R. 7796</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240322">March 22, 2024</action-date><action-desc><sponsor name-id="B001313">Ms. Brown</sponsor> (for herself, <cosponsor name-id="P000610">Ms. Plaskett</cosponsor>, <cosponsor name-id="C001126">Mr. Carey</cosponsor>, and <cosponsor name-id="J000309">Mr. Jackson of Illinois</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and the Workforce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to authorize the use of Student Support and Academic Enrichment Grants for the development and maintenance of school and community gardens, and for other purposes.</official-title></form><legis-body id="HA9EEEC45DE534314978489AD8D627F7F" style="OLC"><section id="H03B6E03EC676454D84F2376EAA9FC0F2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Thriving Community Gardens Act</short-title></quote>.</text></section><section id="HD428234DA2C74BF98F68D21241C53A0E"><enum>2.</enum><header>Activities to support safe and healthy students</header><text display-inline="no-display-inline">Clause (ii) of section 4108(5)(C) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7118">20 U.S.C. 7118(5)(C)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H10C3D771390C467A90966D0FBA9E5B7D" display-inline="no-display-inline"><clause id="H3B231368A05F48679EAACD16AD2196A8"><enum>(ii)</enum><text display-inline="yes-display-inline">support a healthy, active lifestyle, including—</text><subclause id="H06CDB023BF3041578FD2440F91B1F1EA"><enum>(I)</enum><text>nutritional education and regular, structured physical education activities and programs, that may address chronic disease management with instruction led by school nurses, nurse practitioners, or other appropriate specialists or professionals to help maintain the well-being of students; and</text></subclause><subclause id="HE2D33488AF5F4D368E351AC5FA929B0E"><enum>(II)</enum><text display-inline="yes-display-inline">the development and maintenance of school or community gardens;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H8BC9A86745084BA09714BB563D706BA9"><enum>3.</enum><header>Information collection and best practices</header><subsection id="HB661C72A36284AE791A6593AE2FF4765"><enum>(a)</enum><header>Information collection</header><text display-inline="yes-display-inline">The Secretary of Education shall regularly collect information from local educational agencies that use funds provided under section 4108 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7118">20 U.S.C. 7118</external-xref>) to develop and maintain community gardens (as authorized under paragraph (5)(C)(ii)(II) of such section).</text></subsection><subsection id="H1624028123D740AEB0C4AFAF2B7DB4A1"><enum>(b)</enum><header>Identification of best practices</header><text display-inline="yes-display-inline">Based on the information collected from local educational agencies under subsection (a), the Secretary of Education shall identify best practices for the development and maintenance of community gardens as described in such subsection.</text></subsection><subsection id="H4ED5D77A36F041B08A4E0DE8192BAF32"><enum>(c)</enum><header>Publication and updates</header><text>The Secretary of Education shall—</text><paragraph id="H91DC6112BFBA44098FE7F8CF05E56FD0"><enum>(1)</enum><text>publish the best practices identified under subsection (b) on a publicly accessible website of the Department of Education; and</text></paragraph><paragraph id="H2029C0274C264FCFA89050DD9B8C9C17"><enum>(2)</enum><text>regularly update the best practices based on information received from local educational agencies under subsection (a).</text></paragraph></subsection></section></legis-body></bill>
