R. 7822</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240326">March 26, 2024</action-date><action-desc><sponsor name-id="G000594">Mr. Tony Gonzales of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act with respect to visa overstays.</official-title></form><legis-body id="HB9C411E65CCC43A4B4BDCCB1099AAADD" style="OLC"><section id="H006EF30016C040E59A4BF8366189C846" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visa Integrity Act of 2024</short-title></quote>.</text></section><section id="HBD12276C719345C69776DB36FCF7A92B"><enum>2.</enum><header>Visa overstays criminalized</header><subsection id="H3F9572DA1B3D472495E00C41F399936E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 275 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325</external-xref>) is amended—</text><paragraph id="H25EE795F81CD42C2B7277498F1524511"><enum>(1)</enum><text>in subsection (a) by inserting after <quote>for a subsequent commission of any such offense</quote> the following: <quote>or if the alien was previously convicted of an offense under subsection (e)</quote>;</text></paragraph><paragraph id="HD7F52FEAC7EA4CB6AC2C491650E252A4"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H5B426316D9E747D09F4AC74876AE8B6D"><enum>(A)</enum><text>in paragraph (1), by striking <quote>at least $50 and not more than $250</quote> and inserting <quote>not less than $500 and not more than $1,000</quote>;</text></subparagraph><subparagraph id="H03328B0985464D20AD0A01858851454F"><enum>(B)</enum><text>in paragraph (2), by inserting after <quote>in the case of an alien who has been previously subject to a civil penalty under this subsection</quote> the following: <quote>or subsection (e)</quote>; and</text></subparagraph><subparagraph id="HA58EFAFDF20A4AFBB579C4DD9B38AD66"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HEEF56CFFAF38429CACFFBF078C467044" display-inline="no-display-inline"><subsection id="H376F3A7E7FEE4AAE82CBD0869B05E3DD"><enum>(e)</enum><text display-inline="yes-display-inline">An alien who was admitted as a nonimmigrant for an aggregate of 10 days or more who has failed to </text><paragraph commented="no" display-inline="yes-display-inline" id="HEF7545D2FFAE454683793424F1580639"><enum>(1)</enum><text>maintain such nonimmigrant status, or a change in classification of nonimmigrant status under section 248, including complying with the period of stay authorized by the Secretary of Homeland Security in connection with such status, or </text></paragraph><paragraph commented="no" display-inline="yes-display-inline" id="H10FB851F120545D6BF546CF5C0283B59"><enum>(2)</enum><text display-inline="yes-display-inline">comply otherwise with the conditions of such nonimmigrant status, shall for the first commission of such a violation, be fined under title 18, United States Code, or imprisoned not more than 6 months, or both, and, for a subsequent commission of such a violation, or if the alien was previously convicted of an offense under subsection (a), be fined under such title 18, or imprisoned not more than 2 years, or both.</text></paragraph></subsection><subsection id="H104199C1906845958482B0C0CB6ECD86"><enum>(f)</enum><text>An alien in violation of this subsection (e) shall be subject to a civil penalty of </text><paragraph commented="no" display-inline="yes-display-inline" id="H115239E05AB747F1BA32A9620BACF852"><enum>(1)</enum><text>not less than $500 and not more than $1,000 for each violation, or</text></paragraph><paragraph commented="no" display-inline="yes-display-inline" id="H356CCAF8483745D994275EBF87FB065D"><enum> (2)</enum><text>twice the amount specified under paragraph (1) in the case of an alien who has been previously subject to a civil penalty under subsection (a) or (e). A civil penalty under this subsection shall be in addition to, and not in lieu of, any criminal or other civil penalties that may be imposed. </text></paragraph></subsection><subsection id="H0782383D9A374CAFBF201BBF583653A2"><enum>(g)</enum><text display-inline="yes-display-inline">If the Secretary of Homeland Security determines on an individual case-by-case basis that, because of reasons of a medical necessity, public safety, or national security, the alien violated subsection (e), the alien shall not be subject to the penalties under subsection (e).</text></subsection><subsection id="HFCDD66CBADE54E9DBDDD7A1C1A138AC3"><enum>(h)</enum><text>In the case of any application or petition by or on behalf of an alien for admission to the United States, the Secretary of State or the Secretary of Homeland Security, as applicable, shall provide the alien with notice of the penalties under this section on receipt of the application or petition, and again at the time of admission.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HC7CBA2E7CEA1499B8028DE4EA8D4BCAA"><enum>(b)</enum><header>Negotiations by Secretary of Homeland Security</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Homeland Security shall seek to negotiate agreements, accords, or memoranda of understanding between the United States and Mexico to—</text><paragraph id="H32E0C64FF54A49668F0E8466AD166022"><enum>(1)</enum><text display-inline="yes-display-inline">require the sharing of relevant, reliable, and accurate information within the legal and privacy regimes of both countries, such as information contained on biographic and biometric national security watchlists, certain traveler criminal history records, and immigration violations; and</text></paragraph><paragraph id="H0266D2923E68437088292BE7EB33B5C7"><enum>(2)</enum><text>requiring the sharing of entry data at the land border such that the entry information from one country could constitute the exit information from another through an integrated entry and exit system.</text></paragraph></subsection></section></legis-body></bill>
