committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure the Department of Homeland Security is appropriately measuring the scope of certain border security matters, and for other purposes.</official-title></form><legis-body id="HDA7DF0137EA349B3B9A61227D67D5129" style="OLC"><section id="HD2C4CC559E2543139A34EB435A2DB70C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Data for a Secured Border Act</short-title></quote>. </text></section><section id="H8F48BD3F42E2403DA6F5731F2B68F587" section-type="subsequent-section"><enum>2.</enum><header>Matters relating to border security</header><subsection id="H2997DB03262340C1BA3F4C7679D5A9C8"><enum>(a)</enum><header>Border security metrics</header><paragraph id="HFEEB73D573E04A17A83465F647B86EE3"><enum>(1)</enum><header>Annual reports</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in coordination with the Executive Director of the Office of Homeland Security Statistics, shall submit to the Committee on Homeland Security, the Committee on the Judiciary, and the Committee on Foreign Affairs of the House of Representatives and the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, and the Committee on Foreign Relations of the Senate an annual report that—</text><subparagraph id="H5E3A9271A64F46E18201DD8B0D5B1446"><enum>(A)</enum><text>assesses the usefulness of the border security metrics described in section 1092 of the National Defense Authorization Act for Fiscal Year 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/114/328">Public Law 114–328</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/223">6 U.S.C. 223</external-xref>) that are utilized in preparing the reports required under such section; and</text></subparagraph><subparagraph id="H17CDD34EF32C440CB27351DB002EF8D4"><enum>(B)</enum><text display-inline="yes-display-inline">makes recommendations for any updates to such border security metrics. </text></subparagraph></paragraph><paragraph id="H6A7422D08D7643259AFFD801C53ACE2C"><enum>(2)</enum><header>Timing</header><text display-inline="yes-display-inline">Each report under this subsection shall be submitted at the same time as each report required under such section 1092.</text></paragraph></subsection><subsection id="H5E4890067086463BB967B80675F1C287"><enum>(b)</enum><header>Joint capabilities</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security, in cooperation and collaboration with the Under Secretary for Management of the Department of Homeland Security and the Deputy’s Management Action Group (DMAG) of the Department, shall submit to the Committee on Homeland Security, the Committee on the Judiciary, and the Committee on Foreign Affairs of the House of Representatives and the Committee on Homeland Security and Governmental Affairs, the Committee on the Judiciary, and the Committee on Foreign Relations of the Senate a report that includes the following:</text><paragraph id="HF32084297ADB469981A546D2D969C91D"><enum>(1)</enum><text display-inline="yes-display-inline">An assessment of the workforce, authorities, and responsibilities of the Joint Requirements Council (JRC) of the Department.</text></paragraph><paragraph id="H1782A69134424DCD8458C140C35F1507" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">A determination regarding whether the JRC is meeting its intent, including whether the JRC implements a joint requirements process or any additional responsibility that the Secretary has assigned to it, including relating to the following:</text><subparagraph id="H33077595FD014673A766459698993D34" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The validation of any evaluation, as appropriate, by a component, support component, or office, of the Department that—</text><clause id="HAE1C5D88AFA846CD85D4BA5C5A50F4CC"><enum>(i)</enum><text display-inline="yes-display-inline">identifies any capability gaps, redundancies, or overlaps; and</text></clause><clause id="H0622D610163F4D51A88D43AAD5756F28"><enum>(ii)</enum><text>provides recommendations for either materiel or nonmateriel solutions to address any such capability gap, redundancy, or overlap.</text></clause></subparagraph><subparagraph id="H26FFC360DB794A529D301BEA035ECDE6" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">The submission of such validation to department leadership for consideration in investment decisions.</text></subparagraph></paragraph><paragraph id="H0D3486972EFF48898982F136DB56AA5A"><enum>(3)</enum><text display-inline="yes-display-inline">An identification of the position within the Department responsible for implementing a joint requirements process that validates an evaluation by a component of the Department that identifies any capability gaps, redundancies, or overlaps pursuant to paragraph (2)(A).</text></paragraph><paragraph id="HA059BB3BF1174B87A8CE959640D6E804" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">An identification of the officer or official of the Department who oversees the JRC’s activities and responsibilities, including the JRC’s reporting responsibilities to the DMAG.</text></paragraph><paragraph id="H11B5B304ADD14B12A6FA4B42ED737D50"><enum>(5)</enum><text display-inline="yes-display-inline">A description of how the JRC is assisting the Department’s efforts in performing border security-related missions and assisting incorporation of technological advances into border management based on available resources, such as the flow of fentanyl across the border and the backlog of migrant processing.</text></paragraph><paragraph id="HC493C1A8A95146F9A7901A392D156CDD"><enum>(6)</enum><text display-inline="yes-display-inline">A review of the progress of the Department’s engagement with the JRC to carry out the following:</text><subparagraph id="HFCD3F14D3F5A4CA78D0FEFCF165F2DEE"><enum>(A)</enum><text>Review the JRC’s recommendations.</text></subparagraph><subparagraph id="HB3A2D47E9FA14A0ABB760528A081D33B"><enum>(B)</enum><text>Approve or direct related follow-on activities.</text></subparagraph><subparagraph id="H812BF6D164444585B417A6E4037C31CC"><enum>(C)</enum><text>Provide direction and guidance to the JRC.</text></subparagraph></paragraph><paragraph id="H1BA7D44BA8EB4B6BADB4E77B62DDD8FF"><enum>(7)</enum><text display-inline="yes-display-inline">A review of the JRC’s recommendations, the approval and direct related follow-on activities, and the direction and guidance to the JRC from the Secretary or the Secretary’s designee. </text></paragraph><paragraph id="H36804D01C7624C79855B9D013CD72E4D"><enum>(8)</enum><text display-inline="yes-display-inline">A description of how Department senior leadership makes use of JRC analyses and associated products.</text></paragraph><paragraph id="HEB9929CC8A7845E4B9F9C0EF678936EA"><enum>(9)</enum><text>An evaluation of the placement of the JRC within the Management Directorate of the Department to ensure such placement aligns fully with the JRC’s mission and maintains the JRC’s independence.</text></paragraph><paragraph id="H2C8192F13F004E9BB973F7E9DDDF66ED" commented="no"><enum>(10)</enum><text display-inline="yes-display-inline">An evaluation of the role of the JRC and broader Department internal communications of needs and requirements, and how the processes for communicating and documenting such needs and requirements can be improved at the Department.</text></paragraph></subsection><subsection id="H7835BEB80020417CB01D1C5AF83806FA"><enum>(c)</enum><header>Other administrative needs</header><text display-inline="yes-display-inline">The reports required under subsections (a) and (b) shall also be submitted to the following:</text><paragraph id="H91648E34C69C4AC288EB5150B483FC11"><enum>(1)</enum><text display-inline="yes-display-inline">Homeland Security Investigations of U.S. Immigrations and Customs Enforcement, with any illicit drug highlights.</text></paragraph><paragraph id="H0A919FA78B9F4D9C9712E13A2977FFB7"><enum>(2)</enum><text>The Office of National Drug Control Policy (ONDCP), with any illicit drug highlights.</text></paragraph><paragraph id="H36D5221FFFD743819B4179F5CF935E2C"><enum>(3)</enum><text>The Drug Enforcement Administration, with any illicit drug highlights.</text></paragraph><paragraph id="H3C5398586CEB4327A262074B6EDAAC26"><enum>(4)</enum><text>The Federal Emergency Management Agency, with any migrant crossing surges that would cross the threshold into emergency situations.</text></paragraph><paragraph id="HD46D4925901D4ACCA0BE44F94D4DC74B"><enum>(5)</enum><text>The Department of Justice, including law enforcement agencies of the Department, regarding such Department’s and agencies’ related border metrics.</text></paragraph></subsection><subsection id="HC669DB1B094B43D7A9CFE2F28240FDE3"><enum>(d)</enum><header>Definition</header><text>The terms <quote>Joint Requirements Council</quote> and <quote>JRC</quote> include any successor entity.</text></subsection></section></legis-body></bill>
