which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit deployment of Federal air marshals to the southern and northern borders of the United States, and for other purposes.</official-title></form><legis-body id="H66B85CF4909A4136A515F95B3D93F59E" style="OLC"><section id="H3927716B68D34D61A9F52FCEBD9380FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No FAMS at the Border Act of 2024</short-title></quote>.</text></section><section id="H58F6EF4A43D345EDB31D3EDA765C6EC7"><enum>2.</enum><header>Prohibition on deployment</header><subsection commented="no" display-inline="no-display-inline" id="H43E79E7A031C4B258DEBE06CB450FFB0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 44917 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H078D02A306DD4475BA3990744EEE1332"><subsection id="HFA956766CCD549B3A2DFF3AD7217F579"><enum>(d)</enum><header>Prohibition on deployment</header><paragraph commented="no" display-inline="no-display-inline" id="H93A7EDF6429241C68EF3D83FAEEFE7F8"><enum>(1)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text><subparagraph commented="no" display-inline="no-display-inline" id="H62FE70A7D4AB4B698C6030624BBBC768"><enum>(A)</enum><header>Alien</header><text display-inline="yes-display-inline">The term <term>alien</term> has the meaning given that term in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H786CD99E72FF40DFB7A1859201700603"><enum>(B)</enum><header>Appropriate congressional committees</header><text display-inline="yes-display-inline">The term <term>appropriate congressional committees</term> means—</text><clause commented="no" display-inline="no-display-inline" id="H03C973129C0A4CE49DE5D26DBD8D8393"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Commerce, Science, and Transportation of the Senate; and </text></clause><clause commented="no" display-inline="no-display-inline" id="HBB3F18C453E74D7DB92C9EED3927F72D"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security of the House of Representatives.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9A286275F7AD45E9B865AE0A203A66E8"><enum>(C)</enum><header>Illegal alien</header><text display-inline="yes-display-inline">The term <term>illegal alien</term> means an alien who has not been admitted (as that term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA73FA2C8A24B4CA5A491A31B1CBAFF95"><enum>(D)</enum><header>Immigrant</header><text display-inline="yes-display-inline">The term <term>immigrant</term> has the meaning given that term in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEC350B5DE5074FA38996111080F04533"><enum>(2)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3) and notwithstanding any other provision of law, including section 103 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1103">8 U.S.C. 1103</external-xref>), Federal air marshals may not be deployed to the southern or northern border of the United States for border security or immigration purposes, including to aid the Department of Homeland Security or any other Federal agency with the processing of illegal aliens, or any other immigrants.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB82C8E19D47A4951B233A4F0894F21CE"><enum>(3)</enum><header>Exceptions</header><subparagraph commented="no" display-inline="no-display-inline" id="HAD06656134BB4A3EB17434D9382BF7A8"><enum>(A)</enum><header>Exception in case of border crisis</header><text display-inline="yes-display-inline">Paragraph (2) shall not apply if the Secretary of Homeland Security—</text><clause commented="no" display-inline="no-display-inline" id="H2869B1164CB94492966B5261D9530072"><enum>(i)</enum><text display-inline="yes-display-inline">determines that a border crisis exists; and</text></clause><clause commented="no" display-inline="no-display-inline" id="HE842253038D84AFE8944EC684B8143EF"><enum>(ii)</enum><text>certifies to the appropriate congressional committees in writing that a border crisis exists.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA9DF114BD6B14D85A0CA57D060D8AE38"><enum>(B)</enum><header>Nondelegation</header><text display-inline="yes-display-inline">The Secretary may not delegate the authority to make a determination or certification described in subparagraph (A).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="H1B2FB065AE9641A7BEB2FC50A266DC09"><enum>(b)</enum><header>Technical amendment</header><text>Section 44917(b) of title 49, United States Code, is amended by striking <quote>Under Secretary</quote> each place it appears and inserting <quote>Administrator</quote>.</text></subsection></section></legis-body></bill>
