which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Agriculture to publish, on an annual basis, an assessment on United States dependency on critical agricultural products or inputs from the People’s Republic of China, and for other purposes.</official-title></form><legis-body id="HBEEF331A85A34B23A1FED974A210A0ED" style="OLC"><section id="HF81054982CCE4255808168CDC1D84BF5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing American Agriculture Act</short-title></quote>. </text></section><section id="H80814EB3A6C4471AB64B411931705C0D"><enum>2.</enum><header>Critical agricultural products or inputs study</header><subsection id="H6B55803944874B95BEDCFF402C28EECA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture (in this section referred to as the <quote>Secretary</quote>) shall, on an annual basis, submit to the Committee on Agriculture of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate, an assessment of the dependency of the United States on critical agricultural products or inputs that could be exploited in the event the People’s Republic of China weaponizes any such critical dependency.</text></subsection><subsection id="HEA8BDE3BFA3440BEA08FD2DA368C5292"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The assessment under subsection (a) shall—</text><paragraph id="HAF04EAA7F40840608E89CA1A4E66D84B"><enum>(1)</enum><text>address, with respect to the critical inputs specified in subsection (c), the following:</text><subparagraph id="H1BC3D18B7CF04E809DA0DE3B52B99219"><enum>(A)</enum><text>the current domestic production capacity of each such critical input; and</text></subparagraph><subparagraph id="H2C29E678C2D54F7AAEE8256364437D54"><enum>(B)</enum><text>the current and potential bottlenecks in the supply chain for each such critical input that could be exploited by the People’s Republic of China; and</text></subparagraph></paragraph><paragraph id="H1DD7BD5ED80241AAA0DC7815E8BDA25D"><enum>(2)</enum><text display-inline="yes-display-inline">contain the Secretary’s recommendations to reduce the dependency of the United States on the People’s Republic of China to supply critical agricultural products or inputs, including—</text><subparagraph id="H5A6AF92B776B4787A0991034D2E86B92"><enum>(A)</enum><text>recommendations to mitigate potential threats posed by the People’s Republic of China to the supply chains of each critical input specified in subsection (c); and</text></subparagraph><subparagraph id="HC236539B687543CDAA4C623A06F2DF1B"><enum>(B)</enum><text>recommendations for legislative and regulatory actions to reduce barriers to onshore or nearshore the production of each such critical input.</text></subparagraph></paragraph></subsection><subsection id="H1CB29262D1DE48DC9456101991AF7383"><enum>(c)</enum><header>Critical inputs</header><text display-inline="yes-display-inline">The critical inputs specified in this subsection shall include all farm management, agronomic, and field-applied production inputs, including each of the following:</text><paragraph id="H14F12091BC2F4F5484E8AA914C6ECA00"><enum>(1)</enum><text display-inline="yes-display-inline">Agricultural equipment, machinery, and technology.</text></paragraph><paragraph id="H8E0406B9832B44E08AC695D22378E646"><enum>(2)</enum><text>Fuel.</text></paragraph><paragraph id="H26C9DA6B0AEF47399443915523A3C8EA"><enum>(3)</enum><text>Fertilizers.</text></paragraph><paragraph id="HEBD0E2E5A60D4AE5B9F8CD6A83745941"><enum>(4)</enum><text display-inline="yes-display-inline">Feed, including its components, such as vitamins, amino acids, and minerals. </text></paragraph><paragraph id="HB474B7CA3216452B96EBBE4076F71BDD"><enum>(5)</enum><text>Veterinary drugs and vaccines.</text></paragraph><paragraph id="HA319298957F5435CB7A904D3AA9E17C7"><enum>(6)</enum><text>Crop protection chemicals.</text></paragraph><paragraph id="HA8620C8357474BC0A7CD17E4AB958FCC"><enum>(7)</enum><text>Seed.</text></paragraph><paragraph id="H9897DFC3CFEF4C66862A0568E29F0AFE"><enum>(8)</enum><text>Any other critical agricultural inputs, as determined by the Secretary.</text></paragraph></subsection><subsection id="H90726263195B41E4A8129A3925F55285"><enum>(d)</enum><header>Collection, distribution, and protection of information</header><paragraph id="HC7B070C5F0AE43E1B6B5109A6E1797F1"><enum>(1)</enum><header>Voluntary basis</header><text display-inline="yes-display-inline">In conducting an assessment under subsection (a), the Secretary may not require any private entity to provide information to the Secretary.</text></paragraph><paragraph id="H43D5D6D89FFC45BC811095B220BE559E"><enum>(2)</enum><header>Aggregate data</header><text display-inline="yes-display-inline">In the case of information provided to the Secretary to conduct an assessment under subsection (a), neither the Secretary, any other officer or employee of the Department of Agriculture or agency thereof, nor any other person may—</text><subparagraph id="H20E510A87AB54806B1492BF306362EE8"><enum>(A)</enum><text>use such information for a purpose other than the development or reporting of aggregate data in a manner such that the identity of the person who supplied such information is not discernible and is not material to the intended uses of such information; or</text></subparagraph><subparagraph id="HB0770DA522AF4482B59F75B85D3165E9"><enum>(B)</enum><text>disclose such information to the public, unless such information has been transformed into a statistical or aggregate form that does not allow the identification of the person who supplied particular information.</text></subparagraph></paragraph><paragraph id="H53A9C85E876F49C197C0B0C4A87C0942"><enum>(3)</enum><header>Confidentiality</header><text>The Secretary shall ensure that assessments submitted under subsection (a) do not include any information that is a trade secret or confidential information subject to section 552(b)(4) of title 5, United States Code, or section 1905 of title 18, United States Code.</text></paragraph><paragraph id="H069FC946D885445792FE43128A9E0397"><enum>(4)</enum><header>Immunity from disclosure</header><text display-inline="yes-display-inline">Any information provided to the Secretary as part of an assessment conducted under subsection (a) may not be used by the Secretary for any purpose other than to carry out such subsection.</text></paragraph></subsection></section></legis-body></bill>
