section-type="section-one" id="H5B5276CF5CC84EE0BAC2F7C0C52738B1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commission to Study the Potential Transfer of the Weitzman National Museum of American Jewish History to the Smithsonian Institution Act</short-title></quote>.</text></section><section id="HFE29EE6CDCF74CD69607C415395B47DB"><enum>2.</enum><header>Establishment of commission</header><subsection id="H0FBCC64F291B4B26A1E25D7C3AF6BD49"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established the Commission to Study the Potential Transfer of the Weitzman National Museum of American Jewish History to the Smithsonian Institution (hereafter in this Act referred to as the <quote>Commission</quote>). </text></subsection><subsection id="H13465CA74B884396B98BF9AA5D9E4A14"><enum>(b)</enum><header>Membership</header><text display-inline="yes-display-inline">The Commission shall be composed of 8 members, of whom—</text><paragraph id="H38FBC9BE6E4B4028B5F30CC910CD52C9"><enum>(1)</enum><text>2 voting members shall be appointed by the majority leader of the Senate;</text></paragraph><paragraph id="H4D2CDF57E8E04E698EEAB6111BF0B035"><enum>(2)</enum><text>2 voting members shall be appointed by the Speaker of the House of Representatives;</text></paragraph><paragraph id="HFD6D8F3377754D7F90CC08D2F5C6D441"><enum>(3)</enum><text>2 voting members shall be appointed by the minority leader of the Senate; and</text></paragraph><paragraph id="H345EC39048114B7983FAB2B781C3E4A4"><enum>(4)</enum><text>2 voting members shall be appointed by the minority leader of the House of Representatives.</text></paragraph></subsection><subsection id="H6610333EF90E4951A3A086EDBE9062BD"><enum>(c)</enum><header>Qualification</header><text display-inline="yes-display-inline">Members of the Commission shall be appointed to the Commission from among individuals, or representatives of institutions or entities, who possess—</text><paragraph id="H79DCEAB6EDEF4C128FE02FAB04165AF8"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE7205D37D56C490CA7A21F1285D291C0"><enum>(A)</enum><text display-inline="yes-display-inline">a demonstrated commitment to the research, study, or promotion of Jewish American history, art, political or economic status, or culture; and</text></subparagraph><subparagraph id="HAF172A0C18864A4D852B14E948738204" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H56E5E47C53514700A86201ADAF60145A"><enum>(i)</enum><text display-inline="yes-display-inline">expertise in museum administration; </text></clause><clause id="HFCC669C0469047B98D07EA33E5DC186E" indent="up1"><enum>(ii)</enum><text>expertise in fund-raising for nonprofit or cultural institutions; </text></clause><clause id="HDE1E066A6874489EA18363D65C4A1878" indent="up1"><enum>(iii)</enum><text>experience in the study and teaching of Jewish American history;</text></clause><clause id="H3A9EE557BCD549E3949A4ABAD7E46EF0" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">experience in the study and teaching of combating and countering antisemitism;</text></clause><clause id="H0A481735F2BF4C5D8E2AFE9A2F6F8EA8" indent="up1"><enum>(v)</enum><text>experience in studying the issue of the representation of Jewish Americans in art, life, history, and culture at the Smithsonian Institution; or </text></clause><clause id="H389CCB47000B4498A4C5EC26617D2041" indent="up1"><enum>(vi)</enum><text>extensive experience in public or elected service;</text></clause></subparagraph></paragraph><paragraph id="HD74358DF49A24A428A7BC14DAAAE67CF"><enum>(2)</enum><text display-inline="yes-display-inline">experience in the administration of, or the strategic planning for, museums; or</text></paragraph><paragraph id="HE1C8F6F2E07644BBA3DEB3DF950042E2"><enum>(3)</enum><text display-inline="yes-display-inline">experience in the planning or design of museum facilities.</text></paragraph></subsection><subsection id="H8D545F04F25F40E9A515B02894D84200"><enum>(d)</enum><header>Deadline for initial appointment</header><text display-inline="yes-display-inline">The initial members of the Commission shall be appointed not later than the date that is 90 days after the date of enactment of this Act.</text></subsection><subsection id="H5320C057E8CE40BCB437F68C744765DC"><enum>(e)</enum><header>Vacancies</header><text>A vacancy in the Commission—</text><paragraph id="H3451CA2DF1A14BEB9E20DC08C40CC6C9"><enum>(1)</enum><text display-inline="yes-display-inline">shall not affect the powers of the Commission; and </text></paragraph><paragraph id="H1CC9851EA3AA4A3B95B7F77A58813846"><enum>(2)</enum><text>shall be filled in the same manner as the original appointment was made.</text></paragraph></subsection><subsection id="H4761E50D93C0488B8F5AD7899121333E"><enum>(f)</enum><header>Chairperson</header><text display-inline="yes-display-inline">The Commission shall, by majority vote of all of the voting members, select 1 member of the Commission to serve as the Chairperson of the Commission. </text></subsection><subsection id="H911E1D174D0E452C879673AB678DC810"><enum>(g)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No employee of the Federal Government may serve as a member of the Commission. </text></subsection></section><section id="HCB42445472324628AEE2B390AEFD414E"><enum>3.</enum><header>Duties of commission</header><subsection id="HC0BAB38ED0D846EDA9F46C696FED2EA6"><enum>(a)</enum><header>Reports and other deliverables</header><text>Not later than 2 years after the date of the first meeting of the Commission, the Commission shall submit to the President and to Congress the report, plan, and recommendations described in paragraphs (1) through (3). </text><paragraph id="H5146564015A84F38BC7B0D34AA3EB513"><enum>(1)</enum><header>Report on issues</header><text>A report that addresses the following issues relating to the Weitzman National Museum of American Jewish History in Philadelphia, PA, and its environs (hereafter in this Act referred to as the <quote>Museum</quote>):</text><subparagraph id="HF14A84E7E43A444495E2CC0069EE11FD"><enum>(A)</enum><text>The collections held by the Museum at the time of the report, the extent to which such collections are already represented in the Smithsonian Institution and Federal memorials at the time of the report, and the availability and cost of future collections to be acquired and housed in the Museum.</text></subparagraph><subparagraph id="HDCB832905A2D49A588CBD421CDB609D8"><enum>(B)</enum><text>The impact of the Museum on educational and governmental efforts to study and counter antisemitism.</text></subparagraph><subparagraph id="HDB643D53935B45B9A3DC9A729958350B"><enum>(C)</enum><text>The financial assets and liabilities held by the Museum, and the cost of operating and maintaining the Museum.</text></subparagraph><subparagraph id="H6D53DB7003D94F0198E51CC2350C6BF9"><enum>(D)</enum><text>The governance and organizational structure from which the Museum should operate if transferred to the Smithsonian Institution.</text></subparagraph><subparagraph id="H63CD27CFE9274625A4548B2915B7F049"><enum>(E)</enum><text>The financial and legal considerations associated with the potential transfer of the Museum to the Smithsonian Institution, including—</text><clause id="H7327D98C354545F9899D4130F26C09AB"><enum>(i)</enum><text>any donor or legal restrictions on the Museum’s collections, endowments, and real estate;</text></clause><clause id="H2F3CA64FAF3A4F4F896910A72BF36E99"><enum>(ii)</enum><text>costs associated with actions that will be necessary to resolve the status of employees of the Museum, if the Museum is transferred to the Smithsonian Institution; and</text></clause><clause id="HF77271A2C1524AA5AF099B7207B81CFB"><enum>(iii)</enum><text>all additional costs for the Smithsonian Institution that would be associated with operating and maintaining a new museum outside of the Washington, D.C. metropolitan area. </text></clause></subparagraph><subparagraph id="H06F2556AB2E441B89E22890F9AFD7C73"><enum>(F)</enum><text>The feasibility of the Museum becoming part of the Smithsonian Institution, taking into account the Museum’s potential impact on the Smithsonian’s existing facilities maintenance backlog, collections storage needs, and identified construction or renovation costs for new or existing museums.</text></subparagraph></paragraph><paragraph id="H9A4BEA2E9DEB4C598EFE7F740B97D1C3"><enum>(2)</enum><header>Fund-raising plan</header><text>A fund-raising plan that addresses the following topics:</text><subparagraph id="HF710253442BB4D32A70582F2AD2FD4A6"><enum>(A)</enum><text>The ability to support the transfer, operation, and maintenance of the Museum through contributions from the public, including potential charges for admission.</text></subparagraph><subparagraph id="HEE01414A257048539404618897BA2A39"><enum>(B)</enum><text>Any potential issues with funding the operations and maintenance of the Museum in perpetuity without reliance on appropriations of Federal funds.</text></subparagraph></paragraph><paragraph id="H0BB10BCC0EF240CD85639D792E6093BA"><enum>(3)</enum><header>Legislative recommendations</header><text>A report containing recommendations regarding a legislative plan for transferring the Museum to the Smithsonian Institution, which shall include each of the following: </text><subparagraph id="H441BBC25CB3D4E3C8C23317E98F85EC0"><enum>(A)</enum><text>Proposals regarding the time frame, one-time appropriations level, and continuing appropriations levels that might be included in such legislation.</text></subparagraph><subparagraph id="HDA0AD7F17B6E48AAA740131C301FAA15"><enum>(B)</enum><text>Recommendations for the future name of the Museum if it is transferred to the Smithsonian Institution.</text></subparagraph></paragraph></subsection><subsection id="H62CCB4B46C144DC285310EE025AEB9F9"><enum>(b)</enum><header>National conference</header><text display-inline="yes-display-inline">Not later than 2 years after the date on which the initial members of the Commission are appointed under section 2, the Commission may, in carrying out the duties of the Commission under this section, convene a national conference relating to the Museum, to be comprised of individuals committed to the advancement of the life, art, history, and culture of Jewish Americans. </text></subsection></section><section id="HD323C5C5DA3A4495BDDE4DB0EE7B95FE"><enum>4.</enum><header>Administrative provisions</header><subsection id="H0136709853E441208ABB09346DB81B07"><enum>(a)</enum><header>Compensation</header><paragraph id="H84514CA17D6C47499046F562FEABB344"><enum>(1)</enum><header>In general</header><text>A member of the Commission—</text><subparagraph id="H0D5C8C4BE0DE4B329113FB914D0FA3BE"><enum>(A)</enum><text display-inline="yes-display-inline">shall not be considered to be a Federal employee for any purpose by reason of service on the Commission; and </text></subparagraph><subparagraph id="H0BBD7F93D76C4B6C9D60CE2E35F61090"><enum>(B)</enum><text>shall serve without pay.</text></subparagraph></paragraph><paragraph id="HA8048A2D07634B26B73E0A12E62EF3C1"><enum>(2)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">A member of the Commission shall be allowed a per diem allowance for travel expenses, at rates consistent with those authorized under subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/57">chapter 57</external-xref> of title 5, United States Code. </text></paragraph><paragraph id="H5B0ED5D2E73E4BC0B4D9DA4DA0CAD376"><enum>(3)</enum><header>Gifts, bequests, and devises</header><text display-inline="yes-display-inline">The Commission may solicit, accept, use, and dispose of gifts, bequests, or devises of money, services, or real or personal property for the purpose of aiding or facilitating the work of the Commission. Such gifts, bequests, or devises may be from the Museum. </text></paragraph></subsection><subsection id="H887193F8B5844578BA213F7D0B1F68DC"><enum>(b)</enum><header>Termination</header><text display-inline="yes-display-inline">The Commission shall terminate on the date that is 30 days after the date on which the final versions of the report, plan, and recommendations required under section 3 are submitted. </text></subsection><subsection id="HD1D6E69C9F284646ADE3FB7552915118"><enum>(c)</enum><header>Funding</header><text display-inline="yes-display-inline">The Commission shall be solely responsible for acceptance of contributions for, and payment of the expenses of, the Commission. </text></subsection><subsection id="HD65F57601A204147A200121C3DDF1A82"><enum>(d)</enum><header>Director and staff of commission</header><paragraph id="HDF76422C7EEF48C0B462A63F15C0535A"><enum>(1)</enum><header>Director and staff</header><subparagraph id="HF1FBEFD4B19F441B9CD10172617EB69A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission may employ and compensate an executive director and any other additional personnel that are necessary to enable the Commission to perform the duties of the Commission. </text></subparagraph><subparagraph id="H85715005C31647FEA7EBEF613560384A"><enum>(B)</enum><header>Rates of pay</header><text display-inline="yes-display-inline">Rates of pay for persons employed under subparagraph (A) shall be consistent with the rates of pay allowed for employees of a temporary organization under section 3161 of title 5, United States Code. </text></subparagraph></paragraph><paragraph id="HF004F33E08D5453092DD7E66F8A2DC3E"><enum>(2)</enum><header>Not Federal employment</header><text display-inline="yes-display-inline">Any individual employed under this subsection shall not be considered a Federal employee for the purpose of any law governing Federal employment.</text></paragraph><paragraph id="HB8A4B20F23694F83867FF97497890329"><enum>(3)</enum><header>Technical assistance</header><subparagraph id="H46BD3D7219A548F6A34F6EEF45215F95"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), on request of the Commission, the head of a Federal agency shall provide technical assistance to the Commission.</text></subparagraph><subparagraph id="H978F7B37186949EF97C192A0D3A9DDDB"><enum>(B)</enum><header>Prohibition</header><text>No Federal employees may be detailed to the Commission.</text></subparagraph></paragraph><paragraph id="H04955A46F3A94019BB05F70978EBA709"><enum>(4)</enum><header>Volunteer services</header><text>Notwithstanding section 1342 of title 31, United States Code, the Commission may accept and use voluntary and uncompensated services as the Commission determines necessary.</text></paragraph></subsection><subsection id="H5DCDD8E6B06E466E87FB03E04E9CE00B"><enum>(e)</enum><header>Administrative support services</header><text>Upon request of the Commission, the Administrator of the General Services Administration shall provide to the Commission, on a reimbursable basis, the administrative support services necessary for the Commission to carry out its responsibilities under this Act. The involvement of the General Services Administration shall be limited to providing administrative support to the Commission, and such involvement shall terminate upon termination of the Commission. </text></subsection><subsection id="HB79A80CE9FD744AA97C63068C741AED1"><enum>(f)</enum><header>Meeting location</header><text>The Commission may meet virtually or in-person.</text></subsection><subsection id="H1F83063BD3BD46BA98EFEF828A8B4576"><enum>(g)</enum><header>Appointment delays</header><text>The Commission may begin to meet and carry out activities under this Act before all members of the Commission have been appointed if—</text><paragraph commented="no" display-inline="no-display-inline" id="HD8BF1F597C4041348D7FBF4FE49AE7D7"><enum>(1)</enum><text display-inline="yes-display-inline">90 days have passed since the date of the enactment of this Act; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD8DCC9513A614FD3B0D5143C51B28BBC"><enum>(2)</enum><text display-inline="yes-display-inline">a majority of the members of the Commission have been appointed. </text></paragraph></subsection></section></legis-body><endorsement display="yes"><action-date date="20240917">September 17, 2024</action-date><action-desc>Reported with an amendment, committed to the Committee of the Whole House on the State of the Union, and ordered to be printed</action-desc></endorsement></bill>
