<section id="H41F9F6344BF24EC2BBD86F5FAFAB66B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening the Medical Examiner and Coroner System Act of 2024</short-title></quote>.</text></section> <section commented="no" display-inline="no-display-inline" id="H7151E666B45148E8A068779BC2467FF7"><enum>2.</enum><header>Forensic medical needs</header><text display-inline="no-display-inline">Part E of title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/294n">42 U.S.C. 294n et seq.</external-xref>) is amended by adding at the end the following:</text>

<subpart id="H2337A30C077243E182EA4C543D873EC0" style="OLC"><enum>4</enum><header>Forensic pathology workforce</header> 
<section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="HB5E576EF5A26452DB22B6350F5A047AD"><enum>779.</enum><header display-inline="yes-display-inline">Grants to address the forensic medicine service provider shortage</header> 
<subsection id="H8287423B021941E1A7D6E79483E2EECF" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph commented="no" display-inline="no-display-inline" id="H43125B049BAC4EAEB4885ABC855245AF"><enum>(1)</enum><header display-inline="yes-display-inline">Forensic medicine service provider</header><text>The term <term>forensic medicine service provider</term> has the meaning given the term in section 6 of Billy's Law (<external-xref legal-doc="usc" parsable-cite="usc/34/40506">34 U.S.C. 40506</external-xref> note; <external-xref legal-doc="public-law" parsable-cite="pl/117/327">Public Law 117–327</external-xref>).</text></paragraph> 
<paragraph id="HB8FFB520701F424CA9A45FC4BADDE0E3"><enum>(2)</enum><header>Medicolegal death investigator</header><text>The term <term>medicolegal death investigator</term> means an individual who performs formal inquiry into the circumstances surrounding the death of a human being to assist in the determination of the cause and manner of death. </text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H410A01050DF64B26AB0AEBEA560BB6DC"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary, acting through the Collaborating Office of Medical Examiners and Coroners of the Centers for Disease Control and Prevention.</text></paragraph></subsection> 
<subsection id="H9FAE7B36A5A44660946338B285AE8B02"><enum>(b)</enum><header>Purposes</header><text>The purposes of this section are—</text> <paragraph commented="no" display-inline="no-display-inline" id="HD57D8104AA024101AA21054F7BFA99E6"><enum>(1)</enum><text display-inline="yes-display-inline">to encourage and incentivize qualified medical school graduates to enter the practice of forensic pathology by supporting forensic pathology fellowships;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HFF572EE512044A9A8407B5E4DD50CB11"><enum>(2)</enum><text display-inline="yes-display-inline">to encourage and incentivize qualified individuals to enter the field of medicolegal death investigation to conduct death investigations in support of forensic medicine service providers; and</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H7DB586F5AD2343C88891D05927B6DA44"><enum>(3)</enum><text display-inline="yes-display-inline">to support qualified individuals who enter the field of forensic toxicology through employment in forensic toxicology laboratories in the acquisition of skills in pharmacology, advanced and emerging toxicological methods, and instrumentation needed to assist with the interpretation of toxicological findings.</text></paragraph></subsection> 
<subsection id="H414E19067E5146AA89961ED0C407E3B1"><enum>(c)</enum><header>Grants</header><text>The Secretary shall award grants to eligible entities described in subsection (d) to assist such entities in addressing their shortages by offering the training and fellowships described in subsection (e)(1).</text></subsection> <subsection id="H98D5B3D9957C4F44B256E8869CB47EE3"><enum>(d)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an entity shall be—</text> 
<paragraph id="H1F05A26725254C728D7A6B6EB51761BA" commented="no"><enum>(1)</enum><text>a graduate medical education program—</text> <subparagraph id="H6502020D35C147EBB4E9B2375B25CF4B" commented="no"><enum>(A)</enum><text>accredited by the Accreditation Council for Graduate Medical Education that offers a forensic pathology fellowship that is so accredited; or</text></subparagraph> 
<subparagraph id="HEFDD3DB679714292A36F08579450B112" commented="no"><enum>(B)</enum><text>that is seeking such accreditation for a forensic pathology fellowship; </text></subparagraph></paragraph> <paragraph id="HBBAE7F29D4E647AE93FA928A91FDA380"><enum>(2)</enum><text>a publicly funded medical examiner or coroner office that is accredited or seeking accreditation; or</text></paragraph> 
<paragraph id="HF6A073F534204BC188C165AF8EBD7B83"><enum>(3)</enum><text>a publicly funded forensic toxicology laboratory that supports medical examiner and coroner offices and that is accredited or seeking accreditation.</text></paragraph></subsection> <subsection id="HFD02AFDBD2EC4EFEB0C8D05B5A03A1EB"><enum>(e)</enum><header>Use of grant funds</header> <paragraph id="HE1A308DF068946B9A0319CCE929C298B"><enum>(1)</enum><header>In general</header><text>An eligible entity that receives a grant under this section shall use the grant funds—</text> 
<subparagraph id="HDA9E2603BCC84236A8E21431C8D4D79E"><enum>(A)</enum><text>to provide payment to individuals selected by such entity for a forensic pathology fellowship for salary, fringe benefits, related supply expenses, and other educational expenses of such individuals; </text></subparagraph> <subparagraph id="HF4216A65C0654F62ADEFC5E1B5DBC9CE"><enum>(B)</enum><text>provide training for medicolegal death investigators, including paying for the costs of continuing education for medicolegal death investigators for purposes of such individuals—</text> 
<clause id="HC0CD5BC0312D48CCBC7AE64C117EBFAD"><enum>(i)</enum><text>becoming certified by the American Board of Medicolegal Death Investigation (or another accredited certifying organization); and</text></clause> <clause id="HC7E6F243F3FF4B808B8784C883FF2EFA"><enum>(ii)</enum><text>maintaining such certification; or</text></clause></subparagraph> 
<subparagraph id="HE45625B687204D53BE7DA4789CFA11C4"><enum>(C)</enum><text>to assist eligible entities—</text> <clause commented="no" display-inline="no-display-inline" id="H9D500016BB24471BBF8F018B7BB3C3BB"><enum>(i)</enum><text display-inline="yes-display-inline">in providing the education and training to individuals employed by such entities necessary—</text> 
<subclause id="H73F63B7C5E34470E83F87E3FD25F7381"><enum>(I)</enum><text>to gain initial competency, additional training, and continuing education in pharmacology and advanced and emerging toxicological methods and instrumentation needed to assist with the interpretation of toxicological findings;</text></subclause> <subclause id="HF159AB3176C740B28ECB2CF59F954C53"><enum>(II)</enum><text>to become certified by the American Board of Forensic Toxicology, the American Association of Clinical Chemistry, or another accredited certifying organization; or</text></subclause> 
<subclause id="H3193BCF0EA694E2E82503B866EF86381"><enum>(III)</enum><text>to maintain such certification or to obtain recertification by such a certifying organization; or</text></subclause></clause> <clause id="HD833B55CD021414098552FF31810BE15" commented="no"><enum>(ii)</enum><text>in obtaining accreditation by the Accreditation Council for Graduate Medical Education for forensic pathology fellowships. </text></clause></subparagraph></paragraph> 
<paragraph id="HF7A1A054DAB6425182DF2DCAD5C64B5E"><enum>(2)</enum><header>Administrative costs</header><text>An eligible entity that receives a grant under this section may use not more than 15 percent of the total amount of the grant for administrative expenses, including grant management services.</text></paragraph></subsection> <subsection id="H71CDE38A7497462E836CAA7D00775C89"><enum>(f)</enum><header>Recipient requirements</header><text>To be eligible to receive a fellowship funded by a grant under this section, an individual shall—</text> 
<paragraph id="H3506144AD7274350AD26343B6786902B" commented="no"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H8D01AE2B1D864164A2E7848E18341676"><enum>(A)</enum><text>be enrolled in, or shall have completed, an anatomical pathology or anatomical and clinical pathology residency program accredited by the Accreditation Council for Graduate Medical Education; and </text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H32D8D62AE4B540D78154ECDF2564E642" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">not be, and shall never have been, in default on any public or private student loan; </text></subparagraph></paragraph> 
<paragraph id="HCD5EA8D50F7D400EA14DA14253817672" commented="no"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HCE55FD0C001945149234CA9EA05638A0"><enum>(A)</enum><text>be an individual who has completed a program of baccalaureate or postbaccalaureate education and earned a degree, or completed a concentration, in forensic science, natural science, anthropology, nursing, or other medical and forensic-related fields; and</text></subparagraph> <subparagraph indent="up1" commented="no" display-inline="no-display-inline" id="HB7E60F4D66A64874B32C5365DD13CCE0"><enum>(B)</enum><text display-inline="yes-display-inline">be a coroner or medicolegal death investigator working full-time at, or in a contractual relationship with, a publicly funded medical examiner or coroner office who—</text> 
<clause id="H4C310B19A67A4131931CEE1E66CA9A2E" commented="no"><enum>(i)</enum><text>has not achieved, and is seeking, certification by an accredited certification organization described in subsection (e)(1)(B)(i); or</text></clause> <clause id="H8FA8E27B65BC4F9BB4FB3C4457855D09" commented="no"><enum>(ii)</enum><text>who is seeking continuing education for purposes of maintaining such certification;</text></clause></subparagraph></paragraph> 
<paragraph id="H18F545CF821142B2BFC004F80AA1AE63" commented="no"><enum>(3)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="H46AE62EAE4CD4EE3B5CB934AE76B6DCC"><enum>(A)</enum><text>have completed a program of baccalaureate or postbaccalaureate education and earned a degree, or completed a concentration, in forensic science or physical or natural sciences, with a chemistry, toxicology, or other closely related scientific or forensic component; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H0D12ECD5F6AE45FA8668586AEA0DBFB8" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">be employed by the eligible entity as a toxicologist or pharmacologist.</text></subparagraph></paragraph></subsection> 
<subsection id="H4A870ABE0D9747A6A5401B12CFA99BC2"><enum>(g)</enum><header>Tax waiver</header><text>The payment amounts to an individual under this section or any other benefit received by the individual from the grant recipient shall not be taxable to the individual.</text></subsection> <subsection id="HFF777472ED48419A94CF863C75228BA2"><enum>(h)</enum><header>Geographic distribution</header><text>In awarding grants under this section, the Secretary shall take into consideration—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H7BC50F7B530E41BD9F4139BAD4EA11D3"><enum>(1)</enum><text display-inline="yes-display-inline">the geographic distribution of grant funding among the States;</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H04A6E326D1EA4C2C839B57E3C4D7611B"><enum>(2)</enum><text display-inline="yes-display-inline">the relative proportion of grant funding between rural and urban areas; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE12B480D8AE24916AD32123D92BD8C82"><enum>(3)</enum><text display-inline="yes-display-inline">the unique needs of rural communities, including—</text> <subparagraph commented="no" display-inline="no-display-inline" id="HF6F489DF70C94C8490036812FCD6D66A"><enum>(A)</enum><text display-inline="yes-display-inline">communities with an incidence of individuals with opioid use disorder that is above the national average; and </text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF93B645BCD6048619CC660638C83712A"><enum>(B)</enum><text display-inline="yes-display-inline">communities with a shortage of forensic medicine service providers.</text></subparagraph></paragraph></subsection> <subsection id="H9CE1237DE62A45AF8F7755B307ABB49B"><enum>(i)</enum><header>Authorization of appropriations</header> <paragraph commented="no" display-inline="no-display-inline" id="H546BDEC708B84A139223E938E8EF78B0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this section $13,000,000 for each of fiscal years 2025 through 2029.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2AFB2C6A56524E36A354FDE52A4F1CA2"><enum>(2)</enum><header>Allocations</header><text display-inline="yes-display-inline">Of the amounts made available each fiscal year under paragraph (1), the Secretary shall allocate—</text> <subparagraph commented="no" display-inline="no-display-inline" id="H76023DEED52C4579A13441D2865D4458"><enum>(A)</enum><text display-inline="yes-display-inline">subject to paragraph (3), not less than $7,000,000 for grants to eligible entities carrying out the purpose described in subsection (e)(1)(A);</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC249AC65BC9A4690A4A02A206A5DAAAA"><enum>(B)</enum><text display-inline="yes-display-inline">not less than $3,000,000 for grants to eligible entities carrying out the purpose described in subsection (e)(1)(B); and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="H13F464C2FBCC44558E19B81ECB69E551"><enum>(C)</enum><text display-inline="yes-display-inline">not less than $3,000,000 for grants to eligible entities carrying out the purpose described in subsection (e)(1)(C).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD1AADC2557224F3F978C08173B3603AA"><enum>(3)</enum><header>Fellowship minimum</header><text display-inline="yes-display-inline">In allocating amounts for grants to eligible entities carrying out the purpose described in subsection (e)(1)(A), the Secretary shall award sufficient grant funding to such entities to ensure that not fewer than 40 forensic pathology fellowships are funded.</text></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body></bill>
