which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committees on <committee-name committee-id="HAS00">Armed Services</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the removal of abandoned vessels, and for other purposes.</official-title></form><legis-body id="H58AC7214598442809B8766E9B231D7DC"><section id="H6B7EF7E54F5C48D480D290B0CCB9F2B0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abandoned and Derelict Vessel Removal Act of 2024</short-title></quote>.</text></section><section id="H38877D4C0BBE49D08C20BB93F1C00C43"><enum>2.</enum><header>Abandoned and derelict vessels</header><subsection id="H46EA4DD5CDAC43CCBE0883201BC67543"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/47">Chapter 47</external-xref> of title 46, United States Code, is amended—</text><paragraph id="H87C52F688BB54D99848F1113D53E70AA"><enum>(1)</enum><text>in the chapter heading by striking <quote><header-in-text style="USC">BARGES</header-in-text></quote> and inserting <quote><header-in-text style="USC">VESSELS</header-in-text></quote>;</text></paragraph><paragraph id="HBD77921794CA443C9A1329827D2D2B05"><enum>(2)</enum><text>by inserting before section 4701 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idF8991B8A45D5411DAA513F6E808DC8D1"><subchapter id="idfc73acae7d0c4435900633f316e4ac0b"><enum>I</enum><header>BARGES</header></subchapter><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><continuation-text indent="paragraph">and</continuation-text><paragraph id="H1A1574E2AB034265A047FC7CF013E582"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H95037EE0EBFF4342AD19149FC75F7B1D" style="USC"><subchapter id="id3284e1c2b1f741988f47a7d99325338d" style="USC"><enum>II</enum><header>NON-BARGE VESSELS</header><section id="HA8DAB6D21FA1444F85FE9CEC02ACCFFB"><enum>4710.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H296D7990CD6644FF90E16DCD6183C948"><enum>(1)</enum><header>Abandon</header><text>The term <quote>abandon</quote> means to moor, strand, wreck, sink, or leave a covered vessel unattended for longer than 45 days.</text></paragraph><paragraph id="HB02FDF5E8FAF40A8B6B208320A5D70F9"><enum>(2)</enum><header>Covered vessel</header><text>The term <quote>covered vessel</quote> means a vessel that is not a barge to which subchapter I applies.</text></paragraph><paragraph id="H8EB03192E6F947B79F12F42A7E641B47"><enum>(3)</enum><header>Indian tribe</header><text>The term <quote>Indian Tribe</quote> has the meaning given such term in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph></section><section id="HDD8A4FBAE0AD4765A43D03BEF537EB5D"><enum>4711.</enum><header>Abandonment of vessels prohibited</header><subsection id="HCC3D75FCAF374EDD8515DD64B7DFF976"><enum>(a)</enum><header>In general</header><text>An owner or operator of a covered vessel may not abandon such vessel on the navigable waters of the United States.</text></subsection><subsection id="H2D495F07DD8A4ED9A09874650DF0F976"><enum>(b)</enum><header>Determination of abandonment</header><paragraph id="H581064D68DE742DAA7D0CA437A84E0D8"><enum>(1)</enum><header>Notification</header><subparagraph id="HCE642F4F3DBC4344BA76B1D1AEE622F1"><enum>(A)</enum><header>In general</header><text>With respect to a covered vessel that appears to be abandoned, the Commandant of the Coast Guard shall—</text><clause id="H45ABF3E1D0F840E5A312827BA1E0350B"><enum>(i)</enum><text>attempt to identify the owner using the vessel registration number, hull identification number, or any other information that can be reasonably inferred or gathered; and</text></clause><clause id="H9FA4CEE98E9A40358A7762714096CC6E"><enum>(ii)</enum><text>notify such owner—</text><subclause id="H9D9C4C7452884AAA8B4344167CA9FEDD"><enum>(I)</enum><text>of the penalty described in subsection (c); and</text></subclause><subclause id="H233CE656A2314903B202A024E2B01084"><enum>(II)</enum><text>that the vessel will be removed at the expense of the owner if the Commandant determines that the vessel is abandoned and the owner does not remove or account for the vessel.</text></subclause></clause></subparagraph><subparagraph id="H72B9A50AC92B4E5FB6FBF84837EBEDFB"><enum>(B)</enum><header>Form</header><text>The Commandant shall provide the notice required under subparagraph (A)—</text><clause id="H2B402B7ECDC64C48BEA0A221B1C57DF6"><enum>(i)</enum><text>if the owner can be identified, via certified mail or other appropriate forms determined by the Commandant; or</text></clause><clause id="H5CF8349466324B3AB830D07C0704647C"><enum>(ii)</enum><text>if the owner cannot be identified, via an announcement in a local publication and on a website maintained by the Coast Guard.</text></clause></subparagraph></paragraph><paragraph id="HE843D61FE6754CD494E8652AB5C9F5B1"><enum>(2)</enum><header>Determination</header><text>The Commandant shall make a determination not earlier than 45 days after the date on which the Commandant provides the notification required under paragraph (1) of whether a covered vessel described in such paragraph is abandoned.</text></paragraph></subsection><subsection id="H140895EF7D5D47E9852FD194B7AD3C3B"><enum>(c)</enum><header>Penalty</header><paragraph id="HB2DEA8B875004BFC94BC2BB444447467"><enum>(1)</enum><header>In general</header><text>The Commandant may assess a civil penalty of not more than $500 against an owner or operator of a covered vessel determined to be abandoned under subsection (b) for a violation of subsection (a).</text></paragraph><paragraph id="HD0F29E0EF3184880B7FA19210A741E6F"><enum>(2)</enum><header>Liability in rem</header><text>The owner or operator of a covered vessel shall also be liable in rem for a penalty imposed under paragraph (1).</text></paragraph></subsection><subsection id="H8B6B8B77A80A435D8C9F8A17EF4E2073"><enum>(d)</enum><header>Vessels not abandoned</header><text>The Commandant may not determine that a covered vessel is abandoned under this section if—</text><paragraph id="H147D6499047C4AC687DCD8B88E7B7EB6"><enum>(1)</enum><text>such vessel is located at a federally approved or State approved mooring area or anchorage;</text></paragraph><paragraph id="HAE508346E5BB437EAC75AC1963DB87B2"><enum>(2)</enum><text>such vessel is located on private property with the permission of the owner of such property;</text></paragraph><paragraph id="H19E8BB77CF8A4724AC798A8D4DC8CC82"><enum>(3)</enum><text>the owner or operator of such vessel provides a notification to the Commandant that—</text><subparagraph id="HCD9CC0A367744D46AA84B7BB5BFB7A7E"><enum>(A)</enum><text>indicates the location of the vessel;</text></subparagraph><subparagraph id="HA9DA78EAFB8D40F7BC56A063C321F9EC"><enum>(B)</enum><text>indicates that the vessel is not abandoned; and</text></subparagraph><subparagraph id="HCEF518404CF74356A8FB86143DB6ED5C"><enum>(C)</enum><text>contains documentation proving that the vessel is allowed to be in such location; or</text></subparagraph></paragraph><paragraph id="HACE4413B7B9D450795DDD9522F78D671"><enum>(4)</enum><text>the Commandant determines that such an abandonment determination would not be in the public interest.</text></paragraph></subsection></section><section id="H847C339A95C2419C9B6A0168590DB5B4"><enum>4712.</enum><header>Inventory of abandoned vessels</header><subsection id="H3AC64062055645B1BB1CA1CE4D60076A"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Commandant, in consultation with the Administrator of the National Oceanic and Atmospheric Administration and relevant State agencies, shall establish and maintain a national inventory of covered vessels that are abandoned.</text></subsection><subsection id="HA0A72CA18C0546A1ADC76DCA5C3E48CA"><enum>(b)</enum><header>Contents</header><text>The inventory established and maintained under subsection (a) shall include data on each vessel, including geographic information system data related to the location of each such vessel.</text></subsection><subsection id="H0B7C92D260BB46E1AAEFE2CD765126C8"><enum>(c)</enum><header>Publication</header><text>The Commandant shall make the inventory established under subsection (a) publicly available on a website of the Coast Guard.</text></subsection><subsection id="H708053F1E4C84308AC99AF1325F805FC"><enum>(d)</enum><header>Reporting of potentially abandoned vessels</header><text>In carrying out this section, the Commandant shall develop a process by which—</text><paragraph id="H9488CD58761640728CC8234CD7CC37BA"><enum>(1)</enum><text>a State, Indian Tribe, or person may report a covered vessel that may be abandoned to the Commandant for potential inclusion in the inventory established under subsection (a); and</text></paragraph><paragraph id="H63C6E0872A5E41AFABE51961C2101064"><enum>(2)</enum><text>the Commandant shall review any such report and add such vessel to the inventory if the Commandant determines that the reported vessel is abandoned pursuant to section 4711.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HA192674B7C984B128F4FC8026AB770D2"><enum>(b)</enum><header>Rulemaking</header><text>The Secretary of the department in which the Coast Guard is operating, in consultation with the Secretary of the Army, acting through the Chief of Engineers, and the Secretary of Commerce, acting through the Under Secretary for Oceans and Atmosphere, shall issue regulations with respect to the procedures for determining that a vessel is abandoned for the purposes of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/47">chapter 47</external-xref> of title 46, United States Code (as added by this section).</text></subsection><subsection id="H22FE6D3DCA824DB7ACCC075C0529378E"><enum>(c)</enum><header>Conforming amendments</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/47">Chapter 47</external-xref> of title 46, United States Code, is amended—</text><paragraph id="H47F695B637E143FFB8C477DF527F3630"><enum>(1)</enum><text>in section 4701—</text><subparagraph id="H3996F081524D41949E75AEFFD5CFA3C1"><enum>(A)</enum><text>in the matter preceding paragraph (1) by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>; and</text></subparagraph><subparagraph id="HA89AAEA486F145F1936BF2BA43FF4F41"><enum>(B)</enum><text>in paragraph (2) by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>;</text></subparagraph></paragraph><paragraph id="H3DCF176991A840599E51EF9574CB3DF4"><enum>(2)</enum><text>in section 4703 by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>;</text></paragraph><paragraph id="H10094E7E5C824D80AFFCAE4875EED1F1"><enum>(3)</enum><text>in section 4704 by striking <quote>chapter</quote> each place it appears and inserting <quote>subchapter</quote>; and</text></paragraph><paragraph id="HED5F4CF33375422894BA113B3C7828BF"><enum>(4)</enum><text>in section 4705 by striking <quote>chapter</quote> and inserting <quote>subchapter</quote>.</text></paragraph></subsection><subsection id="H45DA12C3A85C42CDA9E5B8DFF86ADB43"><enum>(d)</enum><header>Clerical amendments</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/47">chapter 47</external-xref> of title 46, United States Code, is amended—</text><paragraph id="H0EA64E9789A244AC8833BFA2F5C84908"><enum>(1)</enum><text>by inserting before the item relating to section 4701 the following:</text><quoted-block id="H28674013982F41BF94D01C076F7A2283" style="USC"><toc><toc-entry level="subchapter">Subchapter I—Barges</toc-entry></toc><after-quoted-block>;</after-quoted-block></quoted-block><continuation-text continuation-text-level="paragraph"> and</continuation-text></paragraph><paragraph id="H7AE6F131205342E8B7899551B4BD22A4"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block id="H2F39273F458341EE920D9E18FAA3EB40" style="USC"><toc><toc-entry level="subchapter">Subchapter II—Vessels</toc-entry><toc-entry level="section">4710. Definitions.</toc-entry><toc-entry level="section">4711. Abandonment of vessels prohibited.</toc-entry><toc-entry level="section">4712. Inventory of abandoned vessels.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H2BEBD15D4D3C40B59B89BBA2790B50AD"><enum>3.</enum><header>Oil and hazardous substance removal</header><text display-inline="no-display-inline">The removal and disposal of an abandoned vessel under the direction of an on-scene coordinator appointed under the National Contingency Plan developed under section 311 of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1321">33 U.S.C. 1321</external-xref>) shall be deemed to be a removal action under such section for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/9509">section 9509</external-xref> of the Internal Revenue Code of 1986.</text></section><section id="H09C3E20354514F0C916E24E54FBF6CB0"><enum>4.</enum><header>Uses of oil spill liability trust fund</header><subsection id="H75F27C9740F94C59B6853A873047DCB6"><enum>(a)</enum><header>In general</header><text>Section 1012(a) of the Oil Pollution Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/33/2712">33 U.S.C. 2712(a)</external-xref>) is amended—</text><paragraph id="HC4F41E9454BE4F2AB7D6FA214B976037"><enum>(1)</enum><text>in paragraph (4), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H4B29A1FDA6BD429F886ACF48BE73A403"><enum>(2)</enum><text>in paragraph (5)(D), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HB6758169723240C4B5D07EEA04D32AB8"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H0ECE1A2E858442CF97B1FC0315B0D0BC" style="OLC"><paragraph id="H5776FE9E53354561918AC94983160DDF"><enum>(6)</enum><text>the payment of costs associated with the collection and disposal of an abandoned vessel, including a derelict vessel, by the President if—</text><subparagraph id="H1DA39BD066B6487FB90D7849CDD01AD3"><enum>(A)</enum><text>such collection and disposal is determined to be in the public interest by the Federal Government, a State, or an Indian tribe; and</text></subparagraph><subparagraph id="HA2B5339BABFF4BB9958A293E94AACFA9"><enum>(B)</enum><text>a determination that the vessel is abandoned is made by the Commandant of the Coast Guard in accordance with section 4711 of title 46, United States Code.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HC2A65579BFEA41B2A40429E2AC726C93"><enum>(b)</enum><header>Costs of collection and disposal of abandoned or derelict vessels</header><paragraph id="HE96D14FCBE76494AB3D4143CE256A602"><enum>(1)</enum><header>Cumulative costs</header><text>The cumulative cost for the collection and disposal of abandoned vessels, including derelict vessels, described in section 1012(a)(6) of the Oil Pollution Act of 1990 (as added by subsection (a)) in a calendar year shall be deemed to be a single incident for purposes of <external-xref legal-doc="usc" parsable-cite="usc/26/9509">section 9509</external-xref> of the Internal Revenue Code of 1986.</text></paragraph><paragraph id="H90195BB969C94947834AE070120B0A35"><enum>(2)</enum><header>Liability</header><text>The owner of any abandoned vessel, including a derelict vessel, collected and disposed of using funds from the Oil Spill Liability Trust Fund pursuant to section 1012(a)(6) of the Oil Pollution Act of 1990 (as added by subsection (a)) shall be liable to the United States for the costs of such collection and disposal and such costs shall be deemed to be amounts described in section 9509(b)(2) of the Internal Revenue Code.</text></paragraph></subsection><subsection id="HCBC8A44CC0C44553B10E72AE3C501141"><enum>(c)</enum><header>Conforming amendment</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9509">Section 9509(f)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting before the period at the end <quote>, except with respect to section 1012(a)(6) of the Oil Pollution Act of 1990</quote>.</text></subsection></section><section id="HA60B77A990BE4861A4CE919B0A06FC2A"><enum>5.</enum><header>Requirements for purchasing federally auctioned vessels</header><subsection id="H329A261769FC44A8BE850DFD290E782D"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/571">Chapter 571</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H089C06C764E34975979BF2CA666FE9E1" style="USC"><section id="HAD81524DDE4E44FC86B909CEEBA4E240"><enum>57112.</enum><header>Requirements for purchasing federally auctioned vessels</header><subsection id="H816269FC3DAD4BC0AFC57BEA89D8F934"><enum>(a)</enum><header>In general</header><text>To be eligible to purchase a covered vessel from the Federal Government, a person shall provide proof of—</text><paragraph id="H3EA6078764EE47CEBD21B28D01D8F64F"><enum>(1)</enum><text>liability insurance for the operator of such covered vessel;</text></paragraph><paragraph id="H7D7084B1737B46A38A06C5CFA9E536E1"><enum>(2)</enum><text>proof of financial resources sufficient to cover maintenance costs of such covered vessel; and</text></paragraph><paragraph id="HF2493CF13B15452A8F3B1F10016C53AE"><enum>(3)</enum><text>with respect to a covered vessel requiring documentation under chapter 121, an admiralty bond or stipulation.</text></paragraph></subsection><subsection id="H7A35AF96A846483FAE50A4F5158170F7"><enum>(b)</enum><header>Definition</header><text>In this section, the term <quote>covered vessel</quote> means—</text><paragraph id="H98F11FC737D2407EB566E04E14188CFA"><enum>(1)</enum><text>a government-owned vessel disposed of in accordance with this part and section 548 of title 40;</text></paragraph><paragraph id="H6153AE625D684E4E850B8FAD976FBF73"><enum>(2)</enum><text>a vessel seized or forfeited pursuant to any law, and auctioned by the Federal Government, including a vessel seized or forfeited pursuant to section 7301 or 7302 of the Internal Revenue Code of 1986; and</text></paragraph><paragraph id="HA76B59022AD345A6B3F828077FDED3DE"><enum>(3)</enum><text>a fishing vessel seized or forfeited pursuant to section 310 of the Magnuson-Stevens Fishery Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1860">16 U.S.C. 1860</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDEC5AB96E0204253AEF4AFC3CF8EB640"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/571">chapter 571</external-xref> of title 46, United States Code, is amended by adding at the end the following:</text><quoted-block id="H1B95DA2E27E0479A90AC2F5A8C3A9FD5" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">57112. Requirements for purchasing federally auctioned vessels.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H08FCDF8B9C29477ABFE02E6F707C6F17"><enum>6.</enum><header>Removal of obstructive or abandoned vessels</header><subsection id="HB618923A5B64449AABE8F14FDFB6520C"><enum>(a)</enum><header>In general</header><text>Section 19 of the River and Harbor Act of March 3, 1899 (<external-xref legal-doc="usc" parsable-cite="usc/33/414">33 U.S.C. 414</external-xref>), is amended—</text><paragraph id="HAB1000E526C643B5AC18FD1A5B7C0091"><enum>(1)</enum><text>by striking by striking <quote><header-in-text level="subsection">Sec. 19. </header-in-text> (a) That whenever</quote> and inserting the following:</text><quoted-block id="H55C9EE057B5E42EFBF8D90E12C13A2F7" style="OLC"><section id="H2CC4C9899A424881B029D05CFC014FC5"><enum>19.</enum><header>Vessel removal by secretary of the army</header><subsection id="H75392E66DAFF40B1A739CEE03E5E8A53"><enum>(a)</enum><header>Removal of obstructive vessels</header><paragraph id="H9BE495071A0A47A490B5ACD33F5804E3"><enum>(1)</enum><header>In general</header><text>That whenever</text></paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H11B1C1BED5254B4187D9386A7D4AC91F"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H3FBD7A2A9BC44B0698BD9485CAF69E49"><enum>(A)</enum><text>by striking <quote>described in this section</quote> and inserting <quote>described in this subsection</quote>; and</text></subparagraph><subparagraph id="HEB2DA20F3005498D81104B4C7E4B66B2"><enum>(B)</enum><text>by striking <quote>under subsection (a)</quote> and inserting <quote>under paragraph (1)</quote>;</text></subparagraph></paragraph><paragraph id="HB7176A50E39846478142907951EE02C3"><enum>(3)</enum><text>by striking <quote>(b) The owner</quote> and inserting the following:</text><quoted-block id="HAD91D9D414B54651A524CB61A0FEC525" style="OLC"><paragraph id="H01576336EFCD49809E11B00FAD4973EF"><enum>(2)</enum><header>Liability of owner, lessee, or operator</header><text>The owner</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H3D5CD20374464EF98F035F293FBD5FB5"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block id="H3EBDC8CEE581469EBE50A3D2EF61C115" style="OLC"><subsection id="HC6C515F3F8B840D995D3C2FF7B87A313"><enum>(b)</enum><header>Removal of abandoned vessel</header><paragraph id="H00312FDEFB8E45608A4F28C69705192E"><enum>(1)</enum><header>In general</header><text>The Secretary of the Army is authorized to remove from the waters of the United States any abandoned vessel or any vessel under the control of the United States by reason of seizure or forfeiture pursuant to any law, that does not obstruct the navigation of such waters, if—</text><subparagraph id="HB01DCCE80E0841DE855B9E5FD07F4EC1"><enum>(A)</enum><text>such removal is determined to be in the public interest by the Federal Government, a State, or an Indian tribe; and</text></subparagraph><subparagraph id="H0E7D484D3C1E493981E1CC8A609714B4"><enum>(B)</enum><text>in the case of a vessel that is not under the control of the United States by reason of seizure or forfeiture, the Commandant of the Coast Guard makes a determination that the vessel is abandoned in accordance with section 4711 of title 46, United States Code.</text></subparagraph></paragraph><paragraph id="H87CF2553E68B44C18469898080BBC9C0"><enum>(2)</enum><header>Interagency agreements</header><text>In removing a vessel under this section that is under the control of the United States by reason of seizure or forfeiture, the Secretary shall enter into an interagency agreement with the head of the Federal department, agency, or instrumentality that has control of such vessel.</text></paragraph><paragraph id="H8E31D76FA3C342D49462F7F5818A5161"><enum>(3)</enum><header>Liability</header><text>The owner of any vessel described in paragraph (1) that is not under the control of the United States by reason of seizure or forfeiture shall be liable to the United States for the costs of removal and disposal of such vessel.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H70A6C142C4B14DEB9F0364CE93E959EE"><enum>(b)</enum><header>Conforming amendment</header><text>Section 1115 of the Water Resources Development Act of 1986 (100 Stat. 4235; 102 Stat. 4026) is repealed.</text></subsection></section></legis-body></bill>
