which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To limit USDA funding for ground-mounted solar energy systems, and for other purposes.</official-title></form><legis-body id="H2CBD8A75489C408981B24FA2107B6673" style="OLC"><section id="H28A9EE19B8464B03B1498CA325D7AA1F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Our Lands and Resources Act</short-title></quote> or the <quote><short-title>SOLAR Act</short-title></quote>.</text></section><section id="H85C299639E1A40889B9825BBA0E347FA"><enum>2.</enum><header>Limitation on USDA funding for ground-mounted solar energy systems</header><subsection id="H8912182BCF074D258B70D3674B009454"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H9646386583BC4EE29DB4878EDDE12773"><enum>(1)</enum><header>Covered farmland</header><text>The term <term>covered farmland</term> has the meaning given in the term in section 1540(c)(1) of the Farmland Protection Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/7/4201">7 U.S.C. 4201(c)(1)</external-xref>).</text></paragraph><paragraph id="H76FF8C1774FF46B4982A60141F939D13"><enum>(2)</enum><header>Conversion</header><text display-inline="yes-display-inline">The term <term>conversion</term> means, with respect to covered farmland, any activity that results in the covered farmland failing to meet the requirements of a State (as defined in section 343 of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1991">7 U.S.C. 1991</external-xref>)) for agricultural production, activity, or use.</text></paragraph><paragraph id="H893239CC0A6C4C0C8E9F0E1158806EF7"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="H28C7383F651146C9A62F593F5563E2B3"><enum>(b)</enum><header>In general</header><text>The Secretary may not provide financial assistance for a project that would result in the conversion of covered farmland for solar energy production.</text></subsection><subsection id="H5430C23B57DA4AE4B54551A9F6620E2C"><enum>(c)</enum><header>Exception</header><text>Subsection (b) shall not apply to a project if the project—</text><paragraph id="HAA87A51E3C3E4E8B8F2395A273A272B3"><enum>(1)</enum><text display-inline="yes-display-inline">results in the conversion of less than the greater of—</text><subparagraph id="H2FBFB9C8E494493BB673CCF5A4318FDC"><enum>(A)</enum><text>a de minimis amount of covered farmland for solar energy production relative to the total project area necessary for the success of the project, as determined by the Secretary, not to exceed 5 acres; or</text></subparagraph><subparagraph id="H4CCC61813AE141B6A0A37E1F00C9CE31"><enum>(B)</enum><text>1 acre of covered farmland; and</text></subparagraph></paragraph><paragraph id="H34486B1E69C4454C97CD82202DE33364"><enum>(2)</enum><text>has received a resolution of approval or support, or other similar instrument from each county and municipality in which the project is sited.</text></paragraph></subsection><subsection id="HADBDEE3581454C508791C36B52FD5AA7"><enum>(d)</enum><header>Covered farmland protection</header><paragraph id="H0DEB7C5B5D914C3A95BF093AFAB8FE60"><enum>(1)</enum><header>Mitigation and remediation plan required</header><text display-inline="yes-display-inline">A person who has applied to the Secretary for financial assistance for a project that would result in the conversion of covered farmland for solar energy production and to which subsection (b) does not apply shall—</text><subparagraph id="H6C6138852E8F4421B3360146BDB9C4D5"><enum>(A)</enum><text>develop a mitigation and remediation plan for the project to—</text><clause id="H1D069BB476D9442097673E7B91858AFE"><enum>(i)</enum><text>implement best practices to protect future soil health and productivity, and mitigate soil erosion, compaction, and other effects of solar energy production during construction, operation, and decommissioning; and</text></clause><clause id="HE40FAAB608F84795A481D3089F936F8D"><enum>(ii)</enum><text>remediate and restore the soil health of the farmland to that of the farmland before the solar energy production project construction; and</text></clause></subparagraph><subparagraph id="HBCB8483126864479BC35D575BADBD2C7"><enum>(B)</enum><text>ensure that sufficient funds, as determined by the Secretary, are provided for the decommissioning of the solar energy production system and the remediation and restoration of covered farmland to carry out the mitigation and remediation plan described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H08E9EC52545B49A5AB1C7EBE6A5E4D18"><enum>(2)</enum><header>Obligation and disbursement of funds</header><text display-inline="yes-display-inline">The Secretary may obligate financial assistance for a project described in paragraph (1), but shall not disburse the financial assistance until the Secretary has determined that the applicant for the financial assistance has complied with paragraph (1).</text></paragraph><paragraph id="HA89BD5AA381647C09BCFAF2E98E9812C"><enum>(3)</enum><header>Plan implementation</header><text>A person referred to in paragraph (1) shall carry out—</text><subparagraph id="HF0626535B5DD411ABAE2721A6A797F59"><enum>(A)</enum><text>the provisions of the plan that are described in paragraph (1)(A)(i), on the receipt by the project of financial assistance from the Secretary and for the duration of solar energy production under the project; and</text></subparagraph><subparagraph id="HCA59EDB0AB71482791311061F1E9C78C"><enum>(B)</enum><text>the provisions of the plan that are described in paragraph (1)(A)(ii), on the cessation of solar energy production under the project.</text></subparagraph></paragraph><paragraph id="H9E05121194EF480683DCE0EEAE0688A0"><enum>(4)</enum><header>Compliance</header><text>A person who fails to comply with paragraph (3) with respect to a project shall repay to the Secretary the full amount of the financial assistance provided by the Secretary to the person for the project.</text></paragraph></subsection></section></legis-body></bill>
