R. 7732</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20240319">March 19, 2024</action-date><action-desc><sponsor name-id="V000135">Mr. Van Orden</sponsor> (for himself and <cosponsor name-id="B001295">Mr. Bost</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HVR00">Veterans' Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles 10 and 38, United States Code, to make improvements to certain programs for a member nearing separation, or for a veteran who recently separated, from the Armed Forces, and for other purposes.</official-title></form><legis-body id="HBED56CC43D054634A2C41BE7B31C586B" style="OLC"><section id="H10A26414CD144369A17DE1321209C9AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing the Transitioning Servicemember’s Experience Act</short-title></quote> or the <quote><short-title>ETS Act</short-title></quote> .</text></section><section id="HCE973DAD596B4F039C29F56306644150" section-type="subsequent-section"><enum>2.</enum><header>Transition Assistance Program: amendments; pilot program; reports</header><subsection id="H9B6E0DE89ADC4B709B21401C2873DD85"><enum>(a)</enum><header>Requirement of preseparation counseling: number of days</header><text display-inline="yes-display-inline">Subsection (a) of section 1142 of title 10, United States Code, is amended, in paragraph (1)—</text><paragraph id="H80690EE73DC444EC881AFAEC8ED8BC8C"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>Within</quote>; and</text></paragraph><paragraph id="H395BDF7E92DE47858FF53105CFF4C5B7"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="H731FA87F95E846D7AE244F0F56228A35" display-inline="no-display-inline"><subparagraph id="H603AEC0FED2C47928583784CF3FE340C" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The Secretary concerned shall ensure that a member described in subparagraph (A) receives preseparation counseling in the following amounts:</text><clause id="H6FB2AA0340A84FA9948825A7818C3408"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a member who has secured full-time employment, or has enrolled in a program of education or vocational training, that shall commence after the member separates, retires, or is discharged, not fewer than three days.</text></clause><clause id="HFDC8451DCA4F4E2FAAFFF6CCA2A8177B"><enum>(ii)</enum><text>In the case of a member other than a member described in clause (i), not fewer than five days.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H35D7F245426540C9B14BEFF337A8F944"><enum>(b)</enum><header>Provision of preseparation counseling: third-Party counselors; in-Person to the extent practicable</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (2)—</text><paragraph id="HFC9F8E726C81440C8AE9229F5D370B17"><enum>(1)</enum><text>by inserting <quote><header-in-text level="subparagraph" style="USC"><enum-in-header>(A)</enum-in-header></header-in-text></quote> before <quote>In carrying</quote>; and</text></paragraph><paragraph id="H446A12545E3F468D9E1219A90B287D7B"><enum>(2)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="USC" id="H363E2043EF4146F0BBF4CB39D8526D43" display-inline="no-display-inline"><subparagraph id="HD3CB49BE53BD4575A098A809C8BB91C3" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">Preseparation counseling may not be provided by a member of the armed forces or a civilian employee of the Secretary concerned. The Secretary concerned shall enter into an agreement with an entity to provide such counseling.</text></subparagraph><subparagraph id="H8A8214F0B7274BB0B21D0323A989A89E" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">Preseparation counseling shall be provided in person to the extent practicable. If the Secretary concerned determines that a member cannot attend such counseling in person, such member may receive such counseling remotely.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD6E827FF751C495F9E6BA5E2C6F1828F"><enum>(c)</enum><header>Waiver for certain members of the reserve components</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (4), by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="H68FA612D4BA347E38196A25A10F68C23" display-inline="no-display-inline"><subparagraph id="H2A06E824BACB4F00B2B3387C8FB6B58D" indent="up2"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary concerned may waive the requirement for preseparation counseling under paragraph (1) in the case of a member of the reserve components who requests such a waiver and who received preseparation counseling during the period of three years preceding the date of such request.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H395BB2DF448C4AC293502EAA0756B59C"><enum>(d)</enum><header>Eligibility of a member who reenlists To receive preseparation counseling</header><text>Such subsection is further amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HA33CE3ECE3E249CE94C0B11716A4C9F7" display-inline="no-display-inline"><paragraph id="H2A959A849A7649B8940B749E4C1A63EA" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">A member described in this subsection may elect to receive preseparation counseling regardless of whether such member reenlists or agrees to a new period of obligated service.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDAA5D347039D43A882368B0D71FE4CA1"><enum>(e)</enum><header>Elective inclusion of the spouse of a member</header><text display-inline="yes-display-inline">Such section is further amended, in subsection (b), in paragraph (5), by striking <quote>regarding the matters covered by paragraphs (9), (10), and (16)</quote>.</text></subsection><subsection id="HE1B789FC560A478888EEEFAA3FADC6A5"><enum>(f)</enum><header>Minimum amount of counseling regarding financial planning</header><text display-inline="yes-display-inline">Such subsection is further amended, in paragraph (9), by adding <quote>Counseling under this paragraph may not be shorter than one hour.</quote> at the end.</text></subsection><subsection id="HE9D9547604914499949DA18709C6AB0A"><enum>(g)</enum><header>Counseling regarding homelessness and food insecurity</header><text display-inline="yes-display-inline">Such subsection is further amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="HA8A525B16DF346C585291090EB09380D" display-inline="no-display-inline"><paragraph id="HCCF52E9429AF4A5CBE2F1AC320ADAC5C"><enum>(20)</enum><text display-inline="yes-display-inline">If the Secretary concerned determines that a member is at risk of homelessness or food insecurity, information regarding Federal benefits for low-income households, including the supplemental nutrition assistance program (as such term is defined in section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/88/525">Public Law 88–525</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>)). In making such determination, the Secretary concerned shall consider factors including the following:</text><subparagraph id="HA25733398324470E89C19F19AAF3E0CE"><enum>(A)</enum><text display-inline="yes-display-inline">Whether the member is eligible for the basic needs allowance under section 402b of title 37.</text></subparagraph><subparagraph id="HA8DA3549A5F04A53951BDDC0564E4D56"><enum>(B)</enum><text>Whether the member is being medically separated or is being retired under chapter 61 of this title.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC960F989720248AE80EE2BAB3C9C607C" display-inline="no-display-inline"><enum>(h)</enum><header>Presentation by a veterans service organization in preseparation counseling</header><text display-inline="yes-display-inline">Such subsection is further amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H584F445DB7A94BDF9D2B3788A734A92E" display-inline="no-display-inline"><paragraph id="H9BE5120B22EF4690A3088C0B3CB0DDD5"><enum>(21)</enum><text display-inline="yes-display-inline">A presentation that promotes the benefits available to veterans under laws administered by the Secretary of Veterans Affairs. Such presentation—</text><subparagraph id="H1FF9B83F48DA4A97A3EA9FC6911A666D"><enum>(A)</enum><text display-inline="yes-display-inline">shall be standardized;</text></subparagraph><subparagraph id="HA60D960590EE4A189C4892E490F31286"><enum>(B)</enum><text>shall be previously reviewed and approved by the Secretary of Veterans Affairs;</text></subparagraph><subparagraph id="H161F7FFB913A47918A1AAE24B48D17F3"><enum>(C)</enum><text display-inline="yes-display-inline">shall be submitted by the Secretary of Veterans Affairs to the Committees on Armed Services, and the Committees on Veterans’ Affairs, of the Senate and House of Representatives, for review at least 90 days before implementation;</text></subparagraph><subparagraph id="HEB746FF6CAC348F6B2C2F2911FDAC9FA"><enum>(D)</enum><text display-inline="yes-display-inline">shall be presented by—</text><clause id="H23AADBB46F1149F0A1B67BEFD68C375A"><enum>(i)</enum><text>a national representative of a veterans service organization recognized under section 5902 of title 38; or</text></clause><clause id="H2DA06D712DFB43EF8BE6B2D85B20FBCA"><enum>(ii)</enum><text display-inline="yes-display-inline">if a national representative is unavailable, a State or local representative of such an organization authorized by the Secretary concerned to so present;</text></clause></subparagraph><subparagraph id="H7A7C979532134D1385FCA0AB0492D71C"><enum>(E)</enum><text display-inline="yes-display-inline">shall include information on how a veterans service organization may assist the member in filing a claim described in paragraph (19);</text></subparagraph><subparagraph id="H474905AA684B4A21900CFB25EB6F8AF0"><enum>(F)</enum><text display-inline="yes-display-inline">may not encourage the member to join a particular veterans service organization; and</text></subparagraph><subparagraph id="HE08BF5D0B1B448A99CA952C683A213D3"><enum>(G)</enum><text>may not be longer than one hour.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H948E7AFC0E314B26BFA324A716B58EBD"><enum>(i)</enum><header>Pathway for a member who transfers from regular component to a reserve component</header><text display-inline="yes-display-inline">Such section is further amended, in subsection (c)(1)(D), by inserting <quote>, or is transferring from a regular component to a reserve component</quote> before the period at the end.</text></subsection><subsection id="H93011EC9E3FA453899404C7E21F143C7"><enum>(j)</enum><header>Coordination with Solid Start Program of the Department of Veterans Affairs</header><text display-inline="yes-display-inline">Such section is further amended, in subsection (d)—</text><paragraph id="H1EE41840BCD94E27B9BB339EEB7325B2"><enum>(1)</enum><text>in the heading, by striking <quote><header-in-text level="subsection" style="USC">medical</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="USC">certain</header-in-text></quote>;</text></paragraph><paragraph id="H82CE3578D8644484A7D8254616643229"><enum>(2)</enum><text>by inserting <quote>(1)</quote> before <quote>In the case</quote>; and</text></paragraph><paragraph id="HB6CA5F0CC29A48BAB029F200E45C0E5F"><enum>(3)</enum><text>by adding at the end the following new paragraphs:</text><quoted-block style="USC" display-inline="no-display-inline" id="HBE7C8ABB791046189C8690FF27336A0B"><paragraph id="H445D8B23914441F3BE891B7A7AE26B26" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Before a member described in subsection (a) separates, retires, or is discharged, the Secretary concerned shall transmit to the Secretary of Veterans Affairs the following information:</text><subparagraph id="H1ACFA3D4CEB140A6943746541D213B54"><enum>(A)</enum><text>The contact information of such member.</text></subparagraph><subparagraph id="H4A9A52B76102406C9C3E7D5EA61FB714"><enum>(B)</enum><text display-inline="yes-display-inline">The determination of the Secretary concerned under subsection (b)(20) regarding such member.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF1ED89A2110C427D8AAB404F5F3F1861"><enum>(k)</enum><header>Prohibition of provision of DD Form 214 for certain members who do not complete preseparation counseling</header><text>Such section is further amended by adding at the end the following new subsection:</text><quoted-block style="USC" id="HF7AA64E08E374D0D98914CB8C778EF3B" display-inline="no-display-inline"><subsection id="H11AF5201923A487B8CD43AF294C1DD1A"><enum>(f)</enum><header>DD Form 214</header><paragraph commented="no" display-inline="yes-display-inline" id="H85580F60CC884896835644BC560A3FD1"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary concerned may not provide a member required to receive preseparation counseling under this section a copy of the Certificate of Release or Discharge from Active Duty (DD Form 214) for such member if the member does not complete such counseling.</text></paragraph><paragraph id="HED28246CF4A0479E924B1EF8AA7D6F94" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The prohibition under paragraph (1) shall not apply in the case of a member—</text><subparagraph id="H44B89423B1CE4A0F8595190A0A075F70"><enum>(A)</enum><text>who is being retired or separated for disability; or</text></subparagraph><subparagraph id="H4C68F26A205B40D48A825B6B71A6D654"><enum>(B)</enum><text>whose discharge is not characterized as honorable or general.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCD67D5477F9E43169588AAE116CB5457" display-inline="no-display-inline"><enum>(l)</enum><header>Department of Labor Employment Navigator and Partnership Program</header><paragraph id="HFDF6A1115FD9451E88AFC1BDBB2AC4E1"><enum>(1)</enum><header>Establishment of program</header><text display-inline="yes-display-inline">Section 1144 of title 10, United States Code, is amended—</text><subparagraph id="HC9FAAD9EECED420288F8FDDA0AA9920E"><enum>(A)</enum><text>in subsection (d)—</text><clause id="H85E0BC52033A4DB18AD116BC7AC38A33"><enum>(i)</enum><text>in paragraph (4), by inserting <quote>and</quote> after the semicolon; </text></clause><clause id="HD475A78C9DBE4200BCD2C4EB147AEA36"><enum>(ii)</enum><text>by striking paragraphs (5) and (6); and</text></clause><clause id="HC80D43195F234A73A32D455AEEB0CC19"><enum>(iii)</enum><text>by redesignating paragraph (7) as paragraph (5);</text></clause></subparagraph><subparagraph id="HFCB78C3479C345F28D2D9CD34EFB3E18"><enum>(B)</enum><text>by redesignating subsections (e) and (f) as subsections (f) and (g), respectively; and</text></subparagraph><subparagraph id="H77DAA57A3F0C408CB6746AC54F536B76"><enum>(C)</enum><text>by inserting after subsection (d) the following new subsection (e):</text><quoted-block id="H531F38FFAB8848E981418E375E225FF2" style="OLC"><subsection id="H6B26B0D0F30B46FCB6314E55A28198AB"><enum>(e)</enum><header>Employment navigator and partnership program</header><paragraph commented="no" display-inline="yes-display-inline" id="H4F3045E8580244539B71D62F172B9170"><enum>(1)</enum><text>As part of the program carried out under this section, the Secretary of Labor, in consultation with the Secretary of Defense, the Secretary of Homeland Security, and the Secretary of Veterans Affairs, shall carry out and maintain a program to be known as the <quote>Employment Navigator and Partnership Program</quote>. Under such program, the Secretary of Labor shall seek to enter into contracts with public, private, and nonprofit entities under which such entities provide individualized employment counseling for members of the Armed Forces and their spouses.</text></paragraph><paragraph id="H15054408EF6A48B980207E77187929E9" display-inline="no-display-inline" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In carrying out the program under this subsection, the Secretary of Labor shall—</text><subparagraph id="H5183011C10B44D4EBD2A339F75BE7C71"><enum>(A)</enum><text>prioritize entering into contracts with qualified private entities that have experience providing instruction to members of the Armed Forces eligible for assistance under the program carried out under this section on—</text><clause id="HAB34C042F1204C8086E0A1534EEE238A"><enum>(i)</enum><text>private sector culture, résumé writing, career networking, and training on job search technologies;</text></clause><clause id="HD685ADA3FEA44DA9ABB1154204950C91"><enum>(ii)</enum><text>academic readiness and educational opportunities; or</text></clause><clause id="H1E862B19840846F19D79C63900987020"><enum>(iii)</enum><text>other relevant topics, as determined by the Secretary;</text></clause></subparagraph><subparagraph id="H29BA56E4C077417686317DF8BB1D8165" display-inline="no-display-inline"><enum>(B)</enum><text>give a preference to any private entity that—</text><clause id="HC7D1BBF969C94240B0E7C275AA010355"><enum>(i)</enum><text>has a national or international geographical area of service;</text></clause><clause id="H8EF5FAEF44D5485B8868B0362BB3BC0F"><enum>(ii)</enum><text>provides multiple forms of career assistance and placement services to—</text><subclause id="H10A23AEAE03A475190D4A1E05CE07585"><enum>(I)</enum><text>active duty members of the Armed Forces;</text></subclause><subclause id="H9486937DC3D14A4AA0158210CBAB2A23"><enum>(II)</enum><text>spouses of active duty members of the Armed Forces;</text></subclause><subclause id="HDCDB976B52244F08BAFC959B97DED60B"><enum>(III)</enum><text>veterans; and</text></subclause><subclause id="HBE0D8E0157284BACAF4862D4CFAE9EA9"><enum>(IV)</enum><text>spouses of veterans;</text></subclause></clause><clause id="HCFC1FCA5D700400BB8FF6A6389E12025"><enum>(iii)</enum><text>provides services to at least 5,000 individuals who are—</text><subclause id="H4C9BC2B9D7124FF0A7D150D05EB61306"><enum>(I)</enum><text>active duty members of the Armed Forces;</text></subclause><subclause id="H57CEAA0879DD4AA3A051CE8C165BF10B"><enum>(II)</enum><text>spouses of active duty members of the Armed Forces;</text></subclause><subclause id="H56FD2605ED014E84BCDC0CE2A91BB182"><enum>(III)</enum><text>veterans; or</text></subclause><subclause id="H1A0742635A1E488485A95EABDD82C3B7"><enum>(IV)</enum><text>spouses of veterans;</text></subclause></clause><clause id="H7926619717E0466BA6C4ACF76CC131E4"><enum>(iv)</enum><text display-inline="yes-display-inline">has continuously, for at least the five-year period immediately preceding the date of the contract, provided services to individuals who are—</text><subclause id="H612D0839688E45DB8D7ACABBE7882F4B"><enum>(I)</enum><text>active duty members of the Armed Forces;</text></subclause><subclause id="H8CD6A2D240F34AE49634540A8D2413C4"><enum>(II)</enum><text>spouses of active duty members of the Armed Forces;</text></subclause><subclause id="H223DD8D5D94240588473DE49D956AD8B"><enum>(III)</enum><text>veterans; and</text></subclause><subclause id="H1078D28152C2418FB0FDDCA7CB89DFCD"><enum>(IV)</enum><text>spouses of veterans; and</text></subclause></clause><clause id="H86860FAB7DC247578150A4A8B3D1C713"><enum>(v)</enum><text>has a demonstrated record of success in providing assistance with employment services, as indicated by—</text><subclause id="HA127CE7065E54305A82D7580054AE5C8"><enum>(I)</enum><text>the average wages or earnings of people who receive employment services provided by the entity;</text></subclause><subclause id="H7797C055643D48E89A3C625575340E07"><enum>(II)</enum><text>prior completion of Federal grants or contracts;</text></subclause><subclause id="HF763EA900C21428CB84A9B207EA11FDB"><enum>(III)</enum><text>having at least 50 percent of its participants find full-time employment within six months of initially receiving employment services provided by the entity; and</text></subclause><subclause id="H3AF624643E5645219638DC5DFE60BBE5"><enum>(IV)</enum><text>other employment performance indicators, as determined by the Secretary; and</text></subclause></clause></subparagraph><subparagraph id="HDFB6A7C49B44427C81A76191F8B5F481"><enum>(C)</enum><text display-inline="yes-display-inline">seek to enter into contracts with not fewer than five, but not more than ten, private entities under which each such entity is compensated at a rate agreed upon between the Secretary and the entity for each individual who receives employment services provided by the entity; and</text></subparagraph><subparagraph id="H0AD26B8841BD42EA82F866236AA656CD"><enum>(D)</enum><text>conduct such other activities as may be necessary for the delivery of individualized employment counseling and other employment services under this subsection.</text></subparagraph></paragraph><paragraph id="HBD5FE5EA215F4B129AF2B3C42F82DD26" indent="up1"><enum>(3)</enum><text>Not later than October 1 of each year, the Secretary of Labor shall submit to the Committees on Armed Services and the Committees on Veterans’ Affairs of the Senate and House of Representatives a report on the implementation of the program under this subsection, including the employment outcomes for members of the Armed Forces and their spouses who receive employment services under the program.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7B90383206CC481AB0CF6AE3FC61833F"><enum>(2)</enum><header>Effective date</header><text display-inline="yes-display-inline">Subsection (e) of section 1144 of title 10, United States Code, as added by paragraph (1), shall take effect on the date of the enactment of this Act and apply beginning on the date that is 180 days after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="H9947CA9B9E3C467C814B838BBEFA076C"><enum>(m)</enum><header>Pilot program for military spouses</header><paragraph id="H0AF3B3A82A2B44FF8F3FA769798C4853"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall establish a pilot program for spouses of members of the covered Armed Forces who are eligible to receive preseparation counseling under TAP.</text></paragraph><paragraph id="HE31D2761459D46C9A6F26434E79C8DF3"><enum>(2)</enum><header>Voluntary basis</header><text>Participation in the pilot program shall be on a voluntary basis.</text></paragraph><paragraph id="HFC46393D100E46F5AAA1257194D3F9BC"><enum>(3)</enum><header>Curriculum</header><text display-inline="yes-display-inline">The Secretary of Defense, in coordination with the Secretary of Veterans Affairs and the Secretary of Labor, shall establish a curriculum based on TAP for the pilot program. </text></paragraph><paragraph id="HF404DB6A8DE84AE1A962D600C4E3F05B"><enum>(4)</enum><header>Counseling</header><text>Counseling under the pilot program shall—</text><subparagraph id="H9449FC6AE2AD40259EDC0D3623B10029"><enum>(A)</enum><text>be one-on-one;</text></subparagraph><subparagraph id="H506B5AC208284C13AD5BE5A11519D1D1"><enum>(B)</enum><text display-inline="yes-display-inline">be tailored to the participating military spouse;</text></subparagraph><subparagraph id="H51890C5224C64123BBE1F34764868650"><enum>(C)</enum><text display-inline="yes-display-inline">be offered at least once per calendar quarter;</text></subparagraph><subparagraph id="H1012A789E3284202A1120BA5CC484124"><enum>(D)</enum><text display-inline="yes-display-inline">be offered at times including nights and weekends; and</text></subparagraph><subparagraph id="H01B90FEC8A0B477484420A72EF92BE3E"><enum>(E)</enum><text>include at least one hour regarding benefits and assistance available to military families and veterans from each department under the jurisdiction of the Secretaries specified in subparagraph (C).</text></subparagraph></paragraph><paragraph id="H243179E35EBC4DAD86C993B640550247"><enum>(5)</enum><header>Locations</header><text>The Secretary of Defense shall carry out the pilot program at not fewer than four military installations of each of the covered Armed Forces.</text></paragraph><paragraph id="H808451483BFF4CBDB81984383579B4B9"><enum>(6)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than one year before the pilot program terminates, the Secretary of Defense shall submit a report to the regarding the pilot program. Such report shall include elements the Secretary determines appropriate, including whether the pilot program should be made permanent.</text></paragraph><paragraph id="HCB6DA5AD525A429E93A50B0762E91442"><enum>(7)</enum><header>Termination</header><text>The pilot program shall terminate three years after the Secretary of Defense establishes the pilot program.</text></paragraph><paragraph id="H959EF638C2BF4B63842224AD08D9C59F"><enum>(8)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="H185A9614F3E64DD0843F21168017C7DD"><enum>(A)</enum><text>The term <quote>covered Armed Force</quote> means the Army, Navy, Marine Corps, Air Force, or Space Force.</text></subparagraph><subparagraph id="HBFD1EBDD052A4D5A8D9DFD29D2A7A02E"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>TAP</quote> means the Transition Assistance Program under sections 1142 and 1144 of title 10, United States Code.</text></subparagraph></paragraph><paragraph id="HC7C812524BBA4559A912E84132479755"><enum>(9)</enum><header>Reports; tracking system</header><subparagraph id="H4F24E576FAE0406ABD5CB256CE47AAD5"><enum>(A)</enum><header>Annual report on TAP participation</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, and annually thereafter for four years, a report on the Transition Assistance Program. Such report shall include the following elements with regards to the year preceding the date of such report, disaggregated by Armed Force:</text><clause id="HACD4F74E67134D098DC672C8A4FF62E9"><enum>(i)</enum><text display-inline="yes-display-inline">The number of members described in subsection (a)(1)(B)(ii) of section 1142 of title 10, United States Code, as added by subsection (a), who received fewer than five days of preseparation counseling under such section, disaggregated by military installation.</text></clause><clause id="H64710713F9704CA58CF6A0DD85D3036C"><enum>(ii)</enum><text display-inline="yes-display-inline">The average period of time between when a member begins to receive preseparation counseling and the day the member separates, retires, or is discharged.</text></clause><clause id="HB1E2F13844084D26846E440C900E9FF5"><enum>(iii)</enum><text display-inline="yes-display-inline">The number of members who began to receive preseparation counseling and then re-enlisted or agreed to a new period of obligated service.</text></clause><clause id="H99EDC9C5BCDE4413914DB3BF0039757C"><enum>(iv)</enum><text display-inline="yes-display-inline">The number of members who began to receive preseparation counseling and then were deployed.</text></clause><clause id="HBDB1ADDBF9A04F27B6B421CFC0772AFF"><enum>(v)</enum><text display-inline="yes-display-inline">The number of members assigned to each pathway under subsection (c) of such section.</text></clause><clause id="H902084990DCE45DB94506ADE652A3F7F"><enum>(vi)</enum><text display-inline="yes-display-inline">The frequency with which the commander of a military installation received a briefing regarding the Transition Assistance Program.</text></clause></subparagraph><subparagraph id="H4C194168BFDF4DAFAA52B61B2145638D"><enum>(B)</enum><header>Annual report on VSO presentations</header><text display-inline="yes-display-inline">Not less than once each year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives a report—</text><clause id="H6E9A94EB2CC04852A13862B61CA84D6C"><enum>(i)</enum><text display-inline="yes-display-inline">that identifies each veterans service organization that presented under paragraph (21) of section 1142(b) of title 10, United States Code, as added by subsection (h);</text></clause><clause id="H2441AD68F5B04F12A81CD602685FC73A"><enum>(ii)</enum><text>that contains the number of members of the Armed Forces who attended such presentations; and</text></clause><clause id="H428058E89C0C4FCEA40CE389BAF31710"><enum>(iii)</enum><text>that includes any recommendations of the Secretary regarding changes to such presentation or to such paragraph.</text></clause></subparagraph><subparagraph id="HE50DF07772EE49DCAE19A64BB80F85B6"><enum>(C)</enum><header>Tracking of timeliness</header><clause id="H5690340A432D414699053B5F8AD5EF36"><enum>(i)</enum><header>Implementation</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Defense shall implement a system to track how many, and what percentage of, members of the Armed Forces begin to receive preseparation counseling within the time periods established in section 1142 of title 10, United States Code.</text></clause><clause id="H578B9647F65043F3B7DACA0DCEC6603E"><enum>(ii)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, and annually thereafter, the Secretary of Defense shall submit to the Committees on Armed Services, and the Committees on Veterans’ Affairs, of the Senate and House of Representatives, a report on data recorded with such tracking system during the year preceding the date of such report.</text></clause></subparagraph></paragraph></subsection></section><section id="HAA8220E77EB4443CB85C7A57E92D3942"><enum>3.</enum><header>Skillbridge: GAO study</header><subsection id="HA877C1A29F704972A924E43C41E5F180"><enum>(a)</enum><header>Study required</header><text>The Comptroller General of the United States shall conduct a study of the Skillbridge programs under section 1143(e) of title 10, United States Code.</text></subsection><subsection id="HA6C3F47A1B3845ABBD063BA930EC2789"><enum>(b)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than two years after the date of the enactment of this Act, the Comptroller General shall submit to the Committees on Armed Services, and the Committees on Veterans’ Affairs, of the Senate and House of Representatives, a report regarding such study. Such report shall include observations and recommendations of the Comptroller regarding, with respect to members and employers who participate in Skillbridge—</text><paragraph id="HD510F7B3191B42E1A02DE792B2E4E0EF"><enum>(1)</enum><text display-inline="yes-display-inline">differences in criteria for participation between the Armed Forces;</text></paragraph><paragraph id="H77439BA4CC3B4BCF9B2AD88E90826CAF"><enum>(2)</enum><text display-inline="yes-display-inline">other differences in Skillbridge programs between the Armed Forces;</text></paragraph><paragraph id="HBDB992CF929840838F2EC81B3CFC1FFB"><enum>(3)</enum><text display-inline="yes-display-inline">best practices in Skillbridge programs across the Armed Forces, including—</text><subparagraph id="H1F13D506BDBC49729054A5C3F60DE7F0"><enum>(A)</enum><text>the selection of employers; and</text></subparagraph><subparagraph id="H085D9467DBFB46558C97D67F8A62A24C"><enum>(B)</enum><text>the development of contracts; and</text></subparagraph></paragraph><paragraph id="H516FEE5B643945048107924AFCF4D573"><enum>(4)</enum><text display-inline="yes-display-inline">the feasibility of making Skillbridge programs uniform across the Armed Forces.</text></paragraph></subsection></section><section id="H299F1B1B355B4E9C9FEA825ACEC88852" section-type="subsequent-section" display-inline="no-display-inline"><enum>4.</enum><header>Expansion of eligibility for a certain program of job counseling, training, and placement service for veterans</header><subsection id="H94164FCFAE6B4FCAA4498D4F65647FC7"><enum>(a)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 4101 of title 38, United States Code, is amended in paragraph (5)—</text><paragraph id="H21D812AFA56F4BC5A22DF388C8A7467A"><enum>(1)</enum><text>in subparagraph (A), by striking the comma at the end and inserting a semicolon;</text></paragraph><paragraph id="HD610DF7AB5F54940919C8A453E9B2C95"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>power, or</quote> and inserting <quote>power;</quote></text></paragraph><paragraph id="H59AEACD9237B406ABBCA7DEAB426E911"><enum>(3)</enum><text>in subparagraph (C), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HE303AA2D88AC45A3876F97D0E3E0A6BA"><enum>(4)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="USC" id="H648291C377E848FC947E88C83546545B" display-inline="no-display-inline"><subparagraph id="H6BE22166EC9C4303AA4AA5E90B443D04"><enum>(D)</enum><text display-inline="yes-display-inline">a member of the Armed Forces eligible for the Transition Assistance Program under sections 1142 and 1144 of title 10.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF3C075C702AE4AAEA7471BE91119BD55"><enum>(b)</enum><header>Outreach</header><text display-inline="yes-display-inline">Section 4103A(a)(1) of such title is amended—</text><paragraph id="H1025F55C185746AEA2576038437236B3"><enum>(1)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A), by inserting <quote>and certain eligible persons</quote> after <quote>eligible veterans</quote>;</text></paragraph><paragraph id="HC654C046C23845D5A58500FB6131C37A"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (C) as subparagraph (D);
