R. 7780</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240321">March 21, 2024</action-date><action-desc><sponsor name-id="M001210">Mr. Murphy</sponsor> (for himself, <cosponsor name-id="K000376">Mr. Kelly of Pennsylvania</cosponsor>, <cosponsor name-id="T000478">Ms. Tenney</cosponsor>, and <cosponsor name-id="V000134">Ms. Van Duyne</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to prohibit certain retirement plans from making investment decisions on the basis of factors other than financial risk and return factors.</official-title></form><legis-body id="HE91B073E8D9044F18B5AC6C60F54E1B3" style="OLC"><section id="H88BE073E964A4FC48D614484CD36B3DA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Investment Options for Retirement Act</short-title></quote>. </text></section><section id="HA91D913D353F42528E6C14EA2017806C"><enum>2.</enum><header>Prohibition on certain retirement plans from making investment decisions on the basis of factors other than financial risk and return factors</header><subsection id="H6E874B98CBE74D2D856688777E27C2B7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/401">Section 401(a)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after paragraph (39) the following new paragraph:</text><quoted-block style="OLC" id="H211A306DFC584CCA948766B6DCD827A3" display-inline="no-display-inline"><paragraph id="HEC966CC0E47D4CECAEEAE8C81F80AE9E"><enum>(40)</enum><header>Prohibition on consideration of factors other than financial risk and return factors</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <quote>exclusive benefit</quote> shall include a requirement that the corpus and income of the trust are invested exclusively on the basis of financial risk and return factors.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H12FB24D0581343E98877CE0ECEB3D342"><enum>(b)</enum><header>Application to annuity contracts</header><text>Section 403(b)(1) of such Code is amended by striking <quote>and</quote> at the end of subparagraph (D), by adding <quote>and</quote> at the end of subparagraph (E), and by inserting after subparagraph (E) the following new subparagraph:</text><quoted-block style="OLC" id="H63B28B9CF6BC412DA84A74155ED7C835" display-inline="no-display-inline"><subparagraph id="H4E65238DA44A49AD8A5ABC23F709A616"><enum>(F)</enum><text display-inline="yes-display-inline">the corpus and income invested pursuant to such contract are invested exclusively on the basis of financial risk and return factors,</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H26AD83A0714C4FED9661AC1778535A20"><enum>(c)</enum><header>Application to governmental plans</header><text>Section 457(e) of such Code is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HE3B0BD711B04482B81885A993ABA3385" display-inline="no-display-inline"><paragraph id="H2F50DF7A600C405C8897289897BAD925"><enum>(19)</enum><header>Prohibition on governmental plans considering factors other than financial risk and return factors</header><text display-inline="yes-display-inline">In the case of an employer described in subsection (e)(1)(A), a plan shall not be treated as meeting the requirements of this section unless the corpus and income of the plan are invested exclusively on the basis of financial risk and return factors.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF0028D4F4E4E4E99A4B35CA17928F4E4"><enum>(d)</enum><header>Administration by Treasury</header><text display-inline="yes-display-inline">Sections 401(a)(40), 403(b)(1)(F), and 457(e)(19) of the Internal Revenue Code of 1986 (as amended by this section) shall be administered exclusively by the Secretary of the Treasury or the Secretary’s delegate.</text></subsection><subsection id="HB66826497C8D48CABD41C2C2024D8529"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to plan years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
