materials sourced from prohibited foreign entities from the clean vehicle credit.</official-title></form><legis-body id="H56E1C1C1947245CDBFB3705FD4B96F93" style="OLC"><section id="HA66BC8648B67441DB8BECC988250E141" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>End Chinese Dominance of Electric Vehicles in America Act of 2024</short-title></quote>. </text></section><section id="H6F2A889765874828AFFA5E211E7F46D8" commented="no"><enum>2.</enum><header>Exclusion from clean vehicle credit of vehicles containing materials sourced from prohibited foreign entities</header><subsection id="HEAD38C529EEF4F7A88BE84648FC19C43" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/30D">Section 30D(d)(7)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text><quoted-block style="OLC" id="HF3AA73D9FA39458083BE95D402709D05" display-inline="no-display-inline"><paragraph id="H3126B12F1ACF498B9D7D13903C7E7657"><enum>(7)</enum><header>Excluded entities</header><subparagraph id="H5AD3DA1227C4405F937AB218ED67E393"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>new clean vehicle</quote> shall not include any vehicle—</text><clause id="HD0A7615026E94ABC88368637769F188F"><enum>(i)</enum><text>with respect to which any of the components contained in the drive battery or any material contained in such a component was extracted, processed, recycled, manufactured, or assembled by a prohibited foreign entity, or</text></clause><clause id="H1CC021325EFE473A93C8549BCF560B61"><enum>(ii)</enum><text display-inline="yes-display-inline">the drive battery of which is designed, manufactured, or produced using any process attributable to any licensing, royalty, service, or similar agreement with a prohibited foreign entity the estimated total contract cost, including variable, contingent, or sales-based payments, of which exceeds $5,000,000.</text></clause></subparagraph><subparagraph id="HA2A95D4CC77E4834A949C47D1374BF60" commented="no"><enum>(B)</enum><header>Prohibited foreign entity</header><text>For purposes of subparagraph (A), the term <quote>prohibited foreign entity</quote> means—</text><clause id="HC8FA29B7DFB2424E9F06C3DAD49446B8"><enum>(i)</enum><text>any foreign entity of concern (as defined in section 40207(a)(5) of the Infrastructure Investment and Jobs Act),</text></clause><clause id="H8C8449626E0242FA8CB294460CE2E408" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">any entity with respect to which the government of a covered nation has the right or power (directly or indirectly) to appoint or approve the appointment of a covered officer, or</text></clause><clause id="HC8728277921C4602B00E0652E7E432E6" commented="no"><enum>(iii)</enum><text>any entity 25 percent or more of the capital or profits interests of which are owned (directly or indirectly) in the aggregate by 1 or more of the following:</text><subclause id="H1861D8C32DE44A9BB04521E6D6BB4DDE"><enum>(I)</enum><text>A covered nation or an entity described in clause (i) or (ii).</text></subclause><subclause id="HF1952012AAEE46E7BC81B01E9178A9FC"><enum>(II)</enum><text display-inline="yes-display-inline">A citizen, national, or resident of a covered nation.</text></subclause><subclause id="H95DEDDB79D3F41918430D522A041CA6A"><enum>(III)</enum><text>An entity organized under the laws of a covered nation.</text></subclause></clause></subparagraph><subparagraph id="HDA487B22AA2947859C980BD743FAEC51"><enum>(C)</enum><header>Covered officer</header><text>For purposes of this paragraph, the term <quote>covered officer</quote> means—</text><clause id="H1FB36ED60DD34DC8A684025DAC9A2822" commented="no"><enum>(i)</enum><text>any member of the board of directors, board of supervisors, or an equivalent governing body,</text></clause><clause id="HCED15FCD58954FB88CFC4CB609616E8E" commented="no"><enum>(ii)</enum><text>the president, senior vice president, chief executive officer, chief operating officer, chief financial officer, or general counsel, or</text></clause><clause id="HC634D30C6DF54141B8C901592EBAAF97"><enum>(iii)</enum><text>any individual who performs duties usually associated with a title listed in clause (i) or (ii).</text></clause></subparagraph><subparagraph id="H9568ECA1BE5F4896B1AF0C40002F813D" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header>Covered nation</header><text>For purposes of this paragraph, the term <quote>covered nation</quote> has the meaning given such term in section 4872(d) of title 10, United States Code.</text></subparagraph><subparagraph id="HB36F155ACDC94F07B9C60738643E5508"><enum>(E)</enum><header>Drive battery</header><text>For purposes of this paragraph, the term <quote>drive battery</quote> means, with respect to a vehicle, the battery from which the electric motor of such vehicle draws electricity.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7C7D1144642B43DE89A5A87DAEE9759A" commented="no"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made by this subsection shall apply to vehicles placed in service after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
