which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to provide for coverage under the Medicare program of hearing aids and related hearing services.</official-title></form><legis-body id="H011A123AFE574FEE8648CA393DD24CB4" style="OLC"><section id="HB01B5EB97C3C4CE0A85C3BA82CA74448" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help Extend Auditory Relief Act of 2024</short-title></quote> or the <quote><short-title>HEAR Act of 2024</short-title></quote>. </text></section><section id="HA8DC0E6C4A334E6283BDC08A1AB61C27"><enum>2.</enum><header>Medicare coverage of hearing rehabilitation</header><subsection id="HB2DCA7F9AF664890B4642F1949328319"><enum>(a)</enum><header>Coverage of aural rehabilitation services</header><text>Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><paragraph id="HB2EC032EFEC8400C919CCEFA56B17E0F"><enum>(1)</enum><text>in subparagraph (JJ) by adding <quote>and</quote> at the end; and</text></paragraph><paragraph id="H09C0C12198734FE486B0A759A828AA37"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="H0142579B314042B1B2D34466B40D4AF6" style="OLC"><subparagraph id="H0E78E639217443F6BA2DF371C5C671E4" indent="up1"><enum>(KK)</enum><text display-inline="yes-display-inline">aural rehabilitation services (as described in subsection (nnn)(1)(A));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H9EC2715D560C4EDCB26701EBDE0214E5"><enum>(b)</enum><header>Coverage of hearing aids as durable medical equipment</header><text>Section 1861(s)(8) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(8)</external-xref>) is amended by inserting <quote>and hearing aids (as defined in subsection (nnn)(3))</quote> before the period.</text></subsection><subsection id="HBD6767718CAD40CEB06FA1841A28FA02"><enum>(c)</enum><header>Hearing rehabilitation and hearing aid defined</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="H2833DD48FC06460382FA8D337D5819A9" other-style="archaic" style="other"><subsection id="H969030C0299B4B32A2E07E5DE6157A28"><enum>(nnn)</enum><header>Hearing Rehabilitation</header><paragraph commented="no" display-inline="yes-display-inline" id="H20F8AFAD96A144C89FE37A68A440F9A9"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>hearing rehabilitation</term> means—</text><subparagraph id="H263179EC040B4CAFA23E123FD0C66C4D" indent="up1"><enum>(A)</enum><text>aural rehabilitation services (described in paragraph (2)) which meet such requirements as the Secretary prescribes and which are furnished by a physician or qualified audiologist, who is legally authorized to furnish such services under the State law (or the State regulatory mechanism provided by State law) of the State in which the services are furnished; and</text></subparagraph><subparagraph id="H021149334C404A30ABA3D746EEAD545E" indent="up1"><enum>(B)</enum><text>hearing aids (as defined in paragraph (3)).</text></subparagraph></paragraph><paragraph id="H3F438221347C4A87B9A007EC36826F9E" indent="up1"><enum>(2)</enum><text>The services described in this subparagraph include—</text><subparagraph id="HB39F98045D3A4D0C9BDEC04C2743FF72"><enum>(A)</enum><text>aural rehabilitation services;</text></subparagraph><subparagraph id="HBBF19252F4584E22AEC87AB9A721EE1C"><enum>(B)</enum><text>in the case of an individual who has a hearing loss (as defined by the Secretary), a comprehensive audiologic assessment to determine if a hearing aid is appropriate and to determine the need for other diagnostic medical or audiologic testing; and</text></subparagraph><subparagraph id="HF4C669ACCDAA4E669355E1B7C1200BFF"><enum>(C)</enum><text>a threshold test to determine audio acuity.</text></subparagraph></paragraph><paragraph id="H6C5B600E5C69468F9142749702605C5D" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB6752D2322C743DDADFFCFC92A5DCC3D"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>hearing aid</term> means a hearing aid described in subparagraph (B), including the services described in subparagraph (C) furnished by a physician or qualified audiologist, who is legally authorized to supply such hearing aid under the State law (or State regulatory mechanism provided by State law) of the State in which the hearing aid is supplied, to an individual described in subparagraph (D).</text></subparagraph><subparagraph id="H499C66E62BA94652BD74A5C5008F099C" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A hearing aid described in this subparagraph is any wearable instrument or device for, offered for the purpose of, or represented as aiding individuals with, or compensating for, hearing loss that meets requirements of the Food and Drug Administration for marketing, but does not include an over-the-counter hearing aid (as defined in section 520(q)(1) of the Federal Food, Drug, and Cosmetic Act). </text></subparagraph><subparagraph id="H6580AFA6CB24421E9DB2F068D00ADFC0" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The services described in this subparagraph include—</text><clause id="HF0D4252A29234733B2253120F068AA65"><enum>(i)</enum><text>audiology services (as defined in subsection (ll)(2));</text></clause><clause id="H4BEEE5D3FA0449D6863CF6831D548781"><enum>(ii)</enum><text>a hearing aid assessment to determine the appropriate hearing aid for the individual;</text></clause><clause id="H80EC3E1125264F8288C609890263E2AC"><enum>(iii)</enum><text>procurement of an appropriate hearing aid;</text></clause><clause id="H081D9FBA0090454CB614FE04E3B680E7"><enum>(iv)</enum><text>initial fitting and adjustment of the hearing aid;</text></clause><clause id="H122F30B32175415FA1FF62479E9C48C4"><enum>(v)</enum><text>appropriate instruction on the use of the hearing aid;</text></clause><clause id="H7AC9A45DDA014411B212BBAA97DA65A9"><enum>(vi)</enum><text>periodic refittings and adjustments; and</text></clause><clause id="HC59F885217C64D768BB59CD0356BEA04"><enum>(vii)</enum><text>rehabilitation, including counseling on hearing loss, speech reading, and auditory training.</text></clause></subparagraph><subparagraph id="HD09B16F5F61A4902B8D4F8891244E526" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The individuals described in this subparagraph—</text><clause id="HFF2D366C75E340379F7E4EAEC65B34CD"><enum>(i)</enum><text>have been determined (as a result of a comprehensive audiologic assessment) to have a hearing loss which can be appropriately treated with a hearing aid;</text></clause><clause id="HC14236D1583844EEA6C0698ABF9BB975"><enum>(ii)</enum><text>have not been supplied with one monaural hearing aid or two binaural hearing aids during the preceding 3 years; and</text></clause><clause id="HE7015A806FAE43768D5C167D0C720F0D"><enum>(iii)</enum><text>have had a comprehensive audiologic assessment which indicates that the hearing of such individual has deteriorated since such individual was last supplied with a hearing aid such that a hearing aid of a different type is appropriate for such individual.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1315B490E001446AA62E01FFA2BD331F"><enum>(d)</enum><header>Inclusion of audiology rehabilitation services</header><text>Section 1861(ll)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ll)(2)</external-xref>) is amended by inserting <quote>and rehabilitation</quote> after <quote>balance assessment</quote>.</text></subsection><subsection id="HE4F00BC1C3554F5EBDCDD7BE06BBE649"><enum>(e)</enum><header>Exception to exclusions from coverage</header><text>Section 1862(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(a)</external-xref>) is amended—</text><paragraph id="H23B2C122B8634131AC82EF8231B8DBD1"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text><subparagraph id="HD7F344FC0B3F42E2B9F217E465AB5841"><enum>(A)</enum><text>in subparagraph (O), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H12086AB5801C4619B06036722E3C9FBF"><enum>(B)</enum><text>in subparagraph (P); by striking the semicolon at the end and inserting <quote>, and</quote>; and</text></subparagraph><subparagraph id="H1EECB7F34C864919B5BBD16031DDF839"><enum>(C)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block display-inline="no-display-inline" id="HD60F36E6AEA94B89A4789880C29FA081" style="traditional"><subparagraph id="H15352CB38901406580C6CCA32301D0CE" indent="up1"><enum>(Q)</enum><text display-inline="yes-display-inline">in the case of hearing rehabilitation, which is furnished or supplied more frequently than is provided under section 1861(nnn)(3)(D)(ii).</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEDDB9BC69E1140509D77CD009AF3E079"><enum>(2)</enum><text>in paragraph (7) by striking <quote>hearing aids or examinations therefor</quote>.</text></paragraph></subsection><subsection id="H9FE4B1E5AC1249E4B2F38D5EFA075992"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act, and shall apply to items and services furnished on or after a date specified by the Secretary of Health and Human Services that is not sooner than January 1 of the first year beginning after such date of enactment and not later than January 1 of the third year beginning after such date of enactment.</text></subsection></section></legis-body></bill>
