R. 8023</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240416">April 16, 2024</action-date><action-desc><sponsor name-id="K000385">Ms. Kelly of Illinois</sponsor> (for herself and <cosponsor name-id="B001306">Mr. Balderson</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Federal Trade Commission to include in the report of the Commission under the Elder Abuse Prevention and Prosecution Act certain information relating to scams disproportionately impacting seniors during emergencies, and for other purposes.</official-title></form><legis-body id="HC67F519E75214BF48372C46ED82C3B59" style="OLC"><section id="H6A8DB71D04B648CC9B31952A19009B61" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Seniors from Emergency Scams Act</short-title></quote>.</text></section><section id="HE16522EC7D7E41FDBBB3C3D25A306A83"><enum>2.</enum><header>FTC reporting on scams disproportionately impacting seniors during emergencies</header><text display-inline="no-display-inline">The Chair of the Commission shall include in each report required to be submitted by the Chair under section 101(c)(2) of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21711">34 U.S.C. 21711(c)(2)</external-xref>) after the date of the enactment of this Act, with respect to the period covered by the report, the following:</text><paragraph id="H50F4588F0C3B4EB99D88E1E609294FA0"><enum>(1)</enum><text>A description of the number and types of scams identified by the Commission as disproportionately impacting seniors during emergencies.</text></paragraph><paragraph id="H264E4E2BC8E14A71901C5EB580CB57B0"><enum>(2)</enum><text>A description of policy efforts and recommendations of the Commission to prevent such scams, especially as such scams relate to future national emergencies.</text></paragraph><paragraph id="HAD78C19A6BB84BCC99A433B05C9C3C28" commented="no"><enum>(3)</enum><text>A description of enforcement actions taken by the Commission with respect to such scams.</text></paragraph></section><section id="H66255ABBD10D4D45864B8A6E7725E807"><enum>3.</enum><header>Increasing awareness of scams disproportionately impacting seniors</header><subsection id="H2ED76D251894441D8DF824943327F340"><enum>(a)</enum><header>In general</header><text>As soon as practicable after the date of the enactment of this Act, the Commission shall update its web portal to include the latest information, searchable by region and type of scam, on scams disproportionately impacting seniors, including information directing consumers where to report scams disproportionately impacting seniors.</text></subsection><subsection id="H4F57C787CC9F4998A25A8B75AD6F87F9"><enum>(b)</enum><header>Coordination with media outlets and law enforcement</header><text>The Commission shall work with media outlets and law enforcement to distribute the information included in the web portal of the Commission pursuant to subsection (a) to seniors and their families and caregivers.</text></subsection></section><section id="HA3BBF61890BD4C149366D548E87CA6B3"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H5565E5DE47D84AF092E57A6BB01172DF"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Trade Commission.</text></paragraph><paragraph id="H0F650366B2C04B31AC30F61B3F080D32"><enum>(2)</enum><header>Senior</header><text display-inline="yes-display-inline">The term <quote>senior</quote> has the meaning given the term <quote>elder</quote> in section 2 of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21701">34 U.S.C. 21701</external-xref>).</text></paragraph></section></legis-body></bill>
