which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HBA00">Financial Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to provide guidance to State Medicaid agencies, public housing agencies, Continuums of Care, and housing finance agencies on connecting Medicaid beneficiaries with housing-related services and supports under Medicaid and other housing resources, and for other purposes.</official-title></form><legis-body id="HA77795DBA19148E69D3B237A443B3AD8" style="OLC"><section id="HE599D87333B142548C912EDB4EB71323" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housing Alignment and Coordination of Critical and Effective Supportive health Services Act</short-title></quote> or the <quote><short-title>Housing ACCESS Act</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" id="H9E0F9F3C10934476B007736A705C3B1B"><enum>2.</enum><header>Guidance to States on connecting Medicaid beneficiaries with housing-related services and supports and other housing resources</header><subsection commented="no" display-inline="no-display-inline" id="H80438C55E5DB449587CF1D534848DC86"><enum>(a)</enum><header>In general</header><text>Not later than 12 months after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of Housing and Urban Development and the Secretary of Treasury, shall issue guidance to State Medicaid agencies, public housing agencies, Continuums of Care, and housing finance agencies to connect individuals who are receiving medical assistance under a State Medicaid program to Medicaid housing-related services and supports and other housing resources in an integrated manner. </text></subsection><subsection id="H59B4B12E446A4FF4A62B1642838A911E"><enum>(b)</enum><header>Required information</header><text>The guidance issued pursuant to subsection (a) shall include information on—</text><paragraph id="HFEF1ADD11DB245A88880233FE7D2DEC3"><enum>(1)</enum><text>simplifying health care services for housing and homelessness service providers and simplifying housing support services for health care service providers to understand the respective sectors;</text></paragraph><paragraph id="HD31EA9068C8E401B88C17E31EA931551"><enum>(2)</enum><text>developing a memorandum of understanding between State Medicaid agencies, public housing agencies, Continuums of Care, and housing finance agencies that—</text><subparagraph id="H36F0693FC6C34E92B86CDBB98B9476A1"><enum>(A)</enum><text>coordinates housing-related services and supports provided under a State Medicaid program with other housing resources by aligning—</text><clause id="HBE1EB68DC3E54C00A09D58EC155C9EC2"><enum>(i)</enum><text>eligibility criteria;</text></clause><clause id="H1620A4204DA64ACA80EB598D1B553A23"><enum>(ii)</enum><text>eligibility determination processes; and</text></clause><clause id="H4CBBD54D59F84D9EB33D6D68FC32F4C4"><enum>(iii)</enum><text>outcome measures, including housing stability and health outcomes disaggregated by race;</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4DF839810E5B42AD81D535BA6689ADC0"><enum>(B)</enum><text display-inline="yes-display-inline">encourages providers of housing-related services and supports to seek reimbursement for such services and supports through the State Medicaid program, including by— </text><clause commented="no" display-inline="no-display-inline" id="H0F73BF834F78415E87AA909760295508"><enum>(i)</enum><text display-inline="yes-display-inline">explaining how such providers may receive such reimbursement;</text></clause><clause commented="no" display-inline="no-display-inline" id="H3D8F7B8D82EB4DF9AE15A121D4915588"><enum>(ii)</enum><text display-inline="yes-display-inline">helping such providers understand the eligibility determination process for housing-related services and supports offered under the State Medicaid program; and</text></clause><clause id="H095FFCC98AF14C408AA3AC6970B5593B"><enum>(iii)</enum><text>providing guidance with respect to tracking common outcome measures, including housing stability and health outcomes disaggregated by race; and</text></clause></subparagraph></paragraph><paragraph id="H55D73C31467040FDB4A0AD6F3D176663"><enum>(3)</enum><text>existing authorities under which a State Medicaid program may make Federal funds available to providers of housing-related services and supports to build information technology and financial systems and establish adequate infrastructure and staffing levels to seek Medicaid reimbursement.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H79B0530A6E1E4853A2556DE1545EEE05"><enum>(c)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services, in consultation with the Secretary of Housing and Urban Development and the Secretary of Treasury, shall submit a report to Congress that includes—</text><paragraph commented="no" display-inline="no-display-inline" id="HEA6B3751A6BE4C99B17AB1256A48AFFF"><enum>(1)</enum><text display-inline="yes-display-inline">information on the progress of State Medicaid agencies, public housing agencies, Continuums of Care, and housing finance agencies in aligning eligibility criteria, eligibility determination processes, and outcome tracking;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE203230464FC4E938B481B38FE24EE1B"><enum>(2)</enum><text display-inline="yes-display-inline">information on the adoption by such agencies and Continuums of Care of recommendations made in the guidance issued pursuant to subsection (a); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC5DF43D0F8D4ABD8C2D4835F4D642B3"><enum>(3)</enum><text>feedback from States on such guidance and challenges faced by States in connecting individuals receiving medical assistance under a State Medicaid program with housing-related services and supports and other housing resources.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3BB1D570F8B648DCA042395CBD51426F"><enum>(d)</enum><header display-inline="yes-display-inline">Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="H8C611E7BF3674CCC85D89DA5BCC19AD7"><enum>(1)</enum><header>Continuum of Care</header><text>The term <term>Continuum of Care</term> has the meaning given such term in section 578.3 of title 24, Code of Federal Regulations.</text></paragraph><paragraph id="HEE9371FAE3B342BB9AB15B69690BA490" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>State Medicaid program</header><text>The term <term>State Medicaid program</term> means a State plan for medical assistance under title XIX of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>), and includes any waiver of such a plan. </text></paragraph></subsection></section><section id="HB4266B1F1B854F5D9B40915828FD18D5"><enum>3.</enum><header>National rate study on the cost of housing-related services and supports</header><subsection commented="no" display-inline="no-display-inline" id="H223460EEA0D640E7A2783786F6AA082F"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (referred to in this section as the <term>Secretary</term>) shall conduct a national rate study on the cost of housing-related services and supports to determine appropriate rates for such services and supports that will allow providers of such services and supports to pay living wages, reduce staff turnover, and ensure a maximum case manager-to-client ratio of 1:15 in alignment with the evidence-base for strong supportive housing outcomes. Such study shall include an analysis of reimbursement rates for services provided by certified community behavioral health clinics (as such term is used in section 223 of the Protecting Access to Medicare Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note)) and Federally-qualified health centers (as defined in section 1905(l)(2)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(l)(2)(B)</external-xref>)) that promote integrated care, which may include, but is not limited to, housing-related supports and services, and serve people with complex conditions.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H2F0B94892FA24360BE75EA5861DA4F0F"><enum>(b)</enum><header>Publication</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, the Secretary shall publish the results of the study conducted under this section as guidance to State Medicaid agencies.</text></subsection></section></legis-body></bill>
