which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Surface Mining Control and Reclamation Act of 1977 to establish additional considerations with regard to the adequacy of permit performance bonds, and for other purposes.</official-title></form><legis-body id="H8F65D9AB4D5F445E97FAED596C387B23" style="OLC"><section id="HAFC80BD520AE4AE4A0E47C9FA6316BA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bond Improvement and Reclamation Assurance Act</short-title></quote>.</text></section><section id="H3F08CF48AB2D415DB2A1FC2DCFAC199A" section-type="subsequent-section"><enum>2.</enum><header>Surface Mining Control and Reclamation Act of 1977 reform</header><subsection id="H8892D3DF89F74B5187E4F0D755999AB0"><enum>(a)</enum><header>Permit performance bonds</header><text display-inline="yes-display-inline">Section 509 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1259">30 U.S.C. 1259</external-xref>) is amended—</text><paragraph id="H7D91A68260944E7E8219F94EB01CE87B"><enum>(1)</enum><text>in subsection (a), to read as follows:</text><quoted-block style="OLC" id="HE772E54E1A4846E1BFD4DABE3B8D6AC7" display-inline="no-display-inline"><subsection id="H00351DA750F74F8EAB284AB3258BBB92"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H273FD0BB52044321BCE9F3F9F1314186"><enum>(1)</enum><text>After a surface coal mining and reclamation permit application has been approved but before such a permit is issued, the applicant shall file with the regulatory authority, on a form prescribed and furnished by the regulatory authority, a bond for performance payable, as appropriate, to the United States or to the State, and conditional upon faithful performance of all the requirements of this Act and the permit.</text></paragraph><paragraph id="HF31BA3E990774FFCB2C7D31BC2D58531" indent="up1"><enum>(2)</enum><text>The bond shall cover that area of land within the permit area upon which the operator will initiate and conduct surface coal mining and reclamation operations within the initial term of the permit.</text></paragraph><paragraph id="HCF61D25ACCE443A99D18D9471D4ED0AB" indent="up1"><enum>(3)</enum><text>As succeeding increments of surface coal mining and reclamation operations are to be initiated and conducted within the permit area, the permittee shall file with the regulatory authority an additional bond to cover such increments in accordance with this section.</text></paragraph><paragraph id="H224D4ED570D34C3BAC488B250C589ADC" indent="up1"><enum>(4)</enum><text>The amount of the bond required for each bonded area shall—</text><subparagraph id="HFCC837BA1BAF46C98652B5B26A40DFA8"><enum>(A)</enum><text>be determined by the regulatory authority; </text></subparagraph><subparagraph id="H6312FC101CCF4367B05EE4E52F835829"><enum>(B)</enum><text>depend upon the reclamation requirements of the approved permit;</text></subparagraph><subparagraph id="HB081A036A993445AA058A664D3A148E4"><enum>(C)</enum><text>reflect the probable difficulty of reclamation giving consideration to factors including topography, geology of the site, hydrology, and revegetation potential;</text></subparagraph><subparagraph id="HC9D281ABDE9849849663B8FD8C70BC00"><enum>(D)</enum><text>be sufficient to ensure the completion of the reclamation plan if the work had to be performed by the regulatory authority in the event of bond forfeiture; and</text></subparagraph><subparagraph id="H5407720181D64934A4A446508E1C750F"><enum>(E)</enum><text>be set at a level consistent with the rebuttable presumption that the mine will close 5 years after the permit is issued.</text></subparagraph></paragraph><paragraph id="H0467174C770843CB84DA9CA729B5A09D" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">In setting the amount of the bond under paragraph (4), the regulatory authority shall consider—</text><subparagraph id="H2E5F5AEAC1AF40BF9243B10864FD83B3"><enum>(A)</enum><text>the impact of a reasonably expected level of inflation over the time period that the reclamation is likely to occur;</text></subparagraph><subparagraph id="H10B4D4C532414EE1B864166564A8A5CB"><enum>(B)</enum><text>the impact of an unplanned or early mine closure on the cost of reclamation, including whether there will be sufficient spoil available to reclaim the mine; and</text></subparagraph><subparagraph id="H59F2868A3E004C54A3562A1CCFF4EFF5"><enum>(C)</enum><text>any additional costs likely to be incurred as a result of the regulatory authority undertaking reclamation operations upon bond forfeiture.</text></subparagraph></paragraph><paragraph id="H48B57484755744CAB12920D26D3CCA2A" indent="up1"><enum>(6)</enum><text display-inline="yes-display-inline">The amount of a bond for the entire area under 1 permit may not be less than $52,593, annually adjusted for inflation in accordance with the Consumer Price Index for all Urban Consumers, as published by the Bureau of Labor Statistics.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H64283B1B1ACF4CF699FA81EB52241158"><enum>(2)</enum><text>in subsection (e), to read as follows:</text><quoted-block style="OLC" id="H48A038335D674B5FADEBF4576CF6D66E" display-inline="no-display-inline"><subsection id="H23109D2E4ECF438AA1F0D1FBF456E12E"><enum>(e)</enum><text display-inline="yes-display-inline">The amount of the bond or deposit required and the terms of each acceptance of the bond of the applicant shall be adjusted by the regulatory authority—</text><paragraph id="H0A8C2EEDC9654B1EAD24543748D90447"><enum>(1)</enum><text>from time to time—</text><subparagraph id="H53B6452905F24717A1971F1C0C27F295"><enum>(A)</enum><text>as affected land acreages are increased or decreased; or</text></subparagraph><subparagraph id="HE30A07E299DC453E98F52437864E7579"><enum>(B)</enum><text>where the cost of future reclamation changes due to changing circumstances, including—</text><clause id="H1AD72A7616954E8983ACEC7717874E37"><enum>(i)</enum><text>long-term water pollution discharge;</text></clause><clause id="HAF898308B2CF47E0B3A0EDF217354154"><enum>(ii)</enum><text>coal market conditions;</text></clause><clause id="H8FE938FC2DCF43CD9DE8EE86EE6ACE6B"><enum>(iii)</enum><text>unanticipated mine closures; and</text></clause><clause id="H09BC440E53FB4A2B845436DEC5672DF8" commented="no"><enum>(iv)</enum><text>changes in the reclamation plan;</text></clause></subparagraph></paragraph><paragraph id="HB643CD76C3B8496CB15CD421F9BA2331"><enum>(2)</enum><text>whenever a permit is renewed; and</text></paragraph><paragraph id="HDBD314F26E3746CB9BF47E5BA52F6AE2"><enum>(3)</enum><text>whenever a permit is transferred to a new operator.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HAC650715797E46A7A0291D6B56480B9C"><enum>(b)</enum><header>Revision of permits</header><text display-inline="yes-display-inline">Section 511 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1261">30 U.S.C. 1261</external-xref>) is amended—</text><paragraph id="H65674618D17B4CFDB1426910A6FE04E9"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="H400EB242C14143BAB2D67B88479FDA97"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H65A2E2D91C704817802A1DD0430A6701" display-inline="no-display-inline"><subsection id="H568E341004794B13919830110310D8E1"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H0616D2FA72374C28A0EBD4A8751E0593"><enum>(1)</enum><text>Before approving a transfer, assignment, or sale of the rights granted under a permit issued pursuant to this Act or an application for a revision of a permit submitted under subsection (a), the regulatory authority shall recalculate the amount of the bond required under section 509 for such permit and require the transferee, assignee, or purchaser of the rights granted under the permit or the permittee, respectively, to post such amount.</text></paragraph><paragraph id="H5CFB617B0D174B548A847DFBB279ED4F" commented="no" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A permittee and each covered person—</text><subparagraph id="H3AFE73FA8002466F8E9EEE3735442F14"><enum>(A)</enum><text>may not be released from liability under the permit; and</text></subparagraph><subparagraph id="HB3ED757B1FE64D5FAFF96EA58F083919"><enum>(B)</enum><text>shall be jointly and severally liable for all reclamation costs incurred by the regulatory authority to complete reclamation under the permit, including treatment of all postmining water pollution.</text></subparagraph></paragraph><paragraph id="HE6705BB00621479FB5CCA8B421334B97" indent="up1"><enum>(3)</enum><text>In this subsection, the term <term>covered person</term> means, with respect to a permittee—</text><subparagraph id="H516F1BB1C2B34AA1ADC1ACA18EAFC979"><enum>(A)</enum><text>a person that owns or otherwise controls 30 percent or more of the capital interests of the permittee; and</text></subparagraph><subparagraph id="H049B779629CA42CCA6295F921110B925"><enum>(B)</enum><text display-inline="yes-display-inline">a person that owns or otherwise controls 30 percent or more of the capital interests of a person described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5A6521F777BC4126B2A818AE48FB0997"><enum>(c)</enum><header>Inspections and monitoring</header><text display-inline="yes-display-inline">Section 517 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1267">30 U.S.C. 1267</external-xref>) is amended—</text><paragraph id="H1FC596025F174B30A05592DEF1FDEFC1"><enum>(1)</enum><text>in subsection (e)—</text><subparagraph id="H3EDA1E9C2BB041FAA7475138B6C58E66"><enum>(A)</enum><text>by striking <quote>Each inspector</quote> and inserting <quote>(1) Each inspector</quote>; and</text></subparagraph><subparagraph id="H705339BBF4A748C69EA7278334CD5582"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HEA4546B72E7343F69E62F865014CFC51" display-inline="no-display-inline"><paragraph id="HAF11BB274E9E441A9D89083D2A849EEA" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Each inspector, upon completion of an inspection of any surface coal mining and reclamation operations, shall forthwith inform the regulatory authority of any changes to conditions at such surface coal mining and reclamation operations that may—</text><subparagraph id="H798FFF999603493B897A38847034476B"><enum>(A)</enum><text>result in an unanticipated increase in the cost of reclamation of such surface coal mining and reclamation operations; and</text></subparagraph><subparagraph id="H09747DA6E2D247A5B236A632B19309C1"><enum>(B)</enum><text display-inline="yes-display-inline">necessitate a change to the amount of the bond established for the permit associated with such surface coal mining and reclamation operations under section 509.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H8711A810A26A485D8029DA9C240A7AEB"><enum>(2)</enum><text>in subsection (f), by inserting <quote>electronically and also</quote> after <quote>available to the public</quote>. </text></paragraph></subsection><subsection id="HF3186615A60F4B8AAE8AB0F38764A7B6"><enum>(d)</enum><header>Rulemaking</header><paragraph id="HD3FFB4C536DC4797803C17AF4E7DB5F9"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this section, taking into account the standards in subsections (a) and (e) of section 509 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1259">30 U.S.C. 1259</external-xref>) regarding bond adequacy, as amended by this section, the Secretary shall issue regulations to establish guidelines and benchmarks for each Federal and State regulatory authority to determine minimum bond amounts under section 509 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1259">30 U.S.C. 1259</external-xref>).</text></paragraph><paragraph id="HC2D8B2D42CFC4828B3AFB57AC3A150C7"><enum>(2)</enum><header>Data</header><text display-inline="yes-display-inline">In issuing the regulations described in paragraph (1), the Secretary shall use data from a representative sample of recent reclamation projects completed by Federal and State regulatory authorities as a result of bond forfeiture by a permittee.</text></paragraph><paragraph id="H230AEEF53D9648A58993800442322C16"><enum>(3)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HD4A69475C6704DB7ABABE6D75E79CE9E"><enum>(A)</enum><header>Regulatory authority</header><text display-inline="yes-display-inline">The term <term>regulatory authority</term> has the meaning given the term in section 701 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1291">30 U.S.C. 1291</external-xref>).</text></subparagraph><subparagraph id="H6CFD9C9582E74035971AB37B50939B5F"><enum>(B)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the Office of Surface Mining Reclamation and Enforcement.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
