which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to improve the efficiency of adjudications and appeals of claims for benefits under laws administered by Secretary of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="HF33279B961474A24B3FD178FD148B54D" style="OLC"><section id="H6E8E72F173EB4472B1DF4D893968CF7C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Appeals Efficiency Act of 2024</short-title></quote>. </text></section><section id="H95C46938E4FA45069DC478F5E693F725"><enum>2.</enum><header>Improvements to efficiency of adjudications and appeals of claims for benefits under laws administered by Secretary of Veterans Affairs</header><subsection id="HB46C4851FE2C4756938265ABB7DEB914"><enum>(a)</enum><header>Annual report on length of adjudications</header><paragraph id="H02AC324A2C5D4544A7BAAA939B8CBF09"><enum>(1)</enum><header>In general</header><text>Section 5109B of title 38, United States Code, is amended—</text><subparagraph id="H610A639D808C4663839A1534E78FDC78"><enum>(A)</enum><text>by striking <quote>The Secretary</quote> and inserting <quote>(a) <header-in-text level="subsection" style="USC">In general.—</header-in-text>The Secretary</quote>; and</text></subparagraph><subparagraph id="H94A70F31A56A4F1BB8410CAA16FB0CA5"><enum>(B)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="USC" id="HCD54C50F1A664C35808556B71ADB60A6" display-inline="no-display-inline"><subsection id="H6B5201CB774F4413A9F7E37C5F921A31"><enum>(b)</enum><header>Annual report</header><text display-inline="yes-display-inline">The Secretary shall submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate an annual report that includes, with respect to the period covered by the report, a statement of the average length of time a claim (or issue within a claim) that is remanded by the Board of Veterans' Appeals is pending before the Secretary after such return or remand.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H60F953966DBC4E6E92D051D80230EF6F"><enum>(2)</enum><header>Deadline</header><text>The Secretary of Veterans Affairs shall submit the first report required by subsection (b) of section 5109B of such title (as added by paragraph (1)) by not later than one year after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H798E445E43214E469E1A37527604746E"><enum>(b)</enum><header>Requirement To track certain claims for benefits</header><paragraph id="HD89E37095A4244B483EF9504B50B028F"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/51">Chapter 51</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/5109B">section 5109B</external-xref> the following new section:</text><quoted-block style="USC" id="H18F1E6F225DB4EC284FD71B8763D59CE" display-inline="no-display-inline"><section id="H51E87D3351C24FE891982852C030E0AF"><enum>5109C.</enum><header>Requirement to track and maintain information on certain claims for benefits; notice of certain assignments</header><subsection id="H1C4D786292304F85B91B0B35C4C702BD"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall use technology to track and maintain information (including information with respect to timeliness) on—</text><paragraph id="H03009A3C614D4C3BB245C35E313B94B1"><enum>(1)</enum><text>claims for benefits under the laws administered by the Secretary (including issues within such claims) that are—</text><subparagraph id="H3458D367A72A4F219CF074ECFAD50FC9"><enum>(A)</enum><text>continuously pursued in accordance with—</text><clause id="HC7342BD5E2D2473480B9901FD2E6DBD1"><enum>(i)</enum><text>sections 5104C(a) and 5110(a)(2) of this title; or</text></clause><clause id="HE7F97F6BA5C14B7EAEA2F505E6CF11C0"><enum>(ii)</enum><text>any other policy established by the Secretary;</text></clause></subparagraph><subparagraph id="H889E9538A4A14359A82EB3FE2C4A5380"><enum>(B)</enum><text>filed in the National Work Queue (or any successor system) but have not been assigned to an office of the Veterans Benefits Administration for adjudication;</text></subparagraph><subparagraph id="H912CCE247ACB4283A72A9784FE40EBED"><enum>(C)</enum><text display-inline="yes-display-inline">afforded expeditious treatment by the Veterans Benefits Administration pursuant to section 5109B of this title or any other policy established by the Secretary;</text></subparagraph><subparagraph id="HFB6C902462A6467D8C751D2C05EF502C"><enum>(D)</enum><text display-inline="yes-display-inline">remanded by the Board of Veterans’ Appeals to the Secretary pursuant to section 7104 of this title; or</text></subparagraph><subparagraph id="H367A48B3410F46888EA25A686C6DDED4"><enum>(E)</enum><text>pending a hearing by the Board of Veterans’ Appeals under section 7107 of this title;</text></subparagraph></paragraph><paragraph id="HAE313900AF844E7E89CEEAC454E4813D"><enum>(2)</enum><text>instances in which an adjudicator of the Veterans Benefits Administration does not comply with a relevant decision of the Board of Veterans’ Appeals to remand a claim for benefits under the laws administered by the Secretary (or issue within such claim), including such instances in which the relevant decision concerned a failure on the part of the agency of original jurisdiction to satisfy the Secretary’s duty to assist under section 5103A of this title;</text></paragraph><paragraph id="H2538B653649040639E1FDC7175911538"><enum>(3)</enum><text>supplemental claims under section 5108 of this title filed—</text><subparagraph id="HE6DD725A1A574BE6AEA2253B194EA4B0"><enum>(A)</enum><text>in accordance with section 5104C(a) and section 5110(a)(2) of this title; and</text></subparagraph><subparagraph id="HAA0E0B51FFF3496EABCCC535A1CEE573"><enum>(B)</enum><text>after the date of the applicable final decision of the Secretary with respect to a claim for benefits under the laws administered by the Secretary (or issue within such claim);</text></subparagraph></paragraph><paragraph id="HF13A365B9DFA47DBAD450DF349A9C025"><enum>(4)</enum><text>first notices submitted to the Secretary of the death of individuals in receipt of benefits under the laws administered by the Secretary, disaggregated by such individuals who were—</text><subparagraph id="HBA4ACC70DA1245C7BF8DBA82B1AF0BCA"><enum>(A)</enum><text>assigned a fiduciary; and</text></subparagraph><subparagraph id="H435945E0F64046C392EBCD8DE6EBEC73"><enum>(B)</enum><text>not assigned a fiduciary; and</text></subparagraph></paragraph><paragraph id="HBE3DAB5CA44E4BF6A7D443CA66DD90F5"><enum>(5)</enum><text display-inline="yes-display-inline">decisions of the Board of Veterans’ Appeals to remand a claim for benefits under the laws administered by the Secretary that the Chairman of the Board of Veterans’ Appeals determines were unnecessary pursuant to subsection (f) of section 7104 of this title.</text></paragraph></subsection><subsection id="H1B076DFFDE5D412AB3B024FAE67A378D"><enum>(b)</enum><header>Notice of reason for certain assignments</header><text>In carrying out this section, the Secretary shall prescribe rules and regulations to ensure that a claimant (or the representative of a claimant) may view or otherwise obtain notice of the reasons a relevant claim for benefits under the laws administered by the Secretary is—</text><paragraph id="H5A7C4B76C0354AFE834752774C5550CA"><enum>(1)</enum><text display-inline="yes-display-inline">deferred for additional action by an office of the Veterans Benefits Administration in the National Work Queue (or any successor system); or</text></paragraph><paragraph id="H9805C360BE2D4DAAB591C46B47F100BF"><enum>(2)</enum><text>assigned a suspense date for further action in the National Work Queue (or any successor system).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H59731B7A650746D29D65760F8553019F" commented="no"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 5109B the following new item:</text><quoted-block style="USC" id="H4C151ED08DFF4744807BECACDC54ABB4" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 5109C. Requirement to track and maintain information on certain claims for benefits; notice of certain assignments</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7CD97C5A71E2484287E4A153C2E831C9"><enum>(c)</enum><header>Improvements to Board of Veterans’ Appeals</header><paragraph id="HB857BAE75DFA49CB8C296726649B330A"><enum>(1)</enum><header>Authority to aggregate certain claims</header><text>Section 7104 of such section is amended in subsection (a) by inserting after the second sentence <quote>If the Chairman of the Board determines that more than one appeal involves substantially similar questions of law or fact, the Chairman may aggregate such appeals for review.</quote>.</text></paragraph><paragraph id="H6123E346B93C442A92F6FC4C4ACC269A"><enum>(2)</enum><header>Requirement to ensure substantial compliance with certain decisions</header><text>Such section is further amended by adding at the end the following new subsection—</text><subparagraph id="HA05C3836766740A594F1F1A5189D5730"><enum>(A)</enum><text>by redesignating subsection (f) as subsection (g); and</text></subparagraph><subparagraph id="HD2C10A17EDBB4D9C922475067B4714AC"><enum>(B)</enum><text> by inserting after subsection (e) the following new subsection (f):</text><quoted-block style="USC" id="H7A6CB2785EDF42FAAF1DB015CCB2DFEE" display-inline="no-display-inline"><subsection id="H7868BC40E1F24F3A9F42CCC686459A46"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H5788D1E4F7CD43B39DE47F5C6FA4066E"><enum>(1)</enum><text>The Secretary, acting through the Chairman of the Board, shall ensure substantial compliance with any decision of the Board to remand a claim.</text></paragraph><paragraph id="H571F016AE83B4231A8B238E727DFBFE3" indent="up1" commented="no"><enum>(2)</enum><text>The Secretary may waive the requirement under paragraph (1) with respect to a decision of the Board to remand a claim to the Secretary if the Chairman of the Board determines—</text><subparagraph id="H8DD79C0039FB4C299D0A7EA28092709B" commented="no"><enum>(A)</enum><text>evidence added to the evidentiary after the date of such decision is sufficient to resolve the issues underlying such decision; or</text></subparagraph><subparagraph id="H2DB4680A75A042D782E1AD066F757FAF" commented="no"><enum>(B)</enum><text>such decision was unnecessary.</text></subparagraph></paragraph><paragraph id="HB59B6181F3BE424B95894B9A40FEAD8B" indent="up1"><enum>(3)</enum><text>If the Secretary exercises the authority under paragraph (2), the Secretary shall include, pursuant to subsection (d), a written notation of such exercise in the decision of the Board. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA73E76D0B6B64A87B58BAC70A0E623C4"><enum>(3)</enum><header>Motion for OGC opinion</header><text>Section 7104 of such title is amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="H9D5293BF0B25499F8C5BB5C6C0C3818E" display-inline="no-display-inline"><subsection id="H3D1C0AC1F10D4B8FA9DE23140BFF7804" commented="no"><enum>(g)</enum><text display-inline="yes-display-inline">The Board may, on its own initiative or upon motion of the appellant, submit to the General Counsel a request for an opinion with respect to a question of law arising in an appeal under review by the Board. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE463668D830748E9A25A5916C40B8E54"><enum>(d)</enum><header>Expansion of jurisdiction of Court of Appeals for Veterans Claims</header><text display-inline="yes-display-inline">Section 7252 of title 38, United States Code, is amended—</text><paragraph id="HEC9CE98DC7524085B1352E9E07891609"><enum>(1)</enum><text>by redesignating subsections (b) and (c) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="H97AEAF76F4EA4844AF05558035B439EF"><enum>(2)</enum><text>by inserting after subsection (a) the following new subsections:</text><quoted-block style="USC" id="HF34F3585F314482EB0C874AE6AAA6AA4" display-inline="no-display-inline"><subsection id="H86758804D7AA42D7A07B63DAB1690BE3" commented="no"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H6DDAB0A228A844508CEDD74FD78C087E"><enum>(1)</enum><text>The Court shall have supplemental jurisdiction to review an eligible claim pending a final decision of the Board of Veterans Appeals with respect to such eligible claim.</text></paragraph><paragraph id="H77307A5E47D0428694A471B828D6D54B" indent="up1"><enum>(2)</enum><text>The period during which a claimant may submit a request for administrative review of an eligible claim under subsection (a) of section 5104C of this title shall be tolled for the period beginning on the date on which the claimant submits to the Court a motion for class action review and ending on the date that is 60 days after the date on which the Court issues a final decision with respect to—</text><subparagraph id="H2BC53D7570A44A0DB5489E7FA8F1CE8E"><enum>(A)</enum><text>such eligible claim; or</text></subparagraph><subparagraph id="H088210FA2A62458B9331DF4B891F6333"><enum>(B)</enum><text>such motion for class action review, whichever is later.</text></subparagraph></paragraph><paragraph id="H9896F572A79E445CB3DAA870480B4DC5" indent="up1" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term <quote>eligible claim</quote> means a claim for benefits under the laws administered by the Secretary for which relief may be granted on a class-wide basis pursuant to the rules of practice and procedure of the Court of Appeals for Veterans Claims.</text></paragraph></subsection><subsection id="H0C3060C29360442CB3A7A797C091E059" display-inline="no-display-inline"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H55D99A74153E42DCB8F95B2F47C67394"><enum>(1)</enum><text>The Court may remand a matter to the Board of Veterans’ Appeals for the limited purpose of ordering the Board to address a question of law or fact in a claim for benefits under the laws administered by the Secretary that the Court determines the Board failed to—</text><subparagraph id="HBDD99C36907A44B799D96DF291341E48" indent="up1"><enum>(A)</enum><text>address, in the relevant decision of the Board, an issue that—</text><clause id="H5112A33BA65C40999875940B4CCC7286"><enum>(i)</enum><text>the claimant (or representative of such claimant) raised; or</text></clause><clause id="H73D8A2A6EDB24050B578F8633F3CBB32"><enum>(ii)</enum><text>was reasonably raised by the evidentiary record of such claim; or</text></clause></subparagraph><subparagraph id="HE601AE2D2AF64D65B36E83C9599B81C2" indent="up1"><enum>(B)</enum><text>provide adequate reasons or bases for the decision of the Board with respect to such question.</text></subparagraph></paragraph><paragraph id="H3DED6D58AEE548FEB3FE0C48DD3B611B" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In issuing a remand under paragraph (1), the Court may require the Board to issue a decision on the relevant question with a certain period of time prescribed by the Court.</text></paragraph><paragraph id="H6E03BF461C21411CB49DE4F566C97B8C" indent="up1"><enum>(3)</enum><text>With respect to any matter remanded to the Board pursuant to paragraph (1), the Court shall—</text><subparagraph id="HC0F381E3F62D4CD0BCB9CA09735656C2"><enum>(A)</enum><text>retain jurisdiction over such matter; and</text></subparagraph><subparagraph id="H34D2A04D83AF4DA980A30D022EAED87C"><enum>(B)</enum><text>stay the proceedings of the Court on such matter until the date on which the Board issues the decision required by such remand.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2DD9B8D21C7F4801A18ADD07AF39A65E"><enum>(e)</enum><header>Study and report on common questions of law or fact before Board of Veterans’ Appeals</header><paragraph id="HF6490A968FF24E3CA22C270524A26C63"><enum>(1)</enum><header>Study</header><text>The Chairman of the Board of Veterans Appeals shall carry out a study to identify questions of law or fact the Board commonly considers when reviewing appeals pursuant to section 7104 of title 38, United States Code, for which precedential guidance would assist the Board in issuing final decisions on such appeals. The Chairman may use artificial intelligence and other technology in carrying out such study.</text></paragraph><paragraph id="H53A56FD9008B4136BEAC57C2BC7CFA26"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Chairman of the Board of Veterans Appeals shall submit to the Committees on Veterans Affairs of the House of Representatives and the Senate a report that includes the findings of the study required by paragraph (1).</text></paragraph></subsection><subsection id="H946190F31EFD4556AF736599DF371D80"><enum>(f)</enum><header>Independent assessment of potential modifications to authority of Board of Veterans’ Appeals</header><paragraph id="H03D90836DF1240E79042E9EA3CB0AE9A"><enum>(1)</enum><header>Agreement</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall seek to enter into an agreement with an FFRDC for an assessment of the feasibility of modifying the authority of the Board of Veterans’ Appeals established under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/71">chapter 71</external-xref> of title 38, United States Code, to permit the Board to issue precedential decisions with respect to questions of law or fact arising in matters before the Board.</text></paragraph><paragraph id="HAFE64A1B85554408A81E2DCF7A83BF11"><enum>(2)</enum><header>Assessment</header><text display-inline="yes-display-inline">An FFRDC that enters to an agreement under subsection (a) shall submit to the Secretary a written assessment that includes the following:</text><subparagraph id="HA19458E9B42047C1B144C39C92D84D2C"><enum>(A)</enum><text display-inline="yes-display-inline">The determination of the FFRDC of whether modifying the authority of the Board to permit the Board to issue precedential decisions with respect to questions of law or fact arising in matters before the Board is feasible.</text></subparagraph><subparagraph id="H6D206F8553FE412F8460051612B04E2F"><enum>(B)</enum><text display-inline="yes-display-inline">An assessment of the authority of the Board of Veterans’ Appeals to aggregate, for review, more than one appeal under chapter 71 of such title that involves substantially similar questions of law or fact pursuant to section 7104 of such title (as amended by subsection (c)(1)). </text></subparagraph><subparagraph id="HF68BB6AB13BB4C4F8CE953C56BBFFB76"><enum>(C)</enum><text display-inline="yes-display-inline">The recommendations of the FFRDC with respect to rules or principles to which the Board should adhere when aggregating appeals for review pursuant to section 7104(a) of title 38, United States Code (as amended by subsection (d)).</text></subparagraph></paragraph><paragraph id="H2CCF8EE855A3481A9EE5F0989319B6E6"><enum>(3)</enum><header>Report; implementation</header><text>Not later than 90 days after the Secretary receives the assessment under subsection (b), the Secretary shall—</text><subparagraph id="H2413792A75984966AED24A338505FEF2"><enum>(A)</enum><text>submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a copy of such assessment; and</text></subparagraph><subparagraph id="H95C1AAFDC6A74AE2B36444FF832CE01D"><enum>(B)</enum><text display-inline="yes-display-inline">create policies and procedures to implement the recommendations in the assessment with respect to the authority of the Board of Veterans’ Appeals described in subparagraph (B) of paragraph (2).</text></subparagraph></paragraph><paragraph id="HA0B03AE0A1AD43A28224908C1B9B9E4F"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HA261190DEB134DB283FFAD4E28A0CBDB"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>FFRDC</quote> means a federally funded research and development center.</text></subparagraph><subparagraph id="H45D96427B2AE4ABA83CF2BEDA53112E8" commented="no"><enum>(B)</enum><text>The terms <quote>claimant</quote> and <quote>notice</quote> have the meanings given such terms in section 5100 of title 38, United States Code.</text></subparagraph></paragraph></subsection><subsection id="H64DC0697F81F4E4FBE90D2EA9913E014"><enum>(g)</enum><header>Plan for timely assignment of claims</header><text>The Secretary of Veterans Affairs shall develop a plan to ensure claims for benefits administered by the Secretary are assigned to an adjudicator of the Veterans Benefits Administration of the Department of Veterans in a timely manner to the National Work Queue (or any successor system of the Department) and submit to the Committees on Veterans’ Affairs of the House of Representatives and the Senate a copy of such plan by not later than one year after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
