which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Endangered Species Act of 1973 to prohibit the taking for a trophy of any endangered or threatened species of fish or wildlife in the United States and the importation of endangered and threatened species trophies into the United States, and for other purposes.</official-title></form><legis-body id="HEAE52D8CE3BC4E5CB0566ED4CB0F2849" style="OLC"><section id="HD09590B969B341509F573D4FCB570CC3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prohibiting Threatened and Endangered Creature Trophies Act of 2024</short-title></quote> or the <quote><short-title>ProTECT Act of 2024</short-title></quote>.</text></section><section id="H23C975927CD04436861A010D55BFA33F"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H13239C2F98CA4EF4A5A96C95F938EEFA"><enum>(1)</enum><text display-inline="yes-display-inline">Trophy hunting of imperiled species undermines efforts to conserve wildlife populations because trophy hunters routinely target the biggest, strongest males, and removing those individuals from the population can decrease genetic variation, decrease reproduction, alter social structures, increase infanticide, and cause unnatural evolutionary impacts.</text></paragraph><paragraph id="H1C75962564E44902A80F520B65345CD7"><enum>(2)</enum><text>When trophy hunting of imperiled species is sanctioned, poaching activity increases, further threatening the survival of wildlife populations.</text></paragraph><paragraph id="HADCCE43316544350A6A3D253E956C730"><enum>(3)</enum><text>Legal trade in wildlife parts and products can provide cover for markets for illegal trade in wildlife products, which is worth up to $20,000,000,000 annually and run by professional criminal networks linked to other transnational organized criminal activities, including trafficking in narcotics, weapons, and humans.</text></paragraph><paragraph id="H945C41179A8246C3924DD211FCC97846"><enum>(4)</enum><text>While the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>) currently prohibits the take and import of species listed under that Act as endangered species, it does not automatically extend those protections to species listed as threatened species.</text></paragraph></section><section id="H02735F6F4BD94E42B344A95D5EE3EB81"><enum>3.</enum><header>Prohibitions regarding taking and importing of endangered species and threatened species trophies</header><subsection id="HD6AAB4A7734841A89364F76C11675646"><enum>(a)</enum><header>Prohibition of taking or importing</header><text>Section 9 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1538">16 U.S.C. 1538</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HEC7147B7F3494C0B98ACFFE594DE9BB3" style="OLC"><subsection id="H1697E4BA64F54E66A97663E925A1167D"><enum>(h)</enum><header>Trophies</header><text display-inline="yes-display-inline">It is unlawful for any person subject to the jurisdiction of the United States—</text><paragraph id="HB6DEC801C10F43AE8A54F085FD4C8346"><enum>(1)</enum><text display-inline="yes-display-inline">to take for a trophy within the United States or the territorial sea of the United States any species of fish or wildlife listed under section 4 as a threatened species; or</text></paragraph><paragraph id="HB83CFA8CCBBD492B8FDF8F0C5C557D25"><enum>(2)</enum><text display-inline="yes-display-inline">to import into the United States any trophy of any species of fish or wildlife listed under section 4 as a threatened species.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1DEE7116F5294D8DA59D2153C8B6EDE1"><enum>(b)</enum><header>Prohibition of permits</header><text display-inline="yes-display-inline">Section 10(a) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539(a)</external-xref>) is amended—</text><paragraph id="HF643E4AB29244F49A4FD51E332C850EE"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>The Secretary may permit</quote> and inserting <quote>Except as otherwise provided in this subsection, the Secretary may permit</quote>; and</text></paragraph><paragraph id="H7D8A698AA12B4FAEA7122B6F3E8E75BC"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA8EDA2801C3C40BEAEDF0E39BF95C6CD" style="OLC"><paragraph display-inline="no-display-inline" id="H29D31815FC444DD998D4D30596EA3BA4" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary may not permit or otherwise allow—</text><subparagraph id="H3C2F1AE31938417F9E480F560851D668"><enum>(A)</enum><text display-inline="yes-display-inline">taking for a trophy any species of fish or wildlife listed under section 4; or</text></subparagraph><subparagraph id="HE6BC61C4B06C474AA049CBA546FA8FA9"><enum>(B)</enum><text display-inline="yes-display-inline">importing into the United States any trophy of any species of fish or wildlife listed under section 4, notwithstanding section 9(b).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H17365CC2DBDB43C1A4F37FC10916FDBB"><enum>(c)</enum><header>Antiques</header><text display-inline="yes-display-inline">Section 10(h)(1) of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1539">16 U.S.C. 1539(h)(1)</external-xref>) is amended by striking <quote>Sections 4(d), 9(a), and 9(c) do not apply</quote> and inserting <quote>Sections 4(d), 9(a), 9(c), and 9(h)(2) do not apply</quote>.</text></subsection><subsection id="HC50CBCDA89BA4CF2A3F50C5F43843552"><enum>(d)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 3 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1532">16 U.S.C. 1532</external-xref>) is amended—</text><paragraph id="H0A0534244F6E40BB8564637E49A564A5"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (21) as paragraph (22); and</text></paragraph><paragraph id="H213F4598564843218D4066F4468794EE"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (20) the following:</text><quoted-block display-inline="no-display-inline" id="HA762157221B549169E8BDFDE884EBF1D" style="OLC"><paragraph id="HBA8A3BBFC81244359EEDB22C44536461"><enum>(21)</enum><text display-inline="yes-display-inline">The term <quote>trophy</quote> means a whole dead animal, or a readily recognizable part or derivative of an animal, that—</text><subparagraph id="HD10A02B8AB0C4DC79B131D23EB18F12D"><enum>(A)</enum><text>is raw, processed, or manufactured; and</text></subparagraph><subparagraph id="H43D95D4821534C0CB5552A3355E3BA6F"><enum>(B)</enum><text>was obtained under a hunting license or other authorization issued by any State, foreign government, or private landowner.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
