R. 7887</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240409">April 9, 2024</action-date><action-desc><sponsor name-id="M000194">Ms. Mace</sponsor> (for herself and <cosponsor name-id="K000391">Mr. Krishnamoorthi</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Accountability</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 41, United States Code, to prohibit minimum experience or educational requirements for proposed contractor personnel in certain contract solicitations, and for other purposes.</official-title></form><legis-body id="HCDF15B016BAA44D99FC54DED4E690D43" style="OLC"><section id="H7FF3DD0A1CC74EF3A33477C83247DD50" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Allowing Contractors to Choose Employees for Select Skills Act</short-title></quote> or the <quote><short-title>ACCESS Act</short-title></quote>.</text></section><section id="HB06FC6A8EBEC41519718F88CB632C21B"><enum>2.</enum><header>Use of requirements regarding experience and education of contractor personnel</header><subsection id="H0E22362A931B4F579A99322AC200590D"><enum>(a)</enum><header>Flexibility in contractor education requirements</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">Chapter 33</external-xref> of title 41, United States Code, is amended by adding at the end the following new section:</text><quoted-block style="USC" id="HD00709A2828145098BC7C7C3438A04C2" display-inline="no-display-inline"><section id="H888C56AED0DD423FA57C8359F993DDDB"><enum>3313.</enum><header>Flexibility in contractor education requirements</header><subsection id="H7D9E18EB0CBB47E7829D6C8E3469D496"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">A solicitation may not set forth any minimum experience or educational requirement for proposed contractor personnel in order for a bidder to be eligible for award of a contract unless the contracting officer includes in the solicitation a written justification that explains why the needs of the executive agency cannot be met without any such requirement and clarifies how the requirement ensures the needs are met.</text></subsection><subsection id="H75BA4788704C41C68FA27670FE1E1A89"><enum>(b)</enum><header>Executive agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>executive agency</term> has the meaning given that term in section 133.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H40FC7C95F75E43989B8A0B8BFD13A3D4"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/41/33">chapter 33</external-xref> of title 41, United States Code, is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H69CA02D826BC440DBC21D3B32FEB8D5F" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="item">Sec. 3313. Flexibility in contractor education requirements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H418D92CC2CA24602B00A07EE3B40123E"><enum>(c)</enum><header>OMB Guidance</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall issue guidance to executive agencies for implementing the amendment made by subsection (a) that includes the following:</text><paragraph id="HEEE7709BFC794FDAAC96CB97FBE67F45"><enum>(1)</enum><text>Instructions for contracting officers for the justifications under section 3313(a) of title 41, United States Code, as added by subsection (a), including a requirement that each use of an education or experience requirement be separately determined, justified, and reviewed.</text></paragraph><paragraph id="HA8E6EDF90899406889E1FC0249752CF9"><enum>(2)</enum><text>In the case of a solicitation in which education and work experience requirements are included, instructions on how alternative certifications, industry-recognized credentials, and work-based learning programs, including apprenticeships, may satisfy such requirements.</text></paragraph></subsection><subsection id="HE3529D4A2C3E4B45A7257470E8D3CD41" commented="no"><enum>(d)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to solicitations issued on or after the date that is 180 days after the date of the enactment of this Act. </text></subsection><subsection id="H9587916DE0D949ADA7FDBFC275CDB3DE"><enum>(e)</enum><header>GAO report</header><text>Not later than 18 months after the date of the enactment of this Act, the Comptroller General shall submit to Congress an evaluation of executive agency compliance with section 3313 of title 41, United States Code, as added by subsection (a).</text></subsection><subsection id="H119EDDEF01E14E3FB4F40C39E43E7FD9"><enum>(f)</enum><header>Executive agency defined</header><text display-inline="yes-display-inline">In this section, the term <term>executive agency</term> has the meaning given that term in section 133 of title 41, United States Code.</text></subsection></section></legis-body></bill>
