time (including on a 1-time, periodic, or continuing basis within such timeframe as the Administrator may require), in such manner, and containing such information as the Administrator may require.</text></subparagraph><subparagraph id="HC4A72733CDD34D2B84F5045EABF83EE1"><enum>(B)</enum><header>Burden of proof</header><text>In submitting a petition under subparagraph (A)—</text><clause commented="no" display-inline="no-display-inline" id="H62A40438E7414D7A8C56A5102C8C7916"><enum>(i)</enum><text display-inline="yes-display-inline">the burden of proof shall be on the petitioner to demonstrate that a use of a perfluoroalkyl or polyfluoroalkyl substance is a nonessential use or an essential use; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HB1AE28BBE10B4962A7DBDD940195AFF1"><enum>(ii)</enum><text>the petitioner shall provide any information requested by the Administrator, on a 1-time, periodic, or continuous basis within such timeframe as the Administrator may require, to inform a determination under subparagraph (C).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H60E82E5B33CF4422A895099690280049"><enum>(C)</enum><header>Determination</header><clause commented="no" display-inline="no-display-inline" id="H827B8236ADE44DBE9E41425AFA9E9175"><enum>(i)</enum><header display-inline="yes-display-inline">Best available science</header><text>The determination of the Administrator to grant or deny a petition submitted under subparagraph (A) shall be based on—</text><subclause commented="no" display-inline="no-display-inline" id="HA296F1AE957B4FC49DD8FF1241B155C3"><enum>(I)</enum><text display-inline="yes-display-inline">the best available science; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HABDC7F57B82A4A42ADD12E7CD98AB63F"><enum>(II)</enum><text>the applicable recommendations or other analysis, if any, under a report under section 101(h) (including a subsequent report).</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H3B7AE0E939204204955CAD19C108251A"><enum>(ii)</enum><header>Timeline</header><subclause commented="no" display-inline="no-display-inline" id="HD3C21C58E02A4F8CB09B4EFE80823495"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subclause (II), the Administrator shall finalize a determination to grant or deny a petition submitted under subparagraph (A) by not later than 270 days after the date of receipt of the petition.</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H912094B1648F4235807CCFC03E2BBD05"><enum>(II)</enum><header>Requirement</header><text display-inline="yes-display-inline">The Administrator may not finalize a determination to grant or deny a petition submitted under subparagraph (A) before the date that is 1 year after the date on which the first report under subsection (h) of section 101 is submitted after the date on which the review under subsection (c) of that section is completed.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H339C600C6CCD4DA9B9D742AD3B271056"><enum>(iii)</enum><header>Public availability</header><subclause commented="no" display-inline="no-display-inline" id="H3D2270E4AD0446AFA4D8BFD9270FA6F8"><enum>(I)</enum><header>In general</header><text display-inline="yes-display-inline">In making a determination to grant or deny a petition submitted under subparagraph (A), the Administrator shall—</text><item commented="no" display-inline="no-display-inline" id="HCECD63F3D03B4CBB8CEF8A87A9B42183"><enum>(aa)</enum><text display-inline="yes-display-inline">make all materials submitted with the petition available for public review and comment for a period of not less than 180 days; and</text></item><item commented="no" display-inline="no-display-inline" id="HAA778FFC58E34CB4A32988A3FB41FD2E"><enum>(bb)</enum><text>consider all public comments submitted with respect to the materials made available under item (aa).</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="H5BE8192EC0C34E53BFA0042291523F96"><enum>(II)</enum><header>Confidential business information</header><text>Subclause (I) shall be carried out in accordance with section 14 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2613">15 U.S.C. 2613</external-xref>).</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H47865C26434744849F284B2C4A5B07B3"><enum>(D)</enum><header>Expedited consideration</header><text>The Administrator shall, to the maximum extent practicable, expedite the consideration of petitions submitted under subparagraph (A) from a Federal agency.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H606B6021AE2640A685625FF1E1D2126D"><enum>(E)</enum><header>Termination of petition process</header><text>The Administrator shall continue to accept petitions under this paragraph until such time as all perfluoroalkyl or polyfluoroalkyl substances and uses of perfluoroalkyl or polyfluoroalkyl substances are eliminated in accordance with the policy described in section 103(a).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2C7A058A867444D28730EFAB90E2FB75"><enum>(3)</enum><header>Alternative designation process</header><subparagraph commented="no" display-inline="no-display-inline" id="H55E79C6AB5BA41F79DD39C4CF611EAD6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">On a continuing basis and in consultation with relevant Federal agencies as the Administrator determines necessary, the Administrator may review and, through a public rulemaking, designate as a nonessential use or an essential use a use of a perfluoroalkyl or polyfluoroalkyl substance.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD5A18C5E0224487096EFF6E7B676A3AF"><enum>(B)</enum><header>Requirement</header><text>The decision of the Administrator to designate a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use under subparagraph (A) shall be consistent with—</text><clause commented="no" display-inline="no-display-inline" id="H9E16DDB4DCA14BDC975C01B24A659007"><enum>(i)</enum><text display-inline="yes-display-inline">the best available science; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H582CEBD3C7F344D7A95A0A155C551CD1"><enum>(ii)</enum><text>the applicable recommendations or other analysis, if any, under a report under section 101(h) (including a subsequent report).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7476D93B26B344DD9CB00EB67C5A4D5C"><enum>(C)</enum><header>Timeline</header><clause commented="no" display-inline="no-display-inline" id="H2C1CC851B33343F7AC6510F1ED1EA93D"><enum>(i)</enum><header display-inline="yes-display-inline">Report required</header><text>The Administrator may not designate a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use under subparagraph (A) before the date that is 1 year after the date on which the first report under subsection (h) of section 101 is submitted after the date on which the review under subsection (c) of that section is completed.</text></clause><clause commented="no" display-inline="no-display-inline" id="H2907EACDC0004794844A1BF97522B17D"><enum>(ii)</enum><header display-inline="yes-display-inline">Public review</header><text>Before designating a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use under subparagraph (A), the Administrator shall publish the proposed designation for public review and comment for a period of not less than 180 days.</text></clause><clause commented="no" display-inline="no-display-inline" id="H6151F76D0592496AA01AE7691107AC89"><enum>(iii)</enum><header>Final designation</header><text>The Administrator shall publicly issue a final designation of a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use under subparagraph (A) by not later than 270 days after the date on which the public review and comment period under clause (ii) ends. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8F7AF70374B442C1A284EECEAE5D9FD3"><enum>(4)</enum><header>Data transparency</header><text>The Administrator may, to inform a designation under paragraph (2) or (3), require a manufacturer, user, person who manufacturers equipment for a manufacturer or user, person who the Administrator believes may have necessary information to inform a designation under paragraph (2) or (3), or a person subject to the requirements of this title or an amendment made by this title to provide relevant information (on a 1-time, periodic, or continuing basis for such timeframe as the Administrator determines appropriate).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H989FCDC122364A7A804054D98F0B53E1"><enum>(5)</enum><header>Required petitions</header><subparagraph commented="no" display-inline="no-display-inline" id="HDD2F3E031882491988F5DDCE7077662C"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text>Stakeholders shall use the petition process under paragraph (2) to identify and list products and processes that use a perfluoroalkyl or polyfluoroalkyl substance that have a use in a product that is required to be used under Federal law (including regulations), Federal standards, or Federal Government specifications. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H59252E39F1DF49D7ACD718184853C2DD"><enum>(B)</enum><header display-inline="yes-display-inline">Submission to other agencies</header><text>If the Administrator receives a petition under paragraph (2) or begins to carry out the alternative designation process under paragraph (3) with respect to a use described in subparagraph (A), the Administrator shall, on receipt of the petition, share the petition with the head of the Federal agency that required the use for a review and comment period of not less than 30 days.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3BD717ED4D9E42958B5E5B0E49D155D6"><enum>(6)</enum><header>Review of previous designations</header><text display-inline="yes-display-inline">The Administrator may, pursuant to a petition from a petitioner or at the discretion of the Administrator, review the designation of a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use and redesignate that use as a nonessential use or an essential use in accordance with the process under which the designation was originally made.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H76882C9F44B84930AE3EF25FE486B76D"><enum>(d)</enum><header>Administrator prioritization discretion</header><text>The Administrator may prioritize the establishment of a report under this section or a designation of the use of a class or subclass perfluoroalkyl or polyfluoroalkyl substances as a nonessential use or an essential use under subsection (c) in accordance with—</text><paragraph commented="no" display-inline="no-display-inline" id="H36F10A17DDDA4CBDBEBFDADA71445003"><enum>(1)</enum><text display-inline="yes-display-inline">the National PFAS Testing Strategy of the Environmental Protection Agency (or a successor strategy); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H85591924567043E2BDCFCC088AA85248"><enum>(2)</enum><text>any other method that is based on the best available science. </text></paragraph></subsection><subsection id="H38A9F825819B4C93A894208331A8EAF4"><enum>(e)</enum><header>Prohibition of sales of nonessential perfluoroalkyl or polyfluoroalkyl substances</header><paragraph id="H22A1A73138924C9C93FEA9E6E47B9C7A"><enum>(1)</enum><header>In general</header><text>Beginning on the date that is 10 years after the date of enactment of this Act, a manufacturer or user shall not engage in the sale of perfluoroalkyl or polyfluoroalkyl substances that remain in the possession of the manufacturer or user on that date for nonessential uses.</text></paragraph><paragraph id="HDD3A7E8DD7114534B546E7EEE3350D07"><enum>(2)</enum><header>Perfluoroalkyl or polyfluoroalkyl substance stocks</header><text>The Administrator may approve verifiable transfers of perfluoroalkyl or polyfluoroalkyl substance stocks in the possession of a manufacturer or user to an accredited research consortium, including Centers of Excellence, National Laboratories of the Department of Energy, institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), and other relevant entities that contribute to the achievement of the policy described in section 103(a). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCB770ACC89F948BE88C01706A0ED1A12"><enum>(3)</enum><header>Savings provision</header><text>Nothing in this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="H928C9106AAB04BA5A549698ABB7D36BC"><enum>(A)</enum><text display-inline="yes-display-inline">affects an obligation of a manufacturer or user to comply with a regulation or requirement associated with the removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H59B215903FD1436BBE70059C19D059C0"><enum>(B)</enum><text>prohibits a manufacturer or user from using a method of removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance in accordance with applicable law. </text></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD71AE352F27F49CB98F8E4714BF29D93"><enum>103.</enum><header>United States perfluoroalkyl or polyfluoroalkyl substance policy</header><subsection commented="no" display-inline="no-display-inline" id="H68855F74A50140C6B867D4156D23743F"><enum>(a)</enum><header display-inline="yes-display-inline">General policy</header><text>It is the policy of the United States that, to the maximum extent practicable and as permitted under applicable law—</text><paragraph commented="no" display-inline="no-display-inline" id="H65A4E86AE5E04CB58E9A113478B56025"><enum>(1)</enum><text display-inline="yes-display-inline">contamination of any environmental media by a perfluoroalkyl or polyfluoroalkyl substance should be remediated to levels that do not present an unreasonable risk to public health and the environment;</text></paragraph><paragraph id="H7C750D7D623341A0B3817682E1A5ED56"><enum>(2)</enum><text>the destruction and disposal of perfluoroalkyl or polyfluoroalkyl substances—</text><subparagraph id="HCD8105056C814986A8BD889ECEF1BADA"><enum>(A)</enum><text>is considered most essential to the elimination of perfluoroalkyl or polyfluoroalkyl substances, which are also known as <quote>forever chemicals</quote>; and</text></subparagraph><subparagraph id="HE2F177E77BD542908C2DBBDEEC61908E"><enum>(B)</enum><text>should be prioritized as part of any perfluoroalkyl or polyfluoroalkyl substance remediation strategy in a manner that presents the lowest risk of environmental release and the lowest risk to public health and the environment; </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1588CDE0714541EDAF318344ED0B3E78"><enum>(3)</enum><text display-inline="yes-display-inline">the use of perfluoroalkyl or polyfluoroalkyl substances in consumer products should be eliminated; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB2B23E57D2BB4EA2BBEAC7E17A7359F1"><enum>(4)</enum><text display-inline="yes-display-inline">in cases in which the use of perfluoroalkyl or polyfluoroalkyl substances is essential, in accordance with any applicable report under section 101(h) (including a subsequent report), and no safer alternative for that use is available, those perfluoroalkyl or polyfluoroalkyl substances should be removed or replaced by chemicals, product substitutes, or alternative manufacturing processes that reduce overall risk to human health and the environment, including risks due to chronic, acute, and cumulative impacts. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3FCAA645A78B4FA5AF0D26039C950BBA"><enum>(b)</enum><header>Federal procurement</header><paragraph commented="no" display-inline="no-display-inline" id="HC16EFB0E785949B38934CBC199151748"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date of enactment of this Act, the heads of Federal agencies, in coordination with the Administrator and the Administrator of General Services, shall, to the maximum extent practicable, eliminate the procurement of products known to contain perfluoroalkyl or polyfluoroalkyl substances.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB6A795CE867E4D4C82867E38998B9FB5"><enum>(2)</enum><header>Survey</header><text>In carrying out paragraph (1), the heads of Federal agencies may—</text><subparagraph commented="no" display-inline="no-display-inline" id="H2ED7B82995E84325A838FA442C8E03DB"><enum>(A)</enum><text display-inline="yes-display-inline">carry out surveys of the products procured by the Federal agency to determine whether the products contain perfluoroalkyl or polyfluoroalkyl substances; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1139F27E2CC443FD90482B42630B867E"><enum>(B)</enum><text>pause or cease procurement of products that have not been identified as not containing perfluoroalkyl or polyfluoroalkyl substances within a reasonable timeline that accounts for—</text><clause commented="no" display-inline="no-display-inline" id="H7B9FF7913D60430A8404F76408DB18E4"><enum>(i)</enum><text display-inline="yes-display-inline">survey completion and product return; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H41EFA12569A247269166C12DC4CB5025"><enum>(ii)</enum><text>identifying and securing safer alternatives for the product.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE6AEC00B3A3B4DDDB36C4E3267F6DDD3"><enum>(c)</enum><header>Best available science</header><text>A determination that an action complies with the policy described in subsection (a) or an action taken under subsection (b) shall be based on the best available science.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H2666D256FFDA4967A174854C4B192FE8"><enum>(d)</enum><header>Savings provision</header><text>Nothing in this section affects any other duty or obligation under Federal law.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H1532E61700C34C6B8C6C2F8D1B606609"><enum>104.</enum><header>Perfluoroalkyl or polyfluoroalkyl substance release phaseout</header><subsection commented="no" display-inline="no-display-inline" id="HD7993663F1B24AC2BCBECAFA5F334486"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Beginning on the date that is 10 years after the date of enactment of this Act, it shall be unlawful for any manufacturer or user to release any quantity of perfluoroalkyl or polyfluoroalkyl substance above the threshold of detection of a detection method for perfluoroalkyl or polyfluoroalkyl substances that is validated by the Administrator in a manner that permits that perfluoroalkyl or polyfluoroalkyl substance to enter the environment.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H9A43B3C29ABE4FF3AEB6263B967FA45D"><enum>(b)</enum><header>Rulemaking required</header><paragraph commented="no" display-inline="no-display-inline" id="H2318957D2F134DC7A4312AD97D279A14"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 7 years after the date of enactment of this Act and after a period of notice and opportunity for public comment, the Administrator shall finalize a rule that—</text><subparagraph commented="no" display-inline="no-display-inline" id="HA0AAACBB02B943B985C9B0C31B99F555"><enum>(A)</enum><text display-inline="yes-display-inline">establishes a schedule for the phaseout of the releases above the threshold of detection described in subsection (a) by the date described in that subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8860BD15136042A19D9F07715E1FDB56"><enum>(B)</enum><text>establishes applicable detection methods and relevant thresholds.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4C194A75C4D64A12B79D0DC65968F467"><enum>(2)</enum><header>Update</header><text>The Administrator may update, in whole or in part, the schedule required under subparagraph (A) of paragraph (1) in accordance with that paragraph.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8153AE86A10949229587AFDADD253412"><enum>(3)</enum><header>Early adoption</header><text>The Administrator may, in accordance with the policy described in section 103(a) and after a period of notice and opportunity for public comment, finalize a rule before the rule required under paragraph (1) that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H4A4C88FAB9B946EEB05821369B4E3BE9"><enum>(A)</enum><text display-inline="yes-display-inline">establishes a schedule for the phaseout or banning of releases of individual perfluoroalkyl or polyfluoroalkyl substances, mixtures of perfluoroalkyl or polyfluoroalkyl substances, or subclasses of perfluoroalkyl or polyfluoroalkyl substances above the threshold of detection described in subsection (a) by the date described in that subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5509982646CA4BD3955CA0DEFC9811BE"><enum>(B)</enum><text>establishes applicable detection methods and relevant thresholds.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7FA8BE84A24448ECBF411ADBFBA56D2B"><enum>(c)</enum><header>Savings provision</header><text>Nothing in this section affects any other duty or obligation under any other Federal law.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HAABFC345694445B9B705E2778A0FDFE2"><enum>105.</enum><header>Use for research</header><subsection commented="no" display-inline="no-display-inline" id="H642CB3869A2D4D398783C8ADD524C3CB"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text>Notwithstanding any other provision of this title, the Administrator may allow the use and detectable release of perfluoroalkyl or polyfluoroalkyl substances described in subsections (b) and (c) that do not place unreasonable risk on human health or the environment for research, development, testing, and other similar purposes to assist in the achievement of the policy described in section 103(a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H26D4754C25364AC1A6C200AF58F8944D"><enum>(b)</enum><header>Remaining stocks of perfluoroalkyl or polyfluoroalkyl substances</header><paragraph commented="no" display-inline="no-display-inline" id="H2F4A3007697A40F197F60E7106420CBE"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A manufacturer or user with remaining stocks of perfluoroalkyl or polyfluoroalkyl substances in the possession of the manufacturer or user following cessation of the manufacture or use of perfluoroalkyl or polyfluoroalkyl substances may enter into an agreement with the Administrator, an accredited research consortium, including Centers of Excellence, National Laboratories of the Department of Energy, institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)), and other relevant entities, as determined by the Administrator, in order for such stocks to be available for use in accordance with subsection (a).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3F8E990EF5F94D54A75040E73C5BF29A"><enum>(2)</enum><header>Requirement</header><text>The Administrator may only enter into an agreement under paragraph (1) if the actions to be carried out under that agreement directly contribute to the achievement of the policy described in section 103(a), as determined by the Administrator.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1050168B74164790BFE948DA62B0D6EE"><enum>(3)</enum><header>Savings provision</header><text>Nothing in this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF0C04A12CAA547A7B7816B5142F76A7C"><enum>(A)</enum><text display-inline="yes-display-inline">affects an obligation of a manufacturer or user to comply with a regulation or requirement associated with the removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3F253756593944FCB1F4027BA143ABE2"><enum>(B)</enum><text>prohibits a manufacturer or user from using a method of removal, disposal, or destruction of a perfluoroalkyl or polyfluoroalkyl substance in accordance with applicable law. </text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0F71B63489DF4E119F6AF4CFD22CC9DF"><enum>(c)</enum><header>Prohibition</header><text>It shall be unlawful to develop or produce a perfluoroalkyl or polyfluoroalkyl substance solely for the purposes of activities authorized under subsection (a) unless the Administrator determines it necessary to comply with the policy described in section 103(a).</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H3CDA59CCB9924FDFB31F0CD26C1B71B4"><enum>106.</enum><header>Inspections, monitoring, and entry</header><subsection commented="no" display-inline="no-display-inline" id="H85CC07DB048F4544A67BC125E125341C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of determining whether a person is in violation of this title or an amendment made by this title or for the purposes of carrying out any provision of this title or an amendment made by this title—</text><paragraph commented="no" display-inline="no-display-inline" id="HF6A3717A5A064542B843C59C8CEC5944"><enum>(1)</enum><text display-inline="yes-display-inline">the Administrator may require any manufacturer, user, person who manufactures equipment for a manufacturer or user, person who the Administrator believes may have information necessary for the purposes described in this paragraph, or person who is subject to the requirements of this title or an amendment made by this title, on a 1-time, periodic, or continuous basis—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCEC88C14DFD540D0956D9D9A16D52CB3"><enum>(A)</enum><text>to install, use, and maintain such monitoring equipment, and use such audit procedures or methods, as the Administrator may require;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H65CD77874AED4E68933D0FBB63B92F62"><enum>(B)</enum><text>to sample such releases (in accordance with such procedures or methods, at such locations, at such intervals, during such periods, and in such manner as determined by the Administrator) as the Administrator may require;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF0BCE25825E24E2F84D71066D502CD62"><enum>(C)</enum><text>to keep such records on control equipment parameters, production variables, or other equivalent indirect data as the Administrator may require when direct monitoring of releases is impractical;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8565DC2D15DC44E1A66EBAFF6A544A95"><enum>(D)</enum><text>to provide such other information as the Administrator may require; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5900CC093F884AC58F027A9CF381FE64"><enum>(E)</enum><text>to provide records and reports within 30 days of the date of a request by the Administrator for that record or report; and</text></subparagraph></paragraph><paragraph id="H7A039B62C0B543CD934389DAD768B76A"><enum>(2)</enum><text>the Administrator (including an authorized representative of the Administrator), on presentation of the credentials of the Administrator (or authorized representative of the Administrator) shall—</text><subparagraph commented="no" display-inline="no-display-inline" id="H5A54D8DD74F2484E86920E9880E352C1"><enum>(A)</enum><text display-inline="yes-display-inline">have a right of entry to, on, or through any premises of the person or any premises in which any records required to be maintained under paragraph (1) are located; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5E07C381CE044DCFBC0D0CA5C082E5A1"><enum>(B)</enum><text>at reasonable times, have a right to access and copy any records, to inspect any monitoring equipment or method required under paragraph (1), and to sample any releases that the person is required to sample under that paragraph.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC8E7F2950868444DAC60A0803B44C409"><enum>(b)</enum><header>Public availability</header><text>Any record, report, or information obtained by the Administrator under subsection (a) shall, subject to section 14 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2613">15 U.S.C. 2613</external-xref>), be made available to the public as soon as reasonably practicable. </text></subsection></section><section commented="no" display-inline="no-display-inline" id="HBF84C6C73E274E6ABB9854220D6D0D35"><enum>107.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="H89F3054DEE2A4077A1BD860D018BE7ED"><enum>(a)</enum><header>Compliance orders</header><paragraph commented="no" display-inline="no-display-inline" id="H9352CA8526E142228CB37F8F9B152264"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Except as provided in paragraph (2), whenever, on the basis of any information, the Administrator determines that a person may have violated, or may be in violation of, any requirement of this title or an amendment made by this title, the Administrator may—</text><subparagraph commented="no" display-inline="no-display-inline" id="H7335ADE3D16A48328C508734FA50B7CD"><enum>(A)</enum><text display-inline="yes-display-inline">issue an order—</text><clause commented="no" display-inline="no-display-inline" id="H5050854C132345A6800064DF78CBD4C6"><enum>(i)</enum><text display-inline="yes-display-inline">assessing a civil penalty for any past or current violation in an amount that the Administrator determines would remove any economic benefit from the violation;</text></clause><clause commented="no" display-inline="no-display-inline" id="H1DE9314FB1C24110A607079AC781876A"><enum>(ii)</enum><text>requiring compliance with that requirement, either immediately or within a specified period of time; or</text></clause><clause commented="no" display-inline="no-display-inline" id="HBFED340AA0E5488ABEF9DB812860CFF7"><enum>(iii)</enum><text>that both assesses a civil penalty in accordance with clause (i) and requires compliance in accordance with clause (ii); or</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H47E264FDD446458DA0D26ECA1F6DE36A"><enum>(B)</enum><text>commence a civil action for appropriate relief, including a temporary or permanent injunction, in the United States district court for—</text><clause commented="no" display-inline="no-display-inline" id="H5323C1CE8E5648E386A0E5DAFD6E6F61"><enum>(i)</enum><text display-inline="yes-display-inline">the district in which the violation is alleged to have occurred, or is occurring; or </text></clause><clause commented="no" display-inline="no-display-inline" id="H9F647990464D465281D877DC91E006C5"><enum>(ii)</enum><text display-inline="yes-display-inline">the district in which the defendant resides or in which the principal place of business of the defendant is located.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H805B1FB2334A4D3DAD7411D3760E186F"><enum>(2)</enum><header>Notice to State</header><text display-inline="yes-display-inline">Before issuing an order or commencing an action under paragraph (1) for a violation of a requirement of this title or an amendment made by this title, the Administrator shall give notice to the State in which the violation is alleged to have occurred.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H506CAE1D0F8F4028B7691CAFDA877345"><enum>(3)</enum><header>Suspension and revocation</header><text>An order issued pursuant to this subsection—</text><subparagraph commented="no" display-inline="no-display-inline" id="HF9F01C9E98024164A413216FB7262446"><enum>(A)</enum><text display-inline="yes-display-inline">may include a suspension or revocation of any use of a perfluoroalkyl or polyfluoroalkyl substance authorized under this title by the Administrator or a State; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3902D1BD8D8940A78D0B60952C53D1AB"><enum>(B)</enum><text>shall state with reasonable specificity the nature of the violation for which the order was issued.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC3557DBA59D480E88B47C76797FA616"><enum>(4)</enum><header>Civil penalty</header><subparagraph commented="no" display-inline="no-display-inline" id="H3E1C9A3E795B4FEFA912BE5670DCC7C5"><enum>(A)</enum><header>Factors</header><text display-inline="yes-display-inline">In assessing a civil penalty under paragraph (1)(A)(i), the Administrator shall take into account, as applicable—</text><clause commented="no" display-inline="no-display-inline" id="HAD9520BAC74340899F0BF2581C3DAC28"><enum>(i)</enum><text display-inline="yes-display-inline">the seriousness of the violation;</text></clause><clause commented="no" display-inline="no-display-inline" id="H113DA4E8331B4E40984DA3FC71AD3956"><enum>(ii)</enum><text display-inline="yes-display-inline">the full compliance history of the defendant and any good faith efforts to comply;</text></clause><clause commented="no" display-inline="no-display-inline" id="HC2D4BD2615F34153BD74D8578F5C2278"><enum>(iii)</enum><text>the size of the business of the defendant;</text></clause><clause commented="no" display-inline="no-display-inline" id="H7889E78E0A874D889B06D3EF8B658C19"><enum>(iv)</enum><text>the economic impact of the penalty on the business of the defendant;</text></clause><clause commented="no" display-inline="no-display-inline" id="HF2D5CC602F4C4620977FDF2D370D7EEB"><enum>(v)</enum><text>the duration of the violation, as established by credible evidence (including evidence other than the applicable test method);</text></clause><clause commented="no" display-inline="no-display-inline" id="H6AB3FA164CCC4C4EB49C00835002D848"><enum>(vi)</enum><text>the amount of penalties previously assessed for the same violation;</text></clause><clause commented="no" display-inline="no-display-inline" id="H53D3105AA6504A6C882EB7A0B69F02DA"><enum>(vii)</enum><text>the economic benefit of the violation;</text></clause><clause commented="no" display-inline="no-display-inline" id="H5728A06711F84D368556BEB0537B7F9C"><enum>(viii)</enum><text>the cumulative impacts of—</text><subclause commented="no" display-inline="no-display-inline" id="H797E25DCAD2A4358BEB9C95AC9C54E24"><enum>(I)</enum><text display-inline="yes-display-inline">the full compliance history of the defendant and any good faith efforts to comply; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H4B8CC8BAB15143409BA1BD6B221B2B52"><enum>(II)</enum><text>other environmental contaminant exposures in impacted communities and ecosystems; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H9EF5A9E73AB0433587E69F8120C28CCA"><enum>(ix)</enum><text>any other factor that justice may require.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE7F86ADE2F8748EAA8FF4266A73056C3"><enum>(B)</enum><header>Savings provision</header><text>Nothing in this paragraph affects the existing authority of the Administrator to exercise enforcement discretion, including consideration of supplemental environmental projects.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H059DFC14F476440B9A834EDE02283292"><enum>(b)</enum><header>Violation of compliance orders</header><text>If a person subject to an order issued under subsection (a)(1) fails to take corrective action within the period specified in that order, the Administrator may assess a civil penalty in an amount that the Administrator determines would remove any economic benefit from the violation for each day of continuing violation in accordance with subsection (a)(4). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="H8E976A2856B44E788DB50E280C5898D0"><enum>(c)</enum><header>Criminal penalties</header><text>A person who recklessly violates any material condition or requirement of any applicable standard under this title (including regulations) or an amendment made by this title shall, on conviction, be subject to—</text><paragraph commented="no" display-inline="no-display-inline" id="HFCDDEDB29974469193722D06D408CABA"><enum>(1)</enum><text display-inline="yes-display-inline">a fine in an amount that the Administrator determines removes any economic benefit of the violation for each day of continuing violation;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H13A12EEE2D0143D599FA0E1F2F733AFD"><enum>(2)</enum><text>imprisonment for a period of not more than 5 years; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD7892472608144009177CFF8D78C4B0F"><enum>(3)</enum><text>both a fine under paragraph (1) and imprisonment under paragraph (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1860FC09BBD14F3CB983180BCAC99141"><enum>(d)</enum><header>Relationship to other laws</header><text>The Administrator shall carry out this title and amendments made by this title in accordance with—</text><paragraph commented="no" display-inline="no-display-inline" id="H9ABE3400B9DD4870A78E75E651E791C3"><enum>(1)</enum><text display-inline="yes-display-inline">the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1A1535A08AF148F792589AF274080D43"><enum>(2)</enum><text>the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2601">15 U.S.C. 2601 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0382E2E3309943759BC197571207D942"><enum>(3)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF13B3A1B9230415EB1579AEA47F7C367"><enum>(4)</enum><text>the Marine Protection, Research, and Sanctuaries Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/33/1401">33 U.S.C. 1401 et seq.</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H66A583D55A184B96AD85D4600120D9DC"><enum>(5)</enum><text>the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300f">42 U.S.C. 300f et seq.</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA0747AEACC7C483BB5138B29730E16CA"><enum>(6)</enum><text>the Solid Waste Disposal Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) (commonly known as the <quote>Resource Conservation and Recovery Act of 1976</quote>).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H2339A9284B20456EB78D9E899FAD5EB7"><enum>108.</enum><header>Citizen suits</header><subsection commented="no" display-inline="no-display-inline" id="HE3E3FBA9D3224A4AB78DC6B94E11921C"><enum>(a)</enum><header display-inline="yes-display-inline">Citizen suits authorized</header><paragraph commented="no" display-inline="no-display-inline" id="HEF1AC1AF67B34101822D75345C193EDB"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsections (b) and (c), any person may commence a civil action on their own behalf against—</text><subparagraph commented="no" display-inline="no-display-inline" id="H35EA2FF3174045B795AACB0E447494D1"><enum>(A)</enum><text display-inline="yes-display-inline">any manufacturer or user subject to the requirements of this title or an amendment made by this title (including a manufacturer, user, the United States, and, to the extent permitted by the 11th Amendment of the Constitution of the United States, any other governmental instrumentality or agency) that is alleged to be in violation of any standard, regulation, condition, requirement, prohibition, schedule, deadline, or order under this title;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H487BC669132F4160924948529991C62E"><enum>(B)</enum><text>any manufacturer or user subject to the requirements of this title or an amendment made by this title (including the United States and, to the extent permitted by the 11th Amendment of the Constitution of the United States, any other governmental instrumentality or agency) that is using a perfluoroalkyl or polyfluoroalkyl substance that may present an imminent and substantial endangerment to human health or the environment; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA13309F3E104347BD3DCC9D1D3C9A62"><enum>(C)</enum><text>the Administrator, if the Administrator is alleged to have failed to perform any act or duty under this title that is not discretionary.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD6A482885975444CBF9A4779BEBE2A92"><enum>(2)</enum><header>Jurisdiction</header><subparagraph commented="no" display-inline="no-display-inline" id="H542F3535A19E41EE977CAB37ED3B29CA"><enum>(A)</enum><header display-inline="yes-display-inline">Appropriate courts</header><clause commented="no" display-inline="no-display-inline" id="H6CFA2EF2A1344BE99B4CDBF4EED87402"><enum>(i)</enum><header>Violations and endangerment claims</header><text display-inline="yes-display-inline">An action brought under subparagraph (A) or (B) of paragraph (1) shall be brought in the district court for the district in which the alleged violation or endangerment occurred.</text></clause><clause commented="no" display-inline="no-display-inline" id="H49054C6D5B0841ADA54AAE4B0A8A60F5"><enum>(ii)</enum><header>Claims against the Administrator</header><text>An action brought under paragraph (1)(C) may be brought in—</text><subclause commented="no" display-inline="no-display-inline" id="HCDB284DBAF8849089EA3B652E939989E"><enum>(I)</enum><text display-inline="yes-display-inline">the United States district court for the district in which the alleged violation occurred; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HAEE581E6F81C4F6690A5DB5817A89B73"><enum>(II)</enum><text>the United States District Court for the District of Columbia.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H52F8FD26CFF44E24901DBE1EE4BCA314"><enum>(B)</enum><header>Authority</header><text display-inline="yes-display-inline">A district court described in subparagraph (A) shall have jurisdiction—</text><clause commented="no" display-inline="no-display-inline" id="H9BD502CFE56D4104AE132AFE28CA8888"><enum>(i)</enum><text display-inline="yes-display-inline">with respect to an action described in paragraph (1)(A), to enforce the standard, regulation, condition, requirement, prohibition, schedule, deadline, or order described in that paragraph;</text></clause><clause commented="no" display-inline="no-display-inline" id="H2B9A83F617B64E9F84724A1D6FF72CE8"><enum>(ii)</enum><text>with respect to an action described in paragraph (1)(B), to order a person described in that of the perfluoroalkyl or polyfluoroalkyl substance that may be contributing to the imminent and substantial endangerment;</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HE0C779A4942B4614A162F58738F26493"><enum>(II)</enum><text display-inline="yes-display-inline">to take any action as may be necessary to prevent the imminent and substantial endangerment described in that paragraph; or</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HAF4AE0BEA6B6464AB23F44718010DA6B"><enum>(III)</enum><text display-inline="yes-display-inline">to carry out any combination of actions described in subclauses (I) and (II);</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H25A791585ACD488C8C9CBFA7781DA31A"><enum>(iii)</enum><text>with respect to an action described in paragraph (1)(C), to order the Administrator to perform the act or duty referred to in that paragraph; and</text></clause><clause commented="no" id="HAD71557581F04B7BBD84AC4CB993BF0B"><enum>(iv)</enum><text>with respect to any action described in paragraph (1), to apply any appropriate civil remedy under this title.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC2BFE05A8CC948299A21B39E38AFAB13"><enum>(b)</enum><header display-inline="yes-display-inline">Additional requirements</header><paragraph commented="no" display-inline="no-display-inline" id="H86083A9FB5594F029C7B0B208BCEC93F"><enum>(1)</enum><header display-inline="yes-display-inline">Actions for enforcement of requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="HD6863F7BFDB2435AB987651E5846E4CA"><enum>(A)</enum><header>Notice of violation</header><clause commented="no" display-inline="no-display-inline" id="HE73C89568DFC4E1DA8218FC88D37F66C"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">No action may be brought under subsection (a)(1)(A) unless, not less than 60 days before the date on which the action is brought, notice of the violation of the standard, regulation, condition, requirement, prohibition, schedule, deadline, or order for which the action would display-inline="no-display-inline" id="H9F75E8D1C61B42D29FD6CE743BC0BFF8"><enum>(ii)</enum><header>Exception</header><text>Notwithstanding clause (i)(III), an action may be brought under subsection (a)(1)(A) immediately after the notice described in that clause is provided to the alleged violator if the action is for a violation of this title.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5E1C0250907949F592313F26EBD94B7C"><enum>(B)</enum><header>No action if suit ongoing</header><text>No action may be brought under subsection (a)(1)(A) if the Administrator or a State has commenced and is diligently prosecuting a civil or criminal action in a court of the United States or a State to require compliance with the standard, regulation, condition, requirement, prohibition, schedule, deadline, or order for which the action under subsection (a)(1)(A) would be brought.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H840050BABE3C43D5A7B3E59DF30C3A43"><enum>(C)</enum><header>Intervention as matter of right</header><text>In an action under brought under subsection (a)(1)(A) in a court of the United States, any person may intervene as a matter of right. </text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H69A2D175AC944F9E9034D280BF2EA0A2"><enum>(2)</enum><header>Actions for endangerment</header><subparagraph commented="no" display-inline="no-display-inline" id="H4A065160A0F24A8AAD574F6CC62A67BB"><enum>(A)</enum><header display-inline="yes-display-inline">Notice of endangerment</header><text display-inline="yes-display-inline">No action may be brought under subsection (a)(1)(B) unless, not less than 90 days before the date on which the action is brought, notice of the imminent and substantial endangerment to human health or the environment is provided to—</text><clause commented="no" display-inline="no-display-inline" id="HDACA879558514F72BDFCEB7E84008E4E"><enum>(i)</enum><text display-inline="yes-display-inline">the Administrator; </text></clause><clause commented="no" display-inline="no-display-inline" id="H7BF6C19AD2F74CCEA8B65697A96BEB40"><enum>(ii)</enum><text>the State in which the endangerment may occur; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HCC10853FAFA64A83B14263DD758E3790"><enum>(iii)</enum><text>the person that is alleged to be contributing to the use of the perfluoroalkyl or polyfluoroalkyl substance causing the endangerment.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1923D85EC00043A98604D86863334730"><enum>(B)</enum><header>No action if suit is ongoing</header><text>No action may be commenced under subsection (a)(1)(B) if the Administrator, in order to restrain or abate acts or conditions that may have contributed or are contributing to the activities which may present the alleged endangerment, has commenced and is diligently acting on an authority provided under an applicable law. </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5530184F14DC4EC69066020524C9B405"><enum>(C)</enum><header>Intervention as matter of right</header><text>In an action under brought under subsection (a)(1)(B) in a court of the United States, any person may intervene as a matter of right.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEBDD3CA082694CBA902D4FA376952140"><enum>(D)</enum><header>Notice of action</header><text display-inline="yes-display-inline">A person bringing an action under subsection (a)(1)(B) in a court of the United States shall serve a copy of the complaint on—</text><clause commented="no" display-inline="no-display-inline" id="HC979E57764984BD7926EEBAB63A4475F"><enum>(i)</enum><text display-inline="yes-display-inline">the Attorney General; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HEBB936255A6043EA8CAB2F4E64B28A80"><enum>(ii)</enum><text>the Administrator.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H91AAABBFBC1B41869E6E23BF4E44E232"><enum>(3)</enum><header>Actions against the Administrator</header><subparagraph commented="no" display-inline="no-display-inline" id="HF38AA1A4343842789CEAB0D12D8C2D9A"><enum>(A)</enum><header>Notice to Administrator</header><text display-inline="yes-display-inline">No action may be brought under subsection (a)(1)(C) unless, not less than 60 days before the date on which the action is brought, the person bringing the action has given notice to the Administrator of the intent to bring the action.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEE06040F22534F82B9D3B0D9E2044E32"><enum>(B)</enum><header>Form</header><text>The Administrator shall prescribe the form in which the notice under subparagraph (A) shall be provided.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H153C3E5D53DB4C7CB22E25C4AA9004C4"><enum>(c)</enum><header>Costs</header><paragraph commented="no" display-inline="no-display-inline" id="H8DE0415455804365A04BC937E29455B1"><enum>(1)</enum><header>Attorney and expert witness fees</header><text display-inline="yes-display-inline">A court, in issuing any final order in an action brought pursuant to this section, may award the costs of litigation (including reasonable attorney and expert witness fees) to the prevailing or substantially prevailing party, as the court determines to be appropriate.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE95C7C8E6C804902AD494C8E45C852D6"><enum>(2)</enum><header>Bond</header><text>A court, in any action brought pursuant to this section in which a temporary restraining order or preliminary injunction is sought, may require the filing of a bond or equivalent security in accordance with the Federal Rules of Civil Procedure.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HC73E0EAC6B7F4450BC6C1510A661F6BF"><enum>109.</enum><header>Imminent hazard</header><subsection commented="no" display-inline="no-display-inline" id="H8A87E27F44A34951A980B742DC89673D"><enum>(a)</enum><header display-inline="yes-display-inline">Authority of the Administrator</header><text>Notwithstanding any other provision of this title or an amendment made by this title, on receipt of evidence that the use of any perfluoroalkyl or polyfluoroalkyl substance presents an imminent and unreasonable risk of serious or widespread injury to public health or environment, without consideration of costs or other nonrisk factors, the Administrator may issue an order to or bring suit against any manufacturer or user subject to the requirements of this title or an amendment made by this title that is determined by the Administrator to be causing the imminent and unreasonable risk—</text><paragraph commented="no" display-inline="no-display-inline" id="HE79E0BA7A1A545A0871CD3FC75CF6884"><enum>(1)</enum><text display-inline="yes-display-inline">to restrain that manufacturer or user from that use;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8C39E51CB1434B628521E3A42B2EA174"><enum>(2)</enum><text>to order that manufacturer or user to take such other action as may be necessary; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H86349D233B81494F8A705E16FBCFFA3F"><enum>(3)</enum><text>for the purposes described in paragraphs (1) and (2).</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H171E30E6C5704D8B92FB521055491BAC"><enum>(b)</enum><header>Violations</header><text>A manufacturer or user who willfully violates, or fails or refuses to comply with, any order of the Administrator under subsection (a) may, in an action brought in the appropriate United States district court to enforce that order, be fined in an amount that the Administrator determines removes any economic benefit of noncompliance for each day in which the violation occurs or the failure to comply continues.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H95FFCE85E09C4399B5CFFF80FEB5BD89"><enum>(c)</enum><header>Immediate notice</header><text>On receipt of information that there is a perfluoroalkyl or polyfluoroalkyl substance that presents an imminent and substantial endangerment to human health or the environment, the Administrator shall require the violating manufacturer or user, at cost to the violating manufacturer or user—</text><paragraph commented="no" display-inline="no-display-inline" id="H3E0B5FE19D844DC6BB5E8D0BF2B2A5C7"><enum>(1)</enum><text display-inline="yes-display-inline">to provide immediate and public notice, within an estimated radius of impact as determined appropriate by the Administrator, to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H92B9F3E6B02A47B0BE3A248A09BFAC77"><enum>(A)</enum><text display-inline="yes-display-inline">the appropriate local government agencies and public services, including impacted utilities, including drinking water treatment plants, and public health, law enforcement, and environmental protection officials; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H467EB3EB0BB54914B6D1023AD4BCF026"><enum>(B)</enum><text>the community in which the endangerment is occurring, including publicly accessible areas of community congregation, including community recreation and health centers, public libraries, public schools, government offices, online message boards, listservs, and social media used by members of that community, and not-for-profit community services;</text></subparagraph></paragraph><paragraph id="H1C90C52F3EDB47EC9727A2686D27B9A2"><enum>(2)</enum><text>to require—</text><subparagraph commented="no" display-inline="no-display-inline" id="HCEC8577F398E4636A4EB064FD612BC60"><enum>(A)</enum><text display-inline="yes-display-inline">immediate and public notice to impacted members of the community that is provided across communication media and is easily accessible; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC6B5DAE9D0AE43798D3DFD328BE2F4F2"><enum>(B)</enum><text>public meetings, in partnership with the Administrator and local authorities and leaders, for direct community engagement to provide health, safety, and additional information to the community and to field questions and concerns; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4D86FAAB2E64F3A9BD9FEFE41C48649"><enum>(3)</enum><text>to provide regular updates with respect to the endangerment in accordance with the methods described in paragraphs (1) and (2).</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H8EDBE41C82564DFF8622DAC8FEDF1C91"><enum>110.</enum><header>Application of Federal, State, and local law to Federal agencies</header><subsection commented="no" display-inline="no-display-inline" id="H04AE8A26E80E411DA21DB2D7B46E4C60"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HF340EEA02B5F411CBA3EE6247DEC50DC"><enum>(1)</enum><header>Covered agency</header><text display-inline="yes-display-inline">The term <term>covered agency</term> means a department, agency, or instrumentality of the executive, legislative, or judicial branch of the Federal Government that—</text><subparagraph commented="no" display-inline="no-display-inline" id="H71680BE8D4F64B3E8998B21691BB00BE"><enum>(A)</enum><text display-inline="yes-display-inline">has jurisdiction over a facility that manufactures a perfluoroalkyl or polyfluoroalkyl substance; or</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H831AC35E385E472294EE8D3EF7D7BE8F"><enum>(B)</enum><text>is engaged in any activity that results, or may result, in the treatment, disposal, or release of a perfluoroalkyl or polyfluoroalkyl substance into the environment.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF7FA4BDE01654CFA862714FAD70D95AC"><enum>(2)</enum><header>Reasonable service charge</header><text>The term <term>reasonable service charge</term>, with respect to a requirement under Federal, State, interstate, or local law, includes—</text><subparagraph commented="no" display-inline="no-display-inline" id="HEBE23D254967405A9DD7FBFB1EDD16B0"><enum>(A)</enum><text display-inline="yes-display-inline">fees or charges assessed in connection with enforcement, compliance, and investigation activities with respect to that requirement; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H72015D3ABC1D4827AAF97DB7C9DFDAC4"><enum>(B)</enum><text>any other nondiscriminatory charge that is assessed in connection with a Federal, State, interstate, or local perfluoroalkyl or polyfluoroalkyl regulatory program.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA57ECD940725431F9F2F32C16AF05787"><enum>(b)</enum><header>Applicability of laws</header><paragraph commented="no" display-inline="no-display-inline" id="HF9FE7740713A49109C3B1C6BB0EE34FB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Each covered agency shall be subject to, and comply with, all Federal, State, interstate, and local laws regulating perfluoroalkyl or polyfluoroalkyl substances, including substantive and procedural requirements, in the same manner and to the same extent as any person that is subject to those requirements, including any requirements for the payment of reasonable service charges. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA375D0232D6D4D3EAF4763018DE98B35"><enum>(2)</enum><header>Inclusions</header><text>The Federal, State, interstate, and local requirements, including substantive and procedural requirements, described in paragraph (1) include—</text><subparagraph commented="no" display-inline="no-display-inline" id="HBE839B3D48904CEEB703D479FC4166B3"><enum>(A)</enum><text display-inline="yes-display-inline">an administrative order; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB92229F83C8C4ECE928D59FC1ADD165F"><enum>(B)</enum><text>a civil or administrative penalty or fine, regardless of whether that penalty or fine is—</text><clause commented="no" display-inline="no-display-inline" id="H005256CBC7C742C78210676BB9A74EEA"><enum>(i)</enum><text display-inline="yes-display-inline">punitive or coercive in nature; or</text></clause><clause commented="no" display-inline="no-display-inline" id="H24D90774E1384C2099CDE502BB80AF0C"><enum>(ii)</enum><text>imposed for isolated, intermittent, or continuing violations.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H219238EDC673448CA686C71413CF3A56"><enum>(c)</enum><header>Waiver of immunity</header><paragraph commented="no" display-inline="no-display-inline" id="HE9530B86DBFE4754BB558554522315C7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The United States expressly waives any immunity otherwise applicable to the United States with respect to a Federal, State, interstate, or local requirement described in subsection (b)(1), including any immunity with respect to injunctive relief, an administrative order, or a civil or administrative penalty or fine described in subsection (b)(2)(B).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5EBD36C297584844BE563763E9D7D780"><enum>(2)</enum><header>No exemption</header><text>Neither the United States nor an agent, employee, or officer of the United States shall be immune or exempt from any process or sanction of any Federal or State court with respect to the enforcement of any injunctive relief described in paragraph (1).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE4336871137D435D9E3FB98CCBF93E7D"><enum>(3)</enum><header>No personal liability</header><text>No agent, employee, or officer of the United States shall be personally liable for any civil penalty under any Federal, State, interstate, or local law regulating perfluoroalkyl or polyfluoroalkyl substances with respect to any act or omissions that is within the scope of the official duties of the agent, employee, or officer.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H67789B11C4424DC188609CE08F0B4DBB"><enum>(4)</enum><header>Criminal liability</header><text>An agent, employee, or officer of the United States shall be subject to any criminal sanction (including fine or imprisonment) under any Federal or State law regulating perfluoroalkyl or polyfluoroalkyl substances, but no department, agency, or instrumentality of the Federal Government shall be subject to such a criminal sanction.</text></paragraph></subsection><subsection id="HBF074188E7D5465FBDD646370BEDB98D"><enum>(d)</enum><header>Exemption</header><paragraph commented="no" display-inline="no-display-inline" id="H1462EA84003246FC9C8A1A7309DACE30"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (4), the President may exempt, in direct consultation with the Administrator, any department, agency, or instrumentality of the executive branch of the Federal Government from compliance with a requirement under a Federal, State, interstate, or local law regulating perfluoroalkyl or polyfluoroalkyl substances if the President determines that the exemption is in the paramount interest of the United States.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA72C270BF8DD45D191F69EB3168D9A78"><enum>(2)</enum><header>Requirements</header><subparagraph commented="no" display-inline="no-display-inline" id="H7570F39CECD1403098395FFD46EC73B5"><enum>(A)</enum><header display-inline="yes-display-inline">Term</header><text>An exemption under paragraph (1) shall be for a period of not to exceed 1 year.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC354A83A0C354229896BED151ADD5AD6"><enum>(B)</enum><header>Renewal</header><text>The President may, in accordance with paragraph (1), renew an exemption under that paragraph for a period not to exceed 1 year for each renewal.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H84F9555CC73C4BA59DADBC45443BD40B"><enum>(C)</enum><header>Report to Congress</header><text>Not later than January 31 of each year, the President shall submit to Congress a report that describes all exemptions granted under paragraph (1) during the previous calendar year, including a description of the reason for each exemption.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE464C9380214457DA5EC79D5CEAC659E"><enum>(3)</enum><header>Public notice of exemption</header><subparagraph commented="no" display-inline="no-display-inline" id="HAABED5010DA745FB8A44559EA5D5C854"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the President, the Administrator, and the head of the department, agency, or instrumentality subject to an exemption under paragraph (1) shall immediately make public the exemption, including any renewal of an exemption under paragraph (2)(B).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3E3A997FDD0442239157DBA689901E8E"><enum>(B)</enum><header>Waiver of public notice requirement</header><text>The President, in consultation with the Administrator, may waive the requirement under subparagraph (A) if the President, in consultation with the Administrator, determines that the waiver is in the paramount interest of national security.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8A21F6D8506A4DFC8AB35D4E759BFDCA"><enum>(4)</enum><header>No exemption for lack of appropriations</header><text>The President may not grant an exemption under paragraph (1) due to a lack of appropriation of amounts to comply with a requirement described in that paragraph. </text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD87874CB40C840DBB6044D2C0B921D4B"><enum>111.</enum><header>Judicial review</header><subsection commented="no" display-inline="no-display-inline" id="H8A91835E29954ED1A2735AAA380C3122"><enum>(a)</enum><header>Review of final regulations and certain petitions</header><paragraph commented="no" display-inline="no-display-inline" id="H2724304970894D6A9B50953C4569454A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) and (3), any judicial review of a final regulation promulgated pursuant to this title or an amendment made by this title or a denial by the Administrator for a petition for the promulgation, amendment, or repeal of a regulation under this title or an amendment made by this title shall be in accordance with this title and any amendments made by this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6E6E7C92CA345AD8236F2A64615183F"><enum>(2)</enum><header>Limitations on bringing claims</header><subparagraph commented="no" display-inline="no-display-inline" id="H8045D305251C4510877A174A86AA965D"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">A petition for the judicial review of an action of the Administrator in promulgating any regulation or requirement under this title or an amendment made by this title, or the denial of any petition for the promulgation, amendment, or repeal of a regulation under this title or an amendment made by this title, may only be brought—</text><clause commented="no" display-inline="no-display-inline" id="H525165D560C048F3B97BDA8CAC3AB61D"><enum>(i)</enum><text display-inline="yes-display-inline">in the United States Court of Appeals for the District of Columbia; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H0DCC154551FA4C0DA401F127A5794CC5"><enum>(ii)</enum><text>subject to subparagraph (B), not later than 90 days after the date on which the promulgation or denial occurred.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5BFBAC00038444749617B62AF87639D0"><enum>(B)</enum><header>Exception</header><text>A petition described in subparagraph (A) may be brought after the 90-day period described in clause (ii) of that subparagraph if the petition is based solely on grounds that arose after the end of that 90-day period.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B6C4B3FD2A84CDEAB9C84E0FBDD251F"><enum>(C)</enum><header>No review</header><text>An action of the Administrator with respect to which review could have been obtained under this subsection within the 90-day period described in subparagraph (A)(ii), but was not, shall not be subject to judicial review in any civil or criminal proceeding for enforcement of this title or an amendment made by this title.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2DB98B4B3B2941AA8336E9B0DCB9073F"><enum>(3)</enum><header>Proceedings for actions for which notice and comment is required</header><subparagraph commented="no" display-inline="no-display-inline" id="H6499802FF4394689809B34A185AE907A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to a petition for the judicial review of a determination for which this title or an amendment made by this title requires notice and opportunity for hearing, if the party seeking the judicial review applies to the court for leave to adduce additional evidence, and demonstrates to the satisfaction of the court that the evidence is material and that there were reasonable grounds for the failure to adduce that evidence in the proceeding before the Administrator, the court may order that—</text><clause commented="no" display-inline="no-display-inline" id="H9230B816789541A1BBDD177E18311EA2"><enum>(i)</enum><text display-inline="yes-display-inline">additional evidence (and any rebuttal evidence) be taken before the Administrator; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HC6C8C4AA8BCD46E9AF2B3E7C774C1F4C"><enum>(ii)</enum><text>the Administrator adduce that evidence in the hearing in such a manner and on such terms and conditions as the court determines to be appropriate.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5774629E00A94463B84118A0518ED2A0"><enum>(B)</enum><header>Revision</header><text>Based on any evidence adduced pursuant to subparagraph (A)(ii), the Administrator—</text><clause commented="no" display-inline="no-display-inline" id="H93C1D8CD8B7F4AFCB7D589497E2949AC"><enum>(i)</enum><text display-inline="yes-display-inline">may—</text><subclause commented="no" display-inline="no-display-inline" id="H2F00E9CDFBCE494C98A4CA1E0D47FF88"><enum>(I)</enum><text display-inline="yes-display-inline">modify the findings of the Administrator as to the facts; or </text></subclause><subclause commented="no" display-inline="no-display-inline" id="H6BA220B2360D4BDD980342ABE4298DAB"><enum>(II)</enum><text display-inline="yes-display-inline">make new findings; and</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H43B7C7D481084D1AAF179CD9654510E3"><enum>(ii)</enum><text>if applicable, shall file with the court—</text><subclause commented="no" display-inline="no-display-inline" id="HF3B38CBA4C104663A3E76254280A29B0"><enum>(I)</enum><text display-inline="yes-display-inline">any modified or new findings made; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H27E4A8C5B2CC45D19F192573EFE255B8"><enum>(II)</enum><text>the recommendation of the Administrator, if any, regarding whether to modify or set aside the determination of the Administrator being reviewed.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H39198BECBD994244879C9D589B19017A"><enum>(C)</enum><header>Return of evidence</header><text>On filing the findings and recommendations required under subparagraph (B)(ii), the Administrator shall return any additional evidence that had been adduced.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H58BD9A379F2044989712036769B6100B"><enum>(b)</enum><header>Review of other actions</header><paragraph commented="no" display-inline="no-display-inline" id="H372D2425BAA44E26900B5FB10A6BD7DA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text>Any interested person may, in the court of appeals of the United States for the judicial circuit in which the person resides or transacts business, apply for review of the actions of the Administrator in carrying out any mandatory duties required under this title or an amendment made by this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H55B55D2F134E4542AD6F9EA795E236E4"><enum>(2)</enum><header>Time limitations</header><subparagraph commented="no" display-inline="no-display-inline" id="HCB485BA13CD649EF9C22057216B91632"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), an application for review under paragraph (1) shall be made not later than 90 days after the date of the applicable issuance, denial, modification, revocation, grant, or withdrawal.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD46532CAB6EB4E779FE3C1C82CF3C92C"><enum>(B)</enum><header>Exception</header><text>An application for review under paragraph (1) may be made after the date described in subparagraph (A) only if the application is based solely on grounds that arose after the end of the 90-day period described in that subparagraph.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77C8A19FCAD3406E8883552EA07DD165"><enum>(3)</enum><header>No later review</header><text>An action of the Administrator with respect to which review could have been obtained under paragraph (1) within the 90-day period described in paragraph (2)(B), but was not, shall not be subject to judicial review in any civil or criminal proceeding for enforcement of this title or an amendment made by this title.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6A4273F8820242CAA3CC50B19B4B1E77"><enum>(4)</enum><header>Requirement</header><text>A review under paragraph (1) shall be carried out in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H4E32B7E17941418E91C23F98D6326C7B"><enum>(c)</enum><header>Statutory or common law rights not restricted</header><text>Nothing in this title or an amendment made by this title restricts any right that a person or class of persons may have under statutory or common law to seek enforcement of this title or an amendment made by this title or to seek any other relief (including relief against the Administrator or a State agency).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HF2C9A4DC8FF94A9F92BA99196D706E3C"><enum>(d)</enum><header>Nonrestriction of other rights</header><text display-inline="yes-display-inline">Nothing in this title or an amendment made by this title or in any other law of the United States prohibits, excludes, or restricts any State, local, or interstate authority from bringing any enforcement action or obtaining any judicial remedy or sanction in any State or local court with respect to the manufacture or release of perfluoroalkyl or polyfluoroalkyl substances.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="HAF96404463AB4D0283DA1530766F6612"><enum>112.</enum><header>Regulatory authority</header><subsection commented="no" display-inline="no-display-inline" id="H457A29634C5B4B1EB9F24E7010B4AD93"><enum>(a)</enum><header>General authority</header><text display-inline="yes-display-inline">The Administrator may promulgate such regulations as are necessary to carry out this title and the amendments made by this title consistent with the policy described in section 103(a).</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HBD9E6B73F07B477ABCAED537F2C4FF10"><enum>(b)</enum><header>Requirement</header><text>In carrying out any rulemaking under this title or an amendment made by this title that requires a period of notice and opportunity for public comment, that rulemaking shall be carried out in accordance with section 553 of title 5, United States Code.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H8AC448CC809F409A8E206454A834D0F6"><enum>113.</enum><header>Funding</header><subsection commented="no" display-inline="no-display-inline" id="HD97BDC35A2724B5AB676B66EECA6BBD5"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Administrator such sums as may be necessary to carry out this title and the amendments made by this title, except for section 101(i), for each of fiscal years 2024 through 2033.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H4069542222E34EA2B65B0631AD732231"><enum>(b)</enum><header>Fee collection</header><paragraph commented="no" display-inline="no-display-inline" id="HF587FE184B6D4CC39CE61F484EB7551B"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="HD8AE18E0545E4992945CD2CF5926282C"><enum>(A)</enum><header>Petition fee</header><text>The term <term>petition fee</term> means the fee established by the Administrator under paragraph (2)(B)(i)(II) to submit a petition to designate a use of a perfluoroalkyl substance as a nonessential use or an essential use under section 102(c).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H907AD2951BE248259EC878A32EE9F577"><enum>(B)</enum><header>Small manufacturer</header><text>The term <term>small manufacturer</term> has the meaning given the term in section 704.3 of title 40, Code of Federal Regulations (or successor regulations).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6AACD76A981C43FAA4134FA5DA200E7E"><enum>(C)</enum><header>Supplemental report fee</header><text>The term <term>supplemental report fee</term> means the fee established by the Administrator under paragraph (2)(B)(i)(I) to submit a supplemental report under subparagraph (B) of section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCA39FCFCEDA74094877DC3DF5B18BD31"><enum>(2)</enum><header display-inline="yes-display-inline">Establishment of fees</header><subparagraph commented="no" display-inline="no-display-inline" id="H40728366D0F54BCBB40470A5331C1FFB"><enum>(A)</enum><header display-inline="yes-display-inline">Workload assessment analysis</header><text>Not later than 180 days after the date of enactment of this Act, the Administrator shall complete a workload assessment analysis with respect to the costs expected on the Administrator to carry out this title and the amendments made by this title, which may include an examination of the impacts of a reduced fee for small manufacturers under subparagraph (C).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H875A939B705945EEBC61501144A80E92"><enum>(B)</enum><header>Rulemaking</header><clause commented="no" display-inline="no-display-inline" id="HBE9D019308C74E0B91D63018DF97D667"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Administrator completes the workload assessment analysis under subparagraph (A), and using that workload assessment analysis, the Administrator shall complete a public and transparent rulemaking to establish the requirements and fees necessary to submit—</text><subclause commented="no" display-inline="no-display-inline" id="H41542B88940946AF8AD5A1055DE3E388"><enum>(I)</enum><text display-inline="yes-display-inline">the supplemental reports under subparagraph (B) of section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>), including any necessary requirements for supplemental reports under that subparagraph; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="HF6D5467F3C624CBEB562B3FD13145856"><enum>(II)</enum><text>a petition to designate a use of a perfluoroalkyl or polyfluoroalkyl substance as a nonessential use or an essential use under section 102(c), which shall include—</text><item commented="no" display-inline="no-display-inline" id="HE1411A040AB74080976476257394CEE0"><enum>(aa)</enum><text display-inline="yes-display-inline">a separate fee for each use for which a designation is requested in the petition; and</text></item><item commented="no" display-inline="no-display-inline" id="H42A85F1AD6594062A5650C34D9BB88C4"><enum>(bb)</enum><text>any necessary requirements for the petition process under that section.</text></item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="H1ABF668017C4484188F7A0E14F62DBC9"><enum>(ii)</enum><header>Public review and comment</header><text>The 1-year period described in clause (i) shall include not less than 90 days for public review and comment on the proposed rulemaking under that clause.</text></clause><clause commented="no" display-inline="no-display-inline" id="HC4C0C53B420840D69EA118286291864D"><enum>(iii)</enum><header>Factors</header><text>In determining the amount of the supplemental report fee and the petition fee in the rulemaking required under clause (i), the Administrator—</text><subclause commented="no" display-inline="no-display-inline" id="H037B1CF461F24D0C9C3F19152AEB6651"><enum>(I)</enum><text display-inline="yes-display-inline">shall consider—</text><item commented="no" display-inline="no-display-inline" id="HF5E18A5770894428875689FEBFCC4432"><enum>(aa)</enum><text display-inline="yes-display-inline">usage of perfluoroalkyl or polyfluoroalkyl substances;</text></item><item commented="no" display-inline="no-display-inline" id="H2C8FF53E920448AF9DA978486E7BE61F"><enum>(bb)</enum><text>the volume of used perfluoroalkyl or polyfluoroalkyl substances; and</text></item><item id="H4EB89C7C13294943B8FE87BA1CA6C8BF"><enum>(cc)</enum><text>the known toxicological risks of individual perfluoroalkyl or polyfluoroalkyl substances, mixtures of perfluoroalkyl or polyfluoroalkyl substances, and subclasses of perfluoroalkyl or polyfluoroalkyl substances, as determined by sources of information determined relevant by the Administrator, including the National PFAS Testing Strategy and the Computational Toxicology Chemicals Dashboard of the Environmental Protection Agency; and</text></item></subclause><subclause commented="no" display-inline="no-display-inline" id="HCA57791B646D4BF0A699034AE3695BCD"><enum>(II)</enum><text>may consider the expected total annual costs of administering the non-discretionary provisions of this title, including collecting, processing, reviewing, providing access to, and protecting from disclosure confidential business information that is subject to section 14 of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2613">15 U.S.C. 2613</external-xref>). </text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2E8F410BEBDB46A5847F30E98BD6F1D8"><enum>(C)</enum><header>Small manufacturers</header><text display-inline="yes-display-inline">The Administrator may, in the rulemaking required under subparagraph (B)(i), reduce the supplemental report fee and the petition fee for small manufacturers.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAEF7A86A5ACE485C98D5119786F0E75C"><enum>(D)</enum><header>Timeline; required minimum fees</header><clause commented="no" display-inline="no-display-inline" id="H71DCDAB5CC7B45A0B31442BB05298F98"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text>The Administrator shall finalize the amount of the supplemental report fee and the petition fee, including any reduced fees for small manufacturers under subparagraph (C), by the date that is not later than 2 years after the date of enactment of this Act.</text></clause><clause commented="no" display-inline="no-display-inline" id="HD9A63B83DCB64B52AA4CBDD37C0F4C87"><enum>(ii)</enum><header>Required fee</header><text>If the Administrator fails to finalize the amount of the supplemental report fee and the petition fee within the 2-year period described in clause (i)—</text><subclause commented="no" display-inline="no-display-inline" id="H36F5C7CD15714F26B765AF9EFDE05275"><enum>(I)</enum><text display-inline="yes-display-inline">the amount of the supplemental report fee shall be $100,000 for each supplemental report submitted under subparagraph (B) of section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>), which may be lower for small manufacturers as determined by the Administrator; and </text></subclause><subclause commented="no" display-inline="no-display-inline" id="HD9FB5DC7537B4374BCC052262B18D03C"><enum>(II)</enum><text>the amount of the petition fee shall be $100,000 for each petition submitted under section 102(c), which may be lower for small id="H24FC145EACA34C829C80AA9EDD981B99"><enum>(iii)</enum><header>Finalization of amounts</header><text>Nothing in this subparagraph requires the Administrator to use the minimum fee amounts imposed by clause (ii) after completion of the rulemaking process required under subparagraph (B), even if that rulemaking process is not completed within the 2-year period described in clause (i).</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H37905CD0BE4F48C68EAA5EFA1435ADAA"><enum>(3)</enum><header>Adjustment of fee amounts</header><subparagraph commented="no" display-inline="no-display-inline" id="HFCCCE41F009E42C9976D7D9240BEA632"><enum>(A)</enum><header display-inline="yes-display-inline">Adjustment for inflation</header><clause commented="no" display-inline="no-display-inline" id="H31E35C36EF714BBB8DBD0A2A6684C93F"><enum>(i)</enum><header>In general</header><text display-inline="yes-display-inline">On the date that is 3 years after the date on which the Administrator establishes the amount of the supplemental report fee and the petition fee, and every 3 years thereafter, the Administrator shall adjust the amount of the supplemental report fee and the petition fee to reflect changes for the 36-month period ending the preceding November 30 in the Consumer Price Index for All Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor.</text></clause><clause commented="no" display-inline="no-display-inline" id="HEF7D400DA8C04E6DA62C71CCA84B7F3B"><enum>(ii)</enum><header>Adjustment of mandatory minimums</header><text>If the minimum fee amounts under paragraph (2)(D)(ii) are in effect, clause (i) shall be applied by substituting <quote>the date on which the Administrator establishes the amount of the supplemental report fee and the petition fee</quote> for <quote>the date on which minimum fee amounts under paragraph (2)(D)(ii) come into effect</quote> until such time as the Administrator completes the rulemaking process required under paragraph (2)(B).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5F48C82F425F4DDAA9A75F86493AA609"><enum>(B)</enum><header>Additional adjustment</header><text>In addition to the adjustment required under subparagraph (A), the Administrator may, after a period of notice and opportunity for public comment, further adjust the amount of the supplemental report fee and the petition fee.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0AA58FBB742C4F87B54F24EB36780B47"><enum>(4)</enum><header>Waiver of fees</header><text>The Administrator shall waive the petition fee for any petition from a Federal agency or a State agency to designate a use of a perfluoroalkyl substance as a nonessential use or an essential use under section 102(c).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8D3E6375CD2944899735EC2D7F370A37"><enum>(5)</enum><header>Funds</header><subparagraph commented="no" display-inline="no-display-inline" id="H232DC5ED2E3E4A798BD1D57596293C71"><enum>(A)</enum><header display-inline="yes-display-inline">PFAS Report Assessment Fund</header><clause commented="no" display-inline="no-display-inline" id="H174727CD929448A2A0844EF4FBD203DB"><enum>(i)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>PFAS Report Assessment Fund</quote>, to be administered by the Administrator.</text></clause><clause commented="no" display-inline="no-display-inline" id="H37676746B6A247548A98D24E5111B29E"><enum>(ii)</enum><header>Deposits</header><text>Each fiscal year, the Secretary of the Treasury shall deposit into the PFAS Report Assessment Fund an amount equal to all supplemental report fees collected during the previous fiscal year.</text></clause><clause commented="no" display-inline="no-display-inline" id="H500D91F0335F42F6B231830E5026BFF2"><enum>(iii)</enum><header>Contents</header><text>The PFAS Report Assessment Fund shall consist of—</text><subclause commented="no" display-inline="no-display-inline" id="H7E22929909844CFDAE8D60F66CF67208"><enum>(I)</enum><text display-inline="yes-display-inline">amounts deposited by the Secretary of the Treasury under clause (ii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H3F7B9DCA4D554EF58647CD327DD90458"><enum>(II)</enum><text>any appropriations made by Congress.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HD969BE005B3C421D956DE2EA5A18E1C4"><enum>(iv)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Amounts in the PFAS Report Assessment Fund may be used, without further appropriation, to carry out subparagraph (B) of section 8(a)(7) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2607">15 U.S.C. 2607(a)(7)</external-xref>).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7682B2727B4D406086FFB0987D8FD011"><enum>(B)</enum><header display-inline="yes-display-inline">PFAS Petition Assessment Fund</header><clause commented="no" display-inline="no-display-inline" id="H351B240A27664F9AA19ADBFC7E9D1D00"><enum>(i)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury a fund, to be known as the <quote>PFAS Petition Assessment Fund</quote>, to be administered by the Administrator.</text></clause><clause commented="no" display-inline="no-display-inline" id="H04E08E15B73C47E0A3DBA415C1C17D69"><enum>(ii)</enum><header>Deposits</header><text>Each fiscal year, the Secretary of the Treasury shall deposit into the PFAS Petition Assessment Fund an amount equal to all petition fees collected during the previous fiscal year.</text></clause><clause commented="no" display-inline="no-display-inline" id="H4EE43837B7B54652825E67018BC60056"><enum>(iii)</enum><header>Contents</header><text>The PFAS Petition Assessment Fund shall consist of—</text><subclause commented="no" display-inline="no-display-inline" id="H9FE6871E973A4A7392CF59EB131EC75F"><enum>(I)</enum><text display-inline="yes-display-inline">amounts deposited by the Secretary of the Treasury under clause (ii); and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="H0BAA243795E1443EBA99F0A001054ECB"><enum>(II)</enum><text>any appropriations made by Congress.</text></subclause></clause><clause commented="no" display-inline="no-display-inline" id="HB0988E9864AC49EFAEA75568CF3B3167"><enum>(iv)</enum><header>Use of funds</header><text display-inline="yes-display-inline">Amounts in the PFAS Petition Assessment Fund may be used, without further appropriation, to carry out section 102(c).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDD92571CA1AE44009D2661C779D33E62"><enum>(C)</enum><header>Interfund transfers</header><text>The Administrator may, at the discretion of the Administrator and without further appropriation, transfer amounts between the PFAS Report Assessment Fund and the PFAS Petition Assessment Fund.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H254D4CA559DE4832A7995C6E118C358B"><enum>(6)</enum><header>Termination of fees</header><text>The Administrator may terminate collection of the supplemental report fee and the petition fee only after the Administrator determines, using a rulemaking with a public comment period of not less than 90 days, a science-based reason that the fee program is no longer necessary.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H9A3E212D3D3B479DBC46ED8DE2189DEE"><enum>114.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title, an amendment made by this title, or the application of that provision or amendment to any person or circumstance is held to be unconstitutional, the remainder of this title and the amendments made by this title, and the application of the provision or amendment to any other person or circumstance, shall not be affected.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="H26D54C06A4684BE5B6AB66D7C30051A3"><enum>115.</enum><header>Retention of State authority</header><subsection commented="no" display-inline="no-display-inline" id="H68C5A6B1089C4917A940A63D5B06E230"><enum>(a)</enum><header>General policy</header><paragraph commented="no" display-inline="no-display-inline" id="H58BFD856EDF8435EAE39A122E7E9BF96"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), beginning on the effective date of the regulations to carry out this title or an amendment made by this title, no State or political subdivision of a State may impose any requirement that is less stringent than the requirements under this title (including regulations) or an amendment made by this title with respect to the same matters that are regulated under this title (including regulations) or amendment.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H328D6C8D87294288A9E3BF2C893A3F29"><enum>(2)</enum><header>Exception</header><text>If the application of any requirement under this title (including regulations) or an amendment made by this title is postponed or enjoined by action of a court, a State or political subdivision of a State may impose requirements described in paragraph (1) until such time as the requirements under this title (including amendments made by this title) take effect.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF9F3915CE71F4A20B64F9A3E27A42B03"><enum>(b)</enum><header>Savings provision</header><text>Nothing in this title or an amendment made by this title prohibits a State or political subdivision of a State from imposing requirements that are more stringent than those imposed by this title (including regulations) or an amendment made by this title.</text></subsection></section></title><title id="H9ACCE7985FE1434CB72C76EC9A82107F" style="OLC"><enum>II</enum><header>Other matters with respect to perfluoroalkyl or polyfluoroalkyl substances</header><section id="H05F8BEA9FF1547F7BB68EBED83ADC5BE"><enum>201.</enum><header>Centers of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions</header><subsection id="H8ED8DEA1DCD14EA29417B1A7E5CEC1CA"><enum>(a)</enum><header>Purpose</header><text>The purpose of this section is to dedicate resources to advancing, and expanding access to, perfluoroalkyl or polyfluoroalkyl substance detection and remediation science, research, and technologies through Centers of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions.</text></subsection><subsection id="HEF952E710A894617B94C3280D705F304"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H1D39FFC131D8443CAF9A40D5DFFB1DA2"><enum>(1)</enum><header>Appropriate committees of congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="H1FB1DCB4D366478580550D6013514BEE"><enum>(A)</enum><text>the congressional defense committees (as defined in section 101(a) of title 10, United States Code);</text></subparagraph><subparagraph id="HEF5ACF8945354EF892D2991450DEFFE7"><enum>(B)</enum><text>the Committee on Environment and Public Works, the Committee on Energy and Natural Resources, and the Committee on Veterans’ Affairs of the Senate; and</text></subparagraph><subparagraph id="H3CD59E6263AB468A8F6309196F2F4AA8"><enum>(C)</enum><text>the Committee on Energy and Commerce, the Committee on Natural Resources, the Committee on Science, Space, and Technology, and the Committee on Veterans’ Affairs of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H9AC3AE83933243F9B659DD31450954F8"><enum>(2)</enum><header>Center</header><text>The term <term>Center</term> means the Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions established under subsection (c)(1)(A).</text></paragraph><paragraph id="H01AF1552AD4646C3AC5CA1A8A4EF7F0B"><enum>(3)</enum><header>Centers</header><text>The term <term>Centers</term> means—</text><subparagraph id="H5890E7C83CAD4E00BE2F6A2F34B896DA"><enum>(A)</enum><text>the Center; and</text></subparagraph><subparagraph id="HEE6A8770F70E4E1D897DAD9932FFA58F"><enum>(B)</enum><text>the Rural Center.</text></subparagraph></paragraph><paragraph id="HF4BD0730E70E443FA69573C5953D545C"><enum>(4)</enum><header>Eligible research university</header><text>The term <term>eligible research university</term> means an institution of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>)) that—</text><subparagraph id="HE467A08777E0450F817C387A2EED4758"><enum>(A)</enum><text>has annual research expenditures of not less than $750,000,000; and</text></subparagraph><subparagraph id="H52CD244B6D9241CEAA2D4391AD6BF6CA"><enum>(B)</enum><text>is located near a population center of not fewer than 5,000,000 individuals.</text></subparagraph></paragraph><paragraph id="H3CCBDF5E73A84C6FA8AF65760BCE9D9A"><enum>(5)</enum><header>Eligible rural university</header><text>The term <term>eligible rural university</term> means an institution of higher education that—</text><subparagraph id="HE2734CF56E3D4CBA9FF86A906CCA0681"><enum>(A)</enum><text>is located in a State described in section 1703(d)(1)(C)(iii)(I) of title 38, United States Code; and</text></subparagraph><subparagraph id="H79651FF928BE4EEF8E01FABF06D62C2A"><enum>(B)</enum><text>is a member of the National Security Innovation Network in the Rocky Mountain Region.</text></subparagraph></paragraph><paragraph id="HD26CB69973024B6C8EC9FADF47C9B462"><enum>(6)</enum><header>EPA method 533</header><text>The term <term>EPA Method 533</term> means the method described in the document of the Environmental Protection Agency entitled <quote>Method 533: Determination of Per- and Polyfluoroalkyl Substances in Drinking Water by Isotope Dilution Anion Exchange Solid Phase Extraction and Liquid Chromatography/Tandem mass Spectrometry</quote> (or a successor document).</text></paragraph><paragraph id="H459AF1A3DA604B6DA3B25E5864AF46D5"><enum>(7)</enum><header>EPA method 537.1</header><text>The term <term>EPA Method 537.1</term> means the method described in the document of the Environmental Protection Agency entitled <quote>Determination of Selected Per- and Polyfluorinated Alkyl Substances in Drinking Water by Solid Phase Extraction and Liquid Chromatography/Tandem Mass Spectrometry (LC/MS/MS)</quote> (or a successor document).</text></paragraph><paragraph id="HA1FB8F39B3CB42D5B2E7A0751D8A77D8"><enum>(8)</enum><header>National laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>).</text></paragraph><paragraph id="H91E54E435A7C4B84BCD74B07AB33DF1F"><enum>(9)</enum><header>Rural Center</header><text>The term <term>Rural Center</term> means the Rural Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions established under subsection (c)(1)(B).</text></paragraph></subsection><subsection id="HEA0902FE5890490591B8B5B32FEF086A"><enum>(c)</enum><header>Establishment</header><paragraph id="H83143481B80C40419C2E7E647A2AFBF1"><enum>(1)</enum><header>In general</header><text>The Administrator shall—</text><subparagraph id="H76C99981FEA94F9D8C6607DD5CB3BE74"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H3E09D94FE9F34DF8B8231586765D4C18"><enum>(i)</enum><text>select from among the applications submitted under paragraph (2)(A) an eligible research university and a National Laboratory applying jointly for the establishment of a center, to be known as the <quote>Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions</quote>, which shall be a bi-institutional collaboration between the eligible research university and National Laboratory co-applicants; and</text></clause><clause commented="no" display-inline="no-display-inline" indent="up1" id="H8477FB88B8C344118D76B44AAB01F99F"><enum>(ii)</enum><text>guide and assist the eligible research university and National Laboratory in the establishment of that center; and</text></clause></subparagraph><subparagraph id="H0BDF97279D3842B8A614FBC0FE03B284"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H17069B92BD2B4EF9BB772D898EA68FA4"><enum>(i)</enum><text>select from among the applications submitted under paragraph (2)(B) an eligible rural university for the establishment of an additional center, to be known as the <quote>Rural Center of Excellence for Assessing Perfluoroalkyl and Polyfluoroalkyl Substances in Water Sources and Perfluoroalkyl and Polyfluoroalkyl Substance Remediation Solutions</quote>; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H71D279CE1F4243F7AC5F2FD954B5C3AF" indent="up1"><enum>(ii)</enum><text>guide and assist the eligible rural university in the establishment of that center. </text></clause></subparagraph></paragraph><paragraph id="HFBDBE23FC7D24656ADBA70480377D4D8"><enum>(2)</enum><header>Applications</header><subparagraph id="H305F66AAE41A4EEF996E6AEC3F9F12BF"><enum>(A)</enum><header>Center</header><clause id="HF62D1A1222DC4E39A8A16231C888B6CA"><enum>(i)</enum><header>In general</header><text>An eligible research university and National Laboratory desiring to establish the Center shall jointly submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></clause><clause id="HC96E813FA6704F969B903BAB965B8752"><enum>(ii)</enum><header>Criteria</header><text>In evaluating applications submitted under clause (i), the Administrator shall only consider applications that—</text><subclause id="HBFF290152CE44FA095219F25D6BBAF1B"><enum>(I)</enum><text>include evidence of an existing partnership between the co-applicants that is dedicated to supporting and expanding shared scientific goals with a clear pathway to collaborating on furthering science and research relating to perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause id="H92C00C5158B742CF8E09EBBF35BAB9ED"><enum>(II)</enum><text>demonstrate a history of collaboration between the co-applicants on the advancement of shared research capabilities, including instrumentation and research infrastructure relating to perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause id="HECA5F67F4C36444F8B7EE24B2F339DB1"><enum>(III)</enum><text>indicate that the co-applicants have the capacity to expand education and research opportunities for undergraduate and graduate students to prepare a generation of experts in sciences relating to perfluoroalkyl or polyfluoroalkyl substances;</text></subclause><subclause id="HE20617E4252A44D7810AE40F903C939C"><enum>(IV)</enum><text>demonstrate that the National Laboratory co-applicant is equipped to scale up newly discovered materials and methods for perfluoroalkyl or polyfluoroalkyl substance detection and perfluoroalkyl or polyfluoroalkyl substance removal processes for low-risk, cost-effective, and validated commercialization; and</text></subclause><subclause id="H0E31D481B6C242C280CA81CCA1B3A9AD"><enum>(V)</enum><text>identify 1 or more staff members of the eligible research university co-applicant and 1 or more staff members of the National Laboratory co-applicant who—</text><item id="H6A39022C4CB04A7285A5EE1BBAF303FB"><enum>(aa)</enum><text>have expertise in sciences relevant to perfluoroalkyl or polyfluoroalkyl substance detection and remediation; and</text></item><item id="H887EFC98BAE5481396A3E34E5CBC0DD3"><enum>(bb)</enum><text>have been jointly selected, and will be jointly appointed, by the co-applicants to lead, and carry out the purposes of, the Center.</text></item></subclause></clause></subparagraph><subparagraph id="HC4B2DD7A2683496A82D6C1092E19259E"><enum>(B)</enum><header>Rural center</header><text>An eligible rural university desiring to establish the Rural Center shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require.</text></subparagraph></paragraph><paragraph id="HED3B9AAE16C549D2B6687B2842960F37"><enum>(3)</enum><header>Timing</header><subparagraph id="HC5E6F30FE3F94DC5A383EC41A980D77F"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Centers shall be established not later than 1 year after the date of enactment of this Act.</text></subparagraph><subparagraph id="H75114A1F182D436F90D3B7CB4E7F2346"><enum>(B)</enum><header>Delay</header><text>If the Administrator determines that a delay in the establishment of 1 or both of the Centers is necessary, the Administrator—</text><clause id="HAEBE3EF32E114B6B9BA28D01BDC4BE89"><enum>(i)</enum><text>not later than the date described in subparagraph (A), shall submit a notification to the appropriate committees of Congress explaining the necessity of the delay; and</text></clause><clause id="H77E044708B4D4356B9B0AF01B1E13804"><enum>(ii)</enum><text>shall ensure that the 1 or more Centers for which a delay is necessary are established not later than 3 years after the date of enactment of this Act.</text></clause></subparagraph></paragraph><paragraph id="H7D5338EECD6549C2A1C5A11DD1F52E12"><enum>(4)</enum><header>Requirement</header><text>The Administrator shall carry out subparagraphs (A) and (B) of paragraph (1)—</text><subparagraph id="H5AF0F5EECA10476285EAD5514489B5A6"><enum>(A)</enum><text>in coordination with the Secretary of Energy, as the Administrator determines to be appropriate; and</text></subparagraph><subparagraph id="H5DB2EAEEB14F42BBB66204B243B70A0E"><enum>(B)</enum><text>in consultation with the Strategic Environmental Research and Development Program and the Environmental Security Technology Certification Program of the Department of Defense.</text></subparagraph></paragraph></subsection><subsection id="HECCD54AB819C46AE92DC42593AF6E205"><enum>(d)</enum><header>Duties and capabilities of the centers</header><paragraph id="H07C67806E49D45799DE4171B0E494F49"><enum>(1)</enum><header>In general</header><text>The Centers shall develop and maintain—</text><subparagraph id="H4A020484BEEB4C3D81F3B7EC16EE5196"><enum>(A)</enum><text>capabilities for measuring, using methods certified by the Environmental Protection Agency, perfluoroalkyl or polyfluoroalkyl substance contamination in drinking water, ground water, and any other relevant environmental, municipal, industrial, or residential water samples; and</text></subparagraph><subparagraph id="H07761E413382412EA0CBA8D335A1AA58"><enum>(B)</enum><text>capabilities for—</text><clause id="H4FD3E56120A44A33855E2B21A5B54250"><enum>(i)</enum><text>evaluating emerging perfluoroalkyl or polyfluoroalkyl substance removal and destruction technologies and methods; and</text></clause><clause id="H16F648AF82A046398451DA0F5E0A7FC3"><enum>(ii)</enum><text>benchmarking those technologies and methods relative to existing technologies and methods.</text></clause></subparagraph></paragraph><paragraph id="HEB5C8523C16E4001911FC53ADEE70D8F"><enum>(2)</enum><header>Requirements</header><subparagraph id="HEB29606D21FC40EFBB0B07AC583A9155"><enum>(A)</enum><header>In general</header><text>In carrying out paragraph (1), the Centers shall, at a minimum—</text><clause id="HFDEC23AA00064A5CA57FFFD3E2733C83"><enum>(i)</enum><text>develop instruments and personnel capable of analyzing perfluoroalkyl or polyfluoroalkyl substance contamination in water using EPA method 533, EPA method 537.1, any future method or updated method, or any other relevant method for detecting perfluoroalkyl or polyfluoroalkyl substances in water;</text></clause><clause id="H9A016D140E784A50A13D83E2E729D3A1"><enum>(ii)</enum><text>develop and maintain capabilities for evaluating the removal of perfluoroalkyl or polyfluoroalkyl substances from water using newly developed adsorbents or membranes;</text></clause><clause id="HEE25829CC911451192C253E02C282505"><enum>(iii)</enum><text>develop and maintain capabilities to evaluate the degradation of perfluoroalkyl or polyfluoroalkyl substances in water or other media;</text></clause><clause id="HEF47F912982F4C94AAB453BF39E463DC"><enum>(iv)</enum><text>make the capabilities and instruments developed under clauses (i) through (iii) available to researchers throughout the regions in which the Centers are located; and</text></clause><clause id="HE9E4774F402743168F6A8B41CF54A44F"><enum>(v)</enum><text>make reliable perfluoroalkyl or polyfluoroalkyl substance measurement capabilities and instruments available to municipalities and individuals in the region in which the Centers are located at reasonable cost.</text></clause></subparagraph><subparagraph id="H5E32E41FAF52439BB1AFCBE1B1B3F783"><enum>(B)</enum><header>Open-access research</header><text>The Centers shall provide open access to the research findings of the Centers.</text></subparagraph></paragraph></subsection><subsection id="H6B6BA302A6B4420DB7B02F2C490A2F81"><enum>(e)</enum><header>Coordination with other federal agencies</header><text>The Administrator may, as the Administrator determines to be necessary, use staff and other resources from other Federal agencies in carrying out this section.</text></subsection><subsection id="HBE874AFBA1F147A2B247B8926A4169A4"><enum>(f)</enum><header>Reports</header><paragraph id="HAA90355632A14EA0B9193FA3CA887223"><enum>(1)</enum><header>Report on establishment of center</header><text>With respect to each of the Center and the Rural Center, not later than 1 year after the date on which the center is established under subsection (c), the Administrator, in coordination with that center, shall submit to the appropriate committees of Congress a report describing—</text><subparagraph id="HF074F97C992640F59EB570EE9FA49B88"><enum>(A)</enum><text>the establishment of that center; and</text></subparagraph><subparagraph id="H7809C2DB76EE414CAAB87F592F1A9A57"><enum>(B)</enum><text>the activities of that center since the date on which that center was established.</text></subparagraph></paragraph><paragraph id="HDD5F983C97DA4784B8B29D739E7E9DAC"><enum>(2)</enum><header>Annual reports</header><text>With respect to each of the Center and the Rural Center, not later than 1 year after the date on which the report under paragraph (1) for that center is submitted, and annually thereafter until the date on which that center is terminated under subsection (g), the Administrator, in coordination with that center, shall submit to the appropriate committees of Congress a report describing—</text><subparagraph id="H941FE463C0434632B02A8456AE6449BA"><enum>(A)</enum><text>the activities of that center during the year covered by the report; and</text></subparagraph><subparagraph id="H3A4FBD924999407383DE5596EF1B608A"><enum>(B)</enum><text>any policy, research, or funding recommendations relating to the purposes or activities of that center.</text></subparagraph></paragraph></subsection><subsection id="H782C3DA20CA44A54A844028F2808AFFC"><enum>(g)</enum><header>Termination</header><paragraph id="H88A577774E7747D398122CE512EE2AE2"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Centers shall terminate on October 1, 2033.</text></paragraph><paragraph id="HFB7C08B71728431D8900D0669FF4E868"><enum>(2)</enum><header>Extension</header><text>If the Administrator, in consultation with the Centers, determines that the continued operation of 1 or both of the Centers beyond the date described in paragraph (1) is necessary to advance science and technologies to address perfluoroalkyl or polyfluoroalkyl substance contamination—</text><subparagraph id="HCA4D9AE3AEE448ABBFCEC09D4D423E7D"><enum>(A)</enum><text>the Administrator shall submit to the appropriate committees of Congress—</text><clause id="H505FDA8D51AD4C99B7D0B59557686156"><enum>(i)</enum><text>a notification of that determination; and</text></clause><clause id="H18CBED154E834BEF871E2168FD5082BF"><enum>(ii)</enum><text>a description of the funding necessary for the applicable 1 or more Centers to continue in operation and fulfill their purpose; and</text></clause></subparagraph><subparagraph id="H56EFF7DE6ED7465C800AB024381E6037"><enum>(B)</enum><text>subject to the availability of funds, may extend the duration of the applicable 1 or more Centers for such time as the Administrator determines to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="H36401696319C42B59AEBE06B9C6FCAC3"><enum>(h)</enum><header>Funding</header><paragraph id="H2D449BE231264A92A08449D71B2DDA32"><enum>(1)</enum><header>In general</header><text>Of the amounts authorized to be appropriated to the Department of Defense for fiscal year 2024 for the Strategic Environmental Research and Development Program and the Environmental Security Technology Certification Program of the Department of Defense, $25,000,000 shall be made available to the Administrator to carry out this section, to remain available until September 30, 2033.</text></paragraph><paragraph id="HB619C55FE45747CBB652F2E7B18933D0"><enum>(2)</enum><header>Administrative costs</header><text>Not more than 4 percent of the amounts made available to the Administrator under paragraph (1) shall be used by the Administrator for the administrative costs of carrying out this section.</text></paragraph></subsection></section><section id="HE5BDD172F2934A52AC7489E720268EC4"><enum>202.</enum><header>Actions under State law for damages from exposure to hazardous substances</header><text display-inline="no-display-inline">Section 309 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9658">42 U.S.C. 9658</external-xref>) is amended—</text><paragraph id="H7A99D58C5E15488C9A09EA356239259B"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H39D552135D964D639A026424DC3ACF96"><enum>(A)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="subsection" style="OLC">and statutes of repose</header-in-text></quote> after <quote><header-in-text level="subsection" style="OLC">limitations</header-in-text></quote>;</text></subparagraph><subparagraph id="H98E9F252F1BA447FA08095B9D407D386"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H84D4AF44471A42F785BC7C98B24DD2C9"><enum>(i)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">of limitations</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">statutes</header-in-text></quote>; and</text></clause><clause id="H7BDAC6E5F3004EE78FCACE06C4DB92FD"><enum>(ii)</enum><text>by inserting <quote>statute of</quote> after <quote>applicable</quote>;</text></clause></subparagraph><subparagraph id="H1B867ABEE8B94685A53E08736D5AA211"><enum>(C)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text></subparagraph><subparagraph id="HCBD80FB8B9A54E68AD37C9E6AEEA7966"><enum>(D)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H43A6151C012B4BBFAEB944962583C856"><paragraph commented="no" display-inline="no-display-inline" id="H8DDFD63899CF4CC98B52ABF789E2239F"><enum>(2)</enum><header display-inline="yes-display-inline">Exception to state statutes of repose</header><text display-inline="yes-display-inline">In the case of any action brought under State law for personal injury, or property damages, which are caused or contributed to by exposure to any hazardous substance, or pollutant or contaminant, released into the environment from a facility, if the applicable statute of repose period for such action (as specified in the State statute of repose or under common law) provides a commencement date which is earlier than the federally required commencement date, such period shall commence at the federally required commencement date in lieu of the date specified in such State statute.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph commented="no" id="HD256B7A6BC01420ABB002E80A66822DD"><enum>(E)</enum><text>in paragraph (3) (as so redesignated)—</text><clause commented="no" id="H0118CCA7077E440E9C9A19C4AD96C757"><enum>(i)</enum><text>by striking <quote>paragraph (1)</quote> and inserting <quote>paragraphs (1) and (2)</quote>; and</text></clause><clause commented="no" id="HEDE92FB7825D4C8DA66ABF0E4368AB1F"><enum>(ii)</enum><text>by inserting <quote>or statute of repose</quote> after <quote>statute of limitations</quote>; and</text></clause></subparagraph></paragraph><paragraph id="HAFF153A44E074C04B6DC657B1CBB4BD0"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H39DE9B8BAEA242928E8B1555BB36AB17"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="H751EB79D2DB44CACA7E347FE622976A2"><enum><italic></italic>(i)</enum><text>in the paragraph heading, by inserting <quote><header-in-text level="paragraph" style="OLC">statute of</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">applicable</header-in-text></quote>; and</text></clause><clause id="HD143B0F59B4C4AEEAA53630AC8841BAC"><enum>(ii)</enum><text>by inserting <quote>statute of</quote> after <quote>applicable</quote>;</text></clause></subparagraph><subparagraph id="HBA7D62BB80A44DC0875833D235334E3A"><enum>(B)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively;</text></subparagraph><subparagraph id="H900C7FBF3E7743C1B0358480131B6CD4"><enum>(C)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H332F74BB33B74B4EACFA4D41FE486B0D"><paragraph id="H5A83CD671B0443E28BF0AB1F05E44AD3"><enum>(3)</enum><header>Applicable statute of repose period</header><text>The term <term>applicable statute of repose period</term> means the period specified in a statute of repose during which a civil action referred to in subsection (a)(2) may be brought.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H651B8F2FCC884AEEB8A3191AFC11F9F5"><enum>(D)</enum><text>in paragraph (4) (as so redesignated)—</text><clause id="H05496567B5E7445CBB51A86B258D6541"><enum>(i)</enum><text>by inserting <quote>or statute of repose</quote> after <quote>statute of limitations</quote>; and</text></clause><clause id="H465E7B86DFC8424DB7D80843FAB984AA"><enum>(ii)</enum><text>by striking <quote>applicable limitations period</quote> and inserting <quote>applicable statute of limitations period or applicable statute of repose period, respectively</quote>; and</text></clause></subparagraph><subparagraph id="H1B8F86C356DE4A6E9F2B6FEF92128726"><enum>(E)</enum><text>in paragraph (5) (as so redesignated)—</text><clause id="HCC7C528985904568ACEC71B0C4480575"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>subsection (a)(1)</quote> and inserting <quote>paragraph (1) or (2) emerging concern, pollutant, chemical, waste, or other substance that is designated as a hazardous substance on or after August 1, 2022, the term <term>federally required commencement date</term> means the latter of—</text><subclause id="HA85748AC697A42BEBC5F15A87ADE2152"><enum>(I)</enum><text>the date on which that contaminant of emerging concern, pollutant, chemical, waste, or other substance is designated as a hazardous substance; and</text></subclause><subclause id="H065E6E63E6A44092829EF10B5D2F3284"><enum>(II)</enum><text>the date on which the plaintiff knew (or reasonably should have known) that the personal injury or property damages referred to in paragraph (1) or (2) of subsection (a) were caused or contributed to by that contaminant of emerging concern, pollutant, chemical, waste, or other substance.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subclause></clause></subparagraph></paragraph></section><section id="H0C9FAA2987AE47A580403D536F3071E5"><enum>203.</enum><header>Bankruptcy provision relating to persistent, bioaccumulative, and toxic chemicals defendants and debtors</header><subsection id="HA5792E5D93C54DA8AAF692D5177D6AD8"><enum>(a)</enum><header>In general</header><text>Title III of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9651">42 U.S.C. 9651 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3998EFBCA5474C94BD6771B889F1D111"><section id="HD710F25C168B40F2B189A6EDC8E74010"><enum>313.</enum><header>Special provision relating to persistent, bioaccumulative, and toxic chemicals defendants and debtors</header><subsection id="H3C426B801D49444593820DB744532AAC"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H478536AD177A4E6F80E74B84E476881B"><enum>(1)</enum><header>Claim; debtor; entity; petition</header><text>The terms <term>claim</term>, <term>debtor</term>, <term>entity</term>, and <term>petition</term> have the meanings given those terms in section 101 of title 11, United States Code.</text></paragraph><paragraph id="HF437345615AE43CC86BBD42E3BBE57F1"><enum>(2)</enum><header>Estate</header><text>The term <term>estate</term> means an estate of a debtor described in section 541 of title 11, United States Code.</text></paragraph><paragraph id="H061B115EA4FE4BDA8C6E5CB3E2C1E1CD"><enum>(3)</enum><header>Nondebtor entity</header><text>The term <term>nondebtor entity</term> means an entity that is not a debtor or an estate.</text></paragraph><paragraph id="H3DA04A98A36947ADAE76E8DF6801841D"><enum>(4)</enum><header>PBT claim</header><text>The term <term>PBT claim</term> means a claim based on, arising from, or attributable to the presence of, or exposure to—</text><subparagraph commented="no" display-inline="no-display-inline" id="H3C041635BA92495F95C1A0672B00C9DD"><enum>(A)</enum><text display-inline="yes-display-inline">a perfluoroalkyl or polyfluoroalkyl substance; or </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7F4A1ACABAE24863921D04E68101AD1D"><enum>(B)</enum><text display-inline="yes-display-inline">any persistent, bioaccumulative, and toxic chemical, as designated under section 6(h) of the Toxic Substances Control Act (<external-xref legal-doc="usc" parsable-cite="usc/15/2605">15 U.S.C. 2605(h)</external-xref>). </text></subparagraph></paragraph></subsection><subsection id="H2BCCFED5CB274227B627D0B573484F77"><enum>(b)</enum><header>Automatic stay</header><text>The filing of a petition does not operate as a stay under section 362(a) of title 11, United States Code, of the commencement or continuation, including the issuance or employment of process, of a judicial, administrative, or other action or proceeding against a nondebtor entity, or any act to obtain or recover property of a nondebtor entity, on account of or with respect to a PBT claim against the nondebtor entity, the debtor, or the estate (including a claim or cause of action against the nondebtor entity that is property of the debtor or the estate).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H589C83E0B9934A8DB894B14250E73694"><enum>(b)</enum><header>Effective date</header><paragraph id="H1E1D0611A0904B2E9213588056C54275"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), this section and the amendment made by this section—</text><subparagraph id="HCBD982A5F6E249E5AED8D0F18F1FD199"><enum>(A)</enum><text>shall take effect on the date of enactment of this Act; and</text></subparagraph><subparagraph id="HCFC6E76659D14FAF8624402CE83E5784"><enum>(B)</enum><text>shall apply to any case under title 11, United States Code, that is—</text><clause id="H26FE84693C8D48D68C0B81667D8C9B97"><enum>(i)</enum><text>pending as of the date of enactment of this Act; or</text></clause><clause id="H9C69F1CA1B244A1E82C2B92B7E5CDB3D"><enum>(ii)</enum><text>commenced or reopened on or after the date of enactment of this Act.</text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBB656636C3014116ADFD500C8928EA45"><enum>(2)</enum><header>Validity of final orders</header><text>Nothing in this section, or the amendment made by this section, shall affect the validity of any final judgment, order, or decree entered before the date of enactment of this Act. </text></paragraph></subsection></section></title></legis-body></bill>
