introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to modify the social security number requirements for claiming the child tax credit and earned income tax credit.</official-title></form><legis-body id="HD94D573743AF4FE18E809C61DBF655B7" style="OLC"><section id="H504FA816777346E2A98F292189BFDC9D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding American Workers’ Benefits Act</short-title></quote>.</text></section><section id="HE1C120CCD7D04930BA892E02E58DF442" section-type="subsequent-section"><enum>2.</enum><header>Modification of social security number requirements for claiming the child tax credit and earned income tax credit</header><subsection id="HC7C45D8522C34BF780EFC803CA55974D"><enum>(a)</enum><header>Child tax credit</header><paragraph id="H2A39F68491CD456B8E68ADB77190DC1B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/24">Section 24(e)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" id="H88664170E45B4C8783303D36398A4F46" display-inline="no-display-inline"><subsection id="HD249AEE36D23488A8EACC2DE46FD102E"><enum>(e)</enum><header>Social security number requirements</header><paragraph id="H2BD551A9489D40BC9FBA12B60872484D"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No credit shall be allowed under this section to a taxpayer with respect to any qualifying child unless the taxpayer includes the social security number of the taxpayer (in the case of a joint return, of both spouses) and of such child on the return of tax for the taxable year.</text></paragraph><paragraph id="H34E156C1BE014C89B7565DBD25953FA8"><enum>(2)</enum><header>Social security number defined</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>social security number</quote> means a social security number issued to an individual by the Social Security Administration, but only if the social security number is issued—</text><subparagraph id="HC8B43101D01F4E95B462DEBA003BA174"><enum>(A)</enum><text display-inline="yes-display-inline">to a citizen of the United States or pursuant to subclause (I) (or that portion of subclause (III) that relates to subclause (I)) of section 205(c)(2)(B)(i) of the Social Security Act, and</text></subparagraph><subparagraph id="H8A4291FA2AC841B78494735E463BE31F"><enum>(B)</enum><text display-inline="yes-display-inline">before the due date for such return.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H07A42EA82D6143A1ACAD18373C89B3C7"><enum>(2)</enum><header>Application to taxable years beginning in 2025</header><text>Section 24(h) of such Code is amended—</text><subparagraph id="HB80FE879C41F4EBFBBC3AA3A92C3BA1F"><enum>(A)</enum><text>by striking subparagraph (C) of paragraph (4), and</text></subparagraph><subparagraph id="HAB651B0F4D27484390BC7803892EB873"><enum>(B)</enum><text>by striking paragraph (7).</text></subparagraph></paragraph><paragraph id="HBDC9D7542DDE462883756F71C53E9C46" display-inline="no-display-inline"><enum>(3)</enum><header>Conforming amendment</header><text>Section 6213(g)(2)(I) of such Code is amended by striking <quote>TIN</quote> and inserting <quote>social security number (as defined in section 24(e)(2))</quote>.</text></paragraph></subsection><subsection id="H6DF721D9A635452E8020569A8D0DB5B9"><enum>(b)</enum><header>Earned income tax credit</header><paragraph id="H040492C022904C90B6C09E0831097CBF"><enum>(1)</enum><header>In general</header><text>Section 32(m) of such Code is amended by striking <quote>a social security number issued to an individual by the Social Security Administration (other than a social security number issued pursuant to clause (II) (or that portion of clause (III) that relates to clause (II)) of section 205(c)(2)(B)(i) of the Social Security Act) on or before the due date for filing the return for the taxable year</quote> and inserting <quote>a social security number (as defined in section 24(e)(2))</quote>.</text></paragraph><paragraph id="HC273070E39BE4F5CB81DD9F7861AD06E" display-inline="no-display-inline"><enum>(2)</enum><header>Conforming amendment</header><text>Section 6213(g)(2)(F) of such Code is amended by striking <quote>taxpayer identification number</quote> and inserting <quote>social security number (as defined in section 24(e)(2))</quote>.</text></paragraph></subsection><subsection commented="no" id="HC9EB3F7A9F104C8A9549D43EF1C25572"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to taxable years beginning after December 31, 2024.</text></subsection></section></legis-body></bill>
